Teen Kills 15-Year-Old Girl While Watching Bodycam Videos — Transcript

- 0:00It's just before 11:00 p.m. at an
- 0:02apartment [music]
- 0:03in Lake Township, Ohio, where police
- 0:05respond to a report of a person shot.
- 0:15>> Police.
- 0:16>> Hi.
- 0:17Hi. So, um the body is upstairs. Um and
- 0:22>> Okay, Mom, I'm going to let you go.
- 0:24>> Okay.
- 0:25So, it's upstairs and then
- 0:29um to the right.
- 0:35>> Downstairs, sir. It's on the dresser.
- 0:36>> Where is it at?
- 0:37>> It's over there. I cleared it.
- 0:42Nope. Nope, sir. It's on by my TV.
- 0:46No, sir. Other TV behind it.
- 0:4810 mm.
- 0:49>> All right.
- 0:52>> In an upstairs bedroom, officers find
- 0:5415-year-old Simmie Moore suffering from
- 0:57a gunshot wound to the head. As one man
- 1:00performs [music] CPR, an officer
- 1:03collects the weapon allegedly used in
- 1:05the shooting, while a familiar show airs
- 1:07on the television.
- 1:09>> Any other guns?
- 1:10>> No, sir.
- 1:20>> The officer secures the firearm in
- 1:22question, which is later submitted into
- 1:24evidence before returning to the
- 1:26bedroom.
- 1:40Simmie was pronounced dead on scene a
- 1:42short time later, according to an
- 1:44incident report. Next, more officials
- 1:47arrive as the investigation gets
- 1:49underway.
- 1:52>> And then
- 1:53I didn't know, but there was blood on my
- 1:55prom shoes, but so I touched her blood
- 1:57and I
- 1:58and then I washed it off in the sink.
- 2:00>> Did the Did the box come from upstairs?
- 2:02>> Yeah, it was It was from upstairs.

- 2:20>> Police identify the suspect seen here as
- 2:2218-year-old Jacob Heinzmann who one
- 2:26officer notes showed, {quote} "no
- 2:28emotion and was extraordinarily calm
- 2:31upon their arrival."

- 2:35>> Okay, go ahead.
- 2:36>> Just Just Just come downstairs.
- 2:53>> Yeah, what's the boy's name again?

- 3:03I was cleaning my gun.
- 3:05Um
- 3:06it was jammed. I couldn't figure out
- 3:07what was wrong with it. I took the mag
- 3:09out. I cleared it. There's nothing in
- 3:11there.
- 3:12I cleaned it again. I put the slide off.
- 3:13I put it back on.
- 3:15As I go to like reinsert the sock back
- 3:17onto the clip itself, it went off.
- 3:20There was There was just like nothing.
- 3:21First thing I did was call 911.
- 3:24She said, "Stay right there."
- 3:25All you guys. That's exactly what I did.
- 3:28I've done that a thousand times. It's
- 3:29never happened. Never had it happen that
- 3:30gun.
- 3:31I don't know what's going on and why it
- 3:32did that, but it never has.
- 3:36>> Jacob claims the gun misfired while he
- 3:39was cleaning it, leading to what he
- 3:40describes as an accidental shooting.
- 3:43But officials have more questions for
- 3:45him.
- 3:47>> Part two was in my purse.
- 3:49It's still in there.
- 3:51And so I
- 3:52was
- 3:52>> No, there are no other weapons like
- 4:00>> I don't know I'm sorry. I think there's
- 4:01a .22 upstairs in that room, but that's
- 4:03about it.

- 4:20I don't know how to say this,
- 4:21but the gun was on.
- 4:22>> Yeah.
- 4:25>> This is for my daughter,
- 4:26and I'm pretty sure she's dead.
- 4:28There was a bullet jammed There was a
- 4:30bullet jammed in the chamber. I was
- 4:32cleaning it out.
- 4:34There were two that were actually
- 4:36jammed. I cleared the first one out, and
- 4:37when I put the second one back on, the
- 4:39hammer re-engaged, and it didn't go off.
- 4:43Everybody in this house is great. I got
- 4:45a problem with my daughter. This never
- 4:46happened.
- 4:52>> What's that?
- 4:52>> I don't know what I could have done
- 4:53differently. I've done that a thousand
- 4:54times. This never happened.
- 4:58This jammed on me before, but it's never
- 5:00launched two bullets.
- 5:04Cuz before you guys got here, before I
- 5:06started CPR, I cleared it just to make
- 5:08sure I I was very compliant. And two of
- 5:10the the
- 5:12one round that was still fully intact
- 5:13came out, and I set that next to the gun
- 5:15with the discharged chambered round, and
- 5:17they were both next They're both in the
- 5:18gun.
- 5:19And there was a silence.
- 5:21I open up the chamber. I didn't know
- 5:22what happened. This happened so fast. I
- 5:23sleep with it cleared. I put it on
- 5:24safety. I had it locked. I had it almost
- 5:2624/7.
- 5:27I'm not home with it.
- 5:32She's going to take the biggest [ __ ]
- 5:34war.
- 5:37It won't go off cuz
- 5:39it's because of what I saw.
- 5:41But I'm going to go up and see what
- 5:42she's not
- 5:43>> And see what?
- 5:44>> I'm going to stop saying that she's not
- 5:46breathing cuz I'm wearing everything.
- 5:48>> I just want

- 5:51>> Well, from what I saw, it looked like it
- 5:53hit her right about here.

- 5:54>> There was no exit wound, so it wasn't a
- 5:56through and through shot.
- 5:58I tried CPR.
- 5:59I checked her pulse two or three
- 6:00different times. There was no pulse.
- 6:06Unfortunately, or fortunately, I should
- 6:09say, I've never had anything happen
- 6:11like this. How does that work about when
- 6:13all of this is done and through about
- 6:14getting my So, we're talking about my
- 6:16firearm at this time.
- 6:18>> Well, it's going to be a while.
- 6:19>> I figured, cuz it's going to happen

- 6:22it'll be held as evidence until

- 6:27along the lines of that. I just wanted
- 6:29to know something.

- 6:32firearm to be returned before making a

- 6:46she's never done anything like this
- 6:47before.

- 6:59arrives to question the suspect.

- 7:09days.

- 7:13Military?
- 7:15Yes.

- 7:22>> Eason.
- 7:23>> Eason. What happened tonight?
- 7:24>> Uh,
- 7:25my gun's been having a problem the last
- 7:26few days. Been jamming.
- 7:28So, the girls were talking to me.
- 7:29>> What kind of gun?
- 7:30>> Uh, 10 mm.
- 7:32>> Okay.
- 7:33>> I I can prove it right now if you want.
- 7:35I actually
- 7:37But I was sitting on my floor and it
- 7:38pointed this way. I guess it was having
- 7:40a problem getting jammed the last few
- 7:41days, so I was continuing to have these
- 7:43problems twice before I opened it and
- 7:44actually fired.
- 7:45Everything out of that suddenly went out
- 7:47of here twice.
- 7:49I took everything off. I I couldn't I
- 7:51couldn't find a problem with it. I don't
- 7:53I've never had a problem with it doing
- 7:54it.
- 7:55As soon as I put the slide back on and
- 7:57it engaged the handle of the pin, there
- 7:59were two rounds that were stuck
- 8:01simultaneously like this that I didn't
- 8:02see.
- 8:03And as soon as it did, it pushed the
- 8:04other one off.
- 8:09>> All right, who are you?
- 8:12Who are you with?
- 8:17Is there a girlfriend?
- 8:18>> I'm not calling her.
- 8:19>> Is there a girlfriend?
- 8:21Okay.
- 8:22Who are you with?
- 8:23>> I'm sorry.
- 8:24>> Okay.
- 8:25Are you guys going to want to talk to
- 8:27the other Everybody else here here
- 8:29except for the counselor?
- 8:30Is he here tonight?

- 8:33>> Yeah. He left. One of the reasons he
- 8:34left is because he took it back way too
- 8:36much. So, he was like, I I just need

- 8:41or back here instead?
- 8:42>> Station's probably fine.
- 8:44>> Jacob sticks to his story, but reveals
- 8:46that two other people were allegedly in
- 8:48the room when the shooting occurred.
- 8:50According to an incident report, one of
- 8:52those witnesses later told police that
- 8:54the four of them had been drinking
- 8:56before she noticed Jacob, quote, playing
- 8:59with his gun shortly before the fatal
- 9:01shot was fired.
- 9:05>> That doesn't look suspicious or
- 9:06anything?
- 9:07>> Not really.
- 9:09I tried not to, but
- 9:11I was more focused on her because
- 9:16the situation.
- 9:18>> Next, another investigator arrives with
- 9:20a few questions of his own.

- 9:25back to my deployment days, not
- 9:27something I ever wanted to see again.

- 9:42training.
- 9:42>> Yeah. So, I went through my MLS, it was
- 9:44my 2336 Delta. I went in for EOD.
- 9:48Um I've been out for
- 9:502 and 1/2 4 months.
- 9:54I'll be honest with you, everything's a
- 9:55little fuzzy right now.
- 9:56>> Okay.
- 9:57So,

- 9:59Prior to us taking this, did you have
- 10:01shoes?
- 10:01>> I told him I said if I'm assuming you
- 10:03guys want to take me down, then I would
- 10:04have to go upstairs grab my shoes and
- 10:06socks real quick and so I should like
- 10:07it. But otherwise, yeah, I would have to
- 10:08take them off.

- 10:11Yeah. I'll grab that for you. So, he
- 10:13just informed me there was somebody here
- 10:14that left prior to our arrival.
- 10:16>> There was so we There were three people
- 10:18here. It was me, her, and then it was my
- 10:20other buddy. He served with me.
- 10:21Um he left suddenly because of you know,
- 10:23he saw the same He couldn't He couldn't
- 10:25handle the situation. He left suddenly.
- 10:27He's going to meet
- 10:29Yeah, he was sitting right next to us.
- 10:30So, I was sitting
- 10:32My bed was here. I was sitting here. My
- 10:34friend was sitting over here and then
- 10:37my next man up was sitting in the
- 10:39closet.
- 10:40Three of us were sitting in the closet.

- 10:44>> Do I need to take a phone charger with
- 10:45me or can I charge it now?
- 10:47>> What kind do you have?

- 11:06So, she was having problems with her
- 11:08travels tonight. Asked if we could pick
- 11:09her up. I said, "Yeah, of course. We're
- 11:11good, okay."

- 11:12>> So, she came over here to stay the
- 11:13night?
- 11:14>> Yeah, I don't know what her other name
- 11:15is. Her
- 11:18Um
- 11:19they were leaving actually shortly. Um I
- 11:22thought 11:30 would be a good time to go
- 11:23back to their place.
- 11:24>> Okay.

- 11:29>> I I just don't understand how I I feel
- 11:31like I got every night at the same time.
- 11:33I wake up and I feel like I'm falling. a
- 11:34blanket and broke one of the slats and I
- 11:36fell and
- 11:39>> You heard that right. Jacob says Simoni
- 11:42was allegedly involved in an argument
- 11:44with a family member before he says she
- 11:46asked to come over.
- 11:48Seconds later the officer reveals the
- 11:50reality of the situation to the suspect.
- 11:54>> He said she was deceased.
- 11:55>> Mhm.
- 11:56>> And they did.

- 13:11dots on it because of when I went over
- 13:13here and I pulled her off the bed
- 13:14because that's what she asked me to do
- 13:15to give her CPR.
- 13:17And then when I pulled her off and I
- 13:18just flipped over here.
- 13:20>> Okay.
- 13:23>> I don't know if it was
- 13:25We we've been having a problem so like
- 13:26if you look on the spring on the itself,
- 13:28there's either like rust or some sort of
- 13:31like orange paint or something on the
- 13:32top of the spring towards the where the
- 13:34actual tip of the barrel is.
- 13:36That was the problem. I don't know if it
- 13:38was just sticky and it got lodged in
- 13:40there.

- 13:58one investigator shares some thoughts.

- 14:09thing about firearm safety and handling.

- 14:38his ride awaits.

- 14:41from sitting here for a while.
- 14:45I wonder if they might start being
- 14:46colder than the Polar Express itself.

- 15:08chats with an officer while waiting for
- 15:10detectives.

- 15:14I I've never made a mistake with a
- 15:16weapon. I was raised so heavily on gun
- 15:18safety.
- 15:21And what I don't understand is because
- 15:22when I cleared it, I had it on the floor
- 15:24and as soon as I turned it around, I
- 15:25heard click, boom.
- 15:28It was that simple. Hand wasn't even on
- 15:29trigger. I had it on the side of the
- 15:30>> Yeah.
- 15:31>> Like
- 15:33Never put my hand on the trigger.
- 15:35Just in case. I just said I'm just I'm
- 15:37I'm not even like I'm still grasping the
- 15:41fact that she got shot. Yeah, but I'm
- 15:43grasping the fact of how because I have
- 15:45never unless I tried to think it
- 15:46happened once or twice, but I have never
- 15:48seen you know a a pistol like that
- 15:50chamber two rounds. You know, between
- 15:52the blood on the floor and my sheets and
- 15:53everything, how's that going to work?
- 15:55Like do I get to go back home? Do they
- 15:57clean that out? How does that work?
- 15:59>> They're probably going to
- 16:01be processing that, I would imagine,
- 16:03until tomorrow.
- 16:04So.
- 16:07Well, very likely, I don't know what it
- 16:09would be, but you're going to catch some
- 16:10kind of charge because some somebody
- 16:12died.
- 16:15>> Yeah.
- 16:16Do you know roughly what it would be?
- 16:18Or do you have any idea?
- 16:19>> Yeah, I can't tell you.
- 16:20>> I'll never forget what though. The one
- 16:21thing that hurts worse about this case
- 16:23is the fact that she was so young.
- 16:25That's what hurts.

- 16:28>> 18. Yeah, but I'm trying to make some
- 16:30sort of light of the situation. The uh
- 16:33dispatcher was like, "Do you know how to
- 16:34do CPR?" I was like, "Well, ma'am, I was
- 16:37a lifeguard for 7 years. I would hope
- 16:38so."
- 16:39She was like, "Okay, do you need me to
- 16:40count for you?" And I'm like
- 16:42>> No.
- 16:43>> No, I'm okay. I promise you I I have
- 16:44more than enough extensive training on
- 16:46how to do CPR.
- 16:47>> Yeah.
- 16:47>> She was like, "Okay." So, I
- 16:49No, I was
- 16:50>> Yeah, couldn't do anything better than
- 16:51what you were doing, so.
- 16:54>> Well, that's definitely something I'll
- 16:55think about for a hot minute.
- 16:57Yeah.
- 16:58The fact that I'm in your guys's top
- 17:00three worst cases.
- 17:01>> Mine.
- 17:02>> Always yours.
- 17:03>> Yeah.
- 17:03>> She was like, "Yeah, just went out the
- 17:05uh Well, the officer that sat in there
- 17:06with me for like 6 hours." I was like,
- 17:08[laughter] "Well, that was that one.
- 17:09He's in the top three worst cases."
- 17:10Really something to be proud of. Go
- 17:12Jake.

- 17:18I don't know hurts more the fact that
- 17:20she was so young
- 17:21when the accident happened,
- 17:23seeing it and reliving it, or the fact
- 17:26of how her parents are going to react.
- 17:28And my uh
- 17:30her her best friend made a joke and she
- 17:32was like
- 17:34I really don't know what to do and I'm
- 17:35just going to use humor as a way She was
- 17:37like, "Well,
- 17:38at least she isn't second."
- 17:40But she was not to drive for that [ __ ]
- 17:41She didn't want to go to it and I was
- 17:43like
- 17:44That's really
- 17:46Too soon. Too way too soon.
- 17:49>> Yeah, that's humor you learn in basic
- 17:51training.
- 17:52>> [laughter]
- 17:53>> See, as much of the bad of the situation
- 17:55that I want to laugh just because I use
- 17:57laughter to cure, you know, cure that
- 17:58[ __ ] That's just what I do. Like
- 18:01humor is my way to solve a lot of my
- 18:02problems but I'm
- 18:04just kind of like in this situation I
- 18:05don't want
- 18:07I want to because I know it'll make me
- 18:09feel a little better. But that's the
- 18:11kind of dark that I'm just like that's
- 18:13not something I really want. Thank you.
- 18:16>> Seconds after stating he doesn't want to
- 18:18think about the incident, Jacob once
- 18:20again rehashes his side of the story.
- 18:23>> Cuz it's like one specific part that's
- 18:25continuously replayed.
- 18:26>> Mhm.
- 18:29>> It's like the only part of which is the
- 18:31fact that like you know,
- 18:33as soon as I put the slide cuz like the
- 18:34way it is you have to like pull the
- 18:36slide back and then lock it to then, you
- 18:39know, flip the switch back up to then
- 18:40close it. And it was as soon as I pulled
- 18:42it back because the way it is because it
- 18:44likes to get stuck right before you can
- 18:46actually lock it. So I like like threw
- 18:48it back into it and as soon as it just
- 18:51hit.
- 18:52It was just enough pressure. I don't
- 18:53understand how.
- 18:55But I was sitting
- 18:57kind of like this, right? And she was
- 18:58laying on my bed. She was kind of laying
- 19:00like if you were to lay like that it
- 19:01would be headed towards me cuz she was
- 19:02like laying on the side of my bed
- 19:04watching TV. We all were.
- 19:06Actually, we were watching Pitch
- 19:07Perfect.
- 19:09And um you know, I pulled my gun and I
- 19:11on, and I like throw back into it. And
- 19:13as soon as I did, my my my hand pushed
- 19:16it up, and as soon as it did, it just
- 19:17was enough to discharge it. And I I
- 19:19immediately heard it, and I looked over
- 19:20cuz I thought, you know, I've got my gun
- 19:22in my bed.
- 19:23I was like, okay.
- 19:24Scary, terrifying, put it on the wall,
- 19:26put it on the bed. Nobody gets hurt. I
- 19:28would rather that happen. So, I mean,
- 19:29it's a big deal. And then the moment I
- 19:31look over, it's just I'm just like
- 19:35I don't know what I'm going to do.
- 19:36Everybody up, call the cops. That's what
- 19:37I was thinking I did.
- 19:39And uh
- 19:40My friend was like, call the cops, call
- 19:41the cops, call the cops. I'm just like,
- 19:43I can't find my phone. I have to find my
- 19:44phone to call the cops.
- 19:45>> Yeah.
- 19:46>> And uh my girlfriend, she was just like,
- 19:48um um
- 19:49um I was like, you you need to get out.
- 19:52She was like, why? And I was like,
- 19:52because this will literally traumatize
- 19:54you. She was like, what about you? And I
- 19:55said,
- 19:56I've seen worse.
- 19:57Literally, I I promise you I've seen
- 19:59worse. This as much as it hurts to
- 20:01as much as this is going to hurt to do,
- 20:04I need to do this because everything
- 20:05will fall off. I said, I I have to do
- 20:07this because he can't, you won't, and
- 20:09I'm not waiting for the paramedics.
- 20:11So, it's just That's That's the part
- 20:12that I keep playing in my head.
- 20:15That's like the only part that has me
- 20:17like continuously shaking my leg cuz I'm

- 20:49guys it was like, you know, like where
- 20:50was everybody? I was like, well, I was
- 20:52on the floor.
- 20:53She was to be laying down on the other
- 20:55side of the wall. She was upstairs. Like
- 20:57I remember how she was laying. I
- 20:58remember how her hair was. Like I
- 20:59remember where my girlfriend was, how
- 21:01she was standing, cuz she had literally
- 21:02just walked back in her room.
- 21:05I remember that after the fact.
- 21:06>> See? She did it.
- 21:09I swear I could like sit here for hours
- 21:11and just be like, "What about this? What
- 21:13about this?" You know? Cuz my buddy was
- 21:15like, "Hey, you want to go do
- 21:16something?" I was like, "No, no, I just
- 21:17want to stay home." What if I would have
- 21:18said yes, you know?
- 21:20Or or something. Or what if I would have
- 21:22said yes to picking her up or you know?
- 21:25I think one thing that hurts me the most
- 21:26was that I told her she was going to be
- 21:27safe at my house.
- 21:29I said, "Nothing's going to happen.
- 21:31You're safe at my house."
- 21:32>> Yeah.
- 21:37That's one of those things that will
- 21:38be stuck in your head for a bit.

- 22:21incident report, he later dropped his
- 22:23claim that he was cleaning the weapon
- 22:25after detectives noted that they had not
- 22:26observed any cleaning equipment in plain
- 22:29sight where the incident occurred.
- 22:31Instead, Jacob allegedly said the gun
- 22:33simply misfired, while another witness
- 22:36claimed he was quote messing around with
- 22:38it by taking it apart and putting it
- 22:40back together.
- 22:41Next, additional officers arrived to
- 22:43escort the suspect to jail.

- 23:5918-year-old was additionally charged
- 24:01with improperly handling firearms in a
- 24:03motor vehicle, carrying a concealed
- 24:05weapon, and failure to comply with
- 24:07underage alcohol laws after prosecutors
- 24:10alleged he had driven with a fully
- 24:12loaded firearm earlier in the day. In an
- 24:14unrelated turn of events, Jacob was also
- 24:17charged with illegal use of a minor in
- 24:19nudity-oriented material after a search
- 24:22of his phone reportedly uncovered
- 24:24illegal material not related to the
- 24:26shooting victim.
- 24:27>> Excuse me, sir, do I have one quick

- 24:29>> Yes.
- 24:30>> Um the guy said that if anything were to
- 24:32happen, I just have my two babes on me.
- 24:33They said they would take it later.
- 24:34>> Okay.

- 24:39few phone numbers from my cell phone so
- 24:41I can call
- 24:43call somebody. How does that work?

- 24:45>> Uh that gentleman has it in there.
- 24:47>> Oh, then no. If it's already seized and
- 24:49booked, we can't
- 24:50take it out of booking.
- 24:51>> No, [snorts] no, that's fine. Um he
- 24:52[clears throat] said that if I left or
- 24:54anything that I would be able to get a
- 24:55or a cell phone like a number out of it.
- 24:57>> Yeah, I
- 24:58I got no way to do that, man.
- 25:00>> Can you ask him? Cuz that was the
- 25:01gentleman who I talked to.
- 25:03>> We got I mean, you need to talk to who?
- 25:05>> That gentleman that just walked out the
- 25:07that door right before I walked out.
- 25:08That's the man that I need to talk to
- 25:10real quick. He was the one who said I
- 25:12could.
- 25:12>> Okay. I'm going to go ask, but I'm
- 25:14assuming the answer's going to be no,
- 25:15but it's worth a shot.
- 25:16>> Thank you, sir.
- 25:18>> Sounds good.
- 25:19>> After pleading guilty to the charges,
- 25:21court records show Jacob was sentenced
- 25:23to more than 11 years behind bars and
- 25:26ordered to register as a sex offender
- 25:28upon his release.
