"Should I Sue the Person Who Screwed Me Over?" — Transcript
Full transcript
- 0:00My husband bought a franchise location
- 0:01but the previous owner had secretly been
- 0:04taking customer payments without
- 0:05shipping anything. Jesus. Invoicing
- 0:07customers, collecting money, and then
- 0:08voiding the invoices to hide it. My god.
- 0:11>> What's wrong with people?
- 0:11>> Now about 60 businesses are suing over
- 0:14this. The location's reputation is
- 0:15likely unsalvageable.
- 0:17>> [clears throat]
- 0:18>> My husband wants to sue the previous
- 0:19owner.
- 0:20What should we do first? Man, it's going
- 0:22to be tough.
- 0:24It's going to be tough.
- 0:26Um
- 0:28Believe it or not, I've actually seen
- 0:29this happen more than one time,
- 0:31unfortunately. Like I've seen this
- 0:32happen
- 0:33a lot of times. Um and this is why due
- 0:36diligence is a step in the M&A process
- 0:38where you acquire a business because
- 0:40people do shady [ __ ] and they do it
- 0:42especially when there's a lot of money
- 0:43on the line and especially when it's a
- 0:44one-time transaction. So, when like when
- 0:47is there the highest likelihood of shady
- 0:48[ __ ] happening is one-time transactions
- 0:50with huge stakes that are irreversible,
- 0:52which is exactly what an M&A what an
- 0:54acquisition of a business or acquisition
- 0:56of real estate is, right? So, there's
- 0:58huge incentive to do wrong if you're a
- 1:01short-term player. Um which obviously
- 1:03this person is. And the amount of money
- 1:05that you can make from short-term
- 1:06thinking um sometimes can be enough to
- 1:09set you up for life depending on how
- 1:11you're
- 1:11>> What a piece of [ __ ]
- 1:12>> No, I agreed. Yeah.
- 1:13>> No, I'm just saying like for you like
- 1:14sorry, it sucks. It's a
- 1:15piece of People are shitty.
- 1:16>> Yeah.
- 1:17>> We've gotten screwed in things like
- 1:18that. It [ __ ] sucks.
- 1:19>> Yeah. And so let me tell you the bad
- 1:20news first. The bad news first is that
- 1:22even if you do sue cuz some people think
- 1:24that like oh, if I sue them, I'll get my
- 1:25money back. It's like you only get the
- 1:26money back if that person has the money
- 1:29and that amount of money divided by the
- 1:30other 60 people suing them is enough to
- 1:33make you whole, which is unlikely cuz
- 1:34either they blew it or that number
- 1:35divided by 60 is not what you spent.
- 1:37>> It's also like okay, it's going to take
- 1:382 years minimum to sue them and get the
- 1:40money. How can you even sustain the
- 1:42legal fees for the 2 years leading up to
- 1:44that to pay lawyers?
- 1:45>> And are you going to live your life in a
- 1:46holding pattern?
- 1:47>> Yeah.
- 1:48>> Like I like
- 1:50I would say that how like how I would
- 1:51actually handle this is I would probably
- 1:53take my licks,
- 1:54learn from the lesson,
- 1:56and then just say like I'm going to be
- 1:56that much bigger and like I will shrink
- 1:58you into irrelevance. So like this
- 2:00problem, though large for me now,
- 2:02the future version of me with the amount
- 2:04of action I'm going to take as a result
- 2:05of this very negative thing is going to
- 2:07make this loss feel inconsequential in
- 2:09the future. And it's the only frame that
- 2:11I think has really helped me.
- 2:12>> Just remember they have a very small
- 2:14penis.
- 2:15>> Jesus Christ.
- 2:21You heard it here.
- 2:22Ladies and gentlemen.
- 2:23>> What? I think it's like it's got You
- 2:25have to get it out with one day and be
- 2:26like this person is a piece of [ __ ]
- 2:27[ __ ] [ __ ] this [ __ ]
- 2:29>> Yeah.
- 2:29>> And then just be done with that and move
- 2:31on.
- 2:31>> And move on.
- 2:32>> You know.
- 2:33>> The key is that like if you just stay
- 2:35angry and don't let it
- 2:37>> I'm going to read that one.
- 2:37>> If you let it prevent you from taking
- 2:39the actions that are going to make you
- 2:40money, like you will make more money
- 2:42making money than trying to get the
- 2:43limited amount of money out of that
- 2:44person there.
- 2:45>> Yeah.
- 2:47Yeah, legal system not a justice system.
- 2:49Remember that.
- 2:50>> This huge. I will say that again. It is
- 2:52the legal system, not the justice
- 2:54system. You will not get justice.
- 2:56>> Like the amount of times that we've had
- 2:57to pay
- 2:58[ __ ] money because they've sued us
- 3:01for something that's a lot.
- 3:02>> Just cuz it cost less to settle.
- 3:03>> Just cuz it cost less to settle. Which
- 3:05by the way, if anyone's watching this
- 3:06right now, I won't do anymore.
- 3:09>> Yeah. I'll just Heads on spikes, baby.
- 3:10Heads on spikes.
- 3:12>> I'll out sue You can try and sue me for
- 3:145 years. You don't have money, I do.
- 3:15>> Cuz then it just becomes a victory of
- 3:16like, well, cost them more than cost me.
- 3:18>> Yeah. But anyways,
- 3:20>> Yeah. [laughter]
- 3:21>> for anyone watching,
- 3:24I'm going to bury you in legal fees,
- 3:26[ __ ]
