4:50stories um well I mean I love Victory
4:54stories um because it's awful for
4:56someone to sit in prison for something
4:59they did not do
5:02um
5:06but
5:07um I was hoping that Christine could
5:10come
5:11on and tell her story herself but
5:19um I thought we had it set up a couple
5:24of times but
5:27um she was just not able to work it out
5:31um she's she is super
5:33busy um she works for I had that pulled
5:38up I'm sorry give me just a second guys
5:49um she's an executive director
5:53at Justice for just us and I'll explain
5:57what that is she's an administrative
5:59assistant at Northwestern
6:02University
6:04um
6:06and she did work at Illinois Innocence
6:12Project now
6:16Justice for just us
6:19is um a program
6:23that they started her and some other
6:26people started here some sponsors in
6:28Indiana because Indiana doesn't
6:31have
6:32um the Innocence
6:35Project um or at the
6:40time I know that she made a video that I
6:43saw so they made that
6:47um and they made it for exonorees for
6:50when they're out of prison because like
6:52she said when she walked out of there
6:54she didn't have anything she had her
6:56family
6:58but there wasn't even anybody to help
7:00her make a resume or you know
7:04so um they help people when they get out
7:07you know with clothes they help them
7:10make resumees they just help them start
7:13over so she is a really busy person so
7:17I'm going to try to tell her story the
7:19best I can tonight um so let me see have

7:52weather has been a damper on that for us
7:56for a couple
7:57weeks so I think I've got it everybody I
8:00don't think I missed anybody I hope not
8:02if I did yell at

8:08so I'm going to read a little bit
8:12um from
8:19this um it's right
8:21from excuse me it's right from um
8:25Northwestern School of Law Center on
8:27wrongful convictions
8:34um bear with me guys because my throat
8:36gets
8:39itchy so she was convicted of murder By
8:42arson but the fire was
8:46accidental
8:50So Christine bunch is her name and she
8:53is a client of the center on wrongful
8:56convictions languished behind bars for
8:58more than 7 years after she was arrested
9:01and charged with setting a fire that
9:02claimed the life of her three-year-old
9:04son Anthony who she calls Tony on June
9:0830th 1995 in a trailer home they shared
9:12in decater County Indiana which is
9:14Greensburg
9:15Indiana shortly after the
9:18fire Brian Frank a state arson
9:21investigator concluded that it had
9:22started in two places and that a liquid
9:25accelerant such as kerosene or charcoal
9:28lighter fluid had been used to start it
9:30at both locations 6 days later based
9:34largely on Frank's findings Christine
9:36was charged with arson and felony murder
9:39at her trial which opened on February
9:4126th
9:421966 Frank told the jury there were two
9:46separate fires one was in the South
9:49bedroom along the South wall that was
9:51caused by the liquid accelerant being
9:53present the second originated at the
9:56doorway the area of the doorway of the
9:58South bedroom into the living room and
10:01there was a liquid accelerant poured
10:03across the floor of the living room that
10:05went to the front door of the mobile
10:08home so
10:11um his testimony regarding the
10:14accelerant was collabor collaborated by
10:17William Canard a forensic analysis with
10:21us Bureau of Alcohol Tobacco and far
10:23Firearms ATF who testified that he had
10:26identified a heavy petroleum dis
10:31distillate if I'm saying that right in
10:33flooring samples taken from both the
10:35living room where the fire was believed
10:37to have started and from the bedroom in
10:39which Anthony died Tom Hol an
10:42independent arson investigator testified
10:44for the defense that the cause of the
10:47fire should have been classified as
10:49undetermined because there was a
10:51probability that it had been accidental
10:54jurors evidently believed the
10:56prosecution witnesses and on March 4th
10:5996 Christine then 22 and Pregnant guilty
11:04of murder and
11:06arson the following April decator
11:10County Circuit Court Judge John a Wester
11:13sentenced her to concurrent prison terms
11:16of 60 years for murder and 50 years for
11:22arson
11:26um on uh June 9th 98 the Supreme Court
11:31affirmed the murder conviction citing
11:33the presence of heavy Petroleum
11:36distillate distillate in several
11:39locations but vacated the arson
11:41conviction on Double Jeopardy
11:43grounds just one second I'm just
11:46checking
11:53chat
11:56okay um
11:59but vacated the arson conviction on
12:01Double Double Jeopardy
12:03grounds Christine's family retained an
12:06Indianapolis attorney Hillary Bo Ricks
12:09who filed a petition for post conviction
12:11relief with judge Wester in 2006 a few
12:16months later Betsy Marx a supporter of
12:18Christine's wrote to the center of
12:19wrongful convictions requesting
12:21assistance her letter was referred to
12:24CWC staff Attorney Jane
12:27rally so
12:30um after discussing the case with
12:32Hillary Ricks and reading the trial
12:35transcript Jane approached three fire
12:38forensic
12:39experts Jamie mallister John Dean and
12:44John Mali who occurred in the view that
12:47the arson testimony presented by the
12:49prosecution at the trial in all
12:51likelihood had been
12:53wrong agreed to join Hillary in
12:56representing Christine
13:00oh I'm sorry Jane NCW
13:03staff councel and Carol Daniel agreed to
13:07join
13:09Hillary so um one of the first things
13:13they did was subpoena ATF files on the
13:15original investigation in response ATF
13:19surrendered previously undisclosed
13:21documents showing that contrary to the
13:24trial testimony of William Kenard the
13:27ATF analyst no heavy petroleum
13:29distillate had been found in the bedroom
13:32or indeed anywhere in the trailer
13:34kerosene had been found only in the
13:36living room where there was an innocent
13:39explanation for its presence the family
13:41had used a kerosene heater in the living
13:43room during winter months and when
13:45filling it sometimes spilled kerosene on
13:47the floor the critical sample in Tony's
13:49bedroom was completely
13:53negative because kennard's trial
13:56testimony that a liquid accelerant had
13:57been found in both the bedroom and
13:59living room left an escapable impression
14:02that the fire had been set the ATF
14:04documents were highly exculpatory I
14:08probably said that wrong I'm sorry yet
14:09they had been withheld from Christine's
14:12trial Council in violation of the US
14:14Supreme Court's 1963 decision in Brady
14:17versus Maryland requiring prosecutors to
14:20turn over that word again exculpatory
14:23exculpatory materials to defense lawyers
14:26prior to trial
14:35so I'm trying
14:39to just try to get to the um so
14:43basically they they lied and then they
14:47withheld that
14:49information so after the evidentiary
14:51hearing in October 2009 Wester took the
14:54case under advisement for8 months before
14:56denying relief on June 8 2010 while
15:00Bunch had new resources available to her
15:03at the postconviction hearing new
15:05experts do not create new evidence he
15:07wrote the issues raised and the
15:10conclusions reached while packaged
15:11differently remain basically the same as
15:14they were at trial in 96 he added that
15:17he did not believe the ATF documents
15:19would have changed the outcome of the
15:22trial really
15:24okay so the defense
15:27appealed and John laramore
15:31of I cannot say
15:34this vager bake
15:38Daniels LLP a leading Indianapolis Law
15:41Firm joined the legal team Ron safer
15:43argued the case before a three-member
15:45panel of the Court appeals of Indiana on
15:48July 13 2011 eight months later on March
15:5121st 2012 the court reversed the
15:54conviction holding 2 to one that
15:56Christine was entitled to a new trial
15:58both because the evolving fire science
16:00met the legal criteria for new evidence
16:03and because the undisclosed ATF evidence
16:07directly contradicted canard's trial
16:11testimony supporting fires originating
16:13in two places on August 8th 2012 the
16:17Indiana Supreme Court unanimously
16:19declined to disturb the court of appeals
16:22decision Christine who had earned
16:24undergraduate degrees in English and
16:27anthropology from from Ball State
16:29University in prison was released on her
16:31own ronance 24 days later 17 years 1
16:36month and 16 days after her wrongful
16:39arrest she walked out of the decor
16:41County Jail where she had been sent to
16:44await trial and into the arms of her
16:47family who had steadfastly supported her
16:49throughout her ordeal 8 days before
16:52Christmas 2012 the prosecution dropped
16:55the
16:57charges and
17:00if you do not mind there is a video here
17:04at the end of all that that I just read

17:29fire begins in your
17:31home it kills your
17:34baby and you're blamed for
17:37it she says that um I don't I I I got

17:49videos but she said she lost
17:52friends she didn't have anybody but her
17:55family so even her own friends believed
17:58this
18:04but we probably every single one of us I
18:07think
18:13probably haven't gone through exactly
18:15this but I'm sure we have been through
18:19something in our lives and we've learned
18:22who are real friends are and who our
18:24real friends aren't
18:29but man
18:32alive
18:37so I just couldn't imagine I
18:41mean she was
18:44arrested she had to grieve over her
18:47son's
18:50death her mother had to raise her other
18:52son because her other son was born she
18:56in in Pres
18:59had to be taken away from her and then
19:02her
19:03family her mother had to raise her other
19:09son but then she had to be so strong and
19:13fight all these years and had nobody on
19:16her side but her

23:59did you ever give up hope no never like

24:06I knew that it was going to work out in
24:09the end and I had a lot of
24:12support can you imagine being out of
24:14handcuffs and
24:15shackles not right at this moment but
24:18soon what's it going to be like when you
24:20walk out the doors breathing at fresh
24:22air
24:25again I very
24:29Serene and a very blessed and merciful
24:34moment for first thing you going to eat
24:37or do I don't know right now it's
24:41overwhelming to be able to do anything

25:48feel when they arrested you in the first
25:50place when you were
25:58um I think honestly during that time I
26:02was in shock so it's really hard to
26:07articulate what I felt um where I was I
26:12I think everybody feels kind of leg
26:14dream and you just can't believe it's
26:17happening it's happen is this is this
26:20process what in a way made me say want
26:26lawyer I believe so I worked in the law
26:29library at the facility for several
26:31years and everybody need some help what
26:36do you think of the Northwestern folks
26:37who came came I cannot say enough about
26:41the Northwestern folks I cannot say
26:42enough about my local Council Hillary
26:45started with me and then it snowball and
26:51Northwestern come on and Sh Harden and
26:54and Daniel and they have been incredible
26:58yeah there's no way we could have
27:00afforded the experts that they were able
27:02to get we started talking to them

27:36you want to practice you want to help
27:37people in the same situation I I want to
27:43work there's still a lot of to
27:46be's
27:49a do you you seem so happy obviously
27:53you're going to be happy but you it
27:55would seem like you might be tempted to
27:57be a little bit bitter about waiting
27:58this long to get out but you don't seem
28:00to show that can you explain that yeah
28:03why we don't see the heading you
28:06um I think because this entire time I
28:10haven't been by myself I had a family
28:13that stood by me I've had people that
28:16believed in me and stepped up and you
28:19can't receive blessings like that and be
28:23better it's you know bringing awareness
28:26to what different people do it's
28:29bringing awareness to how long it takes
28:31to get through our justice system it's
28:33bringing awareness to a whole lot of
28:35friends and I think that's worth the
28:39journey so how do you remain optimistic
28:43um say my dream thing yeah
29:03wasn't that
29:05something however that that was a
29:08awesome video I think that's not the one
29:10I thought it was going to be hey
29:13crime
29:15um I have the others linked below um and
29:20some
29:23articles
29:26um where she talks about
29:29the one
29:34organization that was a good question
29:37they asked her wasn't
29:39it how she's not
29:44bitter
29:50H
29:52so she is a very sweet person
29:58there's a whole lot more people just
30:00like her though sitting in these
30:03prisons for something they did not
30:09do
30:13and in a lot of
30:15cases for
30:20murder
30:22um of of of you know other
30:26crimes meaning
30:28there's someone else out there walking
30:33free so that is Christin's story I know
30:37it's short I'm sorry I really wanted her
30:40to come on and tell
30:42it um and you know she may still come on
30:45someday and talk about it but she really
30:48is a busy
30:49person
30:53um yeah another
30:56reason um
30:58that's a lot of people that I mean
31:00that's a reason a lot of people don't
31:03like the death penalty you guys have all
31:06heard why I don't like it um but that's
31:08another
31:13reason yeah quite a few people thought
31:16um because sometimes when I mentioned
31:18her coming on I didn't say um her last
31:21name and a lot of people thought it was
31:23our
31:24joy um
31:28yeah Mel's still here

31:36um yeah I mean
31:40um it is good you know it's a victory
31:43story but you
31:45know she lost 17 years that she'll never
31:48get
31:50back but I knew it would make you happy

41:26there's short staffed and all that but
41:31sometimes there's just no excuse for
41:33what happens I

41:41there's just times where they you know
41:45Indiana CPS um Evansville you know
41:48they're suing they're getting sued
41:49because of
41:51their you
41:54know and uh I had a c casew worker
41:58outright admit to me that they you know
42:02and they're working on it they're trying
42:03to
42:07so there's just both sides of it you
42:21know hey

42:32coming yeah crime yeah we do we all we
42:37do and um and and you're
42:45right those are those are so very
42:49sad those are the ones that are close to
42:52watcher

44:10parent education so they can be better
44:12parents that they might not have had

44:42the organization stand for children I
44:44got a message from them today about
44:46stopping Indiana from putting minors in
44:49adult prisons like what that makes me
44:53mad
44:57I haven't heard of
44:58it
45:04um well I would say if it's a violent
45:10crime murder
45:14uh abusing you
45:17know sexual abuse on you know I I don't
45:21want to come out and say the word but
45:23you know with
45:25children then they deserve to go to a
45:28adult prison I think that's my
45:33opinion but if it's something
45:35minor you know I mean if they just
45:38shoplifted or something I don't think
45:40they should have to go to an adult
45:42prison I think they have juvenile
45:44detentions but they should have to go to
45:48jail
45:52um they should have to be taught lessons
45:55um you know
45:58because typan new County which is
46:00Lafayette which was where I was born and
46:02raised they did away with their Juvenile
46:04Detention Center a long time
46:07ago so when kids got in trouble
46:12and almost you know trouble
46:16period they spent no
46:19time none they went to the police
46:23station they sat in a little
46:25bitty I don't even want to call it a
46:27holding cell their parents were called
46:30Mommy and Daddy came and picked them
46:32up and then if if they thought it was
46:36something serious enough maybe they had
46:39to go talk to a probation
46:43officer once or twice
46:46and and I thought well okay then when
46:50these kids keep on and keep on and keep
46:53on and then later in life when they're
46:56you know
46:59whose fault's that but that's my opinion
47:01on that Mel I don't think all juveniles
47:04should go to prison I think it depends
47:06on the
47:08crime if it's a violent crime for
47:15sure is that how you feel Mel

47:40sorry okay crime was talking about John
47:45Bonet yeah that's a rabbit hole for
47:49sure you know I always said I didn't
47:53think anybody in that family was guilty
47:54but I don't know I watched something and
47:57maybe it was what Watcher sent me I
47:59don't know because I watched something
48:00recently and it really made me
48:02think I don't know oh okay juny I hope
48:06you're not already gone because I just

52:02um it's not that anymore um I mean for
52:07like the mentally ill
52:09people they like pretty much just threw
52:12them all out I mean it's like boom boom
52:15I mean they just they like there's
52:17nowhere here anymore around here for the
52:20mentally ill so now it's for
52:22the criminally
52:24insane but then they all also have a
52:27section
52:29that is
52:31for uh
52:34juveniles for criminal
52:37juveniles I know it's a detention center
52:40but I don't know if it's classified as
52:42um like a Department of Correction thing
52:45so I don't know if that is where they
52:46would send juveniles that do those adult
52:50crimes as
52:52well but it is it's it's it's in it's
52:56it's out there where the Logan sport
52:58Memorial Hospital was but it's in a
53:01different section in a different
53:04building and I don't know exactly how
53:06that's
53:12classified but there are you know
53:15there's there's there's you know they
53:17get tried as an
53:20adult like I I'm I'm reading part of

53:26age if they are 17 and they go kill a
53:29bunch of people they need to be in adult
53:31jail now if they are 10 that's

54:32night not come home have me going crazy
54:36and um him and his friend went into a
54:39VP he was only

54:43and um they went in there to steal some
54:47beer V VP means Village Pantry around
54:50here by the way I don't know if they
54:52have them
54:53everywhere well when they were on their
54:55way out his friend
54:56didn't they didn't even have a
54:59gun but his friend threatened the
55:01clerk so that made it
55:06robbery my
55:09son so they were charged with uh theft
55:13and
55:15robbery
55:17and he was facing 30 years all because
55:22of that threat and he wasn't even the
55:24one that made that threat
55:27so he had to go to juvenile
55:32court and usually doesn't happen in
55:35juvenile court they set a
55:42bond and I bonded him
55:47out they turned
55:51around and well she told me that she was
55:54transferring to adult Court
56:01and so they charged him as an adult and
56:04when they did when it went through the
56:06adult Court they turned right around and
56:08then issued a $1,000
56:12Bond so they were going to charge him as
56:15an adult and he would have had to have
56:18gone I'm pretty sure I mean I don't know
56:20how it would have worked all I know is
56:21they were going to charge him as an
56:22adult and he was facing 30 years and I
56:25mean you want to talk about a terrified

56:35know I wasn't going to let it happen he
56:37wasn't the one that threatened I you
56:39know he did do time for what he went in
56:42there to do which was to steal the beer
56:45you do the crime you do the time but he
56:47didn't threaten the clerk his friend did
56:50and so I did get him a good lawyer and
56:52so he
56:54did get in trouble for the theft
56:57but yeah I mean the reason I told you
56:59that story is because I was just trying
57:00to use that example he was 16 they were
57:02going to charge him with an adult for
57:11robbery
57:13yeah
