2. 0:03Wayne County Sheriff's Office
3. 0:05at the present time we're conducting an
4. 0:07interview with Elizabeth Diane Downs
5. 0:10president is
6. 0:12Douglas Welch
7. 0:15also a detective William County
8. 0:17Sheriff's Office
9. 0:19Diane you know this conversation is
10. 0:21being reported yeah
11. 0:24and I asked you to come down here to
12. 0:26look at some photographs
13. 0:28of some individuals
14. 0:30uh
15. 0:32we are in the criminal investigation
16. 0:35section and you have been called the
17. 0:39suspect in this case and we are talking
18. 0:41to you about uh facts in this particular
19. 0:43case
20. 0:44so under those circumstances I'm just
21. 0:46going to redo the rights maybe the right
22. 0:49to remain silent anything you say can it
23. 0:51will be against you in a quarter while
24. 0:54do you understand that yeah you have the
25. 0:57right to talk to a lawyer and having a
26. 0:58present with you while you're being
27. 0:59questioned and when you are required to
28. 1:01face Witnesses do you understand that
29. 1:03yes
30. 1:03cannot afford to hire a lawyer one will
31. 1:05be appointed to represent you if you
32. 1:07request of them do you understand that
33. 1:08yeah
34. 1:11do you understand each of these rights
35. 1:12I've explained to you yeah having these
36. 1:15rights in mind you wish to see without a
37. 1:17lot of yeah okay and as I said you're
38. 1:20free to go with any time but however we
39. 1:24are we are going to be discussing
40. 1:26today's today's date is July 22nd 1983
41. 1:30and the time now is 15 43 hours
42. 1:36I'm about to show Diana photo lineup
43. 1:39showing six individuals
44. 1:43on the outside of the lineup
45. 1:45of a disclaimer it says the suspect may
46. 1:48or may not be displayed in this series
47. 1:50of photographs
48. 1:52feel compelled to select any photograph
49. 1:55okay
50. 1:57just look at them carefully
51. 2:24bunch
52. 2:26yeah
53. 2:48and eliminate three of them real fast

55. 3:15I'm not gonna pick anymore
56. 3:17because I'm not absolutely positive and
57. 3:19maybe it's just that pictures look
58. 3:21different from moving bases
59. 3:24do you think that uh if you saw this guy
60. 3:27in the street today you could recognize
61. 3:29it you want the truth I don't know
62. 3:33everybody says I would he said as soon
63. 3:35as he walked up to me I'd Flash

65. 3:48but anyway
66. 3:50people have asked me if I would remember
67. 3:52the person and I said I don't know if I
68. 3:53would and they said oh sure you would
69. 3:55that's something you wouldn't forget if
70. 3:57you saw him again you would know him
71. 3:59well I don't know that I've never been
72. 4:01faced with something like this before so
73. 4:03I don't know that I would know him again
74. 4:06and I'm not going to
75. 4:08say that for sure somebody is the person
76. 4:11if I'm not for sure
77. 4:13because after what I've just been
78. 4:15through and I know I'm not the person I
79. 4:16wouldn't put somebody else through that
80. 4:17unless I was sure you feel fairly
81. 4:20comfortable with none of the people
82. 4:23no you don't feel comfortable no I
83. 4:27in other words five looks real close
84. 4:29okay
85. 4:33but not not enough that I'm going to say
86. 4:35hey that's him
87. 4:37because
88. 4:41then you go to start doing to him what
89. 4:43you've done to me and if he isn't him I
90. 4:46would I would put pity on him I mean
91. 4:51not that you guys you guys really
92. 4:52haven't been that bad she said she took
93. 4:54my kids from you okay okay
94. 5:00my kids are playing
95. 5:02but anyway fireworks
96. 5:11well why aren't you
97. 5:13step back down there
98. 5:15the classical goes periodically
99. 5:20we have been talking about
100. 5:23some people you consider to be enemies
101. 5:25yeah this type is still working good
102. 5:30and you have given me three names
103. 5:33of people who
104. 5:35be the most likely candidate
105. 5:38to do something like this to you and
106. 5:40your kids
107. 5:42from the beginning again
108. 5:45why don't you go ahead and run that bias
109. 5:48and tell us what what if any of you
110. 5:51think those people have okay
111. 5:54this is our fourth trial now so I may
112. 5:57forget things to remind me and I will be
113. 5:59phrase okay
114. 6:01stays down my ex-husband
115. 6:05I divorced him two years ago and he
116. 6:09hated me for that even before that I got
117. 6:12pregnant
118. 6:13with Daniel by somebody else not him
119. 6:17and he's not the biological father he
120. 6:19hated me for that
121. 6:22um
122. 6:25it it destroyed his
123. 6:28character disgrace them to his friend
124. 6:31that I would do these things he tried
125. 6:34for the whole two years to try and get
126. 6:35me back together

129. 6:39I never did go back with him so he hated
130. 6:43me for it I don't know
131. 6:46okay
132. 6:47that's that's a big motive as far as his
133. 6:49relationship with the kids goes
134. 6:53excuse me
135. 6:54as far as his relationship with the kids

137. 6:58he Christie is a very obedient
138. 7:00well-mannered child
139. 7:03she would do anything you'd ask without
140. 7:05asking price it makes it easy to ignore
141. 7:07her
142. 7:09in some cases because you don't have to
143. 7:12yell at her and it's the reason she got
144. 7:15ignored by Stephen because Steve it just
145. 7:18proves again that Steve didn't have any
146. 7:20real love or feeling for the kids
147. 7:22because the only time he spent time with
148. 7:24the kids when Cher was being reprimanded
149. 7:27because she was so hyper and breaking
150. 7:29things and getting into stuff and
151. 7:30climbing on chairs and hanging on people
152. 7:32and and he used to yell at her and just
153. 7:34give her hair emotionally for it
154. 7:37and there were times when he was
155. 7:39physical with her too
156. 7:41and so sure got lots of attention Chris
157. 7:44he got none of attention but all the
158. 7:45attention Charlotte was being was bad
159. 7:46but that's not good
160. 7:48Danny
161. 7:49is a completely different case
162. 7:51altogether
163. 7:53he wasn't biologically students and the
164. 7:55whole time that I was pregnant Steve was
165. 7:57vicious with me
166. 7:59and when I finished being pregnant
167. 8:04he hated Daniel and after that's when I
168. 8:07was pregnant he said as long as you have
169. 8:09a girl baby you will see what happened
170. 8:11but if you have a boy you're both out on
171. 8:14your ass
172. 8:15and I said fine well Danny turned it up
173. 8:18to be a boy and Steve hated him at first
174. 8:22with a passion
175. 8:24whenever Dan would cry he'd scream for
176. 8:27him to shut up and stuff like that so
177. 8:29he even told me to leave
178. 8:32and then when I said fine he said no you
179. 8:34can't leave because he didn't look like
180. 8:36he had failed and this person that got
181. 8:38me pregnant had one or something it was
182. 8:40just another murder was ego and so he
183. 8:42was torn between wanting to get rid of
184. 8:44us and destroy the evidence of what I
185. 8:47had done and at the same time
186. 8:50he didn't want to look like he'd lost
187. 8:52and it was it was a drug
188. 8:54turmoil inside of him like I said he's a
189. 8:57complex person it's not any one thing
190. 8:59that would make him hate me it's just
191. 9:00everything all together makes him hate
192. 9:02me more and more okay let's go on to
193. 9:04number two so much
194. 9:08is Steve's Death Throne has been friends
195. 9:11for about
196. 9:12five or six years I guess he'll do more
197. 9:15I don't really know
198. 9:22does it if one can commit a crime and
199. 9:25get away with it the other one will do
200. 9:27it and I don't know why it is dude I
201. 9:30like a step ladder and they keep filling
202. 9:32each other up and drugs hated me while I
203. 9:35was pregnant because he hated me
204. 9:38most of the time the name is D it was
205. 9:41almost like a jealousy because Steve
206. 9:43would rather spend more time with me
207. 9:44than he would with Greg because we were
208. 9:47an obligation we were a family he had to
209. 9:49come home and spend time with us and so
210. 9:52Greg didn't like that because he was
211. 9:54younger at the same girl and he wanted
212. 9:56to be with him
213. 9:57and so he wanted to split us up while I
214. 10:00was pregnant with Danny Steve told Brad
215. 10:02that Daniel was biologically somebody
216. 10:04offers
217. 10:05and
218. 10:06Greg hated me even more for that during
219. 10:09the last part of my pregnancy drug used
220. 10:11to cry and hang up
221. 10:13whenever I answered the phone trying to
222. 10:15make it sound like the girl was calling
223. 10:16and hanging up and Steve found out that
224. 10:18it was great doing it and told him to
225. 10:20knock it off and Greg told him and the
226. 10:22best thing that could ever happen to you
227. 10:23to get rid of her and those kids and
228. 10:25that stupid thing she's pregnant with
229. 10:27and so that was Greg's attitude about me
230. 10:30and the kids he didn't have any use for
231. 10:32us at all
232. 10:34then when we got our divorce Greg was
233. 10:37very pleased
234. 10:38turned around with Steve a lot
235. 10:40he traveled over the girls being around
236. 10:43sometimes but that was basically a
237. 10:46toleration didn't really like them
238. 10:49and Daniel he put up with Danny because
239. 10:52Steve likes to take Danny places because
240. 10:54Danny's a jewel he's an angel
241. 10:56he's smart he's bright he's fun see
242. 10:59we're taking places it was a showpiece
243. 11:01for him and so Greg put up with that
244. 11:03because it made Steve happy
245. 11:05and
246. 11:07when I brought the kids up here
247. 11:11the kids weren't ever going to come back
248. 11:12to Arizona the kids and I probably would
249. 11:14have stayed here for the rest of our
250. 11:15lives and we didn't need Steve he was
251. 11:18not part of our life there was no use
252. 11:20for him
253. 11:21and Steve knew that he knew I thought
254. 11:24that way about it and Greg knew that I
255. 11:26felt that way about it
256. 11:28when I came up here with Charlene which
257. 11:30is Nick's wife will talk about her mix
258. 11:32called steva and
259. 11:35Nick was supposed to be joining me up
260. 11:37here
261. 11:38and so she called Steve and tried to do
262. 11:41something to make Steve angry enough to
263. 11:44force his hand to do something to bring
264. 11:47the kids back there by bringing me back
265. 11:49there by Nick would still be his wife
266. 11:51his Nick would still be her husband and
267. 11:54I would still be his mistress that at
268. 11:55least she would have him
269. 11:57so she started railing on Steve about
270. 12:00how could he let his kids leave the
271. 12:02state why doesn't he turn me in well the
272. 12:03kids were in my custody they were my
273. 12:06kids so he didn't have the right to keep
274. 12:08the kids but she did that to him she
275. 12:10just really
276. 12:11tormented I might guess with it and he
277. 12:13says well there's nothing I can do about
278. 12:15it the kids are gone and perhaps that
279. 12:17aided him but Greg on the other hand was
280. 12:21probably elated that they were gone
281. 12:22except for the fact that Steve was
282. 12:25probably upset about it so Greg was
283. 12:27upset about it and if he and Stephen
284. 12:29lost three girlfriends because he has
285. 12:31kids and now that Greg has a girlfriend
286. 12:33or a wife I don't think people get
287. 12:35married anymore not a dog has a
288. 12:36girlfriend and a baby
289. 12:38and he's settling down to I guess being
290. 12:41sort of a family man to an extent he
291. 12:43still has his girlfriends and stuff but
292. 12:45you know he has somebody to sleep with
293. 12:47every night type attitude he wanted
294. 12:49Steve to have the same thing well he's
295. 12:52lost three girls he's lost three
296. 12:53girlfriends because of the kids so if
297. 12:55Greg could eliminate the kids
298. 12:59it would release Steve of his
299. 13:00responsibility then he could get a
300. 13:02girlfriend or a wife or whatever and it
301. 13:04would also punish me at the same time
302. 13:06because I would hurt because I love the
303. 13:09kids and Greg knows I love the kids more
304. 13:10than anybody so he would be getting even
305. 13:12with me after all these years he would
306. 13:14finally be doing me in
307. 13:16okay
308. 13:17let's talk about Charlene Charlene
309. 13:20Charlene Knickerbocker she's an ex-wife
310. 13:24um
311. 13:25hurricane motive is still going it's not
312. 13:28quite half over her main motive is the
313. 13:31fact that Nick loves me I can't say love
314. 13:33Mick loved me
315. 13:36um
316. 13:37we have been together for a year
317. 13:40and it was an affair I was his mistress
318. 13:42and that I'm not ashamed of that it's
319. 13:45just the way life is sometimes
320. 13:48he made me happy and I made him happy he
321. 13:50left Charlene
322. 13:52several times
323. 13:54and he physically moved out on her twice
324. 13:57in almost three times
325. 14:00but every time he went back because of
326. 14:02an obligation to her
327. 14:04or for whatever other reason
328. 14:06and
329. 14:08he would go back to her but within two
330. 14:10or three months
331. 14:12he was always coming back and saying I'm
332. 14:14sorry I'd rather be with you
333. 14:17and it was
334. 14:19just back and forth like that and it
335. 14:21probably always would have been that way
336. 14:23except that the next time Nick decided
337. 14:26that he'd rather be with me I'm here
338. 14:28and therefore Nick would have to either
339. 14:31move up here or bring me back there but
340. 14:34if Nick moved up here Charlene and her
341. 14:36family all lived down there and she
342. 14:40would have no reason to move up here
343. 14:41except to follow Nick I think that that
344. 14:43would hurt her Pride it would hurt mine
345. 14:45I think
346. 14:46but uh
347. 14:48promoting would be that if she destroyed
348. 14:50my kids
349. 14:52she would destroy Nick's desire for me
350. 14:55because Nick is a person that doesn't
351. 14:57like complications he doesn't like
352. 15:00hassles and there's nothing more
353. 15:02complicating than a murder
354. 15:04and no matter who gets murdered no
355. 15:07matter who does the murdering if it was
356. 15:09my kids but that killed Nick would never
357. 15:12want to talk to me again let alone
358. 15:14be a companion with me again and at the
359. 15:19same time she would destroy me
360. 15:21so those are the three people that you
361. 15:24feel would be
362. 15:25most likely most likely to commit a
363. 15:28crime like this
364. 15:32you mentioned earlier to us that uh
365. 15:36this individual
366. 15:39talk to you referred to you by name and
367. 15:42also refer to your tattoo right
368. 15:46can we get into a little bit
369. 15:49more about
370. 15:53the conversation he had what as as close
371. 15:56as you can remember what did he tell you
372. 15:59I don't remember all I know is that he
373. 16:02used my name
374. 16:03I don't remember most of the
375. 16:05conversation
376. 16:07I don't remember most of the action I
377. 16:09remember seeing Christy get shot and
378. 16:11that's about Alan I remember getting
379. 16:13back in the car and driving to the
380. 16:14hospital he threatened you though right
381. 16:16yeah okay and the threat was words to
382. 16:20the effect of what
383. 16:24I don't remember but to the effect was
384. 16:26that if I said anything to anybody that
385. 16:28I know that you're waiting for me to say
386. 16:30they because that's what and I almost
387. 16:32did it again
388. 16:33but every time I start rambling and I
389. 16:36start talking about it and thinking fast
390. 16:38I say they so I don't know if there was
391. 16:41a day I remember a he
392. 16:43but what I said was you only saw one
393. 16:47person I only recall seeing one person
394. 16:49one person okay
395. 16:52anyway maybe there was another person
396. 16:54there and that's what I'm blanking at I
397. 16:56don't know I'm not a psychologist and I
398. 16:58don't pretend to try to understand it
399. 16:59I'm totally confusing I'll cut you off
400. 17:03just a second ago you were going to say
401. 17:04something about words to the effect that
402. 17:07if you say anything about what happened
403. 17:10here that they'd come back and kill me
404. 17:13and I don't know why I said they it was
405. 17:17just something that popped out maybe
406. 17:20maybe he said that maybe he was alone
407. 17:23and he was referring to the person that
408. 17:24sent him maybe there were two people
409. 17:27there maybe there were five people there
410. 17:29I don't know was there other
411. 17:31conversation besides this and you just
412. 17:34don't remember it I'm sure that there
413. 17:35was
414. 17:37because
415. 17:39he said that I was supposed to keep my
416. 17:41mouth shut
417. 17:42and not say anything and there must have
418. 17:44been something for me to say if he was
419. 17:46still just threatening me not to throw
420. 17:48anything
421. 17:49I mean I don't know that there was other
422. 17:50conversation but it makes sense because
423. 17:52there'd be no reason to say that if
424. 17:54there wasn't
425. 17:55see
426. 17:56ing so this this person Knew You
427. 17:59referred to you by name and referred to
428. 18:01your tattoo
429. 18:02do you feel that it's logical to assume
430. 18:05that
431. 18:08this individual was sent up here from
432. 18:11Arizona I would think so because
433. 18:15there are only a couple of people up
434. 18:17here that know about my actually my
435. 18:18parents didn't even know about my tattoo
436. 18:20Steve told him when he came out here but
437. 18:24only a couple people up here know him
438. 18:26and they were my best friends and they
439. 18:28would have no they weren't my enemies
440. 18:30they I've only been here for six weeks
441. 18:31and like I said I have a way of getting
442. 18:34on people so that they hate my guts or
443. 18:36they really like me and I haven't been
444. 18:38here long enough to get any enemies and
445. 18:40so the people that knew about my tattoo
446. 18:42up here would have no reason to do this
447. 18:45so if they refer to my tattoo that means
448. 18:48they must have come from Arizona or were
449. 18:51sent from Arizona
450. 18:54I know I know we're just going over this
451. 18:57when you came into the room earlier how
452. 19:00would they know that I was going to be
453. 19:01on that road I don't know
454. 19:04I have no idea Nick and I discussed that
455. 19:07and you're right it makes absolutely no
456. 19:09logic it's always set up how would
457. 19:11somebody know I would be on that
458. 19:12obsolete Road
459. 19:13I haven't got the founders except like I
460. 19:16was saying
461. 19:17when I went to the hospital
462. 19:19doesn't work yet I went to the hospital
463. 19:24I told the Springfield police or whoever
464. 19:27what happened they wanted me to go back
465. 19:29out to the scene I said fine I went
466. 19:32then as we were driving up old Mohawk
467. 19:35Road it flashed that there was a yellow
468. 19:38car there and that it wasn't there now
469. 19:41and I said wait there was a yellow car
470. 19:44and he said
471. 19:46was this person driving the car and I
472. 19:48said I don't know I don't think so I
473. 19:50didn't see him in the car
474. 19:52the car was just parked here I said are
475. 19:54you sure it was parked here I said yeah
476. 19:56I think so I passed it
477. 19:59so I don't know I don't know if Burks
478. 20:03asked me the other day was I followed
479. 20:06no I don't know that I was following
480. 20:09but who looks to see if you're followed
481. 20:11do you remember being followed
482. 20:14after it happened could he run back to
483. 20:16that yellow car and follow you
484. 20:20I don't know after I got in the car I
485. 20:23don't remember anything but Christy wait
486. 20:25a second if you were followed
487. 20:27how could they get somebody in front to
488. 20:30weighs me down I don't know
489. 20:32I don't know I don't understand it
490. 20:35is I mean the whole case yes it is
491. 20:40all I know is I can tell you you still
492. 20:42have the anything that I can remember to
493. 20:44tell you to tell you okay yeah if it
494. 20:46doesn't fit in we'll get them at you
495. 20:48siphon it out just telling you what I
496. 20:51remember I remember a yellow car and it
497. 20:54seems important for some reason it was
498. 20:57important enough that when I told the
499. 20:59story the way it happened
500. 21:01and I didn't say anything about it it
501. 21:03was important enough that my mind said
502. 21:04wait there's a yellow car when we went
503. 21:07back out there and I could and I just
504. 21:08knew I was going to go back to that
505. 21:09thing and I could see the trees and I
506. 21:11could see the bends in the road and I
507. 21:12would be seeing again my kids getting
508. 21:14shot
509. 21:16and it was something my mind was just
510. 21:18fighting with that and the yellow car
511. 21:20was there and my mind just looked pink a
512. 21:23yellow car whether it meant anything or
513. 21:25not
514. 21:26and like I was saying at the time
515. 21:29it's so weird
516. 21:35at the time that the person threatened
517. 21:38me and said that I wasn't supposed to
518. 21:40say anything because I would be too old
519. 21:44I didn't say anything
520. 21:46and for some reason it didn't seem that
521. 21:48it was somebody that knew me and I don't
522. 21:50know why because that's insane too
523. 21:53it was I mean it's like you're both ways
524. 21:56you know that the person knew you
525. 21:59but you're confused because you've never
526. 22:00seen that specific person before
527. 22:03and you're so concerned about the kids
528. 22:05living or dying and one of them did die
529. 22:10and you've got so many things on your
530. 22:12mind just since the cottage your son
531. 22:14looked out about everything that you've
532. 22:16seen everything that you've felt
533. 22:18and maybe your mind just doesn't let you
534. 22:21feel that it was your fault even though
535. 22:23it was somebody that hated me that much
536. 22:25that did that and so you block out the
537. 22:27fact what it was somebody
538. 22:30but knew you even though you know that
539. 22:32it was something this isn't making sense
540. 22:34you're making faces but it does make
541. 22:35sense even though I don't understand you
542. 22:37mentioned something about being your
543. 22:39fault
544. 22:40somebody hated me enough that they would
545. 22:42do this
546. 22:45yeah and because of the way you are that
547. 22:51they began to hate you that that's the
548. 22:54reason this happens
549. 22:56in other words you said earlier people
550. 22:58either like you or they hate you and the
551. 23:00reasons
552. 23:02and the reason people hate you is
553. 23:04because you tell them what you what they
554. 23:06think and because this happened
555. 23:10I
556. 23:12okay I really don't need to hear that
557. 23:15you guys
558. 23:16Steve does that on the phone too
559. 23:18oh you don't like the word no therefore
560. 23:22it makes it my fault I I hate that I
561. 23:24can't stand it because
562. 23:28um okay
563. 23:31um
564. 23:34while you were there
565. 23:37is there anything else that's clicked or
566. 23:39flashed with you about

568. 23:45no but what happened at the scene that's
569. 23:48what I'm saying at the time that it
570. 23:50happened
571. 23:51even though I knew that it was somebody
572. 23:53that knew me
573. 23:54it didn't
574. 23:56click or whatever it didn't register
575. 23:58that it was somebody that you need
576. 23:59because I didn't talk about it
577. 24:01and on the way to the hospital
578. 24:03began thinking about
579. 24:05I remember what's the highlights the
580. 24:07things that I could remember
581. 24:09but you obviously were afraid to tell us
582. 24:13that the person needs my name because
583. 24:15that was the last thing that
584. 24:17he said that was the last thing you said
585. 24:19yeah it was don't say
586. 24:24I don't know what he said something
587. 24:26about don't say that
588. 24:29don't say it he just said no I don't
589. 24:31know what it was I don't remember what
590. 24:33it was were you still standing outside
591. 24:35the car when you said that yeah you
592. 24:37hadn't gotten back in the car where you
593. 24:39had been shot yes
594. 24:41okay
595. 24:43and so on the way to the hospital you
596. 24:45began to think well I can't I don't want
597. 24:47to tell the police
598. 24:49about what he said right because you
599. 24:52were afraid
600. 24:53of retaliation right
601. 24:55okay but I told you what happened yeah
602. 24:57but I didn't tell you that the person
603. 24:59knew me

605. 25:11I didn't know that she would do that

607. 25:15we had the arms of ours on you and the
608. 25:17children before we ever interviewed you
609. 25:19in the hospital I mean we interviewed
610. 25:21you that night at the hospital
611. 25:23from the hospital
612. 25:26I didn't know that
613. 25:42that that's just not right something's
614. 25:45wrong there I mean if you had fear for
615. 25:48your safety and your children's safety
616. 25:50it would seem to me that that would have
617. 25:52been
618. 25:53the best time when you have all the
619. 25:56policemen around armed guards on both
620. 25:58kids and you saw that for several days
621. 26:00armed guards on yourself
622. 26:01for several days it would seem to me
623. 26:04that would be the safest time not now
624. 26:09yeah
625. 26:13correct but the person has no reason to
626. 26:15come get me mad because you guys are
627. 26:17chasing me
628. 26:19he couldn't be closer they don't know
629. 26:21that we're still showing pictures he
630. 26:23doesn't know that the newspaper
631. 26:25so it doesn't mean anything do you guys
632. 26:27are still calling me a suspect
633. 26:30with the alleged attack
