  4. 0:19in case
  5. 0:21020536,
  6. 0:23case of 1975.
  7. 0:26It was in front of Judge George
  8. 0:27McMonagle.
  9. 0:29And uh there was a finding of guilty
  10. 0:32at that point, and uh Mr. Jackson
  11. 0:34actually was sentenced to death in the
  12. 0:37uh
  13. 0:38in the
  14. 0:39penitentiary, and um
  15. 0:41the appeals at least uh took that away
  16. 0:44from
  17. 0:45the state, but since then uh there's
  18. 0:46been a motion for a new trial.
  19. 0:48We had a hearing uh few days ago,
  20. 0:51and the motion for a new trial was
  21. 0:52granted.
  22. 0:54And uh
  23. 0:55Mr. Al-Awdah
  24. 0:57Mr.
  25. 0:58Rath the Assistant
  26. 0:59Thank you.
  27. 1:00Uh I'm on behalf of the state of Ohio
  28. 1:01through the area with Mr. McGinty
  29. 1:04uh said the other day the state of Ohio
  30. 1:05at this time I make a motion to dismiss
  31. 1:08the case.
  32. 1:08All right. This case will be dismissed.
  33. 1:11Uh Mr. Jackson, you're going to be free
  34. 1:12to go.
  35. 1:14Uh let me suggest to you that uh
  36. 1:17life is filled with uh small victories,
  37. 1:19and this is a big one.
  38. 1:21Uh know who your friends are because
  39. 1:23you're going to always going to want a
  40. 1:24piece of you. You're going to trust the
  41. 1:25people who you know you can trust.
  42. 1:28So uh I wish you good luck.
  43. 1:30Thank you. Thank you.

  45. 1:32I like to thank you for conducting these
  46. 1:34proceedings
  47. 1:35in a fair and impartial manner.
  48. 1:37And I also I would like to thank the
  49. 1:39prosecutor's office for showing a lot of
  50. 1:41integrity.
  51. 1:42And you guys let the evidence be heard,
  52. 1:44and you followed the evidence.
  53. 1:46And I would like to thank
  54. 1:49You know, you might not know it, but the
  55. 1:50probation officer who interviewed you
  56. 1:52after the verdict before was Mr.
  57. 1:54McGinty,
  58. 1:55who was the prosecutor who just uh
  59. 1:57dismissed the case against you. So, like
  60. 1:59that was a twist. But, everybody did a
  61. 2:02good job here. I'm proud of everybody.
