  2. 0:02sir good afternoon uh can you tell us
  3. 0:05how it is that you know the
  4. 0:07defendant um I dated her for quite a
  5. 0:11while and then we eventually got married
  6. 0:14when you say you dated her for quite a
  7. 0:16while um how long are we talking um I
  8. 0:19met her in the late
  9. 0:2290s and I believe it was
  10. 0:25around 2005 when we got
  11. 0:28married did do you have any children as
  12. 0:31a result of your marriage with the
  13. 0:32defendant yes we had one
  14. 0:34son and how old is that son um he is
  15. 0:38currently getting ready to turn
  16. 0:4114
  17. 0:42um did your marriage with the defendant
  18. 0:45asked no it did
  19. 0:48not and
  20. 0:50approximately when was it that you uh
  21. 0:54separated and began proceedings for a
  22. 0:57divorce um
  23. 1:00probably
  24. 1:032017 I'm thinking
  25. 1:06maybe and at that time um when was your
  26. 1:11divorce actually
  27. 1:13finalized um oh maybe it was 2016 I
  28. 1:16think the divorce was
  29. 1:192017 I
  30. 1:22believe and after your divorce uh what
  31. 1:28was your custody the arrangement uh with
  32. 1:31your son that you had in common with the
  33. 1:34defendant um she was supposed to have
  34. 1:37him on Mondays in Tuesdays I would have
  35. 1:39them Wednesday Thursdays and then we'
  36. 1:42alternate Friday through Sundays every
  37. 1:44other week so one week you would have
  38. 1:47five days with your son and another week
  39. 1:51she would have five days with it
  40. 1:54correct
  41. 1:56and was this still the same custody
  42. 1:59arrangement in February of 2020
  43. 2:04yes and in February of 2020
  44. 2:09um did you have uh do you recall the
  45. 2:12events that occurred I guess first on
  46. 2:16the the late evening of February 23rd
  47. 2:222020 um on that evening yes uh uh well
  48. 2:27apparent uh Sarah called me at one point
  49. 2:29during the
  50. 2:31nights do you recall about what time she
  51. 2:34called you I think it was 11
  52. 2:38something when you answered the phone
  53. 2:41how did Sarah sound on the phone she
  54. 2:44sounded like she had been drinking was
  55. 2:46pretty
  56. 2:47drunk were you able to understand what
  57. 2:50the defendant was saying um somewhat but
  58. 2:54she woke me up I had work the next day I
  59. 2:58was asleep when she called
  60. 3:01um she's done this before calling me
  61. 3:03late at night and generally I kind of
  62. 3:05just try to ignore it so I wasn't really
  63. 3:08paying
  64. 3:09attention um who was she living with at
  65. 3:13the time uh George
  66. 3:15Torres when she called you late that
  67. 3:19evening uh could you hear George in the
  68. 3:21background at all not that I remember
  69. 3:26now did you pay much attention to this
  70. 3:28phone call
  71. 3:31no now the following morning on February
  72. 3:3524th
  73. 3:372020 did you begin to call the defendant
  74. 3:41yes I did and approximately what time
  75. 3:46did you begin to call the defendant um I
  76. 3:48think it was like 11:00 or
  77. 3:51something and why was it that you were
  78. 3:53calling her um well it was going to be
  79. 3:56Monday um I had had him on Sunday and
  80. 3:59dropped him off at school and I was
  81. 4:00calling to try to find out if she was
  82. 4:03going to be actually picking him up that
  83. 4:05day why would you have a question about
  84. 4:08whether or not she was picking him up
  85. 4:10she wasn't generally very good about
  86. 4:12actually getting him on the day she was
  87. 4:14supposed
  88. 4:16to so it was not uncommon for you to
  89. 4:19have to remind her uh to pick him up or
  90. 4:24to make sure that she she was going to
  91. 4:26pick him up well I mean remind or just
  92. 4:29just find out if she was going to or if
  93. 4:32she was just going to give him over to
  94. 4:34me as what
  95. 4:37happened do you remember at what time on
  96. 4:41February 24th you actually got in touch
  97. 4:45with the defendant um I think it was
  98. 4:47like 12:30 or
  99. 4:48something and when you actually got in
  100. 4:52touch with her what did she tell you on
  101. 4:55the phone um that George was dead and if
  102. 4:59I would come
  103. 5:00over did she say what happened to him um
  104. 5:05I don't remember if she told me then on
  105. 5:07the phone or when I got there but she
  106. 5:10told me they had been playing hide and
  107. 5:12seek and that she fell
  108. 5:14asleep what did you advise her to do um
  109. 5:18I told her she needed to call 911 and
  110. 5:21that I would come over as soon as I
  111. 5:25could and this is on your first phone
  112. 5:28call here at approximately 12:30 yes on
  113. 5:33224 29
  114. 5:37yes did she did she call you again while
  115. 5:40you were in route to her residence she
  116. 5:43did she called to find out if I was um
  117. 5:46still going to be coming
  118. 5:47over and when you spoke with her while
  119. 5:52you were in route what if anything did
  120. 5:54you advise her I told her she needed to
  121. 5:57call 911 and told her I was on my way
  122. 6:00but she needed to get somebody over
  123. 6:03there how long did it take you to
  124. 6:06arrive at her residence from the first
  125. 6:10phone call or yes from the first phone
  126. 6:15um well I mean I don't live I mean I
  127. 6:20live a minute or two drive away but I
  128. 6:22had to get my puppy we we had just
  129. 6:25gotten a puppy recently I had to get him
  130. 6:26in his crate and stuff like that and put
  131. 6:29some something on because I was working
  132. 6:31from home and
  133. 6:34um total time maybe 10
  134. 6:38minutes when you arrived at her
  135. 6:44apartment um tell us tell us what she
  136. 6:48told you when you
  137. 6:50arrived
  138. 6:52um that um I mean George was dead and I
  139. 6:56once again I don't remember if she told
  140. 6:58me now or before before that um they had
  141. 7:02been playing hide and seek and she fell
  142. 7:03asleep but I that time told her again
  143. 7:07she needed to get 911 called to get
  144. 7:09somebody over
  145. 7:11there had she called 911 at this point
  146. 7:14no she had
  147. 7:17not so you've advised her now three
  148. 7:20times to call 911
  149. 7:25yes did you go inside of her apartment I
  150. 7:30walked in the front door into the little
  151. 7:32tiled area like entrance way
  152. 7:36thing what if anything did You
  153. 7:38observe when you made it to that point
  154. 7:43um looking into the living room I could
  155. 7:45see like the end of his feet and maybe a
  156. 7:48little bit of some legs that were kind
  157. 7:50of coming out around uh the backside of
  158. 7:53the kitchen area did you continue to go
  159. 7:57into the apartment no
  160. 8:00where did you go um Sarah told me she
  161. 8:03was going to call 911 and go outside and
  162. 8:06have a cigarette and a drink and asked
  163. 8:09me to come out there with her and I told
  164. 8:10her that I didn't really feel
  165. 8:12comfortable being inside and I went out
  166. 8:15front and got in my car and waited for
  167. 8:17people to show
  168. 8:19up did you witness the defendant call
  169. 8:23911 um I think I was in there when she
  170. 8:25dialed it and first got somebody on the
  171. 8:28phone but I wasn't there for the whole
  172. 8:31conversation now I was
  173. 8:33outside did you stay there at the
  174. 8:37scene while police arrived yes I I was
  175. 8:42there I was part of it I knew I'd have
  176. 8:44to talk to somebody
  177. 8:47so did you talk with law enforcement I
  178. 8:52did I have no further questions at this
  179. 8:56time thank you any cross-examination we
  180. 8:59want to reserve our questions for when
  181. 9:01we call in in our
  182. 9:03case okay all right sir you're subject
  183. 9:06to recall okay thank you thank you
