- 0:00Caroline Peña was a mother of five young
- 0:02children living in Del Rio, Texas, a
- 0:05small city near the Mexican border.
- 0:07>> [music]
- 0:07>> On June 25th, Caroline was killed in
- 0:10broad daylight, stabbed to death in a
- 0:13brutal attack
- 0:14>> [music]
- 0:14>> outside of a Sonic fast-food restaurant.
- 0:17The attack was caught on camera and it
- 0:19didn't take long for investigators to
- 0:21track down the suspects. Two sisters,
- 0:2419-year-old Cookie Diaz and 21-year-old
- 0:28Kitty Diaz, were arrested along with a
- 0:30third woman. Police arrested them at
- 0:33their home. Now everyone is talking
- 0:35about their reaction to the arrest. This
- 0:38was an absolutely gruesome murder scene,
- 0:41but none of that seemed to impact Kitty
- 0:44or Cookie. Cookie was smiling, caught on
- 0:47camera by a local journalist who [music]
- 0:49captured the moment Cookie and Kitty
- 0:51were arrested. Now everyone's wondering,
- 0:54why were they smiling and why did they
- 0:56allegedly murder this young mother of
- 0:59five?
- 1:02This is the kind [music] of case that
- 1:04creates incredible public outrage. Such
- 1:07a gruesome, bloody crime scene. A mom
- 1:11taken away from her five children
- 1:14and the two suspects, sisters, smiling
- 1:17after being arrested. Why did this
- 1:20happen?
- 1:21I'm Vinnie Politan. Let's investigate.
- 1:39I'm a child of the '70s and growing up
- 1:42the classic smiley face, that smile,
- 1:46had a very significant meaning, right?
- 1:49It was to spread happiness, be happy.
- 1:52When you would get your papers back,
- 1:54right? As a grammar school uh kid, if it
- 1:57has smiley face on it, that was good.
- 2:00Right? It's always positive. If you
- 2:02watch Forrest Gump the movie, right?
- 2:03When he puts the the towel on his face
- 2:05and that smiley face comes out, that's
- 2:07that's what I think about when when I
- 2:09think about the smile and the power of a
- 2:13smile and what it means. It should be
- 2:15about something happy. It should be
- 2:17about joy. It should be about love. It
- 2:19should be about friendship. It should be
- 2:21about so many different things.
- 2:25But in this case, it's not about any of
- 2:27that.
- 2:30It's creating outrage. Outrage from the
- 2:32public, outrage from me.
- 2:35Cookie was smiling, one of the two
- 2:37sisters who was arrested
- 2:40for a brutal brutal murder. And And my
- 2:42understanding from some of the local
- 2:44reporting
- 2:46is that
- 2:47the woman who is dead,
- 2:49Cookie knew that she had small children
- 2:52at home.
- 2:55Now, I don't know what happened. It's
- 2:56alleged that she's responsible along
- 2:59with her sister and a third woman.
- 3:02But at a minimum,
- 3:04but at a minimum,
- 3:06a mother of five is dead.
- 3:09And how does that lead to any sort of
- 3:11smile when you're being arrested?
- 3:14Oh, she's young, I get it.
- 3:16But like
- 3:17not that young.
- 3:20Okay?
- 3:21Not not so young that you can't figure
- 3:23out right from wrong.
- 3:25Good from evil.
- 3:29And what happened to this mother
- 3:32and what happened to those five children
- 3:33as a result is is
- 3:35unreal.
- 3:37Because while she's smiling, there are
- 3:38five children who are not smiling.
- 3:42And will have a very difficult time to
- 3:43smile
- 3:44uh for a very long time.
- 3:47This has
- 3:48impacted the trajectory of their lives.
- 3:52This is something that they are going to
- 3:54have to deal with and and live with and
- 3:56and try to survive.
- 4:02And that's again why I don't understand
- 4:04like if you have any sense of of
- 4:07humanity
- 4:09a mother has been brutally killed
- 4:12for whatever reason by whomever
- 4:16to be smiling in that moment.
- 4:21Now
- 4:22the question for me is
- 4:24that I have for them
- 4:26is is is life in jail changing any of
- 4:31that?
- 4:32Right? The cuffs are on. Oh, I still got
- 4:34my little halter top on. Oh, yes,
- 4:36everything's hunky-dory here. Right?
- 4:39But does the fact that you're now locked
- 4:41up, does the fact that you're facing
- 4:43murder charges, does the fact that
- 4:45you're facing a potential of life behind
- 4:47bars like never getting out ever again,
- 4:49never being free, ever ever again?
- 4:53Does that does that turn that smile
- 4:56upside down into a frown?
- 5:00Does it give you any reason to pause for
- 5:02a moment of reflection
- 5:04about the seriousness of all this?
- 5:07Well, I guess we'll see in the way that
- 5:09this case plays out.
- 5:13Because the the attitude of these
- 5:15sisters
- 5:17may have a lot to do with what the rest
- 5:20of their lives are going to be like and
- 5:22where they'll be spending that time and
- 5:24whether or not
- 5:26they get convicted or ever get a second
- 5:28chance at life.
- 5:30So, I've talked a lot about this this
- 5:32moment. So, I want to show it to you.
- 5:35I'm going to show you something that's
- 5:36from Good Citizen on YouTube and and it
- 5:38happened there was a local journalist
- 5:39who happened to be there
- 5:41at the moment of the arrest. This is a
- 5:42big story in the town that this this
- 5:44mother of five was murdered in broad
- 5:47daylight And then later that day, police
- 5:49are at the home of Cookie and Kitty. So,
- 5:53let's take a look at that video.
- 5:57There's the first sister going in.
- 5:59That's Kitty. And here comes Cookie.
- 6:00She's the one who's smiling.
- 6:03Look at this.
- 6:05And enjoying the moment. Turning to the
- 6:08camera a little bit.
- 6:09Make sure you get my good side.
- 6:14You know, maybe it's a product of the
- 6:15the world that we live in. I don't know.
- 6:18Social media, Instagram, all those
- 6:21things. You know, all the you post these
- 6:23beauty shots and you get all of this
- 6:25reaction. And people like you, they love
- 6:28you, they want you, they know you. Um is
- 6:31that what she sees in that moment?
- 6:34She doesn't understand
- 6:37what that moment is about.
- 6:39Like that moment's about you being
- 6:41arrested
- 6:44for murdering this young mother.
- 6:51I've seen defendants like this have the
- 6:54same attitude carry over into the
- 6:56courtroom.
- 6:57Never ends well for them.
- 7:00It never does.
- 7:03It makes them you know, the the
- 7:05callousness, the lack of remorse, the
- 7:08lack of acknowledgement of what you've
- 7:10done. And our system of justice treats
- 7:12people
- 7:15better.
- 7:16And I'm talking about like defendants.
- 7:18I'm talking about criminals.
- 7:20When they have these moments of
- 7:21self-reflection that are legitimate.
- 7:25When they have actual remorse.
- 7:29There there is a there is a level,
- 7:30whether it's a jury or a judge. There's
- 7:32a level of okay, all right. Well, maybe
- 7:35this is someone worth looking at. This
- 7:38is someone worth potentially giving
- 7:40another chance to. Or maybe it's someone
- 7:42worth believing uh if and when they they
- 7:44testify on on a witness stand.
- 7:48So, attitude has a lot to do with how
- 7:50this case is going to play out. And out
- 7:52of the box,
- 7:54not good
- 7:55for Cookie, not good for Kitty.
- 7:58Let me put this up there. This is from
- 7:59the city of Del Rio from the
- 8:01police department. They posted this on
- 8:02Facebook
- 8:04talking about what happened here.
- 8:06And and they're starting to to dig into
- 8:08the case.
- 8:09Obviously, the first thing you want to
- 8:11do when you're having an arrest like
- 8:11this, you want to line up some of the
- 8:13physical evidence.
- 8:14Um three arrested in connection with the
- 8:17Del Rio homicide investigation.
- 8:20On June 25th,
- 8:222026 at approximately 2:10 p.m.,
- 8:25officers with the Del Rio Police
- 8:26Department responded to
- 8:28Val Verde Regional Medical Center after
- 8:30receiving report of a female suffering
- 8:32from multiple stab wounds.
- 8:35Upon arrival, officers determined the
- 8:36assault had occurred in the 800 block of
- 8:38East 10th Street.
- 8:42Due to the severity of her injuries, the
- 8:43victim was transported to a medical
- 8:45facility in San Antonio for emergency
- 8:48treatment. So, now here's the part of
- 8:50the report that talks about the
- 8:51investigation.
- 8:53During the investigation, detectives
- 8:55identified the victim as a 32-year-old
- 8:58female and developed three suspects:
- 9:01Kitty Mia Diaz, age 21,
- 9:04Amaya Cookie Diaz, age 19, and Kiandra
- 9:07Renee Faz, age 21.
- 9:1332-year-old
- 9:15female victim. So, not much older than
- 9:18the three defendants, about 10 years
- 9:19older than the three defendants, but in
- 9:21a much different position. She's a
- 9:2332-year-old mother of five young
- 9:25children.
- 9:27Investigators gathered surveillance
- 9:29video, processed evidence, and conducted
- 9:31numerous witness interviews. So, the
- 9:34surveillance video is going to play a
- 9:36huge role in all of this because from
- 9:38the local reporting
- 9:40the video
- 9:42shows the actual attack.
- 9:45It shows Caroline, the mother of five,
- 9:49trying to fend off her attackers.
- 9:53Bravely trying to withstand what was
- 9:56what was happening.
- 9:57Now all this is happening in broad
- 9:59daylight. Like the time of day she's at
- 10:02the emergency facility 2:10.
- 10:06At 2:10 by the time police respond. This
- 10:08is happening in the middle of the day in
- 10:10broad daylight.
- 10:13This isn't some sort of sneak attack.
- 10:15Like if you do this, you've got to know,
- 10:17if you have half a brain, that there's
- 10:20going to be witnesses who see exactly
- 10:22what happens.
- 10:23There's cameras everywhere.
- 10:26And it's all captured. It's such an easy
- 10:28case for investigators. I mean, they're
- 10:30at the emergency
- 10:31uh uh
- 10:32place at the emergency center 2:10 p.m.
- 10:36And by 4:00
- 10:39they're making an arrest.
- 10:41Like this wasn't the first 48 hours,
- 10:42like the first 48 minutes
- 10:44that it took here.
- 10:46Which raises the question, why would you
- 10:47do this? Why would you take your entire
- 10:49life,
- 10:51throw it away, right? That's number one.
- 10:53And number two,
- 10:55take the life of this woman.
- 10:59Investigators um
- 11:01at approximately 4:00 p.m. officers
- 11:03located and arrested Kidy Mia Diaz and
- 11:06Amaya Cookie Diaz without incident.
- 11:08Yeah, it's not only without incident,
- 11:11it's like without any remorse.
- 11:14Smiling
- 11:17for for the camera that happened to show
- 11:18up for the arrest.
- 11:20How do I look? Do I look okay? Am I
- 11:21good?
- 11:23Peeking over the shoulder.
- 11:26A short time later officers located and
- 11:29arrested Keandra Faz in connection with
- 11:31the investigation. All three suspects
- 11:34were transported to the Del Rio Police
- 11:35Department for booking and and
- 11:37processing.
- 11:39And I'm wondering if this is processing
- 11:41in their minds. Like
- 11:43I think about this all the time when
- 11:44people commit
- 11:46or are accused of committing crimes like
- 11:47this.
- 11:49Like
- 11:50did you take any moment at any point
- 11:53just to think about
- 11:54what impact this crime is going to have
- 11:57on you, okay? I'll take I'll take out of
- 11:59the box like for some reason you may
- 12:01hate this person or you whatever, right?
- 12:04It's obviously impacting them the most
- 12:06and their family the most. But do you
- 12:07ever take a moment to think about how
- 12:09it's going to impact you?
- 12:12So here you are, right? Walking around,
- 12:14strutting around with your little
- 12:15outfits on
- 12:18in the greatest country in the world
- 12:22and for whatever reason like in broad
- 12:25daylight
- 12:27get accused of committing a a a brutal
- 12:30murder.
- 12:33This wasn't like a stab and run away.
- 12:35That's not the way it's being described.
- 12:38It's like making sure the job is done.
- 12:41And according to investigators here,
- 12:42it's three of them
- 12:43against this one mother.
- 12:47At approximately 9:00 p.m. investigators
- 12:48were notified that the victim had
- 12:49succumbed to her injuries and was
- 12:51pronounced deceased. She fought.
- 12:54She fought to survive this attack.
- 12:57Following the death
- 12:59Keondra Renee Vaz, Kity Mia Diaz and
- 13:02Amaya Cookie Diaz reach charged with
- 13:04murder.
- 13:06All three were transported to the GEO
- 13:08Correctional Facility where they remain
- 13:10pending magistration.
- 13:13This investigation remains active and
- 13:14ongoing. Additional charges may be filed
- 13:17as investigators continue to gather
- 13:18evidence and determine the full
- 13:20circumstances surrounding the incident.
- 13:23The full circumstances they they want to
- 13:25understand like how and why this
- 13:26happened.
- 13:29Right? Every defendant has a defense. We
- 13:31don't know what it's going to be for
- 13:32these three. I've no idea. It's going to
- 13:34be self-defense?
- 13:36I don't know.
- 13:37No idea.
- 13:39But what I do know is investigators want
- 13:41to figure out as much as they can.
- 13:43Because when you hand the case over to
- 13:45prosecutors like I was,
- 13:47prosecutors, yeah, they want to know
- 13:49what evidence do you have, what proof do
- 13:51you have,
- 13:52and what else do you have about what
- 13:53happened here?
- 13:56Because I'm going to be in front of a
- 13:57jury, and and I've got to tell them a
- 13:59story.
- 14:02And the jury's going to want to know why
- 14:04three young women
- 14:07would
- 14:08decimate their own lives while at the
- 14:10same time taking the life
- 14:13of a young mom. Like, what was going on
- 14:15here? Was there history?
- 14:17Now,
- 14:18there's a lot of witnesses, and this is
- 14:20such a big story locally, and and some
- 14:22of the reporting locally has talked
- 14:23about the fact that there was some
- 14:25connection
- 14:27uh between
- 14:28the victim and the suspects.
- 14:32None of this has been corroborated by
- 14:34police. It hasn't come out in an
- 14:35affidavit yet. It's just local reporters
- 14:37going around talking to people who know
- 14:40um those involved. And the information
- 14:43that they're gathering from people who
- 14:44know
- 14:46the victim and know the defendants that
- 14:47there was some connection with with the
- 14:49families.
- 14:51That they spent time together. So,
- 14:52there's there's definitely some level of
- 14:55a relationship ahead of time. This isn't
- 14:58road rage. This isn't you you cut me off
- 15:01or, you know, we're at Sonic and, you
- 15:03know, you grab my order instead.
- 15:06Which to me, if there is some history
- 15:08there,
- 15:10and these weapons are used,
- 15:14it does, to me, open the door to
- 15:18a lot of potential premeditation.
- 15:22That there was something going on in in
- 15:25the in the history between
- 15:28Caroline, the victim,
- 15:30and one or more of the suspects.
- 15:32Sometimes it's just one of them and they
- 15:33bring their friends along or friends and
- 15:35family
- 15:37in this case. Or or or it could be that
- 15:40all three had some issue here.
- 15:46But it seems that would be the the the
- 15:48the genesis of
- 15:50trying to explain
- 15:53why this happened.
- 15:57Because there's so much that is just
- 15:59tossed aside here and it's such a waste.
- 16:05And it's not a lot of times we deal with
- 16:07young people, it's, you know, and we've
- 16:09covered these these cases where, you
- 16:12know, young men full of testosterone and
- 16:15they're just getting angry and there's
- 16:16pride and they're, you know, there's a
- 16:18fist fight and someone brings a weapon
- 16:20to a fist fight.
- 16:22That does not appear to be what's
- 16:23happening here. It's it's they're not
- 16:26out drinking. They're not at some party.
- 16:29This is a mom
- 16:32surrounded by or attacked by allegedly
- 16:34three different women.
- 16:38So,
- 16:39while a prosecutor never has to
- 16:41absolutely prove that,
- 16:45you're going to want to explain it. It
- 16:47just makes your story stronger because
- 16:50you don't know where the attack is going
- 16:51to be from the defense.
- 16:54Is it you know, sometimes in a case
- 16:55where there's video and everything else
- 16:56going on,
- 16:58um
- 16:59you know, it's it's either diminished
- 17:01capacity
- 17:03or it's self-defense.
- 17:06But diminished capacity for three
- 17:08defendants?
- 17:10That's a tough sell.
- 17:12That's a tough sell.
- 17:14Because
- 17:15you're you're talking about three
- 17:17different people suffering from some
- 17:18level of mental illness or mental
- 17:21delusion. Doesn't work that way.
- 17:24Just doesn't work that way.
- 17:26You want to argue heat of passion?
- 17:29Like something happened in the moment,
- 17:31so it's something less than murder
- 17:35or less than first-degree premeditated
- 17:37murder?
- 17:38Maybe that's where they end up.
- 17:41I don't know if this is going to be a a
- 17:43death penalty case. That's possible.
- 17:45Need a few more facts surrounding the
- 17:47case in order to make that
- 17:49determination.
- 17:53But understanding why goes a long way
- 17:57inside of a courtroom. Think about the
- 17:58cases that we've we've covered through
- 18:00the years.
- 18:03And and
- 18:04a question that the defense
- 18:07many times were
- 18:08Why why would she do this? She wouldn't
- 18:10do this or he wouldn't do this. Why
- 18:13would he
- 18:14commit this murder? It makes no sense
- 18:16for him to do it.
- 18:17Well, it never does make sense, but they
- 18:19always make that argument.
- 18:22They always make that argument.
- 18:24So, you need the counter to that. You
- 18:26need to be able to respond to that or
- 18:27better yet, lay it out in your opening
- 18:29statement
- 18:31and tell the story
- 18:34of how Caroline Peña,
- 18:3732 years old,
- 18:39a young mother of five children,
- 18:42went out. It was lunchtime.
- 18:45She was going to to Sonic to pick up
- 18:48food for her children.
- 18:51And while she was there,
- 18:53she was confronted
- 18:55confronted by sisters, confronted by
- 18:57their friend.
- 19:00People she knew.
- 19:04But this confrontation
- 19:06wasn't just an argument.
- 19:09This confrontation was a plan.
- 19:12This confrontation was premeditated
- 19:14murder.
- 19:16And let me tell you why.
- 19:18And that's the blank that they're going
- 19:19to have to fill in.
- 19:21We can't fill it in yet, but obviously
- 19:23we will continue
- 19:25to cover this story and and try to
- 19:27understand
- 19:28why these five children are going to
- 19:30grow up
- 19:32without a mother.
