- 1:28so that you're not interfering with
- 1:30other discussions that are going on.

- 1:54and then It's Cahill, Planning Director,

- 1:58and then older person cats in the back.
- 2:02So
- 2:05First item that the adoption of the
- 2:08September 22nd, 2026 Planning Board
- 2:11meetings that everyone's had a chance to
- 2:12review.
- 2:13Any additions, corrections?
- 2:17No.
- 2:18Motion to approve. Andrew Harris.
- 2:21All in favor.
- 2:23>> I'll second.
- 2:24>> I'll second.
- 2:25>> Thank you.
- 2:26>> All in favor.
- 2:28Okay, we are good.
- 2:30We are going to shuffle a couple agenda
- 2:33items around just for efficiency this
- 2:36evening.
- 2:37Um
- 2:38Get back to it.
- 2:40409 East Chester Street. If you guys
- 2:43could come up to the
- 2:49>> Yes, thank you.
- 3:01>> It's number 10.
- 3:03>> Yeah.
- 3:28>> Okay,
- 3:29item 10 tonight, number 409 East Chester
- 3:32Street. It's a major waiver request to
- 3:35increase the build two zone and decrease
- 3:38the rear yard setback. SBL
- 3:4148.75-9-10.100.
- 3:46Secret determination.
- 3:48That's
- 3:51>> It's
- 3:51>> Type-o.
- 3:53>> Trans-tech zone
- 3:55>> and ward 7, Winston and Tracy and Daly,
- 3:59applicant owners.
- 4:02If you guys just quick intro for the
- 4:04record.
- 4:05>> I'm Tracy Ann and this is the
- 4:07>> Winston, welcome.
- 4:09So, you guys are seeking a building
- 4:12permit to construction addition onto
- 4:13your home?
- 4:14>> Yes.
- 4:15>> Okay.
- 4:16Um
- 4:18So, we have referred this to the uh
- 4:20zoning enforcement. Uh two waivers were
- 4:22identified due to the location of the
- 4:24addition. Just want to give us a quick
- 4:26overview of what you're looking to do.
- 4:29>> So, the main thing that we wanted to do
- 4:31was to put in another playroom because
- 4:33of our parents
- 4:34and um we have a non-verbal
- 4:38uh you know, home. He have a non-verbal
- 4:412-year-old.
- 4:42Um autistic and he
- 4:45He needs sensory So, he's always moving,
- 4:48jumping.
- 4:49And the living room is about our current
- 4:52bedroom and there's no rest for us.
- 4:55>> Okay.
- 4:56>> So, the main thing was to put in
- 4:57additional um
- 4:59playroom. Also, my parents are living
- 5:01with us and the room they're now using
- 5:03is very small.
- 5:05And my mom-in-law has arthritis, so we
- 5:07wanted to do a
- 5:09bigger room also.
- 5:10And so, that's how we came up with the
- 5:13addition.
- 5:14And then we decided to put one room just
- 5:16in case if we have family visits. So,
- 5:19come visit.
- 5:20>> Is it Is it something attached?
- 5:21>> So, then essentially what they're doing
- 5:23is they're following the current
- 5:25building form because of the building
- 5:28lines versus having to bring it more
- 5:31like towards the street, which is a busy
- 5:33street, and keeping it in line and just
- 5:37extending to the side.
- 5:38>> Yes.
- 5:39>> They might put a door.
- 5:41>> We need
- 5:41>> We need We need to leave a little bit of
- 5:43openings.
- 5:45>> Okay.
- 5:46>> So, where
- 5:48So, the parents are living
- 5:50>> Yes, I have a question.
- 5:52>> So, for our waiver checklist, so board
- 5:56will go through these questions with a
- 5:57yes or no
- 5:59uh to help make our determination. So,
- 6:02the applicant has included a waiver
- 6:03request letter that clearly identifies
- 6:05and describes the waiver being proposed
- 6:08accompanied by plans and other visual
- 6:10representations as applicable.
- 6:13>> Yes.
- 6:16I [clears throat] ask
- 6:18Yes.
- 6:18>> Uh
- 6:19in their letter, the applicant describes
- 6:21in detail why the waiver is needed and
- 6:23how the waiver request is consistent
- 6:25with the intent, design, and
- 6:26compatibility of the transect zone in
- 6:29which the project is located.
- 6:32>> Yes.
- 6:32>> Yes.
- 6:37>> Will granting the waiver contribute to
- 6:39the realization of the overall intent of
- 6:41the transect zone helping an improved
- 6:43project which will be an attractive and
- 6:45durable contribution to the transect
- 6:47zone?
- 6:48>> Uh I forgot.
- 6:51>> Uh we have yes or no.
- 6:53>> Yes.
- 6:54>> Yes.
- 6:58>> Uh to support walkable neighborhoods and
- 7:01or mixed-use centers, the project
- 7:03emulates the neighborhood context
- 7:05for how far the building buildings
- 7:07relate to the sidewalk, how the facade
- 7:09is designated, and how the building
- 7:11interacts with the street.
- 7:15>> Yeah, yes. The shape was changed.
- 7:17>> Yes, get continuation.
- 7:21The project supports a green and
- 7:22resilient future, for example, by
- 7:24reducing vehicular miles traveled,
- 7:26providing green infrastructure and or
- 7:28street trees, and or including
- 7:30high-quality usable open space.
- 7:33>> Same applicable to that.
- 7:37>> Project supports incremental development
- 7:40patterns in its size and density that's
- 7:42the towards infill development or the
- 7:44reuse of existing buildings.
- 7:47>> Yeah. Yes. Yes, then.
- 7:50>> The project supports the provision of a
- 7:52variety of housing types to support a
- 7:54range of income levels, age groups, and
- 7:56family units.
- 7:57>> Yeah, I would like the opinion.
- 8:00>> The project specifies street design that
- 8:02is walkable, bikeable, and will
- 8:04reinforce safe, comfortable environments
- 8:07for all users.
- 8:08>> I did.
- 8:11Okay.
- 8:12>> So,
- 8:13>> I think it works, but
- 8:15>> We're good for the waiver.
- 8:16>> Yeah.
- 8:17>> Um so, it just both my eyes those type
- 8:19two.
- 8:20>> Okay, this is
- 8:22a type two in seeker, and then do we
- 8:25have to do a motion and
- 8:26>> Yeah, no objection to approve the
- 8:28waiver.
- 8:28>> Who would like to make the motion?
- 8:30Andrew, second? Kyra.
- 8:32All in favor?
- 8:34>> I.
- 8:34>> Opposed?
- 8:36Okay, passed.
- 8:38>> Thank you.
- 8:41You're all good.
- 8:42>> We can leave?
- 8:43>> Yeah.
- 8:55It's 95 Wilson Avenue, correct?
- 8:58All right, may I go first? Please come
- 8:59on up.
- 9:12Welcome.
- 9:13If we can just get your names for the
- 9:14record.
- 9:16>> Steve Sumida.
- 9:18>> Okay, welcome.
- 9:26So, item 11, 95 Wilson Avenue, major
- 9:30waiver request to install a larger curb
- 9:33cut than permitted. Uh, SBL 48.269-4-8.
- 9:39Secret determination. Uh, it's type two.
- 9:43>> Yes.
- 9:43>> Okay. Transit zone, T3N, ward six.
- 9:48Um, and um,
- 9:49So, pronunciation of your name?
- 9:51>> Kind of like the bird.
- 9:53>> Twee. And Steve Shoemaker, the applicant
- 9:56voters.
- 9:57Um,
- 9:58the applicant is for major waiver for
- 10:00section 405.16.e.3,
- 10:03which limits the maximum current cut to
- 10:0610 ft for a single-family home.
- 10:09Um,
- 10:10remove the existing driveway to add a
- 10:12pool and fenced-in yard. We're now
- 10:13looking to relocate the driveway to
- 10:15accommodate an off-street space for the
- 10:17vehicle. Um, guys, just give us a quick
- 10:20overview.
- 10:22>> Sure. Um,
- 10:23we started this process
- 10:25a little over a year ago.
- 10:27Um,
- 10:28we installed a pool, and we wanted to
- 10:30move the driveway 12 ft from the
- 10:32original
- 10:33area where it was.
- 10:34>> Okay.
- 10:36>> So, yeah, if you see it with the
- 10:37driveway, it was kind of was more over
- 10:39towards the pool.
- 10:41So, we wanted to move the driveway. It
- 10:43would be if you
- 10:45it's on the way towards Wilson about 12
- 10:47ft over over where it originally was.
- 10:51And and um, we're you know, we're asking
- 10:52for a reasonable accommodation cuz we
- 10:53have a adult son with autism.
- 10:56Um, we first initially applied for the
- 10:59permit.
- 11:01Um, they required us to get a survey,
- 11:02which we didn't do.
- 11:05But, it's very confusing because
- 11:08in the emails we've had with the build
- 11:10codes office,
- 11:13they said we didn't need a permit.
- 11:16And the DPW would have to give us five
- 11:18for a permit for them initially, which
- 11:21Mr. Coons came out.
- 11:23I would say it was probably in June of
- 11:25last year. He did a site survey.
- 11:28And he said there isn't any issues with
- 11:30the driveway now. And beyond it wasn't
- 11:32as large as the initial was, you know,
- 11:34with with where the driveway was to be
- 11:35moved and eventually probably because it
- 11:37was
- 11:38from the curb it was 15, possibly 15 ft
- 11:40in the curb, and this is the way it was
- 11:41set.
- 11:43Um
- 11:45so we're going to survey, going to get a
- 11:46survey done until the beginning of this
- 11:48year, and
- 11:50I am kind of dumbfounded why I hadn't
- 11:54even get a survey.
- 11:56Um it's contextual to the adjacent
- 11:58properties still have wide driveway.
- 12:02Some of them built them in recent years,
- 12:03so it's not grandfathered. Some of them
- 12:05been handed on to.
- 12:07We've consulted with some of the
- 12:08neighbors, never had to require a
- 12:09survey.
- 12:10But primarily, like I said, what we're
- 12:12doing the uh
- 12:14the alterations to our home is because
- 12:16of our our oldest son, who's 23, with
- 12:18severe autism.
- 12:20And uh we're currently parked on the
- 12:22street, and we haven't been able to do
- 12:24anything until we resolve this, and it's
- 12:26very unsafe.
- 12:28We you know, for him to go out on the
- 12:29street because sometimes he he's
- 12:31anxious.
- 12:32You know, getting in and out of the car,
- 12:34you know, sensory needs, sometimes he
- 12:36he you know, he has a little anxiety and
- 12:38everything, and we even actually had two
- 12:40letters thrown in our yard com- that's
- 12:42complaints over the last, let's say, 6
- 12:45months.
- 12:46You know, anonymous letters get kind of
- 12:48really
- 12:49you know, uh degrading us and stuff
- 12:50about us and our situation, about, you
- 12:52know, parking on the street with a child
- 12:54having a kid with a
- 12:55a child with a condition, you know,
- 12:57you're you're not a good parent. So, you
- 13:00know, uh we did consult with an
- 13:02attorney, and of course they felt like
- 13:05we would be better off applying for a
- 13:06reasonable accommodation and to see if
- 13:08we can get this resolved. We
- 13:11>> Basically, just so there's an under-
- 13:13Just so the board has a little bit of
- 13:15background, residential properties are
- 13:17allowed more than 10 ft wide per car.
- 13:20They're asking for a per car that's
- 13:22larger than typical would be for a
- 13:25normal residential use, but they did in
- 13:28their application also provide
- 13:30representative examples of other
- 13:32properties within close proximity that
- 13:35have the same type of double wide
- 13:37driveways. So,
- 13:38it's a pretty
- 13:40standard regular task.
- 13:52>> Would there be any issue with not
- 13:54approving this?
- 13:56>> Okay. So, do you need to just go through
- 13:57the checklist?
- 14:20>> The applicant has included a waiver
- 14:22request letter that clearly identifies
- 14:23and describes the waiver being proposed,
- 14:25accompanied by plans and other visual
- 14:27representations as applicable.
- 14:29>> Yes.
- 14:31>> Yes.
- 14:33Uh
- 14:33in their letter,
- 14:34the applicant describes in detail why
- 14:36the waiver is needed and how the waiver
- 14:38request is consistent with the intent,
- 14:40design, and compatibility of the
- 14:42transect zone in which the project is
- 14:44located.
- 14:45>> Yes.
- 14:45>> Yes.
- 14:47Uh will granting the waiver contribute
- 14:49to the realization of the overall intent
- 14:51of the transect zone and result in a
- 14:53improved project which will be an
- 14:55attractive and durable contribution to
- 14:57the transect zone.
- 14:59>> Yes.
- 15:02>> To support walkable neighborhoods and or
- 15:04mixed-use sectors, the project emulates
- 15:07the neighborhood context for how the
- 15:08building buildings relate to the
- 15:10sidewalk, how the facade is designed,
- 15:12and how the building interacts with the
- 15:14street.
- 15:15>> Yes.
- 15:16>> I'm going to go with that, but
- 15:18Vince, yes.
- 15:20Yes.
- 15:22Uh the project supports a green and
- 15:24resilient future
- 15:26uh by for example reducing vehicular
- 15:28miles traveled, providing green
- 15:30infrastructure, and or street trees, and
- 15:32or including high-quality usable open
- 15:35space.
- 15:37>> Not applicable to me.
- 15:38>> Yeah, in a day.
- 15:40Uh the project supports incremental
- 15:42development patterns in its size and
- 15:44density and supports an infill
- 15:46development or the reuse of existing
- 15:48buildings.
- 15:52>> In a day.
- 15:56>> Project supports the provision of a
- 15:57variety of housing types to support a
- 15:59range of income levels, age groups, and
- 16:02family units.
- 16:05Project specifies street design that is
- 16:07walkable, bikeable, and will reinforce
- 16:09safe and comfortable environments for
- 16:11all users.
- 16:13>> Yes, I'll complain.
- 16:15>> Yes.
- 16:16>> In a day.
- 16:18>> Uh
- 16:19Oops, sorry.
- 16:20>> You got one vote for this.
- 16:21>> So,
- 16:22you're not applicable to that?
- 16:24Or for the same
- 16:27looking at 50 cents in Seattle.
- 16:29>> I think it's in a
- 16:31>> You think it's not applicable?
- 16:32>> Yeah.
- 16:33>> Well, you're now
- 16:34The reason why you said it last is
- 16:36because it's
- 16:38The only person that's not
- 16:40>> [clears throat]
- 16:40>> able to
- 16:44be safe
- 16:45and use the environment comfortably is
- 16:47our son.
- 16:49So, this would include him.
- 16:52And therefore, it would be
- 16:55specific to the walkable
- 16:58area which is the
- 16:59curb cut on the sidewalk.
- 17:06>> So, you're going to have to take a vote
- 17:09of
- 17:09one on
- 17:11the total overall
- 17:13waiver.
- 17:17>> Okay. So, um
- 17:20I guess we're going to do a board vote
- 17:22and then approve the waiver?
- 17:24>> And then we got motion.
- 17:26>> Make a motion.
- 17:27Um to approve this waiver.
- 17:30>> Yep.
- 17:30>> Yes, second.
- 17:31>> Second.
- 17:32>> Okay.
- 17:33All right, I.
- 17:34>> I.
- 17:36>> Okay, opposed?
- 17:38>> That's okay.
- 17:39>> I vote yes.
- 17:40>> Okay.
- 17:40>> Okay.
- 17:40>> So, it's approved.
- 17:42>> Right.
- 17:55You good?
- 17:56>> Okay.
- 17:57>> All right, may I have a motion to
- 17:58adjourn?
- 18:00>> And then can we do the meeting on Zoom?
- 18:02>> Baby Paul.
- 18:08>> Uh item number two, 370 Albany Avenue,
- 18:13public hearing for administrative
- 18:14special permit renewal to operate a car
- 18:16wash.
- 18:18Is anyone here for 370?
- 18:21>> Which is 370?
- 18:22>> They need to be here to speak.
- 18:23>> Oh, to speak on 370 Albany Ave.
- 18:29>> I'm ready to close the public hearing to
- 18:31you.
- 18:32>> You make a motion to close?
- 18:34>> Yep.
- 18:34>> All right, motion to close the public
- 18:36hearing at 370.
- 18:38And you second.
- 18:39I motion then second.
- 18:53>> Second and you can get out.
- 18:54>> All righty, let's
- 19:05All right, 713 Gerald Street,
- 19:08subdivision of lands of Travis Myers,
- 19:10SBL 56.357-14-2.
- 19:16seeking a determination type two trans x
- 19:18zone T4N ward seven.
- 19:23Travis Myers applicant's owner.
- 19:26Is anyone here for 713 Gerald Street?
- 19:35>> And that piece of land so
- 19:38basically what this one is and if you
- 19:41recall
- 19:43about a year or so ago we reviewed a
- 19:46application to combine two parcels into
- 19:48one. He had a proposal to develop a four
- 19:52unit row house type of structure.
- 19:56Financially that has economically become
- 19:59unfeasible for him. So he is now
- 20:03reverting back wanting to separate the
- 20:05parcels again. He's going to sell one
- 20:07off and retain the other.
- 20:10Pretty straight forward here. We'll need
- 20:11some
- 20:15>> Any questions from the board?
- 20:18>> Yes,
- 20:19this is unlisted.
- 20:23>> Right. So it's good
- 20:26make a motion to
- 20:28>> I make a motion to place it on
- 20:30action.
- 20:30>> So this is an unlisted action.
- 20:33>> I make a motion
- 20:34>> What else?
- 20:34>> I make a motion to approve the
- 20:36>> It's already.
- 20:48This looks to be in order.
- 20:50I'll make a motion to accept the short
- 20:53environmental assessment form.
- 20:55Vince Andrews seconds.
- 20:58All approved.
- 21:00Opposed.
- 21:04>> I make a motion to sign the best.
- 21:06>> No, they are often made
- 21:26>> You saw any Are there any questions on
- 21:28this?
- 21:29I'm not Well, I would need What's that?
- 21:32So, we will need five paper copies, one
- 21:36minor.
- 21:38You don't need time to read the other
- 21:39instructions.
- 21:41The board um
- 21:45They can be signed and we will need
- 21:49uh
- 21:50the owner's signature
- 21:53before the chairman and sign off on it.
- 21:57Found last.
- 22:00And for policy six.
- 22:02>> Okay.
- 22:02>> Those are the additions.
- 22:07>> Yeah.
- 22:10>> That was my question.
- 22:12>> Right.
- 22:12>> Um motion to approve this?
- 22:15Andrew, second.
- 22:18Karin.
- 22:20All in favor?
- 22:21Opposed?
- 22:23>> All right.
- 22:23>> It's passed.
- 22:25>> Thanks.
- 22:28Chairman.
- 22:28>> All right. And we have Fagus, 79 German
- 22:31Street.
- 22:34Um so, good evening. We're going to hang
- 22:37on one sec. So, this is a subdivision of
- 22:39lands of
- 22:41uh
- 22:42three FFRE LLC and a major waiver for
- 22:46rear yard setback.
- 22:48SBL 56.42-14-21.
- 22:52Uh secret determination type two.
- 22:56It's correct zone. Transaxle.
- 22:58>> Oh, I'm listed. Sorry.
- 22:59>> I'm listed.
- 23:00>> Transaxle, T4N, uh Ward 8, Michael Betar
- 23:04applicants,
- 23:05uh 3 F F R E is the owner.
- 23:09>> Welcome.
- 23:10>> Thank you.
- 23:10>> And just quick name for the record?
- 23:12>> Mike Betar, surveyor.
- 23:14Uh I'm representing the Frescos and 3 F
- 23:16F R E LLC.
- 23:18Uh we have two homes situated on one lot
- 23:22on the corner of German and Ridge. Um
- 23:26pictures of the homes here. I know you
- 23:27guys have them in the application, but
- 23:29obviously we have fronting on German
- 23:33and then we have the brick home fronting
- 23:34on Ridge. I tried to get some decent
- 23:36pictures here to show the spacing and so
- 23:38on, but they are in the application. Um
- 23:42so we're trying to separate the two
- 23:44houses into separate deeded lots. Uh we
- 23:47come into a few things that um not only
- 23:49the planning department, but the
- 23:51building department um is interested in
- 23:53including the spacing between the
- 23:55structures
- 23:56uh being a building department related
- 23:58item, the offset to the rear of the
- 24:00building being a waiver related
- 24:04mathematical item. Uh but we are with in
- 24:07terms of our lot coverage, we are um you
- 24:09know, we're good to go. We don't we
- 24:11don't we're not even close to the lot
- 24:14coverage um
- 24:15percentages. Um we've designed the new
- 24:19line to meet all of the 5-ft spread as
- 24:22required by the building department. Uh
- 24:25we've created an easement to bring
- 24:28utilities into the brick rear structure.
- 24:32Uh
- 24:32we are seeking the variance aka waiver
- 24:36for the rear um
- 24:40yard setback and otherwise
- 24:44um we are you know, looking to get some
- 24:46type of
- 24:47uh two separate deeded homes uh each
- 24:51having different frontage. Brick home
- 24:53fronting on Ridge Street with the front
- 24:54facing Ridge Street, German obviously
- 24:56facing German Street. Uh so they already
- 24:59have a a view of being separated. We're
- 25:02just trying to officially separate them.
- 25:05Um and that's basically the
- 25:09just of the story.
- 25:13>> Um just want to talk about the easement
- 25:15that is going to be required as well.
- 25:17Mike
- 25:18>> For the the utility easement, yes. So in
- 25:21order for us to get the 5-ft spread,
- 25:24uh we have to have an easement for the
- 25:26gas to
- 25:28um connect to the brick structure. We're
- 25:31obviously close in this area here. Um
- 25:34and there is a picture of that area um
- 25:36well defined in the application uh
- 25:39looking down between the structures. Um
- 25:44small easement um
- 25:47you know uh
- 25:48L6 is on here is uh you know they're
- 25:51small distances. L4 being 21 ft. So it's
- 25:55roughly 20 by 5-ft on one end. So it's
- 25:59maybe 100 sq ft.
- 26:02125 sq ft max.
- 26:12Questions from the board?
- 26:15>> Is there a new utility pole or is this
- 26:17>> No, that's an under line that's an
- 26:19underground gas line that's probably
- 26:21from the you know the '80s '70s '80s
- 26:24when the gas went in.
- 26:27>> No, I was talking about the utility
- 26:28pole.
- 26:29>> Oh, the utility pole?
- 26:30>> Yeah.
- 26:31>> Um no, that's been there. That's how
- 26:32they've always got electric and that
- 26:34actually really doesn't come into play.
- 26:36Luckily for us the the overhead
- 26:38utilities are already well split. The
- 26:40only item that we have is the
- 26:43underground gas that requires an
- 26:45easement through lot two to attach to
- 26:47lot one.
- 27:02>> Oops.
- 27:04What is the distance?
- 27:06>> Relatively straight forward.
- 27:09>> Okay.
- 27:10And then you need to do the waiver
- 27:12setback or the computer setback
- 27:16to say you understand it's a tight fit
- 27:18with the fire
- 27:19your setback is still okay and maybe
- 27:22they got blocked in line in the building
- 27:24entrance on German Street
- 27:28and it's a setback of only 5 ft versus
- 27:3110.
- 27:32>> Also, one thing to speak on on the
- 27:35waiver is in terms of contextual for
- 27:39that neighborhood 10 ft would be less
- 27:42contextual than what we're asking for
- 27:45based upon the fact that the Delaware
- 27:46Hudson Canal lots are obviously very
- 27:48congested. You know, the houses or some
- 27:50of them are
- 27:52in this neighborhood there are many
- 27:53structures which are party wall lines.
- 27:55So there's no setbacks whatsoever. So in
- 27:58terms of the overall look and context,
- 28:02this fits
- 28:03with the overall look of the
- 28:05neighborhood. There's nothing out lying
- 28:07here that's saying, "Oh my God, there's
- 28:08only a short amount." Everything is a
- 28:10short amount in that neighborhood
- 28:11specifically those few streets in that
- 28:13block. You have some tight buildings in
- 28:16there.
- 28:17That's probably how they got built
- 28:19together on one lot in the first place.
- 28:23>> So if that one of the houses faces here
- 28:27and one of them is
- 28:28facing here. Look, the setback line is
- 28:31the correct or the setback is similar in
- 28:35here and it's
- 28:37and then in the middle of it the fire
- 28:38department would have Yeah, they would
- 28:39have to make
- 28:40comply with the safety I'm not a
- 28:42problem. That's all.
- 28:43>> [clears throat]
- 28:44>> So just to give you a better idea of
- 28:46also like here, I know you're talking
- 28:48about the furniture. So, here's the
- 28:49picture of the house fronting on
- 28:51Germany. So, we have this white frame
- 28:53structure. Here is the house fronting on
- 28:55Ridge, the brick structure. And then
- 28:57this is the spacing between. So, we have
- 29:00a 5-ft spread coming down through here
- 29:02to get these two. So, there's still
- 29:04walkable area on both sides of the
- 29:05boundary line. And that easement that I
- 29:07show is right here going in the gas line
- 29:10cuz you can see the gas meter on the
- 29:11house right there.
- 29:13And then this is actually our
- 29:14neighboring house right here. So, again,
- 29:17the lots are tight in this area.
- 29:20Uh but that is neither here nor there.
- 29:22>> Would that be anything to do with it
- 29:23being a double ending?
- 29:24>> No, no. It's just It's a separately
- 29:27separated property on the end of the
- 29:28block.
- 29:30>> Okay.
- 29:31>> But it's just a potential thing.
- 29:33I mean, they're all in there even using
- 29:35the black system.
- 29:37But they're not separate.
- 29:39>> Mhm.
- 29:39>> They're not separate lots either.
- 29:42>> All right.
- 29:43The applicant has included a waiver
- 29:45request that clearly identifies and
- 29:47describes the waiver being proposed,
- 29:49accompanied by plans and other visual
- 29:51representations as applicable.
- 29:54>> Yes.
- 29:56>> In their letter, the applicant describes
- 29:58in detail why the waiver is needed and
- 30:00how the waiver request is consistent
- 30:02with the intent, design, and
- 30:03compatibility of the transect zone in
- 30:05which the project is located.
- 30:07>> Yes.
- 30:08>> Yes.
- 30:10>> Will granting the waiver contribute to
- 30:12the realization of the overall intent of
- 30:14the transect zone and result in an
- 30:16improved project which will be an
- 30:18attractive and durable contribution to
- 30:20the transect zone?
- 30:23>> So.
- 30:24>> Okay.
- 30:28>> To support walkable neighborhoods and or
- 30:30mixed-use centers, the project emulates
- 30:32the neighborhood context for how far the
- 30:34building
- 30:35buildings relate to the sidewalk, how
- 30:37the facade is designed, and how the
- 30:39building interacts with the street.
- 30:43>> And I agree.
- 30:45This is our assistant.
- 30:47Project supports a green and resilient
- 30:49future by, for example, reducing
- 30:52vehicular miles traveled, providing
- 30:54green infrastructure and or street
- 30:55trees, and or including high-quality
- 30:58usable open space.
- 31:03Project supports implementation of
- 31:04development patterns that enhance
- 31:06density and supports infill development
- 31:08or the reuse of existing buildings.
- 31:13Project supports the provision of a
- 31:15variety of housing types to support a
- 31:17range of income levels, age groups, and
- 31:19family units.
- 31:24Project specifies street design that is
- 31:26walkable, bikeable, and will reinforce
- 31:29safe and comfort comfortable
- 31:31environments for all users.
- 31:36Okay, so
- 31:38approved.
- 31:42>> I will then point out one thing. I don't
- 31:44have a policy six on this map. Uh just
- 31:47as it's been going back and forth
- 31:48between the building and planning
- 31:49department. We'll add that as we get it
- 31:51more board.
- 31:55>> We have those conditions with G. Uh What
- 31:57are we supposed to do on this thing?
- 32:04>> This looks to be complete.
- 32:09>> [clears throat]
- 32:13>> We have a motion to accept the short
- 32:16environmental assessment form.
- 32:18>> Make a motion to accept.
- 32:20>> All right, second Spence.
- 32:23All in favor?
- 32:25Opposed?
- 32:41>> And and
- 32:43so the motion would be for
- 32:46approval of the one or subdivision with
- 32:50road policy six including the major
- 32:53waiver putting their setback
- 32:55submission of five paper and one minor
- 32:58copies
- 32:59given descriptions for filing including
- 33:02the easements with the end of the
- 33:04restrictions and all signed by the owner
- 33:07before the chairman's signature.
- 33:10>> Motion?
- 33:13>> Thanks.
- 33:13>> Second.
- 33:14>> Andrew?
- 33:15>> Andrew.
- 33:18>> All approved.
- 33:20Opposed?
- 33:22>> Approved.
- 33:22>> Good.
- 33:23>> So thank you and Sue, if you want to you
- 33:26know in a when you have time in an email
- 33:27or whatever um
- 33:29lead me to where you want me to go next.
- 33:31I know we talked about the building
- 33:32department having to approve them of the
- 33:35subdivision after the subdivision
- 33:36approved. So
- 33:38if it's dropping these off or an email
- 33:40copy or whatever to get these things
- 33:42moving forward, please advise.
- 33:45Thank you everybody.
- 33:46>> Thank you.
- 33:47>> Have a good night.
- 33:47>> You too.
- 33:52>> Hello Randy.
- 33:54So
- 33:55>> Hello Randy.
- 33:55>> Yep.
- 33:56So item five 298 to 300 302 to 318 392
- 34:02306 Old Boulevard 262 Boulevard 43 to 75
- 34:07Halbert Street extension

- 34:16line revision to combine seven lots into
- 34:19three
- 34:20SBL 56.48-2-7.100
- 34:25and 7.200
- 34:288 9 10.100
- 34:3211 and 12 secret determination.
- 34:36Type two Ransack Zone T3 and
- 34:41019
- 34:43P&D Group LLC is the applicant owner. So
- 34:47welcome.
- 34:49Call Arias from Banarian Arias. Our firm
- 34:52representing the applicant Jeff
- 34:55of the P&D Group.
- 34:57Our firm did the survey and subdivision
- 35:00work.
- 35:01>> They're studying it up.
- 35:03>> Do I have
- 35:04I don't know if [clears throat] I can
- 35:05get one of these.
- 35:07>> They have them in their notes.
- 35:27They do have a copy of anything else
- 35:29that you want to do. Sorry, it's just
- 35:30taking you
- 35:32>> The owner applicant
- 35:34owns a total of eight lots here,
- 35:37adjacent lots. One of them,
- 35:39this one here that fronts 32, will
- 35:42remain the same. The other seven lots
- 35:45will be essentially consolidated into
- 35:48three lots for a total of four total
- 35:51lots
- 35:53essentially to accommodate
- 35:56potential future development
- 35:59of these four lots.
- 36:01I believe we're seeking two major
- 36:03waivers
- 36:05for exceeding the maximum lot width and
- 36:08lot depth.
- 36:10These
- 36:11dimensions were already
- 36:14exceeding the lot width and depth
- 36:17in their current state, but as a result
- 36:20of creating new lots under the new
- 36:22zoning,
- 36:23the waiver is required.
- 36:30>> So, they existed
- 36:32outside and they spelled out what is
- 36:34unique current gains on each lot.
- 36:37>> Correct. Well, there's multiple lots to
- 36:39what they're doing is kind of
- 36:42shifting property line and consolidating
- 36:45seven to three, right?
- 36:48Um the if you're familiar with the
- 36:51location where the electric is located,
- 36:56um the business will stay primarily
- 36:58they're consolidating those upper lots
- 37:01on the top portion.
- 37:03>> We'd be deleting lot lines here.
- 37:06>> And then
- 37:06>> And then
- 37:07>> And down below they're shifting that
- 37:09over to create two new lots that will be
- 37:14primarily, I guess, developed as
- 37:16residential new residential housing
- 37:18parcels.
- 37:24So, the access off of both Albert and
- 37:27Condi Street.
- 37:33>> So, the the the waiver ask is based on
- 37:38>> The
- 37:39the current lots do exceed that width
- 37:42and depth.
- 37:43Um so, it's not really um
- 37:45it's it's not like the subdivision
- 37:48made these lots much larger.
- 37:51>> So, the the plan base code has
- 37:54maximum
- 37:56depth and maximum widths.
- 37:58>> Right.
- 37:59>> So, just by shifting a line, we meet two
- 38:02of those dimensional
- 38:05requirements. So, they do need
- 38:07the waivers in order to exceed those
- 38:10dimensional requirements on the lower
- 38:12portion.
- 38:13>> But, it's just written in relation to
- 38:15the actual property. It's not because of
- 38:17the structure.
- 38:17>> Correct. Yeah, there's no structures
- 38:20where they are they're to be new
- 38:21buildings, new houses.
- 38:23>> So, if you had an an existing
- 38:27line
- 38:28that
- 38:30now falls under
- 38:32not being compliant under the form-based
- 38:34code now,
- 38:36what would be the issue in making it
- 38:38compliant with the current form-based
- 38:40code?
- 38:43I feel like I need
- 38:45>> multiple small
- 38:47>> I think cuz they're combining parcels.
- 38:50>> They're adding They're adding properties
- 38:53together. They're creating larger two
- 38:56larger parcels on the lower section and
- 38:59one parcel on the upper section. So, by
- 39:02combining all of the properties
- 39:04together, the lower the lower parcels
- 39:06exceed the dimensions.
- 39:09>> They're
- 39:09>> Cuz it's 100 ft wide.
- 39:11>> It's the It's the sort of nature of the
- 39:13the property.
- 39:15>> They're getting larger. Yeah.
- 39:18They're larger.
- 39:19>> Yeah.
- 39:21>> And then the depth is 180 ft. This goes
- 39:24past those.
- 39:25Because of taking multiple small
- 39:28combined into
- 39:29fewer larger lots.
- 39:31>> Okay.
- 39:37>> Any questions?
- 39:39>> Thanks. Thank you.
- 39:41>> But the checklist
- 39:43>> Yes, we should have one.
- 39:45We have one.
- 39:47>> Okay.
- 39:50>> They have one.
- 39:52>> What Yeah, we created one for both
- 39:54because they're both dimensional.
- 39:56>> That's right.
- 39:57All right.
- 39:59Uh the applicant has included a waiver
- 40:01request that clearly identifies and
- 40:03describes the waiver being proposed,
- 40:05accompanied by plans and other visual
- 40:07representations as applicable.
- 40:09>> Yes. Yeah.
- 40:11>> In their letter, the applicant describes
- 40:13in detail why the waiver is needed and
- 40:15how the waiver request is consistent
- 40:17with the intent, design, and
- 40:18compatibility of the transect zone in
- 40:20which the project is located. Yes.
- 40:26Granting the waiver
- 40:28Will granting the waiver contribute to
- 40:29the realization of the overall intent of
- 40:31the transect zone and result in improved
- 40:34project, which will be an attractive and
- 40:35durable contribution to the transect
- 40:38zone.
- 40:39Yes.
- 40:42To support walkable neighborhoods and or
- 40:44mixed-use centers, the project emulates
- 40:47the neighborhood context for how far the
- 40:48building buildings relate to the
- 40:51sidewalk, how the facade is designed,
- 40:53and how the building interacts with the
- 40:54street.
- 40:55Yes, it can.
- 40:58Project supports green and resilient
- 40:59future by, for example, reducing vehicle
- 41:02miles traveled, providing green
- 41:04infrastructure and or street trees, and
- 41:06or including high-quality usable open
- 41:08space.
- 41:11Yes,
- 41:12it can.
- 41:13Project supports incremental development
- 41:16in its size and density and supports
- 41:18infill development or the reuse of
- 41:20existing buildings.
- 41:23Yes, it can. Yes.
- 41:26Your choices
- 41:27So, this
- 41:31Use the existing building as one
- 41:32building on the They just rolled right
- 41:34out. Is that Yes. Uh yes.
- 41:38Supports infill development or reuse of
- 41:41existing Yes.
- 41:43Yes, it can.
- 41:45Project supports the provision of a
- 41:47variety of housing types to support a
- 41:49range of income levels, age groups, and
- 41:51family units. Yes,
- 41:54it can.
- 41:55Project specifies street design that is
- 41:57walkable, bikeable, and will reinforce
- 41:59safe and comfortable environments for
- 42:01all users.
- 42:03Yes, it can.
- 42:05Good.
- 42:07So, that's approved. So, now Motion to
- 42:10accept. Mhm. All right. Motion Andrew
- 42:15who would like to second
- 42:20all in favor
- 42:22opposed
- 42:25this passed.
- 42:42Almost there.
- 42:53I think it's five right now.
- 42:59>> Ordinance
- 43:016
- 43:02>> Motion
- 43:03>> And waivers approved
- 43:06will gradually buy paper copies one
- 43:09mylar
- 43:10written scriptures will need to be
- 43:12submitted with the result parcels and
- 43:15the event by the national meeting to be
- 43:17signed by the owner or the chairman and
- 43:20then provided with the Ulster County
- 43:21Planning Board with all the details.
- 43:23>> I have them one mylar.
- 43:24>> Five paper one mylar.
- 43:26>> All right, thank you.
- 43:29>> That's the second motion.
- 43:31>> Okay, so a motion from Kai second Andrew
- 43:37all in favor
- 43:39opposed.
- 43:41Passed.
- 44:08>> I have a question.
- 44:11>> 40 Thomas Street.
- 44:15>> 40 Thomas Street.
- 44:24>> What's that?
- 44:26Up next,
- 44:27item six, 40 Thomas Street, public
- 44:30hearing for administrative special
- 44:32permit renewal to operate an emergency
- 44:35shelter. SBL 56.25-4-44. Secret
- 44:37determination,
- 44:41this one too.
- 44:42>> Type two.
- 44:43>> Type two. Transect zone T5F, ward five,
- 44:47Family of Woodstock, applicant owner.
- 44:51So, any
- 44:52>> This is basically style of a caring
- 44:54neighborhood building.
- 44:56So,
- 44:57no one is
- 44:58>> Anyone have
- 44:59>> Speak.
- 45:02Close the hearing, we're done.
- 45:04>> Hearing is now closed.
- 45:07>> Okay.
- 45:09Good.
- 45:10>> Okay.
- 45:10>> All set.
- 45:11>> All right, item number seven, 25 Fields
- 45:14Court.
- 45:16Site plan and waivers to construct a
- 45:17mixed mixed-use building with commercial
- 45:20on the ground floor and residential
- 45:23above.
- 45:24SBL 56.25-3-25.
- 45:28Secret determination, this one too.
- 45:31Secret determination.
- 45:32>> This this will be a type two.
- 45:35>> Okay.
- 45:35>> But this is a type two.
- 45:36>> This will be a type two secret
- 45:37determination.
- 45:39Transect zone T5F, ward four, Keith
- 45:42Leibold, applicant, City of Easton,
- 45:45owner.
- 45:46So, we'll vote.
- 45:48>> It's public hearing, so is anybody from
- 45:51the public that wants to speak on this?
- 46:02>> Might be a something like that.
- 46:04>> Um
- 46:05>> [laughter]
- 46:06>> Sarah Vasky.
- 46:07>> Okay. We could introductions for the
- 46:10record, please.
- 46:11>> Sure. Good evening, ladies. Michael
- 46:12McGarvey, I'm the project engineer for
- 46:13this application for the board. I have
- 46:15here with me Mr. Keith Wagner from the
- 46:17school development team.
- 46:19>> Okay.
- 46:20>> I
- 46:21see Denise is online. Is she going to
- 46:25>> She has a few town
- 46:26>> She She's
- 46:27>> I'm here and I'm happy to share screen.
- 46:30>> But there's a lot of things
- 46:32>> too. I'm not sure what people whatever
- 46:33one prefers.
- 46:39>> Welcome, folks. Would you like to just
- 46:41walk us through?
- 46:42>> Sure. I brought hard copies. Let's see
- 46:44if I can bring the site plan up on the
- 46:46screen.
- 46:47Standish on Raven Street site plan.
- 47:03>> Can everyone see the screen?
- 47:05>> Yep.
- 47:06>> Yes.
- 47:06>> Great.
- 47:08>> Okay. So, as you noted earlier, the site
- 47:11location is 25 Field Court. It's at the
- 47:13end of Field Court on this side and near
- 47:17the intersection of O'Neal Street and
- 47:18Midtown Linear Park at that location.
- 47:21The existing site actually consists of
- 47:23an abandoned commercial building.
- 47:26The entire site's paved or impervious
- 47:30previous eligibility.
- 47:31We're in the T5 flex zone for this
- 47:35particular project and we're proposing
- 47:3771 units and five stories. It's got an
- 47:40attic and a partial basement. We are
- 47:42seeking waivers
- 47:44as a part of this project 3405
- 47:4716 E3 405 16 at 405 16 J, respectively.
- 47:54We're also proposing
- 47:5635 parking spaces. Standish, you can on
- 47:59the safe line pretty much.
- 48:01Um we're proposing 35 parking spaces
- 48:04and we've designed storm water detention
- 48:06areas in this portion of the lot and
- 48:08under the parking space over here in
- 48:11that portion of the lot. Um so, outside
- 48:14of those waivers that we're requesting,
- 48:15it appears that the project's fully zone
- 48:17compliant I believe.
- 48:19Um
- 48:20We prepared landscaping plan, lighting
- 48:22plan
- 48:23Well, it's already he doesn't go along
- 48:25with it.
- 48:27That's basically the project in a
- 48:29nutshell.
- 48:30Okay.
- 48:31I think our plan was to get feedback
- 48:33from this meeting and then incorporate
- 48:35the comments from the last meeting and
- 48:36this meeting and have those measured
- 48:38fairly quickly. We've
- 48:40addressed most of what percent this
- 48:41already I think all of that or
- 48:44>> So, you got
- 48:44>> Listen to me.
- 48:45>> You've gotten your staff comments back
- 48:47and obviously we just received the this
- 48:50is kind of town board comments.
- 48:53You've seen those.
- 48:55Um
- 48:56they've been posted online as well. So,
- 49:00um have you had a chance to take a look
- 49:02at them and give consideration or any
- 49:05thoughts on I know one of them was
- 49:08pedestrian access egress and Guild Ford
- 49:12and Sue and Neil Street. Another one was
- 49:15to um and I don't know if you got this
- 49:18coming up to you know what you got this
- 49:19as well they came in Friday. But another
- 49:22one was to provide for some additional
- 49:25uh visual um
- 49:28concept
- 49:30drawings to show in the evening and
- 49:33daytime and shadowing um impacts that
- 49:36could potentially lead to the um green
- 49:39line along the
- 49:41halfway there.
- 49:43Have you looked at that?
- 49:44>> What I'm what we kind of said in that
- 49:46was we were confused by that one because
- 49:48we gave
- 49:49you the visuals of all four sides of the
- 49:51building and you can get a visual of
- 49:52some flash
- 49:54through the sunset. It will
- 49:56Yeah, and it will cast a shadow at
- 49:58certain times of the day, and you see
- 50:01it's right up against the
- 50:02>> I think one of the things that the board
- 50:05is going to be interested in seeing are
- 50:09a little bit more of the architectural
- 50:11detail in into the visual simulations as
- 50:16well as the nighttime renderings. Um
- 50:19some of the the renderings that were
- 50:21provided you know, leave a lot of
- 50:23question about window treatments and and
- 50:27materials
- 50:28um
- 50:29and that. So, I think a little bit more
- 50:31detail on those would be um helpful in a
- 50:35final evaluation. Interesting. What it's
- 50:38going to look like from different
- 50:39vantage points, not only from the real
- 50:42line but from the adjoining streetscape,
- 50:45um would be good.
- 50:47>> The work that was provided you know, it
- 50:49doesn't really render the the building
- 50:51details well when you
- 50:53reduce the scale so much. But I tried to
- 50:55blow it up and maybe if I showed you a
- 50:57section
- 50:58of each you kind of get a feel for the
- 51:00architectural
- 51:01>> Yeah, see like the cources, the sills,
- 51:04the lintels, the building material of
- 51:07the facade. That just goes little
- 51:09details.
- 51:10>> No, I understand that we're we're just
- 51:12talking about that today but you know,
- 51:13you can't you just can't see it at that
- 51:15scale. But the first floor is going to
- 51:17be brick and then the upper floors will
- 51:19be various types of concrete siding.
- 51:23>> Then even the coloring if there's
- 51:24variations throughout that and it's
- 51:26two-tone, three-tone, or whatnot.
- 51:28>> Yeah.
- 51:29>> I think a night a nightscape or night
- 51:31scene.
- 51:31>> You want a nightscape as well?
- 51:33We did one There's one rendering of we
- 51:36did it sunset
- 51:39of the main next to the sales office.
- 51:41Hey Stan, do we have that one rendering
- 51:43that shows the building at sunset at the
- 51:45entrance?
- 51:46>> Yeah, we actually have [snorts] we did
- 51:49uh daytime and nighttime views for each
- 51:52view.
- 51:54>> Yeah, I think the problem is that that
- 51:56scale we can't see they can't see the
- 51:58details of them.
- 51:59>> Yeah, so in the lights in that in that
- 52:01rendering there like the the windows
- 52:03just like look
- 52:05black.
- 52:06>> Yeah.
- 52:06>> No, I understand.
- 52:08>> Yeah.
- 52:10>> Yep.
- 52:15Yeah, and the color changes are subtle.
- 52:17It doesn't it doesn't render well on
- 52:19this.
- 52:20Um
- 52:20Can you go up one standish?
- 52:23We didn't do virtual renderings of
- 52:24different color patterns, but there is a
- 52:27few different
- 52:29>> So we also think putting putting the
- 52:32project into the context of
- 52:35the neighborhood and the adjoining
- 52:37buildings rather than
- 52:39having it as a standalone we type of
- 52:42>> Yeah.
- 52:43Okay.
- 52:44>> Visual [snorts]
- 52:45with the helpful.
- 52:52>> Well, did you have Yeah, I wanted to
- 52:54hear that tonight. That's going to be a
- 52:56very specific I mean the same is
- 52:58going to be applied to that.
- 53:00The last thing
- 53:07>> I think the light from the building is
- 53:08actually going to help that part of
- 53:11Broadway because on Broadway is so
- 53:13bright but then just right back back
- 53:15actually I mean it's very dark. So
- 53:21being it from that perspective too is
- 53:23only going to show and demonstrate what
- 53:25kind of difference areas with all that
- 53:27additional light.
- 53:36>> Can you go back to the same one
- 53:37standish?
- 53:38>> Actually that's interesting.
- 53:40>> I think
- 53:41>> I mean I don't know what she said she
- 53:42was like
- 53:49>> Yeah,
- 53:50during construction, what's the plan for
- 53:53staging materials?
- 53:55How do you anticipate that will
- 53:59>> Sure, we're going to utilize the
- 54:01parking area to stage materials, and
- 54:03then once the building's up, we'll then
- 54:06focus on building the parking area out.
- 54:08The construction work will also be
- 54:10mostly parking in the municipal lot.
- 54:13>> You also have this open area back here,
- 54:15which before the structure goes up can
- 54:17store materials as well.
- 54:22>> Security, what do you have planned for
- 54:24that?
- 54:25>> Um we have to fence the site in, and we
- 54:27have to We'll have some cameras up,
- 54:29which are There's five of them.
- 54:33We got mobile cameras set up twice, so
- 54:35we're going to have more cameras.
- 54:37>> Okay.
- 54:37>> But we will have a We're going to do a
- 54:39So the plan unless requested still don't
- 54:42have the plan that shows staging.
- 54:44>> I mean, it's kind of easy on this site
- 54:46because it's already cleared.
- 54:48So you know, we we kind of have a
- 54:51nice surface to lay
- 54:52>> Yeah, but you know, I'm sorry cuz you
- 54:53don't
- 54:54>> just use the parking area to lay down
- 54:57yard for the building, and then as the
- 54:58building goes up,
- 55:00um
- 55:01you'll switch over and do the site work
- 55:02when they finish the inside of the
- 55:04building.
- 55:05>> So with most of your activity going on
- 55:07to build board,
- 55:09with construction, unless presuming most
- 55:13of your materials and and the
- 55:15construction activity will get in and
- 55:16out of build board, how are you thinking
- 55:20of any traffic control
- 55:23at Broadway because that's
- 55:25that's a tough
- 55:27exit out there.
- 55:29>> So for traffic signal.
- 55:30>> Normal traffic. I mean, like you're
- 55:32going to have larger vehicles and
- 55:34construction vehicles going in and out.
- 55:37Do you have any thoughts about that?
- 55:40>> We'll work that out. We plan no more
- 55:42than two deliveries a day. So, I don't I
- 55:45don't think it's going to be a huge
- 55:46impact. You can
- 55:48Once the foundation's in place,
- 55:51the the one-way lane going through
- 55:54O'Neil will be open. So, we'll have
- 55:56during construction that can be that can
- 55:58go in either direction. So, we'll have
- 56:00the ability to come in and out of
- 56:02O'Neil.
- 56:05If you know, if there is
- 56:07if there is an occasional long-body
- 56:09truck that has to get in there, it's
- 56:10probably going to want to come on that
- 56:12O'Neil side. We'll have to shuttle
- 56:14things like
- 56:15>> Okay.
- 56:16>> which trucks would would come in on that
- 56:17side of the building. We'll have
- 56:20>> And then we had talked to you about the
- 56:22parking supply and demand reduction
- 56:25strategy. How are things on that?
- 56:27>> We
- 56:28We did with one way in and out.
- 56:30>> Okay.
- 56:31>> One way in is not existing study still
- 56:33in town.
- 56:33>> Okay.
- 56:35>> That side of the solutions.
- 56:39>> The existing community events that
- 56:41happen on Bill Court, including the
- 56:43pickleball,
- 56:44is that going to need something that's
- 56:45going to have to come to a halt for 2
- 56:47years while this is being developed? So,
- 56:49are we putting those pending those
- 56:51programs
- 56:52>> I don't know. I don't
- 56:54>> I know that the heart of
- 56:55>> It's going to be going on the first time
- 56:56because
- 56:57>> part of the in-town happens on Bill
- 56:59Court.
- 57:00And then also the pickleball's becoming
- 57:02more popular.
- 57:03>> Yeah.
- 57:05Yeah, we did want to talk about I think
- 57:07that third entrance tonight on the rear
- 57:09of the field court. And
- 57:12we were wanting to have that community
- 57:14garden entrance, but a safety entrance
- 57:17for snow removal in the winter if you
- 57:19have to plow snow off the site because
- 57:21there isn't a lot of snow load here.
- 57:23And
- 57:25in in case we get a
- 57:27an accident or something that prevents
- 57:30But then with access onto O'Neil, you
- 57:32had a that would certainly go straight
- 57:33through and out of the site. You want
- 57:36You wanted to give that but stone it.
- 57:39We thought I I thought we had discussed
- 57:41that earlier on as soon as that was
- 57:42something important was
- 57:44open to considering whether or not to
- 57:45have it removed, but
- 57:48um it's a it's important from a
- 57:50pedestrian access standpoint.
- 57:51>> But I think
- 57:52>> Yeah.
- 57:52>> along with otherwise we literally have
- 57:54one-way traffic through the site. So
- 57:56when they only have access there,
- 57:58it's the same as I mean it would be the
- 57:59best if you could put some type of a uh
- 58:02you know, a gate with a bar that raises
- 58:04um so that if we need to have um
- 58:06residents from O'Neal exit the site, and
- 58:08then we would be allowed
- 58:09out of O'Neal and get out the field
- 58:11court as well. And then also, as Keith
- 58:12noted,
- 58:13it assists us in snow removal and so
- 58:20As far as the parking lot statement, um
- 58:23would the board like to see any like a
- 58:27stone wall
- 58:29along the court face or court face along
- 58:30the green sections? So
- 58:33we could do a stone wall that maybe we
- 58:35could build up like a 30-in wall with
- 58:37stone face and make half of it be going
- 58:39to be stable as sitting bench as well as
- 58:42a
- 58:42>> I was saying in in in terms of combining
- 58:45that with the activities that generally
- 58:47take place there where the general
- 58:49public, it might be nice to maybe
- 58:51incorporate a
- 58:52you know, a combination of seating
- 58:54element with your landscaping
- 58:58uh requirement to
- 59:00you know,
- 59:00>> What sort of what would you see along
- 59:03here? Cuz we we were thinking about
- 59:04doing
- 59:06like where these green spaces are
- 59:08uh here, here, and here
- 59:12doing a like a poured concrete wall with
- 59:14stone veneer half and it would be like a
- 59:17sitting bench.
- 59:18>> So it would be it would be great if you
- 59:19>> kind of acts as a a visual break and
- 59:22that it meets the
- 59:24desire of the code,
- 59:26but it's also very functional. People
- 59:27would there that can actually just sit
- 59:29on it, especially for pickleball.
- 59:32>> Yeah.
- 59:34>> You could also have like a a trash
- 59:35receptacle cuz if people are there
- 59:37playing, they'll ultimately have
- 59:39something to throw away. It's not a
- 59:41handy way for you to just have a meeting
- 59:43Skype when you're going to have a
- 59:44meeting.
- 59:45>> And were um some comments
- 59:48>> Do they need to put that waiver?
- 59:51>> Yeah.
- 59:51>> Okay.
- 59:51>> Yeah.
- 59:52>> Yeah. Yeah.
- 59:53>> So, there were some comments received
- 59:55from the CAC
- 59:56>> as well.
- 59:57>> that.
- 59:57>> You saw those as well. So, we're going
- 59:59to need to have them address those
- 1:00:01>> Yeah.
- 1:00:02>> um in your final response for for the
- 1:00:04November meeting.
- 1:00:05>> Okay.
- 1:00:06>> Um I
- 1:00:07>> What one of the other waivers found was
- 1:00:08the
- 1:00:09the setback from the parking from the
- 1:00:10property line?
- 1:00:112 ft versus 5 ft.
- 1:00:13Um that is a waiver we'd be seeking
- 1:00:15because I think it allows us an extra 1
- 1:00:182 3 4 parking spaces.
- 1:00:20>> Mhm.
- 1:00:21>> And there's already a shortage of
- 1:00:22parking in the city on the site. So, um
- 1:00:25it's a it's a small waiver request 2 ft
- 1:00:27to 5 ft plus I think the addition of
- 1:00:30this um landscape wall will provide a
- 1:00:33nice separation between the parking lot
- 1:00:36um and field court, which will add to
- 1:00:38the I think board's consideration of
- 1:00:40that waiver.
- 1:00:42>> Mhm.
- 1:00:45>> We spoke with the landscape architect
- 1:00:47studio.
- 1:00:48We worked with the urban forestry.
- 1:00:51They're they're good on that on that.
- 1:00:53>> Right.
- 1:00:54>> Yes.
- 1:00:54>> We got an understanding of the salt for
- 1:00:56W.
- 1:00:56>> Yes, at least we're dealing with crane.
- 1:00:59>> Yeah.
- 1:00:59>> Um final plan.
- 1:01:00>> Yeah.
- 1:01:01And the third the third waiver I think
- 1:01:03was the elevation difference between the
- 1:01:05first floor I mean
- 1:01:06>> and the grade, yeah.
- 1:01:07>> and the grade.
- 1:01:08>> I accept that.
- 1:01:09>> Okay. So, yeah, yeah, we discussed that,
- 1:01:11but just from an ADA entrance
- 1:01:12compliance, we had to submit a new plan.
- 1:01:21>> So, I guess you do want us to continue
- 1:01:22to proceed with the extra curb cut and
- 1:01:25fill with
- 1:01:29the extra curb cut will remain but will
- 1:01:30have a gate for emergency access
- 1:01:32assessment right.
- 1:01:35How does the board feel about that?
- 1:01:37Well,
- 1:01:38their sales enable you to refer to the
- 1:01:39second curb cut. Yes. Yeah.
- 1:01:42Yes.
- 1:01:45Yeah.
- 1:01:46I think they made it a lot easier just
- 1:01:49and still change access. Yeah.
- 1:01:51I think it's the best of all worlds.
- 1:01:54I agree.
- 1:01:56Okay.
- 1:02:02Does the board have any other questions?
- 1:02:14I sent him an email today reminding him
- 1:02:17that we are looking for names for the
- 1:02:19balance. So hopefully
- 1:02:21I will keep pushing him.
- 1:02:24But yeah. I said about keeping it beyond
- 1:02:27the meeting with the department head
- 1:02:29essentially will get you
- 1:02:30drawings and DPW's approval and
- 1:02:33everything. So you've gotten their
- 1:02:35feedback
- 1:02:36preliminarily
- 1:02:42Board of any other comments?
- 1:02:44What?
- 1:02:47Okay. So you think being
- 1:02:49in about your marching orders? We
- 1:02:51leaving the public hearing open
- 1:02:55sorry. Are we leaving the public hearing
- 1:02:56open?
- 1:03:00But do you mean like to leave the public
- 1:03:01hearing open or do you want to close it?
- 1:03:04I would leave it open
- 1:03:06okay. I would leave it open for now.
- 1:03:08Okay.
- 1:03:12>> [clears throat]
- 1:03:13>> So are you able to end?
- 1:03:17What do you want to say at this point?
- 1:03:27motion
- 1:03:29>> Wait, motion to table this and keep the
- 1:03:31public hearing open until next month.
- 1:03:33Andrew, is motion second? Kyra?
- 1:03:37All in favor?
- 1:03:39Opposed?
- 1:03:41Okay.
- 1:03:43>> Mark is absent.
- 1:03:48>> It is at the time of the excelsior.
- 1:03:51>> Okay.
- 1:03:52All right. Thank you.
- 1:03:54Thank you.
- 1:04:04Maybe I can do that.
- 1:04:06Thank you so much.
- 1:04:07>> And
- 1:04:08let the record show that Sage Nukirk has
- 1:04:11arrived and will be participating.
- 1:04:16>> Go back again.
- 1:04:19Did they win? They won. One to zero.
- 1:04:22I'm not signing this one, right?
- 1:04:24>> Correct.
- 1:04:43>> Number eight.
- 1:04:45>> Number eight.
- 1:04:57Okay, item number eight. 350 Broadway,
- 1:04:59site plan to construct an addition to an
- 1:05:01existing building and establish 10
- 1:05:03residential units.
- 1:05:05SBL 56.26.11-49.100.
- 1:05:10Secret determination soon.
- 1:05:12So, this
- 1:05:13>> This one is, I think, entry.
- 1:05:17>> Try it too.
- 1:05:18Uh transex zone T5, the applicant has
- 1:05:21ward nine. Diane Chen is the applicant.
- 1:05:24350 Broadway Kingston LLC owner.
- 1:05:28Welcome.
- 1:05:29Are you going to just names for the
- 1:05:31record, please?
- 1:05:31>> Good evening. Diane Chen. This is
- 1:05:35This is Mike Shilo, my GC, Odyssey
- 1:05:38Builder. So, I'm going to turn it over
- 1:05:40to him. He knows what to do. Thank you.
- 1:05:42>> [laughter]
- 1:05:43>> Well, if you just want to give us a
- 1:05:44quick walk through. Sure.
- 1:05:46>> will have the screen, so.
- 1:05:48>> You guys are probably familiar with the
- 1:05:50property because it's been on the
- 1:05:51planning board previously with a grant
- 1:05:53on seven units.
- 1:05:55When Diane bought the property, it was
- 1:05:57showing seven units, but it would never
- 1:05:59qualify for
- 1:06:01a building permit because the two
- 1:06:03adjacent lots, even though they're
- 1:06:05lower, didn't allow proper fire egress
- 1:06:08because there was no way they had
- 1:06:09multiple bedrooms.
- 1:06:11During this process, we discovered that
- 1:06:13the second and third floor roofs are in
- 1:06:15total need of replacement, and we talked
- 1:06:18to our local architect, Robert Sweeney,
- 1:06:20and looked at the feasibility of of just
- 1:06:22removing down to the second floor and
- 1:06:24going back up over the existing
- 1:06:26footprint and enclosing the entire
- 1:06:28footprint.
- 1:06:29To make the building code compliant, we
- 1:06:31could only fit studios like we need
- 1:06:33eight one-bedrooms in there that would
- 1:06:34be closed off, and we wouldn't be fire
- 1:06:36code. So, we figured out that we can
- 1:06:38keep the same bedroom count, but we get
- 1:06:4010 units versus the seven that were
- 1:06:42originally planned.
- 1:06:44Mhm.
- 1:06:46Project has three affordable units as
- 1:06:49part of the scope. Um
- 1:06:52we will be looking for a handicap spot
- 1:06:54on the street because when our 10
- 1:06:56originally property was being marketed
- 1:06:59with gated parking in the rear, it
- 1:07:01turned out that the spots weren't gated
- 1:07:03after all of the property, so
- 1:07:05the originally planned handicap parking
- 1:07:07in the back is not feasible anymore. So,
- 1:07:09we either would like to do right in
- 1:07:11front of the property or
- 1:07:13paint and stripe one of the closest
- 1:07:14street in with the city lot if the city
- 1:07:16would be able to do it for the one or
- 1:07:17the other if the city would do it to us.
- 1:07:19In the rear of the property, we are
- 1:07:21going to have access for a full garbage
- 1:07:23container as well as a closed bicycle
- 1:07:26enclosures so that we can fit probably
- 1:07:29one bike for most of the tenants even
- 1:07:31though we're only required to have two,
- 1:07:32we're making it available for
- 1:07:33everybody's use.
- 1:07:35And we're not changing footprint of the
- 1:07:37property at all.
- 1:07:39That's rear of the property. So,
- 1:07:41Broadway facing side will still look the
- 1:07:43same and actually look better cuz it'll
- 1:07:44have windows finally. And probably the
- 1:07:46same thing too.
- 1:07:47I'll answer any questions the board has.
- 1:07:49>> So, you mentioned about the back of the
- 1:07:51property with the
- 1:07:53>> [clears throat]
- 1:07:53>> trash receptacles and all of that. So,
- 1:07:56the last time I was here there was an
- 1:07:58easement [clears throat]
- 1:07:59to access
- 1:08:01>> The easement does not exist. They never
- 1:08:03registered it when the hospital The
- 1:08:04original Since the hospital sold the
- 1:08:06property or the easement, the previous
- 1:08:08owner never got that documented on the
- 1:08:12deed. And unfortunately, it didn't
- 1:08:13transfer to us. It's not mapped there.
- 1:08:16Worst case scenario, if and when the
- 1:08:18hospital decides to do something with
- 1:08:20that lot, we can take the garbage that
- 1:08:22we have there and walk it through our
- 1:08:23ground floor corridor and and put it out
- 1:08:25front where our garbage dumpster comes.
- 1:08:27So, right now we'll have an enclosure
- 1:08:29which can store a 4-yard container which
- 1:08:32the dumpster company can come in and
- 1:08:33open the gates, pull it out, dump it,
- 1:08:36put it back in. And close up the And
- 1:08:39it's not visible. We do have a small
- 1:08:40section in the back which we're going to
- 1:08:42make still keep retain the originally
- 1:08:45planned steps. And there will still be
- 1:08:47an access point on the back of the
- 1:08:49property so that you in essence can walk
- 1:08:51through to the front and that's our main
- 1:08:53ADA compatible.
- 1:08:55>> Okay.
- 1:08:56>> We also plan on marketing the two ground
- 1:08:58floor apartments as ADA. We're required
- 1:09:00to have one but we're making both ADA
- 1:09:02accessible.
- 1:09:04>> Okay.
- 1:09:08Now, this is the change of the facade on
- 1:09:10the front of the building first floor.
- 1:09:13>> This is the existing.
- 1:09:15>> Okay.
- 1:09:15>> It's going to be all We're not changing
- 1:09:17anything on the facade on the front
- 1:09:18floor. There's an existing roofing
- 1:09:19canopy. We're just going to re-roof it
- 1:09:21cuz it's
- 1:09:22>> Okay.
- 1:09:22>> in not in good shape. So, this is the
- 1:09:24rear of the property and it had stucco
- 1:09:27and siding and had a mishmash of
- 1:09:28different things. So, we're going to use
- 1:09:30a Hardie Plank 9-in white standard look.
- 1:09:33The bottom We changed it's masonry on
- 1:09:35this side. The masonry goes up and over
- 1:09:37here it's a wood structure to the top.
- 1:09:39>> But, you you were going to enclose that
- 1:09:42front
- 1:09:42>> Where?
- 1:09:43>> little alcove?
- 1:09:44>> Yes. Oh my god. I Sorry, I totally
- 1:09:46forgot about that. So, right now we have
- 1:09:47a homeless person that likes to use our
- 1:09:49spot. And what we decided to do is bring
- 1:09:52that
- 1:09:53space towards the street more. We'll
- 1:09:55probably leave it within a foot of its
- 1:09:58of the property line. So, that we can
- 1:10:00still keep the We'll call box for the
- 1:10:02fire departments and have their access
- 1:10:04to it, but it would also serve as a wind
- 1:10:06entry for the retail when we rent it
- 1:10:08out.
- 1:10:08>> Amen.
- 1:10:09>> And eliminate the homeless person
- 1:10:10sleeping there.
- 1:10:12>> And then with
- 1:10:13um mailboxes?
- 1:10:14>> Mailboxes, right now we have two
- 1:10:16options. One is right here on the sliver
- 1:10:19just a built-in. We might make the wall
- 1:10:21wider or right now it's programmed you
- 1:10:23walk into the corridor and there'll be
- 1:10:2510 mailboxes plus a commercial for the
- 1:10:27mail departments use in this instance.
- 1:10:30We set inside the wall.
- 1:10:31>> Okay. That would be inside the left
- 1:10:33>> Inside the left door, yes.
- 1:10:34>> Okay.
- 1:10:35>> Secondary door there. So, the mailman
- 1:10:36can get in, but he can't go beyond the
- 1:10:38problem.
- 1:10:38>> Okay.
- 1:10:39>> Um so, you go to your plan to make sure
- 1:10:40there
- 1:10:41>> And the first floor apartments, their
- 1:10:43access
- 1:10:44You go behind?
- 1:10:45>> No, you actually have entrances from the
- 1:10:46front. If you go to the plan
- 1:10:49the section that has
- 1:10:51So, you would walk in here
- 1:10:53>> Okay.
- 1:10:54>> and you have a corridor here to this
- 1:10:55unit and you can go to this one. But,
- 1:10:58they also have access from the rear if
- 1:11:00they want to.
- 1:11:08Because we couldn't bank on having this
- 1:11:10always available for handicap entry, we
- 1:11:13originally were programmed to have a
- 1:11:14lift there. We have to lose access to
- 1:11:16that, we have to maintain this corridor,
- 1:11:18and we have to sacrifice some of this
- 1:11:20space, which originally was part of the
- 1:11:22retail. But, by doing so, we've
- 1:11:24maintained access and also here is the
- 1:11:26>> And it's just one retail?
- 1:11:28>> One retail.
- 1:11:29>> Okay.
- 1:11:30>> Existing.
- 1:11:32750-ish square feet.
- 1:11:42>> Now, another question. Since this takes
- 1:11:45up most of the footprint, and there is
- 1:11:47no easement in the back, how will
- 1:11:49construction stage with materials and
- 1:11:52equipment and
- 1:11:54>> I can bring everything in through here
- 1:11:55or boom it in.
- 1:11:57>> Okay.
- 1:11:57>> We do have
- 1:11:58>> like machines, booms to bring
- 1:12:01>> Well, I did I would have a delivery of
- 1:12:02drywall, that's our biggest item really
- 1:12:04to come in, and and some 2x4s, so we can
- 1:12:06stage it right through the windows.
- 1:12:08Um, I'm led to believe with initial
- 1:12:10conversations that the hospital would
- 1:12:12allow us to take deliveries from the
- 1:12:14back, and wouldn't impact this.
- 1:12:16If we have to go to the front, we'll
- 1:12:17apply for a permit to park,
- 1:12:20load it, and then leave.
- 1:12:21>> Okay.
- 1:12:22>> With flaggers.
- 1:12:31>> Right now, the parking lot, every time I
- 1:12:33go, it's really empty.
- 1:12:35They have been doing work on that there,
- 1:12:36so hopefully
- 1:12:38>> They'll probably stage that area when we
- 1:12:39start.
- 1:12:40>> And then we won't bother anybody too.
- 1:12:42Hopefully they complete it fairly soon.
- 1:12:48What's your timeline?
- 1:12:50>> Assuming this gets going in the right
- 1:12:52direction, we would apply for permits
- 1:12:55next week for the first phase that's
- 1:12:56already permitted, which is the
- 1:12:58downstairs.
- 1:12:59We're finalizing drawings with Charlie
- 1:13:01and hope to have something ready for
- 1:13:03There's an existing building right now
- 1:13:04that we're going to be filing for demo
- 1:13:06and we want to do the roof
- 1:13:08sooner than later. So, if it's not
- 1:13:09raining it's worse.
- 1:13:11>> We're really hoping that's
- 1:13:13late spring this year.
- 1:13:14>> Be on the market soon. Yeah.
- 1:13:18>> But, because I'm in the commercial we
- 1:13:20keep
- 1:13:21interior material business anyway, so
- 1:13:24that becomes very easy. Once I have the
- 1:13:26roof and the windows, inside it will go
- 1:13:29really fast.
- 1:13:30>> Okay.
- 1:13:36>> Any questions?
- 1:13:37>> We're going to go over it now.
- 1:13:41>> And then, I think it's great. I mean,
- 1:13:43that you don't really see a lot of
- 1:13:45proposals for studios and the fact that
- 1:13:48you can get more housing out of it for
- 1:13:50people. Which
- 1:13:51is great.
- 1:13:52>> Lemonade out of lemons. Yeah. Yeah.
- 1:13:54>> That's our architect, Charlie Wesley.
- 1:13:57He's a native Kingston. He said this
- 1:13:59will be so good for the area.
- 1:14:01Great location for a And it will be nice
- 1:14:03to see that
- 1:14:04>> [laughter]
- 1:14:05>> Everybody's looking forward to it.
- 1:14:07>> coming to Is that vacant?
- 1:14:09Finally.
- 1:14:11>> See you then.
- 1:14:11>> Everybody can't wait. Yeah, yeah. Thank
- 1:14:13you.
- 1:14:15>> All right. So,
- 1:14:17>> Thank you so much.
- 1:14:19>> All right. So, this is a type two. We
- 1:14:22have the
- 1:14:22>> And
- 1:14:23is
- 1:14:24Do you
- 1:14:25do require because it's 10 units, you
- 1:14:29are required to have one unit dedicated
- 1:14:32affordable with three
- 1:14:33>> We have three.
- 1:14:35>> You'll have to have one deed restricted
- 1:14:36through a covenant. And then, there will
- 1:14:39be a wreck fee of $10,000.
- 1:14:42And we just recognized potential
- 1:14:45easement in the future and then the
- 1:14:47fourth policies four or ending 6 7 11
- 1:14:5112 16 16A 17 20 21 22 23 and 24.
- 1:14:58Which you will get.
- 1:14:59>> [laughter]
- 1:15:00>> Perfect.
- 1:15:01>> Can you get them?
- 1:15:01>> [clears throat]
- 1:15:02>> How much you said the rent for unit 9
- 1:15:03that's
- 1:15:04>> 11
- 1:15:05>> $9,000 for the rent for unit
- 1:15:06>> 9,000 well
- 1:15:08Yeah, the with 10 units the first six
- 1:15:10are exempt for the and then because they
- 1:15:13are the affordable units for you and six
- 1:15:15units is all
- 1:15:16>> Mhm.
- 1:15:18>> What about taking the other two
- 1:15:19affordable that we're putting into
- 1:15:21consideration?
- 1:15:22>> Mhm.
- 1:15:25>> Take those into account and take those
- 1:15:27are deed restricted, right?
- 1:15:28>> Yes.
- 1:15:28>> Okay.
- 1:15:29>> If they're deed restricted then that one
- 1:15:31>> They are.
- 1:15:32>> If you spread it over they have to be
- 1:15:34deed restricted basically in perpetuity
- 1:15:37for as long as the use remains
- 1:15:40residentially
- 1:15:42occupied.
- 1:15:43>> I think that's your situation.
- 1:15:44>> I can't really adjust it but yeah.
- 1:15:48>> All right, so motion next.
- 1:15:50>> I need a motion.
- 1:15:51>> I'll make a motion.
- 1:15:52>> Can I get a second?
- 1:15:54Sage
- 1:15:56All in favor?
- 1:15:58Opposed?
- 1:16:01Thank you folks. Really appreciate it.
- 1:16:04Look forward to
- 1:16:06receiving the homework.
- 1:16:11Have a great evening.
- 1:16:14>> I'll find the deputy director.
- 1:16:17>> Yeah, we'll we'll send you a my letter.
- 1:16:19>> Do you have any homework
- 1:16:20>> Are you kidding?
- 1:16:21>> I can't even imagine.
- 1:16:22>> What do you
- 1:16:23>> I don't know what that is.
- 1:16:24>> I have a question about
- 1:16:27>> Who says it's a good thing?
- 1:16:28>> I don't know what she what's saying.
- 1:16:30>> So this happened in just one
- 1:16:32>> I was I was waiting to
- 1:16:33>> I don't know what to
- 1:16:34>> I was saying that
- 1:16:34>> I don't know what she was saying to me.
- 1:16:37>> You can do a good job.
- 1:16:40>> Stop it.
- 1:16:42>> I guess that's it.
- 1:16:43>> What did you say?
- 1:17:04>> Okay, item number nine, 11 111 Schwenk
- 1:17:08Drive site plan with associated waivers
- 1:17:11to demolish the existing building and
- 1:17:13construct a mixed-use building with
- 1:17:15ground floor commercial and residential

- 1:17:53>> [laughter]
- 1:18:28>> Well, welcome folks and if we could just
- 1:18:29have everyone's name for the record.
- 1:18:31>> Yeah, absolutely. Thank you so much for
- 1:18:32having us.
- 1:18:33I'm Marley Bushen. I'm a partner and
- 1:18:35head of development at Milestones.
- 1:18:39Uh this is Martha Bush
- 1:18:41>> I'm a director at Marble. We have a
- 1:18:43construction project.
- 1:18:44>> And now he will also be joining us.
- 1:18:46Scott James.
- 1:18:47>> He's an associate at Marble.
- 1:18:49>> Uh
- 1:18:49we've got Mike Moriello who's doing our

- 1:19:05>> And
- 1:19:05>> Um and Samara and Eloise, Mary Daley and
- 1:19:08Eloise Paul from Sycamore Street
- 1:19:09Advisors who are also on the project.
- 1:19:12>> Thanks, Samara. Well, welcome, folks.
- 1:19:15Um
- 1:19:15this point you just want to give us a
- 1:19:18walk through?
- 1:19:18>> Yeah, absolutely. Um so, I think many of
- 1:19:21you know the site as the Kia site.
- 1:19:25>> [laughter]
- 1:19:26>> Uh we'd love for it to be rebranded as
- 1:19:27something else. I have but uh we're
- 1:19:30really excited about this project. We
- 1:19:32are proposing 135 units of all
- 1:19:35affordable housing. Um
- 1:19:38we are working with HCR on the financing
- 1:19:40for this. So, we're doing it as a bond
- 1:19:42and credit deal. So, that will ensure
- 1:19:44that it is 100% affordable. We're
- 1:19:47targeting AMIs between 40%
- 1:19:51Um and we are hoping to close on this
- 1:19:55about a year from now on financing. Um
- 1:19:59assuming that approvals and everything
- 1:20:00go well, okay. Uh we are including
- 1:20:04studios to three-bedroom units.
- 1:20:06Um
- 1:20:07and uh as you can see, the building is
- 1:20:11sort of L-shaped and it's got a small
- 1:20:13amount of ground floor retail to comply
- 1:20:15with the zoning on the C5 Main Street.
- 1:20:17Um and we're also currently proposing
- 1:20:20doing the project uh as mass timber uh
- 1:20:23as sort of a sustainable building
- 1:20:25method. We have uh geothermal heating
- 1:20:28and cooling uh that we're designing into
- 1:20:30the project. and um
- 1:20:33yeah, we uh
- 1:20:34have
- 1:20:35over 100 spaces of surface parking
- 1:20:38beside this by far it is about 2 acres,
- 1:20:40so we're able to accommodate that and we
- 1:20:42think that that will be more than enough
- 1:20:44for the uh population in the building.
- 1:20:47Um and I will turn it over to the
- 1:20:50architects who will take us through more
- 1:20:52of the specifics. Yeah.
- 1:20:53>> If there's any questions about 519, I'll
- 1:20:55be able to explain them.
- 1:20:58Um I think we're just getting them
- 1:21:00Yeah, the graphics up.
- 1:21:10full screen.
- 1:21:16We got
- 1:21:17We got the server
- 1:21:18How do you like those yet?
- 1:21:25And then change
- 1:21:33Well, this is the aspect of speaking.
- 1:21:36All of this is
- 1:21:37still
- 1:21:54So, what we're doing is this is the um
- 1:21:57all of that on the site plan, but
- 1:21:59there's going to be a small lot line
- 1:22:02revision associated with this because
- 1:22:05there's a piece in the rear that they're
- 1:22:07going to need
- 1:22:08um
- 1:22:09assuming ownership of the adjoining
- 1:22:12property to the land.
- 1:22:14>> I'm going to guess they're off the rear.
- 1:22:16>> Back here on the site, there's that odd
- 1:22:19sort of triangle uh that cuts in versus
- 1:22:21to the 111 straight site, and so we um
- 1:22:26have an agreement with um
- 1:22:28um Bob Ryan
- 1:22:30uh, who owns the property and I started
- 1:22:32to acquire that site in conjunction with
- 1:22:34our closing. And you can actually see
- 1:22:36the triangle sort of highlighted on the
- 1:22:37bubble. You have a small computer.
- 1:22:40>> So, uh, project highlights which Marley
- 1:22:43just ran through. This mentions 100%
- 1:22:46portable 150 by units,
- 1:22:48hybrid CLT construction cross-laminated
- 1:22:50timber, uh, geothermal heating and
- 1:22:53cooling.
- 1:22:54Um, also some interesting stuff at the
- 1:22:56site. We're actually flood wings. We're
- 1:22:57doing flood resiliency to buildings.
- 1:22:59It's actually 5 ft above the ground
- 1:23:02plane. So, we're going with that.
- 1:23:04Um, and we're providing approximately
- 1:23:06102 parking spaces. So,
- 1:23:09real quickly, I'll go over some context
- 1:23:11and design and then get into the
- 1:23:12building. So, this is where Branch
- 1:23:14Schwenk is uh, located. So, this is the
- 1:23:16site with that lot line adjustment
- 1:23:18shown. So, we're just outside of the
- 1:23:20historic district here on the other side
- 1:23:22of the hill.
- 1:23:23Um, and here there's the single, uh,
- 1:23:26old, uh, car lot there with
- 1:23:29asphalt around it. So, when we got into
- 1:23:32the design, we were really taken,
- 1:23:34obviously, with the Stockade District
- 1:23:35and with Front Street and Wall Street
- 1:23:37and kind of looking at the qualities of
- 1:23:39the buildings there
- 1:23:41um, and contrasting that with Schwenk
- 1:23:43Drive. So, we went through and we did a
- 1:23:44whole inclusive looking at the rhythms
- 1:23:46and the proportions of those facades and
- 1:23:48trying to understand what makes those
- 1:23:50buildings have so much character.
- 1:23:52And then we looked at Schwenk Drive
- 1:23:54which has
- 1:23:55a quite different typology of suburban
- 1:23:57buildings and a parking lot, right? So,
- 1:23:58kind of the big question for us is how
- 1:24:00we bring that character down there on
- 1:24:03the river here.
- 1:24:04Um, and so, this is some photos of the
- 1:24:06site if you don't know it that well. Uh,
- 1:24:08so, this is the building on the
- 1:24:10backside. Here you have all these
- 1:24:12building these trees that are going up
- 1:24:13the hill kind of screen the parking lot
- 1:24:15a little bit. And there's existing
- 1:24:17foliage on either side of the building
- 1:24:19as well.
- 1:24:20Um,
- 1:24:21so, we're really taken with the textures
- 1:24:23of the town, right? All the different
- 1:24:24history and all the details that make up
- 1:24:27the buildings and particularly the
- 1:24:29adjacent Stockade Historic Area. And we
- 1:24:31did a whole analysis looking at the
- 1:24:33wealth and material history that comes
- 1:24:34from Kingston and the greater Ulster
- 1:24:36County. So, we looked at brick, we
- 1:24:38looked at timber, we looked at bluestone
- 1:24:41and limestone masonry, we looked at
- 1:24:42cement.
- 1:24:44And then we, you know, went back to the
- 1:24:45site
- 1:24:47and we looked at actually the building
- 1:24:48history of the Stockade District and
- 1:24:51what the buildings were made out of,
- 1:24:53largely brick frame siding and concrete
- 1:24:55and how that changed over time.
- 1:24:57So, then when we went to the site, we
- 1:24:59took two what we call bars
- 1:25:02and we treated one with brick and
- 1:25:03another with a limestone or stone like
- 1:25:05material using a high-density panel
- 1:25:08which has a texture to it, it's like a
- 1:25:10furred material.
- 1:25:12So, we defined those volumes, we
- 1:25:14articulated the volumes a little bit
- 1:25:15differently. The brick one has this
- 1:25:17stepping on the front to follow the
- 1:25:18curve of the street corner. As that's
- 1:25:20what we always said, but don't show me
- 1:25:22the whole thing. We connected them with
- 1:25:24this bridge across. And then finally we
- 1:25:27articulated the volumes by adding some
- 1:25:29more wood into the the building and
- 1:25:32those kind of that happen at public
- 1:25:33spaces within the building and then we
- 1:25:36lifted the back portion of the building
- 1:25:38up so that we get all the parking
- 1:25:40underneath it in the front.
- 1:25:42So, that gives us two facade systems for
- 1:25:45the building. They're both
- 1:25:47a rain screen insulation system, but on
- 1:25:49the front it's a a brick facade, it's a
- 1:25:52Kingston brick so it's a bit longer and
- 1:25:54taller.
- 1:25:56And then on the back is that
- 1:25:58high-density panel that we talked about.
- 1:26:00So, the brick will have headers and
- 1:26:02sills
- 1:26:04and then the
- 1:26:06panel portion will have some trim around
- 1:26:09the windows to help cast shadows and
- 1:26:10break up the facade as well.
- 1:26:13So, we mentioned that it was hybrid CLT.
- 1:26:16What that means is that the floors and
- 1:26:18then out of cross-laminated timber.
- 1:26:20Um so, because of the flood plane here,
- 1:26:23we're building that first floor out of
- 1:26:24concrete. So, it's resilient. So, it's a
- 1:26:26concrete podium.
- 1:26:28Um so, above that, but you have See
- 1:26:30these orange lines here? That will be
- 1:26:33cross-laminated timber flooring, which
- 1:26:34will be exposed in the apartment. So,
- 1:26:36this is a similar style project, but you
- 1:26:38can see the wood ceilings there. And
- 1:26:41then the walls themselves will be
- 1:26:43uh light wood framing. So, those are
- 1:26:46spaced on a 12 by 6 module,
- 1:26:48um which act as bearing and shear walls
- 1:26:50throughout.
- 1:26:51Uh and then also above the first floor,
- 1:26:54that CLT is going to be making up the
- 1:26:57elevator shafts and the stair shafts.
- 1:26:59So, when you're in a corridor, you can
- 1:27:00see where the public spaces are, and
- 1:27:02they can move by seeing the wood.
- 1:27:06Uh so, this is a view from the
- 1:27:07northwest, um which was on one of the
- 1:27:09earlier slides. This is the retail
- 1:27:11component uh that Marylin mentioned.
- 1:27:14This is the kind of burning the sloping
- 1:27:16that we're using to navigate that 5-ft
- 1:27:19difference. So, we're using the
- 1:27:20landscape and we use it as notches, like
- 1:27:22a harsh wall in front of the building's
- 1:27:24wall. Well,
- 1:27:25this is a view from the southwest. If
- 1:27:27you go in the parking lot, so if you
- 1:27:29look at it
- 1:27:31that way. And then this is the screening
- 1:27:33and the rear entrance into that amenity
- 1:27:35courtyard
- 1:27:37um that was mentioned, and you can start
- 1:27:38to see some of the amenity rooftop
- 1:27:40terraces above.
- 1:27:43And then looking at the northeast, you
- 1:27:44can see the drive aisle. So, that takes
- 1:27:46you back into the parking. There's 102
- 1:27:47spaces. And then here you get a kind of
- 1:27:49clear view of the residential entrance.
- 1:27:51So, again, anywhere where there's kind
- 1:27:53of public movement, that's where we
- 1:27:55start to bring in the wood and bring it
- 1:27:56in from the outside.
- 1:27:58Um and then here you see the stepping of
- 1:27:59the building itself. It's stepping 2 and
- 1:28:011/2 in 2 and 1/2 foot increments. And
- 1:28:04so, that brings down the natural canopy,
- 1:28:06so that we don't need to add anything
- 1:28:08else on to the facade.
- 1:28:11And then this is a view from the
- 1:28:13courtyard. That initial early sketch we
- 1:28:15did, but gives you an idea of the
- 1:28:17amenity spaces that will be wrapping
- 1:28:19this courtyard. So you'll have your
- 1:28:20lounge off of it. Uh you'll have your
- 1:28:22laundry and your gym. Um and then you
- 1:28:25can kind of see some of the CLT coming
- 1:28:27through the windows up there.
- 1:28:30Uh this is a ground floor plan zoomed in
- 1:28:33on the first floor of the building
- 1:28:35itself. So this is the courtyard
- 1:28:37that we were just looking at. You have
- 1:28:38your amenity spaces wrapping it with
- 1:28:40this corridor so that there's always
- 1:28:41natural light coming into that. Um and
- 1:28:44then you have your main entrance here in
- 1:28:46the north, which is what we looked at
- 1:28:47with the ramp, the stairs, the retail,
- 1:28:49and the residential entrance are on the
- 1:28:51same level. So they're both at that 5-ft
- 1:28:54uh elevation. And then there is a rear
- 1:28:56entrance from the parking area that has
- 1:28:59both a ramp and stairs as well.
- 1:29:02Um on the ground floor we also have like
- 1:29:04our water meter, electrical service room
- 1:29:06up here in the corner. We have a
- 1:29:08compactor room um which will carry 30
- 1:29:11toters, which will be brought out and
- 1:29:12staged in the back. Uh we're working
- 1:29:15with our waste management on that.
- 1:29:18And then the typical floor, these will
- 1:29:20run through two through six. Um so these
- 1:29:22have the studios, the one beds, the two
- 1:29:24beds, and the three beds.
- 1:29:26Uh this repeats per the floor or per
- 1:29:29every floor. So there's an elevator bank
- 1:29:30here in the north. You have your stair
- 1:29:32here in the north and another stair in
- 1:29:33the south. So those run
- 1:29:36back
- 1:29:38down.
- 1:29:39So that stair A goes out and exits
- 1:29:41through there and stair B connects it
- 1:29:42out here. And stair B actually exits out
- 1:29:45above the flood plane,
- 1:29:48um which is just kind of a
- 1:29:50you know, in case there is a flood, that
- 1:29:52way you're not opening the flood right
- 1:29:54out of the water.
- 1:29:57And then on the roof we have an amenity
- 1:29:59terrace in the bar portion in the center
- 1:30:01there.
- 1:30:02Uh and then we have the stairs on either
- 1:30:04side.
- 1:30:05Because we're using a geothermal system,
- 1:30:08we don't actually have that much
- 1:30:09equipment on the roof. So, we have two
- 1:30:11ERVs in the north and two ERVs in the
- 1:30:13south. And then there's a a generator
- 1:30:16that will be on the north on the strong
- 1:30:18rise.
- 1:30:21So, as part of this, we are going for
- 1:30:24seven
- 1:30:25waivers. Three of them are major and
- 1:30:28four minor. The first one
- 1:30:32is the built-to zone. So, as of right
- 1:30:35with the affordability bonus, we can
- 1:30:37build up to six stories. Uh for the
- 1:30:39first 80 ft. So, that's essentially
- 1:30:41roughly this far in the broad up to six
- 1:30:45stories.
- 1:30:46Uh what we're looking to do is to
- 1:30:48continue that across so that we get more
- 1:30:51affordable units here in the back seven.
- 1:30:53Um the second major waiver is a distance
- 1:30:57between glazing. So, per zoning, I'll
- 1:31:00jump back to that beautiful
- 1:31:03Per zoning, this portion of the facade
- 1:31:05needs to be 2 ft wide. Uh we're showing
- 1:31:08it as four to keep a proportional rhythm
- 1:31:10with the rest of the building.
- 1:31:11Um and also to account for the
- 1:31:13structural column that's coming down
- 1:31:14there.
- 1:31:18The
- 1:31:19third major waiver is
- 1:31:21curb cut width. Uh per the zoning, the
- 1:31:23maximum curb cut is 20 ft wide. We are
- 1:31:26showing currently a 24 ft curb cut
- 1:31:28width, but then the arrows are 20 ft and
- 1:31:30the drive aisle after it will be on the
- 1:31:32street.
- 1:31:33Uh the four minor waivers are for the
- 1:31:35front built-to zone. So, first one is
- 1:31:38per the zoning, the building needs to be
- 1:31:41within 5 ft of the perimeter of the
- 1:31:43property line. But, because of the flood
- 1:31:47uh resiliency, we the space to get up
- 1:31:50into the building. So,
- 1:31:52we're trying to set that back.
- 1:31:53Uh the building width uh the the zoning
- 1:31:56permits 150 ft. So, we're less than 10%
- 1:31:59over, but we're a little bit wider this
- 1:32:01far of 162 ft.
- 1:32:03Um and then there is a blank wall on the
- 1:32:07ground floor.
- 1:32:10Here, so in order to get this drive out
- 1:32:12here so that the cars can come through,
- 1:32:14that means that we need to put the
- 1:32:16front-facing utility entry here.
- 1:32:20Um instead of being able to like break
- 1:32:21it up or put something in between. Uh so
- 1:32:24that creates uh
- 1:32:26a blank wall that's a little bit larger,
- 1:32:27but we're articulating that with
- 1:32:29different materials and potentially
- 1:32:30putting signage there.
- 1:32:32>> Can you show that blank wall on the
- 1:32:33front right here?
- 1:32:34>> The um
- 1:32:35yeah, it's
- 1:32:38here.
- 1:32:39>> Okay.
- 1:32:39>> So our thought is like we can add
- 1:32:41signage here adjacent to it and then use
- 1:32:43the landscaping to soften that. Um so
- 1:32:46that way it's not just a big a stretch.
- 1:32:52And then the fourth waiver is related to
- 1:32:54signage. Uh per the zoning
- 1:32:57the letter of it says that the wall
- 1:32:59signage needs to be uh
- 1:33:01above the storefront. We're showing it
- 1:33:03as adjacent uh in our drawings, which I
- 1:33:06can pull those up, but
- 1:33:08um that's largely because here the
- 1:33:09storefront runs all the way to the top,
- 1:33:11so we have the signage here to help
- 1:33:14break up that
- 1:33:16uh blank wall facade. Um whereas it'll
- 1:33:19be above the
- 1:33:21the storefront for the retail.
- 1:33:24And then this is the overall site plan.
- 1:33:27So this is 102 parking spaces.
- 1:33:30The EV spaces here to the south, the
- 1:33:32bike parking will be
- 1:33:34uh under the overhang of the building
- 1:33:36adjacent to the back entry. Um and then
- 1:33:40we have our ADA spaces here as well.
- 1:33:42Uh Paul, was there anything else with
- 1:33:44the
- 1:33:45>> Um I'll just say quickly uh
- 1:33:49we're to
- 1:33:50redeveloping a largely impervious site
- 1:33:53and and actually reducing by 8% the
- 1:33:56impervious area.
- 1:33:58Um [snorts] I have verified in
- 1:34:00communication with the city engineer the
- 1:34:02base flood elevation we're using 155.4.
- 1:34:06So, the finished floors are all 2 ft
- 1:34:08above that.
- 1:34:10Um and happy to answer any questions
- 1:34:14regarding our our civil site plan or
- 1:34:16engineering related issues.
- 1:34:19>> Can you just speak to just a little bit
- 1:34:21about how right now there is storm water
- 1:34:24that and it runs through the site, it
- 1:34:26connects other properties as well, and
- 1:34:29how that's going to all be redirected
- 1:34:32and on an interim when the construction
- 1:34:35is not being on this site, how the storm
- 1:34:39water is going to be addressed from the
- 1:34:40adjacent sites and that doesn't back up
- 1:34:43there?
- 1:34:43>> Sure. Um so, we have I believe four
- 1:34:47connections. There's a small catch basin
- 1:34:50from Bob Ryan's property that goes into
- 1:34:53a basin on our site. We have a small
- 1:34:56basin from the teachers union
- 1:35:00on the adjacent site who have an
- 1:35:02easement here and a small 6-in line that
- 1:35:05comes onto our site and then there's uh
- 1:35:08one other line from the federal credit
- 1:35:11union that actually won't be affected.
- 1:35:14We'll be rerouting the storm up
- 1:35:16Let me show it better on a different
- 1:35:18plan. Um so, it's really just these two
- 1:35:20basins which are essentially overflows
- 1:35:24from a drywell system on this property
- 1:35:26adjacent.
- 1:35:28Um
- 1:35:29not really concerned about
- 1:35:32during construction. What they would go
- 1:35:35from downstream and back, so these would
- 1:35:39by the time these are tied back in,
- 1:35:42they they would be connected to the Frog
- 1:35:44Alley system that discharges
- 1:35:47that way.
- 1:35:48Um
- 1:35:49if we have to do any temporary bypass
- 1:35:53uh
- 1:35:53if there's a storm, then they're not
- 1:35:55connected in the couple days while we're
- 1:35:58reconnecting these
- 1:36:00these 6-in lines, uh we'll we'll do that
- 1:36:03as needed.
- 1:36:05>> And you're proposing a new um
- 1:36:09What's the name of it?
- 1:36:10>> The hydro-dynamic separator.
- 1:36:12>> Thank you.
- 1:36:13>> That'll That'll help us meet our water
- 1:36:15quality goal and treatment for the slip
- 1:36:18redevelopment slip. Um allows for the
- 1:36:21use of those, and that's
- 1:36:23that'll be here right before going out
- 1:36:26the Frog Alley.
- 1:36:27Um and that will be able to convey the
- 1:36:30100-year storm flow while while treating
- 1:36:33the storm water.
- 1:36:34>> I don't know the board is familiar with
- 1:36:37that. Can you just kind of describe the
- 1:36:38system because I don't think it's
- 1:36:40something that we're
- 1:36:40>> Sure. It's more of a mechanized uh
- 1:36:43system
- 1:36:45um
- 1:36:46that has like a swirl
- 1:36:48um
- 1:36:49I I call it a filter filtration system
- 1:36:52that that treats storm water and and
- 1:36:54discharges it a cleaner uh storm water
- 1:36:57we used one at Benedictine and
- 1:37:01we've used them all over for
- 1:37:02redevelopment projects. It's I think a
- 1:37:056-ft diameter. Looks like a looks like a
- 1:37:08dry well, but it has a
- 1:37:11it it's mechanized and and provides our
- 1:37:14treatment.
- 1:37:15>> Does that need to be serviced or
- 1:37:17emptied?
- 1:37:18>> There's There's some maintenance
- 1:37:20requirements um
- 1:37:22I'm sure every 5 to 10 years.
- 1:37:24I I would have to check the exact.
- 1:37:28>> The The building is anticipating having
- 1:37:29a building superintendent.
- 1:37:31>> Okay.
- 1:37:31>> So maintenance should be easily covered.
- 1:37:40>> Yep. So if there's any questions for our
- 1:37:41group, thank you.
- 1:37:47>> So
- 1:37:48just for the record numbers, we've
- 1:37:50obviously you've got staff notes and we
- 1:37:52did send the staff notes out to you all.
- 1:37:56I'm sure some of you will look at them
- 1:37:58and digest them
- 1:38:00and
- 1:38:01we'll be making
- 1:38:03comments back on them. If you have any
- 1:38:05questions for us about anything that is
- 1:38:09within those, let us know
- 1:38:11before next month.
- 1:38:14This does need to go to the county, so I
- 1:38:17do want to forward to
- 1:38:19if they're comfortable with the level of
- 1:38:21information. I think it's developed we
- 1:38:23think it's developed enough to send that
- 1:38:26referral to the county planning board
- 1:38:29so that we can do that next month. I
- 1:38:31think also we would ask the board at
- 1:38:33public hearing.
- 1:38:35There's obviously one required by law
- 1:38:37for the lot line revision that is part
- 1:38:40of the project. I think a site plan
- 1:38:43public hearing is also in order
- 1:38:45on this.
- 1:38:47The other thing I'm just as we talked
- 1:38:49about with the 25 foot court one, I
- 1:38:51think that there should be some um
- 1:38:54uh more visual simulations done. Um I'd
- 1:38:58like the board to think about and
- 1:39:00maybe tonight come up with a couple of
- 1:39:03locations that, you know, as you're
- 1:39:06coming down Schwank or going up, you
- 1:39:08know, either direction on Schwank I
- 1:39:10think it'd be really appropriate to
- 1:39:12have some
- 1:39:14visual simulations for day and night um
- 1:39:17with building context of existing
- 1:39:20buildings in place.
- 1:39:22Um
- 1:39:23and also maybe from up above to get any
- 1:39:26sense of
- 1:39:28from the historic district. So, I don't
- 1:39:31know what are the board's thoughts on
- 1:39:33that.
- 1:39:37>> And this is a
- 1:39:39six-story building primarily is a
- 1:39:42one-story area.
- 1:39:44>> So, especially with the front street
- 1:39:45just to see what it'll do to the view.
- 1:39:48That would be one location.
- 1:39:50Not that it's saying.
- 1:39:58>> So, the that parking lot on on North
- 1:40:01Front Street is
- 1:40:03right. This is the guardrail.
- 1:40:05>> Yeah, yeah.
- 1:40:07>> From Front Street, it's due to the
- 1:40:09mature trees that are sort of on that
- 1:40:11slope up to the parking lot. They
- 1:40:13actually provide quite a bit of
- 1:40:15screening from Front Street.
- 1:40:18Um but that's sort of the perspective
- 1:40:20there.
- 1:40:20>> Yeah, this is a the normal perspective.
- 1:40:23>> Do we know the grade change between the
- 1:40:25our parking lot and
- 1:40:27the parking lot of North Street?
- 1:40:29>> Yeah.
- 1:40:36We go from 180 to about what what do we
- 1:40:39have? 150 or 160? Or 155? Yeah.
- 1:40:4425 ft.
- 1:40:49>> I just I think it's important
- 1:40:51to have those simulations particularly
- 1:40:54because one of the waiver requests is
- 1:40:58to have both the fifth and the sixth
- 1:41:00floor extended
- 1:41:02back
- 1:41:04all the way to the rear of the building,
- 1:41:06which is
- 1:41:08quite a large deviation
- 1:41:11waiver request. I wasn't It's close to
- 1:41:14200% and so I think it's important to
- 1:41:17understand
- 1:41:19visually and different
- 1:41:25view viewpoints.
- 1:41:30>> Sure, and we can also show it in the
- 1:41:31context of the Kingstonian, which will
- 1:41:34also be like a virtual drive by there.
- 1:41:38And the
- 1:41:41I mentioned it like the reason to bring
- 1:41:43that waiver or why we're requesting that
- 1:41:45is we get about
- 1:41:4730
- 1:41:49additional units of affordable housing.
- 1:41:51And so it it has a lot of implications
- 1:41:55if we were to lose those units, we'd
- 1:41:56likely be pushed into the HCR 9%
- 1:42:01financing program, which then is
- 1:42:03competitive, which you know, I can't say
- 1:42:06when we would close with that. And so
- 1:42:08keeping our building at a certain scale
- 1:42:11helps on multiple fronts.
- 1:42:14>> We're doing the housing diversity
- 1:42:16through the
- 1:42:17through the through the heart and those
- 1:42:18will be all up in two years, but we'll
- 1:42:20definitely do those visuals that you
- 1:42:21requested.
- 1:42:22>> Yeah.
- 1:42:23>> Do we know if the parking lot has
- 1:42:25been put out in RFP and there's been
- 1:42:28responses to develop on that?
- 1:42:30They're going to alter it slightly.
- 1:42:33Any issues to be
- 1:42:35to be able to be put on the parking lot
- 1:42:37on the west side?
- 1:42:38We'll get various vehicles for it.
- 1:42:41>> Yeah, absolutely. So we can take one
- 1:42:43from that parking lot for other areas.
- 1:42:45>> But we haven't seen the intersection.
- 1:42:49>> Okay, I got you. I got you.
- 1:42:50>> Uh no, other other intersection. Just
- 1:42:53with the parking lot.
- 1:42:54>> Yeah.
- 1:42:54>> Yeah. Yeah.
- 1:43:09>> The three affordable housing units
- 1:43:12going to be
- 1:43:14solely sourced through Roto?
- 1:43:18>> We will be the managing agent,
- 1:43:20um but the uh
- 1:43:23limited market environment of water of
- 1:43:2540 units.
- 1:43:29>> And we'll do, you know, it's always been
- 1:43:32our precedence to notify the community
- 1:43:34as much as we can that the lottery is
- 1:43:36active to, you know, encourage as many
- 1:43:39applications, especially locally, as we
- 1:43:41can.
- 1:43:42You know, we want people who live in
- 1:43:44Kingston who need an affordable home to
- 1:43:47be the first people to apply for this.
- 1:43:48So, if there's any suggestions of
- 1:43:50organizations we'd like to see us do
- 1:43:52outreach to, we're happy to consider
- 1:43:54that and make sure that we tell them
- 1:43:56that the lottery is active and even give
- 1:43:58them heads up. You know, in the past
- 1:44:00we've done even trainings on like this
- 1:44:02is how you actually apply for it when
- 1:44:03it's a complicated lottery system,
- 1:44:05things like that.
- 1:44:09>> So,
- 1:44:10the parking demand
- 1:44:12and reduction study it came in late. I
- 1:44:15just quickly reviewed it and a couple
- 1:44:17things.
- 1:44:19Um,
- 1:44:20I'm I'm thinking that, you know, what
- 1:44:22might be nice to incorporate into the
- 1:44:25project would be maybe a bus shelter
- 1:44:28along the public right-of-way to
- 1:44:30encourage, you know, ridership um or a
- 1:44:33place for them maybe
- 1:44:36um
- 1:44:36it's not, you know, I know you said you
- 1:44:39would provide information to residents,
- 1:44:42but I'm not seeing the
- 1:44:46intermodal kind of connectivity that I
- 1:44:48would like to see in that study
- 1:44:50identified.
- 1:44:51>> Sure, and we can certainly talk to
- 1:44:54bus operator here and see if there is an
- 1:44:56opportunity for that and at the very
- 1:44:58least do wayfinding, you know, if they
- 1:45:00say you don't want a bus shelter there,
- 1:45:01but do wayfinding of, you know, bus stop
- 1:45:04100 ft this way, whatever it is.
- 1:45:06Certainly want to encourage
- 1:45:08multimodal transit.
- 1:45:12>> Now, with this being in the flood plain,
- 1:45:14what
- 1:45:16are there any specialized construction
- 1:45:18techniques that you're going to use to
- 1:45:21put pilings in or how is
- 1:45:23the support going into the ground to
- 1:45:25bedrock or what
- 1:45:28that look like?
- 1:45:29>> So, our structural engineer is still
- 1:45:31working on that based off the geotech
- 1:45:33report, but um the basic feedback that
- 1:45:35we've gotten is because we're we're
- 1:45:36building up uh the 5 ft uh to do it with
- 1:45:40fill so that we're on slab
- 1:45:43um so that that would prevent having to
- 1:45:46wet flood proof anything.
- 1:45:49Uh so,
- 1:45:50currently
- 1:45:52uh the piles are are pretty standard. Um
- 1:45:55the depths will be based off of the
- 1:45:56geotech report um in terms of like flood
- 1:45:59resiliency, there isn't
- 1:46:01a lot extra that we have to do because
- 1:46:03we're doing uh
- 1:46:04the pile system here.
- 1:46:07>> Geotech says piles
- 1:46:09>> Yeah, mhm.
- 1:46:14>> So, would you be doing um so,
- 1:46:17for the pilings, would you be doing
- 1:46:19you'd be doing compacting, right? From
- 1:46:21what I understood reading the geotech,
- 1:46:23like they would be compacting the soils.
- 1:46:27>> That's what I already said.
- 1:46:28>> Okay.
- 1:46:31Um would you
- 1:46:33be doing any surveying of the adjacent
- 1:46:36properties or monitoring any of the
- 1:46:39buildings that are
- 1:46:40>> Absolutely, yeah. You know, normal
- 1:46:43course of business, we'll do a
- 1:46:44pre-construction survey of, you know,
- 1:46:46our geotech engineer or structural
- 1:46:48engineer will recommend which
- 1:46:49properties, how far it should extend,
- 1:46:51and then we'll do vibration monitoring,
- 1:46:53optical monitoring, whatever is
- 1:46:55necessary per their recommendations.
- 1:47:02>> So, do you I have listed in the agenda
- 1:47:06the New York State Office of Parks,
- 1:47:07Recreation and Historic Preservation as
- 1:47:09a circulating
- 1:47:11uh agency. Do you guys anticipate
- 1:47:15reaching out to them through Chris?
- 1:47:17Because the reason I ask is because what
- 1:47:20I found that would be happening more and
- 1:47:22more recently is once DEC gets it in
- 1:47:25their system, it takes several months.
- 1:47:28Then it goes to OPRHP, and then it's
- 1:47:31like 5 months later you get a letter
- 1:47:33that says, "Oh, we want to see
- 1:47:35everything." So, do you guys
- 1:47:37go to Chris right at the beginning?
- 1:47:39Should we do it? Should we
- 1:47:41>> I don't
- 1:47:43I typically only would have if we were
- 1:47:45doing the coordinating review, which
- 1:47:47which this is not we're treating as a
- 1:47:50activity,
- 1:47:51>> Yeah, my concern my concern is that
- 1:47:53they're going to get it
- 1:47:55and then say, "Okay, we're commenting."
- 1:47:57I mean, even though they're not
- 1:47:59interested agencies can
- 1:48:01>> in the each like if you're going for
- 1:48:03state funding,
- 1:48:05finance agencies
- 1:48:06>> It's going to be in the system.
- 1:48:07>> But that agency may develop a referral
- 1:48:10process.
- 1:48:11>> Okay.
- 1:48:12>> Well, we'll talk when we're
- 1:48:14But you don't you you we can do it
- 1:48:16anywhere we want.
- 1:48:17>> Well, we can check in with HCR if you
- 1:48:19want.
- 1:48:19>> Yeah, I just don't want to find out like
- 1:48:215 6 months after we
- 1:48:23>> Yeah, I don't want to have
- 1:48:25I don't want to have a shovel-ready
- 1:48:26project, but but it's in the hole for
- 1:48:28it.
- 1:48:31Um and so, you had mentioned uh
- 1:48:34settings referring this to the county.
- 1:48:36We did have our gateway meeting with
- 1:48:38Dennis Doyle a few weeks ago.
- 1:48:41No substantial comments came out of
- 1:48:43that. We learned about
- 1:48:45Dennis's personal feelings on brick.
- 1:48:48Uh
- 1:48:51That that was the most controversial
- 1:48:53thing out of there.
- 1:49:00>> They're just saying that
- 1:49:01personal
- 1:49:13>> Okay. So,
- 1:49:14where
- 1:49:16I can't hear you. I'm sorry, but I can't
- 1:49:17hear you.
- 1:49:18Did you hear me?
- 1:49:19Okay.
- 1:49:20>> he's going to be.
- 1:49:20>> Okay. So, we are making the visuals. Do
- 1:49:23you want to see visuals from the
- 1:49:27intersections
- 1:49:29of
- 1:49:29Plaza and Kenchway and looking towards
- 1:49:32the this project.
- 1:49:34>> Um this project alley and Kenchway
- 1:49:36>> Plaza alley and Kenchway and then up
- 1:49:38above from North Front Street looking
- 1:49:41down. Any any other
- 1:49:43>> I think I'd like to see it just kind of
- 1:49:45a sign with the one-story buildings.
- 1:49:47They're not as tall as six stories, but
- 1:49:49look compared next to
- 1:49:51>> Okay.
- 1:49:51>> You know, like Ryan and next You know
- 1:49:53what I'm saying? Like something where
- 1:49:55you can see the surrounding property.
- 1:49:58>> Yep.
- 1:50:01>> We can do the videos.
- 1:50:03>> Um I would do them in both night time
- 1:50:07and day time.
- 1:50:10I don't
- 1:50:11I think the night time particularly
- 1:50:12because if you're going to have the
- 1:50:14um
- 1:50:16top floor have that open
- 1:50:18>> air with the terrace restaurant
- 1:50:20>> the lights and how that might impact
- 1:50:23>> Yeah. We're also just in a doing um EGC
- 1:50:27as part of the ACR process. So, we are
- 1:50:28following the uh dark sky standards in
- 1:50:30the lighting. So, but as is worth
- 1:50:34probably making any kind of light still
- 1:50:35up. So,
- 1:50:37uh we've been They've been looking at
- 1:50:38the light poles through that as it So,
- 1:50:39we'll we'll
- 1:50:40give you some illustrations of that.
- 1:50:46>> I think we have it.
- 1:50:49You
- 1:50:49have it.
- 1:50:52No, we didn't.
- 1:50:53>> Mhm.
- 1:50:57>> I think we brought that in.
- 1:51:03>> Okay.
- 1:51:04>> Now, if everything goes to plan
- 1:51:08then if
- 1:51:10What are the [clears throat] timelines
- 1:51:11you guys are at?
- 1:51:13>> I think I will
- 1:51:14>> Sure.
- 1:51:15So, we have
- 1:51:18pretty aggressive design schedule. We're
- 1:51:20currently on pause until we get the
- 1:51:23feedback from the planning board, but
- 1:51:25when we resume, we'll be resuming with
- 1:51:28design development
- 1:51:29and we have a schedule that will get us
- 1:51:32to 100% CD drawings by the spring.
- 1:51:36In our conversations with HCR, we've
- 1:51:40been talking about a
- 1:51:43late summer closing and we have also
- 1:51:46been talking since this is a tax credit
- 1:51:48project, we need tax credit investor.
- 1:51:52We currently have a couple of
- 1:51:54investors who are interested and are
- 1:51:55holding us our project in their 2027
- 1:51:58pipeline.
- 1:51:59Tax credit equity has gotten very tight
- 1:52:01in the past couple of years and so we
- 1:52:04wouldn't be able to consider financial
- 1:52:05closing [clears throat] without also
- 1:52:06having that sort of piece lined up.
- 1:52:11And then we're underwriting a 30-month
- 1:52:14construction timeline, I believe.
- 1:52:20I'm sorry, the I think it's 24. I'm
- 1:52:23sorry, I'm completing projects.
- 1:52:25>> The fire chief did have some comments
- 1:52:27that I did upload. I don't know.
- 1:52:30You you should get notification when the
- 1:52:32>> We get them as well.
- 1:52:33>> Ours are being asserted.
- 1:52:34>> I just want to make sure you were okay
- 1:52:36because he had some height
- 1:52:38>> Yeah.
- 1:52:38>> complaints and
- 1:52:39>> We looked at that. I know that
- 1:52:41the minimum truck height is 16 ft. Our
- 1:52:45passer were holding 18 ft right now
- 1:52:48under the building itself. Uh but it
- 1:52:51does vary because of the slight grade
- 1:52:53change but it's always at like 16 ft 9
- 1:52:56to 17 ft and a half.
- 1:52:58Um and then there's a lot
- 1:53:00There's some room in there so we can
- 1:53:01play with the design of that. It's still
- 1:53:03in that development further.
- 1:53:04>> And we've been in contact with the
- 1:53:06chief.
