0:57um from that time yall moved you and
0:59your family your mother and father moved
1:01to Orlando and my grandparents okay you
1:05all moved down from Atlanta down to
1:06Orlando yes my two brothers okay and uh
1:10did you were you raised here essentially
1:12from that time on yes and you resided
1:15here in Orange County Florida that
1:16entire time yes okay and uh where did
1:19did you go to high school here locally I
1:21did where did you go to high school gr
1:24water okay and tell the jury uh how old
1:26were you when you graduated I was 18
1:29years old
1:30now I know you lost your mother and
1:32father uh over I know you lost your
1:36mother and father and your teens and in
1:38your 20s is that true I lost my
1:41grandfather when I was a sophomore in
1:43high school and I lost my father when I
1:45was a senior and then uh my mother
1:49passed away a few years after that and
1:51then my grandmother passed away after my
1:53mother
1:54died so you were in your 20s when all
1:56that was going on yes okay
2:00and then at some point in your 20s you
2:02met Brian Boone I did yes all right and
2:06did uh how long did y'all date before
2:08you married
2:10um a good handful of years my I helped
2:14my family with paying mortgage and bills
2:17for the house since my father had passed
2:20away and my grandfather so um so you
2:23worked outside the home I did okay can
2:26you tell the jury when you said you and
2:29Brian Bo
2:30um dated for a while do you remember uh
2:33when y'all married I do could you tell
2:35the jury when y'all were married the
2:37year yeah um you remember the date it
2:42happened to be yes that after my mother
2:43passed away that he had waited to ask me
2:46to marry him because he knew it would
2:48being um I actually not responsive
2:52sustained just just answer the question
2:54if you can miss bab are you are you a
2:56little bit nervous a little bit okay
2:58well just just tell tell the jury if you
3:00remember the date that you and Brian
3:02Boone married August 21st 2004 okay and
3:05had y'all lived with each other for a
3:07little a short time before that short
3:09time yes okay after you married how long
3:13was it before y'all had any
3:15children um
3:18gosh six years okay and y'all y'all have
3:23one son yes what's his name Lucas and
3:26how old is Lucas now Lucas will be 14
3:29years old on the 28 28th of this month
3:32yes okay so you and Brian um were
3:36married and y'all lived in Orange County
3:39how long were you all married for 13
3:41years right and Y all divorced yes and
3:46as part of the divorce were youall to
3:47share custody of your son
3:50yes so y'all had split days would that
3:52be fair to say yes okay it's sometime
3:56after you and Brian split up did you
3:58meet George
4:00Torres yes all right could you tell the
4:03jury how you met George
4:05Torres um I Met George
4:08when I decided
4:11to Buck up I guess and was tired of
4:15trying to patch things up with my
4:18ex-husband and I decided to go one day
4:21for a walk across the street and go have
4:25a beer by myself and sit in people watch
4:27just to get out of my house and a change
4:30of scenery all right now this is is this
4:32your
4:33apartment no this is the marital home
4:37okay where is that marital home Winter
4:41Park you're no longer living in that
4:43marital home no who lives in the marital
4:45home um no when it has been sold
4:48okay so this you met George Torres
4:51before you got the apartment yes okay
4:54and you met him at a bar across the
4:56street from the marital home yes we had
4:58a mutual friend there
5:00were you introduced yes all right how
5:03did you and
5:05George um get along when youall first
5:08met um very well it
5:12was
5:15um it was strange how quickly we hit
5:18things off and had so much in common and
5:22um I never thought that he would be
5:25interested in someone like me and I
5:29just couldn't believe that he was
5:31actually interested in me and said a lot
5:33of nice things and
5:35um one hour ended up being four hours um
5:39from when we had first met and then we
5:40would always have something to talk
5:41about why why couldn't you believe that
5:44he would be interested in
5:47you um he was very handsome um he was
5:50very funny
5:53um he was smart and
5:57I would show up in workout clothes and
6:00disheveled hair and I guess I kind of
6:03felt broken from being in the process of
6:05the divorce that he knew about but then
6:07one of the things that we could relate
6:09also was the fact that he was here in
6:10Florida because he had just been
6:13divorced from his second wife so that
6:15was another um topic that he and I could
6:18compare notes
6:20on So eventually the divorce was settled
6:23did you get your own place
6:26yes is it fair to say that
6:30after
6:33you at first you lived in your your
6:35parents home correct yes until I was
6:37married and then you moved directly in
6:39with Brian yes and then y'all lived in
6:42the marital home correct yes and then
6:45you got this apartment yes so that was
6:47the first time in your life that you
6:49actually had your own place yes and what
6:51was the
6:52address 4748 France Court Apartment
6:56number three and what city is that in
6:59it's in water
7:00how far is that from
7:02here 20 minutes
7:04okay so you got that apartment and uh
7:08initially were you by
7:10yourself um no all right tell tell the
7:14jury um in the almost year about 10
7:18months of separation from Brian my
7:21ex-husband that is the time when I met
7:24uh George and my ex-husband was trying
7:27to buy me out or for me out of our
7:30marital home and I needed to find
7:32somewhere to live and um so did you did
7:36you and George agree to rent the
7:38apartment yes one of the I needed extra
7:42income we could not afford it um just on
7:45my own you were receiving some income
7:47from the the marriage settlement were
7:49you not yes so you you did have a
7:52consistent monthly income coming in from
7:54the uh settle marriage settlement for
7:57the most part yes but you needed you
7:59needed more to to uh live yes to pay the
8:03bills and for rent so did you and George
8:05have some agreement we did all right
8:07what was the agreement the agreement was
8:09that if I decided um for he and I to
8:12live with one another because it would
8:14be under my name that he would help with
8:18the monthly bills and on a regular basis
8:21where it wouldn't be something that I
8:22would have to argue with him about it
8:23would just be an
8:25automatic um make sure that everything's
8:27paid first and then from there hopefully
8:29have fun with it okay so I understand
8:32from that point
8:34on um would it be fair to
8:37say that yall saw each other on and off
8:42for about the next three and a half
8:45years no um we were I I would consider
8:50us a couple at some point he asked me to
8:53marry him okay but y'all y'all did have
8:56times where he left and went to live
8:58with his parents yes is that is that
8:59fair yes and there were times where uh
9:04there was an understanding that y'all
9:05were going to break
9:07up multiple times
9:11okay all right
9:13so again on again off again yes this was
9:17actually before we had our um apartment
9:21that was I guess our dating phase okay
9:24so y'all were together for three and a
9:26half years is that fair MH yes and y'all
9:29had actually agreed to marry he had
9:33asked me yes um a couple of times to
9:35marry him and one time I agree to yes
9:40okay now I want to get directly to the
9:43date of this event so that the jury can
9:47hear your testimony all right so tell us
9:52I believe the date is February the 23rd
9:54of
9:562020 explain to the jury that whole day
10:00from the time y'all got up the whole
10:04thing

11:16now now miss Boon let's just instead of
11:20one long speech let me break you up over
11:23the course of the day so do you remember
11:25the date of February 23rd 2020 yes do
11:29you remember getting
11:31up yes all right just tell the jury
11:33about the morning what y'all did that
11:35morning what you and George George you
11:37and George spent the night together at
11:39at the apartment yes at that point he
11:41was living there yes so y'all slept in
11:44the bed together
11:46upstairs February so you got you would
11:49have gotten up y'all would have gotten
11:50up that morning February 23rd of 2020
11:53yes all right tell the jury what
11:55happened when y'all got up um he was
11:58already down downstairs and I went
12:02downstairs and he wanted to start the
12:05day off by drinking because it was a day
12:07off from his job and I taught him
12:12into cleaning and tidying up the house
12:14for a sense of accomplishment um so that
12:17is what we did um for however long that
12:21it took um so we did tidy up the house
12:24and got everything in order and it was
12:27kind of a reward I guess to be able to
12:29sit and enjoy ourselves and um sit on
12:33the back Fort all right what do you mean
12:35by cleaning up the house what did you
12:36all do um we swept and mopped we folded
12:39some of the laundry um I know that we
12:42did the dishes um emptied the dishwasher
12:45just general run-of-the-mill tidying up
12:48and did you have your son coming the
12:51next day yes that was one of the reasons
12:53why we we were able to do that what was
12:56the arrangement you had in terms of the
12:58next day would have been your day to
13:00pick up your son from school yes what
13:02time would you pick Lucas up from school
13:04the next day I believe his school ended
13:07at 3:00 okay so you would have been
13:09responsible to pick him up and he would
13:11be spending a night with you that night
13:14yes so you wanted to have the house nice
13:15and clean yes how many bedrooms are in
13:18the home two and uh you and George had
13:22one bedroom yes and who had the other
13:24Lucas right is that exclusively his
13:26bedroom yes
13:29all right so how long would it have
13:30taken y'all that morning to
13:33clean um I don't really remember what
13:35time we woke up um but maybe a good two
13:40maybe three hours okay and would it be
13:43fair to say that you and George both
13:45smoke cigarettes yes and would it be
13:47fair to say that you and George both
13:50drink alcohol yes so at some point y'all
13:54finished
13:55your chores right and then y'all were
13:58going to join the day yes right what was
14:01the
14:02plan um it was just kind of you know
14:05we've got the day to ourselves just kind
14:07of relax and go with the flow all right
14:10were y'all did y'all make a decision
14:12that y'all were going to start drinking
14:14um yes he we had a a half of a bottle
14:17that was already in the refrigerator and
14:21I did not want to go out afterwards I
14:24again had Lucas coming the next day so
14:27we went over to public to purchase
14:30another bottle of wine um so we could um
14:34not have to go out later on that evening
14:36now you you were here in court when the
14:39state the state played the video of you
14:42two and the Public's purchasing the
14:44bottle of wine yes is that what you're
14:46referring to here with the jury right
14:48now yes okay and that was around
14:51Nish I believe so yes okay had y'all
14:54started drinking the the leftover bottle
14:57before before going to the public no
15:00okay
15:02so y'all bought a bottle of wine yes all
15:05right and how did y'all get to Publix my
15:08car how far is Publix from your
15:13apartment five minutes how would you get
15:15there from your apartment what do you
15:18need did you have to go across City
15:20major highways or is it right there um
15:23you just come out of our um apartment
15:25complex and you do a little U-turn and
15:27then you come up and it's right in that
15:28complex okay okay but it's easier to
15:30drive than to walk yes okay I know at
15:34sometimes y'all would y'all would simply
15:35need cigarettes and it was in walking
15:37distance can you tell the jury about
15:39that yes um there was a aot Zone
15:42convenience store with um in the same I
15:46guess parking lot of our town home our
15:49complex and it was just a straight shot
15:52from our um apartment to a back gate and
15:56you could get right into the convenience
15:57store from right there okay but y'all
16:00went over to get that bottle of L around
16:01noonish and how did y'all Y you took
16:03your car yes did George have a vehicle
16:06he did
16:08not and uh how did you pay for the one
16:10with my debit
16:12card and then y'all came back and
16:14started drinking yes okay tell us what
16:16you did when you got back from the
16:19Publix um just went on the back porch
16:22where we um usually spend our time
16:26because we're able to smoke cigarettes
16:28outside as opposed to
16:30inside and is cigarette smoking not
16:32allowed indoors it is not okay do you
16:36have pets yes I do well did did you have
16:39pets I did yes okay
16:44um were they with y'all there that day
16:47yes my dogs were with me all the time
16:49when I was there how many dogs do you
16:51have I have two and uh just what are
16:54their names Penny and Tess and
17:00um they are red Boston carriers and are
17:02they both the same um yes penny is blind
17:06and te is
17:08deaf so when y'all went out to
17:12smoke on the back porch and drink I
17:15assume as well correct yes um did y'all
17:18take the dogs out oh yes all right is
17:21there a place for them to do their
17:23business out there um yes I extended our
17:28back por
17:29um for them to have a little bit of area
17:32as opposed to going from a large back
17:35yard from my marital home to our little
17:37town home and um they would come out
17:40there and do their business and I could
17:42sometimes open I would open the gate and
17:43then walk them in the back part of our
17:45um apartment so you and George were just
17:48going to enjoy the day together correct
17:51is it fair to say you don't have a lot
17:52of money yes and so y'all were going to
17:55do something there in the home y'all
17:57weren't going out for dinner
18:00yes we primarily I would consider us
18:02home bodies as opposed to going out and
18:06partying and doing this and that okay
18:09and how long do you think yall were out
18:12uh that afternoon
18:15outside um a few hours could you tell
18:18the jury what y'all
18:20did during that time um we have a dart
18:23board that's out there
18:26and we just had and we're uh just really
18:31enjoying each other's company and
18:33talking about you know things up coming
18:35you know um we both were looking for a
18:38job and just kind of I guess encouraging
18:42and supporting and
18:45planning well now you said he had a job
18:48was he looking for a job a second job no
18:51the job that he had was very unstable
18:54and at that so he was looking for
18:56something to yes at that time yes yes
18:59okay and so during that two or three
19:01hours would it be fair to say that y'all
19:03drank the
19:05bottle yes okay so would it be fair to
19:08say that y'all were feeling the effects
19:10of the
19:11alcohol yes okay at some point who made
19:15the decision to come in I did okay why
19:18why did yall why did you want to come in
19:20I felt that George needed a change of
19:22scenery okay so y'all came in and then
19:26um
19:29did y'all do anything else before he
19:31left again were y'all doing anything I
19:35know y'all y'all did some arts and
19:37crafts what what did y'all do at some
19:40point he went to get another bottle at
19:42Publix yes um after I believe it was
19:46after we had it was right before I
19:48believe that we had gone inside um
19:51because uh he called his daughters I was
19:54trying to encourage him to call his
19:56family okay now where where are his
19:58daughters
19:59um his two daughters are located in
20:01Pennsylvania and what are their names
20:04Anna and
20:05Destiny and how old are
20:07they I believe that Anna is in her 30s
20:11and um destiny may be in
20:14her early 20s all right does he have any
20:17more children yes he has a son and what
20:21is his son he is in Pennsylvania also
20:25okay so part of that afternoon as y'all
20:28came in to call relatives call family no
20:32I had him call
20:33outside um just trying
20:37to I guess boost the mood um
20:42and uh the first daughter didn't answer
20:45and I don't remember the reason I didn't
20:48speak to the second one it I believe if
20:50he did it was just for a moment right
20:52now whose phone were weall using my
20:54phone all right and is that common for
20:57y'all to use that were youall to share
20:59that phone it was because George said
21:02that he didn't have a phone so um it
21:05would either be lost
21:06or um given to him by his mother so I
21:12didn't know he had a cell phone so we
21:13would use my phone so it was primarily
21:15your phone yes okay and um you took a
21:20lot of photographs that were on that
21:22phone yes vide tapes yes text messages
21:26yes phone call he and I both on the
21:29phone calls so he would use it as well
21:32yes and uh that phone is that the one
21:35that was that was seized in this case
21:40yes all right so y'all called his
21:45daughters and then um during that phone
21:48call period did you also call his
21:50brother yes okay and who which brother
21:53was that John now how many how many
21:56brothers and sisters does George have
21:59yeah um I'm going to list him if that's
22:03okay okay um it's John
22:07barell Isaac
22:11Mo and his
22:14sister okay and do they all live here in
22:16Florida yes are they close by as far as
22:19I know yes what about his
22:21parents yes they live here as well yes
22:25okay but his Ex-Wives and and his
22:28children live up in philad Philadelphia
22:32yes
22:34okay so you called called the girls then
22:37you called uh or George called his
22:40brother yes was that conversation that
22:43long no it was not
22:46okay and then after that phone call U
22:49what did y'all were y'all Inside by this
22:51time yes at this at this point I believe
22:55that it was a good time to get a change
22:57of scenery so I thought George would be
23:01better off inside and frankly I didn't
23:04want to be outside any longer
23:06either so just to get an idea about this
23:09time is when he went to get the second
23:11bottle or did y'all stay inside for a
23:13while before he left no um from what I
23:16recall it was I thought the day was over
23:19and it was going to
23:21be um get ready for the evening for the
23:24day what maybe what do you want for
23:25dinner you know do you have an extra
23:27load of laundry that you need to throw
23:29kind of thing and that was my
23:31understanding and this was this was
23:33about fiveish or something I don't
23:36remember the time okay at some point
23:39during that time period did George go to
23:42Publix again yes I thought he was going
23:45to be walking to the convenience store
23:48but apparently um when he returned he
23:52had gone across the street with my car
23:53and my debit card to buy another bottle
23:55of wine what was your understanding of
23:57where he was going
23:59to the convenience for walking for what
24:02cigarettes okay and you've learned you
24:05learned obviously that he came back and
24:08you you learned that he'd used your
24:09vehicle yes and he'd used your debit
24:12card yes and he' brought back a bottle
24:14of wine from Publix right and you saw
24:17the uh the Publix video of that
24:21yes so he comes back with the other
24:24bottle of wine and did he want you to
24:26drink with
24:27him was expected yes yes and you agreed
24:31to consume the one the second bottle
24:33with him yes okay so over the course of
24:36that evening drinking the wine did what
24:39did y'all do for time wise uh watch a
24:43movie music just kind of tell the jury
24:45what you remember I know it's obviously
24:47been a while
24:48but um it was kind of a regular thing
24:51where um I would always try to come up
24:54with um entertaining activities for
24:58George and
25:02um for um I bought a a puzzle um we
25:07started off uh at one point doing a
25:10smaller puzzle and then we did that very
25:12quickly so then I purchased a larger
25:14puzzle and I believe it was a thousand
25:16pieces so I thought to get his mind off
25:19of things and to focus on
25:21something um it would be smart for us to
25:24do the puzzle so for however long that
25:27took um we finished the puzzle so that
25:31was one did you did you every piece was
25:33finished or was um every piece was
25:36finished it was strange that we couldn't
25:38find one piece and we thought it was
25:39funny that um it was like in like the
25:41perfect place on there but yes every
25:43everyone but one piece all right after
25:46the puzzle what did what did y'all do um
25:49I decided to continue to maintain and
25:54focus him and I have a bunch of paints
25:59that I used of my sons that um his
26:03grandmother bought him it's a very big
26:05art wooden box and it's got pastels
26:08pencils paint any kind of whatever and
26:11um he and I were very much into art and
26:14with these with this resource it got him
26:16very interested in being more creative
26:19how long have you been
26:20inor um ever since I can remember as a
26:24child you like to draw I like to do
26:27anything
26:29and I know you know we saw some of the
26:31pictures of your apartment but it looks
26:33like there was pictures and artwork up
26:35is that all your work and George's work
26:38the majority of it yes are U belongings
26:40from my home um and then also some of
26:43George's yes on the wall was he pretty
26:46good at art as well yes all right so you
26:48both enjoyed doing that very much so y
26:51all got out Lucas's art set what did
26:54y'all do with that um we were just I
26:57guess
26:58doodling you know whatever I would
27:01always tell him that everything that you
27:03make is a masterpiece so um just let
27:07loose and just let it go and we would
27:10just paint
27:12and paint and drink yes and uh listening
27:14to music sometimes and yes okay now with
27:18the dogs did y'all get the dogs involved
27:20oh yes my dogs follow me everywhere yes
27:23was there some dancing going on with the
27:24dogs yes after we had completed the
27:27puzzle and
27:28and
27:30um I guess we painted out um I thought
27:34that it might be a good point for us to
27:36maybe listen to some music um
27:40and the music that George listens to is
27:43a little it's very fractious to me and
27:46it was definitely not going to lighten
27:47the mood so we ended up finding some
27:49channel on the radio and um he was
27:53feeling it and then we ended up my one
27:55dog um gets very active and was dancing
27:57with us and we were just just um having
27:59a good time listening to music okay and
28:03um I guess it's getting pretty late in
28:05the
28:06evening yes anything else I've
28:10missed I don't believe so all right so
28:12tell us tell us where y'all ended up
28:15before before you started the game of
28:18hide and
28:20seek uh we were there I couldn't think
28:24of anything else possibly that I had to
28:26continue entertainment
28:29but I remember sitting at the end of the
28:32couch and him sitting in my son's one of
28:36my son's chairs that was in the living
28:38room and just kind of doing this like
28:41what are we going to do now like I very
28:43much would like to go to sleep had y'all
28:45had y'all finished off the
28:48uh that bottle that he had
28:51bought I don't remember to be honest
28:54with you bless you would it be fair to
28:56say that as the they wore on the more
28:59y'all
29:02consumed yes and would it be fair to say
29:06that as the day wor on the more you
29:08consumed the more the more effects you
29:10felt from the alcohol of course yes both
29:13both of you yes okay so you would agree
29:17would you not that at the time y'all
29:19were trying to figure out something to
29:21do and you put your head on the couch
29:24that y'all would it be fair to say that
29:25y'all were intoxicated
29:28yes tell the jury what
29:32happened um at one point I guess he knew
29:36that I couldn't come up with anything
29:38else um tapped me on my knee and said
29:40you're it so from there I ran up the
29:45stairs and hid
29:46into um our shower
29:50um just waiting for him to find me so we
29:54could hopefully go to sleep soon at some
29:56point and um
29:59your shower is it uh is it a tub or just
30:01a Walkin it's a tub um but it's in the
30:04master bedroom and you have to go all
30:06the way upstairs you have to go in the
30:07bedroom and then you have to go into the
30:09bathroom part and then there's the
30:10shower part so did you lay down in the
30:12tub I at first at one point yes I was
30:15okay so you were
30:16hiding I was trying okay and did you
30:20believe that he was going to come try to
30:21find you
30:23yes did you
30:25wait yes for quite some time all right
30:28then what did you decide to do that I
30:31decided that I need to go to sleep I'm
30:33picking my son up the next day and we
30:36need to start wrapping up the evening um
30:40and I went downstairs to find where he
30:43was and what I think I think the jury
30:47has seen pictures of your would you call
30:50it an apartment or it's considered a
30:53town home a town home so you walk down
30:56the stairs
30:58right mhm and at the bottom of the
31:00stairs is a bookshelf here yes at the
31:03very end of it yes okay so you walked
31:05down the stairs and you turn and look in
31:07the living room did you what did you
31:10see um I don't even think I made it all
31:12the way down the stairwell because I was
31:14just looking for him as soon as I could
31:15um to hopefully go upstairs as soon as
31:17we could and
31:20um I saw I looked over and I saw him
31:23settling himself in the suitcase right
31:25tell us about the suitcase how how long
31:28is it an older suitcase yes who whose
31:30suitcase was it this is George's
31:33suitcase all right and did he use it for
31:35traveling back and forth to Philly yes I
31:38had uh recently taken him on a trip to
31:42go see his children in Pennsylvania who
31:45he hasn't seen in years and we took that
31:48with us and uh because of how
31:51dilapitated it was how broken it was um
31:54in the end after that trip we decided
31:56that we would donate it s right and uh I
32:00understand y'all kept y'all kept the
32:01suitcase upstairs yes how long did y'all
32:04keep it upstairs since we had moved
32:08in is there is there a closet up there
32:11you kept it in yes it was in the master
32:13closet um the master bedroom closet all
32:16the way in the back because of um the
32:18size of it and there was nowhere to put
32:19it so all the way in the back so when
32:22did y'all decide to move it down from
32:24upstairs to downstairs was it that day
32:26or sometime earlier no it was
32:28um maybe a week or so prior okay and so
32:32what y'all were going
32:34to donate that to Goodwill or yes we
32:37were going to do I guess a spring
32:39cleaning um my anyone who has children
32:42understands that they grow quickly and
32:44there was a lot of clothes that I needed
32:47to um go through um of my sons and then
32:51also from George and I moving in and
32:54just kind of putting everything in there
32:56you know at one point where we just
32:57needed to actually go through it and
32:59organize it and get things um more in
33:01order so is that the reason it was
33:04downstairs you were going to donate it
33:06and a bunch of things that you're going
33:07to put inside of it correct yes okay so
33:10it had been down there a week so it was
33:12already down there yes George brought it
33:13down okay so you said that you got down

33:28obviously not going to be going to sleep
33:30anytime soon and
33:32um I walked over and um he was trying to
33:36get himself flat so I couldn't tell that
33:39he was in there and then now let let me
33:41stop you there the suitcase is it the
33:43suitcase over here in the yes the Box
33:46have you've seen it you saw it yes uh
33:49it's a pretty big suitcase yes how how
33:52big is George George was my height um
33:57and how tall are you I'm 53 okay and how
34:01much did uh George weigh I I thought it
34:06was 100 PB okay and how much did you
34:08weigh um I was 98 pounds all right do
34:12you agree you you put on some way since
34:15I've been incarcerated
34:17yes well at the time though y'all were
34:20y'all were pretty skinny yes so um from
34:25the pictures it looks like y'all were
34:26both pretty thin
34:29yes all right so because of his thinness
34:33um is that how and he's he's a small man
34:37yes okay so he was able to get in the
34:39suitcase on his own yes did he willingly
34:42get in the suitcase he was already in
34:44there okay when you got to him did he
34:47see you yes all right tell us what
34:50happened um I I
34:53mean I just kind of I zipped him up we
34:55thought it was funny and um were joking
34:58about how he
35:00was guess small enough to fit inside of
35:03the
35:04suitcase right so what happened
35:06there um from there it was just um we
35:11were laughing about it and
35:15um it was just strange that he was small
35:19enough to fit in there and then um I
35:22kind of moved it around a little bit
35:25with him in the suitcase still it was
35:27was still funny that he was still in the
35:30suitcase just I think he and I were just
35:33kind
35:35of couldn't believe that he was he could
35:37fit in the
35:38suitcase did you eventually close the
35:41top yes in order for well the top was
35:44already closed as he was settling
35:47himself in there it was that's how I
35:49knew he was in there was because the top
35:51was kind of flopping a little bit so he
35:53had got in there to hide and he pulled
35:55the top yes on top of it but you could
35:57tell it was isn't it yes you saw him
35:59right away yes all right so at some
36:01point did you zip him up did
36:05you and what was he saying or doing when
36:07you were zipping him up we just thought
36:10it was funny um were you both laughing
36:13MH
36:14yes and um so you zipped him up were
36:18yall still laughing once you zipped him
36:19up yes tell us tell the jury what
36:22happened then um from there I just I
36:26moved the suitcase around uh a couple of
36:28times just kind of with on the wheels
36:31and moved it around and um at that point
36:35it was still it was funny we were joking
36:37and laughing about it all now eventually
36:41did you go sit down on the couch and get
36:45your
36:46phone um yes um the
36:49something
36:52um well I the suitcase had um
36:58me moving it around had flopped was
37:01flopped over so while it was like that I
37:05thought at that point I had a moment
37:09to I guess take the time to talk to him
37:14while I guess he was not able to get out
37:19for a moment so you flipped
37:21it you got you got it on the top right
37:24it gets in but at some point you flip it
37:27over so so he the zipper is on the
37:29bottom well it was just kind of how I
37:31was moving it around then it ended up
37:33kind of flopping so it was upside down
37:37yes so after you did that what did you
37:40do um that's when I I went over and
37:44decided to um videotape
37:49to just see the um I guess the the
37:54justest in it for
37:57to understand that right now I feel safe
38:01and right now I have the ability to
38:03actually speak to you um in a manner
38:06that normally I would not have the
38:08ability to do and you were intoxicated
38:12yes and you would agree that you said
38:17some things you should not
38:20yes but you you realized he could not
38:23get out and get at you is that fair at
38:26that moment yes so the it goes on for
38:28about 10
38:31minutes um yes did you heard it here
38:33today did you not yes you heard you
38:36heard his voice as he was speaking from
38:39the suitcase yes that was his voice on
38:42the video and audio yes and you heard
38:44your voice on the video and audio yes
38:47that was your voice yes all those things
38:50said by the man were said by George in
38:53that two-minute video correct all the
38:56words said by the female were said by
38:58you in that two-minute video correct
39:00were you intending on showing him the
39:02video the next
39:04day
39:06yes at the time or the next day was it
39:09fair to say you don't even remember a
39:10video tape I do
39:13not
39:15so from what you can tell from watching
39:18it did that refresh your memory about
39:20that event I
39:25did why did you s

41:41the two-minute video part that we
41:43recorded could you just tell the
41:48jury what you were feeling what your
41:51feelings were at the time and then
41:54explain just explain that to the
41:58you mentioned you talked about it before
42:00you said he was in that confined space
42:02and it was my chance but is that do you
42:04want to elaborate on that or sure
42:07I I want you all to know that I the
42:11majority of the time am always afraid
42:12and always scared all right
42:15well I understand that okay I understand
42:19that but um would it be fair to say
42:24that you had some anger at that point
42:27I did I would it be fair to say that you
42:30wanted to tell him off to some degree I
42:32just wanted yes for him to have a better
42:36understanding um which was the whole
42:38point of the videos and documentation
42:40prior and you could tell that he was
42:44uncomfortable I'm
42:46guessing and did did you want him to
42:49feel some
42:52uncomfort I did okay
42:57now at some
42:59point you turned off the video
43:03yes and then we
43:05saw a second video which was
43:08approximately 11 minutes later and
43:10you've seen that video it was played to
43:12the jury it was 22 seconds long yes and
43:15I don't think you speak in that video
43:18you hear George say Sarah one time yes
43:20is that fair to say
43:23yes so between the two-minute video
43:27and the 22 second video is an 11 minute
43:31period would you tell the jury what
43:34happened um we continue
43:36to I guess speak to one another
43:40and um his tone changed and
43:46I knew the tone and um we ended up I
43:51guess arguing back and forth with one
43:53another and
43:59it
44:00was the things that he was saying um
44:03very much frightened me and um cursing
44:07at me and threatening me and did he want
44:11you to let him out of the
44:13suitcase um I'm I'm sure so go
44:18ahead um and it just got it got very
44:22heated very quickly and he continued to
44:25push on the suitcase
44:27and um my fear was that he was going to
44:30break out of the suitcase knowing that
44:32it was a broken
44:33suitcase and
44:36um his hand started to come through his
44:39his hand started to come through this
44:41way and so I shook the suitcase I shook
44:45the suitcase trying to get his hand to
44:47go back in shaking it and telling him
44:50that please stop doing this please
44:52please stop doing this to me please stop
44:54doing this to me so his hand his hand
44:57actually got out of the suitcase yes and
44:59you went to the suitcase yes and shook
45:01it yes did that Force his hand to go
45:05back in
45:06no um so you're shaking it were you
45:10shaking it to try to get the suitcas his
45:12hand back in yes how long did you shake
45:14it I don't know but his hand was still
45:17out yes was he trying to get out
45:21forcefully yes was he angry at you yes
45:30were you in
45:31fear
45:34always if he would have gotten out of
45:36the
45:38suitcase what would he have done to
45:40you like he used to tell me he probably
45:43would have made me unrecognizable or I
45:45would have uh lost my
45:50life did you lose the grip on a suit
45:53kit yes
45:57where was the bath in relation to the
46:00suitcas um it was um leaned up against
46:03the dining room table right
46:07there how far was the bat from the
46:11suitcase 3et
46:142et was the sand still out of the
46:17suitcase yes and was he getting out of
46:19the suitcase he very much was trying yes
46:23and so what did you do for the Split
46:26Second reaction that I had I happened to
46:28see that and I grabbed the baseball bat
46:31and was trying to poke his hand to go
46:34back in to please don't go don't break
46:36through please so I hit his
46:39hand did you
46:41hit the outside part of his hand yes
46:45we've seen the photographs of his left
46:47hand did you cause the bruising there
46:50I'm guessing
46:52yes now you've seen the backat
46:58it's a a Ed B yes I bought it for my
47:04son is this the bat you used
47:08yes
47:10and you said you poked him with it yes I
47:14I kind of
47:15pushed um like I held it with the skinny
47:19part here and then so so the grip here
47:22Pro it at it yes you grabb you grabbed
47:25it with both hands here yes and then the
47:28barrel of the bat the big part of the
47:30bat is here correct and you thrusted it
47:34into the different areas of the suitcase
47:37I started with his hand and his hand he
47:39was still trying to get out he was still
47:42trying to do that so I started to push
47:45on the suitcase around it hoping to have
47:48his hand retract and go back inside
48:01you made those
48:02injuries I
48:04did we've seen the photographs yes we
48:07see the the bruising is that from that
48:11bat
48:14yes
48:17eventually did his hand go back inside
48:20from you
48:22doing yes finally he had had subsided
48:26retracted his hand so in your mind did
48:29you prevent him from attacking you
48:31absolutely Split Second decision now
48:34once he retracted his
48:37hand did do you remember zipping it up
48:39some or what did you do in relation cuz
48:42he he was upside down was he not at that
48:45point yes at some point you flipped him
48:48back up I did tell tell how that
48:52happened he
48:55wasn't cursing wasn't threatening he his
48:58hand was inside foremost there was no
49:01more of him trying to break through the
49:03suitcase so I
49:08felt safe enough to turn it back over it
49:13wasn't it wasn't happening
49:19anymore you went back to the video and
49:22the
49:24couch I did yes
49:27and we saw the second video yes the 222
49:30and he's right side up again yes and you
49:35hear him say

49:38yes had you left enough room for him to
49:41get out zipper to zipper yes that's how
49:45his hand was trying that that suitcase
49:48has two zippers doesn't it and they meet
49:50at various places along the line correct
49:57how much room when you flipped it over
49:59how much room was between zipper to
50:03zipper I don't know specifically I mean
50:06it was enough to where his hand was
50:08coming
50:11out after you would hit him with the bat
50:13was he not trying to get out anymore
50:19no did you believe that he could breathe
50:21in there yes did you ever believe he
50:25could die in there
50:27no at all were you trying to kill him
50:31never did you want to kill him I did
50:45not did you walk
50:48upstairs I did yes why didn't you let
50:51him out before you walked
50:55upstairs you you
50:58afraid terrified is more of the
51:02word as long as he was in the suitcase
51:05he couldn't harm
51:07me
51:13right when
51:21he's did you want him to calm
51:24down yes I wanted him to stop being
51:27angry because I know what it is for him
51:29to be
51:30angry you went
51:33upstairs where were the dogs the dogs
51:36ran upstairs with
51:39me and where did they
51:41go um on the
51:49bed did you have the phone with
51:52you yes I know at some point you called
51:55your husband Brian did you not I
51:59did do you recall how long that
52:01conversation was not very
52:07long can you recall what was
52:10said I don't remember exactly no I don't
52:40Miss sah you said that when he was in
52:44the suitcase he was threatening her
52:46threatening you can you tell the jury
52:49what he was
52:52saying I don't know am I allowed to
52:55curse
52:58yes um that he was going to [ __ ] end
53:02me and
53:04it that's what made me ask him please to
53:08stop doing what he's doing to me
53:11that he was going to I'm guessing try
53:15his best that night to probably take my
53:18life but
53:20what the the threat you heard was he's
53:23he's going
53:24to say say the word and me excuse me
53:28[ __ ] and me and you
53:33yes so I think we left
53:37off you had called
53:41um your
53:43ex-husband
53:45yes all
53:47right after after you called your
53:50ex-husband what happened after
53:53that I ended up falling asleep
54:01okay do you remember waking up the next
54:04morning yes did you sleep
54:09in not
54:10intentionally okay but you didn't get up
54:14at 8:00 did you
54:17no did you wake up closer to
54:20noon I believe so yes did you check the
54:24time no
54:28now um did you hear some phone your
54:30phone ringing yes my phone is ringing
54:34and uh did you answer it right away
54:38no
54:41uh do you know how approximately how how
54:44many times it rang before you answered
54:48it um I believe called was about three
54:52times do you know who was calling I
54:55figured it was my ex-husband
54:57and why would he be calling um to make
55:00sure that um I was still on schedule to
55:03pick up our son at 3 that afternoon
55:07correct and he goes to school there
55:09close by
55:15yes all right when you woke up did you
55:19stay in bed for a while for a little
55:21while
55:23yes all right tell the jury what
55:24happened when you got out
55:30I knew it was my ex-husband calling um
55:32repeatedly
55:35um I didn't answer right away because
55:38one of our problems is that he doesn't
55:40understand that I'm doing things around
55:42the apartment and looking for jobs and
55:43so on and so forth so I
55:48inevitably just let it rain and I sat or
55:51I laid in the bed
55:53and I figured that George was downstairs
55:55either drinking or um looking for jobs
55:59um or may have just left and So
56:04eventually I decided to get out of the
56:07bed and start moving to go downstairs I
56:10was motivated enough to go downstairs
56:12and
56:14um when I went downstairs it was very
56:16quiet so I had the understanding I
56:19believed that he had left um and did you
56:23check to see if he was where would he be
56:25looking for a job
56:27um usually on the couch he would have my
56:30son's laptop and he and I which we would
56:32share y only have the the son's laptop
56:36correct and the TV was not working at
56:39this
56:40time the TV was not there okay so you
56:45thought he would be in the living room
56:47on on the laptop yes he was not there no
56:51where else did you look for um I looked
56:53on the back porch um I went through the
56:56front door um to see if my car was there
56:58thinking maybe he had taken my car um I
57:01checked the bathroom and when I was
57:02checking the bathroom I saw the suitcase
57:04and I
57:05remember about the night prior
57:10and I unzipped the suitcase and let me
57:15stop you
57:23there you said you were in the bathroom
57:26when you saw the suitcase or coming out
57:27of the bathroom no where our bathroom is
57:31I would have to go to the bathroom here
57:34and then when I turned around I noticed
57:36the suitcase and I remember how did you
57:39feel when you saw the
57:41suitcase I don't think I've ever
57:43experienced anything like that before
57:46describe it to the
57:49jury I guess it
57:53was I was a gas and
57:59and I just can't describe the feeling
58:02Terror to a certain degree sorry say
58:04that again now it was Terror to a
58:06certain
58:07degree
58:10um I just can't describe it in words the
58:14feeling of
58:16remembering and then he was still in
58:22there so what did you
58:24do I immediately unzipped
58:28the I immediately unzipped the suitcase
58:31and I was screaming George George George
58:35and I was shaking him I was shaking him
58:38and I pulled him out and I stretched him
58:41out flat and then I began instantly
58:44trying to do CPR and then was trying to
58:47look for a pulse or a breath or just
58:49anything and um was just screaming his
58:53name over and over and over again and
58:55come on on George come on
58:57George and I continued CPR continued CPR
59:02and I continued CPR and um he was
59:04gurgling and what color was he what
59:08color was he yes he was
59:14purple at some point did you call your
59:16your ex-husband yes when he started to
59:20gurgle and I knew that
59:24my my ex-husband is notorious for
59:27bringing my son over in very inopportune
59:29times when George is possibly drunk or
59:33doing things not appropriate for my son
59:37to see and um I just didn't know what to
59:40do it was just a quick knee-jerk
59:43reaction Ryan was kind of my go-to
59:46person because of my family being
59:48deceased and I don't have anyone else
59:49that I can call um and I just wanted to
59:52ensure that he would not bring my son
59:54over in the process of all of this at
59:56some point so you called him I called
59:59him did you ask him what to
1:00:02do or did you just tell him to come over
1:00:04I just told him to come over did you
1:00:06tell him that you felt like George was
1:00:09dead yes I
1:00:12did and how far you said it's 5 minutes
1:00:16from house to
1:00:18house yes did you call him back yes
1:00:22because he was taking so long it felt
1:00:24seconds for hours yes I'm still doing
1:00:28CPR at the same time in the process of
1:00:30it I'm doing CPR I don't know how many
1:00:32times did he get there yes did he walk
1:00:36in yes did he walk out yes what did he
1:00:39tell you to do call 911 what did you do
1:00:43I called 911 is that the recording we've
1:00:47heard here in this trial yes

1:01:11day George was
1:01:14very passionate George was a very real
1:01:20person George was nice to me on the good
1:01:23days George complimented me
1:01:30George and I were
1:01:32two bodies with one Soul he and I would
1:01:34always say I don't believe that I've
1:01:37ever had a connection with anyone like I
1:01:39have with George did you have that
1:01:41connection with I did not was it even
1:01:45close
1:01:51no George has some good traits doesn't
1:01:53you very much
1:01:57did George have some bad
1:01:59traits he
1:02:01didn't did you drink too
1:02:04much I did did George drank too much yes
1:02:08tell the jury about George's
1:02:15drink if George was able to he would
1:02:17drink from sun up to sun down
1:02:21and me having my son and trying to work
1:02:25and
1:02:26maintain the home and just have a life a
1:02:30normal life as best as I could somehow
1:02:34that upset George and because I had a
1:02:40certain dollar amount from my divorce
1:02:43settlement at one point it was from wine
1:02:46we could afford vodka so a lot of the
1:02:49times he would take my car and my debit
1:02:52card and go buy the large we call them
1:02:55handles
1:02:56of vodka which is the big big bottle and
1:03:00sometimes he would finish that all off
1:03:01on his own throughout an entire period
1:03:04um of a of a day of a day into an
1:03:07evening that's honestly where I thought
1:03:09that he was going to be that morning
1:03:10when I came downstairs because he's
1:03:12notorious for just automatically already
1:03:14being outside from drinking all the
1:03:21time and um
1:03:30you said you have an alcohol
1:03:33problem George has an alcohol problem
1:03:47yes how did George's
1:03:51drinking adversely affect you
1:03:58it would debilitate my ability to help
1:04:02him the way that I was always trying to
1:04:05help him because it would be one good
1:04:09day a day of survival um and then it
1:04:12would be another day where I'm having to
1:04:15peel him off of me and call
1:04:19911 why why would he get that way tell
1:04:22us tell us his pattern as it relates to
1:04:25drinking and
1:04:29then
1:04:54approach

1:07:40would get to a a state of intoxication

1:12:12continue to
1:12:13drink um so he slapped my thigh as
1:12:16possibly hard as he possibly could and
1:12:19said that you're not going anywhere and
1:12:21it
1:12:22was it was a good smack on
1:12:26my is that a fair in accurate depiction
1:12:29of the uh the wound that you suffered as
1:12:31a result of George Torres slapping you
1:12:33on the side yes George I'd like to offer

1:13:31flip-flops this is in the kitchen at
1:13:34Brian's house okay what happened
1:13:38there so George
1:13:42was very drunk and um I wanted to leave
1:13:46and he's notorious for taking my car
1:13:48keys and putting them around his neck
1:13:51and my phone in his his crotch area me
1:13:55to come get them and I really wanted to
1:13:58leave because of how drunk and I knew
1:14:00the escalation of his anger I didn't
1:14:02want to be there when it was at its peak
1:14:06so I tried to take my keys from around
1:14:09him because he kept taunting me to take
1:14:11my keys come get your keys and so I
1:14:14attempted to go and get my
1:14:16keys and so um he ended up getting a
1:14:20butcher knife and um I called I had an
1:14:23opportunity to call Brian to come and
1:14:25help me to please come pick me up to
1:14:27come get me and of course he brings my
1:14:30son with him and so I'm in the parking
1:14:34lot asking Brian to please help me get
1:14:38my car keys away from him and there's
1:14:40neighbors and it's a it's a scene at
1:14:42this point and George comes to the
1:14:45doorway of my town home wielding the
1:14:47butcher knife saying that do like
1:14:51CSE that no one's going to take her
1:14:54[ __ ] key pleas no one's going to
1:14:56[ __ ] come into this house and he's
1:14:57waving the butcher knife and
1:15:00um I walked up to him and I I just
1:15:04wanted to leave and my little son who
1:15:06was I believe seven or eight at the time
1:15:08just is screaming give Mommy her keys
1:15:11give Mommy her keys let her leave Ryan
1:15:13was even trying to negotiate with him
1:15:15saying please you know you know she'll
1:15:17come back just just let her just let her
1:15:20leave so I went up to try and take the
1:15:23keys from him and he was pulling on them
1:15:26and I ended up pulling harder and um he
1:15:31pulled them back again to try to pull me
1:15:33in the house and I pulled them even
1:15:34harder and it ripped my finger and I at
1:15:39one point the I had lost the fingernail
1:15:41and the tip of my pinky was severely
1:15:46gashed i' like to offer
1:15:50this what was it premark us
1:15:52counselor was like s

1:16:58was broccoli and cheddar soup and I
1:17:01didn't get it out enough time and he
1:17:03came up behind me and he slapped it out
1:17:05of my hand and it was a second degree
1:17:08burn I went to the hospital for it um
1:17:12those fair and accurate depictions of
1:17:14the injury burn to your thigh
1:17:17yes would like to offer identification

1:18:47well let's let's go
1:18:49back and explain what led up to that I
1:18:54thought it would be nice to cook a nice
1:18:55steak dinner we don't have two nickel
1:18:57threw up together so I thought it would
1:18:59be special to make a steak dinner and
1:19:02make potato
1:19:04and go above the normal whatever's left
1:19:07over in the refrigerator and um so I
1:19:11spent a lot of time doing that and
1:19:15um George is drinking the entire time
1:19:18and on the back porch you were drinking
1:19:21as well were you not I was drinking um
1:19:23he was on the back porch while I was in
1:19:26the house and I was
1:19:28cooking and
1:19:30um it was one of those where maybe if I
1:19:33start making dinner now it will be over
1:19:36at a particular time and we can go to
1:19:37bed at a reasonable time and um I even
1:19:42put it in the bedroom and had a movie
1:19:44set up for us to watch um so it would
1:19:46just kind of be dinner and bed and then
1:19:50um he came upstairs and saw that I had
1:19:53made the Stak dinner
1:19:57and I don't know how to describe how
1:19:59drunk he was but it definitely was not
1:20:02George and um had him come lay on the
1:20:06bed sit on the bed and you know put the
1:20:09um I I got the dogs out and um I was
1:20:13ined him with the state dinner and um
1:20:15sat down and uh was getting ready to
1:20:18start playing the movie and um he starts
1:20:22being very
1:20:25rude
1:20:27and cursing the steak
1:20:30and finding fault with it and then um
1:20:35you know I'm having to encourage him to
1:20:36eat you know if you want me to cut it up
1:20:38for you I will cut it up for you did you
1:20:39want some more sour cream for your your
1:20:42potato what can I do to make you happier
1:20:44and um then he started to pull on me and
1:20:47kept saying that excuse me that I just
1:20:50want to [ __ ] you [ __ ] you on the steak
1:20:52and [ __ ] you on the on the potatoes and
1:20:54and I took offense to that and I kept
1:20:57trying to encourage him to eat I started
1:21:00to eat was this just him really drunk
1:21:02and saying
1:21:07nonsense I don't know why he was so
1:21:09angry that day I don't know if it's
1:21:10because I
1:21:12was I I got stake I don't know I most of
1:21:15the time I don't know the reason why um
1:21:19so
1:21:21um I couldn't take it anymore obviously
1:21:24was not going to be able to eat so I
1:21:27started to crawl off of the bed to leave
1:21:30um just just the bedroom and he told me
1:21:33again that I'm not going anywhere and he
1:21:36stabbed me in my leg and it crunched you
1:21:40could hear a noise that it made and
1:21:42blood just started to come out of my leg
1:21:44just like a fountain so I got off of the
1:21:48bed he's starting to freak out and um
1:21:52grabbed me a a towel um I got a wet
1:21:55towel and I'm sitting here holding the
1:21:56towel and um it's increasingly becoming
1:22:00even more and more saturated saturated
1:22:03by the minute it's just minutes so I'm
1:22:04going my through towels and towels and I
1:22:06said George I think I need to go to the
1:22:07hospital this is not this is not
1:22:10stopping to bleed that this is
1:22:12serious and um he got on his knees and
1:22:16begged me please don't call the police
1:22:19please don't call the police please
1:22:21don't call the
1:22:22police um and
1:22:25inevitably he went and got my car keys
1:22:27and put them around his neck again and
1:22:28my cell phone so I was not able to call
1:22:31him call anyone and I wasn't able
1:22:35to leave in my car
1:22:38so I figured I would just go downstairs
1:22:41and I'm just going to go downstairs and
1:22:43I had propped my foot up on the glass
1:22:46table that we had and blood is just
1:22:48everywhere blood is
1:22:50everywhere um I can't keep up with the
1:22:53amount of blood and I'm starting to feel
1:22:54very weak and really weird and he comes
1:22:58downstairs and he's still begging me
1:22:59please don't call 911 please don't call
1:23:01911 I I kept telling him there's
1:23:03something this is serious this is this
1:23:05is
1:23:06something um because he knew that he
1:23:08would probably get arrested or something
1:23:10bad would happen to him so I I couldn't
1:23:13take him anymore he was just all over me
1:23:15and just I'm bleeding I'm I'm bleeding
1:23:17very badly and he's having me try to
1:23:19console him and I kept telling him
1:23:22please I need to call 911
1:23:25please and I said okay just let me just
1:23:28give me a moment and I crawled upstairs
1:23:30to my son's bathroom which is the
1:23:32furthest bathroom away from everything
1:23:35and I remember holding onto the sink and
1:23:38I looked into the mirror and my lips
1:23:40were blue and I I knew I needed help I I
1:23:44I needed help and he came upstairs
1:23:47looking frantic for me calling my name
1:23:49and then
1:23:52um I turned to him and I said please
1:23:54please I'm I'm I'm going to die I I've
1:23:58lost a lot of blood there's something
1:24:00wrong my lips are blue please please we
1:24:03don't have to call an ambulance if you
1:24:05could just take me just I'll drive
1:24:06whatever I can do please to go to the
1:24:08hospital for this and he
1:24:12said that before anything happens I had
1:24:15to concoct a story in order for him to
1:24:18not be arrested or be in trouble when we
1:24:20did inevitably get to the
1:24:22hospital so I'm sitting there with this
1:24:25blood soaked
1:24:27towel with blue lips trying to come up
1:24:30with a story of what I can tell them
1:24:31when I go down there so he's not in
1:24:33trouble and telling him that it's okay
1:24:35and I came up with
1:24:38the the story of that we were sword
1:24:41fighting silly after drinking with our
1:24:43steak knives and he
1:24:46accidentally punctured my leg and from
1:24:49there how did you get to the hospital
1:24:52originally um he told me to drive and
1:24:55because of the amount of alcohol that he
1:24:57drank and it was I couldn't so um he got
1:25:03into the driver's seat and drove me and
1:25:05the entire time he's barking at me to
1:25:07make sure that I get the story straight
1:25:09we're sword fighting okay we were drunk
1:25:12you know did you go did you go being
1:25:13silly yes all right and did uh you get
1:25:16treated there yes um I I was bloody and
1:25:22um let me show you the photog
1:25:25I show you
1:25:27this all right is this a fair and
1:25:29accurate depiction of the injury to your
1:25:33leg yes I had to go to two different
1:25:36hospitals for
1:25:37it and you lied to medical personnel
1:25:41about how this happened yes they brought
1:25:44in sheriffs and everything was it
1:25:46consistent they brought in sheriffs did
1:25:48you did you have to answer to the law
1:25:49enforcement offic yes did you uh story
1:25:54that you and George had agreed I did jge
1:25:57I like to offer

1:28:31drinking I I'm I'm sure um I know that
1:28:35he had been drinking this is one of the
1:28:37instances where I would go upstairs to
1:28:38try to go to sleep but y'all drank
1:28:41together a lot did you
1:28:43not sometimes yes but there were times
1:28:46where he wanted to stay up and continue
1:28:48to drink and you wanted to go to bed
1:28:50many times
1:28:52yes you were done
1:28:55he was not correct was that one of these
1:28:58times
1:29:01yes so tell us what
1:29:03happened I'm sleeping in the bed sound
1:29:08asleep and he comes into the room and
1:29:12grabs me by my hair a lot of the times
1:29:15and from here he scratched me from
1:29:18trying to grab me and then grabbed my
1:29:21hair and pulled me off of the bed and
1:29:22then raged my face across the carpet
1:29:25these are these are carpet Burns to your
1:29:28lips yes what about to they look like
1:29:30the eyebrow area that some where he from
1:29:33grabbing me scratched me and got a hold
1:29:36of me by my
1:29:38hair why was he mad at
1:29:41you I wasn't downstairs with him he
1:29:45wanted you to be drinking with him all
1:29:47the
1:29:49time all right I'd like
1:29:51to introduce the identification

1:30:50ever called
1:30:51911 um George and I had gone to a bar
1:30:55across the street within walking
1:30:56distance and
1:30:59um at some point um I asked a a guy or
1:31:05he asked me somehow or another it was
1:31:07over a
1:31:08cigarette and um he left and I didn't
1:31:11know where he went and the bartender
1:31:13said oh he he left he took your car and
1:31:15he left so um why would he do
1:31:20that well I found out when I got home it
1:31:23was because I spoke to a another
1:31:26man and um so I paid the tab and I I
1:31:32walked home and he's sitting on the back
1:31:35porch with the handle of
1:31:39vodka and I was walking on eggshells and
1:31:44terrified and kind of treaded lightly
1:31:46when I came in and he acted all natural
1:31:49and fine so I didn't know the reason why
1:31:53that he had just gotten up and left with
1:31:55my car so then
1:31:59um he calls me a [ __ ] and then he calls
1:32:02me a [ __ ] and then he calls me a [ __ ]
1:32:05and gets up and pushes me and he pushed
1:32:07me with both of his hands so hard that
1:32:11we have um this little area where our
1:32:14washer and dryer is and there are metal
1:32:16doors that are on it and he pushed me
1:32:19into the metal door and then I fell back
1:32:22and he got his knees on top of of me on
1:32:25my arms here so I was pinned down and
1:32:28was started to strangle me and hit my
1:32:30head up against the metal closet over
1:32:32and over and over and over and over
1:32:34again and calling me a [ __ ] [ __ ] and
1:32:36you're such a [ __ ] and [ __ ] you and
1:32:38everything and
1:32:40um I my tongue was flopping out of my
1:32:43mouth and I was I thought I was going to
1:32:45bite my tongue off
1:32:48and because of the amount of noise I
1:32:50guess my head was making on the metal
1:32:52door he slid me down and got back on me
1:32:56and then started to strangle me again
1:32:58and it was on we have carpet but it's
1:33:01very like concrete
1:33:04and I was able
1:33:06to get my arms out from underneath and
1:33:09grab his throat and get him off of me so
1:33:13I get I got him off of me and I pushed
1:33:15him off and he came up and he goes you
1:33:18[ __ ] [ __ ] and he stomped my face and
1:33:22the next thing I know
1:33:25I woke up I obviously blacked out out
1:33:29I'm I'm obviously I guess yes and um he
1:33:34was passed out on the floor and I woke
1:33:37up frantic looking for my phone and I
1:33:41immediately called
1:33:44911 okay the police police arrived on
1:33:47that incident yes they did is this a
1:33:49fair and accurate depiction of the
1:33:51injury you sustained as a result of
1:33:52kicking you stomping yes a Stomp all I
1:33:57saw was his
1:33:59heel this is ask this be identification
1:34:03be aded what was pre-marked as U will be

1:34:36later that's a couple of days later
1:34:39that's the bruising froming of the
1:34:43ey now the police will called we talk
1:34:46about that a minute

1:35:08picture um yes is that your leg
1:35:12yes and is that like the injury to your
1:35:16namee

1:35:26jury I was trying to get off of the back
1:35:29porch and he grabbed me and pushed me
1:35:33and it was a rock or a really P sharp
1:35:36piece of
1:35:39mol um from him grabbing me and pushing
1:35:41me onto the ground and I I guess I just
1:35:44happened to hit my knee just right on
1:35:46whatever it was were you all
1:35:50drinking why why did to was because I
1:35:53wanted to get off of the back porch he
1:35:55wanted to stay out there yes he wanted
1:35:58you to be with him what's the deal with
1:36:00him wanting to be with you
1:36:03all in security I guess I don't
1:36:06know I don't know you do your best to
1:36:09please
1:36:11him and then some
1:36:14yes all right I'd like introdu

1:37:11the arm with some type of injury yes do
1:37:13you remember this event multiple times
1:37:16yes well talking about this isolated
1:37:20event where this Photograph was taken
1:37:21the injury used suain y who who injured
1:37:24your George Torres you remember this
1:37:28event yes you tell the jury about it
1:37:31this was one of the instances where I
1:37:33would try to pull away from him and I
1:37:35don't know how my arm started to do this
1:37:39but um from him him pulling from this
1:37:43way how hard he would
1:37:45pull um with me trying to struggle to
1:37:47get away from him it it would leave
1:37:50these bloody um under the skin splotches
1:37:54so he wouldn't hit you sometimes he
1:37:55would just grab you and pull you yes for
1:37:58me trying to pull away from him that's
1:38:00the point of it doing this from me
1:38:02pulling away from him now this is one of
1:38:05the many times y'all were both
1:38:07intoxicated um I mean I can't say for
1:38:09sure that yes but whenever it would
1:38:13happen yes it would be
1:38:17thinking identification

1:39:42consumed any alcohol um I I mean I may
1:39:46have earlier this was another I was in
1:39:48the bed trying to sleep where was George
1:39:51um downstairs Jing
1:39:54all right and
1:39:57so you you were wanting to go to bed and
1:40:01he wanted you to stay down there with
1:40:03him yes I was in the
1:40:05bed all right tell the jury what
1:40:07happened on this event I believe this
1:40:09was the instant where I was in the bed
1:40:12and
1:40:14he I used to barricade the door with our
1:40:18dresser why you just lock
1:40:20it all of the locks were broken in my
1:40:23home
1:40:24they were from
1:40:26George including my sons at one point I
1:40:28could seek refuge in my son's room but
1:40:30he broke that one as
1:40:32well tell me explain how that
1:40:35happens tell the jury we can't read your
1:40:40mind George wants me which he has told
1:40:43me numerous times that I to be with him
1:40:45at all times and doesn't like to be uh
1:40:49apart from me or away from me so
1:40:52whenever it was even just to go to the
1:40:54bathroom sometimes I he would go with me
1:40:58and you have to understand I have a
1:41:00twostory 900 foot town home so there's
1:41:03not many places to go so it just
1:41:05happened to be
1:41:06that it would be upstairs or downstairs
1:41:09or i' be in a particular room or not so
1:41:11um inevitably did you want some time
1:41:14away yes I did even if it were just him
1:41:18upstairs or me downstairs or vice versa
1:41:20so I rarely got to sleep
1:41:24um this was one of the instances because
1:41:26I had barricaded the door with our I
1:41:30don't know 200 lb dresser that we had
1:41:32and then um I had my nightstand
1:41:34barricaded up against that up against
1:41:36the bed to where it was even more
1:41:39difficult from the prior times of him
1:41:40breaking in um and he would I don't know
1:41:43how he would ever do it but he would get
1:41:46himself in through the the crack of the
1:41:48door that he would be able to wedge in
1:41:51wedge the dresser in the night stand and
1:41:54he pulled me out of the bed and um told
1:41:57me I was going to die and
1:42:01um it's I believe it's this inant and
1:42:03then and punched me and punched you on
1:42:07the side of the head yes my temple and
1:42:10everything was it an open fist or a
1:42:13closed fist or do you know it was fully
1:42:16closed

1:43:00came but I don't remember I remember it

1:43:38picture was taken would have been taken

1:43:542020 yes what's the significance of
1:43:58this again because I was sleeping um
1:44:02George was upset with me and came in
1:44:05with a metal curtain rod and bent it and
1:44:11snapped it in half and then crunched me
1:44:13the forehead with
1:44:14it um and it started to beat the
1:44:18furniture that was in the um in the
1:44:21bedroom
1:44:23um it this is probably a good month uh
1:44:29before or after it had happened before I
1:44:32really believe that I should have gotten
1:44:34stitches but I was not allowed to go to
1:44:35the
1:44:36hospital I'd like identification why
1:44:40evidence it was a gash what was premark
1:44:43as why will be receiving the evidence
1:44:45without objection as defense

1:44:50mentioned in the two-hour interrogation
1:44:52video which they didn't take
1:45:04us this was photographs that were taken
1:45:07the
1:45:09um I guess it would have been the the
1:45:11crime scene was it the crime scene
1:45:14investigator that came out and took
1:45:16photographs I don't remember who it was
1:45:18but yes someone did on the day of was it
1:45:20different from the uh
1:45:24extraction the phone extraction expert
1:45:25is it somebody
1:45:27different I
1:45:30think but this is it this is this right
1:45:34here yes and remember that's a month
1:45:39later and then on that same date uh they
1:45:43took same time they took this Photograph
1:45:46as well which is identification

1:45:57DET um I believe it's from holding the
1:46:00baseball back and is that an injury to
1:46:03your hand it's a
1:46:05bruise was that taken
1:46:09um February was it February 23rd 2020
1:46:13when the investigators came out when
1:46:16February feary 24
1:46:24I'd like to

1:47:26suffered that injury I believe it's from
1:47:28holding the baseball

1:48:10in there like five photographs can you
1:48:13look at
1:48:16those see if you recognize them
1:48:32and are those fair and accurate
1:48:36depictions yes as a composite of the
1:48:39events that occurred in relation to
1:48:40George Torres and the T your TV
1:48:47yes yes
1:48:52all right is that are those seals of a
1:48:54videotape that you took
1:48:57yes and is that vide tape was it on your
1:49:00phone
1:49:02yes so when law enforcement sees the
1:49:06phone they would have had access to this
1:49:09video I believe so
1:49:11yes
1:49:14and tell me about
1:49:17it
1:49:20um Lucas liked to watch cartoons and
1:49:24play video games on the big screen which
1:49:26is this is the big screen and um I would
1:49:30have to call Brian to come over
1:49:32sometimes to help me figure out the fire
1:49:34stick and whatever platform or whatever
1:49:37whatever it was that Lucas was trying to
1:49:39view his uh shows and video games on and
1:49:44I don't remember how um uh George found
1:49:48out that Brian had come over I believe
1:49:50because it was actually fixed and he
1:49:51knew that I didn't know how to Do It
1:49:55um found out that Brian had come over to
1:49:58fix it and was he General
1:50:02super I don't know if he was jealous of
1:50:05Brian I think that he had a fear that I
1:50:10somehow would go back to Brian so I I
1:50:13think by Brian helping me with things
1:50:17for Lucas um he just didn't want him to
1:50:20be interacting with me at all
1:50:23so Lucas wasn't over here this day was
1:50:26he Ryan wasn't over here this day um he
1:50:30may have been I can't remember when he
1:50:33actually fixed the television for Lucas
1:50:36yall were
1:50:40drinking I'm I know he was for a fact
1:50:43yes chances are you probably so yes okay
1:50:46I would agree so how did it end up
1:50:49badly um he accused me of
1:50:53sucking Brian's dick and told me that he
1:50:57was going to break my face with the bat
1:50:59that he was going to make the
1:51:01unrecognizable to my son with the bat
1:51:04and then told me that he's going to
1:51:07destroy my [ __ ]
1:51:09television and then I was going to
1:51:12remove it from the
1:51:15apartment and if I didn't I was going to
1:51:17be again unrecognizable to my son so did
1:51:20he grab the bath uh absolutely he
1:51:23already had had that in his hand and he
1:51:24told me that I had to videotape it did
1:51:27you videotape it

1:51:31no all right but there is a video but
1:51:33I'm going to go ahead and ask judge if I
1:51:35can introduce this identification of

1:52:37either way I was kicking apart and
1:52:39removing
1:52:45it what is this picture of in the
1:52:48process of him destroying my television
1:53:01is that the result no after that he
1:53:04ripped it off of the TV
1:53:08stand can you later pass

1:53:22I don't know something I'm

1:53:57crime

1:55:14was the television stand and then my
1:55:16back porch area and the dog bed

1:55:23the of the stairs that doggy it's a baby
1:55:28gate but um my dogs would wander
1:55:32upstairs sometimes and go to the
1:55:35bathroom sometimes when we couldn't get
1:55:36them out so I would at
1:55:39nighttime um or whenever we weren't home
1:55:42make sure that they didn't go upstairs
1:55:43and plus Penny was
1:55:47blind there's an allegation that you
1:55:49push George down the stairs
1:55:53apparently or got him in the suitcase
1:55:56upstairs and pushed him down the stair
1:55:58supposedly is that Ur absolutely
1:56:05not is that bookshelf Disturbed in any
1:56:09way no nor the plant next to it

1:56:44it's one that Lucas Lucas wasn't over
1:56:46here so it had to be George how can you
1:56:49tell yall were drinking because they're
1:56:52they cut here and then he has a
1:56:55beer and uh there two dogs there's one
1:56:58sitting next to you who's that that's
1:57:00Penny she's the blind
1:57:03dog I used to have to pick her up to put
1:57:05her somewhere so she would stay there
1:57:08because she um was unfamiliar with the
1:57:10area especially since we moved from a
1:57:12marital home to the um Town Hall so most
1:57:15of the time Penny would be close or next
1:57:17to me who's next to the film um this is
1:57:21little guard dog t
1:57:22um she was the de dog um and this is the
1:57:27fence here I'll show okay um but this is
1:57:31Tess and then this is death blind Penny

1:57:41porch taking a nap she was never far
1:57:44from you all right when George was sober
1:57:47how did he treat the
1:57:50dogs nice
1:57:54I don't know if he was a pet person but
1:57:58I mean he was he was I used to I needed
1:58:01him to feed them they he would feed them
1:58:04were there times
1:58:05when George was
1:58:09drinking where he would threaten to harm
1:58:11the dogs all the time we going have to
1:58:15tell the
1:58:17jury one of the
1:58:19worst one of the worst threats was was
1:58:23Penny being blind um he would
1:58:28um actually leave the gate open in the
1:58:31back he wouldn't threaten me to do it he
1:58:32would actually do it um on nights that I
1:58:35had to go up to sleep or some I I fled
1:58:38the night before or something um and
1:58:40would tell me that he hoped that I would
1:58:43come back and find her bloated body dead
1:58:46in the pond across the way from our town
1:58:49home and Tess was no notorious if I
1:58:53wasn't there to go look for me and would
1:58:55say that I he would hope that I would
1:58:58have to scrape up her dead body from the
1:59:01the street that was out in front of our
1:59:04uh apartment complex why was George
1:59:06upset with you
1:59:08why anything that he could get to try to
1:59:12have some type of hold over me control
1:59:15and he knew I loved my dogs very much
1:59:18especially that they were
1:59:19handicapped were they afraid of it
1:59:23yes uh Penny would hear his voice and
1:59:25instantly go underneath um the dining
1:59:27room table that we had um Tess was
1:59:31always fractious and very very quick
1:59:35with his movements but she was never
1:59:37never far away they never show their
1:59:40teeth they never growled Tess would
1:59:42occasionally bark but it was very rare
1:59:44and he used to kick them and
1:59:46just for what reason would he kick
1:59:49them and he would try to find me because
1:59:53she's she's
1:59:57blind
1:59:59sustained I'd like to move

2:06:37okay um and you made a statement
2:06:42about tell him tell him
2:06:45something explain that to the to the
2:06:50joury um
2:06:52I told him to tell his brother about you
2:06:56choking me the other day this is a
2:06:59separate choking
2:07:01incident
2:07:03um we had been drinking and I
2:07:08had I wanted George to tell him but he
2:07:12didn't tell him so I said it in the
2:07:16background so he would be aware what did
2:07:19you tell
2:07:22tell
2:07:23him why you choked
2:07:25me or that you choked
2:07:29me
2:07:36now you heard the testimony of the two
2:07:39neighbors the boys that live next to you
2:07:42yes
2:07:45and you heard that they were they were
2:07:48actually questioned I think the um
2:07:52the audio they were Audi interviewed you
2:07:55heard from detective csul I think it was
2:07:57two or three couple of days later on the
2:07:5925th of February or 27th of February yes
2:08:04and uh you heard their testimony earlier
2:08:07this week
2:08:09yes where they hear
2:08:11a kind of a thumping sound starting at
2:08:14the top of the steps ending up at the
2:08:16bottom
2:08:18yes have they got the Night Roll yes
2:08:22so explain to the J that so it was the
2:08:25night before
2:08:27um again I was sleeping and in the
2:08:29middle of the night with the door
2:08:31barricaded he came in and ripped me out
2:08:34of the
2:08:35bed um
2:08:38and first got me with one hand and then
2:08:41both got both hands and pulled me
2:08:42completely off of the bed and then like
2:08:45a caveman had my hair like this and was
2:08:49going down the stairwell taking me with
2:08:51him uh to come downstairs so um I could
2:08:55sit and drink with him do you believe
2:08:58that's the
2:09:00noise that the uh the two neighbor boys
2:09:04heard I absolutely do and it was just
2:09:06the night before
2:09:19correct now some of the time when this
2:09:23abuse
2:09:26occurred you call the
2:09:28police and other times the police were
2:09:30not called
2:09:35correct I want to refer to you the first
2:09:38time I believe you mentioned the 911
2:09:41call I believe that was July 25th of
2:09:442018
2:09:46yes and
2:09:49uh that was the incident
2:09:51in which George kicked
2:09:56you in the
2:09:58a don't you and you had grabbed his neck
2:10:05yes I was able to uh get my arms out
2:10:09from him pinning me down with his knees
2:10:11and grab his neck so law enforcement
2:10:17came and um investigated
2:10:21yes and both of you were arrested
2:10:30correct you recall asking the officer
2:10:33when you were
2:10:37arrested why am I being
2:10:39arrested many times yes you you
2:10:42recall asking the officer why am I being
2:10:45arrested yes
2:10:53and do you recall making any other
2:10:56statements to law enforcement as to why
2:10:59you did what you did to George that was
2:11:02the first time ever that I actually
2:11:03officially fought
2:11:05back did you
2:11:07tell the officer that you were fighting
2:11:10back yes because I was complete shocked
2:11:13that I was getting arrested because of
2:11:14it
2:11:38now on the
2:11:42um the two-minute video the suitcase
2:11:49video you mentioned to
2:11:52him I think you said
2:11:54something I can't breathe he said I
2:11:57can't breathe and you said that's how I
2:11:58feel when you're choking
2:12:00me were you referring to an isolated
2:12:02incident of the the night before two
2:12:05nights before or whatever or were you
2:12:06referring to in
2:12:09general in general the more than two or
2:12:13three four times if he had done it
2:12:17okay and then uh the point about
2:12:19cheating he didn't physically
2:12:21no he did not okay and just I I don't
2:12:24want to go into a lot of detail but what
2:12:26what are you referring
2:12:27to um George was I believe addicted to
2:12:31pornography and a lot of that would be
2:12:34found on my phone from him supposedly
2:12:37wanting to call up job
2:12:39interviews and um as a solution I sat
2:12:42him down and I explained to him to me
2:12:45that you visualizing yourself with
2:12:47someone else um or at least having a
2:12:51pleasurable moment with someone else or
2:12:54watching other people and to me I told
2:12:57him that I considered that cheating on
2:12:59me okay and so he he would download that
2:13:01on your
2:13:03phone
2:13:14yes why did you stay
2:13:19with you got to tell
2:13:24as anyone who has ever been in love
2:13:30or when you love someone
2:13:33or primarily someone or
2:13:36something you go above and beyond and
2:13:39you tolerate and you endure and you
2:13:41persevere
2:13:44and you try to make that P person as
2:13:47spectacular as you possibly can no
2:13:49matter the sacrifice that may have to go
2:13:52through
2:13:54um
2:13:56to serve someone else um in a positive
2:14:00light so they can be better people
2:14:03for um themselves and to just make them
2:14:07a happier person and love love is very
2:14:11strong and love is very deep and love I
2:14:14believe is not fully understood in a lot
2:14:16of ways for how different people react
2:14:19to it and I very much
2:14:23deeply and passionately Love George I
2:14:26love him to this day did you not want to
2:14:30be
2:14:33alone um at beginning um through my
2:14:37divorce um it was very nice to have him
2:14:40around and he was in he was a man man to
2:14:43me and um I felt protected
2:14:47and he very nice and
2:14:52as lame as it sounds used to compliment
2:14:53me and it makes it made my
2:14:57day so
2:15:01yes during that period of time when uh
2:15:05you first started seeing George would it
2:15:07be fair to say that you had low
2:15:11self-esteem yes
2:15:22now we talked about this previous arrest
2:15:24where you told the officer you were
2:15:26fighting back and you got
2:15:34arrested I want to talk about your
2:15:36conversations with law enforcement but
2:15:39first I want to ask you why did you go
2:15:40to the police station that day when you
2:15:42interrogated there we saw the 2our video
2:15:44tell the
2:15:47jury um the day of the incident um
2:15:51the detective copel gave me her business
2:15:54card with her personal cell phone number
2:15:56on it and said if I happen to remember
2:15:58anything or anything that I would like
2:16:00to add to the day for me to um not
2:16:04hesitate to give her a call so
2:16:07throughout the rest of the evening I
2:16:10just something was off I I didn't feel
2:16:13comfortable with what she told me and
2:16:16how she told it to me how long were you
2:16:18have to sing gosh all day from the
2:16:21moment that they were there to the
2:16:23moment that the coroner's van drove off
2:16:26all right when when it ended did you
2:16:28stay in your home no I raced inside and
2:16:32collected some pajamas and a toothbrush
2:16:35and I um went over to where my son was
2:16:39at my ex-us house did you take the dogs
2:16:43I didn't even feed them it was so
2:16:46fast all right and then once you got
2:16:48over to your uh ex-husbands what
2:16:52happened is it relates to detective
2:16:54coule
2:16:56cop something just wasn't sitting right
2:16:59with me and
2:17:02I I had a suspicion that she just wasn't
2:17:04being honest with me so I took it upon
2:17:07myself
2:17:09sustained so you called her tell tell us
2:17:12about that um I called her and I told
2:17:16her that I felt that she was being
2:17:19dishonest with me um she originally had
2:17:21told me that due to her being pregnant
2:17:24it would just be a lot easier for her to
2:17:26have me come down to the station um to
2:17:29pick up my phone the original plan was
2:17:31for she and uh detective loen to return
2:17:35the phone to my
2:17:37apartment um but she said that um it
2:17:40would be a lot easier for me to just
2:17:41come down and pick it up because I
2:17:43remember when I was pregnant that's when
2:17:44she said you remember when you were
2:17:46pregnant so um I said I feel that you're
2:17:48tricking me and I feel that you're being
2:17:50veryy about something and I don't
2:17:51believe that you're being honest with me
2:17:54and I said regardless I'm still going to
2:17:56come
2:17:58sustained so you agreed to come but you
2:18:01understood it was to get your phone
2:18:03correct all right you came that
2:18:04afternoon to the station I did and the
2:18:07original agreement was they were to come
2:18:08to you correct all right when you got to
2:18:10the station what
2:18:12happened um I thought I was just going
2:18:15to be picking up my phone I had I mean
2:18:18my car was there I had everything in my
2:18:20car regular I'm just going to go in
2:18:22maybe sign something and pick up my
2:18:23phone and there's people that are um
2:18:27over here at the windows and I thought
2:18:29that I was supposed to go over there to
2:18:30get my phone and detective loen came
2:18:33down and
2:18:36um said that my phone was upstairs so if
2:18:39I would just follow him upstairs that's
2:18:41where my phone was and then I was taken
2:18:46into a I guess it was an interrogation
2:18:48room and they told me to sit down and
2:18:50and that um then I guess the interview
2:18:55or interrogation began and I just simply
2:18:57getting my
2:19:00phone

2:19:34police I lied to the
2:19:39police basically everyone because I
2:19:43was extremely fearful of being arrested
2:19:48I made
2:19:51first attempt of me calling 911 by
2:19:54telling them what happened and I thought
2:19:57they they were going to help me but in
2:19:58said I was arrested for calling
2:20:03919 so you made the decision to lie I
2:20:07did did you stay with that lie I did are
2:20:11you telling the truth today I
2:20:15am now let me take you back to the um
2:20:25to this
2:20:34incident is it fair to
2:20:38say that when George Torres is
2:20:44sober he commits no violence against you
2:20:47no is that fair to say yes
2:20:51is it fair to say that every time that
2:20:53he's intoxicated or every time that
2:20:56you're hit by him or harmed by him it's
2:20:59when he's intoxicated
2:21:04yes as a result when he's
2:21:09drinking does it change your
2:21:13outlook yes could you explain that to
2:21:16the J
2:21:21I'm always
2:21:23fearful um
2:21:26paranoia why
2:21:29why because I try to protect and defend
2:21:32myself for fear something happens at the
2:21:34last ultimate second but you're always
2:21:37that way fearful is it because of these
2:21:39prior
2:21:41incidents
2:21:47absolutely do you try to play
2:21:49Kate all the time what do you what do
2:21:52you
2:21:54mean I with the puzzles and the painting
2:21:58and feeding the Ducks across the way at
2:22:00the pond um listening to music trying to
2:22:03go for a walk on the trail anything that
2:22:07I possibly can I told you I was running
2:22:09out of things to entertain him with wh
2:22:12why do you think George what what Bob is
2:22:16it sustained does he does he tell you
2:22:27sustained as a result of how he he
2:22:30behaves towards you in that intoxicated
2:22:34State how were you feeling the night of
2:22:36this
2:22:37event
2:22:43over extremely nervous
2:22:48um anxiety Galore
2:22:51just I can never
2:22:54relax when he's
2:22:56drinking
2:22:59yes
2:23:00and the state of intoxication that he
2:23:03was at at the time of this
2:23:08event is that the
2:23:10state that scares you the
2:23:13most it's the tone yes there's a lot of
2:23:16alarms and red flags that go on
2:23:18throughout the day or night to whenever
2:23:21it is that we are drinking
2:23:24respons tell St tell us
2:23:28about tell us about that how that
2:23:31heightens does that heighten your sense
2:23:36of safety at all
2:23:39times but especially when he's drinking
2:23:42oh yes all the time and then his
2:23:45mood yes it depends on what mood he's in
2:23:47that day
2:23:51well do you have you have like a sick
2:23:53sense of how he's
2:23:56doing yes I knew George very well
2:24:01um
2:24:03resp
2:24:04sustained can you tell us what you mean
2:24:06by that six cents or knew knew him very
2:24:12well I guess you could say that I was
2:24:14trained by fear with him
2:24:18just it's it wasn't fun anymore when we
2:24:20were drink and we would uh hang out on
2:24:23the back porch it wasn't fun anymore
2:24:25because I knew inevitably
2:24:27that something was going to happen to me
2:24:29one way or another
2:25:04this
2:25:06been you know those those bruises that
2:25:09we saw of him they look pretty
2:25:16deep tell the jury what you were
2:25:18thinking
2:25:21from the bat your
2:25:24yes I didn't want to die that night
2:25:30I I can't describe it to you
2:25:34it's terrifying love to a certain degree
2:25:40where my plan was to show him the next
2:25:43day and just
2:25:45I I wanted him to be better and treat me
2:25:49nicer and
2:25:51be the person that he was when I
2:25:53originally met him and I knew that was
2:25:55in him still I knew that it could be
2:25:57found and I just couldn't figure out
2:25:58what it was that I was doing wrong in
2:26:00order for it to not be back to where
2:26:02that was
2:26:04and I was tired of living in fear
2:26:08and just sick all the time
2:26:11of figuring out how I can entertain him
2:26:14so I don't die and uh continue a
2:26:18relationship with my son and try to live
2:26:20a normal life that wasn't a normal life
2:26:22for me and just I I bottom line is I
2:26:25didn't want to
2:26:26die I would have I would have died or I
2:26:28would have been disfigured or maimed or
2:26:31if if it weren't me with a bad it would
2:26:33have been him if he were to have gotten
2:26:45out any cross- examination
2:26:58George knows somebody named
2:27:02Crystal did you ever mention crystal in
2:27:05your text messages about being one of
2:27:07his
2:27:09[ __ ] I don't know I don't
2:27:12remember how about Christine did George
2:27:15know a

2:27:22these may have been people that he was
2:27:24communicating with on whatever the
2:27:27platform was on your phone I believe so
2:27:30yes and did you find these
2:27:32communications I believe I found one or
2:27:34two of them from some of them and did
2:27:36you send a long letter to his family uh
2:27:39to relay to him about George and his
2:27:42girls that he was cheating on you with I
2:27:46believe so okay so you do you do know
2:27:48those names right I don't remember them
2:27:51it's been however long
2:27:53okay now on February 24th
2:27:582020 you called 911 at about 100 p.m.
2:28:01correct yes and at that point you were
2:28:05still feeling a little intoxicated were
2:28:07you
2:28:08not it was more shock
2:28:11yes so you agree that you previously
2:28:14stated I was still I believe intoxicated
2:28:17to a
2:28:18degree to age yes okay so 1 p.m.
2:28:23that's it's about 14 hours after 11:
2:28:26p.m. the night 4
2:28:28correct I'm guessing so well 12 hours
2:28:32prior would be 1:00 a.m. then 12 a.m is
2:28:3513 hours 11:00 p.m. is 14 hours correct
2:28:40okay and you were present here for the
2:28:42medical examiner doctor's adage to
2:28:44testify correct yes and you heard her
2:28:47talk about all the effects of ethanol
2:28:49that
2:28:50has on a human body correct yes and she
2:28:54also mentioned something that it on
2:28:56average dissipates at about 015 an hour
2:28:59do you recall that I believe so okay
2:29:15so would it be fair to say that if
2:29:18you're still still feeling the effects
2:29:19of the AL about 1: p.m. so that's 14
2:29:22hours
2:29:25015 we were at a approximately about
2:29:28a.21 at 11:00 p.m. the night before do
2:29:31you feel like you were two and a half
2:29:33times the legal limit at that
2:29:35time I don't know how you came to that
2:29:37number
2:29:49I'm e

2:30:48proceed you test earlier that you all
2:30:51had about half of one of these bottles
2:30:54left from the night before correct yes
2:31:27so would you agree that this is one of
2:31:29the three bottles that was purchased
2:31:31between February 22nd and the two that
2:31:33were purchased on February 23rd of
2:31:362020 I'm guessing it's like the bottle
2:31:40all right and it's 1.5 L would you agree
2:32:03and when you say half what we talking
2:32:05about to the top of the label was left
2:32:07from the day before oh goodness now all
2:32:09right a little less halfway through the
2:32:12label right
2:32:14about okay about
2:32:17half so in addition to half way through
2:32:20the
2:32:22label which you began consuming after
2:32:24going to public at about 12:15
2:32:29correct you all would have been began
2:32:32consuming around 12:30 is it fair to say
2:32:34when you got

2:32:41okay and after finishing what you all
2:32:45had left over from Saturday the two of
2:32:48you
2:32:50consumed two 1.5 L bottles correct I'm
2:32:55not sure about the second bottle that he
2:32:56purchased if it was empty or not at the
2:32:59time well we did mention that the police
2:33:01would find two empty bottles in the top
2:33:03of your trash correct yes and we did all
2:33:06see that in the photographs correct see
2:33:10garbage all right and you say you were
2:33:12about 100 pounds at the
2:33:14time and we all know Mr Torres was 103
2:33:18lbs at the time of his death correct
2:33:21what all right so that's 3 l of wine
2:33:25between 200 lb split between two people
2:33:28over the course of a day
2:33:31correct yes and you testified uh today
2:33:35that you were intoxicated uh at the time
2:33:38that this occurred uh the videos between
2:33:4111: and 11:30 at night correct yes at
2:33:44some level yes now what does that mean
2:33:47to you previously have you indicated
2:33:49that means the room is spinning do do
2:33:51you ever recall saying that I do so what
2:33:54was your level of intoxication at this
2:33:57point in time when the first video was
2:33:59filmed at 11:12
2:34:00p.m. do you mean from lack of sleep or
2:34:05alcohol from the
2:34:07alcohol what was my level what were you
2:34:10feeling did you have trouble with your
2:34:13balance I was more tired than anything
2:34:17did you have trouble with your balance
2:34:20I don't believe so so you were able to
2:34:22flip a suitcase over with a 100 pound
2:34:24man in it
2:34:26right I mean yes it happened okay how
2:34:29about your speech do you feel like your
2:34:31speech was slurred
2:34:33clearly how about your inhibitions do
2:34:35you feel like you were doing things that
2:34:37you wouldn't do when you were sober I
2:34:39wasn't thinking about that well on
2:34:42reflection do you feel like this is
2:34:44something you would have done when you
2:34:45were sober
2:34:50I didn't know me and
2:34:54George I'm just asking you looking back
2:34:56on this when he's in the suitcase and
2:35:00you're telling him how you feel and then
2:35:03you wait 11 minutes and you film another
2:35:0522 seconds and then you go upstairs upon
2:35:08reflection is that something you would
2:35:09have done and left him in there had you
2:35:12not been
2:35:13drinking I don't know I can't say okay
2:35:17if I was scared then it would be
2:35:18something
2:35:20okay all right now today you testified
2:35:24about the time frame between the two
2:35:26videos correct yes so you came down from
2:35:30the shower where you were hiding correct
2:35:33yes and as you're coming down the stairs
2:35:36before you even get to the bottom of the
2:35:38stairs you can kind of see over your
2:35:39shoulder or towards your right that he's
2:35:42trying to hide in the suitcase
2:35:44correct yes and the lid is down but it's
2:35:49it's not closed and you can you can tell
2:35:52he's hiding in there it's not great
2:35:53hiding spot just yet right right and so
2:35:57you come over to him and you're laughing
2:36:00right and you move the suitcase around
2:36:03some before zipping it shut right no no
2:36:06you immediately zip it shut yes

2:40:22suitcase correct he had been angry on an

2:40:29was a wonderful fun day all day correct

2:40:33lived okay but you did not tell us
2:40:35earlier today that he had been angry
2:40:37throughout the
2:40:38day when would I say

2:40:44doing puzzles and arts and crafts and

2:46:18is did he begin telling you that he
2:46:20couldn't breathe before the video or do
2:46:21you not remember I don't
2:46:33remember now you testified moments ago
2:46:36that um your two neighbors must have
2:46:40misremembered which night the loud noise
2:46:42was correct yes and now you're telling
2:46:45us that you don't remember taking the
2:46:47photograph at 11:03 p.m.

2:46:52correct did the police come out to your
2:46:55uh townhouse on Sunday February 23rd
2:47:002020
2:47:02yes I'm talking about Sunday this is the
2:47:04Sunday Funday when we're going to Publix
2:47:06twice were the police out of your
2:47:08residence no it was the day after Monday
2:47:11the 24th correct
2:47:15yes and
2:47:19that Monday morning you called 911 well
2:47:22Monday afternoon at about 1: p.m.
2:47:24correct
2:47:27yes and between that time frame you were
2:47:32the only person in your apartment plus
2:47:34Mr Torres in the suitcase correct yes so
2:47:37if anything had been Disturbed in your
2:47:39apartment you had all the time that you
2:47:42wanted to to undisturbed them before

2:47:50okay and you still your testimony is
2:47:53there was no loud boom that shook the
2:47:56walls of your townhouse at about 11:00
2:47:58p.m. the night of February 23rd 2020
2:48:01correct correct to the best of your
2:48:04memory correct
2:48:14correct now that second video the 22
2:48:17seconds where you just hear him say
2:48:19Sarah and you don't say anything you're
2:48:21familiar with that video correct yes
2:48:24it's after that that you go upstairs
2:48:26correct yes how quickly is it that you
2:48:29go upstairs after
2:48:30that it was pretty quick can you grab
2:48:33the
2:48:34dogs no the dogs were upstairs already
2:48:38okay did you uh call 911 and let the
2:48:42police know that you had zipped somebody
2:48:44shut in a suitcase and they had not been
2:48:46able to get out for 20 minutes
2:48:49not did you go to Brian's house and tell
2:48:53him I had to zip Mr Torres up in a
2:48:56suitcase shut um we need to do something
2:48:59about that before he passes I believe
2:49:02that's what the phone call was okay what
2:49:05do you remember now about the phone call
2:49:06of
2:49:07Ryan I I know that I called him I not I
2:49:11don't know specifically what it was
2:49:14about now your testimony it seems like
2:49:18you spend day after day finding things
2:49:21to entertain Mr Tores to do correct
2:49:24yes almost like having a child you have
2:49:28you have your own child correct I do
2:49:31what you described sounded like having a
2:49:32small child would you agree that's your
2:49:35interpretation okay well you take him
2:49:38from doing arts and crafts to doing
2:49:39puzzles so on and so forth correct when
2:49:43he's been drinking yes
2:49:49and Mr Torres was notorious for doing
2:49:54some of these things correct what do you
2:49:56mean well you described Mr Torres as
2:49:59being notoriously known for doing things
2:50:01you described your ex-husband Brian Boon
2:50:03notorious for doing things like nagging
2:50:05and calling all the time you remember
2:50:07your testimony calling people notorious
2:50:09for doing
2:50:10things yes what would you say people
2:50:15would say you're notorious
2:50:17for I don't know
2:50:23and you would not answer Brian Boon your
2:50:26ex-husband's phone calls just so that
2:50:29you could let him know that you're busy
2:50:30and you have things going on
2:50:33correct I knew that at whatever time it
2:50:36was that he was calling me that he could
2:50:39wait for the few moments of me getting
2:50:42up to where Lucas gets off school out of
2:50:44school at 3:00 okay but you wouldn't
2:50:48return his call you would let him call
2:50:49several times
2:50:51correct that day yes okay how about
2:50:53other days would he have to call to
2:50:55remind you to get Lucas on other days he
2:50:58wasn't reminding me he was
2:51:01just making sure that uh Lucas was was
2:51:06covered for a pickup or drop off all
2:51:10right you didn't mention uh to the
2:51:13Sheriff's Office on either February 24th
2:51:17or February 25th about going to Publix
2:51:19with Mr Torres at noon or 12:17 did you
2:51:23I don't
2:51:25recall so the best the best evidence of
2:51:28that would be the reporting of those
2:51:30interviews cor
2:51:36right did you not remember going to
2:51:39Publix with Mr Torres that
2:51:42day at what point at any
2:51:46point no I didn't
2:51:50you uh had indicated to the police that
2:51:53um it was about 400 p.m. that you all
2:51:55had started drinking after two ures you
2:51:57recall that I
2:51:59do and your testimony today was that it
2:52:03was really more after you guys went to
2:52:05publ at about 12:17 p.m.
2:52:08correct
2:52:09yes and you did not tell the truth
2:52:13correct I'm sorry I you did not tell the
2:52:17the truth to the police about that
2:52:19correct I did
2:52:21not and when they were asking you about
2:52:24Mr torres's
2:52:26injuries you told them that you had
2:52:28nothing to do with it correct yes and
2:52:31that was not the truth correct
2:52:50what did you all have for breakfast on
2:52:51the uh
2:52:5423rd I don't remember did y' all have
2:52:58lunch I believe we had leftovers from I
2:53:02think something that we had in the
2:53:04fridge and do you recall what those
2:53:09were not not at this point
2:53:11no and then I believe you mentioned
2:53:14having a sandwich of some sort for
2:53:15dinner
2:53:18or I'm guessing me and I ate at the same
2:53:41time and at one point Mr Torres called
2:53:45his brother Juan
2:53:47correct and do you admit that you were
2:53:49yelling in the background telling Mr
2:53:51Torres to tell his brother that he had
2:53:53been choking you I don't know if I
2:53:56Wasing I know that I he could hear me
2:53:59through the
2:54:00phone so how long had that been going on
2:54:03that day when did you start uh getting
2:54:05on Mr TR about choking you in the
2:54:10past I had he and I had had
2:54:13conversations about it um because he
2:54:16didn't remember doing it
2:54:19and
2:54:21um the next day and the day
2:54:26of is it fair to say that there are just
2:54:29points in time where you don't remember
2:54:31what you do either
2:54:33correct are you talking about almost
2:54:35five years ago I'm talking about from
2:54:37drinking is it fair to say that you
2:54:40don't often remember things that you did
2:54:42while you were drinking I would not say
2:54:44often
2:54:45okay in the course of your relationship
2:54:48before us are there things you don't
2:54:50remember happening that happened the
2:54:51night before between you and
2:54:53him I can't say that at this
2:54:58point but you said that you don't
2:55:00remember taking that photograph at 11:03
2:55:02p.m. on February 23rd correct
2:55:10yes was there anything else that you
2:55:12were telling Mr Torres that he needed to
2:55:14tell his
2:55:16brother not that I can Rec okay was
2:55:19there anything you were telling him that
2:55:20he needed to tell his daughters
2:55:52now you indicated that Mr Torres would
2:55:55use your phone to look at
2:55:57pornography correct were there ever any
2:56:00points in times when it was you it was
2:56:02you looking at
2:56:04pornography if I was it was to go back
2:56:07and look to
2:56:15see did you ever threatened to get Mr
2:56:19Torres arrested if he did not do what
2:56:21you wanted him to
2:56:23do I wouldn't say threatened okay well
2:56:28were there ever points in times where
2:56:29you would like him to call you or return
2:56:31a call and if he didn't do that um you
2:56:34would threaten to get him
2:56:36arrested it depends on if he had my keys
2:56:39or something that I needed from him
2:56:42okay and it was your townhouse
2:56:46correct m yes FL hours well when did you
2:56:51get him off the
2:56:52lease um I'm not sure what year it was
2:56:56but I don't think he was actually
2:56:57removed from the Lee okay he was made of
2:57:00different type of
2:57:02tenant
2:57:04and did you change the locks so that he
2:57:07couldn't get back in at the points in
2:57:08times when you kicked him out I did
2:57:11sometimes and then would you leave the
2:57:14key in the hiding spot that he was aware
2:57:16of
2:57:20there were multiple hiding places okay
2:57:23on any of the 911 calls did you ever
2:57:25mention that Mr Toros was aware of where
2:57:28you kept your keys and that's how he got
2:57:29back into the
2:57:32house no I needed
2:57:34to he would never break into my
2:57:39home all right it's your testimony that
2:57:41you did not push him down the stairs
2:57:43correct yes and in fact it was him that
2:57:47dragged you down the stairs the night
2:57:50before correct yes now by dragged were
2:57:53did you leave your
2:57:54feet Yes and did you get scrapes on your
2:57:58knees or anywhere from the
2:58:00carpet I'm not sure did you get any
2:58:03injuries like bruises or abrasions or
2:58:06scrapes um I was missing a lot of my
2:58:11hair yes that was on the stairwell okay
2:58:14and you agree that you were photographed
2:58:17on February 24th when the police came
2:58:19out correct the day of the incident well
2:58:23the afternoon after the incident we're
2:58:24not sure when he passed
2:58:29yes some of those photographs showed
2:58:32ashtrays inside your house were you I
2:58:34thought you said you guys couldn't smoke
2:58:35inside your house we couldn't but you
2:58:38did right sometimes
2:58:45yes you agree you would go to the
2:58:47hospital and tell them things that were
2:58:50not true correct yes there were times
2:58:53where you would go to the hospital and
2:58:54leave without getting treatment correct
2:58:57yes and is it fair to say that you often
2:59:00had alcohol in your system when you're
2:59:02going to the hospital correct sometimes
2:59:18all right so just to summarize the day
2:59:21to make sure we understand
2:59:23it you all wake up sometime in the
2:59:26morning but it's an unknown time
2:59:29correct on February 23rd or early
2:59:32afternoon I yes I had a problem with the
2:59:34detectives and been having me
2:59:36guesstimate times okay are you the kind
2:59:39of person like most of us that uses your
2:59:41phone when you wake
2:59:43up so the first activity on your phone
2:59:47may have nothing to do with when you
2:59:48woke up is that fair for you yes other
2:59:51than looking at the time Poss okay so at
2:59:55some point you wake up it doesn't sound
2:59:57like you have breakfast correct correct
2:59:59you do some chores correct yes so that
3:00:03is true that part of it is true you did
3:00:05do chores before going to Publix at 1217
3:00:08yes all right after chores you go to
3:00:11Publix and you get that 1.5 L Magnum
3:00:13bottle of Wood Bridge chardonay correct
3:00:16I'm not sure what Magnum is 1.5 liters
3:00:19instead of the
3:00:20750s it's the double size it's like two
3:00:22bottles of wine okay yes so you got a
3:00:251.5 lit right yes it is the larger
3:00:28bottle and you got home and you at 100
3:00:31PB and Mr Torres at 103 lb began
3:00:33drinking this wine correct I'm I'm
3:00:36guessing so I'm not going to guess times
3:00:39well don't guess I mean you got home
3:00:40from Publix when was your first
3:00:43drink I'm not sure I mean we could have
3:00:46continued to do
3:00:48was left over from what we didn't do
3:00:51before we went to Publix okay so you may
3:00:53have Dr started drinking even later
3:00:55correct then 12:30 when you get back
3:00:58from
3:00:59Publix I I I I don't know okay was it
3:01:031:30 or 2:30 when he began drinking I
3:01:06don't know all right was it before any
3:01:08of the phone calls to the brothers and
3:01:10the and his daughters
3:01:14yes and so you drink what's left in the
3:01:18mag the bottle of wine from the day
3:01:19before that's halfway label correct at
3:01:22some point and then you drink 1.5 L of
3:01:26wine and he goes out and gets another
3:01:28one on his own without your permission
3:01:31or suggestion about 5:30 correct correct
3:01:35and then you all consume that one as
3:01:36well and it ends up in the trash can at
3:01:38the end of the night correct apparently
3:01:42okay at what point in the night does
3:01:45your memory tape stop you descri that it
3:01:48wasn't on at 11:03 p.m. when that
3:01:50photograph was taken what's the last
3:01:52thing you actually do remember prior to
3:01:54these videos being
3:01:58made I I don't recall at this point
3:02:03I I I don't
3:02:06remember all right and so it ends in
3:02:11hide and seek after arts and puzzles
3:02:14correct he says tag you're it but you
3:02:16run and go upstairs and H right yes so
3:02:19does that mean he's it and he's supposed
3:02:20to come find
3:02:22you no so you both
3:02:26hide no okay how does this
3:02:30work I I don't know how to tell you I
3:02:34okay I was it and I I went and ahead I
3:02:38mean my understanding of the rules of
3:02:40hide and seek is one person will be it
3:02:43cover his or her eyes and count to like
3:02:4520 and then go find the person that's
3:02:46hiding is that you're familiarity with
3:02:48the rules too or you guys have house
3:02:51rules I understand how
3:02:55the so explain to me what was your
3:02:57expectation you go up to the shower were
3:02:59you expecting him to come find you I was

3:03:09downstairs right and because of the way
3:03:12your townhouse is set up you can kind of
3:03:14see over where the suitcase is and that
3:03:16he's trying to hide in there but is not
3:03:18successfully hidden just yet I mean yes
3:03:21you have to come down a good ways in
3:03:22order to be able to right but you saw
3:03:25you testify those before you got to the
3:03:27bottom yes all right and then you come
3:03:30over there and thinking that it's funny
3:03:33you zip them shot correct yes we both
3:03:35thought it was funny okay the defendant

3:05:50left an opening that his hand got out of

3:14:22and your testimony is start poking him
3:14:25with the end of
3:14:26it did you say this was the second video
3:14:29between the two videos that's that's
3:14:30when you started hitting with the bat
3:14:32because he was getting angry and trying
3:14:33to escape correct right I was not
3:14:36hitting him I was yes okay did you ever
3:14:39hit him with the bat while he was
3:14:41outside of the suitcase
3:14:44no so each time
3:14:47that he is hit with the backat it's
3:14:50through this
3:14:53suitcase and that's what leavs the marks
3:14:55on them because you didn't hit him with
3:14:56the bat outside of the suitcase correct
3:14:59yes if you'd like me to demonstrate no
3:15:01that's okay suitcase is speak for itself
3:15:06um and then you take the second video
3:15:09and you go upstairs and go to bed
3:15:11correct I apparently went upstairs and I
3:15:13used the thumb to make a phone call okay
3:15:15and then I fell asleep all right and at
3:15:17the point in time when you left and went
3:15:19upstairs he was still inside the
3:15:21suitcase correct correct was he still
3:15:23asking for you and calling your name not
3:15:26that I can recall did you say sh to him
3:15:29again I don't remember did you tell him
3:15:33that this was his problem and it's on
3:15:34you
3:15:35again I don't remember did you do
3:15:38anything to help him escape from the
3:15:40predicament that you zipped him up
3:15:44in no no other question
3:15:48any redirect

3:16:00you you poked
3:16:01him and you didn't poke it you poked
3:16:04every time you poked him hard with the
3:16:07the bat he was inside the
