- 4:14prosecutors saw this as a crime that
- 4:16maybe 8 months in jail would suffice. Um
- 4:18our defense was only asking for a month.
- 4:21Um
- 4:21the judge hit her with 18 months.
- 4:24That's more than twice what prosecutors
- 4:26I was asking for. I think our viewers
- 4:27need to understand that's unusual and
- 4:29this is your neck of the woods. What
- 4:31What do you think happened here?
- 4:32What I think happened is a couple of
- 4:33things. First of all, she pleaded to
- 4:35counts. She pleaded to mail fraud and to
- 4:39lying to the FBI. So you know, typically
- 4:41when you get those lower digit
- 4:43sentences, the one digit, you know, like
- 4:45one year or maybe six months,
- 4:48uh it's because you've settled early and
- 4:50you've pleaded to one count. Her
- 4:51exposure here I believe was 20 to 25
- 4:54years. I think the other reason why the
- 4:56judge stuck it to her was to send a
- 4:58message. She initially told the police
- 5:02that she was basically abducted by two
- 5:05unnamed Hispanic women, okay? I don't
- 5:08know if you remember like for example
- 5:09Susan Smith years ago who killed her
- 5:11children, drowned them, you know, she
- 5:13said that she was carjacked by a black
- 5:15man. Well, let me tell you that resulted
- 5:17in the arrest of at least one black man.
- 5:20Yes.
- 5:20Fortunately here no Hispanic women were
- 5:22arrested but there was that potential
- 5:25out there for unnamed Hispanic women who
- 5:28happen to be going around in twos who
- 5:30could have been picked up, hauled in,
- 5:32accused, God only knows what could have
- 5:34happened and the judge just wanted to
- 5:36send a message to her. You take the 18
- 5:38months or you can have a trial.
- 5:39Yeah, and he also hit her with I believe
- 5:41$300,000 in restitution that has to do
- 5:43with a lot of different things including
- 5:45and I think this was played a role for
- 5:47sure, she even went and got money from
- 5:49the victim's compensation board,
- 5:51$30,000. That had to play a role.
- 5:53Oh, of course. I mean, that is fraud,
- 5:57to say the least. Uh, it's probably also
- 5:59another criminal act. I don't know what
- 6:01she did or lied about under oath to get
- 6:03that money.
- 6:05Uh, and it might actually be a state
- 6:06offense. So, who knows? Maybe as a
- 6:07result of this, there could be another
- 6:09charge coming. I don't know.
- 6:11Well, they they put it in. So, they it
- 6:12was part of her charges. So, the 18
- 6:14months includes that taking that money
- 6:16as well.
- 6:16Oh, then she is lucky. Yeah. She is
- 6:19absolutely lucky.
- 6:20I agree. And when you look at a crime
- 6:21like this, um,
- 6:23the question is, okay, who was hurt,
- 6:24right? And I think you touched on it a
- 6:25little bit. Not only is her husband, he
- 6:27was in in that room. I can't imagine
- 6:29what he was feeling. Um, you have the
- 6:32her family, you have herself, but you
- 6:33mentioned it. And I think this is the
- 6:35key, the community. The community was
- 6:37hurt.
- 6:37Absolutely. Any two women who happen to
- 6:40be Hispanic, maybe pushing a stroller,
- 6:42driving a car, walking down the street
- 6:44arm in arm, or even shopping, could have
- 6:46been collared, hauled in by the police
- 6:48to see if they had anything to do with
- 6:50the abduction of Ms. Papini, you know?
- 6:53And there there was that advent until
- 6:57they finally cracked the case. So, I
- 6:59think they want to send a message that
- 7:00if you're going to start pointing the
- 7:01finger, particularly to minorities,
- 7:03you're going to pay the piper on the
- 7:05back end.
- 7:05And apparently, she still is claiming to
- 7:09friends and others that it didn't happen
- 7:11the way that that she in fact was was
- 7:13abducted in some way. So, there may be
- 7:15some issues mentally there with this
- 7:17woman as well.
