- 0:00on November 12 2004 after a six-month
- 0:04jury trial Scott Peterson was convicted
- 0:06of the homicide of his pregnant wife
- 0:08Lacey and their unborn son Connor we
- 0:11find a defendant Scott Lee Peterson
- 0:13guilty of the crime of murder of Lacey
- 0:15Denise Peterson
- 0:18but what if I told you that regardless
- 0:21of what you may believe about his case
- 0:23that you have not heard the whole story
- 0:26a story that involves a well-funded
- 0:29effort to hide the truth and ultimately
- 0:31to deny Justice to the real victims of
- 0:34this case and I am confident that how
- 0:37this story ends will change the way that
- 0:39you see the Scott Peterson case for good
- 0:42when I originally started to write the
- 0:45script my intention was to create a
- 0:47single hour-long episode but after
- 0:49several hundred hours of research I
- 0:52stumbled onto something that was
- 0:54entirely unexpected what started off as
- 0:57a single thread that seemed out of place
- 0:59began to unravel and what I found is one
- 1:03of the most egregious efforts to deny
- 1:05Justice that I have seen in recent
- 1:08history and it is something that I
- 1:10believe to be one of the most important
- 1:12issues we face in our time as it relates
- 1:15to the criminal justice system and the
- 1:17way those cases are portrayed trade in
- 1:19the media but in order to tell this
- 1:21story we have to start at the very
- 1:23beginning and I promise you by the time
- 1:26I'm done you'll understand why I had to
- 1:29tell this story this way the initial
- 1:32disappearance of Lacey Peterson grabbed
- 1:34the attention of millions around the
- 1:36world when national news outlets picked
- 1:38up the story of the nearly
- 1:40eight-month-old pregnant wife of Scott
- 1:42Peterson who had gone missing on
- 1:44Christmas Eve under very mysterious
- 1:46circumstances KTVU Channel 2 reporter
- 1:49Ted Rollins joins us now live from
- 1:51Modesto with the story Ted they're
- 1:53looking for 26 year old Lacey Patterson
- 1:55of Modesto she is eight months pregnant
- 1:57we appreciate very much your attention
- 2:00to this incident Lacy was last seen by
- 2:02her husband Scott when she was walking
- 2:05her dog possibly in the area of East La
- 2:08Loma Park Dry Creek
- 2:10during the day before Christmas her
- 2:13husband was fishing in the Bay Area to
- 2:16many of us who carefully followed the
- 2:18case all of the available evidence
- 2:20presented on the Nightly News seemed to
- 2:22clearly establish that Scott Peterson's
- 2:24guilt was a foregone conclusion so when
- 2:27I began to watch the case unfold it came
- 2:29as no surprise to me when he was
- 2:31eventually put on trial and convicted
- 2:34but over the last several years an
- 2:36outspoken group of his supporters has
- 2:39seemingly begun to change The Narrative
- 2:41of his case a case that many believed
- 2:43had been long since adjudicated
- 2:45supporters of Scott Peterson have
- 2:48continued to grow in number year after
- 2:50year and in just the last few months
- 2:52alone his team has gained the support of
- 2:55well-known and respected members of the
- 2:57True Crime community and as a result of
- 3:00their influence they have given
- 3:02credibility to his cause in the eyes of
- 3:04the general public we have the evidence
- 3:07to show that Scott Peterson is innocent
- 3:09he should not be sitting on death row
- 3:10with this many unanswered questions
- 3:12within my first few days of researching
- 3:15this case I began to notice the sheer
- 3:17volume of people who had begun to show
- 3:20support for Scott Peterson's innocence
- 3:21all over the Internet and their numbers
- 3:24have grown in size and scope year after
- 3:27year from websites to forums subreddits
- 3:31and documentaries their presence is
- 3:33undeniable and now they are harnessing
- 3:36the power of the media to tell their
- 3:38narrative to the world
- 3:40but I wanted to know if there was any
- 3:42validity to their claims as well as to
- 3:45better understand the history of their
- 3:47movement and what I found is why this
- 3:50video is the longest I have ever created
- 3:53in my investigation I learned that
- 3:55support for Scott Peterson began in the
- 3:58early 2000s beginning primarily on
- 4:00scattered message boards all across the
- 4:02internet but the wave of recent support
- 4:05gained serious Traction in 2017 when a e
- 4:08released a six-part documentary series
- 4:11that brought their narrative to millions
- 4:13of curious Spectators the a E Series
- 4:16seemed to make the case that there was
- 4:18reason to allow people who previously
- 4:20believed in Scott's guilt to now have
- 4:23cause to believe in his innocence so I
- 4:26made the choice to find out for myself
- 4:28if the claims of his innocence were in
- 4:31fact true so before I watched the a E
- 4:34Series I made the decision to leave my
- 4:36preconceived notions at the door and
- 4:39allow myself to ask the question what if
- 4:42Scott Peterson was actually innocent his
- 4:46supporters contend that the media frenzy
- 4:48against him was an unfair and malicious
- 4:51denigration of an innocent man over
- 4:53overcome by a 24-hour news cycle that
- 4:56had already judged him guilty they
- 4:59explained that all of the evidence
- 5:00against him was entirely circumstantial
- 5:03that the prosecution had failed to prove
- 5:05their case and that no forensic evidence
- 5:08ever existed in his case do you believe
- 5:10that Lacey was alive on the morning of
- 5:13December 24th
- 5:1614 Witnesses who reported seeing Lacey
- 5:19and or Mackenzie walking in the
- 5:21neighborhood
- 5:23they also contend that the trial was
- 5:25contaminated by the media who had
- 5:27incorrectly bought into a false
- 5:29narrative about a man who was framed for
- 5:31a crime that he did not commit but if
- 5:34that were true and Scott Peterson was
- 5:37serving a sentence for a crime that he
- 5:39didn't actually do then that would mean
- 5:42that his conviction was a devastating
- 5:44travesty of justice and that he had been
- 5:46unfairly judged by the justice system so
- 5:50I decided to clear the Slate forget
- 5:52everything I thought I knew about this
- 5:55case and go back to the beginning
- 5:57reevaluating the evidence and allowing
- 6:00the facts to dictate where I would land
- 6:02on his case so with the BCM research
- 6:05team in tow we reviewed trial
- 6:07transcripts read through countless pages
- 6:10of available evidence reviewed every
- 6:12available document we could find and
- 6:15after hundreds of hours of painstaking
- 6:17notes analysis and review I was
- 6:21completely taken aback by what I found
- 6:24in those pages the evidence and Records
- 6:27would eventually cause me to arrive at
- 6:30an entirely new opinion of the Scott
- 6:32Peterson case based entirely and
- 6:35completely on the facts absent of media
- 6:38narratives and pundit opinions so today
- 6:41I want to invite you to join me on this
- 6:45arduous Trek because what I'm about to
- 6:47show you even if at times it may be
- 6:50things you already know there are parts
- 6:52to this story that I do not believe have
- 6:55been told and when I finally saw them it
- 6:58completely altered the way that I see
- 7:01True Crime cases forever today we will
- 7:05review the case of Scott Peterson
- 7:07carefully analyzing the claims of his
- 7:09innocence as well as outlining the
- 7:12prosecutions cased against him all while
- 7:14contrasting those details against the
- 7:17court record and once that is complete I
- 7:20will share with you what I believe is an
- 7:23urgent issue that we face in our time
- 7:25that directly stems from and impacts the
- 7:28family and memory of Lacey and Connor
- 7:31Peterson
- 7:32and I believe that by the time this
- 7:35video is over a compelling case will be
- 7:37made concerning the guilt or innocence
- 7:40of Scott Peterson this is a tale of two
- 7:44stories the Scott Peterson Case episode
- 7:47one
- 7:53[Music]
- 7:59it was the best of times it was the
- 8:02worst of times
- 8:04Scott and Lacey Peterson met at a local
- 8:06restaurant where Scott worked as a
- 8:08waiter in San Luis Obispo California
- 8:11they would eventually get married in
- 8:131997 and three years later purchased a
- 8:16home in the suburbs of Modesto
- 8:18California despite Scott's reticence to
- 8:21have a baby he would eventually give in
- 8:23and after many months of trying Lacey
- 8:25would eventually become pregnant in the
- 8:27early summer of 2002 with a due date in
- 8:30early February 2003. on December 23 2002
- 8:35Lacey and Scott went to a salon where
- 8:38Scott would get a haircut from lisi's
- 8:40Sister Amy Rocha while Scott was getting
- 8:42a haircut Lacey's sister mentioned that
- 8:44she needed to go pick up a gift basket
- 8:46the following day at 3 pm Scott Peterson
- 8:50quickly interjected offering to pick up
- 8:52the basket for her mentioning that he
- 8:54would be golfing in the area the
- 8:56following day later that same evening
- 8:58Lacey had a conversation with her mother
- 9:00Sharon Rocha confirming that she and
- 9:03Scott would join them the next evening
- 9:05for Christmas Eve dinner the following
- 9:08day on Christmas Eve Scott Peterson left
- 9:10the Peterson home to go fishing just
- 9:13after 10 A.M at 10 18 a.m a neighbor
- 9:16Karen's service notices the Peterson's
- 9:19dog Mackenzie wandering around the
- 9:21street aimlessly still wearing a leash
- 9:24that he would typically wear during
- 9:25walks
- 9:27Karen would notice that Scott's truck
- 9:29was gone but Lacey's vehicle was still
- 9:31in the driveway Karen would go on to
- 9:34place the Peterson's dog into their
- 9:36backyard closing the gate before she
- 9:38left after leaving his house Scott
- 9:41Peterson would then go to his workplace
- 9:43where he would work for a short time and
- 9:46then eventually began his trip to the
- 9:48Berkeley Marina where he went fishing on
- 9:50his new boat
- 9:51after about 90 minutes of fishing he
- 9:54left the marina and at 2 15 pm he called
- 9:57and left Lacey a voicemail
- 10:03in Berkeley I won't be able to get to
- 10:05develop Farms to get that basket for
- 10:07Papa I was hoping you would get this
- 10:09message and go on out there I'll see in
- 10:11a bit so we love you bye
- 10:14and this message
- 10:16Scott would eventually arrive home
- 10:18between 4 30 and 4 45 PM when he got
- 10:22home he noticed that his dog Mackenzie
- 10:24was on his leash and in the backyard he
- 10:27would walk into his house through the
- 10:29back doors that he noticed was unlocked
- 10:31once inside his house he placed his
- 10:34outfit that he had worn fishing that day
- 10:36in the washing machine went to the
- 10:38kitchen and ate a slice of pizza with
- 10:40milk and took a shower he would later
- 10:43state that he noticed Lacey's vehicle
- 10:45was still at the house but that he
- 10:47assumed she was at her mother's for
- 10:49their previously agreed-upon Christmas
- 10:51Eve dinner at 5 17 PM Scott called
- 10:54Sharon Rocha the mother of Lacey
- 10:57Peterson to inquire if she was there he
- 11:00explained to his mother-in-law that
- 11:02Lacey's car was still in the driveway
- 11:03and that when he had arrived home their
- 11:06doc Mackenzie was on his leash Scott
- 11:09said that Lacey was missing and after
- 11:12that moment nothing would ever be the
- 11:15same again
- 11:16we'd like to thank all of you for being
- 11:18here and helping us trying to find our
- 11:20daughter
- 11:25just like to send a message out there
- 11:27that
- 11:28Whoever has her please please please let
- 11:31her go bring her back we love her so
- 11:32much
- 11:33a short time later Scott began to try
- 11:36and locate Lacey unsuccessfully Scott
- 11:38would again call Lacey's mother and
- 11:40confirm that he had been unable to find
- 11:43her a short time later Ron gransky The
- 11:46Stepfather of Lacey Peterson would call
- 11:48the Modesto Police Department to report
- 11:50Lacey missing from that point forward
- 11:53The Disappearance of Lacey Peterson
- 11:55would take on a life of its own and in a
- 11:57matter of days the national media would
- 11:59take interest in the missing pregnant
- 12:01wife of Scott Peterson which would
- 12:03dominate the airwaves for many years to
- 12:06come by the following month it was
- 12:08revealed that Scott Peterson had been
- 12:10having a torrid affair with the 26 year
- 12:13old massage therapist Amber Frey the
- 12:16revelation of the affair seemed to be an
- 12:18insinuation of his culpability by the
- 12:21media as well as the various pundits who
- 12:24constantly railed against Peterson
- 12:25during this time it would have been
- 12:28nearly impossible to have been alive in
- 12:302003 and not have known about the lacian
- 12:33and Scott Peterson case the 24-hour news
- 12:36cycle made certain of that but it was
- 12:39the eventual discovery of Lacey and
- 12:41Connor Peterson's remains found washed
- 12:43up on the shore of the Berkeley Marina
- 12:45that seemed to send this case to the
- 12:48international stage within a week of
- 12:51their bodies being found Scott Peterson
- 12:53would be arrested for their homicide and
- 12:55the case against him would remain at the
- 12:57Forefront of the minds of the American
- 12:59people until well after his eventual
- 13:02prosecution and conviction so I wanted
- 13:06to know what were the new or compelling
- 13:08details supporters of Scott Peterson
- 13:10believed exonerated him of this crime in
- 13:14part two we will review the defense of
- 13:17Scott Peterson as well as the main
- 13:19arguments in support of his innocence
- 13:21and immediately following that we will
- 13:24review each argument and contrast it
- 13:27against the court record filed briefs
- 13:29and pleadings as well as any other
- 13:31evidence that was presented during and
- 13:34now after his trial and as always I will
- 13:37share with you my views of those facts
- 13:40let's begin in defense of Scott Peterson
- 13:45one of the first encounters that the
- 13:47general public had concerning the
- 13:49defense of Scott Peterson was the
- 13:50aforementioned a e documentary series
- 13:53the six-part series was mostly comprised
- 13:56of the Scott Peterson defense team his
- 13:58family and his other outspoken
- 14:00supporters with a small grouping of
- 14:02pundits still in favor of his guilt the
- 14:05family of Lacey Peterson did not
- 14:07participate in the series episode 1 of
- 14:10the documentary Begins by recounting the
- 14:12story of Scott and Lacey Peterson and
- 14:14from the onset it clearly sets out to
- 14:17establish the innocence of the accused
- 14:19former death row inmate if you know what
- 14:22this case from watching television
- 14:24probably almost everything you believe
- 14:26to be true about the case is not since
- 14:292017 virtually every major Network that
- 14:32covers True Crime content has released
- 14:35their own variations of the series which
- 14:37often includes the family of Scott
- 14:39Peterson and his many Defenders but
- 14:42because the a E Series represents some
- 14:45of the most detailed accounting of the
- 14:47Peterson defense it will serve as the
- 14:49backdrop for the details that we will
- 14:51review in our analysis from the very
- 14:54first episode it is presented to us that
- 14:56Scott Peterson was prosecuted tried and
- 14:59found guilty and the court of public
- 15:01opinion by the media long before he was
- 15:04ever arrested for the crime right away
- 15:07we are shown the throng of onlookers
- 15:10watching and waiting for the word of the
- 15:12jury's verdict then explosively reacting
- 15:16to the news that he had been found
- 15:18guilty we then begin to hear from the
- 15:21members of Scott Peterson's family and
- 15:23his passionate Defenders who tell us
- 15:26that everything we think we know about
- 15:28this case is wrong and over the course
- 15:30of the entire series we are given a
- 15:33detailed breakdown of the various
- 15:35arguments that they believe exonerates
- 15:38Scott Peterson but these are their
- 15:40primary arguments that they present in
- 15:42the series in support of his innocence
- 15:46the reason the police weren't able to
- 15:48find any evidence of a murder inside
- 15:49this house is because no murder occurred
- 15:52inside this house
- 15:54the important house was this house this
- 15:57house was being burglarized we are told
- 16:00that no evidence was found linking Scott
- 16:03Peterson to the crime for which he was
- 16:05convicted and that the entire case was
- 16:07purely circumstantial it is claimed that
- 16:10the Modesto Police Department zeroed in
- 16:13on Scott right after they reported that
- 16:15Lacey was missing despite the lack of
- 16:18any evidence of a crime having been
- 16:20committed in their home or at Scott's
- 16:22Warehouse they explained that on the
- 16:25morning that Lacey went missing the
- 16:27computer of Scott and Lacey Peterson
- 16:29appeared to have evidence that Lacey was
- 16:32online shopping for items on the
- 16:34couple's computer one of their most
- 16:36explosive claims is that 11 different
- 16:39independent people witnessed a pregnant
- 16:41Lacy Peterson walking their dog
- 16:44Mackenzie well after Scott left to go
- 16:47fishing that day
- 16:48we are told that Scott was honest with
- 16:51the cops and decided to go fishing that
- 16:53morning and that he went to Great
- 16:55Lengths to be helpful throughout his
- 16:57interactions with the police Scott's
- 16:59defense team explains that the
- 17:01Peterson's mail carrier who delivered
- 17:03the mail the day that Lacey's
- 17:05disappearance occurred at 10 38 a.m
- 17:08never heard Mackenzie bark that day
- 17:11something Mackenzie did on every day
- 17:14that he attempted to deliver the mail
- 17:16this claim is believed to prove that
- 17:19Lacey was out walking the dog since
- 17:21Karen's service had returned Mackenzie
- 17:23to the house at 10 18 am the brother and
- 17:27sister of Scott Peterson tells us that
- 17:29no one could know how they would react
- 17:32if they had lost a loved one or someone
- 17:34in their life that had gone missing and
- 17:36that we cannot judge Scott for his odd
- 17:39behavior and see it as proof of his
- 17:41criminality in this case lead defense
- 17:44counsel attorney garagos explains to us
- 17:47that the boat that Scott took onto the
- 17:49Berkeley Marina that day couldn't have
- 17:52possibly been able to carry the nearly
- 17:54full-term body of Lacey Peterson and not
- 17:57have been seen by the various onlookers
- 18:00at the marina and that it would have
- 18:01capsized when Scott attempted to push
- 18:04the anchored body over the edge we hear
- 18:07that Scott had been falsely accused of
- 18:09making concrete anchors that were later
- 18:12alleged by law enforcement have been
- 18:14used to weigh down Lacey's body despite
- 18:16the fact that there was evidence that he
- 18:19had used the excess concrete to fill in
- 18:21a hole at his home
- 18:23one of the most effective segments of
- 18:25the series shows us the incredibly
- 18:28damaging effect that Amber Frey had on
- 18:31Scott's case and how the public jumped
- 18:33to conclusions that because Scott had a
- 18:36mistress then surely he must have won at
- 18:38least he gone allowed Lacey's family to
- 18:42go on national television and defend him
- 18:45all the while lying through his teeth
- 18:48about this affair that was downright
- 18:50cruel and I think it tells us something
- 18:51about his personality it tells us
- 18:53something about his conscience and
- 18:56finally the primary argument heard
- 18:58countless times in this series is that
- 19:00the media tried and convicted Scott
- 19:03Peterson during their 24-hour media news
- 19:06cycle that the media bias caused the
- 19:09general public to believe that he was
- 19:11guilty of a crime that had no biological
- 19:14or forensic evidence whatsoever and if
- 19:18you were to add all of these details
- 19:20together along with the various other
- 19:22arguments presented in the series series
- 19:24it appears to be an incredibly powerful
- 19:26narrative that seems to point to the
- 19:28innocence of Scott Peterson so what
- 19:31happened how was he convicted on a
- 19:34purely circumstantial case that did not
- 19:36have any forensic evidence whatsoever I
- 19:40believe that what I have found in my
- 19:42research definitively answers that
- 19:44question but in order to understand the
- 19:47answer with proper context we have to
- 19:49start at the beginning and address the
- 19:51primary defense claims of Scott
- 19:53Peterson's innocence one by one
- 19:56number one the case against Scott
- 19:59Peterson was entirely circumstantial
- 20:02exactly two years to the day prior to
- 20:05The Disappearance of Lacey Peterson just
- 20:07five hours away in Los Angeles another
- 20:10homicide was being uncovered on
- 20:12Christmas Eve in the year 2000 the
- 20:15Beverly Hills Police Department had been
- 20:17notified of the execution-style homicide
- 20:20of Susan Berman Susan had been the
- 20:23daughter of the infamous gangster David
- 20:25Berman who had well-established ties to
- 20:27the mafia in his years operating The
- 20:30Flamingo Hotel and Casino in Las Vegas
- 20:32Nevada
- 20:33at the time it was believed that Berman
- 20:36may have been the unfortunate collateral
- 20:38damage of her father's past lifestyle
- 20:40related to his regrettable ties to the
- 20:43Mob but several days after her homicide
- 20:46the Beverly Hills Police Department
- 20:47would receive a letter with Susan
- 20:49Berman's address and the word cadaver
- 20:52written on the outside of the letter
- 20:54despite the homicide Department's
- 20:57attempts to solve her vicious crime it
- 20:59would sadly go on to become a cold case
- 21:01for nearly 15 years
- 21:04law enforcement was unable to find any
- 21:07forensic evidence or biological evidence
- 21:09they found no murder weapon and no
- 21:12indisputable suspects were able to be
- 21:14definitively tied to the crime scene
- 21:16where Berman was found but all of that
- 21:19would change when Andrew jarecki made
- 21:22the film All Good Things featuring Ryan
- 21:25Gosling and Kirsten Dunst the movie was
- 21:28based on the life of Robert Durst the
- 21:30once heir to the real estate dynasty of
- 21:33the Durst organization Durst would go on
- 21:35to participate in a documentary created
- 21:38by jerecki that would culminate in a
- 21:41spectacular ending that would have the
- 21:43unintended outcome of solving the
- 21:46homicide of Susan Berman you might be
- 21:49wondering how that was possible well for
- 21:51those who haven't seen the Netflix
- 21:52documentary The Jinx I highly recommend
- 21:55it it has one of the most explosive
- 21:57endings of any documentary you will ever
- 22:00see in your life but as a result of a
- 22:03single letter provided to the director
- 22:05Andrew durecki by Berman's stepson it
- 22:08provided the link between Robert Durst
- 22:10and the homicide of Susan Berman and
- 22:14this was accomplished simply because the
- 22:16handwriting of the word cadaver sent to
- 22:18the Beverly Hills Police Department in
- 22:21the year 2000 perfectly matched the
- 22:23handwriting and misspellings of Robert
- 22:26Durst a case that had been called for 15
- 22:29years was solved using entirely
- 22:32circumstantial evidence evidence that
- 22:34had definitively connected Robert Durst
- 22:37to a crime that he had successfully
- 22:39obscured and avoided for over 15 years
- 22:43in my many years of working with clients
- 22:45from all spectrums of societal
- 22:47backgrounds and experiences I have
- 22:49frequently noticed a common
- 22:51misconception concerning the matter of
- 22:53circumstantial evidence the pervasive
- 22:55ideas seems to be that forensic and
- 22:57biological evidence should be found in a
- 23:00homicide in that forensic evidence like
- 23:02DNA is virtually a requirement in order
- 23:05to link an offender to the crime and
- 23:08that without it the case becomes
- 23:09entirely circumstantial the word
- 23:11circumstantial has increasingly become
- 23:13viewed as synonymous with Reasonable
- 23:16Doubt amongst a surprisingly large
- 23:18majority of the general populace and
- 23:21this is something we've discussed on
- 23:23this channel in the past a term referred
- 23:25to as the CSI effect a reoccurring and
- 23:28increasingly pervasive belief that a
- 23:31criminal action involving a homicide
- 23:33must therefore also have compelling
- 23:35forensic evidence and the absence of
- 23:37that evidence likely points to the
- 23:39innocence of the accused party
- 23:41unfortunately that isn't always the case
- 23:44more times than not criminals who commit
- 23:47heinous crimes go to Great Lengths to
- 23:49attempt to cover them up especially if
- 23:51they have the time opportunity and
- 23:54ability to do so many times prosecutors
- 23:57only have circumstantial evidence
- 23:59available to them as a means to pursue
- 24:01Justice because the perpetrator has gone
- 24:04onto Such Great Lengths to hide obscure
- 24:07and eliminate the evidence but Robert
- 24:10Durst isn't the only example of an
- 24:13entirely circumstantial case that was
- 24:15solved another good example that
- 24:17involved circumstantial evidence is the
- 24:19case of Leonard Lake a man who was one
- 24:22of the most vile and fiendish criminals
- 24:24of the 20th century Leonard Lake and his
- 24:28accomplice Charles ing committed heinous
- 24:31crimes that left law enforcement shocked
- 24:33at the extent of his inhuman brutality
- 24:36eventually law enforcement took Lake
- 24:39into custody where he would demonstrate
- 24:41his cowardice of the justice system by
- 24:43way of successfully hiding cyanide pills
- 24:46from law enforcement but before law
- 24:48enforcement could act his accomplished
- 24:50Charles ing would go on the Run fleeing
- 24:53California and finding his way into
- 24:55Canada after several years Canadian law
- 24:58enforcement would eventually catch Ing
- 25:00and despite the enormity of the crimes
- 25:03that he had been accused Dove he would
- 25:05successfully delay his prosecution for
- 25:08well over a decade but even when his
- 25:11trial began the case against him was
- 25:13seen as largely circumstantial since the
- 25:16prosecution didn't have any direct
- 25:17evidence of him committing the crimes
- 25:19for which he was now standing trial even
- 25:22though video evidence existed they
- 25:25didn't have a Smoking Gun or any direct
- 25:27forensic evidence proving that he had
- 25:30personally harmed any of the victims
- 25:32that were later found on Leonard Lake's
- 25:34property law enforcement believed that
- 25:37great Lanes had been taken to hide and
- 25:39obscure the evidence linking into his
- 25:42crimes but the circumstantial case
- 25:44against him was considerable and the
- 25:47jury saw through his many attempts to
- 25:49escape and deny Justice to his many
- 25:52victims the jury would eventually
- 25:55convict and sentence ing to death row at
- 25:58San Quentin the same prison that he and
- 26:01Scott Peterson remained to this very day
- 26:04circumstantial cases are sometimes the
- 26:07only means a victim or their family has
- 26:10of obtaining Justice and if not for film
- 26:12director Andrew durecki it is entirely
- 26:15likely that Robert Durst would have
- 26:17lived out the remainder of his days a
- 26:20free man
- 26:21but a single letter a letter that was
- 26:24likely thought to be completely
- 26:25inconsequential change the outcome of
- 26:28that case for good A Cold Case lacking a
- 26:32forensic connection to the crime had
- 26:34been gifted compelling circumstantial
- 26:36evidence that clearly and profoundly
- 26:38established the guilt of Robert Durst a
- 26:41man who was later convicted for the
- 26:43homicide of Susan Berman nearly 20 years
- 26:47later
- 26:48but just because a circumstantial case
- 26:50can be enough to satisfy the burden of
- 26:52guilt can the same be said of Scott
- 26:54Peterson's case
- 26:56is there compelling evidence in either
- 26:58direction that supports or rejects his
- 27:01claims of Innocence let's review the
- 27:03facts
- 27:04number two the Modesto Police Department
- 27:07focused on Scott Peterson from the very
- 27:10beginning despite the lack of evidence
- 27:12of a crime throughout the various
- 27:14iterations of the Peterson defense it is
- 27:17often claimed that the Modesto Police
- 27:19Department unfairly honed in on Scout
- 27:22from the very beginning and never
- 27:24bothered to look at any other suspects
- 27:27in his wife's disappearance
- 27:29unfortunately after a cursory review of
- 27:32The Evidence it quickly became apparent
- 27:34to me that this claim is entirely untrue
- 27:37the Modesto Police Department did look
- 27:40into other suspects including every
- 27:43single member of the family of both
- 27:45Scott and Lacey Peterson this is known
- 27:48because we have recorded calls between
- 27:50the roaches and the Peterson Family
- 27:52where the police explain that they have
- 27:55cleared the family through an
- 27:57investigation of each person but that
- 28:00they had been unable to clear Scott in
- 28:03my career I learned a number of
- 28:05important truths about the life of a law
- 28:08enforcement officer whenever we analyze
- 28:11a case within the True Crime community
- 28:13no matter how much we learn about it we
- 28:15do so as laypeople but it is no
- 28:18substitution for what a homicide
- 28:20detective sees day after day
- 28:23over the years I learned from many
- 28:25experienced veteran law enforcement
- 28:27officers that the most common party
- 28:29responsible for The Disappearance of a
- 28:31spouse is often the spouse or someone
- 28:35close to them that the victim knew
- 28:37personally it's widely known in the law
- 28:39enforcement community that the last
- 28:42person to see the victim alive is the
- 28:44very first person you want to speak with
- 28:46in connection to that disappearance
- 28:49statistically speaking that person is
- 28:52often either responsible for the crime
- 28:54or knows details about the crime while
- 28:58that isn't always the case volumes of
- 29:00criminal statistics shows that a vast
- 29:03majority of crimes involving a homicide
- 29:05are often committed by someone close to
- 29:08the victim so the claim that the Modesto
- 29:11Police Department didn't consider any
- 29:13other suspects is patently untrue
- 29:16in fact they did consider the burglary
- 29:19that happened across the street to have
- 29:21some possible involvement in her
- 29:23disappearance and they said so in a
- 29:25press conference we have a witness that
- 29:27drove by the residents that lives in the
- 29:30area who saw a suspicious vehicle and
- 29:32some suspicious people feel that it's
- 29:34critical to either confirm is involved
- 29:36with Lacey's disappearance or that is
- 29:38just a burglary records show that they
- 29:41conducted an investigation of those
- 29:42suspects and ultimately cleared them
- 29:45because there was no evidence that they
- 29:47had any involvement in her disappearance
- 29:50eventually in the docu-series it's
- 29:52claimed that someone involved in the
- 29:54crime across the street also admitted to
- 29:57having involvement in Lacey's
- 29:58Disappearance in a recorded call but did
- 30:01you notice the call has never been
- 30:03produced additionally no evidence of any
- 30:06kind circumstantial or otherwise was
- 30:09ever found linking those people to her
- 30:12disappearance or her eventual homicide
- 30:15and more importantly there's the ongoing
- 30:18issue of motive for which these thieves
- 30:20had none to commit such a violent and
- 30:23heinous crime against the pregnant
- 30:25mother in my efforts to validate the
- 30:28claim that the Modesto Police unfairly
- 30:30focused on Scott I randomly came across
- 30:33something that happened mere hours after
- 30:35Lacey's disappearance was reported to
- 30:37police on December 25th just hours after
- 30:41their initial call Scott Peterson calls
- 30:43homicide detector brokini and asks if
- 30:46they've used cadaver dogs yet detective
- 30:49brokini was shocked by the question and
- 30:52asked him Scott cadaver dogs are used
- 30:54for sniffing out dead bodies have you
- 30:57given up hope for finding Lacey alive
- 30:59and Scott's response to his question was
- 31:02to say nothing at all
- 31:04now I don't have to be a member of law
- 31:07enforcement to know just how suspicious
- 31:09that question is because Scott had no
- 31:11reason to believe that Lacey was already
- 31:13deceased and that question is not at all
- 31:17something that is commonly asked in a
- 31:19disappearance before there is any reason
- 31:22to suspect a homicide that question
- 31:25alone would raise the suspicion of any
- 31:27law enforcement officer in that same
- 31:30situation on the a E network there is a
- 31:33show called the first 48. now for those
- 31:36of you who are unfamiliar with the show
- 31:37it is a series that follows real
- 31:40homicide detectives during the first 48
- 31:42hours after a homicide the entire
- 31:45premise of the show is that the first 48
- 31:47hours is the most critical time frame of
- 31:50law enforcement's investigation and that
- 31:52a vast majority of the details
- 31:54concerning that case are determined
- 31:56within a matter of hours after The
- 31:59Police become involved
- 32:01so it's not only common for police to
- 32:03have a suspect in mind right away it's
- 32:06the norm now I am not suggesting that
- 32:09law enforcement as a whole be given a
- 32:11pass whenever they have a rush to
- 32:12judgment what I am saying is that the
- 32:15narrative that Scott Peterson was an
- 32:17immediate suspect is not evidence of law
- 32:20enforcement's prejudice
- 32:22in fact the more I researched the more I
- 32:24found that law enforcement officers who
- 32:27initially responded to the scene
- 32:28eventually got together and discussed a
- 32:31series of concerns that they had after
- 32:33they had spoken with Scott and several
- 32:35of Lacey's family members the following
- 32:38are just some of their initial
- 32:40observations at the scene as stated in
- 32:43their reports
- 32:44they noticed that when they initially
- 32:46spoke with Scott he could not answer
- 32:48what he was fishing for that day
- 32:50additionally in that conversation he
- 32:53volunteered a receipt from the Berkeley
- 32:54Marina something that no one had asked
- 32:57him to do
- 32:59law enforcement was concerned that he'd
- 33:01never call police to report Lacey
- 33:03missing Lacey's stepfather Ron gransky
- 33:06did that their concerns were also
- 33:08heightened when they learned that Scott
- 33:10had come home from an unplanned fishing
- 33:13trip 90 minutes away notices his wife's
- 33:16car is in the driveway sees that she is
- 33:19nowhere to be found sees evidence that
- 33:22someone has walked the dog who was
- 33:24wandering around in their backyard and
- 33:26his first actions are to wash his
- 33:28clothes take a shower and eat pizza and
- 33:32milk detectives would also notice a
- 33:35bunched up rug near the Peterson's back
- 33:37door officers noticed that it appeared
- 33:39as though something was dragged over the
- 33:42top of it they also noticed that on the
- 33:45Peterson's bed there was a large
- 33:47body-like impression on it but most
- 33:50concerning to law enforcement was the
- 33:53fact that Scott Peterson never once
- 33:55called Lacey after he said that he
- 33:58noticed that she was missing he claims
- 34:01that he doesn't know where she was and
- 34:03yet he doesn't bother to call his
- 34:05pregnant wife on her cell phone I
- 34:08remember the first time that I read that
- 34:10I really stopped what I was doing to
- 34:12think about that for a moment you come
- 34:15home to an empty house your nearly
- 34:17full-term pregnant wife who had a
- 34:20fainting spell recently in the park is
- 34:22nowhere to be found her car is in the
- 34:24driveway her shoes are in the house and
- 34:27all of her other belongings are there as
- 34:29well and it never occurs to you to call
- 34:31her according to Scott Peterson he had
- 34:34no idea where Lacey was so why wouldn't
- 34:37he have tried to call her on her cell
- 34:39phone this is even more concerning when
- 34:41you realize that he had tried to call
- 34:43her at 2 15 on his way back from the
- 34:46marina but once he gets home and
- 34:49realizes that Lacey is missing his first
- 34:51call isn't to the police to report his
- 34:54wife missing it's to Lacey's mother to
- 34:56tell her that she's missing ladies and
- 34:59gentlemen that is the very definition of
- 35:02suspicious Behavior
- 35:04and if all you had seen was the a E
- 35:07Series you might incorrectly believe
- 35:09that police had wrongly suspected Scott
- 35:11but these issues were more than enough
- 35:14for any law enforcement agency to
- 35:16consider Scott a person of interest
- 35:19and despite the enormity of everything
- 35:21we just learned law enforcement still
- 35:24did not publicly list Scott as a suspect
- 35:27or as a person of interest for a
- 35:30considerable time after Lacey's initial
- 35:33disappearance one of the other important
- 35:35elements of criminology that I have
- 35:37learned over the years is the importance
- 35:39of motive understanding motive is an
- 35:42important element in understanding a
- 35:45crime a shockingly high percentage of
- 35:47cases that involve violent crimes have
- 35:50motive or someone involved who had
- 35:53reason to want to commit the crime and I
- 35:56suspect as we continue down the list of
- 35:58claims of Scott's innocence that motive
- 36:01is something we are going to want to
- 36:03keep at the Forefront of our analysis so
- 36:06let's continue
- 36:08number three Lacey accessed the Peterson
- 36:11computer at around 8 40 a.m on Christmas
- 36:14Eve proving that she was alive that
- 36:17morning in the docu-series the various
- 36:20Peterson Defenders portray this
- 36:23information as their Smoking Gun that
- 36:25completely disproves the case of the
- 36:27prosecution brought during the trial of
- 36:30Scott Peterson according to the computer
- 36:33expert witness 8 40 in the morning she
- 36:36disappears someone is on the Peterson
- 36:39home computer looking at a sunflower
- 36:41umbrella stand and women's clothing
- 36:43Lacey loves sunflowers to all her
- 36:45friends and family say that Janie
- 36:47Peterson the sister of Scott exclaims
- 36:49how critical this discovery was during
- 36:51the trial because it proved that Lacey
- 36:54was alive that morning at 8 40 a.m and
- 36:57if this were true then it would leave
- 36:59Scott an insufficient window of time to
- 37:02commit the crime when I watched this
- 37:05segment I was struck at how compelling
- 37:06this was because in fact the prosecution
- 37:09seem to contend that this may have
- 37:12actually happened but do you know what I
- 37:14found looking at the trial record I
- 37:17quickly realized that this claim is not
- 37:20even remotely accurate just moments
- 37:23before Lacey Peterson is supposedly
- 37:26online shopping Scott Peterson logs onto
- 37:29his password protected account and
- 37:32checks his private emails and a few
- 37:34moments after Lacey was supposedly
- 37:37online shopping we see Scott checking
- 37:39the weather at the Berkeley Marina
- 37:42playing the part of the Devil's Advocate
- 37:44it could be argued that maybe Lacey
- 37:47jumped onto the computer in between
- 37:49Scott checking his email and checking
- 37:51the weather at the marina but allow me
- 37:53to explain why that didn't happen
- 37:56because in the a E Series we actually
- 37:58learn that Scott didn't even know that
- 38:01Lacey had used the computer that morning
- 38:03but how in the world would that be
- 38:05possible when he's logged into his email
- 38:08checking it and then moments after she's
- 38:11supposedly online shopping he's then
- 38:13checking the weather at the marina
- 38:15but there's something even more
- 38:17important to understand about this
- 38:19entire issue and that has to do with
- 38:22temporary internet files
- 38:24each and every time you view the
- 38:26internet whether it's on your cell phone
- 38:28on a desktop a laptop or any device
- 38:31everything you look at is logged and
- 38:34stored into your web history these files
- 38:38that are stored onto your web browser
- 38:40are referred to as temporary internet
- 38:42files
- 38:43now back in December of 2002 the
- 38:46internet was a vastly different place
- 38:48than it is today it was quite common to
- 38:51deal with pop-up advertisements from
- 38:53virtually every corner of the internet
- 38:55pop-up blockers had not yet become
- 38:58commonly used and despite how annoying
- 39:00Those ads may have been they did leave a
- 39:03fairly distinct Trail in your web
- 39:05browser so even if you didn't click on
- 39:08the pop-up they would still show up in
- 39:10your browser history so to be perfectly
- 39:13clear in 2002 a pop-up ad was not an
- 39:17indicator that you had specifically
- 39:19visited a website more importantly let's
- 39:22think about how online shopping actually
- 39:24works even in 2002 whenever you view a
- 39:28web page every time you view something
- 39:30or click on anything or add an item into
- 39:33your cart each and every page is also
- 39:36logged into your web history
- 39:38so there would be far more than just a
- 39:41few entries in the web history if
- 39:44someone had been online shopping on the
- 39:46Peterson's computer that morning
- 39:48unfortunately in 2002 internet
- 39:51technology wasn't well understood by the
- 39:53general public the way it is now and
- 39:56sadly the prosecution didn't understand
- 39:58that this alleged web history did not
- 40:02prove that Lacey was alive it didn't
- 40:05prove any of the things that the defense
- 40:06claimed it did however since that time
- 40:09it has been used in half a dozen
- 40:12documentaries as proof of something that
- 40:15never actually happened
- 40:17Lacey Peterson did not go online
- 40:20shopping that morning and it doesn't
- 40:22take a computer science degree to know
- 40:24that and this Revelation left me wanting
- 40:27to know one thing if they aren't trying
- 40:30to use this information to convince the
- 40:32court that a mistake was made by way of
- 40:34an appeal then who are they trying to
- 40:37convince that Scott Peterson is innocent
- 40:40because this is now the third time we've
- 40:42uncovered a bogus claim made by the
- 40:44series as well as those who defend
- 40:46Scott's innocence but I wanted to be
- 40:49generous because maybe they just didn't
- 40:51understand how computers work or how
- 40:54internet browser history works so let's
- 40:56evaluate the other Smoking Gun claims in
- 40:59the defense of Scott Peterson number
- 41:02four 11 independent Witnesses saw Lacy
- 41:06Peterson walking their dog Mackenzie
- 41:08after Scott left to go fishing that day
- 41:12the claim that Lacey Peterson was seen
- 41:14by 11 different Witnesses after Scott
- 41:17had already left to go fishing that day
- 41:20is made throughout the entire a e
- 41:22documentary series
- 41:24we are told that if Lacey had been seen
- 41:27by any one of those witnesses that it
- 41:30would mean that Scott Peterson was
- 41:33actually innocent and here's the thing I
- 41:36actually agree with that statement
- 41:38Scott would not have had enough time to
- 41:41commit the crime that he was convicted
- 41:43of if Lisi had been seen by any one of
- 41:46those people after he left the house
- 41:48just after 10 a.m so I had to try and
- 41:51understand how it was possible that so
- 41:54many people had seen her and how Scott
- 41:56was still convicted despite their many
- 41:59claims so once again I dove into the
- 42:02record reviewing the court transcripts
- 42:05reviewing the various reports taken by
- 42:07those who claim to have seen Lacey that
- 42:09day and what I found left me completely
- 42:12stunned here are the facts shortly after
- 42:16Lacey's disappearance a missing poster
- 42:18had gone out through the entire
- 42:20Community being shared absolutely all
- 42:23over Modesto this is the poster that
- 42:26most people saw in their community on
- 42:29the news and all over the Internet a
- 42:33short time later a reward was offered in
- 42:35connection to a lead that would solve
- 42:37her case a monetary Award of half a
- 42:40million dollars now on the missing
- 42:43poster you may notice that it says that
- 42:45she was wearing a white long-sleeve
- 42:47shirt and black pants and wouldn't you
- 42:50know it the many independent Witnesses
- 42:52claim to have seen Lacey wearing exactly
- 42:55that outfit long after Scott had left
- 42:58their house to go on a pleasant day of
- 43:00fishing there is just one very big
- 43:03problem with all of that and that's the
- 43:06fact that when Lacey's remains were
- 43:07found she was wearing beige pants not
- 43:10black so these alleged sightings didn't
- 43:13even match the clothing that she was
- 43:15actually wearing at the time oh and one
- 43:18other thing Lacey's OB GYN testified
- 43:21that she had already stopped walking
- 43:23their dog because she had an episode
- 43:25where she nearly fainted in the park
- 43:27several weeks before her yoga teacher
- 43:30her neighbors her friends and her mother
- 43:32all corroborated the fact that Lacey had
- 43:35stopped walking Mackenzie several weeks
- 43:38earlier
- 43:39but as I was reading through the witness
- 43:40statements I remembered a case that I
- 43:42had helped with many years back it was
- 43:45concerning a family law dispute between
- 43:47two feuding parents the mother was in
- 43:49the process of getting sold custody of
- 43:51her children from a father who had
- 43:53recently been arrested for kidnapping
- 43:55both of their children but thanks to an
- 43:57amber alert he had been caught
- 43:59attempting to flee the state but for the
- 44:01multiple hours that he couldn't be found
- 44:03the police had received several dozen
- 44:06tips from truckers pedestrians and other
- 44:09concerned citizens who swore that they
- 44:12had seen a man fitting his description
- 44:14driving the same color vehicle however
- 44:17despite the fact that law enforcement
- 44:19received nearly 40 leads from concerned
- 44:21citizens who believed in the validity of
- 44:24their sightings not one of those leads
- 44:27were correct her ex-husband was
- 44:29eventually found at his Stepmother's
- 44:31house and taken into custody when his
- 44:33stepmom contacted police to turn him in
- 44:36and that experience taught me that false
- 44:38sightings are a common occurrence that
- 44:41sadly happen all the time so often that
- 44:45it actually happened in another national
- 44:47case concerning The Disappearance of a
- 44:50two-year-old toddler in November 2008
- 44:52the FBI received a tip concerning a
- 44:55toddler that had been missing for well
- 44:57over three months the tipster said that
- 44:59she had been seen at a McDonald's 30
- 45:02miles outside of Nashville Tennessee the
- 45:05FBI rushed into action and quickly
- 45:07reviewed the surveillance footage but
- 45:09the passionate tipster who had been
- 45:11completely convinced that they had seen
- 45:13Kaylee Marie Anthony was in fact wrong
- 45:16each and every time any of Scott
- 45:19supporters discuss his case they tout
- 45:21these 11 witnesses as proof that Lisi
- 45:24was alive in fact Mark garagos the lead
- 45:27defense attorney proclaimed in his
- 45:29opening statements at Scott Peterson's
- 45:31jury trial that he would bring those 11
- 45:34Witnesses before the jury to
- 45:36definitively and demonstrably prove that
- 45:39Lacey he had been walking their dog that
- 45:41day long after Scott had left the area
- 45:44to go on his unplanned fishing trip but
- 45:47do you know what never happened Mark
- 45:49garagos never brought a single one of
- 45:52those Witnesses before the jury not one
- 45:55and he says that the reason he didn't
- 45:57bring any of those promised Witnesses is
- 45:59because he had proved that Lacey was
- 46:01alive that morning at 8 40 a.m but we
- 46:05already know that this claim wasn't true
- 46:07either but I couldn't help but wonder if
- 46:10they were so confident that Lacey was
- 46:12alive and believed it proves God's
- 46:14innocence then why in the world is in
- 46:17any of his appeals based on the
- 46:19testimony of any of these 11 Witnesses
- 46:22why wouldn't Scott file an appeal
- 46:24claiming ineffective assistance of
- 46:26counsel against Mark garagos for failing
- 46:29to bring those Witnesses in front of the
- 46:31jury well attorney garigo slipped up and
- 46:34told us why in his interviews throughout
- 46:37the series simply put their testimony
- 46:40contradicts their statements some of
- 46:43them claim to see Lacey in different
- 46:45places at different times and they all
- 46:47contradict each other attorney garagos
- 46:50chose not to use their statements for a
- 46:53reason because he knew that they would
- 46:55not help his client
- 46:57one thing my legal career has afforded
- 47:00me is an understanding of the legal
- 47:03process the ins and outs of how it
- 47:05actually works because if this argument
- 47:09concerning these 11 Witnesses was so
- 47:12compelling Scott would have filed an
- 47:14appeal based on them by now and that's
- 47:17how you know that it isn't an argument
- 47:20at all but here we are having uncovered
- 47:23the fourth time that claims from this
- 47:25series from supporters of Scott Peterson
- 47:28have failed to tell the whole truth
- 47:30claims that seemingly intend to
- 47:32intentionally mischaracterize the facts
- 47:35of this case but I want to tell you
- 47:37something about me my OCD nature now
- 47:40wants to know the whole truth about all
- 47:42of the claims they've made and I'll just
- 47:44tell you this I could have never guessed
- 47:47the totality of what I would find when I
- 47:49was finished reviewing the facts of this
- 47:52case
- 47:53number five Scott Peterson was honest
- 47:56with police from the beginning and went
- 47:59to Great Lengths to help their
- 48:00investigation throughout the a E Series
- 48:03as well as various other interviews that
- 48:05Scott Peterson's family have agreed to
- 48:08participate in they will say over and
- 48:10over how Scott was truthful and that he
- 48:14only ever lied a handful of times but
- 48:17that if he did lie he was quick to make
- 48:19efforts to correct those lies the
- 48:22examples they give seem to play Scott in
- 48:24a favorable light they demonstrate his
- 48:27efforts to be transparent and if he
- 48:29messed up that he was quick to fix those
- 48:31mistakes
- 48:32but as you may have guessed by now what
- 48:35I found was entirely different on so
- 48:38many different occasions Scott
- 48:39supporters say that Scott decided to go
- 48:42fishing that morning then he came home
- 48:44to an empty house and immediately began
- 48:47to notify everyone that Lacey had
- 48:49seemingly disappeared Into Thin Air but
- 48:52I'm starting to notice a pattern in the
- 48:54entirety of their claims because the
- 48:56notion that Scott decided to go fishing
- 48:58that morning is entirely and completely
- 49:01untrue in all the documentaries that
- 49:04I've seen implying the innocence of
- 49:06Scott Peterson I have never once heard
- 49:08them tell the whole truth about this
- 49:10specific claim because in actuality
- 49:13Scott purchased his fishing license on
- 49:16December 20th four entire days before he
- 49:20actually went fishing so it wasn't a
- 49:23previously unplanned trip that he
- 49:25decided to take that morning because the
- 49:27license that he previously purchased was
- 49:29only good for December 23rd and 24th the
- 49:33day he went fishing was literally the
- 49:36last day that he could legally fish on
- 49:38the marina on his new boat another lie
- 49:41he told was concerning what he did that
- 49:43day he had explained that he went
- 49:44fishing with the silver lure for
- 49:46sturgeon something that on his face
- 49:48seems so completely unimportant but
- 49:51later law enforcement determined that
- 49:53wasn't true either because when police
- 49:55searched his house in his boat they
- 49:57found the only lures that he had
- 49:59anywhere in his possession and the Box
- 50:01they were in were still closed and
- 50:03sealed from his original purchase
- 50:06additionally he couldn't have been
- 50:08fishing for sturgeon that day because
- 50:10they weren't in season and it was
- 50:11illegal to fish for them during that
- 50:13time but the lies didn't end there
- 50:16either he told police that same night
- 50:18that he hadn't had any issues with his
- 50:20marriage and we all know that wasn't
- 50:22true and just six hours after Lacey goes
- 50:26missing before anyone has any idea that
- 50:28she isn't coming home he asks detective
- 50:31brokini for details to contact Chief
- 50:33counselors he had no reason to believe
- 50:35that Lacey wasn't coming home that same
- 50:37night for all he knew so why in the
- 50:39world would he want the phone number for
- 50:42a grief counselor especially when you
- 50:44consider the fact that they are used by
- 50:46law enforcement to assist family
- 50:48whenever a loved one is found deceased
- 50:51and if I were to tell you the number of
- 50:53times that Scott Peterson was caught in
- 50:56a provable lie this video would be 12
- 50:59hours long but rest assured we will
- 51:02discuss some of the more important lies
- 51:04that he told when we get to the
- 51:06prosecution side of this case but I'm
- 51:08really hoping by now you're starting to
- 51:10see the issues I'm having with these
- 51:11claims because each one of them is
- 51:14easily disproven but out of morbid
- 51:16curiosity I wanted to see if any of his
- 51:19claims hold any Merit at all
- 51:22number six the mail carrier never heard
- 51:25the Peterson's dog Mackenzie which
- 51:27indicates that Lacey was out walking the
- 51:30dog this is one of the most commonly
- 51:32argued points anytime I have ever seen
- 51:35public arguments in favor of Scott's
- 51:37innocence it is often considered one of
- 51:39the smoking guns that proves that Lacey
- 51:42was out walking their dog well after
- 51:44Scott left their home to go fishing the
- 51:46argument is predicated on the fact that
- 51:48Karen's service put their dog Mackenzie
- 51:51in their backyard at 10 18 a.m and 20
- 51:53minutes later the mail carrier delivers
- 51:56the Peterson's mail but never hears
- 51:58Mackenzie bark something the dog did
- 52:01every time he delivered the mail Scott
- 52:03supporters claim that it clearly means
- 52:06that the dog wasn't home and therefore
- 52:08implies that Lacey was alive and had to
- 52:10have been outside walking him nearly 40
- 52:13minutes after Scott had already left
- 52:15their house and on its face it seems
- 52:18compelling because if Mackenzie had just
- 52:20been placed in the backyard by Karen
- 52:22service then why wasn't he barking as
- 52:25usual but it doesn't take a Monumental
- 52:27amount of effort to see the flaws in
- 52:29this argument I am the proud owner of
- 52:32this beautiful beagle and for the last
- 52:34several years she has barked at every
- 52:37single person who has ever walked by my
- 52:39house
- 52:45mail carriers doordash deliveries and
- 52:47anyone else who has dared to walk in
- 52:49front of her Hallowed Ground
- 52:52she barks with a passionate Fury every
- 52:55single day without ever taking a single
- 52:57day off and does so with righteous
- 53:00indignation
- 53:01until the day she didn't just a few
- 53:04weeks ago for no discernible reason
- 53:05whatsoever she could see outside clearly
- 53:08as our neighbor walked directly in front
- 53:10of our house and she simply chose not to
- 53:13bark that day in fact she Embark at
- 53:15anyone else that walked by that day
- 53:17either maybe she was tired or maybe she
- 53:20finally listened to my many attempts to
- 53:22train her and it finally stuck I Can
- 53:25Dream but do you know what the mail
- 53:27carrier claimed and now my story of my
- 53:28beagle is its anecdotal evidence and it
- 53:32does not prove a single thing whatsoever
- 53:35which is why Scott's high-priced defense
- 53:38attorneys have never once attempted to
- 53:40bring it into any one of his appeals
- 53:42because it's not evidence and it cannot
- 53:44be used as proof in any Court proceeding
- 53:47most especially not an appeal for a new
- 53:49trial but I wanted to take it a step
- 53:52further and actually show you why I
- 53:54believe that this isn't an argument that
- 53:56proves Lacey was alive let's think about
- 53:59the situation logically for just a
- 54:01moment and just for the sake of this
- 54:03analogy let's say that Scott Peterson
- 54:05did in fact end the life of his wife
- 54:07Lacey now I would imagine that even if
- 54:10the dog had been locked away in another
- 54:12room during the act that eventually
- 54:15Mackenzie was very much aware of what
- 54:17happened to Lacey and if you've ever
- 54:19seen a dog that has lost one of its
- 54:21primary owners they are deeply impacted
- 54:24by that loss their behavior changes so
- 54:27much in fact that it's not uncommon to
- 54:30see them laying around seemingly
- 54:32heartbroken and acting very different
- 54:34than normal because of the trauma of
- 54:36what they now know so it stands to
- 54:39reason that their dog Mackenzie would
- 54:41have had cause to act dramatically
- 54:43different than normal if Scott had ended
- 54:45the life of Lacey in that home and
- 54:48speaking of the Peterson's animals
- 54:50here's something I never heard anyone
- 54:51speak about in terms of his case
- 54:54on the night of Lacey's initial
- 54:55disappearance Scott told police that
- 54:57when he got home he opened the back door
- 54:59and let the dog and cat inside and then
- 55:02he said something that most people
- 55:03didn't seem to realize the importance of
- 55:05but I noticed it from the moment it left
- 55:08his mouth since I was a young child my
- 55:10parents have always owned cats but they
- 55:13were always outdoor cats and there is a
- 55:15massive difference between cats that
- 55:16live outdoors and cats that live indoors
- 55:18but every now and then whenever my mom
- 55:21would prepare a turkey or be cooking
- 55:23with the whole chicken I would take some
- 55:25of those scraps and give them to the
- 55:26outdoor cats and let me tell you those
- 55:29cats would come running from blocks away
- 55:31at the mere scent of blood why because
- 55:34cats are carnivores and it doesn't
- 55:36matter what kind of blood it is they'll
- 55:39come running and when you consider how
- 55:41much cats hate water the fact that his
- 55:43cat would come running over to the
- 55:45bucket is nothing short of reasonable
- 55:47suspicion now is it evidence that could
- 55:50have been used in court no but do you
- 55:53now see how any total evidence can be
- 55:55used to convey whatever narrative you
- 55:57want to push people towards but just in
- 56:00case it isn't clear this argument about
- 56:02the mail carrier isn't one but here we
- 56:05are six claims into their proof of his
- 56:07innocence and not one of them holds to
- 56:10any measure of scrutiny but I will
- 56:12commit to this if we can find that even
- 56:15one of the arguments in support of his
- 56:17innocence has any Merit I will gladly
- 56:20admit that Reasonable Doubt existed in
- 56:22his case
- 56:23so let's continue
- 56:25number seven Scott Peterson was aloof
- 56:28but no one can know how they would react
- 56:30in that same situation and his behavior
- 56:34was not proof of criminality I think
- 56:37everybody sitting at home wants the
- 56:38answer to the same question did you
- 56:40murder your wife no no no I just thought
- 56:44and I had absolutely nothing to do with
- 56:47her disappearance and and use the word
- 56:49murder and yeah I mean that is
- 56:54a possibility
- 56:57um it's not one we're ready to accept
- 56:59and it creeps in my mind late at night
- 57:02and early in the morning
- 57:04there was a poignant moment in the a e
- 57:06docu-series where attorney Mark garagos
- 57:09exclaims that in his entire career he
- 57:12has learned that observing the way
- 57:14someone acts is not a reliable marker
- 57:17for determining guilt and surprisingly I
- 57:20actually agree with him
- 57:22to an extent
- 57:23guilt or innocence should never be
- 57:26formed solely based on how a suspect
- 57:28reacts to a crime doing so can result in
- 57:31false confessions or incorrect
- 57:34assumptions that can have a profoundly
- 57:36negative effect on an ongoing
- 57:38investigation
- 57:40but as much as we may want for
- 57:42criminality to be solely determined
- 57:44based on scientific based forensics the
- 57:47reality of solving crimes often does
- 57:49involve observations that are centered
- 57:51around intuition experience and common
- 57:54sense as well as observing the evidence
- 57:57as a whole it is true that not everyone
- 58:01reacts the same way to trauma and that
- 58:03some people did not express grief in the
- 58:06same way but there was a segment of this
- 58:09documentary that left me questioning the
- 58:11intent of this series as a whole
- 58:13Maureen orth works for Vanity Fair and
- 58:16is one of the pundits seen throughout
- 58:18the series and she begins to chastise
- 58:20the American public's way of handling
- 58:22grief whenever these kinds of cases are
- 58:25picked up by the 24-hour news cycle
- 58:27one of the things that was interesting
- 58:30to me as a journalist was what matters
- 58:34are people's feelings and how terrible
- 58:36they feel and if they cry it's so much
- 58:39better
- 58:40it's really just having a national
- 58:43pageant of grief in which everybody can
- 58:46participate and stare at all the grief
- 58:49and the tears and speculate about all
- 58:52the salacious details
- 58:54now we can all agree that the media
- 58:56today has departed from the previous
- 58:58models of Journalism embodied by the
- 59:01greats who are purely interested in
- 59:03reporting the news men and women who
- 59:06went to Great Lengths to remain
- 59:08objective and simply report the news
- 59:10free of their own personal and
- 59:13subjective opinions and we can also
- 59:16agree that the media tends to only focus
- 59:18on missing people who fit a certain
- 59:21profile but that doesn't change the fact
- 59:23that something tragic did happen in the
- 59:26matter of Lacey Peterson and the
- 59:28arguments against the Public's reaction
- 59:30to Lacey's initial disappearance misses
- 59:33the incredible importance of empathy
- 59:36when you really analyze Marine's
- 59:38statement it comes across as one of the
- 59:40most overt displays of gaslighting I
- 59:43have seen in any recent documentary
- 59:45because I've listened to countless
- 59:48interviews by people who volunteered to
- 59:50help search for Lacey and it would be
- 59:52fair to say that a vast major majority
- 59:54of the people who took interest in this
- 59:56case were fueled by their empathy for
- 59:59Lacey for Connor and for the Rocha
- 1:00:02family and believe it or not even for
- 1:00:05Scott the public took interest in this
- 1:00:07case because we could all agree that the
- 1:00:10loss of her life was a pain that no
- 1:00:12family should ever endure it wasn't just
- 1:00:15some pageant of grief people coalesced
- 1:00:18around this case because in some way we
- 1:00:20could all see ourselves in it we could
- 1:00:23see our own daughters sisters and
- 1:00:25mothers and we could all agree that it
- 1:00:27was something that should never happen
- 1:00:30to anyone and when people claim that the
- 1:00:33Public's response was somehow an
- 1:00:35overreaction it completely takes away
- 1:00:37everything we've learned about Scott
- 1:00:40after Lacey's disappearance Scott
- 1:00:42Peterson wasn't merely aloof smiling at
- 1:00:46wildly inappropriate moments because his
- 1:00:48actions speak louder than anything he
- 1:00:51has to say he lacked empathy for someone
- 1:00:55he claimed to love and routinely failed
- 1:00:57to show any sign that he actually cared
- 1:01:00about Lacey being gone within a few
- 1:01:03weeks of Lacey's disappearance he
- 1:01:05contacted a real estate agent to put
- 1:01:07their house on the market long before
- 1:01:09anyone knew that she was deceased he was
- 1:01:12already selling their home with
- 1:01:14everything in it furnished with all of
- 1:01:17Lacey's Furniture additionally Scott
- 1:01:20ordered hardcore adult content that was
- 1:01:23only viewable in their living room just
- 1:01:25days after she went missing really think
- 1:01:28about that for a second he orders an
- 1:01:31extremely explicit adult television
- 1:01:33channel to his living room TV while
- 1:01:36still expecting his nearly full-term
- 1:01:39pregnant wife to come home and oh don't
- 1:01:42forget the fact that he canceled those
- 1:01:43channels on the same day that police
- 1:01:46executed a search warrant at his house
- 1:01:48but wait there's more within a few weeks
- 1:01:52of her disappearance he sold her car why
- 1:01:55would someone who was looking for his
- 1:01:56wife who claims over and over that she
- 1:01:58will come home safe and sound why would
- 1:02:01he sell her only form of transportation
- 1:02:04and it doesn't stop there either he then
- 1:02:07spent months refusing to give her
- 1:02:09parents any of her childhood keepsakes
- 1:02:11and then once Lacey and Connor were
- 1:02:13found he wouldn't give police her dental
- 1:02:16information so that they could verify it
- 1:02:18was her through her dental records
- 1:02:20instead he told police that he couldn't
- 1:02:23remember who her dentist was despite the
- 1:02:25fact that they went to the same dentist
- 1:02:28oh and let's not forget the fact that he
- 1:02:31was having an affair with Amber Frye
- 1:02:33Fray fry we'll call her fry but for the
- 1:02:37record phonetically it's Fray but I
- 1:02:38digress but while Scott was having an
- 1:02:41affair with Amber he also made plans to
- 1:02:43raise her daughter with her even gifting
- 1:02:46her a book to Amber's daughter that had
- 1:02:48originally been gifted to Lacey at her
- 1:02:51baby shower really stop for a second and
- 1:02:54listen to what I just said Scott and
- 1:02:56Lacey Peterson had been gifted a book
- 1:02:58for their son Connor at Lacey's baby
- 1:03:01shower and during a time when Lacey was
- 1:03:04missing and still believed to be alive
- 1:03:06he gives that book for his unborn son to
- 1:03:11his mistress's daughter if he believed
- 1:03:14Lacey was ever coming home why in the
- 1:03:17world would he have done that and don't
- 1:03:19forget that he never participated in a
- 1:03:21single public event to find Lacey he was
- 1:03:24routinely seen taking down pictures that
- 1:03:27featured both him and Lacey and them at
- 1:03:29the volunteer Center and anytime the
- 1:03:31media showed up he would make sure that
- 1:03:34no pictures of him were taken slipping
- 1:03:36out the back door before anyone could
- 1:03:38speak with him so often in missing
- 1:03:41person cases people that have a missing
- 1:03:44loved one cannot buy media attention and
- 1:03:47have to resort to begging for anyone to
- 1:03:49help them to find their loved one those
- 1:03:52people would do absolutely anything to
- 1:03:55have the kind of media attention that
- 1:03:57Scott Peterson had to try and locate
- 1:03:59Lacey and there he is with the media at
- 1:04:02beating his door down trying to help him
- 1:04:05and he wants nothing to do with any of
- 1:04:08it but for me one of the most compelling
- 1:04:11and outright damning elements of Scott
- 1:04:13Peterson's Behavior happened after he
- 1:04:16was convicted for their homicide despite
- 1:04:18his conviction he would go on to sue the
- 1:04:21family of Lacey Peterson because he
- 1:04:23believed he was owed the 250 thousand
- 1:04:26dollars they received from her life
- 1:04:29insurance policy and even when the Court
- 1:04:32ruled against him deciding that the
- 1:04:34money should go to lisi's family he
- 1:04:36didn't leave it there he appealed the
- 1:04:38ruling and continued to fight them for
- 1:04:41the money he would eventually lose the
- 1:04:43appeal but not after forcing Lacey's
- 1:04:46family to defend themselves in court
- 1:04:48Shilling out tens of thousands of
- 1:04:51dollars in legal expenses fighting the
- 1:04:53man who was convicted of their
- 1:04:55daughter's homicide
- 1:04:57and here's the thing I haven't even
- 1:04:59begun to scratch the surface of the
- 1:05:02innumerable times where Scott Peterson
- 1:05:04failed to show any sign of concern or
- 1:05:07empathy for his missing wife so the next
- 1:05:10time a member of Scott's family or one
- 1:05:13of his supporters says that you can't
- 1:05:15know how you would react here's what I
- 1:05:17do know I wouldn't act like Scott
- 1:05:20Peterson did because while his behavior
- 1:05:23is an indisputable proof of guilt it
- 1:05:26does give us clear insight into a man
- 1:05:28who seemed to be largely unconcerned
- 1:05:31about the whereabouts of his pregnant
- 1:05:33wife Lacey
- 1:05:35number eight Scott Peterson was seen by
- 1:05:39several people at the Berkeley Marina
- 1:05:41and people who saw him that day did not
- 1:05:44see a body inside his boat additionally
- 1:05:47his boat was too small and Lacey would
- 1:05:50have been too heavy to push into the
- 1:05:52harbor without capsizing the boat
- 1:05:55initially before I did any research on
- 1:05:57this case this was one of the few
- 1:05:59arguments that I was most concerned
- 1:06:01about because on the surface it would
- 1:06:03seem to be a compelling argument but as
- 1:06:06I scoured the internet I came across the
- 1:06:09crime Piper blog the blog is run by some
- 1:06:12of the most knowledgeable and
- 1:06:13intelligent people on the topic of Scott
- 1:06:16Peterson and what they extrapolated from
- 1:06:18the court record leaves no doubt to the
- 1:06:21validity of this claim they helped fill
- 1:06:24in the blanks when I sought to
- 1:06:25understand whether or not this claim was
- 1:06:28in fact a problem for those who firmly
- 1:06:30believed in Scott Peterson's guilt so
- 1:06:33here are the facts the following is a
- 1:06:35picture sure of Scott Peterson's boat
- 1:06:37taken from a court exhibit and as you
- 1:06:39can see a woman who was roughly the same
- 1:06:41size as Lacey Peterson was able to get
- 1:06:44into the bottom of Scott's boat and
- 1:06:46remain unseen even at a fairly high
- 1:06:49angle in the trial of Scott Peterson it
- 1:06:52was revealed that he had tarps on top of
- 1:06:55his boat at the time that he was hauling
- 1:06:57it to the marina so there is no reason
- 1:06:59to think that anyone looking inside his
- 1:07:01boat would have seen anything other than
- 1:07:04a tarp Also let's really think logically
- 1:07:07about the situation for a moment if you
- 1:07:09had been at the Berkeley Marina that day
- 1:07:11there's no reason to look at Scott
- 1:07:14Peterson then look inside his boat to
- 1:07:17see if there's anything incriminating
- 1:07:18inside of it he was a well-groomed young
- 1:07:21man who many have described as being
- 1:07:24handsome and easy on the eyes so why
- 1:07:26would anyone be looking in his boat to
- 1:07:29ascertain if there was anything inside
- 1:07:31of it that could implicate him in a
- 1:07:33crime before Lacey was even reported
- 1:07:36missing that is completely absurd and it
- 1:07:39assumes that people who saw him that day
- 1:07:41could have had any idea what they were
- 1:07:44even looking at even if they had looked
- 1:07:47inside his boat furthermore do you know
- 1:07:49what else I found in researching his
- 1:07:51case that when Scott Peterson went
- 1:07:53looking to buy a boat despite the fact
- 1:07:55that money was tight and they did not
- 1:07:57have any extra money to waste on a new
- 1:07:59boat that Scott took out most of their
- 1:08:02savings to buy that boat for fourteen
- 1:08:04hundred dollars I also learned that
- 1:08:07Scott was very specifically looking for
- 1:08:09a boat that had a depth finder on it and
- 1:08:11in case you don't know what that is it's
- 1:08:13a device that uses ultrasonic waves to
- 1:08:16determine the depth of fish below you so
- 1:08:18the deeper the fish the further down the
- 1:08:20bottom of the lake is or in this case
- 1:08:23the ocean Scott even looked at larger
- 1:08:25boats but chose not to buy them because
- 1:08:27they lacked the depth finder that he
- 1:08:30wanted and the argument that he would
- 1:08:32have capsized his boat trying to remove
- 1:08:34the remains of Lacey is total nonsense
- 1:08:37Scott told police that very first night
- 1:08:40that he was out sturgeon fishing that
- 1:08:42day well I might not be a professional
- 1:08:44angler but I do know a thing or two
- 1:08:46about fishing and one thing I know is
- 1:08:48certainty is that sturgeon are massive
- 1:08:51fish they can get to be well over 500
- 1:08:54pounds and the average sturgeon is no
- 1:08:57less than 50 pounds I've been on the
- 1:08:59same kind of boat that Scott was on with
- 1:09:01several large men all at the same time
- 1:09:04while fishing and somehow me and tens of
- 1:09:07thousands of others who go out on boats
- 1:09:09every day of the week somehow find a way
- 1:09:12to keep from capsizing in the series
- 1:09:14attorney garigo shows this video that he
- 1:09:17failed to get entered into evidence as
- 1:09:19you can see the man in it struggles to
- 1:09:22simulate the alleged actions of Scott
- 1:09:24Peterson and eventually falls into the
- 1:09:26water but this video was ruled to be
- 1:09:29inadmissible because it shows the man in
- 1:09:31the video with his foot on the side of
- 1:09:33the boat seemingly intentionally trying
- 1:09:36to end up in the water something that an
- 1:09:38angler would never do and again all we
- 1:09:42need to do is think logically about this
- 1:09:44situation no one in their right mind
- 1:09:46wants to end up in the San Francisco Bay
- 1:09:49in the middle of December it has claimed
- 1:09:52countless lives because of how
- 1:09:54notoriously cold those waters are simply
- 1:09:56put Scott Peterson had reason to stay
- 1:09:59out of the water that day and nothing
- 1:10:02about this argument is compelling and
- 1:10:04it's why the jury ultimately disregarded
- 1:10:07it because like so many of the previous
- 1:10:09points this is not proof it's anecdotal
- 1:10:12evidence that wouldn't pass a
- 1:10:15MythBusters test let alone be seen as
- 1:10:17primary evidence in a jury trial and
- 1:10:21here we are having reviewed most of the
- 1:10:23primary arguments in support of his
- 1:10:25innocence and I'll be honest by this
- 1:10:27point in my research I started to get
- 1:10:30really frustrated because so many of
- 1:10:32these claims have been portrayed as
- 1:10:34proof without any further scrutiny and I
- 1:10:37wanted to understand why but before I
- 1:10:40could answer that question I had to know
- 1:10:42was there any evidence that actually
- 1:10:45pointed towards the innocence of Scott
- 1:10:47Peterson
- 1:10:48number nine Scott Peterson was falsely
- 1:10:51accused of making multiple anchors
- 1:10:53despite evidence that proved that he
- 1:10:55disposed of the excess concrete on the
- 1:10:58side of his house to fill a hole in the
- 1:11:01a e docu-series they use this argument
- 1:11:03as one of the many that seems to show
- 1:11:06that police jumped to false conclusions
- 1:11:08and the frenzied media had incorrectly
- 1:11:11judged Scott Peterson throughout the
- 1:11:13series Nancy Grace plays the role of the
- 1:11:16antagonistic villain often shown as one
- 1:11:19of the lone voices in opposition to his
- 1:11:21innocence they go on to show a moment in
- 1:11:24the series that is seemingly meant to
- 1:11:26demonstrate her incorrect bias and that
- 1:11:29even when she was shown evidence that
- 1:11:31disproved her theories that she refused
- 1:11:33to acknowledge her mistake and there
- 1:11:36someone had very clearly poured a bunch
- 1:11:39of cement powder I called Nancy Grace
- 1:11:42over and I said look there's the cement
- 1:11:44she says huh
- 1:11:46walked away never mentioned it on the
- 1:11:49show never went back on the air and said
- 1:11:51oh you know that whole thing I said
- 1:11:53about uh he was lying about the concrete
- 1:11:55turns out I was wrong he really did that
- 1:11:58didn't happen this series isn't just
- 1:12:00been an attempt to exonerate Scott
- 1:12:02Peterson it seemingly also seeks to
- 1:12:04firmly place the idea that the media is
- 1:12:07fully overrun by biased pundits and
- 1:12:10reporters and that Nancy Grace is one of
- 1:12:13the worst among them they even go so far
- 1:12:16as to show her backstory that included
- 1:12:19her telling of how she lost her former
- 1:12:21partner due to a homicide and that her
- 1:12:23overzealous opinions seem to be fueled
- 1:12:26by her blind rage to go after anyone she
- 1:12:29deems a criminal once again I couldn't
- 1:12:32help but notice how if all you had seen
- 1:12:35is this series you would likely walk
- 1:12:37away thinking that Nancy Grace and the
- 1:12:39media were all Bad actors who only cared
- 1:12:42for Ratings clicks and money especially
- 1:12:46after what see appears to be fairly
- 1:12:48damning evidence that not only exposes
- 1:12:51the media but piggybacks on the recent
- 1:12:53wave of disdain for Nancy Grace by the
- 1:12:55general public Scott Peterson had
- 1:12:58purchased 90 pounds of concrete prior to
- 1:13:00his day of non-fishing for sturgeon on
- 1:13:03the Berkeley Marina but allow me to
- 1:13:05repeat that one more time 90 pounds of
- 1:13:08concrete now Scott claimed that he made
- 1:13:11only one single eight pound anchor from
- 1:13:14that 90 pound bag no I have to admit I'm
- 1:13:17not a mathematician but I'm pretty sure
- 1:13:19my calculations are correct and that if
- 1:13:22Scott made an eight-pound anchor that
- 1:13:24would leave carry the two 82 pounds of
- 1:13:27drag concrete But the A E series shows
- 1:13:30this picture
- 1:13:31this picture as being proof that Scott
- 1:13:35had in fact gotten rid of the rest of
- 1:13:37the concrete on the side of his house
- 1:13:38but I have a question does that look
- 1:13:42like 82 pounds of concrete to you
- 1:13:44because I'm going to go ahead and go out
- 1:13:47on a limb and make a fairly bold
- 1:13:49statement despite the fact that I don't
- 1:13:51have a degree in Structural Engineering
- 1:13:53but I mean I did minor in the obvious
- 1:13:56and say that that is absolutely not 82
- 1:14:00pounds of concrete on the side of Scott
- 1:14:02Peterson's house and of course the
- 1:14:04series very conveniently forgets to
- 1:14:06mention that Scott told multiple stories
- 1:14:09about how he used or got rid of the
- 1:14:11concrete initially he told law
- 1:14:13enforcement that he threw the concrete
- 1:14:15away and then he said he didn't know
- 1:14:16what he did with it finally landing on
- 1:14:19dumping the dry concrete into a hole on
- 1:14:21the side of his house the series also
- 1:14:24forgets to mention that law enforcement
- 1:14:26found evidence of concrete inside of
- 1:14:28Scott's boat and his truck the kind of
- 1:14:31Congo great debris that you would expect
- 1:14:33to find if someone had made multiple
- 1:14:35anchors and then placed them in their
- 1:14:37truck and then in Scott's boat
- 1:14:39throughout this series I noticed a
- 1:14:41reoccurring theme as though they wanted
- 1:14:44to ride the wave of the recent media
- 1:14:46distrust placing the idea firmly in the
- 1:14:49minds of us the viewers that maybe we
- 1:14:52are the victims of an intentional
- 1:14:54campaign to manipulate Us by the media
- 1:14:57into seeing something in Scott that
- 1:14:59wasn't there because if the media was
- 1:15:01willing to lie to us about all these
- 1:15:03various aspects of the world around us
- 1:15:06it's not a stretch to think that they
- 1:15:07had misrepresented the truth concerning
- 1:15:10Scott as well but towards the end of my
- 1:15:13research what I found in the next
- 1:15:15segment changed the way that I saw the
- 1:15:17Scott Peterson case for good
- 1:15:20number 10. Scott Peterson's affair with
- 1:15:23Amber Frye caused the general public to
- 1:15:25wrongly jump to conclusions concerning
- 1:15:28his guilt from the very beginning of my
- 1:15:30review of this case I knew that if there
- 1:15:32was any claim that seemed to hold the
- 1:15:34most considerable way it was the
- 1:15:36assertion that Scott Peterson was
- 1:15:38largely viewed as guilty once it was
- 1:15:40revealed that he was having an affair
- 1:15:42with Amber Frye it made sense to me that
- 1:15:45the general public had made assumptions
- 1:15:46about his guilt once she was brought to
- 1:15:49the Forefront and my goal was to try to
- 1:15:51determine if his affair had wrongly
- 1:15:53contributed to his conviction in the a E
- 1:15:56Series as well as others that have been
- 1:15:58created in the last six years attorney
- 1:16:00Mark garagos has played an important
- 1:16:02role in helping to lay the foundation
- 1:16:04for the claims of Peterson's innocence
- 1:16:06and regardless of what anyone may think
- 1:16:08of him he is a masterful criminal
- 1:16:10defense attorney and he best
- 1:16:12demonstrates that skill with what he
- 1:16:14says in this next segment see a
- 1:16:17scoundrel was he a cad yes I get that
- 1:16:19but but if you're going to put into
- 1:16:21prison every married man who has an
- 1:16:24affair while their wife is eight or nine
- 1:16:26months pregnant
- 1:16:28now just for a moment I want to
- 1:16:30deconstruct what he just said because he
- 1:16:32takes something that we all know is
- 1:16:34unacceptable a married man with a
- 1:16:36pregnant wife having an affair and he
- 1:16:39places it against the backdrop of prison
- 1:16:42because surely we can all agree that
- 1:16:44adultery is immoral and we can also all
- 1:16:47agree that we can't just send every man
- 1:16:49who has an affair to prison because in
- 1:16:52that case there would have to be a lot
- 1:16:54more prisons built and only the most
- 1:16:56unreasonable person could possibly think
- 1:16:58something that extreme he essentially
- 1:17:01forces The Listener to agree with him
- 1:17:03and it's one of the many reasons why I
- 1:17:05have such a problem with this kind of
- 1:17:07non-argument because no one has ever
- 1:17:10said that Scott Peterson should go to
- 1:17:12prison because he had an affair that's
- 1:17:15not even remotely at issue in this case
- 1:17:17and attorney garagos knows that but he
- 1:17:20reframes the discussion in a way that
- 1:17:22forces even the most Ardent Defenders of
- 1:17:24Scott's guilt to have to agree with his
- 1:17:26statement it comes off as this
- 1:17:28Christopher nolan-esque form of
- 1:17:31inception because it plants the idea
- 1:17:33that Scott only had an affair and that
- 1:17:35was the motivating reason for why he was
- 1:17:38ultimately convicted simply because the
- 1:17:41American public was angry at him for
- 1:17:43cheating on his pregnant wife but Scott
- 1:17:46Peterson wasn't charged with adultery he
- 1:17:48was charged with the homicide of Lacey
- 1:17:51and Connor Peterson but allow me to
- 1:17:53share with you the most compelling
- 1:17:55evidence that I uncovered in my
- 1:17:57investigation specific to this issue of
- 1:18:00Scott Peterson's Affair I took the time
- 1:18:03to listen to All of the various audio
- 1:18:05recordings of Scott in Amber's
- 1:18:07conversations additionally taking the
- 1:18:09time to study the whole backstory of
- 1:18:12their relationship and I believe that
- 1:18:14it's a story that you need to hear in
- 1:18:16order to understand how critically
- 1:18:18important it is Amber Frye was
- 1:18:22introduced to Scott Peterson by a mutual
- 1:18:24friend Sean Sibley who had just met
- 1:18:26Peterson at a work conference in early
- 1:18:28November of 2002 a short time later
- 1:18:31Scott asked Sean if she had any single
- 1:18:33friends and eventually she gave Amber's
- 1:18:36information to Scott so that they could
- 1:18:37meet up both Sean and Amber believed
- 1:18:40that Scott was a single man because
- 1:18:42that's what he had told them Amber's
- 1:18:45first date was Scott was an all-night
- 1:18:46Affair that went until the following
- 1:18:48morning and had gone exceedingly well
- 1:18:50soon after things began to progress very
- 1:18:53quickly with Scott who met her for
- 1:18:55multiple weekend long dates including
- 1:18:58picking up her 18 month old daughter
- 1:18:59from daycare picking out a Christmas
- 1:19:01tree for her discussing plans to meet
- 1:19:04her parents and ultimately to get
- 1:19:06married and from the beginning Scott was
- 1:19:09adamant with Amber that he did not want
- 1:19:11children something he had even said
- 1:19:13previously to his wife Lacey years
- 1:19:16before and these Infamous pictures taken
- 1:19:19of Scott and Amber at her Christmas
- 1:19:21party happened on the same night that
- 1:19:23Lacey was forced to go alone to her
- 1:19:26Christmas party because Scott had told
- 1:19:28her that he was meeting with his boss
- 1:19:30who had just flown in from Europe
- 1:19:32unexpectedly but of course in actuality
- 1:19:35he spent the night with Amber at her
- 1:19:37boss's company party leaving his nearly
- 1:19:39full-term pregnant wife by herself
- 1:19:42but what happened on December 8 2002
- 1:19:45changed the way that I saw this case
- 1:19:47forever Amber's friend Sean had heard
- 1:19:50from an acquaintance that Scott Peterson
- 1:19:52was actually married so she called Scott
- 1:19:55and angrily confronted him she told
- 1:19:57Scott that she was going to call Amber
- 1:19:59and tell her the truth about him but
- 1:20:01Scott pleaded begged with her not to do
- 1:20:04that instead he negotiated that he would
- 1:20:07call Amber and tell her the truth
- 1:20:09himself and sure enough Scott Peterson
- 1:20:11calls Amber and tells her that he has
- 1:20:13something very important that he needs
- 1:20:15to talk to her about and the following
- 1:20:17day he comes to her house and he was
- 1:20:19nearly inconsolable Amber recounts the
- 1:20:22story by saying that he was hysterically
- 1:20:24crying talking about how he hadn't told
- 1:20:27her the whole truth that in fact he had
- 1:20:29been married but that he had lost his
- 1:20:31wife and that this would be the first
- 1:20:33Christmas without her weeks before Lacey
- 1:20:36Peterson would actually go missing Scott
- 1:20:39was claiming that she was already gone
- 1:20:42and that's the story that most of us
- 1:20:44familiar with this case have already
- 1:20:47heard but were you aware that on the
- 1:20:49same day that Amber's friend Sean had
- 1:20:52called Scott demanding that he tell
- 1:20:53Amber the truth that his computer logged
- 1:20:56something rather curious the very same
- 1:20:59day that Sean called Scott to confront
- 1:21:01him threatening to end his relationship
- 1:21:03with his new girlfriend Scott Peterson
- 1:21:06searches the weather conditions at the
- 1:21:08Berkeley Marina
- 1:21:10specifically the title patterns in the
- 1:21:13harbor where Lacey and Connor were
- 1:21:15eventually found when I read that for
- 1:21:18the first time I stopped what I was
- 1:21:19doing and tried to find any reasonable
- 1:21:22explanation for why Scott would do that
- 1:21:25and then it just became obvious
- 1:21:27Scott was being threatened with losing
- 1:21:29Amber if he doesn't tell her the truth
- 1:21:31about being married and that same day he
- 1:21:34starts looking at the title patterns for
- 1:21:36the exact same area where Lacey and
- 1:21:39cotter would be found If This Were A
- 1:21:41Hollywood movie it would get horrendous
- 1:21:43critic reviews for being entirely too
- 1:21:46predictable because this is the literal
- 1:21:48age-old definition of motive in just
- 1:21:52hours after the confrontation was shown
- 1:21:54he goes to Amber Fry's house and puts on
- 1:21:57an act where he is able to excessively
- 1:21:59cry on command saying that he lost his
- 1:22:02wife a wife who is still very much alive
- 1:22:05and I've thought a lot about this part
- 1:22:07of his case the fact that Scott is able
- 1:22:10to manipulate and lie to Amber virtually
- 1:22:12on command but more specifically the
- 1:22:14issue of how upset he was and how he was
- 1:22:17unable to stop crying as he makes a
- 1:22:20wildly false declaration in numerous
- 1:22:23interviews Amber discusses how
- 1:22:25inconsolable he was but the ability to
- 1:22:27manufacture emotion over something that
- 1:22:30wasn't even true is precisely why his
- 1:22:33affair was so problematic not because of
- 1:22:36the salacious details but because of
- 1:22:38what it said about Scott's character but
- 1:22:41in all of the various docu-series that
- 1:22:43have been made defending Scott they all
- 1:22:45portrayed this affair as being nothing
- 1:22:47more than tabloid gossip that
- 1:22:49incorrectly prejudiced the world against
- 1:22:51Scott but that simply isn't true the
- 1:22:55problem that the world had with Scott
- 1:22:56was his actions or the lack thereof and
- 1:23:00how those actions directly correlated to
- 1:23:03a man's behavior who continually
- 1:23:05demonstrated a lack of empathy for any
- 1:23:08of the people he claimed to love but
- 1:23:11there are dozens of hours of
- 1:23:12conversations between Amber and Scott
- 1:23:14that completely contradict that claim
- 1:23:17but after watching all six episodes of
- 1:23:20the a E Series I noticed that it was
- 1:23:22filled to the brim with these kinds of
- 1:23:24ridiculous arguments everything that
- 1:23:27points to Scott's guilt is somehow
- 1:23:29incorrect or a rush to judgment
- 1:23:31propagated by the media and every
- 1:23:34possible thing that could even remotely
- 1:23:35make Scott look favorable is used as
- 1:23:38evidence that he is in fact innocent
- 1:23:40apparently we are expected to ignore all
- 1:23:43of the things that point to his guilt
- 1:23:45and only pay attention or give Credence
- 1:23:48to the things that demonstrates his
- 1:23:50innocence but they can't have it both
- 1:23:52ways especially when the evidence
- 1:23:54consistently and continually disproves
- 1:23:57every aspect of their claims and here we
- 1:24:00are well over an hour into this video
- 1:24:03and I haven't even started telling you
- 1:24:05any of the prosecutions case yet but if
- 1:24:08you're still unconvinced in either
- 1:24:10direction don't worry because I'm not
- 1:24:12even close to being done yet number 11
- 1:24:15police fail to follow up on credible
- 1:24:18leads or investigate the strikingly
- 1:24:20similar case of Evelyn Hernandez
- 1:24:24in the a E Series former defense
- 1:24:26attorney Matt Dalton gives one of the
- 1:24:28most impassioned arguments in favor of
- 1:24:30Scott's innocence he tells us about a
- 1:24:32similar crime that was committed just a
- 1:24:34few months before The Disappearance of
- 1:24:36Lacey a young pregnant woman named
- 1:24:38Evelyn Hernandez was eventually found
- 1:24:41deceased on the shores of the San
- 1:24:42Francisco Bay area in close proximity to
- 1:24:45where Lacey and Connor would later be
- 1:24:47found and Evelyn's remains would be
- 1:24:50found in a very similar condition as
- 1:24:52that of Lacey's and this information
- 1:24:55leaves the implication that someone in
- 1:24:57this same area could have been
- 1:24:59responsible for the death of Lacey and
- 1:25:01that police failed to properly
- 1:25:03investigate a crime that had many of the
- 1:25:05same Hallmarks of criminality attorney
- 1:25:08Dalton makes the claim and we are left
- 1:25:10with the inference that so many aspects
- 1:25:12of this case weren't properly explored
- 1:25:15that maybe someone else had something to
- 1:25:17do with Lacey's crime because we find
- 1:25:19out that Evelyn's homicide is still a
- 1:25:21cold case and that it has never ever
- 1:25:24been solved and if you lived on an
- 1:25:26island where only the a e channel was
- 1:25:29available then it would be entirely
- 1:25:31understandable why you could see this
- 1:25:33segment and feel that it was compelling
- 1:25:35in fact when attorney Dalton begins to
- 1:25:38explain the similarity of Evelyn's case
- 1:25:40to Lacy's it's one of those moments that
- 1:25:42leaves you thinking wow someone else may
- 1:25:45have committed this crime I remember the
- 1:25:48first time I saw that segment thinking
- 1:25:50exactly that and being shocked that I
- 1:25:53hadn't heard anything about this case
- 1:25:55until over a decade after Scott's
- 1:25:57conviction and I contend that is why a
- 1:26:00vast majority of people who believe that
- 1:26:02Scott may be innocent believe it because
- 1:26:05they only hear surface level information
- 1:26:07provided to them by the series and never
- 1:26:10really go beyond that but I did in
- 1:26:13reading the news articles about Evelyn
- 1:26:15Hernandez I sat there shaking my head in
- 1:26:18complete disbelief Evelyn Hernandez was
- 1:26:21the Mistress of Hermann Aguilera a
- 1:26:24married man just like Scott Peterson in
- 1:26:27the investigation police determined that
- 1:26:29Evelyn had recently broken up with
- 1:26:31Hermann Aguilera and that she was
- 1:26:33pregnant with his baby a baby that he
- 1:26:36would have been financially responsible
- 1:26:37for while being married to a different
- 1:26:40woman entirely it's been reported that
- 1:26:43he wanted to maintain control over
- 1:26:45Evelyn's life that he wanted to keep
- 1:26:48access to her home and ultimately it was
- 1:26:51believed that he wasn't happy about her
- 1:26:53choice to end the relationship and the
- 1:26:56tragic part of her case is no one seemed
- 1:26:58to care that she went missing she didn't
- 1:27:00get the same news coverage and sadly it
- 1:27:03wasn't just her and her unborn child
- 1:27:04that lost their lives she had a son who
- 1:27:07has never been found since her initial
- 1:27:10disappearance sadly Evelyn's case was
- 1:27:13never solved and she deserves justice
- 1:27:16but she does not deserve to be used as a
- 1:27:18pawn to try and infer her guilt on
- 1:27:21someone other than Scott Peterson and
- 1:27:24after reviewing the entire case file
- 1:27:26that I could get my hands on I saw
- 1:27:28considerable evidence that supports that
- 1:27:30law enforcement did run down hundreds of
- 1:27:33thousands of leads and that they
- 1:27:35investigated everyone close to Lacey as
- 1:27:38well as people in the neighborhood and
- 1:27:39that they clearly determined that no one
- 1:27:42else had reason motive and opportunity
- 1:27:45to harm Lacey Peterson and that's
- 1:27:48precisely why Scott Peterson paid
- 1:27:50attorney Mark garagos 1 million dollars
- 1:27:53to defend his life in a jury trial
- 1:27:55because the evidence that supported his
- 1:27:57motive and opportunity was compelling
- 1:28:00and this series doesn't seem to want to
- 1:28:03address the fact that attorney garagos
- 1:28:04failed to provide any reasonable suspect
- 1:28:07to the jury other than his client that
- 1:28:10could have had motive and opportunity to
- 1:28:12harm Lacey Peterson and after going
- 1:28:15through each of these claims one by one
- 1:28:17reviewing all of their key arguments
- 1:28:20without having found any compelling
- 1:28:22evidence pointing to his innocence I
- 1:28:24purposefully saved their biggest
- 1:28:25argument for last and it is one of the
- 1:28:29most ominous claims that the Defenders
- 1:28:31of Scott Peterson have made from the
- 1:28:34very beginning
- 1:28:36number 12 despite the total lack of
- 1:28:39forensic and biological evidence the
- 1:28:42media still tried and convicted Scott
- 1:28:45Peterson this is the single most
- 1:28:47explosive claim made throughout every
- 1:28:50iteration of any docu-series made in
- 1:28:53favor of Scott's innocence it is
- 1:28:55repeated time and time again at
- 1:28:58virtually every opportunity and by the
- 1:29:00time you've watched every episode of the
- 1:29:02series it seems that they have made a
- 1:29:04compelling case that Scott Peterson was
- 1:29:06found guilty by virtue of the negative
- 1:29:09media attention long before he ever set
- 1:29:12foot in court over and over we are told
- 1:29:15that no forensic or biological evidence
- 1:29:17has ever existed in this case and again
- 1:29:20we are faced with arguments that seem
- 1:29:23truly persuasive and convincing and for
- 1:29:25me it preys on my inherent desire to be
- 1:29:29empathetic to all people because it
- 1:29:31presents the idea that maybe members of
- 1:29:34the public did jump to conclusions and
- 1:29:36that maybe there isn't evidence Beyond a
- 1:29:39man who was morally bankrupt but who
- 1:29:41didn't actually commit these unspeakable
- 1:29:43acts we are bombarded with the idea that
- 1:29:46we need to question what we believe
- 1:29:48which is actually an important part of
- 1:29:50being a human to never be unwilling to
- 1:29:53analyze our positions to be able to
- 1:29:56admit when we are wrong which are all
- 1:29:58inherently good things and in various
- 1:30:01moments of the series I was willing to
- 1:30:03admit that I was wrong and that I had
- 1:30:06seen proof of Scott's unfair conviction
- 1:30:07by the media and that there may have
- 1:30:10been Reasonable Doubt in his case that
- 1:30:13was until attorney Chris Pixley said
- 1:30:15these words
- 1:30:16piece of Lacey's hair on a pair of
- 1:30:19pliers that were rusted shut and I would
- 1:30:21hope that his wife's hair is at his
- 1:30:22workplace I would hope that he had his
- 1:30:24wife hair on some of his clothes now if
- 1:30:26it isn't clear by now I am completely
- 1:30:29disgusted with this series and all
- 1:30:31others like it because every single time
- 1:30:33I look at any of their claims under a
- 1:30:36microscope I find that they have either
- 1:30:37left things out misconstrued the facts
- 1:30:40or seem to be intentionally
- 1:30:42misrepresenting details that are always
- 1:30:44slanted towards defending Scott Peterson
- 1:30:46no matter how bad the facts look someone
- 1:30:49from his defense team always seems to
- 1:30:52have an excuse and let me explain why I
- 1:30:55feel the way that I do about this issue
- 1:30:57specifically because those pliers were
- 1:31:00found inside of Scott Peterson's boat
- 1:31:03the same boat that is believed to have
- 1:31:05carried the remains of Lacey Peterson
- 1:31:07and the hair isn't on the pliers it's in
- 1:31:11those closed pliers a very important
- 1:31:14distinction and he also claims that they
- 1:31:17are rusted shut now I've owned a lot of
- 1:31:19pliers in my day and those are clearly
- 1:31:22not rusted shut and do you know what's
- 1:31:24comical about all of this didn't they
- 1:31:27say over and over that there was no
- 1:31:29forensic or biological evidence found in
- 1:31:32the Scott Peterson case
- 1:31:34well then I have a question what is hair
- 1:31:36didn't they find that the hair in those
- 1:31:39pliers came from a human body and then
- 1:31:42doesn't that hair need to be tested to
- 1:31:44verify its origin and what's that
- 1:31:46process called whenever they send
- 1:31:48something involved in a crime for
- 1:31:50testing oh right forensics so literally
- 1:31:54every single time that we've been told
- 1:31:56that there's no forensic or biological
- 1:31:58evidence ever found in this case it is a
- 1:32:01complete and total fabrication there was
- 1:32:03no biological evidence no forensic
- 1:32:06evidence whatsoever furthermore law
- 1:32:08enforcement found Scott Peterson's fresh
- 1:32:11blood on their bed and I'm pretty sure
- 1:32:14don't quote me but I'm pretty sure Blood
- 1:32:16also counts as forensic evidence and all
- 1:32:20of this information was presented at the
- 1:32:22trial of Scott Peterson to the jury now
- 1:32:26over the years many of Scott Peterson's
- 1:32:28Defenders have talked about the hair
- 1:32:30having mitochondrial DNA that was linked
- 1:32:33to Sharon the mother of Lacey Peterson
- 1:32:36but you'll probably notice that attorney
- 1:32:39Chris Pixley a man who is in every Scott
- 1:32:41Peterson documentary vehemently
- 1:32:43defending him doesn't even make that
- 1:32:46distinction because it's accepted that
- 1:32:48it was Lacey's hair so one of the most
- 1:32:51commonly repeated phrases in defense of
- 1:32:53Scott Peterson is patently untrue and
- 1:32:56while these certainly aren't all of the
- 1:32:58claims that were made in the docu-series
- 1:33:00there remains only one other statement
- 1:33:02that requires our review and this claim
- 1:33:05was saved for last on purpose the
- 1:33:08evidence that Scott Peterson was
- 1:33:10convicted in the eyes of the media is
- 1:33:12portrayed in the multitude of examples
- 1:33:13presented to us in the series but I
- 1:33:16noticed we never hear about the numerous
- 1:33:18times that defense attorney garagos used
- 1:33:21that same media to spread his own
- 1:33:23narratives about the case in one hand
- 1:33:25they condemn the media and in the other
- 1:33:27they use it to their advantage in
- 1:33:30virtually every example that they use
- 1:33:32showing that the media is crucifying
- 1:33:35Scott it is also accompanied by a
- 1:33:37defense attorney like Mark garagos and
- 1:33:40Chris Pixley who would loudly defend
- 1:33:42Scott at every possible opportunity in
- 1:33:45fact it's precisely because of the fact
- 1:33:47that attorney garagos was seen in the
- 1:33:49media so often directly defending Scott
- 1:33:52on so many various occasions that his
- 1:33:55family would eventually go on to hire
- 1:33:57him to represent Scott Attorney garagos
- 1:34:01isn't afraid to use the media that he
- 1:34:03condemns as the cause of convicting
- 1:34:05Scott Peterson and then utilized the
- 1:34:08same tactics to try and exonerate him
- 1:34:11but as I watched the series I began to
- 1:34:13notice something very odd something that
- 1:34:16seemed out of place do you remember this
- 1:34:19man attorney Matt Dalton because he's
- 1:34:21the man in the series that is one of the
- 1:34:23most passionate Defenders of Scott
- 1:34:25Peterson virtually every time he's on
- 1:34:27camera he can be heard practically
- 1:34:29scoffing that anyone could possibly
- 1:34:32believe that Scott was guilty
- 1:34:34but do you ever notice that we're never
- 1:34:36really told who he is at the very
- 1:34:39beginning of the documentary he claims
- 1:34:41that the police looked in the wrong home
- 1:34:42for evidence of Lacey's homicide and in
- 1:34:45fact it was the house across the street
- 1:34:47that they should have been canvassing
- 1:34:48and never mind the fact that no actual
- 1:34:51evidence is ever provided that links
- 1:34:53that burglary to Lacey's homicide but
- 1:34:56its attorney Dalton's relationship to
- 1:34:58this case that is something that I find
- 1:35:00very peculiar when viewed with this next
- 1:35:02segment of attorney garagos's interview
- 1:35:05Scott Peterson's legal team is trying to
- 1:35:08shift blame to some murky satanic cult I
- 1:35:11had an associate who was working on the
- 1:35:12case and he became convinced of this
- 1:35:14theory he started running with it and
- 1:35:16then the tabloids and cable news shows
- 1:35:19went crazy with it you may notice that
- 1:35:21attorney garigo seems to want to
- 1:35:23distance himself from the satanic cult
- 1:35:25Theory which is kind of strange
- 1:35:27considering the fact that he used the
- 1:35:29theory in his opening statement at
- 1:35:32Scott's trial and then never once
- 1:35:34brought any direct evidence to support
- 1:35:36that totally wild and unfounded Theory a
- 1:35:40theory that claimed that Satanist had
- 1:35:43abducted Lacey as part of some Satanic
- 1:35:45ritual a claim that has aged like milk
- 1:35:48and what I find so interesting about
- 1:35:51this whole segment is when Mark garagos
- 1:35:53refers to the person who peddled this
- 1:35:55wild Theory as an associate of his Law
- 1:35:58Firm we find out later that this
- 1:36:00associate is someone he hired to help
- 1:36:03him represent Scott Peterson and this
- 1:36:05unnamed associate apparently ran with
- 1:36:08this crazy Theory which then caused the
- 1:36:11media in tabloid frenzy but I thought it
- 1:36:13was very odd that he never names that
- 1:36:16attorney because he's talking about
- 1:36:18attorney Matt Dalton the same person who
- 1:36:21defends the theory mere moments later
- 1:36:23despite it being characterized as
- 1:36:25tabloid nonsense which it was so I
- 1:36:29started to dig a little deeper and what
- 1:36:31I found was nothing short of
- 1:36:33unbelievable attorney Matt Dalton was
- 1:36:36fired by Mark aragos and his firing came
- 1:36:39shortly after Dalton ignored a
- 1:36:42court-imposed gag order and went ahead
- 1:36:44and spoke with Modesto Area journalist
- 1:36:46despite the court mandating that he not
- 1:36:49speak with the media later when attorney
- 1:36:52Dalton wrote a book about the Scott
- 1:36:54Peterson case Mark garigo sued him to
- 1:36:57try and stop him from publishing
- 1:36:59anything about his former client
- 1:37:01unfortunately garagos's lawsuit failed
- 1:37:04and Dalton was allowed to publish his
- 1:37:06book but in Dalton's book he claims that
- 1:37:09he was fired because he tried to take
- 1:37:11the Peterson's case away from garagos
- 1:37:13and deliver it to a different Law Firm
- 1:37:16altogether and that was why he was
- 1:37:18eventually fired but what's clear about
- 1:37:20this entire interaction is both men are
- 1:37:24doing their level best to hide the fact
- 1:37:26that they have both faced off in court
- 1:37:28as adversaries in that Mark garago sued
- 1:37:31him for what he claimed was unethical
- 1:37:34behavior on the part of attorney Matt
- 1:37:36Dalton and all of this matters because
- 1:37:39it demonstrates how these passionate
- 1:37:41Defenders of Scott Peterson utilize
- 1:37:44information to convey a story that they
- 1:37:47are trying to convince you of they
- 1:37:49seemingly pick and choose which
- 1:37:51narrative suits them best and omit any
- 1:37:54details that could possibly negatively
- 1:37:56impact their version of events they
- 1:37:59carefully construct a convincing story
- 1:38:01that preys on your views knowing full
- 1:38:03well that they are leaving out in
- 1:38:05information that reflects poorly on the
- 1:38:08entirety of their arguments and it
- 1:38:11leaves me wanting to ask a very simple
- 1:38:13question isn't that exactly what they
- 1:38:17are accusing the media of doing and
- 1:38:20after all this time I realized that I
- 1:38:22wasn't able to corroborate a single
- 1:38:25claim that has been made by the
- 1:38:26supporters of Scott Peterson I have not
- 1:38:29found any evidence that leans in his
- 1:38:31favor and you may be asking yourself why
- 1:38:34does it even matter when so many people
- 1:38:37were already convinced that Peterson was
- 1:38:39guilty I asked myself the question why
- 1:38:42go through this just to prove something
- 1:38:44that so many people already believe I
- 1:38:47promise you that by the time I end this
- 1:38:50video I will answer that question in a
- 1:38:52way that I believe will prove why this
- 1:38:55presentation this way was and is so
- 1:38:59important however before I do I am going
- 1:39:03to present in the most concise way that
- 1:39:05I I can the prosecution's case against
- 1:39:08Scott Peterson
- 1:39:09the people versus Scott Peterson the
- 1:39:13jury trial of Scott Peterson took nearly
- 1:39:15six months and despite the overwhelming
- 1:39:17media coverage the court did not allow
- 1:39:20cameras or recording devices this
- 1:39:22presented something of a unique
- 1:39:24challenge for my team but over the last
- 1:39:26four weeks we reviewed hundreds of hours
- 1:39:28of trial transcripts evidence court
- 1:39:30records and anything else related to the
- 1:39:33proceeding that we could find and what
- 1:39:35we learned was that the prosecution
- 1:39:37brought a compelling case against Scott
- 1:39:39Peterson in total the state brought
- 1:39:43174 witnesses to testify during their
- 1:39:46presentation of their case against
- 1:39:48Peterson and despite the many claims of
- 1:39:50Scott's innocence by attorney garagos he
- 1:39:53would only call 14 witnesses to the
- 1:39:55stand and a vast majority of those
- 1:39:58Witnesses had already been called
- 1:40:00previously by the state these are the
- 1:40:03primary arguments and points brought
- 1:40:05against Scott Peterson by the
- 1:40:07prosecution during his trial this list
- 1:40:09does does not include all of the
- 1:40:12previously mentioned points of evidence
- 1:40:13already discussed in this episode which
- 1:40:16are considerable the prosecution's case
- 1:40:19was as follows Scott Peterson was
- 1:40:22believed to have committed the homicide
- 1:40:24of Lacey Peterson sometime between the
- 1:40:26evening of December 23rd and the morning
- 1:40:29of December 24th 2002.
- 1:40:32Peterson was the last person to see
- 1:40:34Lacey alive he was believed to have
- 1:40:36committed the crime in a way that would
- 1:40:38have left little to no biological
- 1:40:40evidence and that he would have had
- 1:40:42ample time to clean up afterward the
- 1:40:45Petersons had just had their home
- 1:40:47cleaned by a maid service who had just
- 1:40:50mopped the floors the day before so the
- 1:40:53presence of a mop and bucket at the
- 1:40:55crime scene was thought to be out of
- 1:40:57place considering the house had just
- 1:40:59been cleaned Scott Peterson went on a
- 1:41:02planned trip to the Berkeley Marina over
- 1:41:0490 minutes away on Christmas Eve when he
- 1:41:08was supposed to be back in the area to
- 1:41:10pick up a gift basket before 3 30 pm he
- 1:41:13didn't leave his home until after 10 AM
- 1:41:16Scott Peterson was fishing in the same
- 1:41:20area where Lacey and Connor would
- 1:41:22eventually be found and on the morning
- 1:41:24of Christmas Eve Susan Medina the
- 1:41:27Peterson's neighbor saw Scott loading
- 1:41:29something large wrapped in a blue tarp
- 1:41:31into his vehicle at 9 55 am just before
- 1:41:36he left for the Berkeley Marina when
- 1:41:38Scott returned home from his fishing
- 1:41:40trip that day he noticed that Lacey's
- 1:41:41car was still in the carport he walked
- 1:41:44inside and saw that she was not home he
- 1:41:46then proceeded to put his clothing in
- 1:41:48the laundry took a shower and waits over
- 1:41:5130 minutes before he calls Lacey's
- 1:41:53mother to notify her that she's missing
- 1:41:56even after Scott verifies that she's not
- 1:41:59at the neighbor's house or anywhere else
- 1:42:01he never once attempts to contact police
- 1:42:03or notify them of her disappearance and
- 1:42:07more importantly Scott never tried to
- 1:42:09call Lacey after he arrived home because
- 1:42:12it's believed that he already knew that
- 1:42:15she was deceased after the family's
- 1:42:17initial search for Lacey in the park
- 1:42:19Scott told Lacey's mother Sharon you
- 1:42:22know if they find blood anywhere that
- 1:42:25doesn't mean anything I'm a sportsman
- 1:42:27just look at my hands I could drop blood
- 1:42:30anywhere law enforcement would lay later
- 1:42:32noticed that evening that Scott Peterson
- 1:42:34had a cut on his hand which seemed fresh
- 1:42:37and recent Scott was seen vacuuming and
- 1:42:41re-vacuuming the laundry room of his
- 1:42:43house on Christmas morning by Lacey's
- 1:42:45friends Stacy and Lori law enforcement
- 1:42:48believed that Scott Peterson used the
- 1:42:50several days that he had before they
- 1:42:52conducted their search to clean up the
- 1:42:54crime scene on January 5th 6th and 9th
- 1:42:58Scott Peterson returned to the Berkeley
- 1:43:00Marina and watched law enforcement as
- 1:43:03their dive teams attempted to find the
- 1:43:05remains of Lacey Peterson Peterson would
- 1:43:08go on to rent several different vehicles
- 1:43:10to revisit the marina believed to be an
- 1:43:13attempt to hide his tracks while he
- 1:43:15monitored law enforcement's efforts to
- 1:43:17find Lacey Days Later Scott would tell
- 1:43:20detective Grogan without being asked
- 1:43:22that they may find Scott's blood in his
- 1:43:24truck because he cut himself all the
- 1:43:27time and bled on the door of his truck
- 1:43:29statements that were entirely on
- 1:43:32unprompted by anyone Scott Peterson lied
- 1:43:35to several people on the day that Lacey
- 1:43:38went missing saying that he was out
- 1:43:40golfing that day something that was
- 1:43:42proven to be a lie the shoes that Scott
- 1:43:45said Lacey wore on her walks were found
- 1:43:48in their home
- 1:43:49eventually when Scott was confronted
- 1:43:51with a picture of him and Amber at the
- 1:43:53Christmas party by law enforcement he
- 1:43:56looked at it and said is that supposed
- 1:43:58to be me Peterson claimed to have only
- 1:44:01one debit card when in fact he had two
- 1:44:04the other PayPal debit card was shown to
- 1:44:07have been used to purchase various items
- 1:44:09and gifts for his Mistresses Scott
- 1:44:12referred to Lacey in the past tense in
- 1:44:15several of his conversations with law
- 1:44:16enforcement and eventually the media
- 1:44:19including asking about cadaver dogs
- 1:44:21within the first 24 hours after Lacey's
- 1:44:25initial disappearance
- 1:44:26after Scott's initial conversation with
- 1:44:29law enforcement he would never call them
- 1:44:31again to inquire the status of their
- 1:44:33investigation into finding Lacey during
- 1:44:37law enforcement's investigation a
- 1:44:39cadaver dog hit on Scott's boat and the
- 1:44:41boat trailer as well as back at the
- 1:44:43Peterson home following a trail out to
- 1:44:46the middle of the street which indicated
- 1:44:48that Lacey left inside of a vehicle on
- 1:44:52the day of his arrest Scott claims that
- 1:44:53he was running from the media trying to
- 1:44:56avoid their incessant efforts to tail
- 1:44:58him we now know that law enforcement was
- 1:45:01in fact tailing him that day and while
- 1:45:03he was being pursued Scott would get out
- 1:45:05of his vehicle and yell why don't you
- 1:45:08just arrest me already later that day
- 1:45:11Scott would be arrested by law
- 1:45:12enforcement as he continued to drive
- 1:45:14erratically which law enforcement
- 1:45:16believed was his attempts to shake their
- 1:45:18tail and flee the country
- 1:45:20in his vehicle law enforcement found the
- 1:45:23following survival gear a tent a shovel
- 1:45:27a gun a knife Viagra sleeping pills
- 1:45:32various camping gear over ten thousand
- 1:45:35dollars in cash including Mexican pesos
- 1:45:37four cell phones and his brother's ID
- 1:45:40police also believe that his family had
- 1:45:43made efforts to help Scott flee the
- 1:45:45country after Scott's mother had given
- 1:45:48him ten thousand dollars shortly after
- 1:45:51Lacey and Connor were found but it
- 1:45:53wasn't until recently that it was
- 1:45:55revealed that Scott Peterson had also
- 1:45:58been found with a map of Amber Fry's
- 1:46:00Workplace Law Enforcement believed at
- 1:46:03the time that Scott had planned to end
- 1:46:05the life of Amber fry because she would
- 1:46:07pose a considerable problem for him if
- 1:46:10and when his case went to trial during
- 1:46:13the trial of Scott Peterson it was
- 1:46:15revealed that he had multiple Affairs
- 1:46:18during the five months that he dated
- 1:46:19Janet ilsee she walked in on him and
- 1:46:22Lacey in bed together Janet would admit
- 1:46:25that she had no idea that Scott was
- 1:46:28already married and that he had
- 1:46:30indicated to her that he wanted to meet
- 1:46:32her family and when he dated Amber he
- 1:46:35lied to her saying that he had a degree
- 1:46:37in Divinity even buying a fake degree to
- 1:46:40fit his lie and all of these
- 1:46:43interactions with each of these
- 1:46:44girlfriends occurred while Scott
- 1:46:46Peterson was married to his wife Lacey
- 1:46:49Peterson these details don't even come
- 1:46:53close to encapsulating all of the
- 1:46:55evidence testimony cross-examination and
- 1:46:58detailed accounts that happened over the
- 1:47:00course of a nearly six month long jury
- 1:47:03trial but it does give a more complete
- 1:47:05view of the case against Scott Peterson
- 1:47:08by the time attorney Mark garagos was
- 1:47:10given the opportunity to tell his side
- 1:47:13of the story his entire case was largely
- 1:47:15seen as incomplete and unproductive his
- 1:47:19closing remarks were seen as so so
- 1:47:21ineffectual that it made national news
- 1:47:24and it wasn't simply due to the fact
- 1:47:26that he was having a bad day attorney
- 1:47:28garagos was trying to polish a literal
- 1:47:31turd of a case devoid of Reasonable
- 1:47:34Doubt despite his client's efforts to
- 1:47:36obscure the evidence of his criminality
- 1:47:39even the most prepared experienced and
- 1:47:42knowledgeable legal Minds would have
- 1:47:44been hard-pressed to effectuate a
- 1:47:46different outcome and the jury would
- 1:47:48explain why members of the jury were
- 1:47:51later asked why they found Scott
- 1:47:53Peterson guilty of the homicide of Lacey
- 1:47:55and Connor Peterson and to them it was
- 1:47:58simple Scott had been fishing in the
- 1:48:01same vicinity of where Lacey and Connor
- 1:48:03were later found upon arriving home he
- 1:48:06immediately washed himself and his
- 1:48:08clothes before calling anyone let alone
- 1:48:11his wife Scott Peterson was the last
- 1:48:14person to see Lacey alive and finally
- 1:48:17Scott Peterson had the means motive and
- 1:48:20upper opportunity to commit the crime in
- 1:48:23a way that no one else did but now we
- 1:48:27have finally arrived at why I spent over
- 1:48:29a month working on this case and my hope
- 1:48:32is that it will explain exactly why I
- 1:48:35took the time to get to this point
- 1:48:38the high price of misinformation
- 1:48:41over the last decade there has been a
- 1:48:44massive shift in the way that criminal
- 1:48:46defendants have arbitrated their
- 1:48:48convictions for most of the last century
- 1:48:51if someone was wrongfully convicted of a
- 1:48:53crime they would have to rely on the
- 1:48:55Appellate process to petition a higher
- 1:48:57Court to review the facts of their case
- 1:48:59and request a new trial in extraordinary
- 1:49:03occasions the Appellate Court may have
- 1:49:05their conviction vacated or set aside
- 1:49:08effectively absolving them of their
- 1:49:11incarceration but this is exceedingly
- 1:49:14rare in the criminal justice system
- 1:49:16successfully appealing a conviction has
- 1:49:19become increasingly more and more
- 1:49:21expensive complicated and often requires
- 1:49:25many years before any significant action
- 1:49:27is taken if at all and as a consequence
- 1:49:31of the slow-moving wheels of Justice we
- 1:49:33have begun to see a considerable effort
- 1:49:36by the convicted to try their cases in
- 1:49:39the court of public opinion these new
- 1:49:41methods are seen as an incredibly
- 1:49:44powerful tool to bring attention to
- 1:49:46cases that have languished in the court
- 1:49:48system cases that involve men and women
- 1:49:51who have endured wrongful convictions
- 1:49:53and that for a variety of reasons can
- 1:49:56only find Justice by means of advocacy
- 1:49:58through social media celebrity attention
- 1:50:01or pardons from Governors and or
- 1:50:04presidents this is best demonstrated in
- 1:50:07the case of Adnan Syed regardless of
- 1:50:10where you land on the guilt or innocence
- 1:50:12of his case a compelling argument can be
- 1:50:15made that it is because of the attention
- 1:50:17by the media and the serial podcast that
- 1:50:20ultimately led to him being a free man
- 1:50:24we can all agree that people who are
- 1:50:27truly innocent who have been unfairly
- 1:50:29convicted deserve their freedom however
- 1:50:32over the last 10 years as social media
- 1:50:35has become an integral part of society
- 1:50:37the use of those platforms has been
- 1:50:39weaponized by criminal defendants to
- 1:50:42reframe their own stories and the
- 1:50:45success of those efforts has started to
- 1:50:47gain the attention of those who were
- 1:50:49previously believed to be guilty Beyond
- 1:50:51any reasonable doubt and now the
- 1:50:54supporters of those defendants utilize
- 1:50:56various forms of social media that helps
- 1:50:59to drastically change The Narrative of
- 1:51:01their guilt previously held by the
- 1:51:04general public simply by dropping small
- 1:51:06and persistent seeds of Doubt eventually
- 1:51:09those seeds take root and if they
- 1:51:12succeed in maturing and growing to
- 1:51:14fruition their Grassroots efforts may
- 1:51:16eventually convince someone with the
- 1:51:19means and connection to create one of
- 1:51:21the most effective tools that can change
- 1:51:23the the minds of millions a tool that
- 1:51:27has the power to change and alter the
- 1:51:30way that we see the world around us
- 1:51:32permanently
- 1:51:33on January 19 2013 a documentary
- 1:51:37premiered at the Sundance Film Festival
- 1:51:39that would eventually go on to be
- 1:51:41nominated for best documentary at the
- 1:51:44bafta film Awards it told the story of
- 1:51:47an orca named Tilikum and the profoundly
- 1:51:50negative impact that captivity has on
- 1:51:53their species the documentary Blackfish
- 1:51:56was eventually released on Netflix and
- 1:51:58quickly became one of the most talked
- 1:52:00about documentaries of the year it would
- 1:52:03go on to have such a profound effect on
- 1:52:06the Public's view of SeaWorld that it
- 1:52:09would eventually lead to their closure
- 1:52:11of the killer whale shows and the
- 1:52:13breeding program entirely the impact was
- 1:52:17so significant that it resulted in a
- 1:52:20drastic decrease in the overall
- 1:52:22profitability of the company and would
- 1:52:24lead to a class action lawsuit for
- 1:52:27failure to admit to shareholders that
- 1:52:29the documentary had profoundly affected
- 1:52:31attendance at the park
- 1:52:34entire segments of the general public
- 1:52:36had vowed to stop attending Sea World
- 1:52:39because of a single documentary the
- 1:52:43impact of which is still being discussed
- 1:52:45and felt to this very day a documentary
- 1:52:49did that for much of the last 20 years
- 1:52:52we have watched the rise of the
- 1:52:54Innocence Project and other similar
- 1:52:56organizations come to the Forefront of
- 1:52:59the Criminal Justice System their
- 1:53:01efforts have exposed wrongful
- 1:53:03convictions have helped men and women
- 1:53:06fight their innocence and through the
- 1:53:08use of advanced forensics like touch DNA
- 1:53:11have helped to take the truly innocent
- 1:53:13off of death row and return to the
- 1:53:16wrongfully convicted their freedom a
- 1:53:20generation of people that saw conviction
- 1:53:22rates soaring through the 70s 80s and
- 1:53:2590s have begun to question the validity
- 1:53:27of a justice system that failed to
- 1:53:30exonerate clear examples of the innocent
- 1:53:33being convinced addicted for crimes they
- 1:53:35did not commit it is incredibly
- 1:53:38important that we continue to advocate
- 1:53:40for the innocent but I believe that in
- 1:53:43this case specifically the pendulum has
- 1:53:45swung too far in the other direction in
- 1:53:48just the last decade we have watched the
- 1:53:50likes of Jodi Arias convicted of the
- 1:53:53brutal homicide of her former boyfriend
- 1:53:55Travis Alexander gained considerable
- 1:53:57support hosting her own website boasting
- 1:54:01a net worth of over one million dollars
- 1:54:04and selling her art that she makes in
- 1:54:06prison for tens of thousands of dollars
- 1:54:09doing all of this while serving a life
- 1:54:11sentence for a truly vicious crime Arius
- 1:54:15lives a more comfortable life than a
- 1:54:18vast majority of middle-class Americans
- 1:54:20trying to make ends meet and largely
- 1:54:22because of the notoriety that she has
- 1:54:24received from the crime that she
- 1:54:26committed and now she enjoys the support
- 1:54:29of thousands who regularly advocate for
- 1:54:32her innocence on her behalf half all
- 1:54:35over social media and right here on
- 1:54:37YouTube just two months ago we watched
- 1:54:40Casey Anthony bring her case before the
- 1:54:42general public through her own
- 1:54:44docu-series which sought to disregard
- 1:54:46all of the evidence and claimed that the
- 1:54:49former most hated mother in America was
- 1:54:52actually the victim not the perpetrator
- 1:54:55a story that was told for her by NBC
- 1:54:58through a three-part documentary series
- 1:55:01and now even a cursory look into the
- 1:55:04social media platform Tick Tock will
- 1:55:07show you the overwhelming support
- 1:55:09Anthony now enjoys because of the
- 1:55:12effectiveness of her campaign to rewrite
- 1:55:15history even the infamous familiar
- 1:55:18convict Chris Watts has an ever-growing
- 1:55:21community of supporters who now create
- 1:55:24content on this very platform that seeks
- 1:55:27to question the legitimacy of his
- 1:55:29conviction
- 1:55:30despite the evidence and his own
- 1:55:32confession his own parents now claim
- 1:55:35that he could not have been responsible
- 1:55:37for his crimes and they seek to put the
- 1:55:39blame and culpability of his conviction
- 1:55:41on a conspiracy to hide the truth and
- 1:55:45here's the thing every single one of the
- 1:55:48people that I just mentioned people that
- 1:55:50I have already discussed on this
- 1:55:52platform they are succeeding each and
- 1:55:56every day they find new supporters
- 1:55:58people who are not familiar with the
- 1:56:00totality of their cases or who just
- 1:56:03don't care and who only see what they
- 1:56:06want to that the person who was charged
- 1:56:09tried and convicted is one of the many
- 1:56:11who are unfairly treated by the justice
- 1:56:14system by the media and because of that
- 1:56:16they don't deserve to be behind bars and
- 1:56:20now after reviewing this case in its
- 1:56:22entirety I believe that one of the most
- 1:56:25successful campaigns of misinformation
- 1:56:27that has occurred in recent history
- 1:56:29began the day that his beautiful wife
- 1:56:32went missing since December 24 2002 I
- 1:56:36believe that Scott Peterson his family
- 1:56:39and many of his supporters have
- 1:56:41intentionally misled the public to
- 1:56:43create a narrative that does not line up
- 1:56:46with the facts I believe that they have
- 1:56:49succeeded in deceiving countless people
- 1:56:51into believing that Scott Peterson is
- 1:56:54innocent and that he was one of the many
- 1:56:56wrongfully convicted victims of a
- 1:57:00justice system overrun by a media
- 1:57:02frenzied populace storming the gates
- 1:57:05pitchforks in hand it takes our
- 1:57:07predilection for empathizing with the
- 1:57:10innocent and it gaslights us into
- 1:57:11believing a narrative that requires you
- 1:57:14to keep your head in the sand and in a
- 1:57:17time where we still have people who
- 1:57:19genuinely and sincerely believe that the
- 1:57:22Earth is flat I am no longer surprised
- 1:57:25when I hear people refusing to see
- 1:57:28undeniable truth staring them right in
- 1:57:31the face for me it is cognitive
- 1:57:34dissonance at its worst because there is
- 1:57:37a vast difference between believing that
- 1:57:39Scott Peterson is innocent and actively
- 1:57:42telling the world that He is we can all
- 1:57:45believe whatever we want to but
- 1:57:47perpetuating a Viewpoint that robs
- 1:57:49victims of justice is something else
- 1:57:52entirely during my investigation I came
- 1:57:55across someone who asked me the question
- 1:57:57why does it matter if Scott Peterson is
- 1:58:00trying to lie his way out of prison who
- 1:58:02does that narrative harm I believe that
- 1:58:05his lies harm everyone it tarnishes the
- 1:58:09memory of Lacey her family and now the
- 1:58:12myriads of people who have been enticed
- 1:58:14by the claim that he had nothing to do
- 1:58:16with her death it continues to defame
- 1:58:20and ignore the life that was stolen from
- 1:58:22Lacey before she ever had the chance to
- 1:58:25be a mother something that she had
- 1:58:27wanted since she was a little girl and
- 1:58:30and what's worse is the person who was
- 1:58:32convicted for that crime continues to
- 1:58:35categorically refuse to acknowledge
- 1:58:37accept or agree that he shares any blame
- 1:58:41whatsoever and now he has successfully
- 1:58:45convinced Untold number of people that
- 1:58:48deny Lacey and her family the Justice
- 1:58:50they deserve
- 1:58:51I have a request just for a moment clear
- 1:58:55your mind and really try to imagine what
- 1:58:58it would be like to be the parents or
- 1:59:01family of Lacey Peterson
- 1:59:03after spending a lifetime watching their
- 1:59:06daughter flourish as a child as a young
- 1:59:09woman and then as a future mother they
- 1:59:12had all of that taken away from them
- 1:59:14every single year at Christmas time when
- 1:59:17the rest of the world is enjoying the
- 1:59:19holidays spending time with family and
- 1:59:21loved ones they have to relive and be
- 1:59:24reminded of one of the most public and
- 1:59:26horrendous tragedies that we've seen in
- 1:59:29the last 20 years the roaches don't get
- 1:59:32to heal because the people who now
- 1:59:34viciously defends God's innocence refuse
- 1:59:37to allow them to have any peace or
- 1:59:39Solace you cannot imagine the things
- 1:59:42I've seen all over the internet from
- 1:59:45people who defend Scott Peterson
- 1:59:47outright Waging War against anyone who
- 1:59:50dares to challenge their claims of his
- 1:59:52innocence these aren't just a few Fringe
- 1:59:55people their entire narrative has been
- 1:59:58shown on some of the largest media
- 2:00:00conglomerates and networks in the world
- 2:00:02that any series alone has over three and
- 2:00:06a half million views on YouTube I cannot
- 2:00:09fathom what the parents of Lacey
- 2:00:11Peterson have been through suffering the
- 2:00:14loss of their child being under the
- 2:00:16scrutiny of the media always under the
- 2:00:18watchful eye of the general public
- 2:00:20enduring years of waiting for justice
- 2:00:23laboring through a nearly six-month long
- 2:00:26jury trial having to see pictures of
- 2:00:29Lacey and Connor desecrated and then
- 2:00:31suffering a near mistrial during the
- 2:00:34jury deliberations only to finally hear
- 2:00:37the words we the jury find Scott
- 2:00:40Peterson guilty and that's where this
- 2:00:43story should have ended but it didn't
- 2:00:46Scott continued to lie something he's
- 2:00:49been doing for decades and then chose to
- 2:00:52weaponize his refusal to be a man and
- 2:00:56empowered his Defenders to go wage war
- 2:00:58with the truth I don't like the word
- 2:01:01Victim Because it implies that the
- 2:01:03person is helpless and unable to fend
- 2:01:05for themselves but in this case I
- 2:01:08believe that Scott Peterson has made
- 2:01:10victims of the family of Lacey Peterson
- 2:01:12and everyone else that he is convinced
- 2:01:15that he is actually innocent and when
- 2:01:18lies become the truth it prevents those
- 2:01:21who are truly innocent from being given
- 2:01:23the opportunity to have their case heard
- 2:01:26people who genuinely need the assistance
- 2:01:29of organizations like the Innocence
- 2:01:31Project are relegated to the back burner
- 2:01:33because the stories of people like Scott
- 2:01:35Peterson who enjoyed the considerable
- 2:01:37financial support of his wealthy family
- 2:01:40are able to encourage and support a
- 2:01:43six-part documentary series that floods
- 2:01:46the airwaves with misinformation a
- 2:01:49documentary that is in my opinion one of
- 2:01:52the most overt examples of
- 2:01:54misinformation that I have seen in the
- 2:01:57last 10 years there are truly innocent
- 2:02:00people whose stories you have never
- 2:02:02heard and do you you know why because
- 2:02:05those people don't have a wealthy family
- 2:02:07they can't afford a million dollar
- 2:02:09retainer for a lawyer like Mark garagos
- 2:02:12and they don't have brothers and sisters
- 2:02:15with a vested interest in getting their
- 2:02:17brother out of prison because of the
- 2:02:19impact that it has on each of them I
- 2:02:22spent many years of my career being on
- 2:02:24the side of Defending my clients even
- 2:02:27clients that made terrible mistakes but
- 2:02:29no matter what they did or didn't do the
- 2:02:32line was always drawn when or if the
- 2:02:35only way forward was to craft a Web of
- 2:02:38Lies to free them from a conviction or
- 2:02:41losing the outcome of a case because the
- 2:02:44truth it matters and not because I say
- 2:02:48so but because it's the right thing for
- 2:02:51Lacey and for their family that was
- 2:02:53robbed of knowing Connor of being
- 2:02:56grandparents of the memories the
- 2:02:58holidays and all of the moments they
- 2:03:01would have had watching Lacey become a
- 2:03:03mom at the beginning of this video I
- 2:03:06told you that I have a new opinion of
- 2:03:08this case and it's true I do reviewing
- 2:03:11this case has changed the way that I see
- 2:03:14True Crime cases forever because I will
- 2:03:17no longer accept claims made by
- 2:03:19documentaries created by either side
- 2:03:22without evidence to back or support them
- 2:03:25I will not allow media pundits to
- 2:03:28dictate how I feel about anything most
- 2:03:32especially a criminal proceeding
- 2:03:34previous to my investigation of this
- 2:03:36case I believe that it was entirely
- 2:03:39possible that Scott Peterson was in fact
- 2:03:41innocent of the crimes that he was
- 2:03:43convicted of in his jury trial that
- 2:03:45maybe there was more to his story and
- 2:03:48that we had all been wrong
- 2:03:49but now after everything that I've
- 2:03:51presented to you and I assure you it is
- 2:03:54nowhere close to the totality of the
- 2:03:56evidence that exists that points to his
- 2:03:59guilt but after all of the hours spent
- 2:04:01reading documents evidence testimony
- 2:04:04pleadings rulings audio recordings books
- 2:04:08and everything in between I have come to
- 2:04:11this definitive conclusion
- 2:04:13I believe that Scott Peterson has
- 2:04:16engaged in a decades-long effort to
- 2:04:18reframe the truth through a deliberate
- 2:04:20campaign of misinformation and lies that
- 2:04:24he is a boy who never learned the
- 2:04:27importance of Integrity of being a man
- 2:04:30and accepting responsibility for his
- 2:04:32misdeeds but that Scott Peterson is
- 2:04:36definitively guilty of the crime of the
- 2:04:39homicide of Lacey and Connor Peterson
- 2:04:41because the truth matters even if Scott
- 2:04:45Peterson refuses to acknowledge it
- 2:04:48in closing today I want to take the time
- 2:04:51to remember the incredible life of Lacey
- 2:04:54Peterson
- 2:04:55her mother Sharon Rocha wrote an
- 2:04:58incredible book called for Lacey in the
- 2:05:02book she describes Lacey's childhood her
- 2:05:05teen years and what she was like as a
- 2:05:07young adult she goes into detail
- 2:05:09outlining the experiences her memories
- 2:05:12and moments that they shared as a mother
- 2:05:15and as a daughter and I want to take a
- 2:05:18moment to read a passage from her book
- 2:05:20because while so much of this video has
- 2:05:23been about Scott I want to end it with
- 2:05:25the person who matters most Lacey and
- 2:05:29the son that she couldn't wait to have
- 2:05:31this is an excerpt from the book for
- 2:05:34Lacey
- 2:05:35[Music]
- 2:05:38I can't accept what happened to Lacey I
- 2:05:41just can't there's nothing as
- 2:05:43devastating as the death of a child and
- 2:05:46there's nothing as unacceptable as what
- 2:05:49Scott did to her together the two are an
- 2:05:52unimaginable horror December 24th 2002
- 2:05:57is the day the sky crashed down on our
- 2:05:59lives time stopped Lacey's been gone
- 2:06:03almost three years as I write this
- 2:06:05sentence and wounds have yet to heal I
- 2:06:09measure life from that call from Scott
- 2:06:11things either happened before or after
- 2:06:14it life has gone on but in increments of
- 2:06:18pain anger and grief from what I know
- 2:06:21that's how it is for families of this
- 2:06:24kind of tragedy it's certainly that way
- 2:06:26for me the trial seems surreal almost
- 2:06:30like it didn't happen I'm glad Scott
- 2:06:32received the punishment he deserved but
- 2:06:35I can't say that I derived any
- 2:06:37satisfaction from it there definitely
- 2:06:39hasn't been any closure other than the
- 2:06:42steel doors clinking shut every night
- 2:06:44what's closed the hole in my heart
- 2:06:47hasn't closed Lacey is still gone what
- 2:06:51happened is just sad Lacey at 27 years
- 2:06:55old seven and a half months pregnant
- 2:06:58exuberant generous full of life and
- 2:07:01excited about the future had her life
- 2:07:04stolen and the person responsible was
- 2:07:08the man she trusted more than anyone Our
- 2:07:11Lives shouldn't be like this at all not
- 2:07:15laces not Scots not ours or the
- 2:07:19Petersons I'm heart sick for all of us I
- 2:07:23still want to know what possessed him to
- 2:07:25do it I want to know what he did I want
- 2:07:29to know what happened to Lacey I want to
- 2:07:33know what made him think he could get
- 2:07:35away with it so many questions
- 2:07:37unanswered
- 2:07:41at the end of her book Sharon Rocha goes
- 2:07:44on to describe a dream that she had
- 2:07:46several years after Lacey and Connor
- 2:07:48were found as a parent I read this next
- 2:07:51part of her book and my heart absolutely
- 2:07:54broke for her and for Lacey's family but
- 2:07:58these are the final words of her book
- 2:08:00for Lacey
- 2:08:02[Music]
- 2:08:05and then there was this one brief
- 2:08:08wonderful peaceful moment when she came
- 2:08:11back it was mid-june 2005 and I was
- 2:08:15asleep dreaming about Lacey something
- 2:08:17I've rarely done as the dream happened I
- 2:08:20was also able to watch it from afar two
- 2:08:23distinct Vantage points allowing me to
- 2:08:26remember the details with unusual
- 2:08:28Clarity in the dream the day was bright
- 2:08:31warm and sunny and I felt the way I did
- 2:08:34before Lacey was stolen from us I was
- 2:08:37happy content and hopeful like maybe
- 2:08:40something good was going to happen then
- 2:08:43I saw my dad who was buried in the same
- 2:08:46Cemetery as Lacey lead my daughter whole
- 2:08:49and beautiful out from her grave my
- 2:08:53father knew how much I needed to see her
- 2:08:55holding her hand he brought her home to
- 2:08:58me then he disappeared leaving the two
- 2:09:02of us alone Lacey and I were in the
- 2:09:05backyard where we sat beneath the
- 2:09:07fruitless Plum Tree I sat cross-legged
- 2:09:10and she laid on her right side with her
- 2:09:13cheek on my thigh she was wearing the
- 2:09:15same bathrobe that she had worn as a
- 2:09:18little girl I took my fingers and
- 2:09:20brushed her bangs to the side stroked
- 2:09:22her cheek and marveled that she always
- 2:09:24had the softest complexion Lacey said
- 2:09:28something to me and her voice was raspy
- 2:09:30for not speaking for two years it felt
- 2:09:33wonderful to have her back I was able to
- 2:09:36touch her again she looked up at me and
- 2:09:39smiled the same way she did as a little
- 2:09:42girl the same way she did as a teenager
- 2:09:45the same way she did the last time we
- 2:09:48were together and I put my hand on her
- 2:09:51pregnant belly I was at peace all was
- 2:09:54calm as she talked Lacey extended her
- 2:09:57left arm in the air waving it around for
- 2:10:00emphasis
- 2:10:01she always gestured as she talked I used
- 2:10:04to say she talked with her hands just as
- 2:10:06I did we were alike in so many ways
- 2:10:09close in so many ways I stared at her
- 2:10:13beautiful little hands adoring her long
- 2:10:16slender fingers and soft skin and then I
- 2:10:19saw her fingernails were polished is
- 2:10:22that Dutch tulips I asked remembering
- 2:10:24the name of the color both of us liked
- 2:10:27yes she said with the giggle then she
- 2:10:30said something else
- 2:10:31mom why did Scott want to kill me she
- 2:10:35asked I don't know honey I said
- 2:10:39I didn't want to die she said
- 2:10:42why did this happen
- 2:10:43I don't know honey I repeated
- 2:10:46mom I came to tell you that I'm okay she
- 2:10:50said
- 2:10:51I wanted you to know that we're at peace
- 2:10:54and I love you
- 2:10:56the last thing I remember is saying
- 2:10:59I love you too
- 2:11:01and I did
- 2:11:03and I do
- 2:11:05and I always will
- 2:11:24several weeks ago a fellow content
- 2:11:27creator here on YouTube named Matt
- 2:11:29Orchard also covered the Scott Peterson
- 2:11:31case instead of viewing his content as
- 2:11:33competition I wanted to do something
- 2:11:36very different after watching his video
- 2:11:38in its entirety I decided that this
- 2:11:41video would complement his I have always
- 2:11:44believed that content creation is an art
- 2:11:46and when it's done well it deserves the
- 2:11:49praise and attention from the community
- 2:11:51regardless of the ever-changing Winds of
- 2:11:54the algorithm Matt Orchard's video is
- 2:11:57truly exceptional and I highly recommend
- 2:12:00that you watch it any area of Scott's
- 2:12:03case that he discussed I have tried to
- 2:12:05leave to him so my video is intended to
- 2:12:08be complementary to his many of you may
- 2:12:11already be aware that the last month has
- 2:12:13been particularly challenging for me I
- 2:12:17underwent a complicated oral surgery
- 2:12:19procedure and I am still in the process
- 2:12:21of having reconstructive surgery that
- 2:12:24will take the better part of 18 months
- 2:12:26to complete so I want to thank you for
- 2:12:29your support while I've been on the mend
- 2:12:31your kind words and remembering me has
- 2:12:34meant the world to me I am so grateful
- 2:12:37to be a part of this community and for
- 2:12:39each of you thank you all for reminding
- 2:12:42me that this world is full of beautiful
- 2:12:45people and that this life is truly a
- 2:12:49gift now I have mentioned it several
- 2:12:51times throughout this video but this
- 2:12:53episode has been the combined effort of
- 2:12:55nearly a dozen people over the last five
- 2:12:58to six weeks and I want to take a moment
- 2:13:01to thank them for their help with the

- 2:14:24achieve their wildest dreams and I am so
- 2:14:27thankful to say that I can count myself
- 2:14:29lucky to be amongst those who are living
- 2:14:32their dreams each and every day and I
- 2:14:36can only say that because you have made
- 2:14:38that possible I am already feverishly
- 2:14:41working on the next series and it will
- 2:14:43be very much like this one but if you
