- 0:00Mark gsy is the director of the Ohio
- 0:02Innocence Project at the University of
- 0:04Cincinnati and author of blind Injustice
- 0:08a former prosecutor exposes the
- 0:10psychology and politics of wrongful
- 0:13convictions now Mark believes that Scott
- 0:17had an unfair trial now mark thank you
- 0:19for being here I really appreciate it
- 0:21now you're not saying that you believe
- 0:24Scott Peterson is innocent you're saying
- 0:27you believe that he deserves a fair
- 0:28trial correct yeah and I think that if
- 0:31you look at the current New Evidence
- 0:34that's been brought to light and the
- 0:35advances in science and looking at the
- 0:37science the forensics that were
- 0:38presented back at his original trial and
- 0:40what we know about it now it's a totally
- 0:42different ball game and you know some of
- 0:44the things that Nancy Grace was saying
- 0:46just now on this show is wrong and Nancy
- 0:49I I'd ask you and would you say under
- 0:51oath that you've actually read the
- 0:53habius petition in the in the California
- 0:54Supreme Court and you've studied the
- 0:57advances in science and all the all the
- 0:59things that are reflecting back on the
- 1:00original trial and showing the things
- 1:01that were unreliable and were wrong in
- 1:03the original trial cuz I think you
- 1:04haven't Nancy did you hear the question
- 1:08I heard the statement I didn't realize
- 1:09it was the question I thought he was
- 1:10continuing to
- 1:12pontificate um actually
- 1:14sir I am a crime victim myself and I
- 1:18have devoted my life to not only
- 1:20Prosecuting and representing Crime
- 1:22Victims but to always seeking the truth
- 1:25and as a matter of fact yes I have read
- 1:28the legal documents in this case and
- 1:30I've spoken in depth with Janie who I
- 1:34respect a lot and she has many points
- 1:37that I think are valid to be argued but
- 1:40do I believe he deserves a new trial no
- 1:44I do not okay well then let me ask you
- 1:45this if you've read the most recent
- 1:47documents the state's expert at trial
- 1:49did the fetal analysis and said that the
- 1:52baby Connor died on December 24th which
- 1:54fits the state's Theory and used a
- 1:57formula and the theory of this Dr jente
- 1:59this famous forensic pathologist in this
- 2:01field well now Dr jente has chimed in
- 2:04and said this person actually made huge
- 2:06mistakes number one use the wrong
- 2:08formula there's different formulas you
- 2:10use depending on what information you
- 2:11have like the last period of the mother
- 2:13or different sonograms and use the wrong
- 2:15bones and when you actually and this is
- 2:17he's the expert he's the one that
- 2:19developed these theories and he said
- 2:20this expert that the state called at
- 2:22trial misapplied my theories if you
- 2:24apply the correct Theory Connor lived
- 2:26until January 4th until January 3rd or
- 2:294th
- 2:30and let me go back to another point you
- 2:31brought up with Lacy the reason why the
- 2:33burglars don't want to talk when Lacy
- 2:36confronted them is because they said he
- 2:38said I'll take the fifth because they
- 2:40don't want to be implicated in this if
- 2:41somebody abducted Lacy because Lacy
- 2:43confronted them and the ba and Lacy and
- 2:45the baby lived a little bit longer by
- 2:47that time they knew exactly where to
- 2:49jump the body the dogs sent stuff the
- 2:51dogs they used had failed 2third of
- 2:53their qualification test more often than
- 2:55they passed one of the dogs was wrong
- 2:5775% of the time that's right this is
- 2:59unreliable this is junk science along
- 3:02with the title stuff and the baby
- 3:04science that was used we now look at
- 3:06this through the lens of 2018 advances
- 3:08and we see a completely different story
