10. 1:24circuit judge for
11. 1:25lincoln county
12. 1:29what's up this is your initial
13. 1:30appearance i'm going to be addressing
14. 1:31you regarding a
15. 1:33criminal case that was recently filed i
16. 1:35want to remind you first of all that you
17. 1:37have the right to remain
18. 1:38silent you don't have to say anything at
19. 1:40all at any time about these allegations
20. 1:43anything that you do say can be used
21. 1:44against you
22. 1:46the state filed a felony complaint this
23. 1:48was filed on july 12
24. 1:502021 in that complaint the state alleges
25. 1:53in count
26. 1:54one that in violation of section 565020
27. 1:58revised statutes of missouri that you
28. 2:00committed the class a
29. 2:01felony of murder in the first degree
30. 2:05punishable upon conviction under section
31. 2:07565020 revised statutes of missouri
32. 2:10in that honor about december 27 2011
33. 2:14in the county of lincoln state of
34. 2:16missouri that after deliberation you
35. 2:19knowingly caused the death of
36. 2:20elizabeth faria by stabbing
37. 2:24state alleges also in count two that in
38. 2:26violation of section 571015 revised
39. 2:29statutes of missouri
40. 2:31that you committed the felony of armed
41. 2:33criminal action
42. 2:35punishable upon conviction under section
43. 2:37571-015.3
44. 2:40in that honorable december 27 2011 in
45. 2:42the county of lincoln state of missouri
46. 2:44you committed the felony of murder that
47. 2:47is charged in count
48. 2:49one and that you committed the foregoing
49. 2:52felony of murder
50. 2:53with and through and with the knowing
51. 2:55use assistance
52. 2:57and aid of a deadly weapon
53. 3:07we have two matters to briefly discuss
54. 3:10at this time council we will need to
55. 3:13schedule a preliminary hearing
56. 3:15and uh unless there's some reason that
57. 3:17we should not do it i
58. 3:18intend to schedule out within 30 days
59. 3:21that's something that we can
60. 3:23talk about in a scheduling conference
61. 3:25afterward
62. 3:26also i see that the state has filed a
63. 3:27motion to dismiss count
64. 3:29two i suggest we talk about scheduling
65. 3:31of
66. 3:32hearing on that as well at our
67. 3:35scheduling conference
68. 3:36okay all right um
69. 3:40and i will enter an order today is there
70. 3:42anything else for the state
71. 3:44nothing further from the state okay
72. 3:46anything for the defense judge just for
73. 3:48the record i believe that miss hub
74. 3:49has a right under rule 33 to have her
75. 3:51bond reviewed in seven days we would
76. 3:53waive that
77. 3:54since she is currently in the department
78. 3:55of corrections so
79. 3:57we do not need to have her bond reviews
80. 3:58in seven days thank you that's noted for
