- 0:00Here, two 15-year-old boys who were
- 0:02spared custody for the rape of two girls
- 0:04in Fordingbridge have been sentenced to
- 0:074 years in jail after the court of
- 0:09appeal ruled their sentences were unduly
- 0:11lenient. The boys, known as X and Y,
- 0:14were given non-custodial sentences in
- 0:16May for a combined 10 counts of rape and
- 0:19seven indecent image offenses related to
- 0:22two victims who were separately attacked
- 0:24in November 2024 and January 2025. Let's
- 0:29speak to our reporter Sam Harrison who's
- 0:31outside the court and tell us more about
- 0:33the remarks in the court today, Sam.
- 0:38>> Afternoon. Well, we are expecting a
- 0:40press conference in a few moments time
- 0:42from one of the solicitors, so we may
- 0:43cut from this. But in in order to
- 0:45understand this appeals process, it's
- 0:48really important to remember that the
- 0:50judge who previously presided over that
- 0:5229-day trial down in Southampton did
- 0:56also agree that the offending by these
- 0:59two individuals, known to us as X and Y,
- 1:02did cross the custody threshold.
- 1:05However, it it was their age that was
- 1:08taken into account. Effectively, their
- 1:10age was up against the seriousness of
- 1:12offending, and it was decided that a
- 1:14non-custodial custodial sentence,
- 1:16effectively not going into detention,
- 1:19should be enforced. This process has
- 1:22been about analyzing that decision and
- 1:25whether or not it was right. And it has
- 1:28come to light today the
- 1:30lady who's been presiding over this,
- 1:31Lady Chief Justice Baroness Carr, she
- 1:34has decided that that sentencing was
- 1:37wrong and that these two teenagers, X
- 1:39and Y, should face a custodial sentence.
- 1:44A big change here. Now, also worth
- 1:46remending remembering that a third
- 1:48individual is involved, a teenager 1
- 1:52year younger throughout this case known
- 1:55as Z. His sentence remains the same. On
- 1:59X and Y, she addressed uh them both
- 2:03whilst they appeared on video link in
- 2:05Southampton. She said, "We do need to
- 2:07change your sentences. What you both did
- 2:11was so bad, we had no other choice. You
- 2:14were enjoying what you did, and you were
- 2:16egging each other on." So, very strong
- 2:19words in the court heard by people
- 2:23today. Now, in terms of the sentence
- 2:25they'll now face, which has been
- 2:27changed, they were up for 3 years under
- 2:30a youth rehabilitation order. They will
- 2:33now be sentenced to 4 years in youth
- 2:36detention, of which they will serve at
- 2:39least half, so 24 months, minus uh any
- 2:42time that they've already spent in
- 2:45detention. So, a really significant
- 2:48ruling here today. That the appeal has
- 2:51been heard, and it has been accepted for
- 2:54individuals X and Y, these two
- 2:5715-year-old teenagers who were found
- 3:00guilty of rape earlier this year.
