  1. 0:00well folks the Supreme Court has now
  2. 0:01decided that affirmative action is no
  3. 0:03longer legal for use in college
  4. 0:04admissions and this has ticked off all
  5. 0:06the right people including Al Sharpton
  6. 0:08and Whoopi Goldberg our nation's great
  7. 0:09intellectual luminaries I think some of
  8. 0:11my favorite
  9. 0:12response here comes from the president
  10. 0:13of Colombia so the president of Columbia
  11. 0:15Lee Bollinger he says test scores are
  12. 0:18discrimination you knew they were going
  13. 0:19in this direction right that if you
  14. 0:20score poorly on a test this is because
  15. 0:22of racism not because maybe you're not
  16. 0:24as smart as the guy down the hall who
  17. 0:26scored 300 points higher
  18. 0:28so we know that standardized test scores
  19. 0:32were introduced
  20. 0:34many decades ago
  21. 0:36with the idea that they would help
  22. 0:39achieve a quality of opportunity for
  23. 0:43students all across the country
  24. 0:46um
  25. 0:47It wouldn't connect wouldn't depend upon
  26. 0:49connections and wealth of your family
  27. 0:52Etc you could take the test and if you
  28. 0:54did better than people who were well
  29. 0:57connected and Wealthy you could get in
  30. 1:00so that was the idea of standardized
  31. 1:02tests
  32. 1:03increasingly in the past decade or so
  33. 1:07it's become fairly clear to everybody
  34. 1:09that standardized test scores are a way
  35. 1:12of reinforcing inequality rather than
  36. 1:15overcoming
  37. 1:16and so I have a question why are they
  38. 1:18reinforcing inequality as Ballinger says
  39. 1:20the entire design of a test is that it
  40. 1:21is colorblind it is literally a question
  41. 1:23and you answer the question and then you
  42. 1:24get a score so why is it that they have
  43. 1:26um become now racist when they were not
  44. 1:28racist to begin the answer is people are
  45. 1:30underperforming
  46. 1:31people aren't performing based on race
  47. 1:34and it's not because they're black it is
  48. 1:36because of all the other things that no
  49. 1:38one wants to actually fix because people
  50. 1:39on the left don't give a damn about
  51. 1:40fixing the problem all they want to do
  52. 1:42is about how terrible America is and how
  53. 1:43racist it is because that is how they
  54. 1:45gain votes because it turns out you know
  55. 1:46it's a real easy sell to people it's not
  56. 1:48your fault it's America's fault that's a
  57. 1:49super easy sell to people you know it's
  58. 1:51a hard sell maybe we ought to break the
  59. 1:53teachers unions maybe you want to fix
  60. 1:54our Public Schools maybe we want to give
  61. 1:55more local control to parents maybe we
  62. 1:57ought to teach kids reading writing and
  63. 1:58arithmetic as opposed to garbage
  64. 2:01CRT critical race Theory
  65. 2:03maybe you should do all those things
  66. 2:05they don't want to do all those things
  67. 2:06that is their agenda their agenda
  68. 2:07matters more than the result and when
  69. 2:08the result is ugly they blame the test
  70. 2:10score blame the metric this is like
  71. 2:12deliberately stunting the growth of an
  72. 2:14entire population by undernourishing
  73. 2:16them and then when you find out that
  74. 2:17everybody is five inches shorter than
  75. 2:18they otherwise would have been you're
  76. 2:19like you know I hate rulers rulers are
  77. 2:21bad
  78. 2:22I really hate tape measures those tape
  79. 2:24measures are racist
  80. 2:25well maybe it's not the tape measure
  81. 2:26that's racist maybe it's you because
  82. 2:28you're the ones who are pursuing these
  83. 2:30garbage policies
  84. 2:32and then the Columbia president again
  85. 2:33it's amazing he lit they're literally
  86. 2:35saying the things that will then be used
  87. 2:36in appellate court to challenge their
  88. 2:38own policies here's Lee Ballinger saying
  89. 2:40a thing that is not legal he says we
  90. 2:42have to use affirmative action to
  91. 2:43correct for past discrimination that is
  92. 2:45literally against the opinion of the
  93. 2:47Court here he is
  94. 2:49Brown versus Board of Education was a
  95. 2:52great moment in American history uh
  96. 2:55declaring that the 14th amendment
  97. 2:57required equal protection and not
  98. 2:59separate but equal schooling than other
  99. 3:01programs
  100. 3:02uh in the United States and set off the
  101. 3:05Civil Rights uh era that was a great
  102. 3:08moment
  103. 3:09but that was only about stopping racial
  104. 3:13discrimination any kind of effort to
  105. 3:17overcome the effects of racial
  106. 3:19discrimination are not allowed in his
  107. 3:22View
  108. 3:23to justices Jackson and Sotomayor this
  109. 3:26is and Thurgood Marshall in the Baki
  110. 3:28case this is wrong thinking that we've
  111. 3:32had several hundred years of
  112. 3:34discrimination against African Americans
  113. 3:36in particular
  114. 3:38and we must as a society find means to
  115. 3:41try to correct for that because they're
  116. 3:43ongoing they haven't stopped so we have
  117. 3:45to grade people by race
  118. 3:46good luck with this one Colombia's
  119. 3:49admissions policy comes up for I'm sure
  120. 3:50judicial review inside the next year or
  121. 3:52so meanwhile the president of the
  122. 3:54National Education Association Rebecca
  123. 3:55Pringle of course she doesn't want to
  124. 3:57actually discuss the actual problems in
  125. 3:58education she's just again going to say
  126. 4:00America's racist that's why there's a
  127. 4:01disparity not because you the head of
  128. 4:03the Nea one of the worst unions in
  129. 4:04America is responsible for the garbage
  130. 4:06education that black kids are receiving
  131. 4:07across the country
  132. 4:09what do you think about this Becky how
  133. 4:12much of an uphill climb is it now if
  134. 4:14this affirmative action program goes
  135. 4:17away from the University to actually
  136. 4:20have a diverse student body and every
  137. 4:22sense of that word diversity
  138. 4:26so just like your other panelists have
  139. 4:28said already the headline for today is
  140. 4:30access and opportunity denied as John
  141. 4:34just said we know that we are stronger
  142. 4:37our schools are stronger our communities
  143. 4:38are stronger our country is stronger
  144. 4:41when we have spaces that reflect all of
  145. 4:45the diversity of this country it's what
  146. 4:47makes us strong and today's decision is
  147. 4:50taking us backwards yes judging people
  148. 4:54based on race that's taking us forward
  149. 4:56saying that we should not judge people
  150. 4:58based on race that takes us backward
  151. 5:00amazing amazing stuff let's talk about

  226. 7:07code Ben members of the media doing the
  227. 7:09same sort of routine Al Sharpton who
  228. 7:12again I have no idea why this person is
  229. 7:13a respected member of the media when
  230. 7:15he's one of the worst race baiters in
  231. 7:16American history one of the most
  232. 7:17nefarious racial forces in American
  233. 7:19modern history here is talking about how
  234. 7:21to dagger in the back
  235. 7:24what has gone through your mind in terms
  236. 7:26of how you believe this will affect
  237. 7:28specifically the African-American
  238. 7:30community
  239. 7:31well I think uh that this is tantamount
  240. 7:34to sticking a dagger in our back because
  241. 7:37what they have said now is that it is
  242. 7:41unconstitutional to even considerates
  243. 7:44and given the racial history of the
  244. 7:47country let's not act like blacks are
  245. 7:50behind because there's something in our
  246. 7:53genes that made us behind it was against
  247. 7:56the law for us to even read and write
  248. 7:59until 160 years ago
  249. 8:03okay you notice where it says 160 years
  250. 8:04ago
  251. 8:06that's 160 years ago my friend
  252. 8:08and um and so the idea that blacks have
  253. 8:11not been reading and writing for you
  254. 8:13know almost two centuries is what he's
  255. 8:14saying right there uh and then that's
  256. 8:16why the disparities exist today weird
  257. 8:18because you know what happened with say
  258. 8:20Asian populations that came over here
  259. 8:21they didn't speak English and now
  260. 8:23they're destroying these tests how about
  261. 8:25Jewish populations who when they first
  262. 8:26arrived in the United States in the
  263. 8:27early 20th century were actually
  264. 8:29considered low IQ because they couldn't
  265. 8:30read English
  266. 8:31and now they are performing about one
  267. 8:34standard deviation Ashkenazi Jews
  268. 8:35performed about one standard deviation
  269. 8:36above other people on IQ test is that
  270. 8:38because of racial and inequality and
  271. 8:41inequity or is it because people learn
  272. 8:43to read and write in other words
  273. 8:45discrimination of the past and evils of
  274. 8:47the past are rectifiable but only by
  275. 8:49individuals who actually go and do the
  276. 8:51work to overcome those objections
  277. 8:55this notion that people are failing
  278. 8:56today in 2023 when it is literally
  279. 8:59illegal for black people to be
  280. 9:01discriminated against in the United
  281. 9:02States
  282. 9:03that the failure is because people
  283. 9:04couldn't read and write 160 years ago
  284. 9:07that it's it's so it's it's so pathetic
  285. 9:10on every possible score it's it's not
  286. 9:12true and it's pathetic perhaps the best
  287. 9:15media moment of the day yesterday is one
  288. 9:16of the one of the plaintiffs in this
  289. 9:18case is an Asian student who was on with
  290. 9:20Abby Phillip and he just wrecks her Abby
  291. 9:22Philip is trying to make the case that
  292. 9:23um it would be better if uh if this
  293. 9:25Asian student weren't able to get into
  294. 9:26an institution of higher education
  295. 9:28despite scoring really high in the SATs
  296. 9:29and he's like uh no
  297. 9:31because of affirmative action black
  298. 9:34Americans graduate from law school at
  299. 9:36the bottom 25 percent of their classes
  300. 9:37largely speaking and we we don't want
  301. 9:40that we want black students to succeed
  302. 9:42we want every student to succeed
  303. 9:44low-income students to succeed but you
  304. 9:47have to put them in scenarios in places
  305. 9:49where they are likely to succeed and
  306. 9:51lowering your standard to admit somebody
  307. 9:53of a socioeconomic status or race uh
  308. 9:56would not help them do that in fact it
  309. 9:58would harm their graduation rate and
  310. 9:59Excellence well as the case also points
  311. 10:03out the standard isn't necessarily
  312. 10:05lowered because the its students are all
  313. 10:07admitted it's the question is whether
  314. 10:08race can be an added consideration
  315. 10:11a Tipping Point
  316. 10:15the standard is lowered as the Superman
  317. 10:18admissions data shows and Asian has to
  318. 10:20score 273 points higher on the SAT to
  319. 10:22have the same chance of admission as a
  320. 10:24black person so the standard is lowered
  321. 10:25for black Americans
  322. 10:27oops
  323. 10:28and you're just not going to get around
  324. 10:30that but apparently that's okay because
  325. 10:31that Asian guy after all he's Asian he's
  326. 10:33in Black so if he if he has to suffer
  327. 10:35according to the left well you know that
  328. 10:37was just that was just the brakes that
  329. 10:38was just the brakes and then presumably
  330. 10:40a generation from now then we can you
  331. 10:42know do some affirmative action for
  332. 10:43Asian people or something the
  333. 10:45never-ending Carousel of racial
  334. 10:46discrimination will continue forever and
  335. 10:48it'll just be awesome
  336. 10:50final take goes to uh Whoopi Goldberg
  337. 10:53who uh comes up with the dumbest
  338. 10:55possible answer here she says will this
  339. 10:58lead to no women in colleges I don't
  340. 10:59even know how she I don't even know how
  341. 11:00she gets here and Whoopi Goldberg that
  342. 11:02is it that is a mind upon which
  343. 11:04inspiration Springs
  344. 11:06my goodness when you have a Justice who
  345. 11:08says something as ridiculous as I don't
  346. 11:10get it right it just makes a kid an
  347. 11:13Asian kid a Native American kid a black
  348. 11:15kid feel like you don't matter right
  349. 11:17like you didn't you don't understand why
  350. 11:19my struggle is hard or your struggle or
  351. 11:22your struggle you know is this leading
  352. 11:25to no women in colleges soon is this
  353. 11:27leading to no women in college yes
  354. 11:29nailed it will be women constitute a
  355. 11:31majority of current college and grad
  356. 11:33school enrollees by the way a sheer
  357. 11:35majority yeah nailed it would be as as
  358. 11:37per our usual Arrangement probably we
  359. 11:39should put her on the Supreme Court
  360. 11:40honestly she can't write an opinion any
  361. 11:41worse than katanji brown Jackson did
  362. 11:42alrighty coming up we are going to be
