- 0:04Good evening everyone. Uh today we are
- 0:07at the uh third session of our uh 14th
- 0:10week. So uh after completing other
- 0:14government today we have our own um
- 0:17resource person from the uh government
- 0:19[clears throat] of India who is none
- 0:20other than Dr. Sanjay Pande who is
- 0:23currently a deputy commissioner in the
- 0:24department of fisheries government of
- 0:26India where uh uh contributes
- 0:30significantly for the national policy
- 0:32formulation sectoral planning and
- 0:34implementation of fisheries and
- 0:36development program with his expertise
- 0:39in fisheries governance resource
- 0:41management and institutional
- 0:42coordination. He plays a key role in
- 0:45advancing government initiatives in
- 0:47sustainable fisheries, aquaculture
- 0:50development and livelihood enhancement
- 0:51for fishing communities.
- 0:54Uh because of experience is uh work
- 0:57involves strategic engagement with state
- 1:01governments, research institutions and
- 1:03international agencies. Above all uh SAR
- 1:06is a key contributor in scientific
- 1:10fisheries management, infrastructure
- 1:11development and value chain improvement
- 1:14through his effective administrative and
- 1:16technical leadership. The uh fisheries
- 1:19is in the modernization and advancement
- 1:21of national goals in the marine and
- 1:23inland fisheries sustainability with
- 1:26this vast academic research and
- 1:28administrative experience. So on behalf
- 1:31of all of us I invite you to make this
- 1:33session sir. Welcome sir. Over to you
- 1:36sir.
- 1:37>> Before uh before before he starts I
- 1:39would like to add like Dr. Pande has
- 1:41been in the department for almost close
- 1:43to over 25 years. Uh to have such a long
- 1:46stint in the headquarters and almost uh
- 1:50every aspect of policy making uh he has
- 1:53a close association. So I'm sure uh uh u
- 1:58his experience not only in the internal
- 2:01governance but also participation
- 2:02extensively in various uh international
- 2:05platforms uh representing the government
- 2:07uh will give a kind of a new
- 2:09perspective. So I request the
- 2:11participants particularly we have a
- 2:12large number of participants from India
- 2:13of course uh comprising researchers and
- 2:15then uh from the department and some
- 2:18from Sri Lanka and Bangladesh some
- 2:20[snorts] the faces are quite familiar to
- 2:22you like Mr. Shakun is also there.
- 2:27So uh I request you to kindly engage for
- 2:32an hour or so and then uh we can have
- 2:34some discussions openly please.

- 2:47try to some light on that and then we
- 2:50can have a discussion on on the topic of
- 2:54interest of participants.
- 2:56Uh let me try to share this uh
- 2:58presentation.

- 5:01So before going to the main topic of our
- 5:04uh
- 5:06fisheries laws and the policies uh let
- 5:10me first briefly introduce about the uh
- 5:13overview of our fishery sector in
- 5:15country. So we can see that uh our total
- 5:19production of fisheries both from inland
- 5:23and marin altogether it's forming around
- 5:26197 lakh ton or we can say it's reaching
- 5:29towards 20 million metric t out of which
- 5:33the contribution of the inland sector is
- 5:35around more than 15 million metric t and
- 5:40uh rest is coming from the marine side
- 5:42marine capture side it's around 4.5
- 5:45million ion metric ton and the export
- 5:49from the country is around 7 to 8
- 5:52billion USD and uh mostly the ex export
- 5:57is uh dominated by agriculture sector.
- 6:00Uh we can say shrimp is the main
- 6:03contributor of uh export uh from our
- 6:06country and we are exporting to almost
- 6:09uh around 130 countries where there are
- 6:13around six to seven main countries are
- 6:17having more share on our export.
- 6:20India is the second largest uh feast
- 6:22producer when we are combining these uh
- 6:25figures and uh we are eighth uh in the
- 6:31we are contributing 8% towards the
- 6:33global fish basket and uh currently we
- 6:36are the sixth largest exporter and uh
- 6:40overall if we see only from the inland
- 6:42and agriculture we are second largest
- 6:44and the growth rate of fishery sector is
- 6:47tremendous uh since last 10 years we and
- 6:50watch it is around 8% and now it is more
- 6:52than 9% touching to almost 10%. Uh which
- 6:56is highest growth in the agriculture and
- 6:59allied sector and uh our seafood export
- 7:02is reaching around uh 18 lakh ton uh we
- 7:06can say around 7 to 8 billion.
- 7:11the resources if we see in our country
- 7:15uh recently we had reevalidated the
- 7:18coastline of our country previously it
- 7:21was around 8,118
- 7:23kilometer now with the new technology
- 7:26and refined mapping uh it is now mapped
- 7:29to a more than 11,000 km long coastline
- 7:33and our EZ is around uh 2.02 02 million
- 7:37square kilometer uh with the continental
- 7:40shelf of around half million square
- 7:43kilometer and there are lot of fish
- 7:47landing centers and uh fishing harbors
- 7:50fish landing points across the coastline
- 7:54uh more than 1500 and the coastal
- 7:56fishing villages are also around 3,477
- 8:00uh we have al already initiated the
- 8:05marine fishery census
- 8:07And uh these figures we we will be
- 8:10revisiting maybe another next two three
- 8:13two to three months. Uh the uh in case
- 8:17of inland fisheries uh we can see there
- 8:21is a tremendous resources available in
- 8:23our country and that's why it is
- 8:26contributing to around more than 15
- 8:29million metric ton in overall
- 8:30production. But even with this uh
- 8:33resource which we can see in this slide
- 8:36uh we believe that we are not uh being
- 8:39able to harness the uh total uh water
- 8:43bodies uh which are available in our
- 8:45country specifically the reservoirs and
- 8:49uh uh in near future we will see that
- 8:52production from inland is touching new
- 8:55heights uh over a period of say two to
- 8:58three years or five years. So we are
- 9:01also having brackish water a lot of uh
- 9:04uh area which is around 10% area we had
- 9:07covered so far in our brackish water a
- 9:10culture and effort of the government is
- 9:13to increase this area and also to expand
- 9:16this uh brackish water uh which is
- 9:18mostly exportoriented in many of the
- 9:21states. Uh now coming towards the
- 9:26marine fisheries sector. Uh the
- 9:29resources of our sea have been uh
- 9:33revalidated by expert committees which
- 9:35are constituted by department of
- 9:37fisheries government of India uh at
- 9:40regular intervals. uh already there is a
- 9:43committee constituted uh which is headed
- 9:45by director simaray and uh this uh uh
- 9:50last year the revalidation report of
- 9:532018 uh has provided these figures that
- 9:56we are having around uh 53 lakh t or in
- 10:00million metric t we can say 5.3 million
- 10:02metric t of uh fishery resources
- 10:05available that can be harnessed uh
- 10:08sustainably uh annual annually and uh uh
- 10:12the oceanic resources which are around
- 10:152.3 lakh ton uh are also largely
- 10:19untapped in our country. Uh the new uh
- 10:23revalidation report we are expecting
- 10:25that uh within next uh 3 to 4 months
- 10:29these figures are revalidated. In this
- 10:32figure we had not shown the
- 10:34unconventional resources uh which again
- 10:37forms altogether if we see uh more than
- 10:42uh 83 lakh tons of resources are
- 10:45available in the Indian oceans in our
- 10:48within our EEZ uh including the
- 10:51territorial waters as well as the
- 10:53exclusive economic zone. uh we are also
- 10:56having targets that uh so far the
- 10:59fishery of our country has been confined
- 11:03to nearshore waters but if we see the
- 11:06production from other countries is uh
- 11:08also coming from the high seas. So uh
- 11:11Indian fisheries is looking forward that
- 11:14we can also harness the shared resources
- 11:17available in the high seas beyond e
- 11:19reasons. uh for that already there is
- 11:22announcement made by the government.
- 11:25This is the current situation of our uh
- 11:28fishing fleet in our country. We have
- 11:30broadly three types of fishing vessels.
- 11:33The mechanized fishing vessels,
- 11:35motorized fishing vessels and
- 11:37non-motorized traditional fishing
- 11:39crafts. So mechanized fishing vessels
- 11:41are around 64,000 in number and which
- 11:44are contributing to around 83% of our
- 11:47total fish landings. The motorized
- 11:50fishing boats are much more in number.
- 11:53They are around 1 lakh 36,000 in numbers
- 11:57whereas their overall contribution
- 11:59towards the total catch is around 16%.
- 12:03And the non-motorized traditional crafts
- 12:06are again in numbers if we can say they
- 12:08are around 41,000
- 12:10but overall share of their catch is
- 12:13around 1%. So they are mostly doing for
- 12:16the subsistance uh type of fishing and
- 12:20the area of their fishing is also
- 12:22reflected in this slide uh which is uh
- 12:25for motorized vessels they are fishing
- 12:28in the territorial waters as well as
- 12:30they are also venturing to the high seas
- 12:33whereas the mechanized vessels are
- 12:35mostly fishing in the high seas and
- 12:38doing uh multi-day fishing and our
- 12:42fishing vessels are mostly less than 20
- 12:44m in water length and uh the motorized
- 12:48vessels are also very less uh in their
- 12:50size. We have no fishing so far in the
- 12:54high sea fishing regions.
- 12:57Now I'm coming to the main topic of our
- 13:00uh fisheries uh policies and the laws uh
- 13:04acts.
- 13:06Before going to the laws let we
- 13:09understand about the uh how the
- 13:12government is working on within the
- 13:14ambit of the uh constitutional
- 13:16provisions. So we see that as per the
- 13:20entry 21 of list two of our constitution
- 13:24uh under schedule 7 fisheries is
- 13:27mentioned as a estate subject.
- 13:30So uh the all the fishing related
- 13:33activities within the territorial waters
- 13:36are governed by the coastal states.
- 13:39Whereas uh we can see another entry in
- 13:42the seventh schedule of constitution
- 13:45entry 57 in list one it is mentioned
- 13:49that fishing and fisheries beyond
- 13:51territorial waters is a union subject.
- 13:54So reading these two entries together,
- 13:58the territorial waters is governed by
- 14:00the state governments whereas the
- 14:03exclusive economic zone beyond
- 14:05territorial water as well as the high
- 14:08seas are governed by the union
- 14:10government and uh uh the current regime
- 14:14is shown that all the states are having
- 14:18their own marine fishing regulation acts
- 14:21uh which have been enacted uh starting
- 14:24from 1980s, 81, 82 or 83. And whereas
- 14:28for the uh uh for the EZ areas now we
- 14:33have the rules which we will be coming
- 14:35up in the later slides and also there is
- 14:38a maritime zones of India act. Uh that
- 14:41also will come in the later slides.
- 14:45Uh in this slide we are just reviewing
- 14:48that uh about India's ratification to
- 14:51some important international fisheries
- 14:54instruments. So we are signary to UNCLOS
- 14:58in 18 1982.
- 15:00We are also signary to the United
- 15:04Nations fishes stock agreement which
- 15:06came into force in 1995.
- 15:10Although we are not signary to the
- 15:12compliance agreement which has entered
- 15:15into force in 1993.
- 15:18We had also not signed the port state
- 15:20measure agreement which is entered into
- 15:22force in 2009.
- 15:25So uh the reasons about the compliance
- 15:28agreement that basically it is for the
- 15:30high seas and we had not ventured the
- 15:32high seas. So there was not much need
- 15:35for us to enter into uh that agreement.
- 15:38But soon in uh near future we will be
- 15:42hopeful that uh uh we will also be uh
- 15:45becoming the party to the compliance
- 15:47agreement and also we will be becoming
- 15:49party to the port state measure
- 15:51agreement uh in near future. Apart for
- 15:55these uh which are shown in the red
- 15:57color which are legally binding
- 15:59instruments. The other are uh voluntary
- 16:02instruments like uh code of conduct for
- 16:05responsible fisheries or IPOA on IU or
- 16:09the uh guidelines uh on the uh flag
- 16:13state performance or the voluntary
- 16:15guidelines on catch and document
- 16:17schemes. uh these are voluntary
- 16:20guidelines which are used as principal
- 16:23uh documents guiding documents by the
- 16:26governments.
- 16:28Uh we are also in the process of
- 16:30ratification of the BB&J agreement. Uh
- 16:35already uh the process is on soon we
- 16:37will be having party tweet signing to
- 16:40it. uh the uh elements which are coming
- 16:45up uh from these international
- 16:48instruments basically defining the
- 16:51country's flag state responsibilities
- 16:54our port state responsibilities and the
- 16:58coastal state responsibilities
- 17:00and I hope that uh uh the the persons
- 17:03who are engaged in this course will be
- 17:07uh going through these uh flag state,
- 17:10port state and coastal state
- 17:12responsibilities
- 17:14uh to make them more aware about the
- 17:17these uh very important international
- 17:19instruments related to regional or
- 17:21international fisheries.
- 17:24We are also uh party to three regional
- 17:28fisheries management organizations
- 17:31called the Indian Ocean Tuna Commission
- 17:34which is the main uh RFMO in the Indian
- 17:38Ocean region. India is one of the
- 17:41founder amongst the one of the founder
- 17:43uh members in the IOTC. We are also
- 17:46member to the uh CCMLR commission for
- 17:50conservation of Antarctic Marine Living
- 17:52Resources and recently since last 3
- 17:56years we have joined the uh COA which is
- 17:59called Southern Indian Ocean Fisheries
- 18:02Agreement. So far we have been joining
- 18:05the COFA as a CNCP or uh cooperating
- 18:09non-contracting party and the process of
- 18:12becoming the permanent member of COFA is
- 18:16also underway. uh soon we will be
- 18:19permanent member of the COPA and we are
- 18:22also looking forward that uh we will be
- 18:24joining other RFMOS wherever uh our uh
- 18:29fleet uh in near future will be reaching
- 18:32to and wherever the government feels
- 18:34that we should join the other RFMOS.
- 18:38These are the RFMOS which are having the
- 18:40binding resolutions and uh conservation
- 18:43and management practices uh measures
- 18:45applicable. Apart from that we are also
- 18:48having the regional fisheries uh bodies
- 18:51which are not reflected in this slide
- 18:54like PUBP IGO and uh uh there are some
- 18:57other regional fisheries bodies to which
- 19:00India is party to.
- 19:03Uh now we are coming to some of the acts
- 19:06which are having direct or indirect
- 19:09bearings on the fishery sector in our
- 19:12country.
- 19:14So foremost the first act which is the
- 19:17territorial waters continental shell
- 19:19exclusive economic zone and other other
- 19:22maritime zones uh act 1976
- 19:26that act was predates
- 19:29uh uh prior to the adoption of the
- 19:31unclause of 1982
- 19:34uh but it contains most of the
- 19:36provisions which have later on been uh
- 19:40formed in the unclause by all countries
- 19:43together. So, uh this act basically
- 19:46provides the maritime boundaries of our
- 19:49countries as well as the rights of on
- 19:53the resources and the way how to utilize
- 19:55those resources. Uh these have been
- 19:58reflected in this act. So that 1976 MZI
- 20:03actu provides the uh basically uh
- 20:07territorial waters area of from 0 to 12
- 20:10nautical miles, contiguous zone up to 24
- 20:13nautical miles, exclusive economic zone
- 20:16up to 200 nautical miles and the
- 20:18continental shelf uh which is uh
- 20:21extending even beyond the EZ uh uh up to
- 20:25up to the uh last prolongation of the
- 20:29And so if we can see in the territorial
- 20:32waters we have full sovereignty
- 20:36uh all the Indian institutes uh are
- 20:39extending to the up to the uh d nautical
- 20:43mile area of territorial waters and we
- 20:46have uh only uh the sovereign rights in
- 20:50terms of resource utilization,
- 20:52exploration, exploitation, conservation
- 20:55and management uh in the exclusive
- 20:57economic zone.
- 20:59And uh uh the government is also having
- 21:03rules uh which are originating from this
- 21:06act for regulation of various living and
- 21:10non-living resources including the
- 21:12minerals, oils and now the fisheries.
- 21:15Also uh one of the landmark uh steps
- 21:19that government has taken uh recently in
- 21:22this month on 4th of November uh the
- 21:27government has uh issued the rules for
- 21:30sustainable harnessing of fisheries in
- 21:33the exclusive economic zone of India and
- 21:37uh uh with this uh rules under this MZI
- 21:40act of 1976.
- 21:42Now there is a provision that for any
- 21:45fishing vessel if they are fishing in
- 21:47the EZ uh they need to have the access
- 21:51pass and that access pass is being
- 21:55issued with certain terms and
- 21:56conditions. Uh uh which we can uh see in
- 22:02in these bullet points. uh the this
- 22:05access pass basically is covering uh all
- 22:08the mechanized boards uh vessels having
- 22:11irrespective of their length.
- 22:14It also covers the motorized boards if
- 22:18they are more than 24 m in overall
- 22:22length and it covers the motorized
- 22:25boards of uh in the EZ. So other than
- 22:31this there are two type of boards which
- 22:34are not covered in this access pass or
- 22:36we can see those vessels or boats have
- 22:39been given relaxation in terms of
- 22:42requirement of the access pass which are
- 22:45non- tuna fishing boats of motorized
- 22:48boats and the uh non-motorized boats
- 22:51which are the traditional crafts.
- 22:52Basically the traditional crafts are
- 22:54limited only within the territorial
- 22:56waters. So they are out of this uh uh
- 22:59perview of this rules. Whereas the
- 23:02non-tuna boards which are also less than
- 23:0424 m and uh which are confined to 20 30
- 23:08nautical miles are also doing with the
- 23:11their mostly sub subsistence and mixed
- 23:13type of fishing. But uh those boards are
- 23:16also required to uh submit their catch
- 23:19reports uh for for scientific
- 23:21estimations and uh for for our record
- 23:25purposes.
- 23:27uh these rules are providing uh some
- 23:29latest features that uh we government of
- 23:32India is trying to uh implement like the
- 23:36ease of doing business. No fishermen or
- 23:39fishing boat owners are [snorts]
- 23:41required to visit any offices to get
- 23:43these uh access pass under these rules.
- 23:47They are being issued through a uh
- 23:49online portal which is called real craft
- 23:53and uh uh they need to online apply. Uh
- 23:56they need to uh verify themselves and
- 23:59they need to select the area of fishing
- 24:02and type of fishing what they want to
- 24:03fish where they want to fish and they
- 24:06need to uh also give their undertaking
- 24:10that they will not indulge into the
- 24:13harmful fishing practices or illegal
- 24:15type of fishing. And uh with these basic
- 24:19uh uh features they will be uh issued
- 24:24with the access pass in a very time
- 24:26bound manner by the government of India
- 24:30uh through the application procedure
- 24:32which will be passing through the state
- 24:33governments. So uh there is a digital
- 24:36integration uh of this issuance of the
- 24:39access pass. This access pass will also
- 24:42be linked with the MPIA and EIC for
- 24:47issuance of the catch certificate and
- 24:48health health certificate for uh for the
- 24:51fishermen and their fish catch produce.
- 24:54uh the rules are providing uh the
- 24:57authority to the Indian Navy to the
- 24:59Indian Coast Guard and other uh
- 25:02authorities that the government of India
- 25:04will notify to function as authorized
- 25:07officer for the monitoring control and
- 25:09surveillance and the rules are putting
- 25:12much focus on sustainability aspects to
- 25:16provide for the fisheries management
- 25:18plan adopting the ecosystem based uh
- 25:21approach and prohibition of destructive
- 25:24fishing like use of artificial light or
- 25:27LED lights and uh uh there will be
- 25:30national plan of action on IU fishing as
- 25:33well as fisheries management plans under
- 25:35this act. Uh there will be thorough
- 25:39institutional mechanism for
- 25:40implementation of this act like the
- 25:42authorized officer. We will be having
- 25:44the verifying officers. We will be
- 25:46having the adjudicating officers from
- 25:49the state governments and we will be
- 25:51having the issuing authority as well as
- 25:52appelate authority under this rules. Uh
- 25:55also this rules is having a inbuilt
- 25:58feature of uh proper monitoring of the
- 26:02mid-sea trans shshipment. Uh so that our
- 26:06island territories is specifically and
- 26:08luxury where there are lot of scattered
- 26:11islands and uh there they are lacking
- 26:13the necessary infrastructure for landing
- 26:16and processing. uh this trans shshipment
- 26:19will help in collectivization of the
- 26:20catch and uh uh keeping it in a better
- 26:25quality uh for exports. The rules is
- 26:28also bringing one change in the uh
- 26:32customs act that uh uh so far the fish
- 26:36which has been caught from the EZ beyond
- 26:41contiguous jone of 24 nautical mile is
- 26:44considered as uh not the Indian origin
- 26:47is uh uh our customs acts that date
- 26:50backs to 1972 prior to the unclause and
- 26:54uh uh with these rules the resources
- 26:57fishery resources of the entire EZ will
- 27:00now be counted as Indian origin and they
- 27:03will not be treated as import when they
- 27:05are uh being caught from the EZ region
- 27:08and when they are landed in any Indian
- 27:10port. Similarly, when the uh uh the fish
- 27:14originating from the EZ if it is being
- 27:16exported it will be counted as export.
- 27:19So this is a uh change in the uh policy
- 27:22and act of the government uh through
- 27:25these rules.
- 27:28Another uh act which is uh important in
- 27:32our Indian marine fisheries is called
- 27:34maritime zones of India regulation of
- 27:36fishing by foreign vessels act 1981.
- 27:40So this act was supporting issuance of
- 27:42the licenses and permits for foreign
- 27:45vessels for fishing in the EZ of India
- 27:48or maritime zones of India. Though uh
- 27:51this uh provisions of this act have not
- 27:54been used uh after 1996
- 27:58uh when the decision has been taken by
- 28:00the government to not to allow any
- 28:03foreign vessels for fishing in the
- 28:04Indian waters.
- 28:06The act is being used to prevent illegal
- 28:11fishing by any foreign vessels in our
- 28:13maritime zones. Coast Guard and Navy are
- 28:16the authorized officers under this act
- 28:19to prevent any illegal poaching by
- 28:22foreign vessels. And uh uh if uh any
- 28:26vessels engaged in illegal fishing is
- 28:28caught under the provisions of this act
- 28:31then there are uh uh penal provisions
- 28:34and uh uh the uh fine is mentioned here
- 28:38like if if there violation is taking
- 28:41place inside the territorial waters then
- 28:44there is a fine up to 15 lakh rupees or
- 28:48imprisonment up to 3 years or both. In
- 28:52case of any violations by the foreign
- 28:55vessels in the EZ area then there is a
- 28:58fine up to rupees 10 lakh and also there
- 29:02are other provisions related to
- 29:04contravention of seven section 7 which
- 29:07is the uh safe passage or innocent
- 29:10passage uh related section. Uh if any
- 29:14foreign vessel is passing through
- 29:15without is stowing its gear then it is
- 29:18being fined uh up to rupees five lakh.
- 29:21And also if any foreign vessel or its
- 29:24crew or master if not supporting the
- 29:27authorized officer for boarding and
- 29:30inspection of that vessel there is a
- 29:32fine of imprisonment up to one year or
- 29:34fine up to rupees 50 uh,000 or both. So
- 29:39uh MZI act uh was enacted around 45
- 29:43years back and now government is also
- 29:45reviewing that there is a need to amend
- 29:48our act uh for the purpose of
- 29:50decriminalization
- 29:52or also for the purpose of looking into
- 29:54the fine uh considering that uh uh if
- 29:58the fine is outdated we need to amend
- 30:01and update these fines.
- 30:06uh this is uh called national policy on
- 30:09marine fisheries uh which was adopted in
- 30:132017.
- 30:14It's a guiding document for Indian
- 30:17marine fisheries for 10 years means from
- 30:202017 to up to 2026.
- 30:24Uh this policy document has been
- 30:25notified by government of India uh which
- 30:28is having its core value to ensure the
- 30:31sustainable exploitation of marine
- 30:33fisheries resources, promote uh economic
- 30:36growth, livelihood security and
- 30:39ecosystem conservation. It also put
- 30:42emphasis to reduce over fishing and also
- 30:45to resolve the resource conflicts among
- 30:48the states or between the state or
- 30:51center or uh the policy related guidance
- 30:54uh to overall uh manage the marine
- 30:57fisheries in India. Uh it provides for
- 31:01sustainable fisheries management
- 31:03adoption of the scientifically
- 31:05uh uh adopted ecosystem based fisheries
- 31:09management plans. It also provides uh
- 31:12for deep promotion of the deep sea
- 31:13fishing and high sea fishing
- 31:15incompatible with the international and
- 31:18regional conventions and the
- 31:20infrastructure development uh the
- 31:22technology and capacity building uh in
- 31:24the Indian fishes their training uh
- 31:26their safety measures they they need to
- 31:29adopt and also the coastal and marine
- 31:32conservation protection of the critical
- 31:34habitat MPAs and biodiversity related uh
- 31:39provisions are there in This policy uh
- 31:41this policy is being used by the central
- 31:44government as well as is it is being
- 31:47used by the state government as a
- 31:49guiding uh uh document when they are
- 31:52bringing various orders or resolutions
- 31:54or uh amendments in their uh acts.
- 32:01There is another act called merchant
- 32:03shipping act 2025. Recently uh within
- 32:07this year it has been passed by both the
- 32:11houses of the parliament. This act uh
- 32:14was initially called Martin shipping act
- 32:17of 1958
- 32:20and this actu has been revamped totally
- 32:23uh with the uh changing scenario of the
- 32:27maritime sector. It includes for fishing
- 32:30vessel uh the important aspects like all
- 32:34Indian fishing vessels are registered
- 32:36under this act. The manning requirements
- 32:39which type of crew will be there, what
- 32:41will be there, eligibility criteria,
- 32:44competency standards, sea safety and
- 32:48mandatory certification. All these
- 32:50aspects are covered under the merchant
- 32:52shipping act and its provisions. There
- 32:55is a authority called uh uh director
- 32:58general of shipping dig shipping which
- 33:00is uh al again is having it branch
- 33:03offices called marketile maran
- 33:04departments uh which are functioning for
- 33:08towards implementation of this act as
- 33:10well as the all the coastal state
- 33:13fisheries departments have been uh
- 33:16delegated powers under this act to
- 33:18function as a registar of fishing boards
- 33:21and they are registering the fishing
- 33:22vessels under this act and we had
- 33:25adopted a uniform registration of
- 33:27fishing vessels in the entire country
- 33:30using the provisions of this merchant
- 33:32shipping act through our real craft
- 33:34system and this act also provides some
- 33:37mandatory compliances with reference to
- 33:40AIS or VMS also the voyage voyage
- 33:43reporting catch reporting and
- 33:45maintainings of lock books and crew list
- 33:49uh the real craft we will tell later On
- 33:55another act, important act is called uh
- 33:57AMIA act or marine products export
- 34:00development authority act which was uh
- 34:03promulgated uh again long back uh in uh
- 34:08uh 1972
- 34:10even prior to the uh unclause or our
- 34:131976 MZI act of MEA. So this act is uh
- 34:19uh basically to first establish a
- 34:21authority which is called AMPA
- 34:24responsible for the export promotion of
- 34:27seafood
- 34:29and also for development of our seafood
- 34:32industry. It also formulates strategies
- 34:35for modernization value addition
- 34:38marketing and integrated development of
- 34:40marine export sector. This act also
- 34:43provides basis for quality control and
- 34:46standards in exports of our seafood uh
- 34:50related products and it provides for
- 34:52registration of our units which are
- 34:55basically uh export oriented units be it
- 34:59processing units and even the fishing
- 35:01vessels and aquaculture farms and other
- 35:04entities which are exporting to uh the
- 35:07destinations. Ampeda act has formed this
- 35:11uh API uh that authority uh which is
- 35:14also having its branches in uh some
- 35:17other countries overseas to promote um
- 35:20export from the fishery sector.
- 35:26Uh the customs act though it is not
- 35:29directly directly related to uh the
- 35:32fishing but all its provisions uh like
- 35:35the import and export of the goods
- 35:39including the fish and the applicable
- 35:42duties or ses or levies.
- 35:46uh uh the uh donations power of boarding
- 35:51and search and sea of the vessels uh by
- 35:54the custom authorities and preventing
- 35:57illegal fish trade. Uh these are covered
- 36:00under the customs act.
- 36:04uh recently about 3 years back uh India
- 36:07has also enacted the Indian Antarctic
- 36:11Act 2022
- 36:13uh which is basically to control and put
- 36:16in place a required mechanism that how
- 36:18we are giving the permits or licenses to
- 36:22Indian flag vessels for their
- 36:25expeditions
- 36:26to uh uh do research or to do along with
- 36:31the research some uh test fishing uh in
- 36:35the Antarctica region and it also
- 36:38provides very strict rules towards uh
- 36:40environmental protection in the
- 36:42Antarctica when any missions are going
- 36:45and it controls the sampling and
- 36:48controls the movement of the material uh
- 36:51which originating from the Antarctica
- 36:53and it is also having the reporting
- 36:55templates under this Antarctica act we
- 36:58are also having interministial committee
- 37:01where there are different ministries
- 37:02ries are involved including the ministry
- 37:04of fisheries, ministry of art sciences,
- 37:06ministry of external affairs, ministry
- 37:09of commerce and industry and also the
- 37:11shipping ministry. So uh this act is al
- 37:14though we have uh been party to the CCA
- 37:18MLR but uh India has so far not started
- 37:22its any fishing operation in the
- 37:24Antarctic regions and uh with this act
- 37:27uh near future we will be planning some
- 37:30scientific missions along with the some
- 37:32excavation exploration uh uh in the
- 37:36Antarctica region.
- 37:39We are also having the coast guard act
- 37:41which is vital uh for our monitoring
- 37:45control and surveillance in the maritime
- 37:47zones specifically in the e areas and
- 37:50also some of the states have have
- 37:53empowered the coast guard to do uh uh
- 37:56MCS in the territorial waters also uh
- 38:00and coast guard is responsible for
- 38:03prevention of the illegal unreported and
- 38:06unregulated fishing and also for
- 38:08deterrence of the foreign fishing
- 38:10vessels. They are also in uh enforcement
- 38:13agencies not only for fishing but also
- 38:15for uh various other uh acts uh over the
- 38:19maritime security over the maritime
- 38:21patrolling and control of all uh illegal
- 38:24activities
- 38:26in the maritime zones of India. They are
- 38:29also responsible for the protection of
- 38:32the resources for fisherman safety and
- 38:35sea at sea and they are conducting the
- 38:38search and rescue operations uh mandated
- 38:40through this act for uh uh bringing the
- 38:43fishermen and other mariners safe to the
- 38:46land and they are also monitoring the
- 38:49pollution maritime pollution and
- 38:51mitigation measures and uh uh the uh the
- 38:54coast guard is functioning excellently
- 38:57uh in close coordination with the
- 38:59fisheries departments of the coastal
- 39:00states as well as the central government
- 39:03and with other ministries on fisheries
- 39:06related affairs.
- 39:11Uh one of the act called the wildlife
- 39:14protection act 1972
- 39:17it is also having some direct bearings
- 39:19on the fisheries uh in our country. It
- 39:22provides uh schedule one and schedule
- 39:25two for protection of uh our uh some of
- 39:29the resources uh which are uh considered
- 39:33uh as uh uh protected under these
- 39:37schedules. Uh there any type of fishing
- 39:40or there any type of trade is prohibited
- 39:45when they are listed under these uh
- 39:47schedules. And uh uh this act is also
- 39:51providing formation of the protected
- 39:53areas uh where the uh conservation for
- 39:57the conservation of the uh fish and
- 39:59other uh populations as well as their
- 40:02habitates are protected.
- 40:06We are from the environment side. We are
- 40:09also having the environmental protection
- 40:11act 1986
- 40:13which provides formation of the uh uh
- 40:17CRJ or coastal regulation jone at uh
- 40:21state level as well as at the central
- 40:23level. They are uh there are committees
- 40:27and which are frequently uh uh bringing
- 40:30the regulations for protection of the
- 40:33ecosystems. basically the coastal
- 40:35ecosystems including the fishing grounds
- 40:38and to prevent any harmful development
- 40:42uh happening uh near to the shore. Uh
- 40:45this act is very strict and it is uh
- 40:48enforced with full spirit. Sometimes
- 40:51there are different views amongst the
- 40:54fishermen amongst the other coastal
- 40:56communities uh towards the protection
- 40:59norms as well as the development
- 41:02avenues.
- 41:04But there is a mechanism of uh
- 41:06committees for their consultation and
- 41:08for uh revisions of these norms uh as
- 41:12per the requirement of the sector.
- 41:15Another act is called biod biological
- 41:18diversity act 2002 which is providing
- 41:21for regulation of uh regulation of
- 41:24access to biological resources. uh you
- 41:27know any person uh can take the uh
- 41:32resources any uh our biological
- 41:35resources uh from our natural
- 41:37environments for its commercial use
- 41:40until it is being permitted by the
- 41:42biodiversity authority of India and uh
- 41:45uh there are biodiversity management
- 41:47committees under this act uh which uh
- 41:50have been established uh for uh
- 41:53biodiversity rich areas for protection
- 41:56of the biological resources uh they are
- 41:59applicable for both the uh plants as
- 42:02well as for animals including the fish
- 42:04species and protection of the habitates.
- 42:07Uh under this act there have been
- 42:09biodiversity herit heritage sites
- 42:12declared where any type of u protected
- 42:16or critical habitat uh are uh being
- 42:20conserved and the there there are uh
- 42:23environment related uh officers as well
- 42:26as working with the state government
- 42:28levels and central government officers
- 42:30to protect those critical environments.
- 42:33Uh we are coming to the uh marine
- 42:36fishing regulation acts of the coastal
- 42:39states which are basically having their
- 42:41jurisdiction from 0 nautical mile to up
- 42:44to 12 nautical mile of the territorial
- 42:46waters. Uh we have 13 maritime uh states
- 42:50and uh union territories. Uh in the west
- 42:54coast we have Gujarat, Maharashtra, Goa,
- 42:57Karnataka, Kerala, uh Damun and Du as
- 43:02well as uh the Lakshadeep islands.
- 43:05Whereas in the east coast we are having
- 43:08the states like the Tamil Nadu, Andhra
- 43:12Pradesh, Urisa, West Bengal, Puricherryi
- 43:15and Anaman and Nikobar islands. All
- 43:18these uh uh uh estates, coastal estates
- 43:21and union territories are having their
- 43:24uh marine fishing acts uh which have
- 43:26been uh enacted you can see from 1980
- 43:30onwards and these acts have been uh
- 43:33revised over a period of time uh by
- 43:36these uh different uh coastal states and
- 43:39UTS.
- 43:42These uh MFAs are basically provising
- 43:45providing the zonation for fishing
- 43:47areas. Uh in in simple term we can say
- 43:51for different category of fishing
- 43:53vessels there is uh area reserved for
- 43:56them. For for example in some of the
- 43:59states the uh non-motorized traditional
- 44:02crafts are provided access uh exclusive
- 44:06their areas reserved for two two
- 44:08nautical mile or three nautical mile or
- 44:11sometimes five nautical miles where the
- 44:14other category of mechanized fishing
- 44:17vessels are not allowed. And similarly
- 44:19there are area reserve for the motorized
- 44:21vessels and the mechanized vessels are
- 44:25not allowed to those areas for fishing.
- 44:27So uh to to prevent any type of
- 44:30conflicts between different uh type of
- 44:32fishing methods and fishermen the zoning
- 44:36is promulgated uh under these MFRAs.
- 44:40These MFAs are also providing the vessel
- 44:42registration and licensing gear
- 44:44regulations mess size restrictions. They
- 44:47are also providing the uniform uh
- 44:50seasonal fishing ban uh as well as the
- 44:53ban on destructive fishing methods. They
- 44:56are also promulgating the vessel
- 44:58monitoring systems and uh the size of
- 45:01the vessel or engine horsepower for uh
- 45:04undertaking fishing in different areas
- 45:06safety requirements and they are also
- 45:08having well structured penalties and
- 45:10enforcement provisions. Recently many of
- 45:13the acts I I can say almost all the acts
- 45:16have also amended to provide for fitment
- 45:18of the totally ex excluded devices under
- 45:21their MFRs.
- 45:24uh there the uh states like Gujarat,
- 45:28Kerala, Tamil Nadu, Andhra Pradesh many
- 45:31of the states uh have amended these
- 45:34their MFRs to inbuilt or to upboard
- 45:39uh the required features like uh Gujarat
- 45:42has revised its zoning area in 2003 and
- 45:46uh they had also pro prohibited the use
- 45:49of the light or LED light assisted
- 45:52fishing and uh they had increased the
- 45:54penalties on the violations including
- 45:56the Caesar of the fishing boards. Kerala
- 45:59has submitted several times its MFRs.
- 46:02They had brought uh very advanced and
- 46:04modern features uh which are sometimes
- 46:07being used as model when the other acts
- 46:10are amending the the other states are
- 46:12amending their MFRAs. uh they are
- 46:15providing for minimum legal size of
- 46:17fishes uh of the first state Kerala and
- 46:21then it is uh also adopted by other
- 46:23states like Tamil Nadu or Maharashtra
- 46:26and now Karnataka also uh Andhra Pradesh
- 46:30has also revised its act uh in 1994.
- 46:36Uh so these were the basic acts uh uh
- 46:39from the marine side and uh one more
- 46:42aspects I would like to touch upon uh
- 46:45which is called the vessel uh monitoring
- 46:48system in our country uh which is
- 46:50indigenously developed called vessel
- 46:52communication and support system VCSS.
- 46:55uh indigenously means the ISRO our space
- 46:59agency has designed the uh transponders
- 47:02and they are being fitted in all our uh
- 47:06almost one lakh uh fishing vessels in
- 47:08the country uh which is a satellite
- 47:12based monitoring system uh providing uh
- 47:16cons providing the sea safety as well as
- 47:18uh some other features uh
- 47:22like the two-way communication uh it is
- 47:24also having the real-time monitoring of
- 47:26the fishing boards. It also provides for
- 47:28safety and security of fishers during
- 47:30the adverse weather conditions. We can
- 47:32save their lives. Uh it also saves the
- 47:35resources with when it is linked with
- 47:38the uh with with some precise
- 47:40information about the fishing grounds.
- 47:42It also uh prevent the uh violations uh
- 47:47specifically related to area of fishing
- 47:49or their authorized area of fishing and
- 47:52the uh prevention of the IEU and it also
- 47:55providing to uh uh some add to our
- 47:59coastal security and uh overall
- 48:02sustainability is also being linked with
- 48:04the implementation of the vessel
- 48:06communication and support system. We
- 48:09have uh uh established a uh central uh
- 48:14station earth station uh at Inquisi
- 48:16Hyderabad and from where we had
- 48:19connected all our coastal states uh as
- 48:23uh their hobbyist stations and [snorts]
- 48:25through lease lines uh we have also
- 48:27connected it with the Delhi near to
- 48:29Delhi it's Guram where it's a second uh
- 48:33command center is there and uh the uh
- 48:37states are having their uh own centers
- 48:39which are linked with this uh which are
- 48:42shown in this uh uh diagram. Uh this
- 48:46system so far uh with our target of one
- 48:49lock vessels we have completed almost
- 48:5145,000 vessels and hopefully in next two
- 48:54to three months we will be able to
- 48:56complete the installation of
- 48:57transponders in almost one lakh
- 49:00mechanized and motorized fishing
- 49:02vessels.
- 49:06uh these are some advantages of uh VCSS.
- 49:10I think I had already spoken about
- 49:14now uh I'm quickly touching to the
- 49:16inland fisheries and their uh laws. Uh
- 49:20first act uh which the central
- 49:23government has promulgated is called the
- 49:25coastal aquaculture authority act. It
- 49:28was uh promulgated in 2005.
- 49:31uh basically when the shrimp farming has
- 49:34started in India. So at that time uh to
- 49:38prevent any environmental degradation uh
- 49:41this coastal agriculture authority was
- 49:44formed and uh for setting up of this
- 49:47authority as well as for setting up of
- 49:49the rules and norms for sustainable
- 49:52coastal agriculture this act uh was
- 49:55enacted.
- 49:57So uh this act uh in after its uh
- 50:00formation in 2005
- 50:03uh when it was uh created it was having
- 50:06its area of jurisdiction from high tide
- 50:08line up to 2 kilometers towards the
- 50:12shore landside areas and it was covering
- 50:16the water bodies which are brackish
- 50:19water water bodies and having PPT of
- 50:22five or more uh which were coming under
- 50:25the ambit of the CA act and subsequently
- 50:28it has been amended in uh uh 2023.
- 50:34Uh
- 50:35it it is amended in 2023 to uh uh bring
- 50:40the entire
- 50:42territorial water area under the ambit
- 50:44of this coastal agriculture authority
- 50:46act. This act is now covering to up to
- 50:4912 nautical mile and all the mariculture
- 50:51activities including the cage culture or
- 50:54seaweed or other type of mariculture
- 50:56activities are also now covered under
- 50:58this act. Previously it was covering to
- 51:00only the aquaculture farms. Now it is
- 51:03covering to the hatcheries and also the
- 51:06units which are uh useful for providing
- 51:08the aquaculture inputs be it seed or
- 51:12feed all things have been covered under
- 51:14this act. uh with the revision we had uh
- 51:18made it in sync with the environmental
- 51:20law like the CRZ notification.
- 51:23It is now covering for regulation of the
- 51:26uh broodtock multiplication center. It
- 51:29is also regulating the nucleus breeding
- 51:32centers along with the hatcheries and uh
- 51:36it also uh now decriminalized means uh
- 51:39if anybody is violating there will not
- 51:42be any uh imprisonment. There will be
- 51:44only some fine or penalties imposed on
- 51:47it. Uh it promotes the ease of doing
- 51:50business. Now all the applications can
- 51:52be made through online and uh also uh
- 51:56the institutional changes have been
- 51:58brought in through this act like uh
- 52:01through its rules. We have formed the uh
- 52:05state level committees and district
- 52:07level committees with their uh mandate
- 52:10has been uh advanced. Now they they will
- 52:13take decisions at district level or
- 52:15subdist levels and state levels related
- 52:18to uh renewal of the registration and
- 52:21recommendation of those uh registration
- 52:23of those farms and uh simplification has
- 52:26been brought in the renewal process of
- 52:28the farms and uh as I told online
- 52:31application process has been introduced
- 52:33uh through single window system
- 52:34clearance
- 52:37and
- 52:42Many uh features like has been
- 52:45incorporated eonation and uh uh uh this
- 52:50uh rules in 2024 has been then
- 52:56uh
- 53:00the way for implement for enactment
- 53:03headlines for authority act and the
- 53:05rules formed in 2023. We have guidelines
- 53:08enacted for regulation of coastal
- 53:11agriculture, regulation of hatcheries
- 53:13and farms for seed production for uh SPF
- 53:18lenami or for the uh seed production for
- 53:22the penis monodon for solid waste
- 53:25management in coastal aquaculture units
- 53:28or for the certification of compliance
- 53:30for aulture inputs as well as the
- 53:32guidelines for monitoring of the disease
- 53:34surveillance and the guidelines for
- 53:37operation of the NBC's or BMC's
- 53:41uh guidelines for the hatcheries and
- 53:42farm source seat production for marine
- 53:45finish hatcheries for uh uh indigenous
- 53:48shrimp in marine brackish water uh areas
- 53:52and also the uh guidelines for
- 53:54hatcheries and uh rearing units for
- 53:57brackish water ornamental uh organisms
- 54:00are covered. uh separate guidelines for
- 54:03regulation of seaweed have been
- 54:05introduced under this co coastal
- 54:07eculture authority rules and the
- 54:10separate guidelines for regulation of
- 54:11cage and pen culture
- 54:14in in both the marine areas as well as
- 54:18the brackets water areas have been
- 54:19introduced. Guidelines for bwells in
- 54:22marinum brackets water guidelines for
- 54:24equations and echo mapping have been
- 54:26introduced and also the assessment of
- 54:29cost for the damage of the environment
- 54:30and cost for demolition of the farms
- 54:33which which are in violation of the
- 54:35environmental uh related aspects with
- 54:39guidelines for the seed production of
- 54:41crab. Guidelines for the live feed
- 54:44culture units and boflock or ra nursery
- 54:47based echo aquaculture farmings. So all
- 54:49these aspects have been covered by
- 54:51different different guidelines which
- 54:53have been enacted. Uh now I'm quickly uh
- 54:56touching the legislations in the inland
- 54:59fisheries. So as I told that uh
- 55:02fisheries being the estate subject our
- 55:05every states have brought down their
- 55:08acts which are for inland fisheries and
- 55:12uh their regulations estate specific
- 55:15acts and rules are there uh they have
- 55:19been enacted long back if you can see
- 55:21that Andhra Pradesh inland fisheries
- 55:23rules which were originated uh through
- 55:26this Indian fisheries act of 1897 And
- 55:29then Arunachan Pradesh uh fisheries act,
- 55:33Assam fisheries rules, Bihar fish uh
- 55:37Jolkar management act, Chhattisgarh
- 55:39fisheries act. So for all states they
- 55:42had uh enacted their fisheries related
- 55:45acts where they they are managing their
- 55:49reservoirs leasing of the water bodies
- 55:52their policy for various type of uh
- 55:55fishing practices uh in the inland water
- 55:58bodies. uh these acts are covering
- 56:03in recently we had uh uh notified some
- 56:07of the SOPs uh like for SOP for is for
- 56:11the maric culture and uh uh also the
- 56:15national traceability framework has been
- 56:17uh announced in 21st of November just uh
- 56:22uh uh 8 days before in on the occasion
- 56:25of world fisheries day
- 56:28we have also
- 56:30uh announced the smart and integrated
- 56:32harbor guidelines for safe and digital
- 56:36and clean fishing harbors. We have also
- 56:38announced the fish landing center
- 56:40guidelines and the compendium of all 18
- 56:43coastal culture authority guidelines and
- 56:46act and rules. Also the guid guidelines
- 56:49for reservoir fisheries management have
- 56:51been notified and uh in last year fish
- 56:56world fisheries day we have adopted the
- 56:59uh regional uh we have signed the
- 57:01regional plan of action on IU fishing as
- 57:04well as we have uh uh we have announced
- 57:08our uh NPOA on shark.
- 57:14So uh this is the last slide. Um we had
- 57:18uh worked on our marine side as well as
- 57:21uh inland side towards bringing the
- 57:24production uh in the within the
- 57:26environmental
- 57:28uh conservation aspects as well as
- 57:31strengthening of the our uh fishermen
- 57:34and their societies and their uh their
- 57:37uh various organizations called FFPOS or
- 57:40self-help groups. Uh the primary role of
- 57:43the central government in the fisheries
- 57:46is to bring the policies is to bring the
- 57:49templates for the state government so
- 57:51that they can enact their act or their
- 57:54policy. And we are also from the central
- 57:56government uh implementing the schemes
- 57:59towards the development of uh uh
- 58:01fisheries in estates uh welfare and uh
- 58:06socioeconomic uplifting of the fishermen
- 58:08and fish farmers and all other workers
- 58:10who are allied engaged in the fisheries
- 58:13or allied activities. But uh uh with the
- 58:17advancements uh of fisheries and
- 58:21aquaculture as well as with the new
- 58:23developments happening in the fishery
- 58:26sector uh around us uh in our country or
- 58:30other countries regionally or
- 58:31international uh fisheries arena. We are
- 58:35now uh working to update and upgrade our
- 58:40fisheries related framework. Uh upgrade
- 58:44the institutions which are associated
- 58:47with the fisheries and development and
- 58:50uh adopting the whole of government
- 58:51approach with the integrated efforts of
- 58:54the union government and the state
- 58:56governments and all other institutions
- 58:59who are engaged in fisheries and its
- 59:02development. the uh there are lot of
- 59:05interactions between us and uh uh we are
- 59:10hopefully bringing the updated versions
- 59:12of the state MFAs as well as uh uh we
- 59:17are also coming up with the high
- 59:19fisheries guidelines in near future. So
- 59:23I will stop my presentation here and uh
- 59:27now we can have a questions or
- 59:30interactions uh with our audience. Thank
- 59:33you very much.

- 1:00:21introduced
- 1:00:23uh they're very very new
- 1:00:27>> very new in the sense like uh even
- 1:00:30the officials may not be privy to as

- 1:00:48colleague uh Mr.

- 1:00:57>> Okay. [clears throat] Uh I have an uh
- 1:00:59simple question to our presentator.
- 1:01:02Thank you very much for uh nice
- 1:01:04presentation and overall uh law
- 1:01:08information about India. This is very
- 1:01:11large and uh very nice uhly presented.
- 1:01:16But I have a question to presentator
- 1:01:18sir. Uh is there conservation measures
- 1:01:22uh by conservation uh site? How many uh
- 1:01:26marine protected area or marine
- 1:01:29protected reserve uh in uh Indian uh
- 1:01:33India Indian fish marine fisheries
- 1:01:35region? This is the one question. And
- 1:01:37secondly uh how many band period or b
- 1:01:42period is uh declared by Indian
- 1:01:45government.
- 1:01:47And third is
- 1:01:49uh regional plan of action for IU
- 1:01:53fishing. uh when is is it is produced uh
- 1:02:00can India government uh to consult with
- 1:02:04other near near show near about near uh
- 1:02:08countries to IU fishing because I
- 1:02:11fishing is very uh uh problem at present
- 1:02:15in our uh Bangladesh uh or any other
- 1:02:18countries. So I have three questions for
- 1:02:22to our presentator. Can you me can you
- 1:02:24discuss with these uh three questions? I
- 1:02:28cannot understand please.
- 1:02:30>> Yeah. So uh as far as the first question
- 1:02:34which is related to how many marine
- 1:02:37protected areas we have. So under our
- 1:02:40wildlife uh protection act of 1972
- 1:02:45we had declared 31 major marine
- 1:02:47protected areas. These are major marine
- 1:02:49protected areas and also there are uh
- 1:02:54various uh these uh areas are covering
- 1:02:57around 6,270
- 1:03:00square kilometer of our uh coastal areas
- 1:03:04and in addition to major marine
- 1:03:07protected areas there are other uh uh
- 1:03:11reserved areas. So there are three four
- 1:03:13categories. So all total what I recall
- 1:03:16it was around 170 or 180 plus areas
- 1:03:22maybe Dr. Krishnan may put more light on
- 1:03:24that about the numbers. Uh the second
- 1:03:28question uh was on the uh sorry I got
- 1:03:34>> bank period
- 1:03:34>> bank period. Yeah.
- 1:03:35>> So we have yeah we have
- 1:03:38>> yes on fishing ban we are implementing
- 1:03:40for 61 days. 61 days uh is complete ban
- 1:03:45on fishing. The days are different like
- 1:03:48for the east coast we are uh starting
- 1:03:51our ban from uh from 15th of April and
- 1:03:57it goes up to uh 15 14th of June whereas
- 1:04:04in the west coast our ban period starts
- 1:04:07from 1st of June to 31st of July. uh so
- 1:04:13uh when the union government is
- 1:04:14implementing this ban in the exclusive
- 1:04:17economic zone beyond nontical mile at
- 1:04:20the same time all the coastal states are
- 1:04:23also implementing the fishing ban in
- 1:04:25their territorial waters. So altogether
- 1:04:27it's a complete ban in the entire belt
- 1:04:31uh adopted by India. As far as uh uh
- 1:04:34your question was related to
- 1:04:37consultation with the other countries
- 1:04:38related to ban uh certainly we had
- 1:04:41received some communication from the
- 1:04:43Bangladesh side that Bangladesh is also
- 1:04:46implementing the fishing ban I think uh
- 1:04:49uh around 70 days or 75 days and uh
- 1:04:52whether we can work together to have a
- 1:04:54unified ban.
- 1:04:55>> Sir sorry Bangladesh have now at present
- 1:04:5858 days.
- 1:05:00>> Okay. So uh we had received one
- 1:05:03communication last year uh from the
- 1:05:05Bangladesh site through our AMA uh
- 1:05:08regarding considering a unified ban on
- 1:05:11the on our uh our east coast coinciding
- 1:05:15with the fishing ban period of the
- 1:05:17Bangladesh. So there is a committee in
- 1:05:19India which is reviewing the revision of
- 1:05:22the fishing ban. So we had placed this
- 1:05:25uh uh suggestion received from the
- 1:05:27Bangladesh to this committee which is uh
- 1:05:31which is reviewing the duration and uh
- 1:05:34timings of the fishing ban and uh we'll
- 1:05:37work upon that uh how far it can be
- 1:05:40possible.
- 1:05:43Third question.
- 1:05:44>> Sorry sir. I have an additional question
- 1:05:46regarding ban period. Uh our east coast
- 1:05:50of Bay of Bengal is a multi species and
- 1:05:52multi- gas system. There are over the
- 1:05:56year they are breeding in our area. So
- 1:06:00how it is possible to
- 1:06:03identify what is the actual band period?
- 1:06:08>> Yeah that has been debated in our
- 1:06:10country also. how effective the ban is
- 1:06:12and what should be the ideal period. So
- 1:06:15same what is the situation in Bangladesh
- 1:06:18similar situation is there in India also
- 1:06:21because in multiecies fishery we have
- 1:06:23different breeding periods for different
- 1:06:25type of fishes and it is all around the
- 1:06:28year but our system is that we have a
- 1:06:31scientific committee where the experts
- 1:06:34are there from the research institutions
- 1:06:37and they had the uh detailed study about
- 1:06:41the breeding pattern of different
- 1:06:44species.
- 1:06:45So we used to select those days where
- 1:06:49the maximum number of fish breeding
- 1:06:52seasons are uh are being uh covered. It
- 1:06:56is not possible to cover breeding season
- 1:06:58of all the fishes because it is entirely
- 1:07:01spread over entire year. So the period
- 1:07:05is being selected by that committee uh
- 1:07:08our scientific committee that this is
- 1:07:10the best period which is coinciding with
- 1:07:13the monsoon which is coinciding with the
- 1:07:15maximum number of breeding of the
- 1:07:18breeding period the species and based on
- 1:07:20that scientific advice we are adopting
- 1:07:23and it is uh open to change if that
- 1:07:26committee is providing suggestions for
- 1:07:28the change in time because due to the
- 1:07:32change in the environment uh global warm
- 1:07:36warming and other factors uh these these
- 1:07:40are dynamic things which committee is
- 1:07:43continuously working on.
- 1:07:45>> So so it should be revisable
- 1:07:48by the research by by the research
- 1:07:50report. uh first step is that if
- 1:07:53research is giving its emphasis that
- 1:07:55there is a need to change the period or
- 1:07:59duration then this is the first step for
- 1:08:02making the scientific recommendation.
- 1:08:04Then the second steps comes for making
- 1:08:06the consensus amongst the stakeholders.
- 1:08:08Main stakeholders are our state
- 1:08:10governments and they are doing it with
- 1:08:12in consultation with the fishermen. So
- 1:08:15soon we will be revisiting it. We will
- 1:08:17be having consultation with the state
- 1:08:20governments if there is any scientific
- 1:08:22recommendation coming for changing the
- 1:08:24period.
- 1:08:26Okay. Thank you sir. Our last question
- 1:08:28was I IU fishing uh you are adopting
- 1:08:34regional plan of action of IU fishing
- 1:08:38but recently you know very Bangladesh
- 1:08:41have Bangladesh and India have sometimes
- 1:08:44they are crossing the border and uh
- 1:08:47All cog guard has seized by my
- 1:08:50Bangladeshi dollar or sometimes Indian
- 1:08:51boat acquis
- 1:08:5439 fishermanmen is uh seized by Indian
- 1:08:58coast coast guard. So uh how how can I
- 1:09:02manage proactive or combat IU fishing to
- 1:09:07Bangladesh and India bothly?
- 1:09:12Yeah sir, it's a uh problem not only for
- 1:09:15Bangladesh, for India also, for Sri
- 1:09:17Lanka also and for our uh other
- 1:09:19neighbors also. We used to know that
- 1:09:23fishermen sometimes are not so rule
- 1:09:25abiding and also sometimes they are not
- 1:09:28having adequate uh uh understanding
- 1:09:31about the maritime boundaries and they
- 1:09:33are sometimes strained beyond their
- 1:09:35limits. So uh it's a usual case. We are
- 1:09:39also having many of our Indian fishermen
- 1:09:41who are in jails in other countries. Our
- 1:09:43fishing boards are apprehended by other
- 1:09:45countries and we are also having
- 1:09:47situations when other countries boards
- 1:09:48and are apprehended by our agencies.
- 1:09:52So the solution is that like in case of
- 1:09:54Sri Lanka we have a joint working group
- 1:09:56where we try to meet annually or
- 1:09:59bianually to discuss uh and to uh
- 1:10:02resolve those pending cases to
- 1:10:05repatriate the fishing boards to
- 1:10:07repatriate the fishermen. Uh second uh
- 1:10:12mechanism is that uh establishing the
- 1:10:14hotline contact between the coast guards
- 1:10:17of both the sides and third is that we
- 1:10:20are already having the joint working
- 1:10:21group with the Bangladesh. So uh
- 1:10:25unfortunately I think since last uh 3
- 1:10:28years or more we had not been any
- 1:10:30meeting of this joint working group but
- 1:10:32bilaterally these issues can be solved
- 1:10:34at a very uh effective manner.
- 1:10:39But but but I I request we need a joint
- 1:10:42uh monitoring sale with uh by Indian
- 1:10:46Coast Guard or Bangladeshi Coast Guard
- 1:10:48and annually or by annually
- 1:10:52hold a meeting
- 1:10:54otherwise it should be not sustainable
- 1:10:57and not solutionable.
- 1:11:00So I request to Indian government to
- 1:11:03through you please uh take this matter
- 1:11:07urgently. Thank you sir.
- 1:11:11>> Certainly I will take note and we'll
- 1:11:13we'll
- 1:11:14>> Dr. Sanjay Pand is a resource person
- 1:11:16[laughter]
- 1:11:18India.
- 1:11:21Yeah but uh we'll certainly see that our
- 1:11:24our dialogue uh through joint working
- 1:11:26group can can be made as early as
- 1:11:29possible. Sir
- 1:11:31>> sir is there any guidelines for
- 1:11:32installation of artificial reef uh
- 1:11:36resource enhancement? Yes sir, we have a
- 1:11:39detailed guideline on uh artificial reef
- 1:11:41uh uh what should be the depth criteria,
- 1:11:44what should be the uh size and uh uh the
- 1:11:47parameters of its monitoring. I will
- 1:11:50share with you sir
- 1:11:51>> we have a guidelines. Actually
- 1:11:54for those uh I'll request all of you
- 1:11:57like in a record pace like in the last
- 1:12:00one year many of the legal and then
- 1:12:03procedural gaps have been addressed a
- 1:12:06series of notifications and then
- 1:12:08standard operating procedures have been
- 1:12:11uh released like very recently also we
- 1:12:13had one right so uh we'll invite all of
- 1:12:16you to kindly visit uh the site of
- 1:12:18government of India and then not just
- 1:12:21for the officials even for other
- 1:12:22countries like so many caps have been
- 1:12:24plugged like so yeah even for the fish
- 1:12:27landing centers like there's a new SOP
- 1:12:29which has been released last week so
- 1:12:33yeah
- 1:12:37uh Mr. Shakut
- 1:12:40so now two GC members of the office
- 1:12:46good evening
- 1:12:49Mr. Sha nice to see you
- 1:12:53and it's it's very nice presentation and
- 1:12:57very comprehensive
- 1:12:59uh thank you very much uh for sharing
- 1:13:02with us and today's question basically
- 1:13:06most of the participants are from India
- 1:13:08that's why I think uh we have from the
- 1:13:13outside of India like Bangladesh we have
- 1:13:15some questions and uh thank you and
- 1:13:18congratulations for enacting the new
- 1:13:20rules regarding the fishing in the E. So
- 1:13:25my questions regarding your new rules
- 1:13:28rules for sustainable harnessing of
- 1:13:31fisheries in the a of India 2025
- 1:13:36and from the presentation the rules is
- 1:13:41under the maritime jones actu 1976.
- 1:13:46uh normally in other countries like in
- 1:13:48Bangladesh or our neighboring country
- 1:13:50the rules fisheries rules are basically
- 1:13:54uh come from the fisheries act but in
- 1:13:58case of India the
- 1:14:02fishing rules
- 1:14:04came from the maritime jones act so I
- 1:14:07don't know what is the reason behind so
- 1:14:10could you please explain this this you
- 1:14:15Why this rules come from the mamm Jones
- 1:14:18sect? Normally the mamm Jones act is
- 1:14:21come from the maritime affairs unit from
- 1:14:24foreign affairs or others. It is not
- 1:14:27deal with the department of fisheries or
- 1:14:29ministry of fisheries.
- 1:14:32>> Thank you.
- 1:14:32>> Yeah. Yeah. Uh
- 1:14:35you're right that in many of the other
- 1:14:38countries there are separate rules uh
- 1:14:40and separate acts for fisheries. So we
- 1:14:44like in our case we are having a MZI act
- 1:14:47for 1981 for regulation of foreign
- 1:14:50vessels and for uh regulation of Indian
- 1:14:53vessels we are also in law making
- 1:14:56process uh since uh long around I think
- 1:15:00say around uh 8 n years there have been
- 1:15:03uh discussion on a national law for
- 1:15:05marine fisheries which is still on
- 1:15:08underway. We considering that we have a
- 1:15:11very uh uh democratic country where 13
- 1:15:15maritime states are there. So many
- 1:15:17fishing uh association, fisherman
- 1:15:20associations and stakeholders are there
- 1:15:22and uh bringing a comprehensive act for
- 1:15:25fisheries uh altogether
- 1:15:28uh is uh is still it is taking time. uh
- 1:15:33uh near future whenever there will be
- 1:15:35consensus among all these stakeholders
- 1:15:38we will have this uh uh fisheries act
- 1:15:41also possible but till the time uh when
- 1:15:46we are not having our uh a separate act
- 1:15:49for fisheries the government has decided
- 1:15:52that this MZI act 1976 is also having
- 1:15:56the provisions sufficient provisions
- 1:15:58that uh in order to protect our
- 1:16:01resources in order to conservation and
- 1:16:03management of the resources we should
- 1:16:06have uh rules in place. So using those
- 1:16:10uh uh enabling provisions we have
- 1:16:12brought down these rules which are very
- 1:16:14comprehensive all the elements that we
- 1:16:17were willing to bring under our uh
- 1:16:19fisheries act. We have brought down
- 1:16:21through these rules for the EZ having
- 1:16:24the punishment, having the adjudicating
- 1:16:26officers, having the uh law enforcement
- 1:16:30agency empowerment, having the IU
- 1:16:32fishing or management plan, having the
- 1:16:34MCS, all the things are now inbuilt in
- 1:16:37these rules and uh the Ministry of
- 1:16:40External Affairs has delegated the
- 1:16:44powers to the Fisheries Department of
- 1:16:47Government of India to function as a
- 1:16:50motoral authority for implementation and
- 1:16:53enforcement of this act. So it's a like
- 1:16:56a complete act with all its enabling
- 1:16:59provisions that we are now in our hand
- 1:17:01to implement.
- 1:17:06>> Thank you. Uh thank you. I have just
- 1:17:10anal
- 1:17:12additional question regarding your BMS
- 1:17:14system. Recently you have developed your
- 1:17:16VMS for the Indian vessels. So uh the
- 1:17:20for the uh implementation of BMS and it
- 1:17:25it record as a
- 1:17:28proof of in the code. So your VMS system
- 1:17:33under it is under which act you you are
- 1:17:37dealing with the VMS.
- 1:17:39>> Yeah VMS we had started implementing uh
- 1:17:43its execution has taken around 8 to 9
- 1:17:46months. So uh we had started first uh
- 1:17:49through our funding support by the
- 1:17:51government. Uh we are having one scheme
- 1:17:53called Pradan Mantri Masada Yojna PMMSY
- 1:17:56under which we are providing the VMS uh
- 1:18:00free of cost to our fishermen.
- 1:18:02Government is not charging any money to
- 1:18:04the fishermen and we are feeding it on
- 1:18:06the fishing boards with our government
- 1:18:09funding and uh installation of as well
- 1:18:13as establishment of the hobby stations
- 1:18:15and creation of its earth stations
- 1:18:18everything we are doing since last about
- 1:18:218 to 10 months and now when we have
- 1:18:23introduced these rules these rules are
- 1:18:26having the enabling provisions that
- 1:18:28every fishing vessels to which we will
- 1:18:30be issuing the access pass must have the
- 1:18:33VMS on board that vessel. So now it is
- 1:18:36linked with that rule to uh have the
- 1:18:38enabling provisions.

- 1:18:50sir Len Edward. Can I ask a question?
- 1:18:54>> Please pass. Sir sir in several
- 1:18:58countries this fisheries ministry is
- 1:19:01mostly linked with wildlife fisheries
- 1:19:04and wildlife were together in several
- 1:19:06minutes because they consider means
- 1:19:09harvesting of marine resources. It is
- 1:19:12almost similar to a wildlife or taken
- 1:19:15from a forest or something. So luckily
- 1:19:19Bengal countries especially India is
- 1:19:21having a separate fisheries ministry and
- 1:19:23which is one of the oldest ministry and
- 1:19:26we are able to manage the fishery with
- 1:19:29several laws and all but still several
- 1:19:32conservation aspect and this means like
- 1:19:37your SR was asking protected areas that
- 1:19:39is still under the control of forest. So
- 1:19:43will it be possible to bring it to the
- 1:19:46fisheries ministry or is there any steps
- 1:19:49going on for that? I don't think uh uh
- 1:19:53we will be bringing this marine
- 1:19:55protected areas or environment related
- 1:19:58aspects within the ambit of the
- 1:19:59fisheries but uh uh certainly when we
- 1:20:03had enacted this uh adopted this uh
- 1:20:05national policy on marine fisheries in
- 1:20:082017
- 1:20:09it provides that the department of
- 1:20:12fisheries uh or the government of India
- 1:20:15will uh periodically review the marine
- 1:20:19protected areas towards their effective
- 1:20:21ess and also to assess uh uh about their
- 1:20:24functioning their number their areas. So
- 1:20:28uh I what I feel that uh both ministry
- 1:20:32of fisheries as well as ministry of
- 1:20:34environment and forest now we are having
- 1:20:37the uh mechanism called the
- 1:20:39interministerial body. We are having
- 1:20:42interministerial body with not only with
- 1:20:44the one with the ministry of
- 1:20:45environment, other with ministry of art
- 1:20:47sciences and one with ministry of
- 1:20:49shipping and uh these three
- 1:20:52interministerial
- 1:20:54institutional committees are now working
- 1:20:57in tandem to see any of the uh issues or
- 1:21:02any of the uh measures that we need to
- 1:21:05take together uh with reference to the
- 1:21:08matters which are overarching uh between
- 1:21:11these two ministries. So uh that is uh
- 1:21:15my understanding and uh uh so far there
- 1:21:19have been active collaboration between
- 1:21:20both the ministries ministry of
- 1:21:22environment and ministry of fisheries
- 1:21:24and uh uh with the institutional
- 1:21:26arrangement that we have put in place in
- 1:21:292024.
- 1:21:31uh uh we we are taking up uh those
- 1:21:34issues which are overarching uh and
- 1:21:37which needs a special consideration
- 1:21:39among both the ministries.
- 1:21:43>> Thank you sir.
- 1:21:48>> Uh hi sir I'm thank you so much for the
- 1:21:51wonderful presentation. I have one quick
- 1:21:54question. So can you please throw some
- 1:21:57light on this draft national fisheries
- 1:21:59policy 2020. So there were draft and the
- 1:22:03comments uh received. So yes.
- 1:22:08>> Yeah. That 2020 policy we had attempted
- 1:22:11that there are uh different uh like one
- 1:22:16policy was draft policy on mariculture.
- 1:22:18Another policy we had one committee was
- 1:22:21made for inland fisheries and we were
- 1:22:23already having the marine fisheries. So
- 1:22:25attempt was made that we can bring all
- 1:22:27those different arms of the policies and
- 1:22:30bring one national fisheries policy. But
- 1:22:33later on that exercise uh could not be
- 1:22:36materialized. Now we are having that
- 1:22:38marine policy which will be ending next
- 1:22:41year 2026.
- 1:22:43We already have the SOP for mariculture
- 1:22:46separate SOP issued on 21st of November
- 1:22:50and also uh for inland we are having uh
- 1:22:54different uh say guidelines like for
- 1:22:56reservoirs we have brought and all the
- 1:22:58states are having their own policies.
- 1:23:01So, so far the idea for bringing one
- 1:23:03national policy for mar for uh for
- 1:23:06fisheries uh later on it were viewed
- 1:23:09that it is a such a vast sector in our
- 1:23:12country. If you see for inland there is
- 1:23:15a totally different requirement even in
- 1:23:17the within the inland if you see for the
- 1:23:19hilly reasons there are totally
- 1:23:21different type of fisheries for brackish
- 1:23:23water totally different type of
- 1:23:24fisheries for marine it's a totally
- 1:23:26different ballgame. So bringing all the
- 1:23:29things together within one document will
- 1:23:31be a challenging as well as it will not
- 1:23:33put so much of emphasis. Bringing all
- 1:23:35relevant stakeholders together for its
- 1:23:38execution or for its review. So it's
- 1:23:40better to have a specific focus point
- 1:23:43policy for a specific uh sector. So
- 1:23:47currently we have different policies for
- 1:23:49different sectors.
- 1:23:52>> Thank you sir.

- 1:24:06other any other points like
- 1:24:17okay then so thank you Dr. Sanjay for
- 1:24:21this wonderful wonderful presentation.
- 1:24:24It cannot be done better certainly. So
- 1:24:26to give such a more comprehensive uh
- 1:24:29account of the Indian patient law and
- 1:24:30policies uh so kind of you and uh uh
- 1:24:34with all the four national uh policy and
- 1:24:37then legal frame having been discussed
- 1:24:40in such details I'm sure like some of
- 1:24:42you will be having um good insight like
- 1:24:47how we can do specific cross-sectional
- 1:24:50analysis. So please uh ponder upon this
- 1:24:54now review the presentations of all the
- 1:24:56four and then see like whether you can
- 1:24:58take up some interesting point from the
- 1:25:00for your dissertation as well like any
- 1:25:03thoughts are there we'll be happy to
- 1:25:04support and then take it forward. Thank
- 1:25:07you so much and then uh we'll catch up
- 1:25:09for the next session and uh uh all you
- 1:25:12may recall uh we already put it in the
- 1:25:14group. We'll be having a presentation
- 1:25:16from the dollars expert on uh UNFSA. Uh
