- 0:02Ms. Caldwell, you were charged with
- 0:03assault of a family member. You were
- 0:05facing up to a year in jail and a $4,000
- 0:08fine.
- 0:09We were going to do probable cause. You

- 0:19The officer was dispatched to a
- 0:20residence in Harris County, Texas in
- 0:22response to a family disturbance. The
- 0:24complainant stated that she got into a
- 0:25verbal argument with the defendant, her
- 0:27daughter, because the complainant
- 0:29believed the defendant was not taking
- 0:31care of her children. At that point, the
- 0:33defendant picked up a baby bottle and
- 0:34threw it at the complainant, hitting her
- 0:36in the cheek, causing pain. The
- 0:38defendant admitted to having thrown the
- 0:40baby bottle.
- 0:42>> Ma'am, I'm going to find that there's
- 0:43probable cause to go forward with your
- 0:45case.

- 1:03Ms. Caldwell, I'm entering in what's
- 1:05called a magistrate's order for
- 1:06emergency protection.
- 1:10This is a court order that identifies
- 1:13Candy
- 1:14Lachey as a protected individual. You
- 1:17cannot commit family violence or an
- 1:18assault against this person, commit an
- 1:20act in furtherance of an offense under
- 1:22Section 42.072 of the Texas Penal Code,
- 1:24which is the stalking statute. You
- 1:27cannot threaten, harass, use another
- 1:29person to communicate a threat or
- 1:31harassing behavior. You cannot be in
- 1:32possession of a weapon or go within 200
- 1:35ft of where she lives or where she
- 1:36works.

- 5:04she had the drug test. I don't know if
- 5:05the manner in which they contacted them.
- 5:07I thought they maybe call them
- 5:09for that. But um she was originally
- 5:11going to do DWIPTI. She now says she
- 5:13would like to take a time served offer.
- 5:15Would you allow her to do that today?

- 5:22for. Is that what it is?

- 5:25the the expenses of the program and she
- 5:27has she's working right now and she
- 5:28doesn't have time for the program.

- 5:35we might even have the contract already
- 5:36even
- 5:37for DWIPTI.

- 5:47You know, being in court, it's not like
- 5:51being in Target, Costco,
- 5:54HEB, where
- 5:56if you [snorts] don't like something,
- 5:57you can return it, or you get buyer's
- 5:59remorse.
- 6:01When you make decisions in here, they're
- 6:03lifetime decisions that you have to live
- 6:06with forever. And, you know,
- 6:09there are collateral consequences that
- 6:11may arise, meaning consequences that you
- 6:13may never see
- 6:15pop up as a result of decisions that you
- 6:18make in here. When you plead guilty to
- 6:20an offense,
- 6:22that offense goes on your record, and
- 6:24it's there for the rest of your life.
- 6:25And when you plead guilty, you can't
- 6:27take it off. You cannot say, "You know
- 6:29what? I have a change of heart. I can't
- 6:31get an apartment. You know what? Let me
- 6:32go and and try to do something else."
- 6:35Once you plead,
- 6:37you're stuck like Chuck for the rest of
- 6:38your life.
- 6:39I tell you now, I have,
- 6:43you know,
- 6:45every month, people that call me, they
- 6:47go, "You know, this lawyer pled me to
- 6:49this case, and I can't get an apartment.
- 6:52Can you take it off?" I I have
- 6:55Like, they pled 10 plus years ago.
- 6:58You know, truck drivers that want to
- 7:01better their life, but they pled guilty
- 7:02to a, you know, less than a gram case,
- 7:04and and it never take it off.
- 7:08When you plead to a DWI,
- 7:11not only is it very possible that you
- 7:13lose jobs with regard to, you know,
- 7:15making a living with a car, your
- 7:17insurance is going to go up. Your Your
- 7:19insurance is going to skyrocket.
- 7:21Insurance is expensive as it is as it is
- 7:23now. You pick up a DWI, it's going to be
- 7:25about four times what it is now. Not to
- 7:27mention any other consequence that can
- 7:29arise from a DWI conviction. You have
- 7:32the opportunity now where if you are
- 7:35granted entry into this program, if you
- 7:37complete it successfully, they dismiss
- 7:40the case. It looks like you've all
- 7:42already have been granted entry into it.
- 7:44The problem The only problem I see now
- 7:46is that you were called upon to take a
- 7:48drug test
- 7:49and you failed to go.
- 7:50I'm going to go send you for a drug test
- 7:52regardless, right?
- 7:53>> This is this one.

- 7:56when you take a half-ass
- 7:59approach to something, you get a
- 8:01half-ass result.
- 8:03And it's usually not a good idea to do
- 8:06that with a criminal case, you know?
- 8:10When you try hard, you get a good
- 8:12result. You know, James worked hard to
- 8:14try to get you into this program.
- 8:16Has she been already admitted into it,
- 8:18you know?
- 8:20>> She's not in PTI yet, but she's been
- 8:22>> Right, right, right. But right, I mean
- 8:23>> Just your honor, the last update was
- 8:25that the contract was signed. The NDA
- 8:27was
- 8:27>> All you literally need to do are two
- 8:29things. You pay the DA fee
- 8:31and you get an interlock. The DA fee, if
- 8:33you fill out a waiver, they may be able
- 8:35to waive that $300 fee. As far as the
- 8:38interlock, I I can't pay for that. I can
- 8:41only pay for it while you're on bond.
- 8:42That's something that you'll be required
- 8:44to pay for, but I'll tell you now, the
- 8:46$50 to $75 cost you per month now is
- 8:49nothing compared to what you will end up
- 8:52paying
- 8:53with a DWI conviction.
- 8:55So,
- 8:57you make the decision on what you want
- 8:58to do. I am going to send you for a drug
- 9:00test right now regardless.
- 9:01>> This is fine.
- 9:02>> And alcohol test. But
- 9:05think long and hard before you make this
- 9:07decision because there's no turning back
- 9:09from it.

- 9:57beginning. I just wanted to do the time
- 9:59serve, and then I talked to my friends
- 10:00and my family, and they suggested to do
- 10:02the program.
- 10:04But
- 10:05>> And if I got
- 10:05>> Anytime you can get something dismissed,
- 10:08no matter how,
- 10:10that's always the best result, you know?
- 10:13Really, because like I told you, the
- 10:15consequences of a DWI conviction,
- 10:18they're staggering. You never know how
- 10:21it's going to affect you. It will. It's
- 10:23going to affect you.
- 10:25It just you never know how and by how
- 10:27much. And with a DWI, DWI is big
- 10:30business. If you plead guilty, from now
- 10:33on you're looking at a minimum of 30
- 10:34days in jail. You're also looking at a
- 10:36mandatory about 6 to 7,000 dollars in
- 10:39fines and fees just here from court, not
- 10:43to mention insurance going up, not to
- 10:44mention all the other stuff in your
- 10:46life, how it's going to affect you.
- 10:47Whereas,
- 10:48if you do this program, you do well,
- 10:50maybe they'll even boot you out early.
- 10:52If you do everything speedy, you do it
- 10:54quick, maybe they'll take you out early,
- 10:56too.
- 10:58Just depends on how well you do.
- 11:00You know, but you have to put effort
- 11:02into it.
- 11:03>> Yes.
- 11:03>> You know, you can I mean, all you do is
- 11:05>> There's two classes, right?
- 11:06>> There's a couple classes [clears throat]
- 11:07and then there's the alcohol monitoring
- 11:08device.
- 11:09>> And a lit- is there's two classes, a
- 11:11little community service, and just stay
- 11:12clean. That's all you have to do.
- 11:14>> I I find it really do everything in 6
- 11:16months.
- 11:20>> Take your time. I don't want you to rush
- 11:21into something now. So, we'll set you
- 11:23off a couple weeks.
- 11:25You know, in the interim,
- 11:27do we have the financial affidavit so So
- 11:30can have her doing it then as well?
- 11:31>> I
- 11:32>> send you a copy of the financial
- 11:33affidavit to waive the $300 fee if you
- 11:35qualify and but you need a bills and pay
- 11:37stubs and all that to be attached. I can
- 11:40send that to your judge.
- 11:41>> Please. And I think we may even have a
- 11:43copy here actually for you. So
- 11:46you know, try to get that $300 fee
- 11:48waived, you know, and then all you have
- 11:50to do is pay for the analog and just
- 11:52stay clean.

- 11:58still want to do the time serve, that's

- 13:13trial,

- 13:18normally we do a 30-day trial setting,
- 13:21but 30 days from today runs into the
- 13:23Christmas time and we don't have any
- 13:25juries here.
- 13:26So the first jury trial setting that we
- 13:28have is for January 7th
- 13:31and he wanted to set your case for jury
- 13:33trial on that day
- 13:35to see whether they can make the case or
- 13:37not.

- 13:40I know that you're itching to get out,
- 13:43but you got to understand that if you
- 13:45plead
- 13:46today
- 13:48there are very serious consequences.
- 13:50You're charged with assault of a family
- 13:52member.
- 13:53This carries an affirmative finding of
- 13:55family violence.
- 13:57What that means is that if you ever pick
- 13:58up another one of these cases again
- 14:01you will be charged with a third-degree
- 14:02felony and you will be looking at a
- 14:04minimum of 2 years in prison, a maximum
- 14:06of 10 years in prison.
- 14:08And when I mean an assault, it doesn't
- 14:10have to be a
- 14:12beat down with blood everywhere. Simple
- 14:14fact is you grab someone's arm and
- 14:16squeeze it to where it hurts.
- 14:18That's enough
- 14:20for them to charge you with a serious
- 14:22felony where you're looking at 10 years
- 14:24in prison.
- 14:27If you do this, you can never own a gun
- 14:29or ammunition
- 14:30as well.
- 14:33So, the advice by your lawyer is for you
- 14:34to wait a bit and set up a trial January
- 14:377th.

- 16:47made it really easy for DAs across Texas
- 16:51to seize and take cars away from
- 16:54individuals who do this. You are now
- 16:56going to end up with the conviction for
- 16:58this on your record. You pick on up You
- 17:01pick up another one of these cases, it's
- 17:02very possible that they seize and take
- 17:05that car forever
- 17:07and you don't get it back.

- 17:23naturalization. You give up the right to
- 17:25appeal. Once you plead guilty, it will
- 17:26go on your record. You can never change
- 17:28this.

- 20:44that they didn't even inform us in
- 20:46February when the first time you tested
- 20:48positive for cocaine. So, now
- 20:50>> Another failed drug test turns probation
- 20:54into a path back to jail.

- 20:58figure something out, but you can't
- 21:00continue to use cocaine while you're on
- 21:02probation and expect good things. Do you
