- 0:00My husband forbade me from buying
- 0:02stocks. You will lose everything. But
- 0:05secretly, I invested $500.
- 0:104 years later, they grew to $73 million.
- 0:14I decided not to tell my husband what
- 0:17happened the next day.
- 0:20Good day, dear listeners. It's Maria
- 0:22again. I'm glad you're here with me.
- 0:24Please subscribe to my channel and like
- 0:26this video. And also, let me know in the
- 0:29comments which city you're listening
- 0:32from. That way, I can see how far my
- 0:35story has traveled. For 16 years, I
- 0:39measured my life in other people's
- 0:41schedules. I woke at 5:40 in our house
- 0:44on Larchmere Boulevard in Shaker
- 0:46Heights, Ohio. Packed two lunches, drove
- 0:49Sophie to middle school, and Ben to the
- 0:51elementary building three blocks
- 0:53farther, and was home by 8:15 to make my
- 0:56husband's coffee the way he liked it.
- 0:59Two scoops, half a cup of water in the
- 1:01carafe the line, because Daniel said the
- 1:04machine over extracted otherwise.
- 1:07I had been a clinical research
- 1:08coordinator at University Hospitals
- 1:10before Sophie was born. I gave that up
- 1:13in 2011. Daniel said it made financial
- 1:16sense. It did on paper. Daniel was very
- 1:20good at paper. He was a CPA with his own
- 1:23three-person practice in Beachwood, and
- 1:26money in our house was a language only
- 1:28he spoke. I had a debit card attached to
- 1:31a household account he funded every 2
- 1:34weeks with $1,100.
- 1:36Groceries, gas, kids' shoes, my
- 1:39haircuts. If I needed more, I asked. He
- 1:43never said no in a cruel way. He said,
- 1:46"Send me the numbers." And then he'd
- 1:48send back a spreadsheet with a column
- 1:50labeled discretionary.
- 1:52Reviewed, and somehow by the end of the
- 1:55conversation, the thing I wanted had
- 1:57become something I decided against
- 1:59myself.
- 2:01Do you know that particular trick?
- 2:03The one where you're never refused, only
- 2:05reasoned out of your own wanting?
- 2:08The first time I brought up investing
- 2:09was February 2018.
- 2:12I'd read a book from the Shaker library,
- 2:14one of those plain language index fund
- 2:17books, and I sat down at our kitchen
- 2:19table with a legal pad, actually
- 2:22excited, and told him I wanted to open a
- 2:24small brokerage account of my own, $400
- 2:28a month, nothing dramatic.
- 2:31He didn't laugh.
- 2:32That would have been easier.
- 2:34He set down his fork, folded his hands,
- 2:37and said,
- 2:38"Claire,
- 2:39you'll lose everything."
- 2:41I remember the hum of the refrigerator.
- 2:44I remember the exact tilt of his head,
- 2:47the patient one,
- 2:48the one he used with clients who'd tried
- 2:50to deduct their boats.
- 2:53"People like you," he said, "get
- 2:55emotional. You buy high, you panic, you
- 2:58sell low. That's not an insult. That's
- 3:01data.
- 3:02I've watched it happen to 40 clients."
- 3:05Then he softened, reached across the
- 3:07table, covered my hand.
- 3:10"Let me take care of this. That's the
- 3:12whole point of me."
- 3:14And I said, "Okay."
- 3:16God help me, I said, "Okay." And I put
- 3:18the legal pad in the drawer under the
- 3:19phone books, and for 2 years, I didn't
- 3:22bring it up again.
- 3:23Then in March 2020, my grandmother Ruth
- 3:26died in Toledo, and after the funeral,
- 3:29my father handed me a check for $4,000
- 3:32from her estate.
- 3:33Daniel deposited 3,500 of it into the
- 3:36joint account within a week.
- 3:39"So it's working," he said.
- 3:41I kept 500 in cash in a Chock Full
- 3:44O'Nuts tin at the back of my closet
- 3:46behind the winter boots. Not a plan,
- 3:49just $500 that belonged to me because
- 3:52Ruth had meant it to.
- 3:54And then, Priya called.
- 3:56Priya Raman and I had been roommates at
- 3:58Ohio State, and she'd stayed in the
- 4:00science while I'd stepped out of it.
- 4:03She was starting a company, Northlight
- 4:05Diagnostics, building a home coagulation
- 4:08monitor for patients on blood thinners.
- 4:11So, a 79-year-old in Ashtabula wouldn't
- 4:14have to drive 40 minutes for a finger
- 4:16stick every week. She had a prototype, a
- 4:19co-founder from Case Western, and no one
- 4:22who could write a regulatory submission.
- 4:25I could write a regulatory submission.
- 4:28I'd written 11 of them before Sophie was
- 4:30born. She asked me to come on as a
- 4:32founding contributor. Weekends,
- 4:35evenings, unpaid, for as long as it
- 4:37took. And she said the friends and
- 4:39family round was open at a nominal
- 4:42price.
- 4:43Anything. $500.
- 4:45Just so the equity was clean and I was a
- 4:47real shareholder and not a favor.
- 4:51I gave her the coffee tin money on April
- 4:5311th, 2020, in the parking lot of a
- 4:56Panera in Woodmere, with our masks on.
- 4:594.1% of the common stock on a stock
- 5:03purchase agreement I signed on the hood
- 5:05of her Subaru. I did not tell Daniel.
- 5:08Not that first night, and then not the
- 5:10next week, and then it had been a month,
- 5:12and telling him would have required
- 5:13explaining the lie.
- 5:15And so, I simply kept not telling him.
- 5:18For 26 months, I worked in the Shaker
- 5:20Library's second floor study rooms and
- 5:23at the kitchen table after midnight. And
- 5:26Daniel thought I was doing a genealogy
- 5:28project. On October 3rd, 2024, Priya
- 5:32called me from Chicago and told me
- 5:34Covalent Medical had signed a definitive
- 5:36agreement to acquire Northlight for $1.9
- 5:39billion.
- 5:41After the preference stack, my 4.1% came
- 5:44to roughly $73 million before tax. I sat
- 5:49down on the bottom stair of my own
- 5:50house, and I did not feel joy.
- 5:53I felt something closer to vertigo, and
- 5:55by the time I stood up, I had decided I
- 5:58would not tell him. Not yet. Maybe not
- 6:01ever.
- 6:03The next morning I came back from the
- 6:04school run at 8:20 with a gallon of milk
- 6:07in my arm. Daniel was at the kitchen
- 6:09table. He was still in his coat. In
- 6:12front of him was a torn-open FedEx
- 6:14envelope, the kind that requires a
- 6:16signature, addressed to Claire E.
- 6:18Whittaker, shareholder of record. He
- 6:21looked up at me, and he smiled.
- 6:24"I signed for it," he said. "You were
- 6:27out."
- 6:28The milk was sweating in my arm. I put
- 6:31it in the refrigerator because that's
- 6:32what your hands do when the rest of you
- 6:34has gone somewhere else,
- 6:36and I closed the door slowly enough to
- 6:38hear the seal catch,
- 6:40and then I turned around.
- 6:42He had the letter squared in front of
- 6:44him, corners aligned with the edge of
- 6:46the table.
- 6:48Corden's outside counsel, Foley and
- 6:50Marsh, informing shareholders of record
- 6:53of the closing timeline and requesting a
- 6:55completed W-9 and wire instructions.
- 6:59"73 million dollars,"
- 7:02Daniel said. He said it the way you'd
- 7:04say a temperature.
- 7:06"Claire, sit down."
- 7:08I sat. I expected rage. I braced for the
- 7:12vein in his forehead, for the 16-year
- 7:14archive of every dollar I'd spent to be
- 7:17read aloud. Instead, he took my hand
- 7:20across the table, exactly like he had in
- 7:23February 2018, and his eyes were wet.
- 7:27"I'm not angry," he said. "I'm Honestly,
- 7:30I'm proud. You did this. That's
- 7:33incredible."
- 7:34He squeezed.
- 7:36"And thank God you have me, because we
- 7:38have about 90 days to restructure this
- 7:40properly, or the IRS is going to take
- 7:43half.
- 7:44We.
- 7:46There it was. Dropped in so lightly I
- 7:48almost didn't catch it. He was already
- 7:51talking. Grant her trusts, an Ohio LLC
- 7:55he'd form by Friday. Something called a
- 7:58QSBS analysis. He'd call Meredith to get
- 8:02a rush on the entity filings. Her firm
- 8:04could turn it around in a day.
- 8:07He'd need the stock purchase agreement,
- 8:09the cap table, Priya's counsel's contact
- 8:12information.
- 8:13And we should look at the agreement, he
- 8:14said, just to make sure it doesn't cause
- 8:16a problem.
- 8:18What agreement?
- 8:19He was writing on a legal pad. The one
- 8:21from the refinance.
- 8:24He didn't look up. I said, "Danielle,
- 8:27what agreement from the refinance?"
- 8:29And he looked up then, and for maybe a
- 8:31second and a half his face was
- 8:33completely blank. Not caught, just
- 8:37recalculating.
- 8:38Then he smiled again and said,
- 8:41"Paperwork, Claire.
- 8:42Don't spiral."
- 8:44He went to work at 9:00. I stayed at the
- 8:47table until 10:40.
- 8:49Here is what I owned on the morning I
- 8:51was worth $73 million.
- 8:54$2,106
- 8:57in the household checking account, which
- 8:59he funded and could see.
- 9:01A 2016 Honda Pilot titled in his name
- 9:04because he'd said the insurance was
- 9:06cheaper that way.
- 9:07A credit card that was an authorized
- 9:10user card on his account. My name
- 9:13printed on it. His name on the
- 9:15obligation, which meant 13 years of my
- 9:18perfect payment history had built his
- 9:21credit and not mine.
- 9:23No account of my own since 2011. No pay
- 9:27stub since 2011. My phone was on his
- 9:30plan. Our house was in both names and
- 9:33the mortgage had been refinanced twice,
- 9:35in 2019 and 2021. And I had signed
- 9:39whatever he put in front of me at the
- 9:40title company because he sat beside me
- 9:43and said initial here, sign here, this
- 9:47one's just the escrow disclosure.
- 9:5096 pages both times. I'd read none of
- 9:53it.
- 9:54How many pages have you signed because a
- 9:56man beside you said the word just? I
- 9:59made a list on the back of a grocery
- 10:01receipt and the list frightened me more
- 10:03than the letter had because it wasn't
- 10:05what I had. It was a list of what he
- 10:07could turn off. Phone, car, card, house.
- 10:13In one afternoon if he wanted and under
- 10:15that one more line, the one that made my
- 10:18hands cold, he knows before the money
- 10:21lands. That was the true danger. The
- 10:23money wasn't in my hands yet. Closing
- 10:26was projected for late January. For 4
- 10:29months there would be a number on a page
- 10:31and nothing in an account and 4 months
- 10:34is a very long time to be a woman with
- 10:36no bank account of her own living with a
- 10:38man who says we.
- 10:40I did three things that day.
- 10:42First I drove to the Shaker Library
- 10:44second floor, the same study room where
- 10:46I drafted North Lights 510K
- 10:49submission
- 10:51and I logged into the guest computer
- 10:52instead of my phone. I searched Ohio
- 10:55post nuptial agreement enforceable. In
- 10:582024 Ohio had only just begun permitting
- 11:02them at all. The statute changed in
- 11:04March 2023.
- 11:07Anything signed before that date between
- 11:09spouses purporting to alter marital
- 11:12property rights was on extremely shaky
- 11:14ground.
- 11:16I wrote that on an index card.
- 11:18Second, I called Priya from the library
- 11:21parking lot and told her everything in
- 11:23about 90 seconds and she was quiet and
- 11:26then she said, "Claire,
- 11:28do not sign anything. Not a trust, not
- 11:31an LLC, not a transfer, nothing. I'm
- 11:35sending you Foley and Marsha's transfer
- 11:38agent contact, and I'm putting a note in
- 11:40the file that no instruction is accepted
- 11:42from anyone but you in writing,
- 11:45notarized by a notary neither of us is
- 11:48related to.
- 11:50Third, and this was the hardest, and it
- 11:53took me until 2:00 p.m. sitting in my
- 11:55car outside the Fifth Third branch on
- 11:58Chagrin. I walked in with my driver's
- 12:01license, my social security card, and
- 12:03$200 cash, and I opened a checking
- 12:07account in the name Claire Elizabeth
- 12:09Whittaker with a paper statement only
- 12:11setting and my mother's Toledo address
- 12:14on the file.
- 12:15The teller was maybe 24.
- 12:17She said, "Any joint owners?"
- 12:20"No," I said, and my voice shook on one
- 12:23syllable.
- 12:24"Just me."
- 12:26Then I sat in the parking lot and made
- 12:28my plan in order on the back of the same
- 12:30receipt. One, my own lawyer, one he had
- 12:34never met. Two, copies of every document
- 12:38I had ever signed. Both title companies,
- 12:41the county recorder, everything.
- 12:44Three, find out what the agreement from
- 12:47the refinance was before he did. Because
- 12:51he'd said it out loud, hadn't he? And a
- 12:53man like Daniel doesn't mention a card
- 12:55he isn't already holding.
- 12:58Anita Bell's office was on the ninth
- 13:00floor of a limestone building on East
- 13:03Ninth Street in downtown Cleveland with
- 13:05a view of a parking garage and a slice
- 13:08of the lake if you stood in the corner.
- 13:10She was 61, wore reading glasses on a
- 13:13beaded chain, and had practiced domestic
- 13:16relations law in Cuyahoga County for 29
- 13:19years.
- 13:20I picked her because she had no
- 13:21connection to Beachwood, to Daniel's
- 13:24referral network, or to Hallack and
- 13:26Price. I paid the $7,500 retainer with a
- 13:29cashier's check drawn on my new account
- 13:32funded by a wire from Priya that she
- 13:35labeled on the memo line consulting
- 13:38arrears 2020-2022
- 13:41which was, if you think about it simply
- 13:43the truth arriving late.
- 13:46Anita listened for 40 minutes without
- 13:48writing anything. Then she took off her
- 13:51glasses.
- 13:52Mrs. Whitaker
- 13:54the shares are the smaller problem. I
- 13:56want you to understand that.
- 13:58They're $73 million.
- 14:02And in Ohio, appreciation on separate
- 14:04property is marital property if it
- 14:07results from the labor of either spouse
- 14:10during the marriage. You did the labor
- 14:13during the marriage.
- 14:14She let that sit.
- 14:16A judge could call most of that marital
- 14:18and split it. That's not a scandal.
- 14:20That's just Ohio.
- 14:22I felt the floor tilt. So he gets half.
- 14:26Maybe. Unless something else is true.
- 14:29She put the glasses back on.
- 14:31What worries me is a man who mentioned
- 14:34an agreement and then told you not to
- 14:37spiral. Men who have nothing to hide say
- 14:40what the agreement is. She slid a legal
- 14:43pad across. Write down every place you
- 14:46have ever signed your name in the last
- 14:4810 years. Every closing, every bank,
- 14:51every notary.
- 14:53I wrote for 20 minutes. Two refinances,
- 14:56Buckeye Land Title in Mayfield Heights,
- 14:59March 2019 and a different one in 2021.
- 15:03A car loan, a HELOC application and
- 15:06under notary in every single instance
- 15:09where I could remember a stamp. One name
- 15:12Carol.
- 15:14My mother-in-law had been a commissioned
- 15:16Ohio notary since 1998.
- 15:19She notarized everything for the family.
- 15:22Meredith's adoption paperwork, Daniel's
- 15:25practice documents, my father-in-law's
- 15:27power of attorney before he died. It had
- 15:30always seemed like thrift. Why pay a
- 15:33bank $5 when Carol had a stamp in her
- 15:36purse?
- 15:37Anita looked at the page for a long
- 15:39moment. "Request your complete closing
- 15:42files, both title companies. You're a
- 15:45party. They have to give them to you. Do
- 15:47it by email today from an address he
- 15:49doesn't have." I made a Gmail account in
- 15:52the parking garage. I sent both requests
- 15:55before I got to the car. The reaction
- 15:57came faster than the files did. Meredith
- 16:00called Tuesday. My sister-in-law and I
- 16:03had spoken maybe nine times in 16 years
- 16:06outside of holidays, and she opened with
- 16:09"Claire, I was thinking about you."
- 16:13She wanted to know if I was doing okay
- 16:15with everything, and whether I'd been
- 16:17downtown lately. And then, with the
- 16:20artlessness of a woman who had never
- 16:22once in her life been the least
- 16:24intelligent person in a room, and
- 16:26therefore assumed no one else was,
- 16:28either.
- 16:29"Because if you're talking to anybody,
- 16:31you should really loop me in, since I
- 16:34have all the family's documents anyway."
- 16:37All the family's documents. I said I'd
- 16:39been at the library. She said, "Mhm."
- 16:43and hung up. Carol came Thursday with a
- 16:45chicken and rice casserole in a Pyrex
- 16:47dish, which she had never once done in
- 16:5016 years, and stood in my kitchen and
- 16:53asked me twice, in two different
- 16:55phrasings, whether I'd gotten any mail
- 16:58lately from Chicago.
- 17:00When I said no, she looked at the
- 17:02counter, at the mail basket, and then
- 17:04she said the thing I have never
- 17:06forgotten.
- 17:07"You know, Claire,
- 17:09families protect each other. Nobody
- 17:11wants a stranger looking through our
- 17:13business. Our business. Two women in a
- 17:16week both saying are. The files came
- 17:19Friday, October 18th at 4:12 in the
- 17:23afternoon in two zipped folders from
- 17:25Buckeye Land Title.
- 17:27I opened them at the library because I
- 17:29would not open them in that house.
- 17:32The 2021 file was clean, 91 pages of
- 17:36exactly what it claimed to be. The 2019
- 17:40file was 104 pages. I went through it
- 17:44line by line and I was 38 minutes in and
- 17:47beginning to feel foolish when I turned
- 17:49to page 61.
- 17:53Postnuptial agreement and waiver of
- 17:55marital interest, six pages in the same
- 17:58typeface as the escrow disclosures,
- 18:01sandwiched between a flood certification
- 18:03and a signature page for the note.
- 18:06It said that all business interests,
- 18:09securities, partnership interests, and
- 18:12equity of any kind acquired by either
- 18:15party during the marriage would be held
- 18:17as the sole and separate property of
- 18:20Daniel J. Whitaker and that Claire E.
- 18:23Whitaker waived all present and future
- 18:26claims to them and acknowledged she had
- 18:29been advised to seek independent counsel
- 18:31and had declined.
- 18:33My signature was on page 66.
- 18:37It was my signature. I could see where
- 18:39the pen had skipped on the L and beneath
- 18:42it a notary block, stamp, commission
- 18:45number, the whole apparatus, sworn to
- 18:48and subscribed before me this 14th day
- 18:51of March 2019,
- 18:54signed Carol A. Whitaker.
- 18:57I sat in that study room with my hand
- 18:58over my mouth because on March 14th,
- 19:012019, I was not in Mayfield Heights,
- 19:05Ohio. On March 14th, 2019, I was in
- 19:09Toledo at ProMedica Toledo Hospital in a
- 19:12fourth-floor waiting room because my
- 19:14father had gone in for an emergency
- 19:15gallbladder removal at 6:00 in the
- 19:17morning, and I had driven out at 4:00
- 19:20a.m. and stayed until the 9th. I had the
- 19:22parking receipts in a shoebox. I had
- 19:25texts. I had a photograph of my father
- 19:28with a plastic cup of ice chips
- 19:30timestamped 11:40 a.m. The closing had
- 19:34been at 10:00. I had not signed that
- 19:36page in front of her. I had not signed
- 19:38that page at all. It had been slid into
- 19:41a stack, or my signature page had been
- 19:44lifted from somewhere else entirely, and
- 19:46his mother had put her stamp on a lie
- 19:48and sworn I was standing in front of
- 19:50her. I printed it. And when the printer
- 19:53stopped, I understood there was no
- 19:56version of my life where I unlearned
- 19:58this.
- 19:59Anita read the six pages twice on Monday
- 20:02morning, and when she finished, she did
- 20:04something I didn't expect. She laughed.
- 20:07One short dry sound like a cough. "Mrs.
- 20:10Whittaker, do you understand what you're
- 20:12holding? An agreement that takes
- 20:15everything.
- 20:16An agreement that cannot possibly
- 20:18stand." She counted on her fingers.
- 20:21"One,
- 20:22Ohio didn't permit postnuptial
- 20:24agreements at all until March 2023.
- 20:28This was executed in 2019. Two, it's
- 20:31unconscionable on its face. Total
- 20:34waiver, no reciprocal provision, no
- 20:37disclosure of assets attached. Three, no
- 20:41independent counsel, and the recital
- 20:43saying you declined counsel is a lie in
- 20:46a document you never read.
- 20:48Four,
- 20:50she tapped the notary block. And this is
- 20:53the one that ends people. This is a
- 20:55false jurat. She swore under her
- 20:58commission that you personally appeared.
- 21:01You were 90 miles away in a hospital.
- 21:04That's not a technicality. That's a
- 21:06fifth degree felony under Ohio law, and
- 21:09it makes the whole instrument a fraud,
- 21:12not a mistake.
- 21:13So, we void it.
- 21:15We void it, and then we use it.
- 21:18She leaned forward.
- 21:19Because Ohio has a statute Y 3105.171E4.
- 21:26If a spouse engages in financial
- 21:28misconduct, the court may compensate the
- 21:30other spouse with a distributive award.
- 21:33Concealment, fraud, dissipation.
- 21:37A postnuptial agreement forged into a
- 21:40mortgage closing by the man's mother is
- 21:43about as clean a case of financial
- 21:44misconduct as I have seen in 29 years.
- 21:49We filed on October 29th, 2024 in the
- 21:52Cuyahoga County Court of Common Pleas,
- 21:55Division of Domestic Relations, a
- 21:58complaint for divorce, a motion to
- 22:00declare the purported postnuptial
- 22:02agreement void ab initio, a motion for
- 22:06temporary orders restraining the
- 22:08transfer or encumbrance of any marital
- 22:11asset, and a request for production of
- 22:13Carol A. Whitaker's notary journal for
- 22:172019.
- 22:18Anita also served a subpoena on Buckeye
- 22:21Land Title for the original wet ink
- 22:23documents and the closing agent's log.
- 22:27Daniel was served at his Beachwood
- 22:28office at 11:15 on a Tuesday in front of
- 22:31his receptionist. He was home at 11:52.
- 22:36I had Sophie and Ben at my mother's in
- 22:38Toledo.
- 22:39I had driven them out Sunday and told my
- 22:41mother the truth in her kitchen and
- 22:43watched a 70-year-old woman go
- 22:45absolutely still and then say, "Good."
- 22:49So, the house was empty, and Anita had
- 22:51told me to record, and I did on my new
- 22:55phone from the counter in a state where
- 22:57one-party consent is legal. He came in,
- 23:01and he did not shout.
- 23:03That's the part people never believe. He
- 23:06hung his coat.
- 23:07"Okay," he said, "here's where we are."
- 23:11By 4:00 that afternoon, the household
- 23:13checking account balance was zero, and
- 23:15the account was closed. My authorized
- 23:18user card was canceled. I found out at a
- 23:21Marathon station with $14 of gas already
- 23:25in the tank.
- 23:27My phone line was suspended at 6:00 p.m.
- 23:30The pilot titled in his name, he simply
- 23:33took he drove it to his office lot and
- 23:35left the second set of keys on the
- 23:37kitchen table like a man returning a
- 23:39library book.
- 23:41That evening, all three of them came.
- 23:44Daniel sat. Carol stood at the sink like
- 23:47she owned it. Meredith did the talking
- 23:49because Meredith always did the talking,
- 23:52and she had brought a folder because a
- 23:54paralegal always brings a folder.
- 23:57She laid out three things on my kitchen
- 23:59table.
- 24:00The first was a printout of my 2019
- 24:03records from the Cleveland Clinic
- 24:04Behavioral Health Department.
- 24:07A 9-month course of sertraline and
- 24:09cognitive behavioral therapy after my
- 24:11second miscarriage.
- 24:13"This is discoverable in a custody
- 24:15proceeding," Meredith said. "Every
- 24:18page."
- 24:19The second was a set of screenshots of
- 24:21texts between me and Priya from Daniel's
- 24:24phone
- 24:25because our phones had backed up to the
- 24:27same family account for years.
- 24:30"You spent 2 years lying to your husband
- 24:32about where you were on weekends," she
- 24:34said. "Read that back to yourself and
- 24:37tell me how it sounds to a magistrate."
- 24:40The third was a one-page document. A
- 24:43withdrawal of the motion regarding the
- 24:45postnuptial agreement and a consent to
- 24:47entry of an agreed order and a signature
- 24:50line with my name typed under it.
- 24:53"Sign this tonight," Meredith said. "And
- 24:56none of the rest of it happens. My
- 24:58mother is 68 years old, Claire.
- 25:01You want to put her in a courtroom over
- 25:03a stamp?"
- 25:04And Carol from the sink said, "I did
- 25:07that for you.
- 25:08Do you know how much you cost this
- 25:10family? 16 years of my son's money and
- 25:13you never earned a dime."
- 25:16I want to tell you that I was brave.
- 25:18What I actually was was numb. And inside
- 25:22that numbness, there was something very
- 25:24clear and very small, like a coin at the
- 25:28bottom of a well.
- 25:30I said, "Meredith, who drafted the
- 25:32postnuptial agreement?"
- 25:35She said nothing.
- 25:36"Because it's in the Buckeye Land Title
- 25:38file as an attachment to an email, and
- 25:41the email came from your firm's domain,
- 25:44and the metadata on the Word document
- 25:47has an author field."
- 25:49I hadn't checked the metadata yet, but
- 25:52she didn't know that, and I watched her
- 25:54face do arithmetic.
- 25:56"So, when you tell me not to put your
- 25:57mother in a courtroom, you're not
- 25:59protecting her. You're standing behind
- 26:02her."
- 26:03Then I looked at Carol.
- 26:05"The county keeps the journal
- 26:06requirement for a reason.
- 26:09You're going to be asked what's written
- 26:10on the March 14th line under oath."
- 26:14Nobody said anything for about 6
- 26:16seconds.
- 26:17Then Daniel stood up, gathered the
- 26:19folder, and said quietly,
- 26:22"This is going to be very bad for you."
- 26:25And they left, all three, and Carol
- 26:28pulled the storm door so hard the glass
- 26:31rang.
- 26:32I locked it. I sat down on the kitchen
- 26:35floor with my back against the
- 26:36dishwasher and shook for 20 minutes.
- 26:40Then I drove my mother's borrowed
- 26:41Corolla out to Geneva on the lake to a
- 26:44friend's off-season cottage with a space
- 26:46heater and no television. And for 4
- 26:49days, I walked on a cold gray beach in a
- 26:52borrowed parka and slept 11 hours a
- 26:56night and did not open a single email.
- 26:59You have to let the body catch up.
- 27:01Nobody tells you that. The war is long
- 27:03and the body has to catch up. The offer
- 27:06came the day I got back. Not from
- 27:09Daniel, from a lawyer named Gerald Prusa
- 27:12of Prusa and Wayne, who had never met me
- 27:15and whose letter was four paragraphs of
- 27:17the most beautiful reasonableness I have
- 27:20ever read. His client, it said, wished
- 27:23to avoid the emotional and financial
- 27:25devastation of protracted litigation,
- 27:28particularly for the benefit of the
- 27:30minor children.
- 27:32His client therefore proposed 60% of the
- 27:35North Light proceeds to me, 40 to him,
- 27:38the marital home to me free and clear,
- 27:41shared parenting on my proposed
- 27:43schedule, all fees paid by his client,
- 27:46conditioned upon withdrawal of the
- 27:49motion concerning the agreement dated
- 27:51March 14th, 2019,
- 27:53withdrawal of the subpoena to Carol A.
- 27:55Whittaker, and a mutual
- 27:57non-disparagement clause with a
- 27:59confidentiality provision, 60%
- 28:03$43.8 million,
- 28:06and I would never have to sit in a
- 28:07courtroom and Sophie would never have to
- 28:09know, and a 68-year-old woman would keep
- 28:12her stamp.
- 28:14Anita put the letter down.
- 28:16It's a real offer. I have an obligation
- 28:19to tell you it's a good one.
- 28:22I looked out at the parking garage.
- 28:24What do they get?
- 28:25They get the fraud buried, which means
- 28:28Carol keeps her commission, Meredith
- 28:30keeps her career, and Daniel keeps his
- 28:33CPA license because the accountancy
- 28:36board disciplines for acts of
- 28:37dishonesty, and this is one, and it's
- 28:40the only thing he's genuinely afraid of.
- 28:43She shrugged.
- 28:45And you get almost $44 million.
- 28:48That is not nothing.
- 28:50And if we go forward,
- 28:52then it's a fight, and fights aren't
- 28:54certain. But Claire,
- 28:56they didn't offer you 60%
- 28:59because they think they'll win.
- 29:02Two days later, Daniel called from a
- 29:03number I didn't know, and he cried.
- 29:07That was the part I'd been dreading. 16
- 29:09years is 16 years. You don't stop
- 29:12knowing the sound of a person. He said
- 29:14he'd made the worst mistake of his life
- 29:16in 2019 and had been sick about it every
- 29:19day since.
- 29:21He said his mother didn't understand
- 29:22what she'd signed, that she'd trusted
- 29:24him. He said Ben had asked when he was
- 29:27coming home. I listened to all of it.
- 29:30And I noticed something that surprised
- 29:32me.
- 29:33I felt nothing move. I said, "Daniel,
- 29:37why did you have it drafted in 2019?"
- 29:40Silence.
- 29:42"Because in 2019, I had no assets, no
- 29:45business, no equity, nothing. There was
- 29:48nothing to protect. You wrote a document
- 29:51that only becomes valuable if I ever
- 29:53earn something.
- 29:55You built a fence in an empty field.
- 29:58Claire,
- 29:59you built it because you were always
- 30:01going to need it eventually."
- 30:03I said it without heat. "That's the part
- 30:06I can't get past. Not that you did it,
- 30:09that you did it early."
- 30:11He hung up.
- 30:12And then, for almost 3 weeks, nothing.
- 30:16No calls, no casseroles, no folders.
- 30:20Meredith's firm entered an appearance
- 30:22for Carol and filed a motion to quash
- 30:24the subpoena, and it was denied. And
- 30:27after that, they went silent and
- 30:29watchful.
- 30:30I'd see Daniel's car,
- 30:32my car, idling on the far side of
- 30:35Larchmere on Sunday evenings when the
- 30:37kids came back. Never approaching, just
- 30:40there.
- 30:42That silence was worse than the
- 30:43shouting.
- 30:45Do you know what it does to you being
- 30:46watched by people who know your medical
- 30:48records? I did not do well alone.
- 30:51I want to be honest about that because
- 30:53the version where a woman becomes steel
- 30:56overnight is a lie that makes real women
- 30:59feel like failures. Priya flew in from
- 31:02Chicago twice and sat in my kitchen and
- 31:04did my expense spreadsheets and made me
- 31:07eat.
- 31:08My mother came from Toledo for 10 days
- 31:10and slept on the couch and answered my
- 31:12phone.
- 31:13But the thing that actually changed me
- 31:16was smaller and stranger.
- 31:19Anita gave me a photocopied flyer for a
- 31:22divorce support group that met Thursday
- 31:24nights in the basement of St. Luke's
- 31:26Lutheran in Lakewood.
- 31:2815 folding chairs, bad coffee, a
- 31:31facilitator named Dot who had done it
- 31:33for 11 years. I almost didn't go. What
- 31:36was I going to say? Hello, I'm having a
- 31:39hard time. I'm about to receive $73
- 31:41million.
- 31:42I went. I sat.
- 31:45For 3 weeks, I said nothing except my
- 31:47first name.
- 31:49On the fourth week, a woman named
- 31:51Rosanne Kapp, 63, retired school
- 31:54secretary from Fairview Park, was
- 31:57talking about her own divorce 7 years
- 31:59back and how she'd walked away with
- 32:01almost nothing because of a document
- 32:04she'd signed at a mortgage closing in
- 32:062016
- 32:07and never read.
- 32:09I heard the sound of my own blood.
- 32:12I waited until the chairs were stacked
- 32:14and I asked her in the parking lot under
- 32:17the sodium light who her husband had
- 32:19been.
- 32:20Her husband had been Thomas Kapp. Thomas
- 32:23Kapp had been Daniel's partner at the
- 32:25practice from 2014 to 2018. I asked her
- 32:29carefully because you cannot ask a
- 32:31stranger a question like this carelessly
- 32:34whether she still had her closing file.
- 32:37She did. In a tote in her basement
- 32:40because she was the kind of woman who
- 32:41keeps everything.
- 32:43Page 58 of Roseann Cap's 2016 file was a
- 32:48postnuptial agreement and waiver of
- 32:50marital interest in the same typeface
- 32:53with the same recital about declining
- 32:56independent counsel with the same
- 32:58structure with the name swapped
- 33:01notarized by Carol A. Whitaker.
- 33:04Roseann looked at me across her basement
- 33:06steps 7 years too late to help herself
- 33:08and said,
- 33:10"Honey, do I get to be a witness?"
- 33:12I said, "Yes."
- 33:13I drove home on I-90 with the file in a
- 33:16tote bag on my passenger seat and I did
- 33:19not feel triumphant. I felt cold and
- 33:22very calm the way you feel when a fever
- 33:25finally breaks and you realize how sick
- 33:28you'd been.
- 33:30Because it wasn't a mistake in 2019, it
- 33:32was a practice.
- 33:34They came on the second Sunday of
- 33:36December at 4:00 in the afternoon when
- 33:38the light in Ohio is already gone and
- 33:41the street lamps make the snow look
- 33:42yellow. I hadn't invited them.
- 33:45Daniel called from the driveway and
- 33:47said, "It's cold. Please." And I could
- 33:50see Carol's white Buick behind his
- 33:53behind my Pilot and I made a decision
- 33:56I'd been coached on. Anita had said if
- 33:59they ever came again, let them in, say
- 34:02almost nothing and record.
- 34:05Ohio, one party.
- 34:07My phone went on the counter screen down
- 34:10next to the fruit bowl.
- 34:11They brought a poinsettia. That detail
- 34:14still gets me.
- 34:16We sat in the living room where I'd hung
- 34:18stockings for 11 years. Carol had done
- 34:21her hair. Meredith had left the folder
- 34:23in the car. I checked and that was the
- 34:26first thing that told me the strategy
- 34:28had changed.
- 34:30Daniel started. He'd rehearsed it. I
- 34:33could hear the seams. He said he was in
- 34:35therapy now twice a week with a man in
- 34:38Pepper Pike. He said he'd been raised by
- 34:40a father who counted everything and that
- 34:43he'd become a person who could only love
- 34:46by controlling. And that he was 50%
- 34:49of the reason this marriage died and he
- 34:52was ready to own it.
- 34:54He said Sophie had cried at
- 34:56Thanksgiving. Carol reached over and
- 34:58took my hand. Same gesture, the family
- 35:02gesture and said, "I've thought about
- 35:04you every day, Claire. I have prayed
- 35:07about it."
- 35:08And I sat there and I felt the pull.
- 35:12That's the thing nobody warns you about,
- 35:15not the threats, the warmth. 16 years of
- 35:19belonging held out in a room with a
- 35:20poinsettia in it and part of me, a real
- 35:24part, not a weak part, wanted to put it
- 35:26all down and go back inside. Then
- 35:29Meredith said, "So we've been thinking
- 35:31about the timeline."
- 35:33And there it was, because reconciliation
- 35:35doesn't have a timeline. Settlements
- 35:38have timelines.
- 35:39She explained in her competent way that
- 35:42they'd retained a forensic accountant
- 35:44out of Columbus,
- 35:46a good one, she said, one who testifies
- 35:49constantly, and that his preliminary
- 35:51read was that every dollar of Northlight
- 35:54was marital because I had performed the
- 35:56labor during the marriage from the
- 35:59marital residence using a laptop
- 36:01purchased with marital funds. He'd
- 36:04opined that the $500 was de minimis and
- 36:08untraceable because I'd taken it in
- 36:10cash.
- 36:12The inheritance argument evaporates
- 36:14without a bank record, Claire. You
- 36:16handed cash to a friend in a parking
- 36:18lot.
- 36:20Daniel said gently, "It could all be
- 36:22marital, all of it. And And all marital,
- 36:26then whatever the court thinks about a
- 36:27piece of paper from 2019,
- 36:30we're still just splitting it down the
- 36:32middle. And you'll have spent a million
- 36:34dollars in fees to get where a
- 36:36settlement would have put you in March.
- 36:39Carol still had my hand.
- 36:41Sweetheart, this doesn't have to be
- 36:43ugly. Just tell the lawyer to leave my
- 36:45name out of it.
- 36:47And Meredith took out a single folded
- 36:49page from her coat pocket. So, the
- 36:52folder had come inside after all, just
- 36:55smaller.
- 36:56And put it on my coffee table next to
- 36:58the poinsettia. Withdrawal of the
- 37:00motion, withdrawal of the subpoena, same
- 37:03as before, retyped with a new date.
- 37:07"Sign it," she said, "and the forensic
- 37:09guy never gets deposed, and we do this
- 37:12like a family."
- 37:14I looked at that page for a long time.
- 37:17Then I asked one question.
- 37:19I asked it because Anita had told me
- 37:21that when people are lying in a group,
- 37:24you should never argue with the group.
- 37:26You should ask one of them a question
- 37:28the others have to watch them answer. I
- 37:30said, "Carol, what does the March 14th
- 37:34entry in your 2019 journal say?"
- 37:38Carol's hand went off mine like I'd
- 37:39become hot.
- 37:41"I don't That was 5 years ago."
- 37:44"But you have the journal."
- 37:46"I keep everything by the book," she
- 37:48said too fast, too loud. "I have kept
- 37:51that commission for 26 years, and no one
- 37:54has ever
- 37:55"Mom," Daniel said.
- 37:58And that one syllable was the entire
- 38:01case.
- 38:02Everyone in the room heard it.
- 38:05Meredith closed her eyes for half a
- 38:06second. I stood up. My legs were
- 38:09unsteady.
- 38:11"I want that on the record." I was
- 38:13frightened of these people. I was
- 38:15frightened of what a forensic accountant
- 38:17from Columbus could do to me. And of the
- 38:20medical records, and of a courtroom and
- 38:22of my daughter finding out that her
- 38:24mother had lied for 2 years about the
- 38:27library.
- 38:28But fear is information, not
- 38:31instruction.
- 38:33I said, "I'm not signing anything. Not
- 38:36tonight, not in March. There's a hearing
- 38:38on February 11th and I'll see you
- 38:40there."
- 38:41And then, because I had one card left
- 38:44and this was the moment to turn it face
- 38:46up, I said, "Also, you should tell your
- 38:49forensic accountant to look at the cap
- 38:51file. 16 Buckeye Land Title, page 58.
- 38:56She kept hers."
- 38:58Meredith's head came up like a deer's.
- 39:01Carol said, "Who?"
- 39:04And it was the worst possible thing she
- 39:06could have said, because it wasn't what
- 39:08file, it was who, and who is what you
- 39:12say when the answer is a person you
- 39:15already remember.
- 39:17They left inside of 90 seconds.
- 39:20Daniel took the poinsettia. He actually
- 39:23picked it up off the table and carried
- 39:24it out, and Meredith was saying
- 39:26something sharp to him on the walkway,
- 39:28and Carol got into the white Buick and
- 39:30shut the door, and I heard through two
- 39:33panes of glass my mother-in-law shouting
- 39:36at her son in my driveway. I stood at
- 39:38the window until the tail lights turned
- 39:40onto Van Aiken. Then I sat down on the
- 39:43floor again. I did a lot of my thinking
- 39:45on floors that winter, and I was afraid,
- 39:48honestly and thoroughly afraid, for
- 39:51about an hour. And then the fear turned
- 39:54over into something else, the way it
- 39:56does around 2:00 in the morning, because
- 39:59they had come here to make me stop. And
- 40:02people who are winning do not drive
- 40:04across town in the snow with a
- 40:06poinsettia to make you stop.
- 40:10The evidentiary hearing on the motion to
- 40:12declare the postnuptial agreement void
- 40:15was held on February 11th, 2025
- 40:18in courtroom 5C of the Cuyahoga County
- 40:21Domestic Relations Court before
- 40:24Magistrate Yvette Cardona. It was
- 40:26scheduled for a half day. It went 11
- 40:29minutes past 6. I wore a gray sweater.
- 40:32Anita told me not to wear black, not to
- 40:35wear jewelry, and not to look at Daniel.
- 40:38I looked at him exactly once at the
- 40:41start, and he was wearing the tie I'd
- 40:43given him for his 40th birthday. And I
- 40:46understood that it was a costume choice,
- 40:49and after that, it was easy not to look
- 40:51at him again.
- 40:52Anita called Carol Whittaker first. That
- 40:55was strategy. Take the notary before the
- 40:58husband can hear what she says. Carol
- 41:00was sworn. She sat with her purse in her
- 41:03lap for the first 20 minutes because no
- 41:05one told her to put it down. Anita went
- 41:07slowly. 26 years commissioned. Renewals
- 41:12in 2003, 2008,
- 41:152013,
- 41:172018, 2023.
- 41:20Familiar with the requirement that a
- 41:22signer personally appear.
- 41:25Familiar with the requirement to keep a
- 41:27journal for notarial acts. Yes. Yes.
- 41:32Yes to all of it. And with each yes,
- 41:36Carol grew more confident because she
- 41:38thought the questions were about her
- 41:39competence. Then Anita moved exhibit
- 41:42nine, the journal produced under
- 41:45subpoena, a black-bound book with a
- 41:47marbled cover.
- 41:49Mrs. Whittaker, please read the entry
- 41:51for March 14th, 2019.
- 41:54Carol read it. Claire E. Whittaker,
- 41:57postnuptial agreement, identification,
- 42:01Ohio driver's license, time 10:20 a.m.
- 42:06location, Buckeye Land Title, Mayfield
- 42:09Heights.
- 42:10And in the signer's signature column,
- 42:13her signature.
- 42:14Is that your handwriting or hers?
- 42:17A pause.
- 42:18Hers.
- 42:20Anita moved exhibit 10. The journal
- 42:23pages for March 11th through March 19th,
- 42:26blown up on the courtroom monitor. Then
- 42:29exhibit 11, a report from a forensic
- 42:31document examiner named Dr. Elaine Poth
- 42:34of Columbus, retained by us in November.
- 42:38Dr. Poth's findings were narrow and
- 42:40devastating. Every entry on those nine
- 42:43pages, including the signer signatures,
- 42:46five different alleged signers,
- 42:49showed the same ballpoint ink
- 42:50formulation, the same pen.
- 42:53The line spacing on the March 14th entry
- 42:56was compressed relative to entries above
- 42:58and below it, consistent with an entry
- 43:01inserted after adjacent lines were
- 43:03written. And the Clare E. Whitaker in
- 43:06the signature column was, in her
- 43:08opinion, not written by the same hand as
- 43:12the exemplars.
- 43:14Carol said, "Well, the pen was on the
- 43:17desk. I always use the same pen."
- 43:20For five different signers on five
- 43:23different days?
- 43:25I
- 43:26She looked at the gallery. She looked at
- 43:28Meredith sitting in the second row. The
- 43:30magistrate saw her look. Everyone in
- 43:33that room saw her look. Then Anita moved
- 43:36exhibits 12 through 16, the ProMedica
- 43:39Toledo Hospital surgical record for
- 43:41Robert Feeney, my father, showing an
- 43:44emergency cholecystectomy
- 43:46beginning at 6:42
- 43:48a.m. on March 14th, 2019.
- 43:53The visitor log with my printed name and
- 43:55signature at 6:15 a.m., a parking garage
- 43:58receipt, entry 6:09 a.m., exit 7:51
- 44:03p.m., a photograph timestamped 11:40
- 44:07a.m. with EXIF data
- 44:10and cell site records from my carrier
- 44:12placing my phone in Lucas County
- 44:14continuously from 4:58 a.m. to 8:20 p.m.
- 44:19Anita said, "Mrs. Whittaker, was Clare
- 44:23Whittaker standing in front of you at
- 44:2410:20 in the morning on March 14th, 2019
- 44:27in Mayfield Heights?"
- 44:29Carol Whittaker sat there. Her hands
- 44:31were on her purse
- 44:33and she was 68 years old and she'd been
- 44:35on that stand for an hour and a half and
- 44:38I want to say I felt nothing but I felt
- 44:40something and it wasn't pleasant. She
- 44:43said,
- 44:44"Daniel brought me the signature page."
- 44:46Behind me someone made a sound. Anita
- 44:49didn't move.
- 44:50"He brought you the page?" "He said
- 44:52she'd already signed it at home." "He
- 44:54said she knew." "He said it was easier
- 44:57than making her drive out."
- 44:59Her chin was shaking now.
- 45:01"He's my son. He does the taxes for the
- 45:04whole family. Why would I question?"
- 45:07"Mom." Daniel said out loud from counsel
- 45:10table and the magistrate said, "Mr.
- 45:13Whittaker, one more word and you will be
- 45:16removed."
- 45:18Then Anita moved exhibit 21.
- 45:21The word document metadata from the file
- 45:23attached to a Hallock and Price email in
- 45:26the Buckeye Land Title production.
- 45:28Author M. Whittaker Doyle, created
- 45:32February 26th, 2019, last modified March
- 45:3611th, 2019.
- 45:39And exhibit 22, the same template
- 45:42created April 3rd, 2016, last modified
- 45:46April 19th, 2016. Attached to a
- 45:48different email. File name KEPP_
- 45:53Postnup_V2.docx
- 45:57and then Anita called Rosanne Kepp who
- 46:00had driven herself from Fairview Park in
- 46:02a Buick older than Carol's, and who
- 46:04identified her own 2016 closing file,
- 46:08page 58, and her own signature, and the
- 46:11notary block bearing Carol A.
- 46:14Whittaker's stamp, and who testified
- 46:16that she had never in her life met Carol
- 46:19Whittaker, had never been in a room with
- 46:21her, and would not have recognized her
- 46:24on the street.
- 46:25Gerald Prouse's cross of Rose Ann lasted
- 46:284 minutes, and he should have skipped it
- 46:31because he asked her whether she was
- 46:33being paid, and she said, "Son, I get
- 46:371,100 a month from the school board.
- 46:39Nobody's paying me.
- 46:41I'm here because she was 38 and I was 56
- 46:44and it was the same piece of paper."
- 46:47Daniel took the stand at 4:40 p.m., and
- 46:50he lost it in the first 10 minutes
- 46:52because Anita didn't ask him about the
- 46:54fraud at all. She asked him about
- 46:57February 2018,
- 47:00about a kitchen table, and a legal pad,
- 47:03and a wife who wanted to invest $400 a
- 47:06month.
- 47:07"Did you tell her she'd lose
- 47:09everything?"
- 47:10"That's not That's out of context." "And
- 47:13then, in February 2019, 12 months later,
- 47:17did you commission a document
- 47:19transferring all of her future business
- 47:21interests to yourself?"
- 47:23"It was estate planning."
- 47:25"Whose estate?" He said, "This is
- 47:27absurd. She was a housewife. There was
- 47:30nothing to plan for. I was protecting
- 47:32the practice from" and he stopped
- 47:35because he had just answered the
- 47:37question and he knew it, and the
- 47:39magistrate was writing. Anita sat down.
- 47:43Magistrate Cardona issued her decision
- 47:45on March 6th, 2025,
- 47:4822 pages, and I read it in Anita's
- 47:51office with the door closed. The
- 47:53purported postnuptial agreement dated
- 47:55March 14th, 2019 was declared void ab
- 48:00initio, not voidable.
- 48:02Void, as though it had never existed.
- 48:06She found it unenforceable on four
- 48:08independent grounds and wrote that any
- 48:10one of them would have sufficed. That
- 48:13Ohio law did not authorize postnuptial
- 48:16agreements at the time of execution.
- 48:18That the instrument was procured by
- 48:20fraud in the execution, having been
- 48:23physically incorporated into a mortgage
- 48:25closing package without disclosure.
- 48:28That the recital of independent counsel
- 48:31was knowingly false.
- 48:33And that the notarial certificate was
- 48:35fabricated.
- 48:36Then came the paragraph Anita read out
- 48:39loud twice.
- 48:40The magistrate found by clear and
- 48:42convincing evidence that Daniel J.
- 48:45Whitaker had engaged in financial
- 48:47misconduct within the meaning of RC
- 48:503105.171E4.
- 48:55And further found that the misconduct
- 48:57was neither isolated nor impulsive. But
- 49:00part of a documented method. Evidenced
- 49:03by a substantially identical instrument
- 49:06executed against the spouse of the
- 49:08respondent's former business partner in
- 49:102016.
- 49:12The property division was journalized on
- 49:14June 19th after the court and closing
- 49:17funded in February and the money 68.4
- 49:21million after the initial tax
- 49:23withholding with the rest reserved sat
- 49:26in an escrow account at Fifth Third that
- 49:29neither of us could touch. The court
- 49:31traced the $500.
- 49:34That was Anita's quiet masterpiece and
- 49:36it took a forensic accountant of our own
- 49:39four months. The probate inventory of
- 49:42Ruth Feeney's estate, the executor's
- 49:44check number 1041,
- 49:47my father's deposit slip, the cash
- 49:49withdrawal, the dated stock purchase
- 49:52agreement and Priya's contemporaneous
- 49:54notes.
- 49:55$500 of inherited separate property
- 49:58traceable in a documented chain.
- 50:02The appreciation, the court held, was
- 50:04largely marital because I had labored
- 50:06during the marriage. Daniel's forensic
- 50:09accountant had been right about that.
- 50:11And then the court awarded me a
- 50:13distributive award as a remedy for
- 50:15financial misconduct equal to the value
- 50:19of his entire marital interest in North
- 50:21Light less $600,000.
- 50:25Daniel Whitaker walked out of a $73
- 50:28million marriage with $600,000,
- 50:31the 2016 Honda Pilot, his retirement
- 50:35account, and a judgment for $1,400,000
- 50:39in my attorney and expert fees, which
- 50:42the court ordered paid from his share,
- 50:44leaving him on net under nothing at all.
- 50:48I got the house on Lochmere. I got the
- 50:51shares.
- 50:52I got on the parenting side what I'd
- 50:55asked for from the start and never used
- 50:57as a weapon, shared parenting, week on
- 51:01and week off because whatever he was to
- 51:03me, he was not violent and my children
- 51:06loved him and I was not going to buy
- 51:08their affection with $73 million.
- 51:12Anita told me I was a fool. I told her I
- 51:15had to be able to look at Sophie in 15
- 51:18years. The rest of it was not in my
- 51:20hands and that is the part people forget
- 51:23about consequences. Once you tell the
- 51:25truth to an institution, the institution
- 51:28takes it from you. Magistrate Cardona
- 51:31referred her findings regarding exhibit
- 51:33nine to the Ohio Secretary of State and
- 51:36to the Cuyahoga County Prosecutor's
- 51:38Office. Carol Whitaker's notary
- 51:41commission was revoked in April.
- 51:43In September 2025, she pleaded guilty to
- 51:46one count of notary misconduct and one
- 51:49count of tampering with records and
- 51:51received two years of community control,
- 51:54100 hours of community service, and
- 51:56restitution. She was 69. Her lawyer's
- 52:00whole mitigation argument was that she
- 52:03had trusted her son, which was true and
- 52:06which no one in that courtroom disputed,
- 52:08and which did not save her because the
- 52:10woman in Fairview Park had also trusted
- 52:14someone.
- 52:15Meredith Whittaker was terminated by
- 52:17Halleck and Price 11 days after the
- 52:19February hearing. Once the metadata
- 52:22exhibit circulated, she was not a
- 52:24lawyer, so she could not be disbarred.
- 52:27What happened to her was worse in the
- 52:29practical sense.
- 52:31The firm's malpractice carrier launched
- 52:33an internal review. The supervising
- 52:36partner, who had signed off on the 2016
- 52:38Kepp engagement, retired abruptly and
- 52:42the disciplinary referral to the Board
- 52:44of Professional Conduct named her in the
- 52:46factual findings.
- 52:48In a legal market the size of
- 52:50Cleveland's, a paralegal named in a
- 52:53fraud referral does not get hired again.
- 52:56She took a job doing intake at a title
- 52:58agency in Parma for $22 an hour. Daniel
- 53:02surrendered his CPA license in November
- 53:052025
- 53:07rather than face the Accountancy Board
- 53:09of Ohio, which had opened a case on
- 53:11referral within a month of the
- 53:13magistrate's decision.
- 53:15His practice's clients, most of whom
- 53:17he'd inherited from Thomas Kepp, left
- 53:20inside a quarter. He kept two, his
- 53:23mother and himself.
- 53:25I was in the courtroom for exactly one
- 53:27of these things, the sentencing, and I
- 53:29sat in the back and I did not speak. And
- 53:32afterward Carol turned around in the
- 53:34aisle and looked at me and I did not
- 53:36look away.
- 53:37She said, "You could have stopped this."
- 53:40And I said the only true thing I had. So
- 53:44could you in 2016.
- 53:47Do you know what surprised me most? Not
- 53:50that I won.
- 53:51That winning felt so little like a
- 53:53celebration and so much like a door
- 53:56closing quietly in an empty building.
- 53:59There was no scene where I told him what
- 54:01I thought of him.
- 54:02There was a wire transfer confirmation
- 54:04on a Thursday morning and a notarized
- 54:06signature see from a notary at a credit
- 54:09union in Beachwood. A stranger, $5, who
- 54:14asked me for my driver's license and
- 54:16looked at my face and checked it against
- 54:17the photograph. I paid the $5 in cash. I
- 54:21cried in my car for a while afterward
- 54:24and I honestly could not have told you
- 54:25why.
- 54:26It is September 2026 now and the thing
- 54:29the money actually bought was an
- 54:31ordinary Tuesday.
- 54:33I still live in Ohio.
- 54:34People assumed I'd go somewhere with
- 54:36palm trees. I sold the Larchmere house
- 54:39after a year.
- 54:40You cannot heal in a room where you sat
- 54:42on the floor and bought a place in Rocky
- 54:45River with morning light in the kitchen
- 54:47and a mudroom big enough for two
- 54:49teenagers worth of shoes.
- 54:51I drive a used Volvo I purchased in my
- 54:53own name and I have the title in my own
- 54:56filing cabinet and I'm aware how strange
- 54:59it is that a woman with this much money
- 55:01gets emotional about a certificate of
- 55:03title.
- 55:04But I do.
- 55:05Sophie is 15 and runs cross country and
- 55:08is furious with me roughly 40% of the
- 55:11time, which our therapist says is
- 55:14developmentally correct.
- 55:16Ben is 12 and intends to be a marine
- 55:18biologist in a state with no ocean.
- 55:21They're at their father's every other
- 55:22week, a two-bedroom above a dry cleaner
- 55:25in Mayfield Heights.
- 55:27They say it's fine. I don't ask more.
- 55:30Last spring Sophie asked me in the car
- 55:32whether it was true that Grandma Carol
- 55:33went to court because of me.
- 55:35I told her the whole thing plainly in a
- 55:38Speedway parking lot for 40 minutes. She
- 55:40didn't say much. Two weeks later, she
- 55:43asked me to show her how to read a
- 55:44closing document. We did it at the
- 55:46kitchen table with a legal pad, which is
- 55:49a sentence I still can't write without
- 55:51stopping.
- 55:52I gave a great deal of it away on
- 55:53purpose. The Ruth Feeney Fund at the
- 55:56Cleveland Foundation, 22 million, does
- 55:59one narrow thing. It pays for
- 56:02independent counsel and forensic
- 56:03accounting for women divorcing a
- 56:06financially controlling spouse. Anita
- 56:09chairs the committee. Roseanne Kemp sits
- 56:12on it. 91 cases in 14 months. I joined
- 56:16Northlight's board, Priya still runs it,
- 56:19and take a director's fee of 40,000 a
- 56:22year, which I like better than the 73
- 56:24million because I earn it hourly, like a
- 56:27person.
- 56:28I've been seeing a man named Owen who
- 56:30teaches Earth Science in Bay Village. I
- 56:33told him about the money on the fourth
- 56:34date. We keep separate accounts. Carol
- 56:37lost the house on Winchell Road to a
- 56:39home equity line she took out for
- 56:41Daniel's legal fees. She's 70 in a
- 56:44rental in Parma and still tells people
- 56:46at church that I ruined her family.
- 56:49Meredith does intake at a title agency
- 56:51for $22 an hour. She's been passed over
- 56:54twice and her marriage ended last
- 56:57spring.
- 56:58Daniel prepares seasonal returns at a
- 57:00storefront with a neon sign and keeps
- 57:03books for two restaurants and a
- 57:05landscaper. A man who was once the only
- 57:07one in the room who understood the
- 57:09numbers now types other people's
- 57:11receipts into QuickBooks.
- 57:13He emailed me once asking about tuition
- 57:16for Meredith's daughter and what the
- 57:18funds money could do for actual family.
- 57:22I forwarded it to Anita and never
- 57:24answered. One Saturday in July, standing
- 57:27in my kitchen with wet hair, something
- 57:29burning on the stove, I realized I
- 57:32hadn't thought about Daniel Whitaker in
- 57:349 days. That was the victory, not the
- 57:38wire transfer. So, here is what I
- 57:40learned. A man who says you'll lose
- 57:43everything is sometimes describing his
- 57:45own plan. Read what you sign. Every
- 57:49page, even page 61, even when someone
- 57:52you love says just keep one account, one
- 57:56card, one thing that is only yours. And
- 58:00know that the truth doesn't need to be
- 58:02loud. It only needs to be documented.
- 58:05$500 didn't save me. A hospital parking
- 58:08receipt did. Now, let me ask you, if you
- 58:11found that page in your own closing
- 58:13file,
- 58:14would you sign the settlement, or would
- 58:16you go to court? Tell me in the
- 58:18comments. Subscribe if this story meant
- 58:21something to you. And thank you
