  17. 1:08those who have fallen to the traffic and
  18. 1:11a give them a fluid the dear friend the
  19. 1:14conductor just stand up and fight back
  20. 1:26thank you for joining us for another
  21. 1:28episode of speak up I'm Kevin a VAR
  22. 1:30state senator here in New Hampshire I
  23. 1:32represent district 12 and as you know if
  24. 1:37you've been following the program that
  25. 1:38we've been talking about the death
  26. 1:40penalty and a certain legislation that I
  27. 1:43introduced to at least put a pause on
  28. 1:46moving forward with it and maybe
  29. 1:48offering some safety nets I've been a
  30. 1:50pro death penalty person all my life and
  31. 1:52in recent years after certain
  32. 1:55discussions and testimonies of I have a
  33. 1:58great pause to reflect and maybe reverse
  34. 2:03my my decision we've interviewed Randy
  35. 2:07stylo who was on death row for about 12
  36. 2:09years he was wrongfully accused who set
  37. 2:12up and in that 12 years he was waiting
  38. 2:15to be put to death until the by fate by
  39. 2:21miraculous providence he was exonerated
  40. 2:27we've introduced a testimony from
  41. 2:30attorneys who have actually prosecuted
  42. 2:32people and have sentenced them to death
  43. 2:35and one person came on our show and he
  44. 2:38talked about how he possibly put
  45. 2:39somebody to death on death row person
  46. 2:43who's innocent or possibly innocent
  47. 2:47today I have another guest and his name
  48. 2:51is Ray Krone he also was an ex honoree
  49. 2:55and he's here to share his story and I
  50. 2:59hope this helps you in your reflection
  51. 3:01on this whole topic as well it's not
  52. 3:03like there's this huge jump there's
  53. 3:05there people that have actually been
  54. 3:06affected by being wrongfully accused
  55. 3:09unfortunately he being the 100 x honoree
  56. 3:14joins us today so right thank you for
  57. 3:17coming on the show and i appreciate you
  58. 3:19coming here to tell your story you're
  59. 3:20actually coming up to testify on the the
  60. 3:23legislation as well that being
  61. 3:25introduced to propose on things and i
  62. 3:28know it's not a full repeal everybody
  63. 3:30wants to hear that but you know at times
  64. 3:34you have to spoon for you the public and
  65. 3:36and I mean that because if you're set in
  66. 3:39your ways for so long you can't just
  67. 3:41jump ship and change it it's just not
  68. 3:44how things work but it's good to bring
  69. 3:48up the discussion you were on death row
  70. 3:50I know nothing about why you were put
  71. 3:53there well you're right i think it's
  72. 3:56something not just here in New Hampshire
  73. 3:59that it has been reviewed around the
  74. 4:00country that a sort of breaks are being
  75. 4:02put on this speeding to an execution
  76. 4:04speeding the judgment because the number
  77. 4:06of stakes my release in 2002 as number
  78. 4:09one hundred others been fifty more in
  79. 4:11just the last basically 12 years the
  80. 4:14ones we know about as far as my case I
  81. 4:17probably should start out saying on
  82. 4:19first of them from a small country town
  83. 4:21in Pennsylvania a lot of small towns a
  84. 4:23day you're born you already have a
  85. 4:24reputation I went to the same high
  86. 4:26school my grandparents went to st.
  87. 4:28church my great-grandparents went to you
  88. 4:30knew everybody I was into church choir
  89. 4:32was a aqua light I played a pee wee
  90. 4:36football little league baseball was in
  91. 4:38the Boy Scouts graduation I went into
  92. 4:41this in the US Air Force I'd signed up
  93. 4:43for six years active duty my six years
  94. 4:46ended up being out Phoenix Arizona I got
  95. 4:49out I got a job at the post office Mike
  96. 4:50was good i met the love of my life I had
  97. 4:52never been married what money must got
  98. 4:54the post I was mine I joined to the life
  99. 4:56out in Arizona I've still involved in a
  100. 4:59lot of sports and that's where my
  101. 5:00problem arose local owner of a bar that
  102. 5:03I played volleyball for I play darts
  103. 5:05there came in one morning found the
  104. 5:07front door oh and locked at his bar
  105. 5:09thought what's going on here why wasn't
  106. 5:10just secured as he made his way around
  107. 5:12through the bar he found his night
  108. 5:14manager stabbed the death line in a
  109. 5:15puddle blood in the men's bathroom while
  110. 5:17she had all her socks and of course the
  111. 5:19police were called and they initiated
  112. 5:20investigation under the assumption that
  113. 5:22this had to be somebody that knew her so
  114. 5:25it was no robbery no break-in they
  115. 5:27questioned co-workers and one of them
  116. 5:29mentioned my name of all the people one
  117. 5:30of us that if she liked god named Ray
  118. 5:32Krone they came and questioned me during
  119. 5:35that time at one point a three hour
  120. 5:36interrogation they take fingerprints on
  121. 5:38me they take mug shots I'll be saying I
  122. 5:40was her boyfriend I was and I've been
  123. 5:42going to the bar for two months I told
  124. 5:44him that I'd only known as as working
  125. 5:46there at the bar and at one point they
  126. 5:47actually had a piece of styrofoam have
  127. 5:49you bite into it
  128. 5:50I didn't know what was going on there
  129. 5:51was no information fed to me was not in
  130. 5:53the news yet not in the papers
  131. 5:55nevertheless that ended after three
  132. 5:58hours I was taken home I didn't know who
  133. 5:59killed her under why anybody would kill
  134. 6:00her and I was home in bed I have a
  135. 6:01roommate that knows that the next day I
  136. 6:04the detective was there after got done
  137. 6:06delivering my mail at the post office he
  138. 6:07was there a question again so I don't
  139. 6:09think he'd been completely truthful it
  140. 6:10means mr. Cronin you want to cooperate
  141. 6:11don't you know well sure I mean I never
  142. 6:13been in trouble with the law I have no
  143. 6:15reason to mistrust I'm gonna be worried
  144. 6:17I didn't do anything and this time he
  145. 6:19took me down to the police station again
  146. 6:21he pulled out a search warrant and hey
  147. 6:22they took hair samples which they
  148. 6:24actually pull out by the roots from all
  149. 6:26over your body it's not cut with
  150. 6:27scissors he then took a blood sample and
  151. 6:30then they had sent me the dentist's
  152. 6:31chair took cast in my teeth still I
  153. 6:33didn't know what's going been in the
  154. 6:34news now I don't know why they was going
  155. 6:36through with this with me but I
  156. 6:37cooperated the age 35 I was at that time
  157. 6:41again i was taking home and i thought
  158. 6:43that was you know at one point though he
  159. 6:46deemed it when i had got to read your
  160. 6:48search warrant it actually said they had
  161. 6:50three hours to do this and i had a
  162. 6:51broken jaw when I was young 17 this this
  163. 6:54process of my mouth took almost three
  164. 6:56hours and I was really angry upset about
  165. 6:58this the way it was almost accusatory
  166. 6:59was intrusive they and at the end of it
  167. 7:03he went to ask me to accredit said your
  168. 7:05three hours of rough did you have an
  169. 7:06attorney at this point no I night hadn't
  170. 7:08been read to Miranda rights nificant
  171. 7:10that's only on TV actually but I had no
  172. 7:12reason again as I said of worried but I
  173. 7:14was frustrated was a grid's man was this
  174. 7:16me is very aggressive questioning if I
  175. 7:19said you're three hours are up they said
  176. 7:21I'm not going to argue there's other
  177. 7:22ways to handle this and that's when I
  178. 7:24found out the next day what other ways
  179. 7:25to handle this mitt because when I got
  180. 7:27home from the post office that day on
  181. 7:29the December thirty first nineteen
  182. 7:30ninety-one New Year's Eve I stepped out
  183. 7:33of my car and my driveway in my house
  184. 7:35and all sudden her discreet your brakes
  185. 7:36hiss on the doors slamming leftovers
  186. 7:40over man loaded police officer spool
  187. 7:41Riker threw me on the ground arrest me
  188. 7:44for murder kidnapping sexual assault
  189. 7:45camiones death Wow okay so you had a
  190. 7:52cooperating witness where you were and
  191. 7:55they took DNA was that an initial arrest
  192. 7:59based on the DNA no actually it was
  193. 8:02based on bite mark
  194. 8:03they actually had a local medical
  195. 8:05examiner was who was going through some
  196. 8:06training on bike mark identification he
  197. 8:09had noticed the bite mark on the body
  198. 8:10when they got the imprint of my teeth in
  199. 8:13the styrofoam that's when they got the
  200. 8:15search warrant to come back and get his
  201. 8:16teeth actual prints of my teeth they
  202. 8:19compared that said it was imagined that
  203. 8:20some other got the rest Warren I was
  204. 8:22arrested just two days after he found
  205. 8:23Kim's body now as I said I've never been
  206. 8:26in trouble with the law before or
  207. 8:28support of the death penalty I thought
  208. 8:30any minute i'll be released from the
  209. 8:32county jail because they're going to
  210. 8:33find an attending investigation find out
  211. 8:35I had nothing to do with this i don't
  212. 8:36have no boat even though our barely knew
  213. 8:38her and I had a roommate that knows I've
  214. 8:39never left the house nevertheless just
  215. 8:42seven months later I was given a court
  216. 8:44appointed attorney within a few months I
  217. 8:46couldn't possibly afford a hundred
  218. 8:48thousand dollars and even work for the
  219. 8:50post office and owner of my own house
  220. 8:51it's just astronomical amount of money
  221. 8:54it costs but when they pointed this man
  222. 8:57a private attorney I felt good i finally
  223. 8:58get somebody to this would be over with
  224. 9:00they went on the granting $5,000 payment
  225. 9:03who represent me in a capital murder
  226. 9:05case you can't at the forest or
  227. 9:08five thousand dollars which is why i got
  228. 9:10the little three-day trow it was all
  229. 9:12about bite marks the prosecution
  230. 9:14Harriton bite mark expert that who came
  231. 9:16in testified absolutely one hundred
  232. 9:17percent those are my teeth marks in that
  233. 9:19body my defense attorney basically
  234. 9:22really sitting little they actually had
  235. 9:25a police officer excuse me go over and
  236. 9:27talk to my roommate what they call an
  237. 9:29alibi buster said well how do you know
  238. 9:31he was there were you were there when
  239. 9:32the room with no course so you don't
  240. 9:34know it for sure he was there well I
  241. 9:35know he never left well how do you know
  242. 9:36those type of questions and finally they
  243. 9:38said well mr. Duncan wasn't sure if I
  244. 9:40was there or not and eventually just a
  245. 9:42three and half day trowel it took the
  246. 9:44jury three hours to convicting me a
  247. 9:45murder kidnapping and the judgment on
  248. 9:47the sense me to death wow so now you're
  249. 9:53on death row it begs the question let's
  250. 9:58talk about the bite mark mmm what
  251. 10:00happened alright well that's the amazing
  252. 10:01thing again I mean I remember sitting in
  253. 10:04the county jail they're trying to bite
  254. 10:06myself after they first told me what
  255. 10:08what what the evidence was I think
  256. 10:09that's crazy that we every now and then
  257. 10:12we get a piece of fresh fruit
  258. 10:13fresh but it was prude anyway and I try
  259. 10:15to bite in this and I want you to
  260. 10:17understand it's not like when you bite
  261. 10:19into a peanut butter and jelly sandwich
  262. 10:20a nearly perfect little indentation
  263. 10:22there was a couple little red marks here
  264. 10:24there was a couple of red marks there
  265. 10:25this was not a perfect bite mark at
  266. 10:29during trial actually the expert had
  267. 10:32said that some spots were the teeth did
  268. 10:34quite line he taken roll the upper caste
  269. 10:35and the lower caste the teeth and
  270. 10:37explain which teeth numbers these word
  271. 10:39and when my attorney what literally
  272. 10:41questioning would actually well how
  273. 10:42comes that done that well this is skin
  274. 10:44its flesh it's not a good medium for for
  275. 10:46for taking proper prints I'm thinking
  276. 10:48well if it's not a good medium for why
  277. 10:50you made mistakes maybe it's not a good
  278. 10:52medium all civil why you think it's
  279. 10:53matched a match nevertheless I said I
  280. 10:56was not was sentenced to death sitting
  281. 10:59on that prison fortunately for me coming
  282. 11:01from a small town being a 35 year old
  283. 11:03man my my friends the people that knew
  284. 11:05me knew my order my integrity my word
  285. 11:07was good they believed me stuff I'd I
  286. 11:09high school teachers write me and say
  287. 11:11they didn't believe this remember moved
  288. 11:13from school and that gave me the
  289. 11:14strength to survive in a Cell the size
  290. 11:17of most people's bathroom I your heel I
  291. 11:19did it's automatic and in Arizona's most
  292. 11:22states when you get a death sentence
  293. 11:24it's automatic it was a direct appeal to
  294. 11:25the States Supreme Court they just
  295. 11:28reviewed the evidence was it admissible
  296. 11:29was it you know according to the rules
  297. 11:31and in my case actually it turned out I
  298. 11:33have to say my attorney actually did
  299. 11:36something right at one point the day
  300. 11:38before trial the prosecution introduced
  301. 11:40the videotape me by their bite mark
  302. 11:42expert about his expertise and how he
  303. 11:44matched his definitively 290 the trainee
  304. 11:47yeah and then of course I my attorney
  305. 11:51was actually a way could pay attention
  306. 11:53to time he objected said Your Honor I've
  307. 11:55never seen this evidence before you
  308. 11:56can't allow this evidence in the judge
  309. 11:58who was an ex-prosecutor responsible
  310. 12:00half a dozen people already on Arizona's
  311. 12:01death row said no overrule we're going
  312. 12:03to allow this evidence then and then a
  313. 12:05burst of brilliance probably never again
  314. 12:07recreated my attorneys career he
  315. 12:09actually asks for a continuance es for a
  316. 12:1230-day delay so he could review this
  317. 12:14evidence and just says denied we need to
  318. 12:16get this trial rolling and now that was
  319. 12:18just seven months after they found Kim's
  320. 12:19by seven months since my arrest they got
  321. 12:21to get a capital murder case rolling so
  322. 12:23in the Arizona Supreme Court reviewed is
  323. 12:25they recognize it was a validation rules
  324. 12:27discovery as defended you have a right
  325. 12:29to know what I was going to be used
  326. 12:30against you in a timely manner they
  327. 12:32rolled it that this was important
  328. 12:34evidence as the whole case was about a
  329. 12:36bite mark and they actually said without
  330. 12:38this video tape there wasn't even a jury
  331. 12:40submersible case against mr. chrome and
  332. 12:42so it's ordered a new trial and by now
  333. 12:45my family had come and see me busy me on
  334. 12:48death row see me shackled handcuffed to
  335. 12:49a table so I could talk to him on the
  336. 12:51phone through through planks gasps
  337. 12:52people were executed in Arizona at that
  338. 12:54time we knew the state wouldn't could
  339. 12:56kill you guilty or innocent this was
  340. 12:58just the finalization of that sentence
  341. 13:01and my folks more Easterhouse cashed in
  342. 13:05the retirement funds local groups back
  343. 13:07in my small town and church raise money
  344. 13:09and stuff and we still could come near
  345. 13:11the hundred thousand dollars at cost but
  346. 13:13there was an attorney out of Southern
  347. 13:14California heard about this bite mark
  348. 13:16case a snaggletooth killer i was called
  349. 13:18he said that be representative just pay
  350. 13:20the court costs in contrast my second
  351. 13:23trial lasted almost seven weeks over 500
  352. 13:25exhibitors reduce we actually found out
  353. 13:27that way back in nineteen ninety two
  354. 13:28they had taken a swab from her breast
  355. 13:30where this bite mark was now DNA was
  356. 13:32knew they hadn't quite perfected it yet
  357. 13:34but they had done some testing and it
  358. 13:36wasn't me it wasn't my DNA and they did
  359. 13:38not they never done it my attorney had
  360. 13:40actually got all the police reports
  361. 13:41finally turned over ton found out that
  362. 13:43they had done it well then he said well
  363. 13:44we used it all up he found out no you
  364. 13:46actually sent it off to DNA lab in
  365. 13:48Colorado we were finally able to get it
  366. 13:50through quarters that being said what
  367. 13:53was that kind of what was that process I
  368. 13:55mean you it just by your tone it sounds
  369. 13:58like that was like point eating this is
  370. 14:00so no pun intended this is something i
  371. 14:03never ever believed our justice could be
  372. 14:05my I fit 60 and a half years in the
  373. 14:07military I work for the post of this was
  374. 14:08about production proficiency getting the
  375. 14:11job done truth honor integrity serving
  376. 14:13your country I cannot believe this type
  377. 14:15of run around it we were get first
  378. 14:16denied at all then we catch them in a
  379. 14:18lie all that needs up like they lied and
  380. 14:20you had to catch him in the life in
  381. 14:22order for them to turn over things that
  382. 14:23would help exonerate exactly and what
  383. 14:26why do you think they were lying that's
  384. 14:27the thing that scares me is it just a
  385. 14:29win-at-all-costs attitude because
  386. 14:32certainly is not my background I have no
  387. 14:34police record I didn't have speeding
  388. 14:36tickets with the post office you lose
  389. 14:37your driver's license you're done your
  390. 14:38job so that is a good question
  391. 14:41I've never really had answer is is it is
  392. 14:43an arrogance that certain wait and see
  393. 14:46people not understand to the prosecutors
  394. 14:48why are there elected or appointed
  395. 14:49depending on what level they are in a
  396. 14:52DA's office they are the sole desire of
  397. 14:55that life or death it's not a group of
  398. 14:56people way the public allow that one
  399. 14:59person that one individually decide to
  400. 15:00us see content putting this case you
  401. 15:01know who as they are they screen for
  402. 15:03that or they you know what are their
  403. 15:05backgrounds to allow them to continue to
  404. 15:06do this so you've got the you've got the
  405. 15:08material that you needed your attorney
  406. 15:11did and after they finally got that
  407. 15:15information than what it was presented
  408. 15:17at the second trial and I thought could
  409. 15:18finally the tricky out the DNA was
  410. 15:20actually where we got it was tested by
  411. 15:22dr. Blake who who progressed the ability
  412. 15:26to take the smallest amounts of DNA and
  413. 15:28expanded into testable stuff he did to
  414. 15:30test the preeminent DNA doctrine in the
  415. 15:33US and he Allah California said one
  416. 15:35owned Ali one hundred percent there's no
  417. 15:38way that could possibly be my saliva on
  418. 15:40that might work the bite mark that their
  419. 15:41expert says was me was no way it was my
  420. 15:43DNA I thought yeah my family come out
  421. 15:46from Pennsylvania SAT through that trout
  422. 15:47then local newspapers are there yes the
  423. 15:49truths coming out and now the whole case
  424. 15:52is predicated upon the Viper work that I
  425. 15:54made at the time of death and a closing
  426. 15:58arguments that prosecutors stood before
  427. 16:00that jury said you can don't let the
  428. 16:01defense mislead you that's all they've
  429. 16:03been trying to do we know who committed
  430. 16:05this horrible murder he's sitting right
  431. 16:06here in this courtroom and you as a
  432. 16:08jurors responsible to see that justice
  433. 16:10is done for Kim and her family at DNA's
  434. 16:13easy to explain she's a waitress I was
  435. 16:14just transferred there by accident from
  436. 16:16somebody else's bottle glass took three
  437. 16:20three and a half days come back and
  438. 16:21found me guilty again now I can't ever
  439. 16:25describe that the pandemonium when that
  440. 16:27happened I they said guilty and I'm go
  441. 16:29back up that's not what you mean I'm
  442. 16:31looking at the jurors are wiping the
  443. 16:33tears out of their eyes the bail that
  444. 16:34was reading the verdicts voice is
  445. 16:35breaking up he can't already finish at
  446. 16:37my attorneys hanging over my floor
  447. 16:38saying oh my god ray why didn't they see
  448. 16:40the truth I look over the prosecutor
  449. 16:42they're all jumping up down celebrate
  450. 16:43like they want a big ballgame the
  451. 16:45Wrightwood all this is going on and snap
  452. 16:47shots through my mind like
  453. 16:48go back up this can't be possible in
  454. 16:50that I heard the most horrible screaming
  455. 16:52whale right behind me in that courtroom
  456. 16:54was my mom and my sister and turned
  457. 16:56around to see the tears in her eyes mom
  458. 16:57don't cry Amy it's all right my little
  459. 16:59sister's just volunteers and we're just
  460. 17:01doing it to me they were doing it to my
  461. 17:03family never that's what I went for
  462. 17:06sentencing before that judge he had been
  463. 17:08through that seven weeks he'd heard the
  464. 17:09evidence been testified to he said his
  465. 17:12case is going to haunt him for the rest
  466. 17:13of his life that he had lingering
  467. 17:14residual doubt of my guilt so he sends
  468. 17:17me to 25 to life instead then went on to
  469. 17:19add 21 more years for the kidnapping he
  470. 17:21wasn't sure I did he was gonna send me
  471. 17:23back to death row so he gave me a total
  472. 17:2546 years minimum I was 35 when it
  473. 17:28happened on how to live to be 80 12 my
  474. 17:29first chance of ever release are you
  475. 17:33sitting here today so obviously
  476. 17:36something happened and you have that
  477. 17:38tape but you know all these series of
  478. 17:40tape to you have that recording the
  479. 17:42judge actually saying that it's on it's
  480. 17:45actually in the court records on the
  481. 17:47transcripts it is yeah it's going to
  482. 17:49show transcript yep and there was
  483. 17:51nothing he could do or she they actually
  484. 17:54had to power he could overturn the
  485. 17:55conviction he didn't but he could have
  486. 17:57actually recording the law did you see
  487. 17:59so you're obviously sitting here so
  488. 18:01something happened while you're being
  489. 18:05confined again my case goes through the
  490. 18:08peel of course now because it's not a
  491. 18:09death sentence and doesn't go right to
  492. 18:11the state Supreme Court but the appeal
  493. 18:12the court's got it after a few years i'm
  494. 18:14now not on death row in isolation total
  495. 18:16isolation I'm out walking in the you are
  496. 18:18what they called the walls and there are
  497. 18:20prisons are dangerous we've been stabbed
  498. 18:22the number of times there are races they
  499. 18:23are sacred you're not segregated but
  500. 18:26they're there they're certainly uh run
  501. 18:27controlled by gangs and I'm getting
  502. 18:29through there I'm seeing people released
  503. 18:31and from DNA and at first I mixed
  504. 18:33emotions like yeah that could be me one
  505. 18:34taken summons the two and i had a wait a
  506. 18:36minute lot of good DNA did me I family
  507. 18:39unfortunately about 2,000 won a lot of
  508. 18:41states recognized most states all had a
  509. 18:44window frame when to introduce new
  510. 18:46evidence if you didn't bring up new
  511. 18:47evidence in one year two years you could
  512. 18:49never bring it up and they realized
  513. 18:51DNA's with exception this was too
  514. 18:52important to critical
  515. 18:55proving a possible innocence and Arizona
  516. 18:57passed a new law allowing
  517. 18:59post-conviction relief for DNA testing
  518. 19:01and hadn't previously been done we found
  519. 19:03out to the police that her clothing be
  520. 19:05cut off her and thrown into court of the
  521. 19:07men's bathroom we found out the day Sade
  522. 19:09to preserve that we petitioned the
  523. 19:11course do DNA testing that was objected
  524. 19:13to by the prosecutor's office he says
  525. 19:14well at least you would think the
  526. 19:16prosecutor would say hey wait a minute
  527. 19:17let's really get at the truth and find
  528. 19:19the real person just in case let's have
  529. 19:22a little safety Neville Plan B that you
  530. 19:25know what instead of going full-bore
  531. 19:26after is there some incentive to not do
  532. 19:29that I don't know I just can say that's
  533. 19:32not raised the way I was ok did you know
  534. 19:34these people no all right you had no
  535. 19:36relationship before with them at all
  536. 19:38that i didn't just came from the bar
  537. 19:41right but that was it another prosecutor
  538. 19:43another place nobody i have no record
  539. 19:45period so that that is alarming that
  540. 19:48there's another piece of evidence that
  541. 19:50it could have been considered but the
  542. 19:53prosecutor didn't want it submitted
  543. 19:56aren't you entitled to that that's what
  544. 20:00my assumption again as an honest
  545. 20:01law-abiding citizen that has a veteran
  546. 20:04as a postal employee I thought our
  547. 20:06system was meant to work to get to the
  548. 20:08truth not to be afraid of the what the
  549. 20:10truth is they objected the whole way
  550. 20:12argue no there's no reason for that two
  551. 20:14convictions or overwhelming evidence of
  552. 20:16his guilt nevertheless that judge
  553. 20:18ordered is done he went in or on toward
  554. 20:20the Phoenix Police Department's by then
  555. 20:22accredited DNA lab now to do the testing
  556. 20:24and that's what really pounding open the
  557. 20:26doors of course after what I've been
  558. 20:28through the last people I want to touch
  559. 20:29anything this finished Police Department
  560. 20:30but by then they now had a nationwide
  561. 20:33DNA data bank DNA was being stored from
  562. 20:35all over the country in Arizona for
  563. 20:37example that time it was acquired
  564. 20:38anybody convicted of a murder or sexual
  565. 20:40offense i believe from around 96 one how
  566. 20:43did it have a give a blood sample that
  567. 20:44was in that data bank and that was
  568. 20:46interconnected through all that the
  569. 20:47government arabs through a law
  570. 20:50enforcement asia's across the country so
  571. 20:52when they did get that clothing they did
  572. 20:54extract DNA from it from the pants and
  573. 20:55underwear compared it to me it wasn't me
  574. 20:57and wasn't a victim now with that new
  575. 20:59technology they took that DNA sample and
  576. 21:02i had to say you go girl because it is
  577. 21:03lab technician wasn't required by this
  578. 21:05court order
  579. 21:06but she put that DNA sample in the
  580. 21:08national data bank they came back with
  581. 21:10the match match the man it was currently
  582. 21:13serving a ten-year since we're having
  583. 21:15sexually assaulted a child just a few
  584. 21:16weeks after the murder a man it was on
  585. 21:18parole at the time of the murder for
  586. 21:20another sexual offense whose address
  587. 21:22parole address was his mom's house which
  588. 21:24was about four blocks from the bar in
  589. 21:25Phoenix Arizona he was questioned and I
  590. 21:29was subsequently released and mr. he was
  591. 21:33then charged with that crime and took a
  592. 21:36plea bar I've fought him I go to death
  593. 21:38row this man had assaulted women and
  594. 21:39children took a plea bargain and he
  595. 21:41servant license and I'm fine with that
  596. 21:43but that's how I got out of that the
  597. 21:45grace of god without pearl yeah he's
  598. 21:47Surrey license without parole yes he
  599. 21:49will not it will never get out of prison
  600. 21:50so women in this story with the
  601. 21:54prosecutor writing a deep letter of
  602. 21:57apology and I had that I have yet to see
  603. 22:00those things I i think they least in my
  604. 22:02case and again I know there's good
  605. 22:03prosecutors out or it's just one of
  606. 22:05those things in our country you only
  607. 22:06want to have the roll the dice to to be
  608. 22:08as somebody you or your family involved
  609. 22:11in when the prosecutors that maybe
  610. 22:12you're just trying to climb that career
  611. 22:13ladder to get that advancement items if
  612. 22:15you've got a death in the case you don't
  613. 22:16want to lose one of them there will be
  614. 22:17the biggest case you'll have in your
  615. 22:19career but no there's been no apology
  616. 22:20for the Emmys actually responds to a
  617. 22:22couple other exonerations from Arizona's
  618. 22:24death row he has retired from the people
  619. 22:26from the prosecutor's office in Maricopa
  620. 22:28County with a lifetime meritorious Eva's
  621. 22:30award and again I think they talk about
  622. 22:32deterrence so the death penalty view
  623. 22:34what deterrence are just me what he
  624. 22:35terms of this thing up there has to be
  625. 22:37consequences for those types of actions
  626. 22:38and so far very few people in our
  627. 22:40country have ever been held account for
  628. 22:42these wrongful convictions these
  629. 22:43wrongful death sentence how many of his
  630. 22:44death penalty cases we threw there's
  631. 22:48three got people that i know 1 is 0
  632. 22:50actual woman 3 or 3 people that have
  633. 22:53been released of all excited for the
  634. 22:56prosecutor misconduct as far as
  635. 22:57executions i believe there's a couple
  636. 22:59then men have been executed i haven't
  637. 23:02researched that that far deeply actually
  638. 23:04it's one of those things that really
  639. 23:05gets me upset to think about the man all
  640. 23:07those years of what
  641. 23:08me my family and other families for the
  642. 23:10sake of his career so you're gonna be
  643. 23:14telling your story in your testimony and
  644. 23:17if you were to think of any kind of a
  645. 23:19safety now how would what what would you
  646. 23:22say to our justice system say look you
  647. 23:25know what gives how can we change us how
  648. 23:28can lawmakers fix this IIIi think it's
  649. 23:32one of those difficult things that we
  650. 23:34attempted to make cars safer airplanes
  651. 23:37safer a number things safer but there's
  652. 23:39always an element of mechanical element
  653. 23:41that okay we can fix that we can see
  654. 23:43this hits here and touches here and
  655. 23:44connects there and that's where the
  656. 23:46weeks buttons but now we're dealing with
  657. 23:47human nature we got everything from egos
  658. 23:49to abilities to intellect to training
  659. 23:52all those things can't have too much of
  660. 23:56an effect on the wrong predictions the
  661. 23:58one thing we know we can do is keep from
  662. 23:59executed as a person to keep from
  663. 24:01ruining another making another family of
  664. 24:04murder victim so you know it came to me
  665. 24:07the other day as I was thinking about
  666. 24:09this you know there I mentioned this in
  667. 24:11previous interview but you know there's
  668. 24:13a proverb in the Bible you know these
  669. 24:15six things left the Lord hate and I
  670. 24:18don't know I just kept coming back at me
  671. 24:19but the first one is a proud look and if
  672. 24:24you if you're prone to be proud arrogant
  673. 24:29refusing to look at things that may not
  674. 24:33go your way because after all you you
  675. 24:36want to get the bad guy you want that
  676. 24:37that badge on you you got to step aside
  677. 24:40and lower your pride and humble yourself
  678. 24:43because a lot of bad things can happen
  679. 24:45you can shed innocent blood in the
  680. 24:47process of this so that's something to
  681. 24:51consider and it does seem germain as I
  682. 24:54as I contemplate this over and over
  683. 24:57again because lives matter cause big now
  684. 25:01all lives matter feet
  685. 25:04so we look forward to hearing you in
  686. 25:07your testimony tomorrow and we hope that
  687. 25:09you're persuasive your source of with me
  688. 25:11obviously and congratulations obviously
  689. 25:14and thank you that you're going around
  690. 25:16the country and testifying on this
  691. 25:18because you might be saving some lives
  692. 25:20I'd hope so and again it will never take
  693. 25:22away those 10 years I know my family for
  694. 25:25instance by me and they had a choice
  695. 25:26each data gaps that we've done it all
  696. 25:28the emotion with all that we can for him
  697. 25:31we just gotta quit I never had a choice
  698. 25:33in prison but I couldn't get up one
  699. 25:35dates they want to go home now I'm done
  700. 25:36I've done enough this but to get out and
  701. 25:39find something positive to move ahead
  702. 25:42and see if I can just have one person I
  703. 25:43can have one other family understand if
  704. 25:45you are get caught up in the justice
  705. 25:46system there are ways to hopefully
  706. 25:48protect yourself and not be quite as
  707. 25:50naive as me and my family was and
  708. 25:52hopefully on every something as major as
  709. 25:55a murder but each and everyone else may
  710. 25:56have a instance of dealing with the
  711. 26:00justice system and as human beings deal
  712. 26:02with anybody we need to be more fair and
  713. 26:03just about it and certainly not right
  714. 26:06away jump to conclusions that a monster
  715. 26:08we're convicting a monster now we have a
  716. 26:10right to kill him right and you know our
  717. 26:12justice system is there to protect us
  718. 26:14we're not we're not supposed to be
  719. 26:16afraid of it and so anyway with that
  720. 26:19will will undo the interview and I
  721. 26:20really appreciate it and thank you
  722. 26:23you're welcome got a group to me and

  725. 26:28was wrongfully accused and the system
  726. 26:31failed the system failed eventually it
  727. 26:34came through but at what cost so we need
  728. 26:37to consider some more checks and
  729. 26:39balances on those that have this power
  730. 26:41and when people fall through the cracks
  731. 26:44it's
  732. 26:51I really don't have words I I just don't
  733. 26:54I I don't see our system helping the
  734. 26:57people that needs to help I'm hearing
  735. 27:01too many complaints on different levels
  736. 27:04these are death penalty issues heck they
  737. 27:06can t we get Family Court right at times
  738. 27:09we see kids being separated on a regular
  739. 27:11basis on rules that don't make sense and
  740. 27:14now we have people that are being
  741. 27:16sentenced to death and and then are not
  742. 27:18allowed to to bring up evidence that
  743. 27:25exonerates them what's going on so if
