0:17investigation is Sarah Boon and the
0:20suitcase murder trial now I've covered
0:22several murders involving suitcases in
0:25all those situations the suitcase was
0:27used to dispose of dismembered body
0:30parts this case is different here the
0:34suitcase is alleged to be the actual
0:38murder weapon here's the
0:44story in February 24th 2020 Sarah Boon
0:47and her boyfriend George Torres were
0:49spending an evening together at Sarah's
0:52home the couple had a bit of a
0:53tumultuous past both had been arrested
0:55on domestic violence charges but they
0:57always seemed to get back together on
1:00this night the two were drinking but
1:02what happened next is almost
1:04inexplicable George got inside of a
1:06suitcase that was then zipped shut why
1:09and exactly how he got into the suitcase
1:11is not 100% clear but what is clear is
1:15that at one point he wanted to get out
1:17he pleaded with Sarah to open the
1:19suitcase but she refused instead she
1:23turned on the video camera on her phone
1:25and started to record as George begged
1:28for his life still she refused to unzip
1:31the suitcase then the following morning
1:33she eventually called 911 she said she
1:37and George were playing hide and seek
1:38and George ended up in the suitcase when
1:41police responded they found George dead
1:44Sarah has been charged with second
1:46degree murder but now she claims she was
1:49the victim and is claiming battered
1:51spouse syndrome what happened inside
1:53that apartment and why was George in
1:56that suitcase
2:00we've been talking about this story for
2:01quite some time the public reaction um
2:05is strong and and and it always comes
2:08back to that image and I'm going to show
2:10you that image right now so I wanted to
2:11warn you some people find this difficult
2:13to watch but it's the video that Sarah
2:16Boon the first video that Sarah Boon
2:19recorded and you'll see the suitcase
2:21you'll hear George torres's voice he's
2:25inside that suitcase you'll hear Sarah
2:27Boon's voice she's the one holding the
2:31camera let's

4:43just a couple of
4:44minutes obviously that's not the entire
4:48time that George is inside that suitcase
4:52which brings me to my first question and
4:55I think it'll be an important one at the
4:56trial how long was George
5:01in the
5:03suitcase when did he get
5:05in when was it finally
5:08unzipped joining me Court TV digital
5:12content producer who's been covering
5:14this story uh inside and out Lauren
5:17Silver is with us and forensic
5:18pathologist Dr priia bannery thank you
5:21both for being here Lauren I'll begin
5:24with you and I want to put this up on
5:25the screen we have somewhat of a
5:27timeline here of what's going on but I
5:29want you to kind of fill in the blanks
5:32um it seems that he's in the suitcase by
5:361112 or
5:37so um Falls exactly so 11 what are they
5:43doing that night at 11:12 that gets him
5:45into the suitcase and how precise is
5:48that time so we know that the their
5:51evening starts at some sometime around
5:53400 p.m. when the two of them are at
5:56home they're painting pictures doing
5:57puzzles and it starts with sharing a
5:59bottle of wine at some point they
6:01decided to play hide and seek Sarah HIIT
6:05upstairs she says George never came to
6:07look for so she went downstairs and
6:09found him and at that point they thought
6:11it would be funny to zip him into the
6:12suitcase now where we're getting that
6:151112 time is that's the first video
6:18recording that you just saw that was on
6:20Sarah's phone so at that point he's
6:23already in the suitcase and saying that
6:25he's having trouble breathing and then
6:28eventually somehow some way she leaves
6:31downstairs goes upstairs and goes to
6:34sleep we get to the next morning what's
6:37the what's the time frame here is is is
6:39she finding him um early in the morning
6:43midm morning late
6:46morning she says she went up uh went to
6:49sleep uh she assumed that she he would
6:52find his own way out of the suitcase so
6:55uh she say she was woken up at about
6:5611:00 a.m. by her phone ringing over and
6:59over again again she assumed it was her
7:00ex-husband looked around and realized I
7:02don't see George so she went downstairs
7:04looking for him and it's at that point
7:06that she realized he was in the suitcase
7:08she couldn't he was unresponsive she
7:10couldn't wake him up and uh her
7:12immediate response was to call her
7:13ex-husband so I'm doing the the math as
7:16you're describing all this like it seems
7:18a at a at a minimum it's 11 hours and 48
7:21minutes all right Dr priia
7:24bannery how long could someone survive
7:28in a suitcase like that and and and is
7:32there any way to tell with any Precision
7:35is it a ballpark and what would it be
7:38like for that amount of time for George
7:44Torres I'm sorry I can't hear
7:47you can can you hear me Dr
7:53bannery doc we're having some trouble
7:55obviously with Dr banery uh hearing me
7:58um so Lauren as we get back
8:01to the suitcase and and the time frame
8:04let's get back to that morning um what's
8:07her story about what she does when she
8:09realizes that he's in the in the
8:11suitcase I I've got to think that she
8:12unzips it right so uh ostensibly she
8:17unzips it realizes she cannot wake him
8:19up uh and her this is at 11:00 in the
8:23morning her first response is to call
8:25her
8:26ex-husband um so she called her
8:31ex-husband her ex-husband came over she
8:34insisted he come over he also saw that
8:37George was
8:38unresponsive and said they needed to
8:40call 911 and then he went outside and
8:42waited until the police
8:46arrived that is so I don't know how long
8:48it took him to get there police arrived
8:51at
8:521:00 and so police aren't there till
8:551:00 in the afternoon and at a minimum
8:59um I mean the the the latest that he
9:01could have gotten in there was 11:12 at
9:04night this to me this is a a big piece
9:08of the story a big piece of the case
9:10because you're talking about okay you're
9:12playing hide and seek you know things go
9:15arai whatever this is overnight this is
9:19through the morning into the afternoon
9:24that George Torres is inside that
9:26suitcase you know the other question a
9:27lot of people have had is is about how
9:30does he even get in there but my
9:32understanding George Torres was um he
9:35wasn't a huge man I mean he was
9:37relatively small he was thin not super
9:40tall um so in terms of his
9:45size um it if you had to describe him
9:49Lauren um or has have they given a a
9:52weight and a height in in some of the
9:54documents do we know that I haven't seen
9:57it um I'm not great with those numbers
10:00and I can't say that I've ever tried to
10:03put humans into a suitcase uh so I don't
10:07know how well or how badly you would fit
10:10um but what Sarah does tell the police
10:13is that he got in willingly they were
10:15laughing about it um and that Sarah
10:18zipped him up but uh two of his fingers
10:21were sticking out of the uh suitcase and
10:24they're having trouble getting them in
10:26and she noted that the handle on the
10:29Zipper was broken and uh they were able
10:32to zip it closed with a paperclip so it
10:35was a broken suitcase the Zipper was
10:37broken but she still maintained he would
10:40find his own way out all right Dr priia
10:42banery back with us uh the question I
10:45have for
10:46you how long could he survive in that
10:49suitcase with it zipped shut we're you
10:51know we've got this 12 seemingly 12
10:54potentially 12 plus hours that he's in
10:57there but how long would it take for him
11:00to no longer be able to
11:03survive well like Lauren said it's not
11:06an experiment we
11:08run in any kind of way you know with
11:11real people he does look thin and
11:14obviously he was able to fold up I don't
11:16expect that to be a roomy suitcase and
11:19why I say that is your breathing is
11:23dependent on your chest and belly right
11:26rising and falling so being able to take
11:29deep breast and if you're scrunched
11:31forward or folded into a suitcase uh at
11:35that point you're your neck everything
11:38is scrunched right so it doesn't even
11:40have the room to expand and then
11:42someone's going to get real tired right
11:44between the stress of being in there um
11:48using up energy and then this doesn't
11:51seem like a thin cloth you know it looks
11:54like a more rugged even though the
11:56zipper's broken so it's not going to be
11:58so breathable that Oxygen's going to get
12:02in so I'm treating it as sort of a
12:03closed space and as soon as that air
12:06quality you know the oxygen runs out
12:08that's it it's going to be minutes you
12:10know we do know the physiology of
12:12someone being strangled uh it's going to
12:14be longer than that because it's going
12:16to take uh longer for the air to you
12:19know oxygen to run out but it's not 11
12:22hours it's going to be shed and it's
12:24traumatic to think that he's asking for
12:27help and he's laughing and and is he
12:29realizing what's happening like at what
12:31point absolutely he does he realize that
12:34oh my goodness this this could be the
12:37end well I think it's sort of a slippery
12:40slope right he's going to become more
12:42confused as the oxygen goes down right
12:45he's going to become weaker so it's both
12:47expending energy and using up the oxygen
12:50so that means he's going to become tired
12:52and his brain's going to become foggy
12:55but she's also overtly laughing at him
12:58right so he's maybe she even removes
13:00herself before he dies that's even
13:03scarier no one's there at the end so I
13:05just think it's it's awful to think
13:07about okay we've got more to uh uncover
13:10and in this case coming up next how did
13:13the suitcase flip

13:36S Sarah Boon is charged with second
13:39deegree murder after her boyfriend
13:41suffocated inside of a
13:43suitcase he's in the suitcase still
13:46there are multiple domestic violence
13:48incidents you two hitting each other
13:50Sarah this my don't wear it up he's
13:53telling you Sarah I can't breathe George
13:55Torres locked inside of a suitcase
13:58begging for help
13:59I thought he was okay the suitcase
14:02murder trial live coverage starting
14:04October 7th on court
14:09TV we have a puzzle that we started in
14:11there okay we've been doing art trying
14:13to taking stuff off the wall to make new
14:15art up there like having a good time
14:17with one another but we're drinking we
14:19had a bottle of wine last night okay so
14:21then it's like we decided to play
14:23hide-and seek right okay so he gets in
14:25the suitcase the problem is is I fell
14:28asleep I fell asleep when did you do CPR
14:31this morning when I found it before you
14:33called
14:35yes 1:00 right now I
14:38tried I was awake but I actually got out
14:41of the bed at like 12:30ish whatever so
14:43I came downstairs and I was like oh he's
14:46in the suitcase still and that's when I
14:48found him and I took him out and I tried
14:50doing CPR and then I called him and then
14:52I called you guys I fell asleep so I
14:54don't know if he suffocated or like had
14:56an aneurysm or a heart attack or what
14:58what kind of medical
14:59conditions that he have nothing that I
15:01know of nothing that you know of take
15:03any medical last night no all we had was
15:06a bottle of
15:08mine yeah 12 hours locked inside of a
15:11suitcase it's not going to be an
15:12aneurysm uh that's going to take your
15:14life so I wanted to I I I said there's
15:17more than one video there's two videos
15:19the second one's a little bit shorter
15:20but I want to show you the second video
15:23as we watch it and listen to it um take
15:27a close look cuz it's it's interesting
15:31to see the positioning of of the uh
15:34suitcase

15:59so the positioning of the suitcase where
16:01it is on the floor and you heard George
16:03was still alive there saying Sarah uh
16:06again pleading for his life let's take a
16:08look at the first video next to the
16:11second
16:12video and the one thing that's clear to
16:15me is that it it's not in the same
16:17position it's moved it is it's
16:21it's it's on its back on one and then
16:24it's on its on the other side in the
16:26other picture so it's not stationary
16:30it's not like he's in the suitcase he's
16:32locked in and the suitcase stays
16:35there something else is at play here
16:38brings me to my next question which
16:41is how did the suitcase flip over what
16:45what's going on there is is it him is is
16:49she torturing him what what exactly is
16:53going on here that changes the position
16:56of that
16:57suitcase with Court TV digital content
17:00producer Lauren Silver and forensic
17:02pathologist Dr priia bannery Lauren is
17:05there any evidence or statements
17:07relative to the positioning of the
17:10suitcase because it's obviously on
17:13different sides flipped over from video
17:15one to video
17:17two well I I ConEd through the documents
17:20and she is very clear that she had been
17:24upstairs the suitcase was downstairs and
17:26they got in the suitcase downstairs so
17:28she said the suitcase was always
17:30downstairs there were some items in
17:32there that they wanted to unpack they
17:33took them out he got in and then she
17:36zipped it up the only mention of the
17:38movement which you clear in the videos
17:41is in by the detectives themselves in
17:43the police report noting on the video
17:46that in the first the suitcase is facing
17:48downward and you can see George is
17:50pressing from inside to get out whereas
17:52the second one it's facing upwards and
17:55is moved over to the left side of the
17:57living room it doesn't doesn't offer any
17:59speculation as to how that happened and
18:01as far as I know Sarah Boon's never
18:03given any
18:04explanation let me ask you Dr priia
18:06banery um I guess two scenarios I want
18:10to talk about one scenario though if she
18:12is moving this suitcase around and
18:14rolling it
18:15around would you expect to find any
18:18particular types of injuries uh during
18:21the autopsy that could perhaps be
18:24consistent with someone being locked in
18:25a suitcase and sort of tossed around in
18:28that
18:31suitcase yeah I don't I don't know the
18:33exact model of the suitcase but
18:35obviously that would be available to my
18:37colleagues often times I think you would
18:39look for Marks like whether it's be
18:42contusion so bruising from any sort of
18:45ribbing
18:46handle uh the wheels jutting in any kind
18:49of Hardware or outpouchings usually I
18:53mean it's pretty smooth but you don't
18:54know how he's like you know scrunched up
18:57in there the one thing I want to point
18:59out though is if and this is pure
19:01speculation if it was twisted while he
19:04was alive you can see that the zipper is
19:08now on the bottom right if we're moving
19:10from position one
19:12being uh on the rightand side of my
19:15screen to the side you know where it
19:18flips over on the rug now uh the sort of
19:22lid if you will the zipper portion is
19:24now on the floor that's impossible to
19:27exate yourself from even if if he's
19:29trying to undo the zipper which is
19:31faulty and then of itself you can see
19:33how is he going to LIF lift the lid off
19:35even if he's trying to kick you know I
19:37don't think it it's so small a grown man
19:40even if he's fa is gonna have a very
19:42difficult time getting out now there's a
19:45video posted on Deep dive True Crime on
19:48YouTube which appears to feature audio
19:50from a police interview with Sarah
19:53Boon's neighbor now in it he describes
19:55hearing a loud crash let's take a listen
20:00do you recall hearing anything coming
20:03from apartment 3 while you were um after
20:06you had gotten home uh around 10:30 or
20:1011:00 there was a very loud crashing
20:13sound where uh I believe I'm not sure I
20:15haven't been in there har my room but I
20:18believe it's the location of the
20:20staircase okay so a little bit above a
20:24very loud you said crashing sound yeah
20:27like it sounded like something been like
20:29walking down the
20:31stairs cuz it started up high and then
20:33it ended um
20:37low okay Dr priia banery if again if
20:41this suitcase with a man inside shut is
20:46rolled down a
20:48staircase what type of injuries would
20:50you expect and would you expect someone
20:53to still be conscious and be able to
20:55talk the way um George was when he was
20:58begging for his
20:59life sure just to clarify are you asking
21:02whether he's already inside the suitcase
21:04as he goes down the stairs oh yeah
21:06inside the suitcase being rolled down
21:08the stairs yeah well that's a whole
21:10another can of worms you can imagine as
21:12that tumbling motion is in there that
21:15could he could bang around and at least
21:18I know it's a softsided suitcase but
21:19there has to be some reinforcement frame
21:21in there those can add you know bumps
21:24and bruises to him um so you should see
21:27some unexplained injuries in that Source
21:29I I don't think there is any significant
21:31head trauma from what I wrot read about
21:34his cause of death it was all the
21:37latest appication Dr priia banery Lauren

21:47investigation continues
22:15I'm VI polyan we continue our
22:16investigation of Sarah Boone and the
22:18suitcase murder trial the biggest issue
22:21for Sarah Boon is that she recorded
22:23herself taunting the victim George
22:26Torres while he begged for his life from
22:28inside a suitcase that inexplicable
22:31behavior is what she'll need to explain
22:34at trial here's the
22:40story Sarah Boon and George Torres were
22:43involved in an on again off again
22:44tumultuous relationship filled with
22:47accusations of cheating and abuse but on
22:50February 23rd 2020 Sarah and George were
22:53together at her home spending some time
22:56together drinking but at some point that
22:58night for some reason George ended up
23:01locked inside of a suitcase while Sarah
23:04taunted him as she recorded a video
23:07George tragically died and now Sarah is
23:09facing murder charges and there are
23:11still many lingering questions in this
23:14case about their relationship and
23:16exactly why Sarah didn't open that
23:19suitcase and just let George
23:23out you know sometimes going into a
23:25trial we know some of the facts and we
23:28know a little bit about the defendant
23:30and what they may or may not have said
23:32this case is different Sarah Boone um
23:34from the 911 call to to the uh interview
23:39SL interrogation to the body cam video
23:43from the responding officers we get to
23:45hear her um tell her story so I want to
23:49play for you right now uh body cam video
23:53from the next day when you have the the
23:54off the responding officer speaking with
23:56Sarah Boon and trying to get a an
23:59understanding of of what's going on here
24:01let's take a look we have a puzzle that
24:04we started in there okay we've been
24:05doing art TR to take the stuff off the
24:07wall to make new AR up there like having
24:10a good time with one another but we're
24:11drinking we had a bottle of wine last
24:13night okay so then it's like we decided
24:15to play hide and seek right okay so he
24:18gets in the suitcase okay who is this
24:20guy that's my ex-husband my former
24:22husband how he lives here with you guys
24:24no I called him over here okay okay I
24:27didn't know what to do okay I didn't
24:29know what to do okay so then he came
24:31over here here let's talk in private
24:33okay I called you
24:35guys it's like
24:37a the problem is is I fell asleep I fell
24:41asleep when did you do CPR this morning
24:44when I found it before you called yes
24:47yes 1:00 right now I tried I was awake
24:52but I actually got out of the bed at
24:54like 12:30ish whatever so I came
24:56downstairs and I was like he's in the
24:58suitcase still and that's when I found
25:01him and I took him out and tried doing
25:02CPR and then I called him and then I
25:04called you guys did he get here before
25:06the fire department down here who your
25:08husband or your ex-husband okay where
25:09did he live at uh right down the street
25:12okay so you were playing and who zipped
25:15him up and I did but then I fell asleep
25:18okay okay you're okay I don't I wasn't
25:21here I'm just trying to figure out what
25:22happened I fell asleep so I don't know
25:23if they suffocated or like had an
25:25aneurysm or a heart attack or what what
25:27kind of medical conditions that you had
25:29nothing that I know of nothing that you
25:31know of take any medical last night no
25:35all we had was a bottle of wine
25:37literally just a bottle of wine okay
25:39doing puzzle artwork then we decided to
25:41play hide and seat M that's all that
25:44happened so that's that's her story to
25:47the responding officer but as I as I
25:49told you that's not the only person
25:52she's uh talking to and and that her
25:55story or her statements are recorded so
25:58that brings me to my next question and
26:00it's an important one for the trial is
26:02Sarah Boon's story
26:04consistent how many times have we seen
26:07cases where stories change and you hear
26:10those arguments in the courtroom that
26:11the story has evolved the story has
26:14change well is her story consistent here
26:17with what happened joining me Sarah
26:20Boon's new
26:22attorney James Owens is with us and
26:25James I understand you're preparing for
26:26trial so I know there may be some things
26:29you can't talk about I just want to let
26:30the viewers know um that that's part of
26:33the deal when we bring on on the lawyer
26:35and thank you so much for being here
26:37also with us a sar's former defense
26:39attorney Frank bankowitz so thank you
26:42both for being here I do appreciate it
26:45so I wanted to point out a couple of
26:48scenarios here and kind of get your your
26:50your take on it and I'll begin with um
26:54Sarah Boon talking about when she woke
26:56up um
26:59in one statement Sarah woke up to her
27:01cell phone ringing multiple times around
27:031100 hours this is in a police statement
27:05she went downstairs did not see George
27:07anywhere in the apartment she then
27:09realizes that he was possibly still
27:11inside the suitcase Sarah unzipped the
27:13suitcase and found George unresponsive
27:15and not
27:16breathing however on the on the body cam
27:19video I I want to play that so we can
27:22see if it's consistent with that
27:25version when did you do CPR this morning
27:28when I found it before you called
27:31yes 1:00 right now I tried I was awake
27:36but I actually got out of the bed at
27:38like 12:30ish
27:40whatever okay so so James is is there a
27:43problem here and when she's getting up
27:46or is is this story uh consistent at
27:49least this part of when she gets up the
27:51following
27:55morning thanks for having me Vinnie um I
27:58you know I don't think she had a watch
28:00on every time they're asking her
28:02questions about the
28:05times guessing trying to give him an
28:07answer um
28:09so don't think she should
28:15be looked down upon or considered that
28:18she's being
28:20evasive I just think she didn't know the
28:22time
28:23frame Frank from your perspective is is
28:26is there a problem with with her story
28:28or is it something that that is
28:32consistent enough for a jury to say hey
28:35every time she's telling the story she's
28:37telling the same story about what
28:38happened that
28:43morning well I I don't know that you can
28:46point to in
28:47inconsistencies I think it's uh you know
28:50she's nervous she's
28:52upset uh you know
28:54she's basically kind of in a panic mode
28:57from what I in the video and what I've
28:59seen in the past and I don't know that
29:01you can point to those as being
29:04inconsistencies all I want to show
29:06another um I go to another issue here
29:09which is the state of mind that night
29:11and what was
29:13happening first Sarah mentioned that she
29:16and George had been consuming alcohol
29:18during the night and she went upstairs
29:21and passed out in her bed but here she
29:23is in her interview talking about the
29:25same issue of drink that night you told
29:30me on the yeah but you told me on
29:31recording like that you were not drunk
29:33he was not drunk you guys were having a
29:35good time I don't get I can't get drunk
29:38number one I do not want to get drunk I
29:42don't like being nomenus having my wits
29:45about myself I don't like feeling out of
29:47control
29:49mhm so I'm just saying you're you're
29:52making it sound like like he's a raging
29:54alcoholic today and yesterday I was kind
29:57of asking you this question questioned
29:58and you're like a little defensive like
30:00no we're not alcoholics he we are not
30:03you know but you guys were both sober on
30:07Sunday to your knowledge because when I
30:09said you went and passed out you were
30:11like no I didn't pass out I just fell
30:13asleep so now it's kind of like what is
30:16it is were you guys drinking and it got
30:18out of hand and it got physical or is it
30:23Sunday was one of the better days that
30:25we have had in quite some time so so
30:29where were you guys at
30:31on on drunkenness not drunkenness on
30:36Sunday you told us you weren't drunk no
30:38I was not drunk I was not
30:41drunk okay James from the beginning of
30:43my coverage of the story that's always
30:44been a big issue because you listen to
30:46The Voice it sounds like she's under the
30:48influence is this is this a problem um
30:52the fact that she seems to be denying
30:54that they were drinking denying that she
30:55was drunk or was she actually uh sober
30:58that
31:02night no I think they were drinking and
31:05I that
31:07um earlier in the day
31:10she to the Publix which is a short
31:13distance away from their
31:16apartment and then later on the day he
31:19went a second time to Publix and got
31:21another
31:22bottle so um both of those and found in
31:27the garbage can and the receipts were
31:29found some in the apartment so
31:33um they were the only in the apartment
31:37that night so they they both
31:40consumed so so they did they did drink
31:43quite a bit Frank uh B wit let me ask
31:47you about that issue of the drinking is
31:51that a huge problem for Sarah Boon that
31:54they were drinking or does this H how
31:57does this play in front of a jury and
31:59what does it
32:04mean well I would agree with Mr Owens uh
32:07they were drinking a lot they consumed
32:09two full bottles of wine uh they kep
32:13finished one and went out and bought it
32:15at the second and finished it uh you
32:17know whether in her mind at that point
32:20in time she can uh establish whether she
32:23was drunk or not I think that's going to
32:25be a question for the jury and they're
32:28going to have to look at all these tapes
32:30and you know and look at the actual
32:32facts as to what she did where she had
32:35gone and the fact that she quote fell
32:38asleep uh to me is consistent with being
32:41passed out but uh that's to me um
32:45fortunately I don't have to deal with
32:48that Mr Owens
32:49does Mr Owens number nine will be
32:52representing Sarah Boon at the trial um
32:56this is a big one now I think this is
32:57probably the biggest one if there is an
33:01inconsistency um from the beginning it
33:03seems that Sarah was talking about
33:05playing a game of hide and seek that
33:07George willingly got into the suitcase
33:10Sarah zipped the suitcase up and they
33:12were both laughing as she zipped him
33:14into the suitcase but now I want to play
33:17the last time James you were in court
33:19talking about what Sarah's defense is
33:22going to be in this
33:24case judge the state doesn't know what
33:28was what happened the two minutes prior
33:31or the the the minutes leading up to the
33:34time leading up to the two-minute video
33:36the state doesn't know what happened
33:38after the two-minute video only Sarah
33:40Boone can testify to
33:43that that's for her to testify to
33:46Florida the appellant has not cited nor
33:48is our re research located any Florida
33:51case holding that evidence of battered
33:53spouse syndrome is admissible where the
33:55defendant claims accident rather than
33:58self-defense who claims accident who
34:00claim whoa are you claiming self-defense
34:04yes well that's the first time that I've
34:06heard that judge I just mentioned it a
34:08while ago the word self-defense never
34:09came out of your mouth judge words that
34:12you believe that the state's position is
34:14what you believe that they're going to
34:16try to establish that we don't know what
34:17happened before and after that video the
34:19words self-defense have never been
34:21uttered this afternoon judge for the
34:22record we're claiming self-defense we're
34:25utilizing the battered spouse syndrome
34:27in in conjunction with that defense okay
34:30right not accident as they want to
34:34allege
34:36okay okay James let me ask you if if
34:39they're laughing if she says they're
34:41laughing when she zipped them in how
34:43does that equal self-defense is that
34:48inconsistent well like I said in
34:51court the video is only two minutes long
34:56that Sarah recorded of George in the
34:58suitcase
35:00so um no one but Sarah knows what
35:04happened prior
35:07toed and no one but Sarah knows what
35:11happened turned off the
35:13video
35:17so or to testify to and explain what
35:21happened all right James Owens and Frank

36:54saying for everything you've done to me

37:36major issue in this case was there a
37:39history of domestic violence Sarah Boon

37:45Torres still with me Sarah Boon new
37:48attorney James Owens and her former
37:51attorney uh Frank bankowitz um before we
37:55talk about this I want to show one more
37:56video from another uh uh domestic
37:59violence incident this one's from
38:00September 4th of
38:052019 George was hiding in the bathtub
38:08upstairs okay yes
38:12so he gave me his side of things I need
38:15you to give me your side of things in
38:16person right here and know we kind of
38:17talked on the phone but I need you to
38:18tell me what happened tonight so what
38:20happened okay well pardon my language
38:24cuz it's not me I was called a
38:29and okay and I'm not a mother to my son
38:34okay all the while nonetheless I was
38:37sleeping before that okay so you're
38:39woken up to him calling you names is
38:42that what you're saying I thought that
38:44I'm like Feed the Beast go outside and
38:47smoke a cigarette with him okay try to
38:51call while the whole time I was there
38:54saying nothing
38:57I was called name okay so you guys are
39:00smoking a cigarette he was calling your
39:02names being verbally aggressive with you
39:04verbally
39:06Abus before that before that where I'm
39:09like I don't want to get hit anymore so
39:12I'm just going to go downstairs and
39:14smoke a cigarette with try to calm them
39:16down okay so you're saying okay I'm
39:19trying to get a timeline of things so
39:21start start from the beginning and give
39:23me the timeline I was asleep I don't not
39:25Literal time but in a in reference of
39:28incidents how they occur tonight I was
39:31asleep and again he comes in and wakes
39:33me up he wakes you up okay he's out of
39:35sorts okay so I'm trying to figure
39:38things out where it's like don't make it
39:41worse just go downstairs with him
39:43because he gets mad at me because I go
39:45to sleep okay I go downstairs smoke a
39:49cigarette the whole time I'm being
39:52belittle okay pardon me for saying
39:55talk okay Frank bankowitz
39:59is there a history of domestic violence
40:03in this relationship and if so how
40:10serious
40:12absolutely there's a long history of
40:14domestic violence and I'm sure all of
40:17that's going to come out or has already
40:19come out with regard to The Battered
40:21spouse defense that's one of the
40:23principal elements uh is to establish
40:28uh a history of abuse and there was a
40:32long history of abuse in this case
40:34history of hospitalizations history of
40:37broken bones history of arrests um it
40:41it's a
40:42classic situation of B spous syndrome in
40:45my opinion I want to put this up on the
40:48screen Sarah stated this is June 15th
40:512019 she was beaten up face head legs
40:54and arms she stated that she beg George
40:58to stop and George stated you're going
41:00to die Sarah stated that the George that
41:02George punched her in the head flung her
41:04off the bed Sarah stated this incident
41:06occurred due to George being upset about
41:09Sarah speaking to a male uh James Owens
41:13this this history that we are uncovering
41:15here is the jury going to see and hear
41:19about this
41:24history yes
41:28the filed a notice of intent to rely
41:34on and
41:36um in the notice and in the amended
41:39notice we alleged that there were prior
41:43incidences of
41:46abuse and
41:48uh Dr Julie
41:51Harper to
41:53testify on that
41:56issue so yes
41:58there
42:00cooperation in the term in terms of a
42:04prior
42:05history of
42:09George and
42:11emotionally and
42:13sexually abusing Sarah
42:17Boon have there and and I'm looking here
42:20at George's arrest history it looks like
42:22June 15th arrested for battery June 18th
42:27arrested for violation of pre-trial
42:29release making contact with Sarah when
42:31he wasn't supposed to April August 28th
42:342019 a battery arrest September 4th uh
42:37arrested for battery is is all of this
42:40connected to Sarah or is there are there
42:43other cases that are out there and and
42:46do you expect the jury to hear um the
42:50history of George Torres uh James
42:57yes I believe those instances relate to
43:01uh the
43:03domestic George and Sarah and I believe
43:08there
43:08is other
43:11incidences as far as how much comes in
43:14you know there are rules that come into
43:16play in the
43:18evidence okay I have to make some
43:20decisions about that James I hate to cut
43:23you off but we are out of time James
43:25Owens we appreciate Frank bankowitz
43:27uh thank you both so much you know one
43:29of the biggest mysteries surrounding
43:30this case has been when will this trial
43:32happen Sarah Boon on lawyer number nine
43:36but believe it or not it looks like this
43:38time it will happen we'll see the trial
43:42right here on court TV the question is
43:45what will the jury say at the end of all
