5. 0:10in the hands of a judge good morning the
6. 0:12defense delivering closing arguments
7. 0:15thursday claiming rachelle nice a juror
8. 0:17in peterson's 2004 murder trial was
9. 0:20biased against him and lied to the court
10. 0:23during jury selection
11. 0:25failing to disclose in a questionnaire
12. 0:27that a judge had previously granted her
13. 0:29a restraining order when she was
14. 0:31pregnant because nice really feared for
15. 0:33her unborn child she issued a
16. 0:36restraining order a three-year
17. 0:37restraining order the prosecution
18. 0:39arguing nice did not intentionally lie
19. 0:42about her history to get on the jury she
20. 0:45had no bias against scott peterson with
21. 0:47his family watching peterson now 49 sat
22. 0:51through the hearing in handcuffs passing
23. 0:53notes to his lawyers who were frequently
24. 0:56challenged by the judge pointing to
25. 0:58their initial failure to further
26. 1:00question nice about a number of
27. 1:02inconsistencies on her juror
28. 1:04questionnaire well but isn't that pretty
29. 1:06important to follow up the whole reason
30. 1:08for these questionnaires
31. 1:11is for the attorneys to look at answers
32. 1:14carefully
33. 1:15and follow up
34. 1:16the prosecution also aiming to prove
35. 1:19nice's involvement and potential bias
36. 1:22had no effect on the outcome of the
37. 1:24trial she did what she was instructed by
38. 1:26the judge to do
39. 1:28and she reached a verdict
40. 1:30peterson's family pushing back
41. 1:33scott did not have an impartial jury and
42. 1:36it's time for him to be granted a new
43. 1:37trial
44. 1:38now with four months to decide if
45. 1:40peterson should get a retrial the fate
46. 1:43of a convicted killer lies in the hands
47. 1:46of a judge
48. 1:48that judge is going to now have to
49. 1:49determine if there's enough evidence to
50. 1:51support the claim that the juror
51. 1:53knowingly and intentionally lied to the
52. 1:55court to get on the jury and that her
53. 1:57bias against scott peterson ultimately
54. 1:59led to his conviction conviction that
