1:01now this is a woman who bit her victim
1:03in the middle of their struggle who the
1:05hell does that some damn wild animal
1:08you know i don't
1:09stephanie lazarus was charged and
1:11convicted of first-degree murder in the
1:14shooting of sheri rasmussen sheri
1:16rasmussen was the wife of her former
1:18lover john rutten so i want you to
1:21remember those three names because those
1:22are the three key people in this case we
1:25have the clown stephanie lazarus we have
1:28the victim cherie rasmussen and we have
1:30john rutten so stephanie and john were
1:32dating casually although john rhoden i
1:34think to this day hasn't
1:36still said that they were never
1:37boyfriend girlfriend they were dating
1:39through college it was casual and he was
1:41never really committed to her but at
1:42some point he finds someone that he
1:44really loves that sherry rasmussen while
1:46upon finding out about the engagement
1:47stephanie and lazarus freaked the [ __ ]
1:50out top bizarre things about this case
1:52one the right that i've already
1:53mentioned two the crime happened in 1986
1:56but it was not solved until almost 30
1:58years later in 2009. three stephen
2:00lazarus was lapd and that bite well that
2:03bite came and bitter in the ass later on
2:05because that was the bite that left the
2:06dna mark on cherry rasmussen and they
2:08kept that in the evidence room now with
2:10all the dna forensics they were able to
2:12find out that the dna belonged to
2:14stephanie lazarus one of her co-workers
2:16had took one of the cups that she
2:17disposed and tested for her dna and it
2:18was a match she was charged convicted
2:20early 2010s and then here she is trying
2:23to appeal let's go through it at the
2:25trial the prosecution established that
2:26stephanie had been in love with rotten
2:28and was emotionally devastated when she
2:30learned of his and rasmussen's 1985
2:32engagement she went to rottens in tears
2:34begging to reconsider and later
2:36confronted rasmussen at work and were
2:38discharged from a gun similar to the one
2:40owned by stephanie which she declared
2:42stolen two weeks ago after the shooting
2:44oh my god that sounds like 20 areas
2:46right there now they're not going to go
2:47away quietly after this her and her
2:49lawyers they're gonna put an appeal and
2:51they're gonna say that hey we have some
2:52issues with the trial let's go over
2:54really quick one the pre-accusation
2:56delay violated her due process right
2:59though the detectives they already had
3:00her as a suspect but when they had the
3:03dna evidence it confirmed it
3:06would be willing to give us one
3:08maybe two the trial court aired in
3:10denying a defense motion to quash search
3:13warrants in stefan lazar's home and
3:15computers
3:16okay three the trial court aaron denying
3:18a defense motion to traverse the search
3:21warrants or the trial court aired in
3:23admitting a tape of appellant's
3:24pre-arrest interview by lapd detectives
3:27i'm so glad that they've released this
3:29the public
3:33five the trial court aired and failing
3:35to hold a kelly hearing before admitting
3:37evidence of partial dna profiles from
3:38materials found on the victim's
3:40fingernail six the trial court aired by
3:42failing to allow the defense to reduce
3:43evidence for burglary that occurred in
3:45the area six weeks after the murder so
3:47number five basically says that there
3:48was other dna evidence underneath sherry
3:50rasmussen's fingernails and number six
3:52they were like well you know there's
3:53like burglaries going around the area
3:55around the time of rasmussen's death so
3:57maybe it was them maybe stephanie's not
3:59culpable for this yeah we'll see about
4:01that now this appeal paperwork goes into
4:03more details about what happened the day
4:06that sherry rasmussen was found in her
4:09apartment evidence at trial so i tried
4:12to find uh videos or maybe even like
4:15court transcripts of the trial but i
4:17wasn't able to get a hold of it and it
4:18really does go into detail so this is
4:20pretty good enough on february 24th 1986
4:24rasmussen this is after she was married
4:26to her husband john rutten by the way i
4:28think this was like about like a month
4:29after they were married or a couple
4:30months rasmussen live in a condominium
4:32on balboa street in van nuys with her
4:34husband john rotten worked as a nurse at
4:37glendale hospital rutten the husband
4:40left for work at 7 20 that morning
4:42rasmussen had called in sick both rotten
4:44and rasmussen's sister had tried to call
4:46rasmussen at home several times that day
4:48beginning at 10 a.m but she never
4:50answered at approximately 9 45 a
4:53neighbor anastasia valentis
4:57notice the garage the rasmus's
4:58condominium was open no cars inside when
5:02rotten returned at six o'clock p.m he
5:04noticed the garage door was open and
5:05rasmus's bmw was missing there was
5:08broken glass in the driveway from the
5:10shattering sliding glass patio door and
5:12the door to the condominium to the
5:14garage which rutten had closed and
5:16locked when he left that morning was
5:17open jar uh rasmussen was lying on the
5:20living room floor she was still wearing
5:22her sleep shirt and her robe the
5:24pathologist that examined sherry
5:26rasmussen's body uh declared that the
5:28cause was three gunshots to the chest
5:30and all of them were fatal they had
5:31found abrasions on sherry rasmussen's
5:34wrist consistent with injury from a rope
5:36and a cord like but what was stefan
5:37lazarus trying to do like try to stage a
5:38kidnapping she had multiple contusions
5:40lacerations abrasions all over her hands
5:42mouth face head and neck and they had
5:45found an injury on sherry rasmussen's
5:46face that was consistent with the blow
5:48from the muzzle of a gun they also
5:50claimed that there was a blow to sherry
5:51rasmus's head that was consistent with
5:53the broken face that was found near the
5:54body and then also additionally on
5:57sherry rasmussen's inner forearm there
6:00was a bite mark a bite mark honestly
6:02after watching stephen lazarus interview
6:05i could totally see her doing the bite
6:06mark the presence of multiple bullet
6:08holes gunshot residue on the quilt led
6:10authorities and experts conclude that
6:12have been wrapped around the assailant's
6:13weapons to dampen the sound of gunshots
6:15i thought that doesn't work i thought
6:17that was just like a thing that you see
6:18in movies but it actually doesn't work
6:20in real life i don't know i watch a
6:21youtube video on it and apparently it
6:23doesn't work especially if you use a
6:24pillow to try to silence your gun now
6:25one of the major reasons why stephanie
6:27lazarus wasn't caught up right away
6:28although i don't see how why not because
6:30a lot of people are pointing fingers at
6:31her makes sense right the jealous
6:33ex-girlfriend who wanted to be with the
6:34guy but she didn't get the guy at the
6:36end these people are pointing at you for
6:38whatever reason i don't know why that's
6:40just crazy i mean that's just that's
6:42absolutely crazy even the victim's
6:43family was pointing fingers at her and
6:45even john rutten as well but the lapd
6:47they closed the case because they deemed
6:48that it was a burglary gone wrong now at
6:51the crime of the scene stereo equipment
6:53had been pulled from the cabinet inside
6:54the condominium's living room and
6:55stacked by the door to the garage makes
6:57no sense a drawer in the living room
6:59table had been pulled out and the
7:00contents dubbed on the floor although
7:02there's no evidence of forced entry the
7:04rooms containing other valuables
7:05including additional stereo equipment
7:07were undisturbed the detectives who
7:09initially investigated they concluded
7:11that it was committed in the course of a
7:13burglary specifically they theorized
7:15that one or two burglars have came in
7:17through the door they were surprised by
7:18raz museum's presence and they had shot
7:20her over a struggle with her gun there
7:22are also other theories out there that
7:24since stephen lazarus was lapd they were
7:26saying lapd was covering it up or maybe
7:28stephen lazarus was trying to do things
7:30behind the scenes to cover up her track
7:31i'm surprised she didn't try to make her
7:32way into the evidence room and try to
7:34get rid of that bite mark sample man she
7:35must have been sweating because in
7:36december 2004 members of lapd cold case
7:40unit reopened the case asking the
7:42coroner's office to locate the bite mark
7:45tissue sample which had been in the
7:47freeze in the coroner's evidence room
7:48since 1986.
7:50uh in o5 sorry 2005. jennifer francis a
7:53criminologist with lapd she examined a
7:56piece of one of the swabs and found that
7:58there was dna on there now she found
8:00that it was a dna profile that belonged
8:02to a female so in 2009 the investigation
8:06turned towards specific women who might
8:08have reason to harm breast mucin the
8:11lapd officer surreptitiously obtained a
8:14sample of stefan lazar's dna by getting
8:17possession of her drinking cup and straw
8:19that she discarded now if you remember
8:21during her interview in 2009 she was
8:23asked towards the end of the
8:24interrogation well to her she knows
8:26interrogation at the time but she must
8:28have knew her gut feeling right you must
8:30have known like how are you lapd for 25
8:32years and not realize that you're really
8:33being interrogated okay don't get me
8:34wrong you're right i have been doing
8:36this a long time yeah and i wish i had
8:38been recording this but uh towards the
8:39end uh they tried to ask her for her dna
8:41swap and she was like no they were like
8:44okay okay sure but you know they end up
8:46getting it anyways asides from the scene
8:47of the crime i don't know why i keep
8:48saying crime on the scene but aside from
8:49the scene of the crime there are other
8:51factors there are other factors that
8:53contribute to evidence against stephen
8:55lazarus let's talk about this event
8:56right here so in 1986 stephanie lazarus
8:58was already lapd officer uh she actually
9:01got into the police academy in 1983 and
9:04graduated 1984. it's only one year for
9:06police academy
9:07anyways um
9:09um so brian met curtin who attended the
9:12academy with stephan lazarus described
9:14her as the most strongest most
9:16aggressive most persistent fighter of
9:19the woman in the class
9:21her level of strength with respect to
9:22other women as superior now just to keep
9:25in mind sherry rasmussen was over six
9:27feet tall she was also very athletic and
9:29i'm sure she was pretty strong as well
9:30like when you're a nurse sometimes you
9:32have to lift up heavy bodies so you
9:33definitely gotta get some strength but
9:34they also testified that stephan lazarus
9:36was a expert shooter however stephan
9:39lazarus showed her friend and fellow
9:41officer lock picking tools and that she
9:44had learned how to use them
9:47you know what they did say that sherry
9:49rasmussen's apartment there was no signs
9:51of breaking and entering so
9:53stephanie lazarus being the crazy person
9:55that she is most likely picked a lock
9:57can you imagine doing that in broad
9:59daylight like what if you get caught
10:00that's so embarrassing not like she
10:01would care though also in 1986 they said
10:03it was common for lapd officers to carry
10:05a backup weapon uh which was issued to
10:08them by the department so the
10:09interesting thing about this backup
10:11weapon uh well cynthia lazarus two weeks
10:13after sherry rasmussen's death she had
10:17reported that her gun was stolen from
10:19the glove compartment of her car in
10:21santa monica however this story is not
10:24consistent to what she told other people
10:26i believe at the time she also told her
10:28roommate or someone days before the gun
10:31was apparently stolen that she was
10:32carrying in a bag or a fanning pack and
10:34i guess it must have just fell out she
10:36asked him how to go about reporting it
10:37and then when the pellen reported her
10:39gun stolen in santa monica she told the
10:41officer the front desk that had been
10:42stolen that day uh there's no record
10:46indicating a penalty report of the staff
10:47to the lapd armor so we're gonna rewind
10:50things back a little bit we're gonna go
10:52back to the time when stephan lazarus
10:55and john rotten rotating and what
10:57happened when john rotten decided to
10:58date sherry rasmussen stephan lazarus
11:00and john rotten they had met in college
11:02dated casually in the late 1970s after
11:04graduation between 1981 and 1984 they
11:08continued to date and they were sexually
11:10intimate but rotten didn't consider as a
11:13girlfriend oh must have been a blow to
11:14her in june 1984 rotten had met
11:17rasmussen
11:19this just reminds me of jodie aries so
11:21much where jody was dating travis
11:23alexander
11:24then travis is like oh i'm good travis
11:26was seeing other people but the same
11:28time he was sexually intimate with jody
11:30and you know what i i'm i guarantee you
11:33that jody aries and stephan lazarus they
11:35were just trying to play at the cool
11:36girl like oh yeah i'm like the cool girl
11:38i don't care you can sleep with their
11:39people you know but you know behind the
11:41scenes they're probably seething not
11:42gonna lie though i try to play cool girl
11:44once and that [ __ ] that [ __ ] sucks it
11:46slugs [ __ ] that to all you young people
11:48out there don't play the cool girl it's
11:50not worth it so in may of 1985 john
11:53broughton and rasmussen they had become
11:54engaged in june of 1985
11:58stephen lazarus found out about the
11:59engagement called him upset and crying
12:03she asked john rotten to come to her
12:05condo at the time when he arrived the
12:07scene was a mess stephan lazarus was
12:09crying she was telling jon that she was
12:11in love with him and then repeatedly
12:13asked him to have sex with her following
12:15this encounter ruxin continued his
12:16relationship with rasmussen and several
12:19weeks later they moved in together some
12:21time after rutten and rasmussen were
12:22living together stephanie lazarus went
12:25to the hospital where sherry rasmussen
12:26had worked at and confronted her they
12:28had a verbal altercation and of course
12:30that evening cheri rasmussen she is so
12:33visibly upset she goes home she goes to
12:35vent her fiance and john rutten was like
12:37you know what i i have a confession to
12:39make you know that time when she called
12:40me and i went over to her condo well i
12:42had sex with her and so rutson had
12:45promised sherry laura smussen that he
12:47was never gonna have any more contact
12:48with stephanie they went on and
12:50continued to marry in november of
12:521985. so stephanie lazarus had told her
12:55roommate that she was in love with jon
12:58on one occasion while their roommate
12:59sometimes between 1984 1985 she woke up
13:03her roommate in the middle of the night
13:04she was crying she wanted everyone to
13:06console her she had told him that oh
13:08john had broken up with me and is going
13:09to marry someone else that's like red
13:11flags right there also stephanie became
13:13really sad easily upset after the
13:15breakup uh she also told the roommate
13:17that she had went to sherry rasmussen's
13:19place of work and confronted her when
13:22discussing why she did not date for an
13:23extended period after the breakup
13:25stephen lazarus told
13:26her roommate that she was picky and
13:28preferred men who were tall and athletic
13:30like john after stephen lazarus was
13:32arrested they had a search warrant and
13:34they went into her house they found
13:36journals daily planners some photos of
13:39john rudden still even though at the
13:40time he was already married the journal
13:42covered appeared between november 1984
13:45in august 1986 so this is before and
13:48after rasmussen's death i'm an entry for
13:51november 1984 discuss the night that
13:53kept my mind off john for a while anyway
13:56and then there's entry for april 1985
13:58stated the appellant saw john rutten's
14:00car put a note on it watch it for one
14:02and a half hour and check up on it a few
14:04times
14:05dude she was obsessive an entree for may
14:081985 mentioned visiting rotten and his
14:10girlfriend being there an entry from
14:121985 stated the appellant stephanie had
14:14found a rutten was getting married she
14:16described herself as being very
14:17depressed and her concentration was
14:19negative 10. listen if the guy that
14:21you're interested in
14:22has moved in with his girlfriend they're
14:24obviously at the stage of their
14:25relationship where things are starting
14:26to get serious another entry for june 85
14:28says that stephanie lazarus didn't feel
14:30like working too stressed out about john
14:33had a hard time concentrating these days
14:35so i caught up and said i didn't feel
14:36well could have a t.o i think it's time
14:38off they gave it to me uh there was no
14:41journal entry for march 1986 or any
14:44other time mentioning that her gun had
14:46been stolen you know what i think for
14:48jodi aries they also went through her
14:49journal entries too in august of 1985
14:51stefan lazarus wrote to john's mother
14:54telling her that she was truly in love
14:56with john and the past year had really
14:59torn her up the letter further stated i
15:01wish it hadn't ended the way it did and
15:03i don't think i'll ever understand
15:04john's decision uh in december 1985
15:07stephanie lazarus received a letter from
15:08jon renton's mom in her journal that
15:10made her very very very sad on the day
15:13of sherry rasmussen's death where was
15:15stephanie lazarus she was off work she
15:18was working that day and not only she
15:20was off that day but she was off the
15:22three days afterwards now let's talk
15:24about what happened after cherie
15:26rasmus's death did her and jon ever get
15:28back together did she finally get what
15:30she wanted or did she end up doing all
15:31this for no damn reason rutten saw
15:34stefan lazarus in 1989 so roughly
15:37three years afterwards uh they were both
15:39in hawaii on vacation with other people
15:42he saw her two or three times afterwards
15:44and they had a sexual relations they
15:45were never in a relationship this is
15:47what i don't get why did stephanie
15:49lazarus do all this why do this if
15:51you're not even gonna end up with the
15:52guy anyways i mean it says right here
15:54that she backed off after rasmussen's
15:56death now they were able to examine
15:59stefan lazarus's computer they found how
16:01did they even go back this far but they
16:04found that on her computer she had
16:05performed searches of john rutten's name
16:07in april 1998 in may 1999 and december
16:121999 that's like
16:1410 years later good girl
16:16does she not delete her internet history
16:18or i guess they can still recover it
16:20even though your internet history is
16:21clear i guess right now i want to jump
16:23to this part of the document right here
16:24because this just reaffirms what i said
16:26earlier people had suspicions that it
16:28was definitely a lazarus one after the
16:31death of rasmussen russian informed
16:32investigators that stephanie was his
16:34former girlfriend two sherry rasmussen's
16:36father told investigator that rasmussen
16:39had been threatened by her husband's
16:40former girlfriend three rasmussen's
16:43parents advised him to investigate
16:45stephanie lazarus i do want to jump
16:47ahead and talk about the burglaries that
16:48were going on in sherry rasmussen's
16:50neighborhood because the burglaries were
16:52the reason why they thought that sherry
16:54rasmussen was involved in a burglary
16:56gone wrong during opening statements
16:58defense council indicated his intention
17:00to present evidence of a burglary that
17:01occurred in rasmussen's neighborhood in
17:03april 86. the court subsequently warned
17:06council there would have to be
17:07remarkable similarities before evidence
17:10could come in and question why this
17:11matter has not been resolved prior to
17:13trial the next day the prosecution filed
17:15a motion to exclude third party
17:17culpability evidence the moving papers
17:19contained in the april burglary was
17:21remarkably different from the crime at
17:23issue and there was no direct or
17:26circumstantial evidence linking any
17:28third person to fresnes's murder
17:30according to police reports on april 11
17:331986
17:34six weeks after the murder a residential
17:37burglary occurred on balboa boulevard
17:39over a mile from resume since
17:41condominium the victim's condominium was
17:43similar to rasmussen's in which both had
17:45locked security gates and stairs leading
17:47from the garages to the condominiums the
17:49victim lisa rivalli told the detectives
17:51that she had been home all day during
17:53the burglary due to an illness someone
17:55rang her doorbell several times that
17:56morning she looked out the people and
17:58saw and unfilmed
18:10and saw an unfamiliar i think it's
18:12because anne and un is yeah that's just
18:14confusing okay saw an unfamiliar
18:17hispanic male she did not open the door
18:19when she had left later in the day the
18:21younger hispanic male in the blue
18:23station wagon seemed to be watching her
18:25uh when she returned her front door had
18:26been forced open standing at the
18:28threshold she saw the hispanic male had
18:30been sitting in the blue cart now
18:31putting stereo equipment uh by the
18:33garage stairs into the bag he ran past
18:36her out the front door and a security
18:38gate a second hispanic male came
18:39downstairs carrying a gun describing the
18:41victim by a 38 with a four inch barrel
18:43our volley had turned and ran the arm
18:46burglar also ran ravali observed paper
18:48stuff to the locks of the outside
18:50security doors apparently placed there
18:51to keep the door from locking shut many
18:53items on the upper floor of the
18:55condominium has to rifle disturb
18:56including a typewriter oh my god a
18:58typewriter oh these have typewriters uh
19:00a jewelry box a dresser a hope chest the
19:03hope chest oh it's one of those chests
19:04that like opens up like this like in
19:05eating the beast the culprits escape
19:07with someone for volley's jewelry the
19:09trial court concluded the evidence did
19:10not meet the standard for third-party
19:12culpability evidence and excluded it the
19:14court found similar certainties
19:15similarities including the killing took
19:17place in daytime and the april burglary
19:19was a daytime crime theory equipment was
19:20involved in both crimes
19:22and so was a gun okay however the court
19:25found the differences uh prevailed the
19:27burglars forced their way inside
19:29rasmus's home showed no set of force
19:30entry and the burglars ransacked revolt
19:33his bedroom took jewelry rasmussen home
19:35showed no evidence of intruder sought
19:37jewelry the burglars left for volleys
19:39home in their own vehicle rasmussen's
19:41assailant left in hers finally the
19:44burglars upon being discovered by rivali
19:46fled without discharging a weapon breast
19:48muse of the stale and brutally beat her
19:50okay again with the vase with the bear
19:52with the gun and there's other marks as
19:54well bit her which definitely seems like
19:56it's personal and then shot her to death
19:58other court found the critical feature
19:59to be nothing linked to the suspects in
20:01the april burglary true rasmus homicide
20:03it's so funny how they're like oh yeah
20:04you know these are such similar you know
20:06because um well there was a stereo
20:07equipment that was involved and there
20:09was a gun that was involved
20:11so
20:12what happened to stephen lazarus appeal
20:14well you better defend him right now
20:15don't worry spoiler she's not like
20:17roaming the streets for you right now or
20:18anything certain facts are largely
20:20uncontradicted at trial and were
20:21demonstrated through the introduction of
20:23evidence whose admission is not
20:24challenged on appeal the appellant
20:26deeply in love with rotten love how he's
20:28not was devastated by his decision to
20:30marry rasmussen more like deeply
20:32obsessively in love okay b the appellant

20:58her dna that found in her bite mark was
21:00intentionally designed to secure a
21:02tactical advantage and showing of
21:04prejudice was minimal we discern no
21:07error in the trial court's determination
21:09the substantial justification for the
21:11delay outweighed any marginal prejudice
21:14demonstrated by appellant and that she
21:16failed to establish a violation of her
21:19due process rights i do have a question
21:20though if you're prosecuting sorry if
21:22you're convicted of crime
21:24especially if a crime is heinous murder
21:26can anyone disappear or do you have to
21:28meet certain thresholds in order to
21:29appeal like for example for when i learn
21:31about the johnny depp and amber heard
21:32trial it's like well not anyone can just
21:34appeal the verdict to try to delay the
21:36uh the payment process because you know
21:39like in virginia you have to post the
21:41bond amount which is the verdict amount
21:43plus interest six percent and yada yada
21:45yada so i i wonder how it is with um
21:48appeals for uh murder trials i gotta
21:50look that up stephanie's obsession with
21:51rotten and desire to continue the
21:53relationship reported the inference that
21:55she would have returned items relating
21:56to him including photographs uploaded to
21:58a computer in any event the trial court
22:00found the officers conducting the
22:02searches relied in good faith upon the
22:06issuance of the warrants though
22:07stephanie's interview statements were
22:08voluntarily made in the course of what
22:10any officer in a position would have
22:12recognized as a criminal investigation
22:15they have that jab man she should have
22:17watched because i know how this stuff
22:19works i mean i i she said i know how
