THE INVESTIGATION OF SCOTT PETERSON WITH DETECTIVE AL BROCCHINI AND DETECTIVE JON BUEHLER — Transcript

- 0:44This is a real mystery. friends and
- 0:46family of this young woman, Lacy
- 0:48Peterson, are gathering at the family
- 0:50home. You can see that they've been
- 0:52putting up fires in the neighborhood
- 0:53here for the last day and a half.
- 0:55They've also been canvasing a park which
- 0:57is nearby this area where Lacy was last
- 1:00seen on Christmas Eve about 9:30 in the
- 1:02morning. Her husband Scott had gone to
- 1:05the Bay Area to go fishing. When he
- 1:07returned, Lacy was nowhere to be found.
- 1:12>> No parent should ever have to think
- 1:13about the way their child was murdered.
- 1:16In my mind, I could hear Lacy say to me,
- 1:18"Mom, please find me and Connor and
- 1:20bring us home. I'm scared. Please don't
- 1:24leave us out here all alone."
- 1:29So on December 24th about uh 7:30 in the
- 1:34evening, I got a phone call and whenever
- 1:37the phone rings at night, I know it's
- 1:39probably work and it's bad news, but it
- 1:41was it was my sergeant. And Sergeant Al
- 1:44Carter told me that there was a missing
- 1:46person in Modesto and she was pregnant
- 1:49and the the officers on scene were
- 1:53wanting to have a detective come out and
- 1:55uh assist in their investigation.
- 1:58So I told him I'd go and it was
- 2:01Christmas Eve and we were at having
- 2:03dinner with my kids and my wife and I
- 2:05finished my dinner and I got in my car
- 2:09and I started heading towards Modesto
- 2:11about hour and a half away. When I
- 2:14arrived at Cavina which was the unusual
- 2:17part was there was a lot of people there
- 2:19in the driveway. I mean, there was co,
- 2:22you know, thermoses of coffee. People
- 2:24were already putting up flyers and I met
- 2:27with the sergeant and the officers and
- 2:29they kind of briefed me and then they
- 2:31introduced me to Scott and I introduced
- 2:34myself to him and I uh
- 2:37asked him to walk me through the house
- 2:39and kind of walk me through the day and
- 2:42tell me what he knew about when he last
- 2:45saw uh Lacy.
- 2:49[Music]
- 2:56I've been around the block a few times
- 2:58and I didn't I was just thinking it was
- 3:01a missing person case. I mean, I could
- 3:03hear uh on my way down I could hear uh
- 3:08the helicopters
- 3:09over the radio when when cops would
- 3:11talk. I heard they were in the park
- 3:14searching. So, I knew they were
- 3:15searching. And when I met Scott, I had
- 3:18no I mean, he just I've never met him
- 3:20before. He seemed like a nice guy. I
- 3:21just there to do my job. Scott walked me
- 3:24through the house, showed me his house.
- 3:27He allowed me to uh search his cars, his
- 3:31truck and her car. There was some things
- 3:33that were unusual for me for my, you
- 3:36know, just the my gut feelings. I wasn't
- 3:39feeling like, oh, he did something to
- 3:41her yet, but I had unusual or gut
- 3:45feelings about things. I mean, like when
- 3:47I searched his truck,
- 3:51uh, I opened the back door and it
- 3:54accidentally hit her Land Rover and he
- 3:58was right jolly on the spot with a,
- 4:01"Hey, Al," and he called me Al right
- 4:02from the beginning. Hey, I'll I'll move
- 4:04my truck or can I put this glove between
- 4:07the door and the Land Rover? And I said,
- 4:09"Hey, Scott, I'll you know, I'll be a
- 4:10little more careful. I'm not going to,
- 4:12you know, I won't do that again." But I
- 4:13mean, I'm thinking, "Okay, your wife's
- 4:15missing and you're focused right now on
- 4:17I bumped the door into the truck." And
- 4:21uh so I just was that was unusual. And
- 4:24then in the truck, I mean in the back of
- 4:27the truck, I noticed there was some
- 4:29umbrellas all wrapped in a blue tarp.
- 4:32And I asked him, I said, "What's what's
- 4:34this, Scott?" He says, "Oh, those are my
- 4:36outdoor umbrellas. I'm going to move
- 4:38them to the shop." And I'm in my head,
- 4:40I'm thinking, "Okay, why not just throw
- 4:42them in the truck? Move them to the shop
- 4:43and put them in there." But he's got
- 4:44them all wrapped up in a blue tarp. That
- 4:46was kind of weird. And then there was
- 4:48another big tarp in the back of the
- 4:49truck, all just kind of bunched up back
- 4:52there. And I just noted those things.
- 4:55And when I searched the interior of the
- 4:56truck, he had told me it was his
- 4:59decision to go fishing that morning.
- 5:02But in the truck, I found a receipt from
- 5:04Big Five where on the 20th, he had
- 5:07purchased a two-day fishing license and
- 5:09dated it the 23rd and 24th. And so I
- 5:12thought that didn't add up. And he told
- 5:15me that when he got home,
- 5:18he he took all his clothes off and put
- 5:22them in the washing machine because they
- 5:24were wet.
- 5:26and the the the jacket he was wearing
- 5:29when he was fishing was in his truck and
- 5:30it wasn't wet. And so I I'm just noting
- 5:33these things in my head and they're just
- 5:35they're not, you know, not adding up the
- 5:38way I would expect them to be. And so I
- 5:40just kept noting those things and uh and
- 5:45moved on. I asked him if he would take
- 5:47me to where the boat was, his shop, and
- 5:50he agreed and we went over to the shop.
- 5:53And all during this time, I'm telling
- 5:55Scott, uh,
- 5:58there's cops and detectives, searching,
- 6:02knocking on doors, interviewing people,
- 6:05but my primary job with you, Scott, is
- 6:08to eliminate you, or not eliminate you
- 6:12yet, but my job is to uh I don't want to
- 6:16say eliminate, but eliminate you as any
- 6:18kind of a suspect. And so, I have to ask
- 6:21you hard questions. and my experience
- 6:23tells me you're not going to like me
- 6:24very much by the end of this. He agreed
- 6:27and he said that he understood and uh he
- 6:30would answer all my questions. And then
- 6:32I asked him to come back to the police
- 6:34department for an interview.
- 6:36>> When do you realize you're going to go
- 6:38fish?
- 6:41>> That was a morning decision. I was also
- 6:44played all the club
- 6:49seemed too cold
- 6:51at the club. So she told what she was
- 6:53going to do for the day and
- 6:55>> Okay. So she told you what she was going
- 6:57to do for the day.
- 6:58>> Yeah.
- 6:59>> And what was that?
- 7:01>> Um she's going to finish cleaning up.
- 7:03Like I said, she
- 7:07um
- 7:09take the dog for a walk and then she is
- 7:11going to the store to buy for
- 7:14Christmas morning breakfast tomorrow.

- 7:45Well, so when I interviewed Scott, I
- 7:48mean, during the interview, I didn't
- 7:50really notice a lot. I mean, I'm just
- 7:53talking to him and he's answering my
- 7:54question, but then later when you I sit
- 7:56back and I watch it and I I I watch it.
- 7:59I mean, he is I mean, he's got his hands
- 8:02in his pockets. I mean, he's leaning
- 8:03back in the in the chair. I mean, it's
- 8:07comfortable. And I mean, I think at one
- 8:10point too, the phone rang and I mean, he
- 8:11he looked at it. He goes, "Oh, you know,
- 8:13that's just so and so." And he didn't
- 8:15even answer it. And I'm thinking, "Okay,
- 8:18what if that was so and so saying, "Hey,
- 8:20Lacy's over at my house." But I mean, he
- 8:22knew she wasn't coming back. And uh but
- 8:26I didn't know it when I was talking to
- 8:29him. I'm starting after I'm watching it,
- 8:32then I'm uh getting those feelings.
- 8:35Okay. So, if you got to the about five
- 8:38minutes to one, you get your boat in.
- 8:41How long you think you stay in the
- 8:42water?
- 8:44Felt like an hour and a half or so.
- 8:48>> Would you be uh willing for me to take a
- 8:51gunshot res? Sure.
- 9:00Exhaust show.
- 9:03What?
- 9:06>> Well, you showered after you said so.
- 9:31Did you have a map for that area or you
- 9:33know would you just we wing it? So you
- 9:36just when you got in your boat you took
- 9:38off. Did you go very far? Well I mean
- 9:43right mile north um found a
- 9:48like a little island kind of deal there.
- 9:59island had a bunch of trash on it. I
- 10:01remember a big sign that said no
- 10:03landing.
- 10:07[Music]
- 10:09It looked like some real pures around
- 10:11and I just assumed it would be a
- 10:13decent shallow area.
- 10:23[Music]
- 10:29Christmas day, I get a call from Al
- 10:31Brokini uh in the morning, right about
- 10:33nine o'clock. And first thing he does,
- 10:35he asked me what I'm doing. I said,
- 10:37well, you probably remember what I'm
- 10:38doing. I'm taking my kids over to their
- 10:40mom's. And I'm thinking, well, this is a
- 10:43call for overtime. And I asked him
- 10:45what's going on. He said he had a
- 10:47missing that um he was working. And I
- 10:50asked him if he needed any help, and he
- 10:52said he did. He told me that he had
- 10:54actually worked on this case from the
- 10:55prior evening on Christmas Eve. Uh he
- 10:58had been called out uh to talk to Scott
- 11:00and interview him regarding Lacy being
- 11:03missing. And in the process of doing
- 11:05this, he didn't find anything that was
- 11:07obvious that made him think that Scott
- 11:09had done anything wrong. But Scott's
- 11:11demeanor was a little bit too calm
- 11:13compared to the other family members.
- 11:15And he had documented a bunch of things
- 11:17that uh were essential later on in the
- 11:19investigation. uh like no forced entry
- 11:22into the house and Scott's demeanor and
- 11:24specific things that Scott did when he
- 11:26came back from fishing. When it came to
- 11:28his conversations, I remember the one
- 11:29that that was suspicious to me from the
- 11:31start, Brokini played it for me on that
- 11:33first day on Christmas Day. When Scott
- 11:36was coming back from Berkeley Marina,
- 11:38he'd made a call to Lacy. Uh her cell
- 11:40phone battery was dead. Uh people had
- 11:43known that, but he left a message. Um
- 11:45and it was words to the effect of, "Hey,
- 11:47beautiful. I'm coming back from
- 11:48fishing." and I'm not going to be able
- 11:50to make it to Vela Farms. Can you go
- 11:52pick up that uh gift basket for Papa and
- 11:56I love you? And it just it it just the
- 11:59tone of it to me was scripted um phrased
- 12:04in a way to show that he was devoted to
- 12:06this girl and and I don't want to have
- 12:08the suspicion on me so I'm leaving this
- 12:10recording to get you guys on a different
- 12:12track. So, we're suspicious of a lot of
- 12:15things because people that talk to
- 12:19detectives often times have a reason to
- 12:20lie and so you have to verify these
- 12:22through a variety of different ways.
- 12:25>> Okay, beautiful. I just left a message
- 12:27at home. Uh 2:15 Len Berkeley. I won't
- 12:30be able to get to the Villa Farms to get
- 12:31that basket for Papa. I was hoping you
- 12:34would get this message and go on out
- 12:36there. I'll see you in a bit. We love
- 12:38you. Bye.
- 12:40>> End of message. But in addition to that,
- 12:43he said that we had to go back out there
- 12:45and talk to Scott a little bit more,
- 12:46which was fine with me because I hadn't
- 12:48met him yet. And we pulled up on Coina,
- 12:50uh, facing south, pulled up next to the
- 12:52house on the curb there. And I saw Scott
- 12:55up to the left. He was walking from the
- 12:57southeast to the northwest and we got
- 12:59out of the car. Al greeted him. You
- 13:01remembered Al from the prior evening.
- 13:03And Al introduced me to Scott. And first
- 13:06impression, like anybody's first
- 13:07impression of Scott, is pleasant,
- 13:09friendly. Uh, very controlled. Uh, he
- 13:12wasn't panicked. He wasn't um frantic or
- 13:16anything like that. He didn't have a lot
- 13:18of questions for us, which seemed kind
- 13:21of strange for me, but I'd only been
- 13:22with him for a few moments at that time.
- 13:24So, right after that, I went over to
- 13:27talk to the neighbor to the south, Karen
- 13:28Service, to get more details from her,
- 13:30specifically when she found the dog, how
- 13:33she found the dog, and the things that
- 13:34were taking place uh on Christmas Eve
- 13:37for her that day. Karen was like one of
- 13:39the neighbors that you would really want
- 13:41to have living next door to you. She was
- 13:43um very friendly. She was uh very
- 13:46accurate about things that she
- 13:47remembered from the day prior as far as
- 13:49finding the dog with the leash, putting
- 13:51the dog back in the Peterson's backyard.
- 13:53In addition to that, she had left uh to
- 13:56go shopping in downtown Modesto and she
- 13:58had a receipt for a purchase that she
- 14:00made that helped us determine the time
- 14:02between when Scott left the house and
- 14:05when the dog was discovered. And that
- 14:08was very helpful to show that there
- 14:09wasn't a lot of time between when Scott
- 14:11pulled out of the driveway and the dog
- 14:13was found. So, she gave us background
- 14:16information about Scott and Lacy. She'd
- 14:18been to their house many times for
- 14:19barbecues and events and things like
- 14:21that and just good neighbors. Nothing
- 14:24bad to say about either one of them. Uh
- 14:27Scott was very helpful to her at her
- 14:29house. Scott was handy uh so he could
- 14:31fix things because she was living alone
- 14:34at that time. And again, just it started
- 14:36to become a common theme that we were
- 14:38finding that everybody pretty much loved
- 14:40Scott.
- 15:06One of the things that came up when I
- 15:07first met Scott, and this existed
- 15:09throughout all of our contacts, which
- 15:11were pretty much always pleasant, uh
- 15:13Scott was pretty easy to deal with. His
- 15:15cooperation was guarded um and it was
- 15:18limited. If we got into areas that he
- 15:20didn't want to go into, uh he would
- 15:22mention his attorney and that he'd have
- 15:24to run that information by his attorney.
- 15:26Pretty unusual for us in a situation
- 15:28like this. Usually people don't do that.
- 15:30They have the right to do it, but
- 15:31generally they don't. They don't put
- 15:33limits on their cooperation. But
- 15:35comparing Scott, from the day I met him
- 15:38all the way until the last time I saw
- 15:40him, he never showed any frantic desire
- 15:45to figure out what happened to Lacy
- 15:47compared to her mom Sharon, her sister
- 15:50Amy, her brother Brent. Um, everybody
- 15:54that was from Lacy's circle, whether it
- 15:56was Stacy or Lori or Renee or Kim or Ron
- 16:00Gransky, um, Dennis Roachcha, Lacy's
- 16:03father, everybody was frantic about
- 16:06where she was, what happened to her,
- 16:08when she was coming back, with the
- 16:10exception of Scott. Now, this could mean
- 16:12that he just had an enormous amount of
- 16:13self-control, which I believe he does,
- 16:16but it also um I've seen it before in
- 16:19other cases where I had guys like this
- 16:21that didn't show that. So, it was
- 16:24something I'd seen before. It didn't
- 16:26mean that he had killed her, but because
- 16:28of his demeanor and because of his
- 16:30limited cooperation, it just meant that
- 16:32we had to keep digging until we could
- 16:34find out that he either didn't have
- 16:36anything to do with Lacy's disappearance
- 16:38or enough evidence came up to show us
- 16:40that he did.

- 18:24keeping all angles open right now, but
- 18:26from talking to the family and friends
- 18:29of the family um who are been extremely
- 18:33cooperative and helpful in this
- 18:34investigation, this is completely out of
- 18:36character for her and her lifestyle.
- 18:39Scott was very cooperative when it came
- 18:42to giving a timeline on what he was
- 18:43doing when he was talking to Al Brokini.
- 18:45So, he explained that he had uh loaded
- 18:48some uh patio umbrellas into the back of
- 18:50his pickup truck and he had had these in
- 18:53the backyard and he was moving those
- 18:55over to his warehouse so they wouldn't
- 18:57be around apparently during the holiday
- 18:59season. And as he did that, he had the
- 19:03truck backed in the driveway. And a
- 19:06couple of the neighbors had mentioned
- 19:07they had never ever seen him back the
- 19:10truck in the driveway. So when he backed
- 19:12it in, it was real handy. The back of
- 19:14the truck was right by the door that
- 19:16goes out from the um it's kind of like a
- 19:18TV room uh that they had in the front of
- 19:21the house. It was a converted garage and
- 19:23there was a side door on the north side
- 19:25that went out to the truck. and he
- 19:28loaded the patio umbrellas into the
- 19:30truck. My belief is he loaded those on
- 19:32top of Lacy as a way to disguise her so
- 19:34that if anybody looked in the bed of the
- 19:36truck, they wouldn't see her. She was
- 19:37probably wrapped up in something. I
- 19:39don't know what it was. There was all
- 19:41sorts of different theories on whether
- 19:43it was a blue tarp or whether it was a
- 19:45blanket or anything like that, but it
- 19:47fits with some little minor evidence
- 19:50things that were noticed early on. there
- 19:51was a a a throw rug that was by this
- 19:54door that goes out to the north side of
- 19:56the house by the carport and that throw
- 19:59rug was bunched up by the door. Now,
- 20:01Scott gave the explanation to that that
- 20:03the cat or the dog had done that and
- 20:06maybe it did, maybe it didn't, but it
- 20:08wouldn't be inconsistent with dragging a
- 20:11dead body from the bedroom across the
- 20:14floor through that TV room out to the
- 20:17truck and bunching up the rug in the
- 20:19process. So, the thing about the patio
- 20:22umbrellas that was kind of interesting
- 20:24was he didn't leave them at the
- 20:26warehouse. He did bring them back to the
- 20:28house after he returned from the fishing
- 20:30trip. And so, that's it. By itself, it
- 20:35really means nothing. But when you start
- 20:38categories of evidence and you start
- 20:42putting these things together and adding
- 20:44them up, you start making a list of
- 20:46circumstantial evidence that doesn't
- 20:49make sense. And the umbrellas being
- 20:52returned were part of that. So when
- 20:54Scott left the house, we were able to
- 20:57determine through cell phone records and
- 20:59where his cell phone was pinging on the
- 21:02antennas that he drove to his warehouse
- 21:05over in West Modesto near the freeway
- 21:08and he stayed there for a certain period
- 21:09of time. His explanation while he was
- 21:11there is he checked his um email. He had
- 21:15a mortising tool that had been delivered
- 21:18for woodworking and that he partially
- 21:21assembled while he was there. And then
- 21:23he backed the truck in and hooked up the
- 21:26boat trailer to the truck. And then he
- 21:29drove up to Berkeley Marina, launched
- 21:31the boat, drove or
- 21:34piloted the boat north through the bay
- 21:36towards Brooks Island. He had specific
- 21:39details about the sign that was on
- 21:41Brooks Island as far as you can't land
- 21:43here. You can't get on the the island,
- 21:45there's no trespassing there. And then
- 21:47he came back. He had a a timed stamped
- 21:51parking permit that he'd gotten when he
- 21:52pulled into the parking lot there at
- 21:54Berkeley Marina. Um, apparently some
- 21:57guys saw him either launching his boat
- 21:59or recovering his boat with the trailer,
- 22:01trying to load it, and I guess he backed
- 22:03a trailer about the way I would, not
- 22:05very skilled, and and um they made some
- 22:08remarks on it, and he was noticed. And
- 22:10I'm not sure if that was the reason that
- 22:12he finally changed his alibi that
- 22:15originally he had told earlier was going
- 22:17to be for golfing.
- 22:19The day before when he had gotten his
- 22:21haircut uh by uh Lacy's sister Amy, he
- 22:26had mentioned to her that on Christmas
- 22:28Eve he was going to go golfing at Del
- 22:30Rio Country Club. He'd also told this to
- 22:33Ron Gransky, who was Lacy's stepdad,
- 22:36Sharon's longtime companion. And later
- 22:41on he changed that alibi. He said it was
- 22:43too cold to go golfing. So he decided to
- 22:45go fishing.
- 22:47Well, that doesn't make much sense to
- 22:49me. Uh you go out on the water, it's
- 22:52going to be colder on the water than it
- 22:54is going to be on the golf course. And
- 22:55then of course you're driving 80 miles
- 22:58to go up to Berkeley to launch your
- 22:59boat. It didn't seem to make too much
- 23:01sense when he could just go up to the
- 23:02Sierras up to Woodward Reservoir, maybe
- 23:0430 mi away, and launch his boat up
- 23:05there. But regardless, this is one of
- 23:08the things that he did when he went
- 23:10there. Now, there's been people in the
- 23:11past that have made remarks about uh
- 23:14Lacy being in the bed of the truck and
- 23:16that she could have been spotted. Well,
- 23:18maybe she could have been if she wasn't
- 23:20wrapped up, if she wasn't disguised, if
- 23:22she wasn't under the patio umbrellas.
- 23:24But also, this is on Christmas Eve, and
- 23:27there wasn't a lot of activity at this
- 23:29warehouse. It was kind of like a kind of
- 23:31like a strip mall warehouse, overhead
- 23:33doors, things like that. But there was
- 23:35no flurry of activity before the
- 23:38holidays because it wasn't retail kind
- 23:41of uh situation where people are
- 23:43shopping. So it would have been real
- 23:45easy for him to back the truck partially
- 23:47into the warehouse itself and transfer
- 23:51Lacy's wrapped up body into the boat,
- 23:54cover the boat with the boat cover, and
- 23:56then hook the trailer up to the truck
- 23:58and drive up to Berkeley. And once he
- 24:01got up there, he said he took the boat
- 24:03out for a while. He said he did some
- 24:05fishing, but he was never specific with
- 24:07any of the officers or even with Brokini
- 24:09as far as what he was fishing for. He
- 24:12had a two-day fishing license that he
- 24:15had purchased on December 20th, but he
- 24:18had not filled in the date as far as
- 24:19when he was going to be fishing uh when
- 24:21he purchased the license. So, that to me
- 24:24also goes along with some premeditation
- 24:26because it was open-ended as far as if
- 24:29or when he was going to kill Lacy. But
- 24:32in addition to that, his packages of
- 24:35lures, which were for freshwater
- 24:37fishing, substantially different from
- 24:38saltwater fishing, had not even been
- 24:40opened. So the boat did test positive
- 24:43for having salt water in the motor and
- 24:45in the bottom of the boat. But there was
- 24:47no evidence that he was doing any
- 24:49fishing and he couldn't speak
- 24:50specifically about fishing. Whereas if
- 24:53you go across the street here to my
- 24:54neighbor's house and you mention fishing
- 24:56for him to him, he'll talk to you for
- 24:58three hours about it and he knows
- 24:59exactly what he's looking for. So open
- 25:02things like this that don't really make
- 25:04sense make detectives suspicious. U and
- 25:08we look for answers on things like that
- 25:11and that's what we were doing with
- 25:12Scott.
- 25:13>> Okay. So one thing uh that I found
- 25:18interesting or during the investigation
- 25:20was Scott was telling me how concerned
- 25:24he was cuz he couldn't get a hold of
- 25:27Lacy. He went fishing. He called her
- 25:30twice from the boat ramp. Then he called
- 25:32her again from the gas station and he's
- 25:35concerned because he's not getting a
- 25:37hold of her. And so then he he uh goes
- 25:41back to the shop, drops the boat off,
- 25:43goes home, and he finds his dog running
- 25:47around with a leash. That's pretty
- 25:49concerning to him, too. And then he
- 25:51finds the door unlocked. He says that's
- 25:53really concerning to him. But he's So
- 25:56he's really nervous. He's concerned. But
- 25:58what does he do? He goes in and only
- 26:02washes the clothes he's wearing. He
- 26:04takes the dirty stuff out of the washer.
- 26:06There's a hamper full of clothes, but he
- 26:08only washes his shirt and his, you know,
- 26:11his pants, what he was wearing. Then he
- 26:14eats some pizza. Then he takes a shower,
- 26:17gets dressed, then he calls Ron and
- 26:21Sharon and basically says, "Lacy's
- 26:23missing. Do you know where she's at?" I
- 26:25mean, so he's telling me he's real
- 26:28concerned, but the his actions aren't
- 26:30showing he's concerned. His actions are
- 26:32showing, you know, something else. And
- 26:34so I think
- 26:36that concerned me, you know, leaving the
- 26:40leash on the dog and leaving the gate
- 26:41open, the dog, he knows the dog's going
- 26:44to run around and it was a rainy day and
- 26:48and the neighbor found the dog and put
- 26:49it back and shut the gate. But yeah, I
- 26:51think that was part of his plan.
- 26:54Uh the people that whoever has Lacy, uh
- 26:57the reward is 500,000. Take the money.
- 27:00Bring my daughter back safe and take the
- 27:02money and go and get away free. Get out
- 27:04of here. Just go with the money. Take
- 27:06the reward and go. Thank you.
- 27:18The Medina home, which is directly
- 27:19across the street from the Petersons,
- 27:21was burglarized around the same time as
- 27:23Lacy Peterson would have went missing
- 27:25while walking her dog. A local resident,
- 27:28a woman by the name of Diane Jackson,
- 27:29told authorities that as she drove by in
- 27:32the direction of the park, and this
- 27:33would have been on December 24th at
- 27:35about 11:40 a.m., she saw a van parked
- 27:38in front of the Medina home. Three men
- 27:41were next to the van and glared at Diane
- 27:43Jackson as she drove by.
- 27:48>> One of the pieces of evidence or things
- 27:51that happened during this case that we
- 27:53had to deal with was uh there was a
- 27:56burglary across the street from uh
- 27:59Scott's house. And this occurred right
- 28:02around the same time as Lacy went
- 28:04missing. And so we had a group of
- 28:08detectives assigned to the burglary
- 28:10case. If you run it out to a logical
- 28:12conclusion, if the burglars abducted
- 28:15Lacy, first off, if they're going to try
- 28:18and frame Scott, they're not going to
- 28:20hide the body on the bottom of San
- 28:22Francisco Bay. Are they going to take
- 28:24the risk to transport the body when
- 28:27everybody's looking for Lacy from
- 28:29Modesto to San Francisco Bay? Much
- 28:31different than when Scott was going up
- 28:32there when nobody was looking for Lacy.
- 28:34In addition to that, um I I I see a lot
- 28:37of Boers down here and most of them are
- 28:39not burglars. So to think that there's
- 28:41burglars that are out boating and things
- 28:43like that seems kind of suspicious uh to
- 28:46me that people would actually believe
- 28:47that they uh pretty much confessed to
- 28:50the burglary.
- 28:52They said, you know, one of them, one of
- 28:55these guys was riding his bike around
- 28:57the day after Christmas and uh found
- 28:59that or Christmas Day or the day after
- 29:02and he uh sees this house is empty and
- 29:06they he breaks in and sees a safe. So,
- 29:08he leaves and goes and gets his friend
- 29:10that has a a a truck and they go back to
- 29:13the house and they steal the safe and
- 29:15they steal all the property. Well, after
- 29:17they got caught, they turned all of that
- 29:19stuff in. They turned in property from
- 29:22other burglaries that they had done. Uh
- 29:26there was a half million dollar reward
- 29:28that was leading for the return of Lacy
- 29:31or her or un you know uninjured
- 29:33recovery. And there was a $50,000 reward
- 29:36leading to the recovery of her remains
- 29:38if she was murdered or had met death
- 29:41some way. And nobody came forward to
- 29:44collect those uh rewards. One lives with
- 29:47his mom and the other one lives with his
- 29:49mom in a shack in the backyard. But I
- 29:52mean, they had alibis.
- 29:54People know where they are on Christmas.
- 29:56I mean, all their alibis checked out.
- 29:59Their polygraphs were clean. They went
- 30:01to jail for the burglaries. Uh, we
- 30:04recovered all kinds of property, but
- 30:06nothing from Lacy. That was the most
- 30:11um thoroughly investigated burglary that
- 30:14we've, you know, done in a long time.
- 30:16I'm It was thorough. And uh they went to
- 30:20jail. They did not want to go to jail
- 30:24with anybody thinking they were involved
- 30:26in that case. That was one thing both of
- 30:28them made perfectly clear. There's
- 30:30certain crimes that people that get
- 30:33incarcerated don't care about, but there
- 30:35is a classification of crimes where if
- 30:38you abduct and kill a mother, a pregnant
- 30:41mother, you're not going to be looked
- 30:42upon too favorably by the other people
- 30:44that are locked up with you. And to
- 30:46think that these guys are going to jail.
- 30:48One of them had a warrant. Of course,
- 30:49they're both arrested for the burglary,
- 30:50and they know they're going to get
- 30:51locked up. They were almost begging to
- 30:53get polygraphs so that they could show
- 30:55the other inmates that they had nothing
- 30:57to do with this. All the property that
- 31:00was taken from the Medina burglary was
- 31:02recovered and other property that wasn't
- 31:04even associated with that burglary was
- 31:06recovered because people that these
- 31:08burglars had sold that property to or
- 31:12given it to, they wanted away from that.
- 31:15And so other property that wasn't even
- 31:16associated with Medina's burglary was
- 31:18recovered. We even had a guy that came
- 31:20in the lobby of the police department
- 31:21with a bag full of stolen property,
- 31:23dumped it, masked up, ran out. we they
- 31:26couldn't catch him because he went down
- 31:27the street. And this this is the the way
- 31:31people felt about this case. They didn't
- 31:32want to be anywhere near it to be
- 31:35dragged into it. As time went by, of
- 31:37course, a lot of people are trying to
- 31:39find reasonable doubt in Scott's uh
- 31:41guilt by claiming that um well, there
- 31:43there was that burglary across the
- 31:45street and um and they we we have that
- 31:48saying that there's no coincidences in
- 31:50homicide uh investigations. And that's
- 31:52generally true. And then people say,
- 31:55"Well, that's a coincidence, John."
- 31:57Well, it is, but when you take that by
- 31:59itself and then you compare it with all
- 32:02the other coincidences of the stack of
- 32:05circumstantial evidence against Scott,
- 32:08the Medina burglary is pretty
- 32:11minor in comparison.
- 32:12>> I mean, those guys, like I said, they
- 32:15live in their backyard with their mother
- 32:17and ride bikes. There's $500,000 reward.
- 32:22If they had Lacy somewhere in the shed
- 32:26with them, they're going to get turned
- 32:28in. I mean, that's just the bottom line.
- 32:30I used to I used to carry $500 and I
- 32:33could buy information from any one of
- 32:35those guys for a hundred bucks. And so
- 32:39that's ridiculous. Now, if you're doing
- 32:43property crime and you're stealing
- 32:44things from people's homes to support a
- 32:46drug habit or whatever you're using it
- 32:48for, to think that if more than one
- 32:51person knew about Lacy being abducted,
- 32:54to think that their loyalty would trump
- 32:57uh a half million dollars,
- 32:59well, you're you're looking at things
- 33:02differently than I do. I just don't see
- 33:04it happening that way, especially when
- 33:06rewards come out and people come forward
- 33:08for $50.
- 33:23We were getting calls of of people
- 33:25seeing a a pregnant lady walking a dog.
- 33:28So, we had a knock on a lot of doors. We
- 33:31interviewed a lot of people. Um, we
- 33:33found two other pregnant ladies that
- 33:35were walking their dogs on Christmas.
- 33:37They were interviewed. Nobody
- 33:40could
- 33:42positively say they saw Lacy walking
- 33:47a dog. In a nutshell,
- 33:50there was, I believe it was about a 20
- 33:52minute time window between when Scott
- 33:54left and when uh Karen Service put the
- 33:58dog in the backyard. And so the skeptics
- 34:02want the reasonable doubt to reflect
- 34:05that during that period of time, Lacy
- 34:08had come back from the walk, had seen
- 34:11the burglary taking place across the
- 34:13street, confronted the burglars in the
- 34:15van. She'd been abducted in the van,
- 34:18tossed in there, and and taken away.
- 34:21Well, it's interesting. You've got all
- 34:22these different people that come forward
- 34:24and claim they saw Lacy walking that day
- 34:27and in a variety of different locations,
- 34:29all these different sightings, but on
- 34:31when you scrutinize it a little bit
- 34:33more, none of the people that claimed
- 34:34they saw Lacy that day knew her before
- 34:37that day. So, they couldn't make a match
- 34:40on familiar facial recognition the way
- 34:42you could if you see your neighbor day
- 34:44in and day out.
- 34:45>> There's a lady missing and you want to
- 34:47be helpful. Nobody is being uh there
- 34:49weren't like being sinister or nothing.
- 34:51They really saw a pregnant lady walking
- 34:53a dog, they called it in. But when you
- 34:56show them a photo lineup where if you
- 34:57show them, did you know? Do you know
- 34:59Lacy? Well, they never they didn't know
- 35:01her. But in addition to that, there were
- 35:04three other gals attractive that walked
- 35:06the neighborhood. Two of which were
- 35:08pregnant. One had a chocolate lab. One
- 35:10had a golden retriever. easily could
- 35:12have miss been mistaken as Lacy by
- 35:15somebody who's not specifically familiar
- 35:17with any of those gals. And so when it
- 35:20comes to that, intentions often times
- 35:22are good, but sometimes they're not.
- 35:24Sometimes people just want to get
- 35:26involved in the big thing that's going
- 35:27on. And there might be some of that
- 35:29going on here. Like if you knew a person
- 35:34walking, you'd recognize them and you'd
- 35:36say, "Yeah, okay, that's my neighbor
- 35:38walking her dog." But if you didn't know
- 35:39him, uh,
- 35:42you'd just call in and say you saw a
- 35:44pregnant lady. So there was there was no
- 35:47credible Lacy sightings. None.
- 36:21[Music]
- 36:23When Al Brokini first looked in the
- 36:25warehouse on Christmas Eve, he went
- 36:27there with Scott and Scott told Al that
- 36:31there was no power in the warehouse, so
- 36:33they couldn't turn on the lights inside
- 36:35the warehouse.
- 36:36Um, Al chocked that up to that there was
- 36:39no power in the warehouse section, but
- 36:41not necessarily the office, which would
- 36:42have allowed Scott to use his computer
- 36:44and things like that. So, Al turned his
- 36:46headlights into the warehouse and there
- 36:49was the aluminum boat that was on the
- 36:51trailer, but in addition to that
- 36:53aluminum boat, there was a flatbed
- 36:55trailer that was rectangular, had the
- 36:58wheels, and it had wood on the uh floor
- 37:01of it. This was used for hauling
- 37:03fertilizer because Scott sold
- 37:05fertilizer.
- 37:07on this flatbed trailer. Al looked and
- 37:11he saw what he believed to be four to
- 37:13five crescentshaped rings that were
- 37:15about the size of like a coffee can or a
- 37:19bucket that one would use if they mixed
- 37:21up readymix cement and poured it into
- 37:24the bucket to harden it to make homemade
- 37:27anchors that people often use on boats
- 37:30when they're fishing in fresh water. As
- 37:32the cement is curing into concrete, they
- 37:35take a U-shaped bend of reinforcing bar,
- 37:39they call rebar, and they stick it down
- 37:41into the cement itself. So, you have a
- 37:44loop which is going to be locked into
- 37:47the concrete once it hardens. Of course,
- 37:49you can tie a rope to that, throw it
- 37:50over the side of the boat. There's your
- 37:51anchor. And there was one anchor that
- 37:54was found in the boat. Found in the
- 37:56front of the boat. Um, bucket wasn't on
- 37:58it. We never did recover the bucket.
- 38:00Don't know where that is. suspect it's
- 38:01probably on the bottom of San Francisco
- 38:03Bay. But the funny thing about the
- 38:06anchor that was in the front of Scott's
- 38:07boat is there was no anchor rope for it.
- 38:10And an anchor really isn't going to do
- 38:12you a lot of good if you're anchoring
- 38:13your boat if you don't have a rope to
- 38:15attach it to. So just little things like
- 38:17this make detectives suspicious and it
- 38:22puts us in a position where we need to
- 38:23look at these things a little bit
- 38:25further. But as they start to mount up,
- 38:28they start to be more than just
- 38:30interesting. They start to become kind
- 38:31of compelling.
- 38:37I've been asked the question of why the
- 38:39Peterson case has become so big and and
- 38:42for us working murderers uh
- 38:46140 of them I think is a little more
- 38:48than 140 when I retired.
- 38:51There were we had a lot of interesting
- 38:53cases. A lot of intriguing cases. And
- 38:55this wasn't really in necessarily in the
- 38:56top 10 of really intriguing cases. It
- 38:58was the the media interest in it made it
- 39:03kind of what it was.
- 39:06Slow news cycle. Um I don't know, maybe
- 39:09there wasn't much going on that the news
- 39:10people could, you know, grab on to. But
- 39:13you throw on top of it, it's a holiday
- 39:15season. You've got a girl who's pregnant
- 39:17and of course there's an enormous uh
- 39:21amount of people that are watching the
- 39:22news that can identify with that, put
- 39:24themselves in that position. You've got
- 39:27an attractive uh victim, you've got an
- 39:30attractive husband, you've got a
- 39:32mystery, and as the local news grabbed
- 39:36on to it, I had heard in the past that
- 39:40there were family members that had
- 39:41notified uh the major network, at least
- 39:45one of the major networks, and mentioned
- 39:46this case because they had a contact
- 39:48there in New York or someplace back
- 39:51east. and that might have kickstarted
- 39:53the national interest in the case. But
- 39:56with that, of course, the way the media
- 39:58works is they don't want to be the ones
- 39:59left out of a big uh story. So, they all
- 40:02pile on top of it and grab for every
- 40:04bite they can get. Um, it made our job a
- 40:07little bit more difficult because there
- 40:09was um a lot of things that we wouldn't
- 40:12have had to do if the media hadn't been
- 40:14so um attracted to this case. It created
- 40:17a lot of wild goose chases that we had
- 40:19to go down that we knew were probably
- 40:21ridiculous from the start. We had a lot
- 40:23of people that wanted to get involved in
- 40:24this case that had nothing to do with
- 40:26it. I remember there was one person that
- 40:28claimed they'd seen Lacy in a grocery
- 40:30store up in Washington and the local
- 40:33authorities up there spent an enormous
- 40:35amount of time reviewing videotape and
- 40:37things like that and they finally
- 40:39determined that this person was making
- 40:40it up. And you get a lot of people that
- 40:43that come forward. I gosh, I remember
- 40:45all the psychics that would call and it
- 40:47would be interesting. They'd call and
- 40:50they'd want to, you know, who am I
- 40:52talking to? And I'm thinking to myself,
- 40:53well, you're the psychic. You ought to
- 40:54know who you're talking to. And they'd
- 40:56always say things like, well, we believe
- 40:58her remains are in salt water or
- 41:00something like that. And like, well,
- 41:02that's helpful. You know, threequarters
- 41:04of the surface of the earth is covered
- 41:05in salt water, so that doesn't narrow it
- 41:07down much. But we had to spend time with
- 41:09all those people, and it took up a lot
- 41:11of investigative time to put those
- 41:13things together. You can't leave them.
- 41:15You can't leave those things hanging
- 41:16because the defense is pretty sharp most
- 41:18of the time. And if they see that you
- 41:21didn't do something that you should have
- 41:22done and it looks one-sided that you're
- 41:25only going after Scott, uh then they're
- 41:27going to attack you viciously in court.
- 41:30And the funny thing about Scott is for
- 41:33the first several days, like first week
- 41:35or so, we couldn't find anything wrong
- 41:38with this guy. I mean, he was just the
- 41:41all-American boy, college student. He's
- 41:44got the baby on the way. He's got the
- 41:46pretty wife. He's belongs to the country
- 41:48club. He's got all these things going.
- 41:50He's got this circle of friends. And and
- 41:53just nobody had a bad word to say about
- 41:55him until Amber came forward. We almost
- 41:59like hit a lull in the investigation
- 42:01right at the end of December, beginning
- 42:03of January. And we were in the office
- 42:05and we had a tip line up 24 hours a day.
- 42:08And I was standing behind one of our
- 42:10clerks, Bev, and she was typing and I
- 42:13was reading over her shoulder and she's
- 42:15typing, uh, Scott Peterson's my
- 42:18boyfriend. You know, I met him on
- 42:20November 20th and he, you know, he calls
- 42:23me every day and I'm like, Bev, uh, is
- 42:26that lady on the phone? And she said,
- 42:28"Yeah." And so I took the phone from her
- 42:30and it was a gal. She says her name was
- 42:33Amber Fry and she said she's dating
- 42:35Scott Peterson and that's her boyfriend.
- 42:36And I said, "Does he know you're
- 42:38calling?" And she said, "No." I said,
- 42:40"Well, don't tell him."
- 42:41>> And Al got a couple more tidbits from
- 42:43her and said, "We're on our way. Don't
- 42:46go anywhere." And she said, "Yeah, I'll
- 42:48wait for you guys." So he grabs me. We
- 42:50go into the sergeant's office and we
- 42:51tell Al Carter, you we've got this lead
- 42:53down in Fresno. And Al said, "Go. Just
- 42:57don't tell anybody about it." Detective
- 42:59Buer and I uh let our sergeant and
- 43:02Detective Grogan know where we're going
- 43:04and we drove straight to her house and
- 43:07met with her and her friend Sean Sibi
- 43:10that uh had introduced Scott to Amber.
- 43:14And
- 43:16from there she told us a story that was
- 43:18pretty incredible.
- 43:19>> And because we're trying to keep kind of
- 43:20a clamp on details like this cuz we
- 43:23don't want it getting out. We get to
- 43:24Amber's place and she's got her friend
- 43:26Shawn Sibi there with her and Shawn is
- 43:29uh the u Amber's friend who had
- 43:32introduced Scott to Amber. Uh Shawn had
- 43:35been at a pest convention for
- 43:37agricultural pest convention down in
- 43:39Anaheim I think in like November or
- 43:41something like that or October and she
- 43:43had met Scott down there along with
- 43:45other people that were involved in
- 43:46fertilizer and pest things for
- 43:48agriculture. And Scott had projected
- 43:51himself at this uh convention that he
- 43:54was single and he was looking for a
- 43:56girlfriend and things like that. And and
- 43:58Shawn started talking to him. She was
- 44:00engaged, so she wasn't interested in
- 44:01him. And she said, you know, she thought
- 44:03of Amber and she, you know, I got this
- 44:05friend. She's really nice, but you know,
- 44:07don't break her heart. You know, don't
- 44:08treat her like garbage. And Scott has a,
- 44:12you know, he's very engaging. He's
- 44:13charming and things like that. And so he
- 44:18ends up contacting Amber. They start
- 44:20dating and when we get down to Amber's
- 44:23place, she starts telling us about how
- 44:25he started romancing her from the start
- 44:27by bringing her roses and um he had
- 44:31strawberries and champagne in his room
- 44:34at the the Sherin or the Rison, whatever
- 44:37he was staying at.
- 44:38>> November 20th. Uh and Scott said he was
- 44:42not married. It was a blind date. Scott
- 44:44asked Amber, "Hey, do you mind coming up
- 44:45to my room um so I can clean up and
- 44:49change and go to dinner?" And so she
- 44:51agreed and he wowed her uh and then they
- 44:55went to dinner and that's their dating
- 44:58relationship started right then on
- 45:00November 20th and it just kind of took
- 45:03off from there. He told her that he
- 45:04lived in Sacramento, but his office was
- 45:06in Modesto and and he traveled a lot and
- 45:09fed her these stories about overseas
- 45:12travel. And part of it was probably
- 45:13true, but not all of it. And um he
- 45:16mentioned to her that he was going to be
- 45:19having uh uh a lot of travel during the
- 45:21holidays and through January, but he was
- 45:24going to be available for a lot more
- 45:25time together after the end of January.
- 45:28And she is just digging all this because
- 45:31uh she's looking for a good guy. She's a
- 45:33single mother. I think her daughter was
- 45:35about two years old at the time. And
- 45:37Scott was very attentive with her
- 45:39daughter and all that. And and Amber was
- 45:42interesting to talk to because she it's
- 45:45almost I got the impression she didn't
- 45:48think that we would believe her on this.
- 45:50And so she had wine corks from they'd
- 45:53had bottles of wine at dinner and she
- 45:55had programs from events they had gone
- 45:58to and and things like this. And so
- 46:00she's showing us all these items that
- 46:04confirm that they had been going to
- 46:07dinner and doing all these different
- 46:08things. And we really had no reason to
- 46:11to
- 46:12disbelieve her at this point. Uh Sean
- 46:15Sibi, we interviewed them separately,
- 46:16recorded of course, and she provided the
- 46:19same information, but not as with as
- 46:21much detail as Amber did. And then what
- 46:24what we found out throughout all this is
- 46:26Amber didn't watch television and she
- 46:29Fresno was not in the Sacramento market
- 46:31for media coverage. So at the beginning
- 46:33before the new the news coverage got
- 46:35giant, she wouldn't have caught it
- 46:37anyway because she wasn't watching TV.
- 46:39But a friend of hers who was a Fresno
- 46:41cop um he'd caught the coverage and he
- 46:44had remembered that she was dating a guy
- 46:47named Scott Peterson. And so he had told
- 46:49her that you probably ought to get a
- 46:51hold of these Modesto cops. The guy
- 46:53you're dating could be the same guy
- 46:55that's involved in this missing thing.
- 46:57And so that's why she finally called us.
- 47:00And when we finished up with the
- 47:02interview, we had pretty much all the
- 47:04information we need. Uh at that time, uh
- 47:07we were going to go eat lunch. So we
- 47:09asked them if if Shawn and Amber wanted
- 47:11to go with us. We figured, well, if
- 47:12we're eating and they're eating with us,
- 47:14they might come up with some other
- 47:15things that we remember, and we can jot
- 47:16those down, too. before we went to the
- 47:18restaurant, Amber comes out with this
- 47:20little jewel out of left field. Totally
- 47:22unexpected. And she goes, "Um, she'd be
- 47:25interested in some pictures."
- 47:27And I'm thinking, "Well, uh, what?" And
- 47:30she said, "Well, if Scott and I," it's
- 47:32like, "Yeah, we'd we'd probably be
- 47:34interested in those." And so, we go to
- 47:37Write Aid or CVS, Walgreens, I don't
- 47:39remember which it was. And she gives a
- 47:41claim ticket to the gal behind the
- 47:42counter, and she comes out with this
- 47:44envelope that's got the double pictures.
- 47:46So, it's got photo prints but doubles.
- 47:50And um you know, this is kind of before
- 47:51cell phone camera stuff was out there.
- 47:54And we open these things up and here
- 47:57they are. Um Scott in the tuxedo, Amber
- 48:00in the red dress. I mean, just a whole
- 48:02slew of these pictures, them sitting on
- 48:04the couch, you know, he's whispering in
- 48:06her ear, all this ridiculousness. And
- 48:08these are just epic. And anybody who's
- 48:10probably watching this probably saw
- 48:13those pictures. And um so yeah, it kind
- 48:16of locked in at that time that she
- 48:18wasn't full of um you know, baloney. She
- 48:20was telling the truth and we said,
- 48:23"Yeah, we'll take these pictures.
- 48:24That'll be good." soon as we saw the
- 48:25photo of him at the Christmas party with
- 48:28Amber and after interviewing Amber and
- 48:31she's telling us all these
- 48:35stories and gifts and cards and things
- 48:39and they're all coming from Scott's shop
- 48:41and the fact that she even told us the
- 48:44first day that Scott had told her on
- 48:49December 9th that he lied to her
- 48:52originally when he said he wasn't
- 48:54married and he broke down and he was
- 48:57sobbing and she was consoling him and he
- 49:00had said he lost his wife and this was
- 49:03going to be the first holiday without
- 49:05her and when we get to the drugstore
- 49:07right next door is a radio shack and I
- 49:09said well if he calls you every day do
- 49:10you mind I'm going to go buy you a tape
- 49:12recorder some tapes and a wire you plug
- 49:15it in your phone and she said I'll you
- 49:18know okay and so I bought it and we
- 49:20didn't really know what her alliance was
- 49:22at that time but she called us So, we
- 49:24thought it's probably worth a gamble.
- 49:26>> And I'm plugging it in her phone for her
- 49:28and I'm showing her, okay, when he
- 49:30calls, push the these two buttons and
- 49:33sure enough, the phone rings right while
- 49:35I'm holding it and it's him.
- 49:36>> The number shows up on her screen. Al
- 49:38recognizes the number. I didn't. And so
- 49:41Al told her, "Well, take that call." And
- 49:42so she did. So she started talking to
- 49:44him.
- 49:44>> And I said, "Amber,
- 49:46you know you're on and uh don't tell him
- 49:49that we're here." and she talked to him
- 49:52like she was his girlfriend, you know,
- 49:54or and uh she did a great job. And after
- 49:59when we left, I left her with a whole
- 50:01bunch of tapes and I just asked her to
- 50:03every time he calls you to tape it for
- 50:05us and we'd pick them up.
- 50:07>> I finally calmed down from it. So,
- 50:11>> I'm sorry, baby. I'm so good for you.
- 50:15>> I miss you, too.
- 50:17I miss you.
- 50:20You don't deserve any pain or any
- 50:21heartache or any arguments or anything.
- 50:24>> So then why don't you tell me something
- 50:25nice?
- 50:27Tell you how wonderful you are.
- 50:30That's pretty easy to do.
- 50:33Howful you are.
- 50:36I always call you when I tell you you're
- 50:38special.
- 50:40Well, she didn't know it at that time,
- 50:41but we already had a court-ordered wire
- 50:44intercept going on Scott's phone, so
- 50:45that call was going to be picked up
- 50:47anyway.
- 50:48>> Our our next thing was to record Scott's
- 50:51conversations,
- 50:53follow him, continue zeroing in on him.
- 50:57That was my job. Other people did other
- 50:59things, but my job was to stay with
- 51:01Scott, clear him of any involvement in
- 51:05this. The family still doesn't know any
- 51:07of this. We're just zeroing in on Scott
- 51:10now.
- 51:11>> Amber was interesting because she was
- 51:14very fragile and I was the only single
- 51:18guy in the unit. All the other guys I
- 51:20worked with were married and they so Al
- 51:22Carter assigned her to me to kind of be
- 51:26her handler because we knew that she was
- 51:29going to be calling at all hours because
- 51:31every time she got off the phone from a
- 51:33call with Scott, she was kind of a wreck
- 51:36for a while. So, she'd call me and then
- 51:38I'd kind of have to talk to her about
- 51:40what's going on and everything and calm
- 51:43her down. I didn't tell her what to say.
- 51:44We didn't have to because she she
- 51:48no training whatsoever. We're not
- 51:50getting paid or anything like that, but
- 51:52she was able to weave these
- 51:54conversations into bringing out details
- 51:57from the past that she had told us
- 51:58about, but we had no documentation on.
- 52:01And Scott apparently had no idea that
- 52:04this was going on. Well, we also had
- 52:06Amber's call on a wire intercept to make
- 52:09sure that we could monitor her calls if
- 52:11she wasn't recording them so that we
- 52:13would know that she wasn't filling Scott
- 52:15with information of what was going on.
- 52:17>> What were you hoping to get?
- 52:19>> Well, I was we were hoping to get I
- 52:22don't know, incriminating information,
- 52:23but at first they never I mean they talk
- 52:26like boyfriend and girlfriend. Even
- 52:28though his wife was missing, she claimed
- 52:31to not know about it. But what Amber
- 52:34didn't know was as soon as we did that,
- 52:37we also went and got a phone, put a
- 52:40phone tap. We tapped Scott's phone, his
- 52:43home, his two cell phones because we
- 52:47wanted to confirm that Amber was being
- 52:50straight with us. She wasn't like
- 52:52conspiring behind our back with him. She
- 52:56had over 29 hours of recorded phone
- 52:59conversation during the time that we had
- 53:00her up uh on the wire. And in that
- 53:03amount of time, I think she missed eight
- 53:05minutes of conversation, probably when
- 53:07she was hooking the device up, her
- 53:08daughter's in the backseat of the car,
- 53:10things like that. But her uh her ability
- 53:14to keep things calm and not tip her hand
- 53:18that she'd already talked to us was
- 53:19remarkable. I thought she did a
- 53:21fantastic job and apparently the jury
- 53:23did too because they enjoyed that or
- 53:25found it very useful in the trial.
- 53:27>> So, while we're still listening to the
- 53:30Amber and Scott talk and we're
- 53:33wiretapping Scott's phone, we get
- 53:35information from the inquire that they
- 53:40have the photo of Amber and Scott and
- 53:43they're going to publish it the next
- 53:44day. Although Al Brokini and I had taken
- 53:47the photo prints from Amber when we'd
- 53:50gotten those at the photo counter,
- 53:53I had left
- 53:56the negatives to those photos with Amber
- 53:59so that she would know that we trusted
- 54:01her. And I and there were other photos
- 54:03on there that had nothing to do with the
- 54:04Peterson case. I didn't think we could
- 54:06really take those. Uh she said that she
- 54:08was going to make sure they were
- 54:09protected. I I can speculate on that,
- 54:11but that's not necessary. Anyway,
- 54:13somehow those photos either got out or
- 54:16they were photos taken by somebody who
- 54:18was there and they got released and the
- 54:21next thing you know the National
- 54:22Enquirers got one of the photos with
- 54:24Amber in the red dress and Scott in the
- 54:26tux and they're going to run it in that
- 54:29week's edition of the National Enquirer.
- 54:32So that pushed us to have to
- 54:37break the news to to Sharon and to Lee
- 54:40and Jackie. Well, we have never dealt
- 54:43with that before on a case. We've dealt
- 54:45with a lot of things in homicide before.
- 54:47So, we roundt that. What do we do on
- 54:49that? Well, you can't you can't ignore
- 54:51it. And at the same time, we don't have
- 54:54the authority to tell the inquirer,
- 54:55don't run it there. First amendment
- 54:57rights trump what we want done on the
- 54:59case. And so, we knew that they were
- 55:01going to publish it. But we also don't
- 55:03want the family members, especially the
- 55:05roaches. Um, you know, can you can
- 55:07imagine Sharon going to the grocery
- 55:09store and she's at the check stand and
- 55:11here's a picture of Scott and Amber who
- 55:14she'd never met there at the check
- 55:17stand. We can't do that to the family.
- 55:19So, we
- 55:21called Sharon and Ron Gransky and asked
- 55:23them if they would come down to our
- 55:25office so that we could talk to them.
- 55:28And this wasn't something that we did
- 55:29very often. So, Brokini and I were going
- 55:31to speak with them. Craig Grogan uh
- 55:34along with another Modesto officer who
- 55:36had a pilot's license and Phil Owen,
- 55:38another Modesto detective took a a plane
- 55:40and they flew down to San Diego to meet
- 55:43with Scott's parents. And the plan was
- 55:45that both sets of family members were
- 55:48going to be shown this photo. And uh I
- 55:52wasn't in the San Diego part of the
- 55:54trip, so I not going to comment too much
- 55:56on that, but we brought Sharon in and
- 55:59Ron and they were um they were
- 56:03apprehensive cuz we didn't call them to
- 56:05come and meet with us very often and
- 56:08made a little bit of small talk and
- 56:09everything. And they were scheduled to
- 56:11do an interview that night with Greta
- 56:12Van Sustern. So this was before they
- 56:15were going to do the interview. So, we
- 56:16had the um photo and I had it in a
- 56:19folder and Sharon was sitting across
- 56:21from me and I said, "Well, there's some
- 56:22things that have developed on this case
- 56:24and we want to make you aware of them
- 56:26before you get surprised and ambushed by
- 56:28them."
- 56:28>> And uh John just
- 56:32shared the photo and slid it across the
- 56:35table and it uh Sharon just broke down
- 56:39and and she just like why why did he
- 56:43have to kill her? Sharon Roachcha looked
- 56:45at it and I just remember her words. She
- 56:48just said, "Why did he have to kill
- 56:49her?" And then she buried her head in
- 56:51her hands and started weeping. And
- 56:54Gransky pretty much in the same
- 56:55condition. And
- 56:59I think this is probably the first time
- 57:00that she
- 57:02had concrete proof that probably
- 57:05substantiated the fears that she had all
- 57:07along that Lacy wasn't coming home. And
- 57:10we gave them a little bit quick briefing
- 57:12on what took place on this and we said,
- 57:13you know, don't draw any necessarily
- 57:14conclusions for this. You know, keep an
- 57:16open mind and then they cancelled their
- 57:18interview with Greta and then they left
- 57:21the office. So that was pretty much it
- 57:24on that. It was um it's that's
- 57:26heartbreaking for when you see that even
- 57:28though you're not related to these
- 57:29people, you you can try to understand
- 57:32what their pain is like, but pretty
- 57:34difficult if you're not in that boat.
- 57:36>> It was pretty sad.
- 57:39compared to the way it went in San Diego
- 57:42when they showed it to Lee. Lee looked
- 57:45at it and said, "So, so what?" I mean,
- 57:49you know, just because he's having an
- 57:51affair doesn't mean he killed, you know,
- 57:53Lacy. It was no big deal to the Peterson
- 57:57side of the family.
- 58:51I wrote a search warrant for Scott's DNA
- 58:54for his hair, blood, saliva,
- 58:58um, and then fingerprints, palm prints,
- 59:01and pictures of his him his his body.
- 59:04And I we called him in and I said, "We
- 59:06have a search warrant to get this stuff
- 59:08from you." So, while he's in there, um,
- 59:11we show him a a a faxed copy of the
- 59:14photo. We ran it through a fax machine,
- 59:17so it was black and white. And when we
- 59:19showed it to him, we said, "Hey, we got
- 59:21a tip." Uh, and we showed him the photo
- 59:23and he picked it up and he's looking at
- 59:25it and he goes, "You don't think that's
- 59:27me, do you?" And we said, "Well, we
- 59:30don't know. This is the tip we got." No.
- 59:31He said, "That ain't me." And he gave it
- 59:34back.
- 59:40Okay, first of all, I met Scott Peterson
- 59:43November 20th, 2002. I was introduced to
- 59:47him. I was told he was unmarried.
- 59:50Scott told me he was not married.
- 59:54We did have a romantic relationship.
- 59:57When I discovered he was involved in the
- 59:59disappear or the Lucy Peterson
- 1:00:01disappearance case, I immediately
- 1:00:04contacted the Modesto Police Department.
- 1:00:07just her saying it wasn't enough. We
- 1:00:09needed to cooperate her and that's what
- 1:00:13we were able she was able to do on those
- 1:00:15phone calls. She got him to admit that
- 1:00:18he had told her that he lost his wife on
- 1:00:20December 9th.
- 1:00:22>> You deserve so much better.
- 1:00:25There's no question so much better.
- 1:00:27>> Yeah. And I deserve to understand an
- 1:00:29explanation of why you told me you had
- 1:00:31lost your wife and this was the first
- 1:00:33holidays you'd spend without her. That
- 1:00:35was December 9th. You told me this. And
- 1:00:38now all a sudden your wife's missing.
- 1:00:40Are you captioning me?
- 1:00:44>> Did you hear me?
- 1:00:45>> I did. I I I I don't know what to say.
- 1:00:49>> I I think an explanation would uh be a
- 1:00:52start.
- 1:00:54>> I know you absolutely deserve an
- 1:00:57explanation.
- 1:00:57>> Yes, I do. I do. And you want to protect
- 1:01:00me from the media? Why did you involve
- 1:01:02me in this?
- 1:01:04How long were you looking for me? Scott,
- 1:01:07>> I'm sorry.
- 1:01:07>> How long were you looking for me?
- 1:01:10>> Looking for you?
- 1:01:11>> Isn't that what you told Sean? You were
- 1:01:12looking for me or someone like me?
- 1:01:16>> When Al Brokini called me in on
- 1:01:18Christmas Day and he told me what had
- 1:01:20happened to Lacy and that she was
- 1:01:21missing. And then he did the bio on her
- 1:01:23and told me about her. My belief was
- 1:01:26this was a murder case and at the time
- 1:01:28it was a nobody case. There is a
- 1:01:31protocol to follow when you're
- 1:01:33investigating a case where you don't yet
- 1:01:35have a body and I had just had one of
- 1:01:37those the August prior and I had that
- 1:01:41protocol and so we started working this
- 1:01:44as a nobody homicide. We didn't tell the
- 1:01:45media that. We certainly didn't tell the
- 1:01:47family that. But you can only
- 1:01:51gather evidence in chronological order
- 1:01:54if you know what you're doing. And if
- 1:01:56you don't work it as a homicide from the
- 1:01:57beginning, you're going to overlook and
- 1:01:59you're going to lose evidence that
- 1:02:00you're going to need later on. So those
- 1:02:02things are kept confidential in the
- 1:02:04investigation. You don't release that.
- 1:02:06Um, and when it came to this, we got to
- 1:02:10the point where
- 1:02:13there were little avalanches of
- 1:02:15information that would come in. So like
- 1:02:17when Amber came up on the radar, there
- 1:02:19was like an avalanche of things that we
- 1:02:21had to do within a short period of time.
- 1:02:23And just about the time we were
- 1:02:24finishing getting that all investigated,
- 1:02:27then another avalanche of information
- 1:02:29would come in. And the the case kind of
- 1:02:30had that for the whole four months or so
- 1:02:33that we worked on it. Uh when we were
- 1:02:35getting towards the tail end before the
- 1:02:37bodies showed up, there really wasn't
- 1:02:39much left to do on this except convince
- 1:02:42the DA to file charges against Scott,
- 1:02:44get an arrest warrant, and bring him in
- 1:02:46and start the process. We're still
- 1:02:48zeroing in on Scott and we're searching
- 1:02:52the bay. And you got to remember Scott
- 1:02:55on five occasions
- 1:02:57drove from Modesto to the bay to watch
- 1:03:01just to look at us. And we followed him
- 1:03:05a couple times. We tracked him with
- 1:03:07trackers a couple times. But I mean, he
- 1:03:10drives up there. There's police there.
- 1:03:13He could get out and say, "Hey, uh,
- 1:03:15what's going on? How's it doing? You
- 1:03:16guys find anything?" But no, he just
- 1:03:18drives, looks five minutes at the most,
- 1:03:21and goes back.
- 1:03:22>> Scott is a very um very charming, very
- 1:03:25convincing person.
- 1:03:27And
- 1:03:29you, we saw this throughout his phone
- 1:03:31calls, uh whether he was talking to his
- 1:03:33dad and his, you know, brother, things
- 1:03:36like that. He could transition from
- 1:03:39weeping with Amber on the phone over
- 1:03:42something and then the next moment he's
- 1:03:44on a phone call talking to his dad about
- 1:03:46going to have cocktails in Delmare or
- 1:03:48something like that. His his
- 1:03:50chameleonike ability to transition from
- 1:03:53one role to another was was very
- 1:03:56interesting. Great actor. But his phone
- 1:03:58conversations they they kind of showed a
- 1:04:01a side of him also and they can be
- 1:04:03interpreted a couple of different ways
- 1:04:04depending on how you want to look at it.
- 1:04:06There was one call in particular. Uh
- 1:04:08media frenzy was taking place when the
- 1:04:11bay search was uh locating something
- 1:04:14that was on the bottom of San Francisco
- 1:04:16Bay that could have been a body. San
- 1:04:18Francisco, Marin County, Oakland. They
- 1:04:22every city on the bay had a boat. We put
- 1:04:25a detective on every boat and with a
- 1:04:29dive team from th those cities. And so I
- 1:04:32was on the Marin County boat and uh they
- 1:04:36had sonar boats out there and they would
- 1:04:38search for
- 1:04:41objects that looked like it could be a
- 1:04:43body and if they found one they would
- 1:04:45pinpoint it and then we would send a
- 1:04:47boat there and we would send divers down
- 1:04:50and to figure out what it was. One of
- 1:04:52the things they found they found
- 1:04:55something that looked like you know like
- 1:04:56this like it could be a body. This is
- 1:04:59before she came up. And so it was late
- 1:05:02at night. The dive team couldn't go down
- 1:05:03in the dark. So they're going to go down
- 1:05:05the next morning.
- 1:05:07So
- 1:05:09big anticipation. All the news know
- 1:05:12they're all waiting. Sharon, this is
- 1:05:14before Sharon knew about Amber. Sharon's
- 1:05:17still on Scott's side. And uh Scott
- 1:05:21decides he has to go to work that day.
- 1:05:24So he leaves. Well, we we don't follow
- 1:05:26him, but we know where he's at by his
- 1:05:29phone, and uh everybody's waiting,
- 1:05:32holding their breath. The dive team goes
- 1:05:34down, comes up. It turns out it's just a
- 1:05:37big anchor, an old anchor.
- 1:05:39>> And so, this information was given to uh
- 1:05:42Sharon Roach. So, she called Scott on
- 1:05:44his cell. And Scott had a habit of very
- 1:05:47seldom picking up the phone. He would
- 1:05:48screen his calls, listen to the
- 1:05:50voicemails, and then decide what to do
- 1:05:51with the calls. Well, the call from
- 1:05:54Sharon uh said that
- 1:05:57it was a boat anchor. Nothing to worry
- 1:05:58about there. Of course, we knew that
- 1:06:00we're going to find her. You know, just
- 1:06:02some sweet message from Sharon to Scott.
- 1:06:05Well, we got the wire tap on him so we
- 1:06:07could hear him and so we can hear him
- 1:06:10pick up his messages. Soon as he starts
- 1:06:11dialing, we can we hear it. He dials his
- 1:06:14puts his code in and hears Sharon's
- 1:06:16message.
- 1:06:17>> You have one unheard message. First
- 1:06:20message. Hi Scott, this is mom. It's
- 1:06:23about4 211. Just want to know I just got
- 1:06:26a call from Ron Ron Clard. He's at
- 1:06:28Marina and it was a boat anchor. Of
- 1:06:30course, we knew it wasn't Lacy, but I
- 1:06:32just wanted you to know. Um I'm going to
- 1:06:34call your house in case you don't get
- 1:06:36this message first. Bye.
- 1:06:39>> Message erased.
- 1:06:40>> And then you hear him go
- 1:06:44just like that. Like
- 1:06:47now he's been radio silent all day.
- 1:06:50Well, now all of a sudden after he has
- 1:06:53that moment, meaning it wasn't her, they
- 1:06:57didn't find her yet. Uh, now he's on the
- 1:07:00phone ordering pizza and, you know,
- 1:07:02x-rated movies from the hotel he's
- 1:07:05staying at. And, uh, then so he can go
- 1:07:08from ordering a pizza and an x-rated
- 1:07:10movie to his sister calling him and he
- 1:07:13answers and now he's blow he's
- 1:07:15blubbering like a baby. Oh my god, he's
- 1:07:17just crying and but
- 1:07:21the next phone call he's fine again. I
- 1:07:23mean, it's just the man was a piece of
- 1:07:26work. Now, other people could say, and I
- 1:07:29can see it both ways, they can say,
- 1:07:30"Well, he made that whistle because he
- 1:07:32was relieved that Lacy could still be
- 1:07:34out there." Well, it just depends on
- 1:07:35which way you look at it and which way
- 1:07:37it goes. And that's what the jury is
- 1:07:38for, is to make those determinations.
- 1:07:40But Scott, he he was talking to Amber
- 1:07:43when he was at the vigil on New Year's
- 1:07:45Eve. And there were there's a photo uh
- 1:07:47that was taken of Scott. He's all
- 1:07:49smiles. Everybody else is a wreck. And
- 1:07:52he's on the phone talking to Amber. Uh
- 1:07:55she's down in Fresno. He's in Modesto.
- 1:07:57He's talking about how he's over in
- 1:07:58Paris uh walking on the decoed or
- 1:08:03covered cobblestones
- 1:08:05uh during the fireworks by the Eiffel
- 1:08:07Tower. and um that there's American pop
- 1:08:11songs being played in the background,
- 1:08:13painting a vivid, incredible picture um
- 1:08:17of what he's doing over there with the
- 1:08:18correct time frame, too. He's got it
- 1:08:21right at New Year's celebration, you
- 1:08:23know, which is the time frame between
- 1:08:25Modesto and and Paris. Uh the guy, he
- 1:08:28really was gifted in putting these
- 1:08:30things together. Great actor. Um but he
- 1:08:33he's at his wife's vigil on this. And to
- 1:08:36me, this is a pretty strong indicator
- 1:08:39that he just didn't give a crap about
- 1:08:41Lacy. He was tired of all this hoopla.
- 1:08:44He just wanted it to be over. And it
- 1:08:47hearkens back to that one thing that he
- 1:08:49told Amber early on that after January,
- 1:08:51he would have a lot more time to devote
- 1:08:53to their relationship. And I my
- 1:08:56suspicions is he compared the media
- 1:09:00length and coverage on Kristen Smart,
- 1:09:02the missing girl from down there in St.
- 1:09:04Louis Abyspo to uh this thing and
- 1:09:08probably thought it was going to be over
- 1:09:10within a month, not having any idea that
- 1:09:12the media was going to grab onto this
- 1:09:14like a pitbull and not let go.
- 1:09:18>> Happy New Year.
- 1:09:19>> Happy to call you.
- 1:09:21>> Thank you.
- 1:09:22>> Are you there?
- 1:09:22>> I'm here.
- 1:09:24>> I wish you could hear me.
- 1:09:26>> I'm on the uh I think I think that
- 1:09:28you're there. I'm near the Eiffel Tower,
- 1:09:32which is unreal.
- 1:09:34The crowd is huge.
- 1:09:36>> The crowd's huge.
- 1:09:37>> Amber.
- 1:09:39>> Yes, I'm here.
- 1:09:40>> Amber, you're there. I can't hear you
- 1:09:42right now, but I'll call you on your
- 1:09:43knees.
- 1:09:47[Music]
- 1:09:53I'm always suspicious of the person
- 1:09:54closest to the victim. And that's how
- 1:09:56you start a murder investigation is you
- 1:09:58always look at the person closest
- 1:10:00because you have to work outwards from
- 1:10:02there. and you're going to be attacked
- 1:10:05in court if you don't clear people that
- 1:10:07are close to the victim. So, this is the
- 1:10:09reason that detectives have to have, you
- 1:10:12know, the obnoxious task of asking close
- 1:10:15family members things that are
- 1:10:16uncomfortable. You like, are you do you
- 1:10:18have anybody else on the side? You know,
- 1:10:20do you have a drug habit? Do you have a
- 1:10:22gambling habit? Anything like this that
- 1:10:24could come up that would, you know, give
- 1:10:25a motive or something like that. So with
- 1:10:28Scott, as as time went by, that first
- 1:10:30week, it was really tough to find
- 1:10:32anything wrong with him. And so I wasn't
- 1:10:34convinced that he had anything to do
- 1:10:35with it. I just was pretty much
- 1:10:36convinced that Lacy wasn't coming home.
- 1:10:38But once Amber came forward and then we
- 1:10:39saw there was this other side of the
- 1:10:41guy, then as we start adding up all the
- 1:10:44circumstantial evidence, it starts
- 1:10:46becoming much more interesting, much
- 1:10:48more compelling. At the same time that
- 1:10:50we're clearing out anybody else that
- 1:10:52could have anything to do with this. So
- 1:10:54whether it was some other violent
- 1:10:55offender that was on parole in the
- 1:10:56community and as those guys are getting
- 1:10:59cleared from involvement by verifying
- 1:11:01their alibis and more questions are
- 1:11:03coming up from Scott. His condition or
- 1:11:05his uh cooperation becomes more
- 1:11:07conditional as that goes on. It gets to
- 1:11:10the point where it's starting to become
- 1:11:12pretty obvious that he had something to
- 1:11:14do with this little things that came up
- 1:11:16during this time period before Amber
- 1:11:19came forward. Nobody had anything bad to
- 1:11:20say about Scott. And that's partially
- 1:11:23because people are smart. They don't
- 1:11:24want to create an atmosphere where if he
- 1:11:26didn't have anything to do with it,
- 1:11:28those words are going to haunt them in
- 1:11:29the relationship in the future. But over
- 1:11:31and above that, when Amber came forward
- 1:11:33now, it kind of on peeled back layers of
- 1:11:36this onion and people would start
- 1:11:38telling us information whether it was
- 1:11:40Lacy's friends, family members, things
- 1:11:43like that. little tidbits about they
- 1:11:46were at a barbecue the the summer before
- 1:11:48Lacy became pregnant and there was a new
- 1:11:51baby there and everybody was holding the
- 1:11:53baby and when they were trying to get
- 1:11:55Scott to hold the baby he recoiled from
- 1:11:58it like it was a rattlesnake. He didn't
- 1:11:59want to be involved in that. Um, I
- 1:12:01remember there was a quote that somebody
- 1:12:03had attributed to him that when Lacy
- 1:12:05became pregnant and they were at a
- 1:12:06barbecue and they said something to him
- 1:12:08about, "Well, you're probably pretty
- 1:12:09excited about the baby coming along."
- 1:12:11And he made this offhand, yeah, kind of
- 1:12:13humorous comment. Well, I was kind of
- 1:12:15hoping for infertility. Well, by
- 1:12:17themselves, they really mean nothing.
- 1:12:19But they also start to paint a picture
- 1:12:21of a reluctant father, somebody who
- 1:12:23really isn't too excited about all this.
- 1:12:25There were things that uh during the
- 1:12:28time that Lacy was pregnant, Scott
- 1:12:30really didn't have much to do with
- 1:12:32touching Lacy's stomach and and feeling
- 1:12:34the baby or anything like that. And
- 1:12:37Sharon mentioned things like that.
- 1:12:40Little things that that don't really
- 1:12:42mean anything early on that they didn't
- 1:12:43want to say anything about, but when
- 1:12:45they start coming forward, then they
- 1:12:47start adding up and we just keep
- 1:12:50gathering and taking these uh these
- 1:12:52facts where they go.
- 1:12:58[Music]
- 1:13:19Jim Brazzleton was the district attorney
- 1:13:21in Sansaw County at the time, gifted
- 1:13:24prosecutor, but we we didn't plead with
- 1:13:26him, but we told him, "Hey, this is what
- 1:13:28we've got. We think we got a good case
- 1:13:29here." and he pretty much said, "I need
- 1:13:32a body before you get a filing." And we
- 1:13:34just thought, "Well, okay, that's the
- 1:13:36way it goes." So, we were clearing up
- 1:13:38and and tidying up loose ends so we
- 1:13:40weren't going to be in a rush. And then,
- 1:13:42just like on clockwork, uh, we get a big
- 1:13:45storm that comes through San Francisco
- 1:13:47Bay. And when it does that, the tidal
- 1:13:50surge
- 1:13:52apparently was violent enough to
- 1:13:55separate Connor from Lacy and he drifted
- 1:13:59ashore. And then it was enough to
- 1:14:02separate her from her limbs. And then
- 1:14:04her remains were brought ashore over a
- 1:14:06period of a couple of days.
- 1:14:15The body of a woman washed up on shore
- 1:14:17was discovered yesterday in Richmond,
- 1:14:19which is on the East Bay side of the San
- 1:14:20Francisco Bay yesterday. One day
- 1:14:23earlier, about a mile away from that
- 1:14:24location, a different person discovered
- 1:14:26the body of a nearly fullterm fetus.
- 1:14:28Each was found within 5 miles of the
- 1:14:30Berkeley Marina. Significant because
- 1:14:32that is where Scott Peterson, Lacy's
- 1:14:35husband, said he was fishing all day on
- 1:14:37Christmas Eve, the day he says she
- 1:14:40disappeared.
- 1:14:50We're still hoping something's going to
- 1:14:54happen, but we're in another one of
- 1:14:55those lols. And uh
- 1:14:59when we get the word that a baby has
- 1:15:01been found in the Berkeley Marina, and
- 1:15:04the baby is found right around where
- 1:15:07Scott told me he was going, where he
- 1:15:09went fishing. I remember when the first
- 1:15:11body was found, I was not optimistic at
- 1:15:14all. When Connor was discovered, I
- 1:15:15thought, "Yeah, there's a lot of people
- 1:15:16in the Bay Area and somebody else could
- 1:15:18have dumped a child in here." And it's
- 1:15:20not the first time that happened.
- 1:15:30We don't know anything yet, but the next
- 1:15:32day when the a body comes up
- 1:15:38wearing maternity clothes,
- 1:15:41doesn't have a head, doesn't have some
- 1:15:43limbs.
- 1:15:44Uh, we are fairly certain that that's
- 1:15:47Lacy and Connor.
- 1:15:59Scott Peterson has been under a cloud of
- 1:16:01suspicion from the very beginning.
- 1:16:03Police have never named him as an
- 1:16:04official suspect, but they also have
- 1:16:06never been able to rule him out. When
- 1:16:08Lacy Peterson vanished, she was 7 and a
- 1:16:10half months pregnant with a boy. Police
- 1:16:13confirmed that the baby found with its
- 1:16:15umbilical cord still attached was indeed
- 1:16:17a boy.
- 1:16:27when Lacy's remains were found um in the
- 1:16:30condition they were found. Uh that kind
- 1:16:32of pretty much cinched it. So we
- 1:16:34probably were on the right track then at
- 1:16:36that time, but we still had to wait for
- 1:16:37DNA. Detective Grogan wrote up a a Remy
- 1:16:41warrant for the arrest of Scott Peterson
- 1:16:44and I called the Department of Justice.
- 1:16:47They have a surveillance team and I
- 1:16:49asked them to find Scott in San Diego
- 1:16:52and just watch him. We we got the
- 1:16:55warrant and you know it's the judge
- 1:16:59asked us uh it's kind of a just a
- 1:17:03handshake deal with the judge. He signed
- 1:17:05a million- dollar warrant but he said
- 1:17:07can you not arrest him until the DNA
- 1:17:10comes back? And so we we agreed but we
- 1:17:13have a warrant and signed in in hand.
- 1:17:15And so, uh,
- 1:17:18Scott's hard to find. I mean, he's the
- 1:17:20car. I had a tracker on his car, but he
- 1:17:23sold it in Sun San Diego. So, we found
- 1:17:25him through the wire tap on his phone,
- 1:17:28so I could find I I we found him. We set
- 1:17:31up surveillance on him. He knew it right
- 1:17:33away. California Department of Justice
- 1:17:35was a great just a great agency to work
- 1:17:39with. Uh, one of their lead agents,
- 1:17:41Ernie Leone, fantastic. His whole crew,
- 1:17:44great guys.
- 1:17:45um skilled agents um and they had Scott
- 1:17:48under surveillance. So, we
- 1:17:51were able to get an arrest warrant for
- 1:17:53Scott uh pre-complaint arrest warrant
- 1:17:56and uh Al Carter, Al Brochini, Craig
- 1:18:00Rogan, and I the the four of us jumped
- 1:18:02in two separate cars and we drove down
- 1:18:05to San Diego and then the next day we
- 1:18:09started following Scott with great
- 1:18:11assistance from DOJ. And Scott knew he
- 1:18:14was being tailed. Uh claims were he
- 1:18:16thought it was the media. Maybe he did,
- 1:18:18maybe he thought it was us. Who knows?
- 1:18:19Only he knows. Only he would tell.
- 1:18:21Probably won't, but he could. And we
- 1:18:24started following him. But his driving
- 1:18:25was was becoming dangerous. He he was a
- 1:18:28pretty good driver. He started driving
- 1:18:30like crazy. He was uh flipping off the
- 1:18:34people, surveilling him. He was calling
- 1:18:36his brother. We could hear the phone
- 1:18:38call. He thinks they're private eyes or
- 1:18:40they're news people. He doesn't know
- 1:18:41they're cops. But he's telling his
- 1:18:44brother, "I can't really come uh golfing
- 1:18:47with you today because I got these
- 1:18:48photographers following me and if they
- 1:18:50see me on the golf course, that's not
- 1:18:52going to look good." And but he's
- 1:18:54driving so bad that even the helicopter
- 1:18:57that we had up watching them lost them.
- 1:19:01He just would drive
- 1:19:04very fast, slam his brakes on on the
- 1:19:06freeway and pull to the side. And you
- 1:19:08know, four or five undercover cars would
- 1:19:11be going by him. He would go into these
- 1:19:13neighborhoods and uh do U-turns and he
- 1:19:17just drove terrible and it got to the
- 1:19:19point where it was dangerous. He'd be in
- 1:19:21the left lane and he'd cross over three
- 1:19:22lanes of traffic, take an off-ramp. We
- 1:19:25couldn't do that. You know, we'd roll
- 1:19:26the car and so he was able to avoid and
- 1:19:29evade our tail on him. One of the agents
- 1:19:33saw him crossing an intersection right
- 1:19:34in front of him and so the chase was
- 1:19:36back on. It was a no lights and siren.
- 1:19:39But finally, our concern was and Craig
- 1:19:41Grogan's call was because he's a case
- 1:19:43agent was we need to make the arrest on
- 1:19:45Scott even before the DNA results come
- 1:19:49back. And the arrangement was the judge
- 1:19:51gave us the arrest warrant with the
- 1:19:53request to hold the execution of the
- 1:19:55warrant until the DOJ DNA results were
- 1:19:58announced. But the concern was that
- 1:20:01erratic driving was going to injure one
- 1:20:03of us or somebody who wasn't even
- 1:20:05connected to the case. So, it was
- 1:20:07dangerous for the undercover officers.
- 1:20:09And we're thinking here we are holding
- 1:20:11this million-doll warrant and if one of
- 1:20:14those guys gets killed or a a civilian
- 1:20:17gets killed by this driving,
- 1:20:21you know, is what is the judge going to
- 1:20:23back us up or are we going to be looking
- 1:20:25dirty? So, we just made a decision.
- 1:20:28Arrest them. And
- 1:20:31we called it into the undercover guys
- 1:20:33and just said just arrest them. That's
- 1:20:35when he was arrested at Tory Pines at
- 1:20:37the entrance to the golf course.
- 1:20:40Talked to him right there at the scene
- 1:20:41of the arrest. No outrage, no protest.
- 1:20:45You got the wrong guy. You guys are
- 1:20:48rookies. This is amateur hour. You guys,
- 1:20:49you don't know your what you're doing. I
- 1:20:52mean, he just was pleasant as usual. And
- 1:20:56um anyway, hair was dyed, of course, you
- 1:20:59know, trying to disguise himself. And
- 1:21:02that was pretty much his demeanor. And I
- 1:21:04know if it was me, I would have been
- 1:21:06protesting, making a lot of noise about
- 1:21:08it, but Scott, he's pretty cool cucumber
- 1:21:12for the most part when it comes to these
- 1:21:13things. The DA didn't come in yet, so we
- 1:21:16had him under arrest. We took him to a
- 1:21:18DOJ office. I took a bunch of pictures
- 1:21:20of him to show that, you know, he was
- 1:21:23not beat up or anything. And we searched
- 1:21:26his car. And I I mean, he had a lot of
- 1:21:28money. He had $14,000 or something. He
- 1:21:30had five cell phones. He had IDs from
- 1:21:34his brother and other people. He was had
- 1:21:37a tuxedo in there, but camping gear. I
- 1:21:39mean, he was ready for anything.
- 1:21:41Clothing that would work for a elegant
- 1:21:43event at the yacht club to hiking boots
- 1:21:46if you're camping in the Sierras. Um,
- 1:21:49when a guy is arrested in California, if
- 1:21:53he's arrested outside of the county
- 1:21:55where the charges are going to be filed,
- 1:21:56he has the right to say, "I'm not going
- 1:21:58back with you guys." and he can request
- 1:22:01being booked into the local jail in the
- 1:22:03jurisdiction where he's arrested. And I
- 1:22:05was kind of hoping Scott would do that.
- 1:22:06I didn't want to drive back up to
- 1:22:07Modesto with him in the back seat, but
- 1:22:09he Scott's pretty pleasant. He I'll go
- 1:22:12back with you. I was like, "Oh, great.
- 1:22:14That's fantastic." So, anyway, it's a
- 1:22:17like a six-hour drive from San Diego to
- 1:22:18Modesto, and you're not going to have
- 1:22:20him cuffed behind his back for a drive
- 1:22:23like that. So you put them in uh ankle
- 1:22:26cuffs with a chain between them so you
- 1:22:29can walk but they don't have enough
- 1:22:30length so he can't run. Um and then you
- 1:22:33have a belt a chain belt that goes
- 1:22:35around him with a padlock and handcuffs
- 1:22:38that are at the hips so he can have his
- 1:22:41hands here. He can you know scratch his
- 1:22:44face or something like that but he's
- 1:22:46cuffed so he can't fight you and he
- 1:22:48can't you know choke you when you're
- 1:22:49driving. sitting behind me and we drive
- 1:22:51and and Grogan's next to him. Al Carter
- 1:22:55and Al Brochini are in their car and um
- 1:22:58we get the call from DOJ that the
- 1:23:01results confirmed that the remains were
- 1:23:03Connor and Lacy. Craig tells that after
- 1:23:05the call to Scott and he makes like a
- 1:23:08little sniffle, like a half-hearted
- 1:23:10attempt to show some emotion and I'm
- 1:23:12kind of looking in the mirror at him and
- 1:23:14it was it just wasn't anything. And I
- 1:23:18thought, well, that pretty much cinches
- 1:23:20it for me because a guy who kills his
- 1:23:22wife 4 months earlier, that's about the
- 1:23:23reaction he's going to have.
- 1:23:26We drive a few more miles. We're getting
- 1:23:28into Bakersfield and getting gas. And
- 1:23:30it's cops like to eat. I mean, you can
- 1:23:33tell by some of them because they're
- 1:23:34kind of large and some of them maybe
- 1:23:36not. So, but we're we still got another
- 1:23:39three and a half hours from Bakersfield
- 1:23:41back to Modesto. Three hours. And so, I
- 1:23:44open up the back door of the car. I'm
- 1:23:46putting gas in it. And I asked Scott, I
- 1:23:48said, "Hey, we're going to get a bite to
- 1:23:49eat. You know, we'll feed you if you
- 1:23:50want to if you want to eat with us." And
- 1:23:52he was, you know, he was pleasant the
- 1:23:54whole time. He wasn't kicking the seat
- 1:23:55or going wacky or anything like that.
- 1:23:57And just told him, "Well, you know,
- 1:23:59we're probably going to get fast food.
- 1:24:01You're not going to do a sit down at
- 1:24:02Outback." And he he said, "Well, what
- 1:24:05are you getting?" And I said, "Well, I
- 1:24:06know there's an an In-N-Out Burger.
- 1:24:08People that don't live in California,
- 1:24:10In-N-Out Burger is pretty popular in
- 1:24:12California. Pretty good burgers." And um
- 1:24:15so I said, "We'll stop there and grab
- 1:24:16you some if you want something." And he
- 1:24:18just kind of gave a like a thoughtful
- 1:24:20look and he said, "I'll have a double
- 1:24:22double with cheese, a fry, and a small
- 1:24:25vanilla shake." And I'm thinking, "Well,
- 1:24:28that's a pretty good order other than
- 1:24:29the cheese." Um I don't know why you'd
- 1:24:31put cheese in a burger, but people do.
- 1:24:33And I said, "Yeah, you got it." And
- 1:24:35closed the door. One last piece of
- 1:24:38circumstantial evidence that told me
- 1:24:39that he did it. Uh if you've ever
- 1:24:41experienced a death in a family, uh
- 1:24:44trauma like that, food is pretty low on
- 1:24:47your priority list. being able to eat
- 1:24:49after receiving news like that,
- 1:24:52especially when you contrast it, and
- 1:24:54this is a thing that I think some people
- 1:24:55miss out on, when you look at the
- 1:24:57interviews, whether it was Diane Sawyer,
- 1:25:01um Ted Roland's or Gloria Gomez, and
- 1:25:03they're talking to Scott and he's faking
- 1:25:06this emotion about missing out on his
- 1:25:09son. And then when he's finally given
- 1:25:13this information that his son is dead,
- 1:25:15his wife is dead, and he still wants a
- 1:25:17burger.
- 1:25:19I guess you can still think that he
- 1:25:21didn't do it, but I'm not part of that
- 1:25:23camp.
- 1:25:28I I was involved in a lot of homicides
- 1:25:30and a lot of jury trials, so I I wasn't
- 1:25:33afraid of uh defense attorneys. I wasn't
- 1:25:35afraid to testify. I felt like I was
- 1:25:38pretty pretty good at it really. But
- 1:25:41with G when Gyros came on,
- 1:25:45the DAS would tell me, Al, he's got you.
- 1:25:49Gyaragos has you. He says he's got you.
- 1:25:52You're going, you know, you're going
- 1:25:54down. I'm like, he I don't know what
- 1:25:56he's talking about. I have no idea what
- 1:25:57he's talking about. And uh I'd see
- 1:26:01Gyaragos before the trial. I mean, you
- 1:26:03know, he it's hard to be nice to
- 1:26:05somebody you're going to you like try to
- 1:26:07backstab. And so I'd be with John and
- 1:26:10Grogan and maybe the sergeant and
- 1:26:12Gyaragos would be there with his
- 1:26:13investigator and we'd be going to the
- 1:26:16evidence room and Garos would open the
- 1:26:17door and everybody would get to walk in.
- 1:26:20When I'd get there, he'd shut he'd close
- 1:26:21the door, make me I'd have to open it
- 1:26:23myself and go in. And it was just so it
- 1:26:25was a it was just a thing with me and
- 1:26:28him. I don't know, but I didn't know
- 1:26:30what it was. And now I'm testifying and
- 1:26:34it's Garagos's turn. And we come to a
- 1:26:38point where I'm on the stand and then
- 1:26:41there's a sidebar and then they go in
- 1:26:43the judges chambers and they come out
- 1:26:45and I could see the DAs and they have
- 1:26:48concerned looks on their faces. I'm
- 1:26:50like, uh oh, something's coming. And so
- 1:26:54Gargo's it we so what we do is we
- 1:26:58dictate our reports into a tape.
- 1:27:01Somebody types them for us, sends it
- 1:27:03back to us, and then we can correct them
- 1:27:06or change them or do whatever and then
- 1:27:08sign it and turn in our reports. Well,
- 1:27:12he's got my tape and I've never I've
- 1:27:14never heard this. Nobody's ever done it
- 1:27:16before, but my voice on a cassette tape
- 1:27:19and it's reading something about uh I
- 1:27:23can't tell you for verbatim what it
- 1:27:24says, but what it basically says is I
- 1:27:27spoke to so and so. I spoke to, you
- 1:27:29know, Mr. Jones and he told me the lady
- 1:27:33that has a shop across from him
- 1:27:38told him that Lacy had come to her shop
- 1:27:42on Christmas Eve to use the bathroom.
- 1:27:44And so I put that in my I taped it. I
- 1:27:47put it in my report. It's hearsay, but I
- 1:27:50I put it in there. And so uh then after
- 1:27:54I dictated my tape, we go into the war
- 1:27:57room and we're all detectives talking
- 1:27:59and we're telling them and I said, "Oh
- 1:28:00yeah, I talked to Mr. Jones and he said
- 1:28:02the lady across from him told him that
- 1:28:04on Christmas Eve, Lacy came and used the
- 1:28:06bathroom or something like that." and
- 1:28:08and Detective Holmes says, "Oh yeah, I
- 1:28:10interviewed her and she told me that
- 1:28:13Lacy came and used the bathroom." And so
- 1:28:15he whole wrote a whole report about it.
- 1:28:16And so when I got my report, I took it
- 1:28:18out. I I took out that section because
- 1:28:22it's in Holmes' report. He interviewed
- 1:28:24the lady that actually had Lacy there.
- 1:28:26So now I'm in court on a Friday at 2:30
- 1:28:31or 3:00, my voice up there and then he
- 1:28:36types out my report and that sentence is
- 1:28:38missing
- 1:28:39and he's like, "Who took that out of
- 1:28:43your report?"
- 1:28:45And I said, "I did." And now the whole
- 1:28:51room full of news reporters that I see
- 1:28:54on TV, it's a big deal. It's a huge
- 1:28:57deal. And now it's break time. He wants
- 1:29:00a break for the weekend. So this little
- 1:29:02bomb he dropped is going to just
- 1:29:05percolate over the weekend that I took
- 1:29:07out exculpatory
- 1:29:10evidence from my police report.
- 1:29:13I knew it was BS, but it it made it
- 1:29:17looks bad, but it was not bad. And we're
- 1:29:22all under a gag order. Can't talk about
- 1:29:25it. Everybody's calling Everybody's
- 1:29:26calling the police department about me
- 1:29:29and about me taking out exculpatory
- 1:29:31evidence. And finally, one of my He's a
- 1:29:34good friend of mine. Uh he told the guy
- 1:29:38on the he told the reporter, "Hey, he
- 1:29:41took it out because it's in Detective
- 1:29:43Holmes's report." Well, that got
- 1:29:46reported over the weekend. And on Monday
- 1:29:49when we came to court, oh my Gyros, who
- 1:29:53usually walked in with a big smile, a
- 1:29:54coke and a different pair of sunglasses
- 1:29:56every day, stomped in there, peed
- 1:30:01off and they had a went to the judge and
- 1:30:04the gag order was violated. And man,
- 1:30:07they judge came out and ordered to have
- 1:30:10my chief of police there the next day.
- 1:30:12And actually a captain went and uh the
- 1:30:16judge told him if a gag order gets
- 1:30:18violated again, I'm going to put you in
- 1:30:20jail. And so it never got
- 1:30:24uh violated again. But the truth is I
- 1:30:28took something out of my report that was
- 1:30:31I could have never testified to it. I
- 1:30:33could never test Mr. Jones couldn't
- 1:30:35testify to it. But
- 1:30:38it was a big deal. And that wasn't the
- 1:30:40only thing I made. I made mistakes.
- 1:30:42Gargo found every one of them. And uh I
- 1:30:45felt bad. I mean I there was a point
- 1:30:47where I was like make it stop. I mean if
- 1:30:52I didn't cross a tea, he found a reason
- 1:30:54to talk about it for an hour. Nothing to
- 1:30:55do with Scott. It's all about me. And uh
- 1:30:59so I was feeling pretty bad there for a
- 1:31:01while. But after because I'd see Sharon
- 1:31:04and the family, I'd see him right there
- 1:31:06in the front row. And you know, they're
- 1:31:09beating me up pretty bad, making me look
- 1:31:11like a, you know, a terrible detective
- 1:31:13and all. And uh when the guilty verdicts
- 1:31:16came and I talked, I got to talk to her
- 1:31:19and she said, "You know, I never lost
- 1:31:23faith in you." And my department after
- 1:31:26we went in, my chief and the command
- 1:31:28staff said, "We we knew. We never lost
- 1:31:30faith in you. That's just that's the
- 1:31:32game they play.
- 1:31:35So
- 1:31:35>> his tactic was effective, but what what
- 1:31:40I didn't like about it was what was
- 1:31:42happening in court wasn't being what was
- 1:31:44reported on TV. And uh it's devastating
- 1:31:48to come home or have, you know, one of
- 1:31:50your family members call you from out of
- 1:31:52state and think that you're going to get
- 1:31:54fired or you're going to get arrested or
- 1:31:55you're going to you're a terrible
- 1:31:57detective when I knew I really didn't do
- 1:32:00anything wrong. I mean, it was all being
- 1:32:02spun wrong. I never got called a liar in
- 1:32:05court. I never was accused of being a
- 1:32:07perjurer in court. But I'd come out
- 1:32:09home, they'll turn the TV on and I'd be
- 1:32:11some guy would be saying I'm a vile
- 1:32:13little man and committed perjury over
- 1:32:15and over and over again. And so that's
- 1:32:17devastating. But as for a defense, I
- 1:32:20mean, I've been doing this for 20 years
- 1:32:22almost now, and that's their job. And he
- 1:32:24did his job. Over the years, one of the
- 1:32:27things I noticed in jury trials is the
- 1:32:31faces are different from the jurors, but
- 1:32:33the expressions seem to be the same with
- 1:32:36every juror on every trial. And it's
- 1:32:38really hard to read to get a good read
- 1:32:41on what their reactions are to different
- 1:32:43things. I know with with this trial,
- 1:32:46Amber was pretty much the star of it. Um
- 1:32:50people if they if they've never sat
- 1:32:51through a jury trial before, they've
- 1:32:52never seen what it's like other than on
- 1:32:54television, they don't really know how
- 1:32:56boring it can really be. And the thing
- 1:32:59is is it it's um laying out evidence
- 1:33:01over a period of time, especially when
- 1:33:03you have a lot of circumstantial
- 1:33:04evidence and then it's being attacked
- 1:33:06can seem like uh one of the most boring
- 1:33:09things you could be involved in and as a
- 1:33:11juror you're probably sitting there
- 1:33:12going when are you going to get to the
- 1:33:14point? But the thing is is there's
- 1:33:16procedures that have to be done and so
- 1:33:17jurors are kind of subjected to, you
- 1:33:19know, things. And the other thing that
- 1:33:21is present with jury trials a lot of the
- 1:33:23time is there's evidence that is not
- 1:33:25allowed to be heard by the jurors. I
- 1:33:28don't like that. I think everything
- 1:33:30should be presented to the jurors
- 1:33:32because it's the truth is the truth
- 1:33:34whether it cuts for or against. And this
- 1:33:36is one of the reasons that I've
- 1:33:37maintained and I was trained by one of
- 1:33:39the best detectives ever, uh, Dick
- 1:33:41Rydenower. He always told me, he said,
- 1:33:42"You put everything in your report that
- 1:33:45is good for the defendant and everything
- 1:33:48in your report that is bad for the
- 1:33:49defendant." Because if you leave things
- 1:33:51out of your report that are favorable
- 1:33:55for the guy that's going to be on trial
- 1:33:56and they're found out about, you'll be
- 1:33:59ripped apart to shreds on the witness
- 1:34:02stand. And it it's much easier if you
- 1:34:06just walk down the middle and you don't
- 1:34:08really take a side. Now, like with
- 1:34:10Scott, like I said, he's kind of kind of
- 1:34:13hard not to like other than the murder
- 1:34:16part of him. Um, so he I could walk
- 1:34:19through this case with him and I didn't
- 1:34:21really have any desire that well we have
- 1:34:23to get them. We were just searching for
- 1:34:25the truth and and it presenting it to a
- 1:34:28jury and they're the ones who are going
- 1:34:29to decide it. But um that the trial was
- 1:34:33just kind of a normal trial went a
- 1:34:34little bit longer because of the media
- 1:34:36coverage and all the things that went
- 1:34:37along with the case. But I thought we
- 1:34:39had a good judge there in Dookuchi. Um
- 1:34:40you'd since passed away and um there's
- 1:34:43some we had really good jurors. I
- 1:34:45thought um of course obviously I'm going
- 1:34:48to think that way because of the
- 1:34:49verdict, but they seem to analyze
- 1:34:51things. There's a couple of them in
- 1:34:53particular that um um speak frequently,
- 1:34:57maybe not frequently, but when you have
- 1:35:00shows like this, they're on it and and
- 1:35:01they have a very good uh demeanor about
- 1:35:04how they looked at the case.
- 1:35:05>> Yeah, I think the trial went I mean, I
- 1:35:08think the facts came out right on on
- 1:35:10this jury trial. I think the jurors got
- 1:35:12it right. Um, I'm sorry they took the
- 1:35:16death penalty off, but maybe I'm not.
- 1:35:18Now, maybe he's in general population
- 1:35:20and he's not doesn't got a single cell.
- 1:35:23But, uh, I think it went good. I'm not
- 1:35:26ashamed of anything I did in that trial
- 1:35:28or in that case. I didn't do any I
- 1:35:31didn't hide any evidence. I didn't fake
- 1:35:34any evidence. I mean, they can say what
- 1:35:36they want. I'm proud of Modesto PD and
- 1:35:38the work that we we did and what we put
- 1:35:41into that.
- 1:35:43The Los Angeles Innocence Project filing
- 1:35:45presents evidence the jury never heard
- 1:35:48when they convicted Scott Peterson for
- 1:35:49the death of his wife Lacy and their
- 1:35:51unborn son Connor in November of 2004.
- 1:35:54They write that the prosecution's case
- 1:35:55was based off circumstantial evidence
- 1:35:57and bluntly state no direct physical or
- 1:36:00forensic evidence was found supporting
- 1:36:02any part of the prosecution's theory or
- 1:36:05otherwise implicating Peterson.
- 1:36:07California state prisons are probably I
- 1:36:11I mean I'm just saying this from my
- 1:36:13aspect. I believe they're probably the
- 1:36:15most professional custodial organization
- 1:36:19in the world. Um I dealt with a lot of
- 1:36:22the parole agents over the years and
- 1:36:25went to many of the state prisons on
- 1:36:27different murder cases.
- 1:36:29These guys play major league baseball.
- 1:36:32They they do it right. And
- 1:36:36for the inmates, it's not a pleasant
- 1:36:39place to be. Um, it's dangerous.
- 1:36:43It is violent. It is noisy. It doesn't
- 1:36:46smell good. And it's
- 1:36:51it's just I I don't even like being
- 1:36:53there for a day. Uh, but I can't imagine
- 1:36:56being there for 20, 30 years because
- 1:36:58it's it's just hideous. It has a very
- 1:37:01interesting culture to it.
- 1:37:04um the state prisons because of the gang
- 1:37:06influence um
- 1:37:10it's not a pleasant place to be which is
- 1:37:13the reason that Scott is always going to
- 1:37:15maintain his innocence because if he
- 1:37:18ever admitted that he did this then his
- 1:37:20chances of ever getting out are gone. So
- 1:37:23of course when you've got a good uh good
- 1:37:26story you stay with it and that's his
- 1:37:28only hope of getting out. Uh the LA
- 1:37:30Innocence Project uh loosely connected
- 1:37:32with the Innocence Project uh has taken
- 1:37:35on this fight and their desire is to
- 1:37:38have more evidence tested. I have
- 1:37:41absolutely no problem whatsoever with
- 1:37:43any evidence being tested, retested,
- 1:37:45triple tested. Makes no difference to
- 1:37:47me. I believe the right guy is locked up
- 1:37:50for this crime and any evidence testing
- 1:37:53is not going to bring forth any other
- 1:37:55conclusion.
- 1:37:56If there's objections to testing
- 1:37:59evidence,
- 1:38:00and there may be legal ones that the
- 1:38:02attorneys have, but from my seat right
- 1:38:04here, I have no objection to testing
- 1:38:06evidence because I don't believe we have
- 1:38:08anything to hide whatsoever.
- 1:38:10>> I don't care about the bloody van
- 1:38:11because she was never in that van. On
- 1:38:14the day after Christmas,
- 1:38:17we go to Scott and we say, "We want to
- 1:38:21search the house again, like thoroughly
- 1:38:24search it. We want to search your
- 1:38:26computer and Lacy's computer. Maybe she
- 1:38:29had a stalker you don't know about.
- 1:38:31Maybe she had a boyfriend you don't know
- 1:38:33about. We want to search her phone
- 1:38:35records and your phone records for any
- 1:38:37kind of information. And he's shaking
- 1:38:40his head like, "Yeah, you know, that's
- 1:38:41that's a good idea. We should do that."
- 1:38:44And then we give him the form to all
- 1:38:48just sign right here and we're going to
- 1:38:50do that. And he reads it and he puts it
- 1:38:52down. He goes, "You don't expect me to
- 1:38:54sign that without a lawyer, do you?" And
- 1:38:56this is on December 26th. We're just
- 1:38:59trying to find his wife and now we got
- 1:39:00to get a lawyer or a search warrant.
- 1:39:03Well, we had the search warrant. We
- 1:39:05showed it to him. We said, "Well, sorry,
- 1:39:07Scott. I was expecting you to say that."
- 1:39:09And we have a search warrant anyway. So,
- 1:39:12uh, he looks at me, he's like, "Al,
- 1:39:16where's the trust?" And I'm like, "Yeah,
- 1:39:19Scott. Where's the trust? I mean, you
- 1:39:21got to go." So then we could search. But
- 1:39:23that's why the innocent project thing
- 1:39:25doesn't even a phase me. Go ahead and do
- 1:39:28DNA on the mattress in the van. Do all
- 1:39:30that as Lacy was never in there. I've
- 1:39:33said this before when they make noise
- 1:39:34that um
- 1:39:37we've got evidence that we want to test
- 1:39:38and the judge grants only some of it.
- 1:39:41I'm not I don't I'm not privy to all the
- 1:39:43information on what's been tested and
- 1:39:45what hasn't been. And if there's stuff
- 1:39:47that needs to be retested, my feeling is
- 1:39:49test it. Take away the mystery. take
- 1:39:51away the skepticism, show it for what it
- 1:39:54is, and put this thing to rest so that
- 1:39:58Scott can serve out his term.
- 1:40:01The baby didn't come out naturally cuz
- 1:40:03she still had her pants on. Uh to think
- 1:40:06that then they're going to these guys
- 1:40:08that ride bikes and don't even own a
- 1:40:10car, they're going to find a way to the
- 1:40:11Berkeley Marina and find a way to get in
- 1:40:13a boat. They're making a name for
- 1:40:14themselves. Maybe they're going to get
- 1:40:15some more business or something. But you
- 1:40:17know one thing, Scott is he is putting
- 1:40:20his family and Sharon's family through
- 1:40:24hell
- 1:40:25and it's wrong.
- 1:40:35So, you know,
- 1:40:38now that it's over, he's been convicted.
- 1:40:41I have my feelings on what happened. And
- 1:40:44I and the you got to remember on the
- 1:40:47very first day on Christmas Eve, I I
- 1:40:50photographed his hands and he has a a
- 1:40:53cut on his knuckle on a on his hand, a
- 1:40:56fresh one. It's not even scabbed over
- 1:40:58yet, so it's pretty pretty fresh. And
- 1:41:00there was blood in his truck. And so I
- 1:41:03believe that she sat on the end of her
- 1:41:07bed to like take her shoes off or put
- 1:41:09them on cuz the bed is made now. He
- 1:41:12tells me they got up on Christmas Eve
- 1:41:14and and they got out of bed and they ate
- 1:41:16cereal, watched TV, and then he went
- 1:41:18fishing and she went walking. Well, when
- 1:41:21he gets home, the bed's made.
- 1:41:25I think he just came up behind her.
- 1:41:29Either he bagged her with a bag over her
- 1:41:33head or he just strangled her and she
- 1:41:34scratched him and there's blood on the
- 1:41:38dvet his blood.
- 1:41:41I think he wrapped her in a tarp and he
- 1:41:43drugg her out to the truck, squishing
- 1:41:47that rug up against that door and then
- 1:41:51he puts her in the back of the truck and
- 1:41:54he's seen by somebody, a neighbor that
- 1:41:58says Merry Christmas to him and he says
- 1:42:00Merry Christmas and he's seen with a
- 1:42:03blue tarp and so
- 1:42:06he's got to have a reason to have a blue
- 1:42:08tarp in the back of his truck and so he
- 1:42:10wraps wraps up these umbrellas and puts
- 1:42:13them in the back of his truck.
- 1:42:15I think he takes her to the shop,
- 1:42:17transfers her to the boat.
- 1:42:20He made more than one anchor. Um, and we
- 1:42:24only found one in the boat. He admitted
- 1:42:28making one anchor, but there was no rope
- 1:42:30in the boat. No rope to to tie it off if
- 1:42:33you're going to throw it over. So,
- 1:42:37uh, I believe
- 1:42:40he put her in the boat because we did
- 1:42:42find a pair of needle-nose pliers in the
- 1:42:44boat with her hair wrapped around them.
- 1:42:48Not like on top of them, not sitting
- 1:42:51there, but wrapped around them. And so,
- 1:42:54I'm thinking he uh used and there was
- 1:42:57some chicken wire in his truck. I think
- 1:42:59he just put these anchors on her and got
- 1:43:02some hair on his pliers and threw her
- 1:43:04overboard.
- 1:43:06>> And premeditated, you think?
- 1:43:08>> So, I believe it was premeditated
- 1:43:10because he predicted she was lost on
- 1:43:12December 9th. He searched the tides of
- 1:43:16the San Francisco Bay on December 8th.
- 1:43:18He didn't search like, "What are you
- 1:43:20fishing for?" He's looking at the tides
- 1:43:22on December 8th. He buys the boat on
- 1:43:24December 9th. Nobody in his family,
- 1:43:28friends, nobody knew he owned a boat on
- 1:43:31December 9th. He buys a fishing license
- 1:43:33on December 20th and dates it for the
- 1:43:3723rd, 24th.
- 1:43:39So, I believe it's planned. Now, I I re
- 1:43:44really believe
- 1:43:46he wasn't going to tell anybody he even
- 1:43:48went fishing. But but by the grace of
- 1:43:52God, when he was backing his truck, the
- 1:43:55boat into the uh water, he hit the dock.
- 1:43:59And he told me when he was when he hit
- 1:44:02the dock, he saw some uh maintenance men
- 1:44:04up there and they were getting a pretty
- 1:44:06good laugh at how he was backing up this
- 1:44:08trailer. So, I think that's what made
- 1:44:11him change his story from cuz everybody
- 1:44:14knew he was going golfing, but from
- 1:44:16golfing to fishing. And even the very
- 1:44:19first neighbor he contacted, he said,
- 1:44:21"Hey, I've been golfing all day and I
- 1:44:23came home and Lacy's not here." Well, I
- 1:44:26think his original plan was to be
- 1:44:27golfing. And uh so I I really believe it
- 1:44:31was premeditated.

- 1:46:21I'd see Ron around at restaurants and
- 1:46:23I'd talk to him and Sharon when I got
- 1:46:26promoted I I invited her and
- 1:46:30Ronda to come to my promotion and they
- 1:46:32name and I used to send Sharon a
- 1:46:35Christmas card every year cuz I would
- 1:46:38write stuff in them and I didn't just
- 1:46:40say like Al Broini or detective but
- 1:46:43after a while I thought
- 1:46:46that I'm a bad memory. I mean I'm
- 1:46:50sending her a Christmas card on
- 1:46:51Christmas the day her daughter and
- 1:46:54grandchild are
- 1:46:57killed. I said I I So I stopped I
- 1:47:00stopped. I didn't want her to I didn't
- 1:47:02want her me to make her think about that
- 1:47:07anymore.
- 1:47:08>> If you watch this and you're not in a

- 1:47:13Sharon. Um, and think of Lacy because
- 1:47:16that's really what this cold case was
- 1:47:17all about.
