1:22not as busy as yesterday but we got some
1:24good stuff today for you
1:26first scott peterson could actually get
1:29a new trial now as you may recall
1:33scott peterson was convicted
1:36many years ago regarding the death of
1:38his wife
1:39and his unborn child he was given the
1:42death penalty
1:43and roughly about a month ago the
1:46california supreme court vacated
1:50the death penalty sentence for scott
1:52peterson
1:53well now in continued post
1:56conviction relief motions filed by scott
1:59peterson's attorneys
2:01the california supreme court has said
2:03you know what
2:05there may be one issue here that has
2:07some merit
2:08so we're going to order the california
2:10supreme court has ordered
2:12the trial court to hold a hearing
2:16regarding some juror conduct on the case
2:20this is the kind of thing that is going
2:22to make the prosecutor
2:24have a little bit of a pucker factor all
2:26right
2:27the same court that already threw out
2:31the death penalty conviction because the
2:34judge
2:34didn't allow qualified jurors to remain
2:40the supreme court has now said look into
2:42this juror misconduct
2:44which may have resulted in an unfair
2:46trial
2:48and if that hearing is held the court
2:51the trial court will have to decide
2:52whether a new trial is warranted
2:54and i assure you if the trial court
2:57denies scott peterson a new trial it
3:00will be appealed
3:01and ultimately it may get to the
3:04california supreme court
3:05now this court's already been found to
3:07have made error once
3:08do you think he wants to make it again
3:10do you think he wants to give
3:12scott peterson a new trial we'll have to
3:15wait and see
3:16the issue as it relates to this new
3:19hearing
3:20is to determine whether peterson should
3:22be granted a new trial on the grounds
3:24that
3:24juror number seven committed prejudicial
3:27misconduct
3:28by not disclosing her prior involvement
3:31with other
3:32legal proceedings including but not
3:35limited to
3:36being a victim of a crime so it is
3:38alleged in
3:39the petition and the california supreme
3:42court agrees
3:43that juror number seven may have
3:46committed prejudicial misconduct by not
3:48disclosing
3:49her prior involvement with other legal
3:50proceedings including but not
3:53limited to being a victim of a crime
3:56now this juror was initially an
3:59alternate
4:00juror but she was given a seat when
4:02another juror was discharged
4:04she loaded she later wrote a book about
4:07her experience according to peterson's
4:10attorneys
4:11they believe that juror number seven
4:13worked just a little too hard
4:15to get on the jury she reportedly
4:19claimed she was willing to serve
4:20despite her employer telling her she
4:22wouldn't be paid for her time
4:24as a result of her missing work this is
4:26significant as i said
4:28originally the california supreme court
4:30overturned peterson's death sentence due
4:32to significant errors in jury selection
4:35here it sounds like there may be a juror
4:38who literally wanted to get on the case
4:40maybe for financial gain maybe she had
4:42an agenda
4:43but she didn't report that she had
4:45involvement with the legal system
4:47including protection order cases that
4:49she was involved in
4:50of jury selection is called voidir and
4:53it means to speak the truth
4:55and what that means is that jurors are
4:56supposed to speak the truth
4:59and it's to find out at the end of the
5:01day whether somebody can be a fair and
5:03impartial juror
5:04and if you have a bias a motive for
5:08conviction or an acquittal as it relates
5:10to
5:11the parties in this particular case
5:13you're not giving the other side a fair
5:16shot and if you have a juror who is
5:18biased and she took that bias and maybe
5:21tainted
5:21the other jurors that will also be
5:24significant
5:25the fact that the supreme court has
5:26already said
5:28there was juror issues and now it's
5:30being remanded
5:31to develop a further record as it
5:33relates to juror issues
5:35makes me think scott peterson may
5:37actually have a shot at this
5:39and the other reason is it's california
5:42everything drags on in california from
5:44what i can tell not licensed there but
5:46it just seems like everything always
5:48drags on
5:49in california now you have to remember
5:51you also have to remember was that there
5:53was no
5:53physical evidence relating to
5:57scott peterson actually being involved
6:00in the death of his
6:01wife and son it was circumstantial now
6:03don't get me wrong
6:05there was some pretty strong
6:06circumstantial evidence which would show
6:08some consciousness of guilt
6:10let's take a quick look at that first
6:12trained dogs picked up lacy
6:14scent at the berkeley marina where
6:16peterson claimed he went fishing
6:18when lacey vanished obviously her
6:20remains were found later
6:21close to the same area peterson visited
6:24the crime scene repeatedly
6:26the tarp that peterson used on his
6:28fishing trip was covered in gasoline in
6:30his shed
6:31gasoline was known by several people to
6:35destroy dna at that time perhaps it's
6:38just a coincidence
6:39another tarp was found buried in
6:41fertilizer also known to destroy dna
6:44that was according to dr henry lee who
6:46testified at peterson's trial
6:48now peterson told detectives he stopped
6:50fishing because it began
6:51to rain although there was no
6:53precipitation in the berkeley
6:55marina on the day in question according
6:58to the harbor master
6:59peterson claimed lacey was watching a
7:02cooking segment on television
7:03when he left their home on december 24th
7:06but
7:06the show he referenced actually aired on
7:09december 23rd
7:10lacey wore a diamond necklace sapphire
7:13ring and
7:14banned each and every time she left her
7:16home
7:17on the day she disappeared the jewelry
7:19was left in her bedroom
7:21now after lacey and connor's remains
7:23were found
7:24authorities caught peterson close to the
7:26mexico border
7:27with his hair and beard died blonde an
7:30identification that didn't belong to him
7:33several credit cards closed knives four
7:35cell phones
7:36a rope camping supplies and roughly
7:39fifteen
7:39thousand dollars in cash circumstantial
7:42evidence possibly
7:44the jury believes so was it enough to
7:47convict
7:48well it was several years ago back in
7:512004
7:52would it be enough to do it again today
7:54we'll have to wait and see if scott
7:56peterson gets a new trial
7:58next on the docket a creepy medical
8:00technician
8:01schedules some follow-up appointments
8:03that's right
8:05a missouri medical technician has been
8:08charged with sexual abuse and invasion
8:10of privacy after he allegedly set up a
8:12fake ct scan for a woman who had an
8:16x-ray
8:16earlier in the day ryan williams 39 will
8:19give him the presumption of innocence
8:21was the x-ray technician who saw the
8:24victim when she reported
8:25to the mercy lincoln hospital in troy
8:28oklahoma
8:29back on october 3rd of this year that
8:31was done at her doctor's request
8:33after the x-ray the woman went home at 7
8:3630 pm prosecutors allege that williams
8:39called her
8:40and asked her to return to the hospital
8:42for another exam because
8:44they saw something and they wanted to
8:46check it out
8:47needless to say the patient returned to
8:49the hospital roughly 30 minutes later
8:51where williams escorted her to the ct
8:53scan room
8:54and gave her a gown he had her lay on
8:56the table and lifted her gown
8:58touching her breast while placing
9:00stickers during the scan
9:01according to investigators after the
9:03exam william showed her a scan and said
9:05the doctor
9:06was concerned she may have lymphoma but
9:09two days later
9:10when she contacted her doctor she was
9:12told there was no such
9:13history of such a scan she also learned
9:15williams had accessed her medical
9:17records
9:18from the hospital system police
9:20investigators found out that williams
9:21had been searching hospital records
9:24for non-elderly adult women who had
9:27potential health issues
9:28involving their private parts
9:31investigators are concerned that there
9:32may be actually
9:33more victims with similar acts as he was
9:36working at the hospital for some time
9:38the hospital of course has launched an
9:39internal investigation and
9:42mr williams has some legal issues
9:44forthcoming
9:45just shows ladies and gentlemen there's
9:48always
9:49someone out there that you think is
9:51supposed to be doing good
9:53and is doing something weird and creepy
9:56next on the docket let's give you a good
9:59example
9:59of what is not self-defense
10:03well there is a case out of detroit
10:06right now
10:07and it happened on the east side of
10:10detroit at a 7
10:116 or 76 gas station and
10:15the police say that the clerk at the gas
10:18station
10:19saw joshua lewis he was 30 years old
10:22and allegedly stealing from a coin
10:24change machine
10:25the clerk did the obvious thing right
10:27pick up the phone and call the police
10:29maybe just make sure the cameras are
10:31going so that you can see it all
10:32no no no no this clerk picked up an
10:35ak-47
10:37fired a single shot through the safety
10:40glass
10:40and guess what mr lewis was killed by
10:43the round
10:44that pierced through the safety glass
10:46and obviously striking him
10:48needless to say the police are treating
10:49this as a homicide
10:51as well it should be you do not
10:54get to justify using deadly force when
10:58someone is stealing
11:00quarters from a change machine for you
11:02to use justified
11:04deadly force you have to believe that
11:07you are
11:07in fear of death or serious bodily
11:10injury
11:11and even then it still has to be
11:13reasonable in your use of force
11:15and i assure you this situation is not
11:19is not a reasonable use of force the
11:22clerk
11:23should be charged with murder
11:26before we go on please i have asked you

12:36familiar story
12:37a missing mom has been located
12:41and in this case it's a montana mom
12:43who'd been missing since september
12:46is found deceased in her car inside a
12:49storage container
12:50mother of four sally jane demarius
12:53smith who resides in montana was known
12:56for always being upbeat whether she was
12:58leading a spin class or getting her
13:00colleagues in the early morning hours
13:02at the elementary school where she
13:04worked the 52-year-old
13:06vanished on september 25th her husband
13:09children
13:09and many friends were obviously worried
13:11sick about her
13:12on sunday her loved ones received the
13:15shocking news that she
13:16was found and in fact she was deceased
13:19the body
13:20was found in a 2005 toyota corolla in a
13:23storage unit
13:24just outside of great falls the autopsy
13:27was scheduled for tuesday and the
13:29results have not been
13:30issued to the public just yet the police
13:33are investigating and they have not said
13:35whether they believe
13:36smith was a victim of foul play or
13:39whether this was in fact
13:40a case of suicide friends and family are
13:43indicating or implying through various
13:46facebook posts
13:47that they believe that she was the
13:48victim of foul play smith's
13:50husband states that he had driven some 3
13:52000 miles
13:53looking for her and in fact had even
13:56searched for her in an airplane he
13:57states that the
13:58family is devastated and we'll see if
14:02there's a suspect or whether this was in
14:04fact
14:04foul play or something else we'll keep
14:06you apprised of future developments
14:08all right ladies you don't like your
14:10husband your ex-husband
14:12get rid of them that's right and look
14:14for a 17 year old to do it you know
14:16they're going to be thorough about it
14:17right
14:18yeah not so much well guess what a woman
14:22in washington state is being accused of
14:24offering a 17 year old
14:2613 000 to get rid of her ex-husband
14:30shireen kelly allegedly got joshua good
14:33to attack her former spouse
14:35and the teenager assassin in turn got
14:37another kid by the name of quincy
14:39mendez to act as a getaway driver that's
14:42not even the most bizarre
14:44thing about this is that the victim
14:47baron lee was shot nine
14:50times and survived apparently the victim
14:53fell to the ground
14:54and the suspect stood over him and
14:56continued to fire according to the
14:58police reports
14:59now lee the victim states of course i
15:02knew she was crazy
15:03did i know she was capable of doing
15:05something like this he says
15:07of course without a doubt
15:10now good shot lee nine times
15:13outside of his apartment and
15:14miraculously none of the rounds hit
15:16any organs or arteries that left alive a
15:20witness victim
15:21with a lot to tell police lee reportedly
15:24told the cops
15:25that the only person he could think of
15:27behind
15:28this was his ex-wife kelly they've been
15:31apparently fighting for custody for five
15:35years
15:35over their six-year-old son gee do you
15:38think you may figure who's gonna get
15:40custody at this point
15:41the real target according to lee was not
15:43him he was the outlet
15:45i was in the way the target's my son and
15:48i'm glad he's going to be safe now
15:49according to lee
15:50the child also apparently has a trust
15:52fund from a settlement after
15:54he sustained a brain injury as an
15:57infant lee alleges that his ex-wife was
15:59really only
16:00there to collect the money police also
16:03were able to
16:03link kelly to the crime after finding a
16:06tracking device on the victim's car
16:08using online records to connect that
16:11device
16:12to miss kelly now mr lee
16:15says he doesn't blame good and menendez
16:17because they're kids
16:19who did something really stupid like
16:21shot him nine times
16:22needless to say now kelly good and
16:25menendez face
16:26a case for attempted first-degree murder
16:28kids are being tried as an adult
16:30and an arraignment is set for october
16:3226th of this year
16:34you just can't make this stuff up ladies
16:36and gentlemen next on the docket
16:38some new information that comes out
16:41regarding the george floyd matter
16:43in some recent filings made by the
16:45prosecution in this case
16:46the prosecutors are alleging they're
16:48filing that during the first five
16:50minutes
16:50mr floyd was pinned and yelled i can't
16:53breathe
16:54more than 20 times and called out for
16:56his deceased mother almost a dozen times
16:59he told the officers almost 10 times
17:02that he feared he would die he stated
17:04repeatedly please
17:05your knee in my neck floyd pleaded tell
17:08my kids i love them
17:10after four minutes floyd's cries became
17:12softer and soon his screams turned into
17:14grunts
17:15and his grunts into mumbles floyd
17:18uttered his last words
17:20around 20 minutes 23 seconds
17:24into the video that's when he fell
17:26silent and lost
17:27consciousness according to the
17:29prosecutor's filing over
17:31four and a half minutes floyd was silent
17:33according to the pleadings by the
17:35prosecutor
17:36for at least three of those minutes
17:38floyd appeared to be
17:40not breathing and for at least two and a
17:42half minutes the officers were
17:44unable to locate floyd's pulse
17:47prosecutors further
17:49say in their filings that conserved
17:50bystanders frantically warned the cops
17:5310 times the floyd was no longer moving
17:56warned them nine times that floyd was
17:57unresponsive
17:58and pleaded with them nearly 30 times to
18:01check mr floyd's pulse
18:03even as the bystanders plead with
18:05officer chauvin to remove his knee
18:07from floyd's neck chauvin rolled his
18:10knee back and forth
18:11pressing it into floyd's neck and
18:13maintaining pressure on floyd's
18:15breathing
18:15that's what the prosecutors allege now
18:18chauvin
18:18is facing charges of second-degree
18:20murder second-degree manslaughter and
18:22third-degree murder
18:23and he was actually released from
18:25custody last week on a one million
18:27dollar bond
18:28the other officers lane kunig and tao
18:30are each charged with aiding and
18:32abetting murder
18:33and manslaughter and once again this was
18:36all over
18:37a counterfeit 20 bill we certainly don't
18:40condone people passing
18:41fake twenty dollar bills to anybody but
18:43as we saw
18:44yesterday from the video that we put up
18:47about the officer
18:48who exercised great restraint when
18:52not shooting someone when actually they
18:54justifiably
18:55would have been justified the floyd case
18:57is a perfect example
18:59of officers going to the extreme
19:03and ignoring the circumstances around
19:06them
19:06if there is a conviction in this case it
19:08will be there it will be for the
19:09complete disregard of the medical
19:12situation that was taking place with mr
19:14floyd
19:15that is manslaughter at a minimum
19:18possibly second degree murder as well
19:20but
19:21we'll see what a jury does in this
19:23particular case the officers are
19:25ultimately going to argue that they were
19:26just
19:27following procedures and you can't blame
19:29us we're just doing what we were told
19:31and we'll see how that defense plays out
19:34when these trials
19:36come before the jury next on the docket
19:38our dumb
19:39criminal contestant of the day

19:47police were called in the early hours
19:49last week after
19:51reports of gunshots were heard at an
19:53apartment complex
19:54there were reports of a man dressed as a
19:57gorilla
19:58carrying a machete he apparently was
20:00also threatening to blow up the building
20:02now this was in fargo north dakota when
20:05the officers arrived
20:06they saw a man dressed like a gorilla
20:08carrying a machete they learned that the
20:10gunshots were in fact fireworks but they
20:12also learned the suspect had threatened
20:13to
20:14go inside the building and blow it up
20:17the gentleman in the gorilla suit was
20:18identified as jordan
20:20pickus 26 he ultimately surrendered to
20:23the police he was taken to the hospital
20:25for a mental health evaluation and was
20:26ultimately arrested and transferred to
20:28the jail
20:29for the charge of terrorizing we
20:31certainly hope
20:33that mr pickus gets any mental health
20:36treatment that he needs but in this
20:39particular case mr pickus
20:41is our dumb criminal contestant of the
20:43day if you're going to try and do
20:45something
20:46you probably don't want to draw a whole
20:47lot of attention to yourself
20:49but running around in a gorilla suit and
20:52a machete is going to draw attention
20:54i don't care who is passing by they're
20:57going to call
