3. 0:05when her retrial is set for the murder
4. 0:07of her four-year-old son Christopher
5. 0:09Milky ABC 15s Mary Ellen Resendez was in
6. 0:12court and Mary Ellen any idea why this
7. 0:13has said so far out I thought we were
8. 0:15expecting this pretty soon here you know
9. 0:18in a capital murder case Steve the
10. 0:19deadline for it to go to trial is about
11. 0:21two years so judge morose was simply
12. 0:23setting the deadlines for this case to
13. 0:25go to trial and that's going to be in
14. 0:27February of 2015 but depending on how
15. 0:29quickly the defense and prosecution can
16. 0:31argue their separate motions it's very
17. 0:33possible this case will get moved up
18. 0:35it's also possible it can be delayed the
19. 0:38largest motion pending right now is
20. 0:39whether or not detective Armando so
21. 0:41Delta will invoke his Fifth Amendment
22. 0:43right and not testify to the confession
23. 0:46that he claims milky made to him now
24. 0:48milky denies ever confessing that she
25. 0:50had her four-year-old son murdered and
26. 0:52there is no evidence of that confession
27. 0:54other than sad all tease word milky
28. 0:56appeared in court for the first time
29. 0:58dressed in regular clothing a sign of
30. 1:01her freedom her former husband Arizona
31. 1:03milky also in court he came out
32. 1:05disappointed that he'll wait 18 more
33. 1:08months while attorneys wrangle with what
34. 1:10to do with this alleged confession par
