  11. 0:57with the senator I Kevin a vard state
  12. 1:00senator here in district 12 in New
  13. 1:01Hampshire and today we're going to be
  14. 1:03talking about the death penalty and my
  15. 1:06guest is Sabrina Butler Porter from
  16. 1:09Mississippi who was on death row and
  17. 1:11she's actually an exonerate and I want
  18. 1:13to welcome you to the show thank you for
  19. 1:15coming and thanks for listening to my
  20. 1:17singing so when people think of death
  21. 1:23row most people don't generally think of
  22. 1:25a women being on death row but somehow
  23. 1:29you ended up on death row how did that
  24. 1:30happen well when I was 17 years old I
  25. 1:34was accused of grammatically my son is
  26. 1:36operating on me and I didn't know how to
  27. 1:38apply CPR I was accused of beating him
  28. 1:42today
  29. 1:46a hard thing for me because you know I
  30. 1:48lost my son and being being accused of
  31. 1:50killing him was very difficult I went to
  32. 1:55the police station after it happened and
  33. 1:57they started questioning me and they
  34. 1:59wanted more answers and they didn't want
  35. 2:02to hear the ones i was giving it they
  36. 2:04were throwing away the original
  37. 2:06statements that I were giving them and
  38. 2:08he wrote out a statement for me to get
  39. 2:11to find after 4i read the statement that
  40. 2:14he made after four hours of them fussing
  41. 2:17at me and see me like they want to jump
  42. 2:19on me and all that I just found I was
  43. 2:22scared I didn't know what did it at 17
  44. 2:25and I didn't think I just knew that
  45. 2:27these people were like they want to hurt
  46. 2:31me so I found and when I found it I was
  47. 2:35charged with Captain with a capital
  48. 2:37murder and have you had any convictions
  49. 2:40or any problems prior with the longhouse
  50. 2:42everything at all you're so we married
  51. 2:45at the time room oh yeah remember and
  52. 2:47how did that what did your husband say
  53. 2:50well we were separated again I again
  54. 2:54pregnant my first child very early age
  55. 2:56mom signed me over to my first husband
  56. 2:59we didn't play together for a year okay
  57. 3:02so I had been promised by myself since I
  58. 3:05was 14 years old columbus mississippi

  60. 3:13what you described briefly what happened
  61. 3:16how did you cover my way wells at the

  63. 3:21son he just I don't know I don't know
  64. 3:23what happened I mean what I did was I
  65. 3:26went jogging at night and most time I
  66. 3:29think that's why I made my mistake I
  67. 3:30left them at the house you know sleep
  68. 3:33and I jogs up the street and came back
  69. 3:34and that's when I noticed it he wasn't
  70. 3:37breathing and I panicked I didn't know
  71. 3:38what I should do what I shouldn't do I
  72. 3:41just grabbed him in Moran I think back
  73. 3:45on that a lot of people say well you
  74. 3:47shouldn't left him at the house but I
  75. 3:48mean I was only seven town was thinking
  76. 3:50like I should have been thinking but you
  77. 3:52grabbed him and grabbed imran and when I
  78. 3:54ran lady downstairs in the apartment
  79. 3:57below me he called me by me
  80. 4:00I didn't know she knew me but he ever
  81. 4:01did she did she grabbed my son and she
  82. 4:03put him on the floor and started CPR and

  92. 4:28we did PPR I think I plateau so the
  93. 4:31right amount of pressure the lady that
  94. 4:33was helping you what happened to us she
  95. 4:36was a white female I'm black so they
  96. 4:39count a pusher to the fat after she gave
  97. 4:41her a statement and everything it was
  98. 4:43nothing else and to her you see was
  99. 4:45definitely looking to me yeah okay so
  100. 4:50you're in a panic you're grieving and
  101. 4:53you signed your life away and all in
  102. 4:58within 24 hours what happened to ask
  103. 5:04that you went to trial they sent me to
  104. 5:06the county jail bait in an old jail
  105. 5:08period for a year a year I saw my first
  106. 5:12set of attorneys two days before trial
  107. 5:14didn't know who my journey to work I was
  108. 5:18told to just sit in front of juries look
  109. 5:20at the true I was given no type of
  110. 5:22preparation for trial or anything like
  111. 5:24that one of the times ahead was drunk
  112. 5:27doing the whole track so you're sitting
  113. 5:29in prison return to jail for a year no
  114. 5:32communication with any defense lawyer
  115. 5:34nothing not really sure what you're
  116. 5:37being charged or did they charge they
  117. 5:38charged me they charged me but they also
  118. 5:40charged me with a child abuse law and
  119. 5:42wasn't allowing 223 days after I'm
  120. 5:44locked up I was already locked up and
  121. 5:47they gave me a chart that wasn't even a
  122. 5:49lawyer did you have any family to
  123. 5:53support you my mom when she found out
  124. 5:55they came down my mom started trying to
  125. 5:59talk for me you know and do things like
  126. 6:01that she really didn't know what to do
  127. 6:03we're never faced with you know
  128. 6:05something of that magnitude so it was
  129. 6:07basically just lose for black and in the
  130. 6:10wrong places where I see it because
  131. 6:12I think my case was mostly merely
  132. 6:16racially motivated and it was just
  133. 6:18something for this district attorney has
  134. 6:20time to do 25 years old he was
  135. 6:22overzealous and he just did whatever he
  136. 6:24could do to get it out prosecution of
  137. 6:27thinness so did they are they how do you
  138. 6:30sign a confession yeah and the way I
  139. 6:32find it I knew it was wrong I put my
  140. 6:35signature on the outside of paper and
  141. 6:37that was brought up in in court like if
  142. 6:40she knew what she was signing why did
  143. 6:41she put her initials way over here and
  144. 6:45you accepted that as a as her you know
  145. 6:48hey that's a fulsome know that I'm good
  146. 6:52they just they want your head they just
  147. 6:55wanted a conviction how long did Shiloh
  148. 7:00I try last a week because two hours for
  149. 7:03them to come back and if I get very near
  150. 7:06the jury had a jury not of my peers but
  151. 7:08haven't you two black from the jury one
  152. 7:10was all do we tell you the symptoms
  153. 7:16sends me to die by lethal injection
  154. 7:18launched to 13th 1990 and my death date
  155. 7:21july second nineteen ninety on the new
  156. 7:25industrial use mammals

  158. 7:36you were on death row for two years of
  159. 7:38the two years and a month when they
  160. 7:40overturned my sentence in 92 sent me dad
  161. 7:44back down I'm thinking that I did well

  163. 7:46symptoms they overturned it because the
  164. 7:48dish return took the jury to a picnic
  165. 7:50why they were supposed to be sequestered
  166. 7:51and he kept alluding to the fact that I
  167. 7:53wouldn't testify in my own defense he
  168. 7:56made jokes being so concerned and you
  169. 7:59can't do that but he can't do it because
  170. 8:01of me he did it I guess just to do it my
  171. 8:04attorneys will let me take the stand in
  172. 8:05my own defense I tried but they were let
  173. 8:08me take the show who said hey you know
  174. 8:09what district attorney screwed up here
  175. 8:12we went to bat for either the first
  176. 8:15attorney that I had felt really bad
  177. 8:17because we really didn't do the
  178. 8:18investigative work at two attorneys one
  179. 8:20was drunk with it the main attorney I
  180. 8:22decided to write a brief for this for my
  181. 8:26nowhere to go to the higher court and
  182. 8:28when he did I ended it with two sets of
  183. 8:31new attorneys who took his briefs and
  184. 8:33they went to argue which is one of the
  185. 8:35attorneys name was Clive Stafford Smith
  186. 8:37who was a he's started organization I'll
  187. 8:40retrieve and he's from England but he
  188. 8:42does a lot of work in the states at the
  189. 8:44time and I he saw my case and took it
  190. 8:49you didn't pay charged music into the
  191. 8:53game they knew who was wrong so you your
  192. 8:59child got overturned is that when you
  193. 9:00were exonerated know when I was with my
  194. 9:02trial was overturned in 92 I thought
  195. 9:05that I was supposed to go back to court
  196. 9:06and you know try to be over but it
  197. 9:09didn't happen like that this returning
  198. 9:11made me sit in the county jail another
  199. 9:12three years before i even went back to
  200. 9:14trial for the second trial when i went
  201. 9:18that you asked for a speedy trial well
  202. 9:20my lawyers did yeah he he kept making
  203. 9:22excuses and they kept grand him you know
  204. 9:25more time and it took three years so
  205. 9:29then once we did make it back to court
  206. 9:32all the time in my firm's records he had
  207. 9:35heart problems kidney problems and
  208. 9:37chronic bowel syndrome always there the
  209. 9:40autopsy report that was done it was
  210. 9:42halfway done because they didn't exhibit
  211. 9:45in have enough money to do
  212. 9:46proper office reports they just kind of
  213. 9:48throw them together and I all this was
  214. 9:50found out in the second trial some of
  215. 9:53the likely also police officers they
  216. 9:58change their testimony a lot of so it's
  217. 10:02a hours of deliberation I'll find on
  218. 10:05your TV 7 18 to 99 25 right on already

  247. 11:38where we were there's only two of us on
  248. 11:40death row at the time and the only

  263. 12:21reading material for stuff like yeah how
  264. 12:28tell me about your conversation me know
  265. 12:31basically with her talking to me trying
  266. 12:34to tell me her experience of being ago
  267. 12:35she had been on there for a while mmm
  268. 12:37she kind of knew you know what they
  269. 12:39expect or what was going on she just
  270. 12:42basically just let me grow up I was 19 I
  271. 12:47got there I was she she 30 that's what
  272. 12:53happened she was a piece of cool police
  273. 12:55up there he got out no she got all day
  274. 12:5840 but they gave her for 25 years to one
  275. 13:01does Mississippi so utilized to
  276. 13:05definitely it's still on the books still
  277. 13:08on the books and actually and add it
  278. 13:09more to it I think they kind of regret
  279. 13:12the firing squad and like this chair we
  280. 13:15have lethal injection but they're trying
  281. 13:16to do add those two I don't understand
  282. 13:20the electric chair that just doesn't
  283. 13:22make sense to me it does not make sense
  284. 13:25living right because we've talked many
  285. 13:28times to people on death row Green Mile
  286. 13:33yes I that was it that was very sad and
  287. 13:37but just thinking I do a better job if
  288. 13:41you're wanting execute somebody that's
  289. 13:44just a horrible way to go no ideas just
  290. 13:48put somebody under their existence I
  291. 13:50make them miserable on their way bottom
  292. 13:52line so you're John raid well you
  293. 13:57communicated with this lady to a toilet
  294. 14:00I mean I'm on the floor you had that
  295. 14:01talk underneath the under the wall yeah
  296. 14:03under wall she was really my keeper
  297. 14:07again we did
  298. 14:10much that's going on there during your
  299. 14:11days are you really I mean what would
  300. 14:13you talk about the life itself yeah just
  301. 14:16the things you want to do no Oak's dream
  302. 14:18stuff I wanted to do that didn't get a
  303. 14:20chance to do want to see my phone when
  304. 14:23I'm older found that older them
  305. 14:25something bad and all so some people say
  306. 14:31well you know if we if we get rid of the
  307. 14:33death penalty where we're going to get
  308. 14:36rid of a deterrent you know for people
  309. 14:40doing crimes or we're not gonna be able
  310. 14:42to use that in the negotiations your
  311. 14:45prosecution to get confessions and
  312. 14:47things of that nature that's all kind of
  313. 14:49screwed up isn't it is because the
  314. 14:52definite is not a deterrent it doesn't
  315. 14:53suit climb people are filled one out
  316. 14:55doing god knows what I think that
  317. 15:00you really definitely will be great so
  318. 15:04living in a cubicle if instead of giving
  319. 15:07somebody the death penalty in spending
  320. 15:09millions of dollars i don't know how
  321. 15:10much was spent on your case from the
  322. 15:13state but if you were to be put in that
  323. 15:14cubicle for the rest of your life only
  324. 15:17allowed one hour oh I justice has to be
  325. 15:21served for those that do commit instance
  326. 15:23that the gentleman that went I'm I
  327. 15:24shouldn't call me gentlemen but he went
  328. 15:25into a bar gay bar and he just shot up
  329. 15:27everybody that was going to happen to
  330. 15:30that person sorry your garage general
  331. 15:32population is too good saying I beg to
  332. 15:37differ yeah yeah because see for me if I
  333. 15:41hadn't been in detective density pinion
  334. 15:43calculus because you're not facing
  335. 15:46people think that you're all but you
  336. 15:48change so many things happen ribbon and
  337. 15:51general population is worse because get
  338. 15:54raped its speed up tab it's true i mean
  339. 15:59people think that prison is really hard
  340. 16:02for the card that means for you yeah or
  341. 16:04like it that's just not true sometimes

  343. 16:10fail isn't a no place for nobody and if
  344. 16:15you get that kind of training for life
  345. 16:16sentence my work yourself it's really a
  346. 16:20disservice to be honest to be honest you
  347. 16:22you're not show you some prison I tell
  348. 16:25everybody there I mean I also have to
  349. 16:28either the revolving door I really don't
  350. 16:31but I just don't feel that we have the
  351. 16:34right of Center vegetate those life
  352. 16:35because I feel like if you kill me for
  353. 16:38something that I did in order to any
  354. 16:41better than me you're killing killing is
  355. 16:43wrong it doesn't matter hottie and gooey
  356. 16:44and I just feel like prison takes care
  357. 16:47of itself what you do Jeffrey Dahmer
  358. 16:50it's happening here in the last two
  359. 16:53months so you're obviously being in the
  360. 16:59bottom what stopped you from losing your
  361. 17:01mind Oh hard i mean i think the
  362. 17:04conversations with her role it a lot
  363. 17:08great a lot because I imagine if I had a
  364. 17:11set
  365. 17:12probably cracked up I mean it's what is
  366. 17:15it you know that you know the verse in

  372. 17:29child dies and you were accused there
  373. 17:31must have been some self-reflection

  375. 17:35that I was angry for the first three I

  377. 17:40because I felt like I you know I tried
  378. 17:42to say you know I'm gonna do the right
  379. 17:44thing didn't know how to do so I felt
  380. 17:46like I shouldn't left the house I felt I
  381. 17:50was continuing myself I didn't need to

  383. 17:54day of my life you know I figured always
  384. 17:56try always making ten what I've done
  385. 17:59better with you know but I look at it
  386. 18:01like my phone already creeped sick to
  387. 18:04the point that I didn't even know I
  388. 18:05didn't even know he had all these easy
  389. 18:08and and I say that to say today I have a
  390. 18:1214 year old daughter with the same
  391. 18:13exactly and we're fighting for her life
  392. 18:16right now so I mean it's not fit I'm

  417. 19:33people aren't different right now Gina
  418. 19:36but I think one of the things that
  419. 19:39disturbs me most about this whole thing
  420. 19:41I mean I've been poor definitely all my
  421. 19:42life you know in this part of the you
  422. 19:45know being conservative you know justice
  423. 19:47I mean justice denied us or delayed
  424. 19:51istam you know justice denied in and you
  425. 19:55come up from a fake that that believes
  426. 19:58that there is a degree of of justice
  427. 20:02that need to be carried out however in
  428. 20:04that same faith which is my Christian
  429. 20:06faith it the Lord is very angry with
  430. 20:09those that shed this is blood and if we
  431. 20:14allow innocent blood be shed in our
  432. 20:18justice system and if some innocent
  433. 20:21legate's that's not the cost of doing
  434. 20:23business and and these six things stuff
  435. 20:26the Lord hey no lying tongue last one is
  436. 20:30he that he that shits in a simple I'd so
  437. 20:35if we are trust these people that have
  438. 20:39ambitions and did you know they like
  439. 20:41they just made a conviction I'm going to
  440. 20:42make attorney general if I get this this
  441. 20:45person on death row I'm gonna look like
  442. 20:48a hero because I got the bad guy
  443. 20:50regardless of the truth and it seems
  444. 20:52that that's happened at least 150 times
  445. 20:54in our what are the safeguards from
  446. 20:57being under a road prosecutor business
  447. 21:03and I feel like as long as we have a
  448. 21:06human element surrounding the distance
  449. 21:08we're not going to get it right I'm just
  450. 21:10sorry I just don't feel like you can fix
  451. 21:14this or make it where I got the right
  452. 21:16person this time I just don't I feel
  453. 21:19like if you got a life sentence you got
  454. 21:21a chance to go back and fix with you so
  455. 21:24you can't fix the person there to kill
  456. 21:26you k you can't go back and fix that so
  457. 21:28that's why I feel like we should best
  458. 21:30final bleeding again so you must you
  459. 21:32must have spoken to a number of
  460. 21:34exoneration what is one of the most
  461. 21:36compelling stories that you've heard
  462. 21:37other than your own well I mean we just
  463. 21:41whole time is wall justice and we want
  464. 21:43to see something done for the role that
  465. 21:45lead up this is like ups to us
  466. 21:48we were tortured no reason I mean being
  467. 21:52accused of something that you didn't do
  468. 21:53and you sit in something no big it in
  469. 21:55your bathroom and you having to you know
  470. 21:58look at its window and say hey you know
  471. 22:01I didn't do this you guys got me locked
  472. 22:03up Colin so this is 17 year olds are out
  473. 22:07there right now and which is therefore
  474. 22:11being accused of them what's your first
  475. 22:13advice give advice to them I wouldn't
  476. 22:16think it always I would see it's my
  477. 22:19parents or whatever are coming that room
  478. 22:22or I would explore attorney right off
  479. 22:23the back I don't care what they say to
  480. 22:25me I would that's where i miss good fit
  481. 22:27I should have waited ask my mom
  482. 22:31something that's furniture in here thank
  483. 22:34you learning and keep your mouth closed
  484. 22:36and let the attorney advise you as to
  485. 22:38what you need to do well what about
  486. 22:39after four hours worth of being
  487. 22:41interrogated I actually watched them a
  488. 22:44Discovery Channel where they wore
  489. 22:46somebody down 24 hours I know it and
  490. 22:48they didn't mom to eat no bathroom break
  491. 22:51and and they got a fault you know
  492. 22:54because the boy was handicapped no no no
  493. 23:00and then that's my hardest thing I don't
  494. 23:02know I don't have an answer for that
  495. 23:04because that's that falls on the Calusa
  496. 23:07phone wherever you have interrogated lot
  497. 23:10of money retraining you know what I'm
  498. 23:12saying and I think it's a lot of naughty
  499. 23:14college type night this isn't it my
  500. 23:17humble opinion you know the police are
  501. 23:18trying to do their job and and you know
  502. 23:20but if you know there could be one bad
  503. 23:22apple in the hole you know we don't want
  504. 23:26to cast aspersions how we don't know
  505. 23:27about there's the police officer ability
  506. 23:29yeah I melody I it's the prosecutor
  507. 23:33that's but on the case that should be
  508. 23:35professional and look at all the
  509. 23:36evidence and have a clear discernment
  510. 23:39but you have somebody who's ambitious I
  511. 23:41think that's work I really struggle with
  512. 23:43it your ambition doesn't you know you
  513. 23:48can affect somebody's life or death and
  514. 23:51we were joking a little bit before we
  515. 23:53got on camera and said you know I have
  516. 23:55you know my faith in the justice system
  517. 24:00is somewhat skewed right
  518. 24:02and we both agree to that because if lot
  519. 24:05they're flawed individuals inland
  520. 24:08precious life so why I feel like we
  521. 24:14should have a dancer so we wouldn't have
  522. 24:15to worry about them making that type of
  523. 24:18mistake and killing them well I
  524. 24:23appreciate you coming on the show how do
  525. 24:24people get in touch with witness when is
  526. 24:26the institute is go to limit inches or
  527. 24:28and you can go on and it shows exonerees
  528. 24:32that we have that are in the program
  529. 24:34with us and then you can also go to d
  530. 24:37picta therefore it shows all these
  531. 24:41honorees and i'm in other cities and
  532. 24:45basically just you know get in touch
  533. 24:48with us that way you can come to your
  534. 24:49town how many schools churches you speak
  535. 24:52all over you do this for a living which
  536. 24:55is a strong fear fees no I don't do for
  537. 24:57a living I just do it every night I'll
  538. 24:59do it all time I got a job what do you
  539. 25:01for woody's you for i'm working at
  540. 25:03target all right all right good yeah are

  542. 25:10subsequent you thinking yeah so it takes
  543. 25:14its toll right I did everything takes it
  544. 25:16so it is as you know exonerees is hard
  545. 25:18for your spouse or something to count on

  547. 25:23kind of difficult and I think you
  548. 25:24brought something up above me two pts I
  549. 25:26mean people that come back with more
  550. 25:27aware people that have been in orange a
  551. 25:30detour to institutionalize which in my
  552. 25:32opinion can be just as bad as being sore
  553. 25:34again mentally you have to deal with a
  554. 25:37lot of different emotions you're very
  555. 25:38complicated at this point right you
  556. 25:40don't get help for it to get out they
  557. 25:42don't and we've all tell me can't for it
  558. 25:45so I try to do this is my way of filling
  559. 25:48my fill I think that does help when you
  560. 25:51help others it helps you process for the
  561. 25:54whole thing some people can internalize
  562. 25:56and poor me but by helping others I
  563. 25:59think you have me you can move forward
  564. 26:02and move on with your life and out of
  565. 26:05here and you're 14 year old daughter how
  566. 26:07does she deal with all this well she
  567. 26:09wants the car with me every time I gold
  568. 26:10but that's it strip right yeah thanks
  569. 26:14for coming on the show really

  572. 26:20there's some legislation coming up soon
  573. 26:21in the house about expanding the death
  574. 26:24penalty and I think I'm going to have a
