2. 0:02a month since Ryan Ferguson was freed
3. 0:04from prison the Missouri Man spent
4. 0:06almost a decade Behind Bars before his
5. 0:08murder conviction was overturned we're
6. 0:10going to talk with him in a moment but
7. 0:12first 48 Hours correspondent Aaron Mor
8. 0:15arti looks at the long legal fight to
9. 0:17prove his innocence 29-year-old Ryan
10. 0:21Ferguson is trying to make up for lost
11. 0:23time nearly 10 years lost that's how
12. 0:26long he was incarcerated for a crime he
13. 0:29has always always said he didn't commit
14. 0:31just look at the facts look at all the
15. 0:33evidence I think if anybody did that
16. 0:36it's obvious that I don't belong here
17. 0:38guilty of murder in the second degree
18. 0:40Ferguson was 19 when he was convicted of
19. 0:42killing Kent heol a newspaper sports
20. 0:44editor although there was no physical
21. 0:47evidence that linked him to the brutal
22. 0:49murder the state's two eyewitnesses both
23. 0:51had credibility problems Charles Erikson
24. 0:55a former classmate of Ferguson's said
25. 0:57the two teens committed the murder but
26. 0:59seemed to know little about it when
27. 1:02questioned by police the other witness
28. 1:04was a janitor who originally said he
29. 1:07couldn't identify anyone at the crime
30. 1:09scene but at trial would you point to
31. 1:13that individual please yes Ferguson
32. 1:16convicted of murder and robbery was
33. 1:18sentenced to 40 years in prison attorney
34. 1:22Kathleen zelner took the case in 2009
35. 1:26once you're convicted the system works
36. 1:28completely against you
37. 1:30ultimately both state Witnesses recanted
38. 1:34may it please the court in September
39. 1:36zelner argued the case before a Missouri
40. 1:39appell court on November 5th the Court
41. 1:42ruled in Ferguson's
42. 1:44favor Ferguson was released after the
43. 1:47state decided not to retry him he's free
44. 1:52but his past he fears could Shadow his
45. 1:55future I've been working hard on being a
46. 1:57positive asset to the community
47. 2:00anywhere I go and and I might not ever
48. 2:03be given a chance and so that's scary
