- 1:57for the medical examiner's office,
- 1:58Volusia County, Uh Daytona Beach.
- 2:00And how long have you been employed with
- 2:02the medical examiner's office?
- 2:03For 5 years.
- 2:04Could you describe to the ladies and
- 2:06gentlemen of the jury some of the duties
- 2:07that you have as an investigator for the
- 2:09medical examiner's office?

- 2:24uh of of a death
- 2:26that occurs within Volusia County that

- 2:32means.

- 2:47police agency, whatever whoever it is,
- 2:49and then we determine uh from the phone
- 2:51call whether or not we will respond to
- 2:52the scene, investigate the scene along
- 2:54with the police agency to determine the
- 2:56manner and cause of death.
- 2:58Were you on duty on December 13th, 1989?

- 3:02And during the course
- 3:02He seems very cool, calm, and collected.
- 3:05and assist the police in the reclamation
- 3:07of a body that was found in the Ormond
- 3:09Beach area, Volusia County?

- 5:25saw it on December the 13th, 1989?

- 5:37the scene as you observed it for the
- 5:38first time
- 5:40That Monopoly man mustache.
- 5:43of the human remains when you arrived?

- 6:00observed it when you arrived on
- 6:01September 13th?
- 6:03Okay. Um
- 6:04the scene was a wooded area off of uh
- 6:08US1, approximately 1/2 of a mile north
- 6:11of uh I-95 um in Volusia County.
- 6:16It was um
- 6:18off of the southbound side and there is
- 6:20a trail which um is represented by this
- 6:24photo that we that we showed here and
- 6:26this is quite relatively accurate as
- 6:28objection to the publication at this
- 6:31time. You're not showing the picture.
- 6:32Okay.
- 6:33Well, then describe what you observed.
- 6:34Okay.
- 6:35There was a trail leading off into the
- 6:36woods, which was the first thing I saw.
- 6:39From the road.
- 6:39Okay. Yeah, that's fair.
- 6:40What if anything did you see after
- 6:42making those initial observations?
- 6:45Well, I met with the the sheriff's
- 6:46deputies that were there and they told
- 6:47me that uh you know, you had to follow
- 6:49the trail back in for a short ways and
- 6:51that uh that's where the the body was
- 6:53that they had reported to me over the
- 6:55phone.
- 6:55Did you see anyone there other than law
- 6:56enforcement officials at that time?
- 7:00Uh
- 7:02and upon my initial response um
- 7:04When you When you When you arrived
- 7:05When I arrived there initially
- 7:07I'm not absolutely positive. There was
- 7:08some news media there later, but I don't
- 7:09know when I got there at what point they
- 7:11they arrived.
- 7:12Okay, sir. But in relationship to where
- 7:13the body was, were they in the immediate
- 7:15area?
- 7:15No. No, just up by the roadway. There
- 7:16there was a um
- 7:19line placed across the uh entrance and
- 7:21they weren't allowed to pass.
- 7:22What do you mean by a line?
- 7:24Uh just a crime scene line uh
- 7:26you know, either
- 7:28um
- 7:29just mark it so nobody could go past
- 7:31this particular point.
- 7:32Was that to keep unauthorized personnel
- 7:33from coming in contaminating a possible
- 7:35scene?
- 7:35Yeah, that's correct.

- 7:52you fairly and accurately depict what

- 7:59location where the body was in
- 8:00relationship to anything
- 8:02in the way of a covering?

- 8:10Uh when I arrived, there was a
- 8:12He's like, I don't know what they want
- 8:14from me.
- 8:15in the natural foliage
- 8:17that was covered by a um maroon with a
- 8:20black trim
- 8:22rug, the type that you see in front of a
- 8:23business, the type that they take on and
- 8:25off in uh and clean in the back of front
- 8:27of a business. It was a good size rug,
- 8:29and it almost completely covered
- 8:31uh
- 8:32the body that was eventually um removed
- 8:34from underneath the rug.
- 8:36Uh at this time, Your Honor, the state
- 8:38would offer equipment previously marked
- 8:39as exhibits
- 8:41in evidence.
- 8:48Yeah, that's

- 10:53And what was previously admitted as
- 10:54state's eight one in evidence.
- 10:56Was that the condition of
- 10:58the scene when you first arrived?
- 11:00I want to know what his him as a lawyer.
- 11:03Cuz he seems to be doing a lot.

- 11:59And there are subsequent to the
- 12:03rug being

- 12:08she did since she was four.
- 12:12I I believe it was in
- 12:13combination of the body and the rug
- 12:15itself.
- 12:16So the
- 12:17That's not old to be
- 12:19no longer here.
- 12:20of who actually removed the rug at this
- 12:22point. No.
- 12:22Okay. Were you present when the
- 12:23Yes, I was.
- 12:24And you document the condition of the
- 12:26body as you saw it
- 12:28while while the rug was being removed
- 12:30and subsequent to the rug being removed?
- 12:32Yes, I I took photographs at every
- 12:34stage.
- 12:34What was the condition of the body when
- 12:36you first observed it after the rug had
- 12:38been removed from it?
- 12:40Uh
- 12:40In which way was the face
- 12:42in relationship with the ground?
- 12:44It was laying uh
- 12:45face down on the ground.
- 12:47Is that represented fairly in State's 10
- 12:50for identification?
- 12:52Well, when we first removed the rug,
- 12:54there was either one or two cardboard
- 12:58pieces of cardboard that were laying
- 12:59over the cross of the top of the back,
- 13:01which is represented right in here the
- 13:03when they were removed. But after they
- 13:05were removed, this accurately represents
- 13:07the position of the body. The body was
- 13:08not moved, just the things that were on
- 13:10top of it.
- 13:11So we put the positioning of the body as
- 13:13you observed it after those articles
- 13:14were disposed, is this a fair and
- 13:15accurate representation?
- 13:16That is correct, yes.
- 13:18Now, did it come a point in time
- 13:21Judge may we publish these at this time
- 13:23to the
- 13:23Yes, sir.
- 13:25Those are admitted in evidence.

- 13:33was admitted by the court.

- 14:17to removal of the body and what you
- 14:18observed?

- 14:25The standard procedure in this and what
- 14:27we did in this particular situation was
- 14:28is that we lay a sheet on the ground
- 14:32alongside of the body.
- 14:34And it
- 14:36it was rolled over or picked up and set
- 14:38down over onto the sheet.
- 14:40have so many This is not anything to do
- 14:42with anything, but he has so many rings
- 14:44on.
- 14:46What are these rings? So, obviously
- 14:47one's a wedding ring and what's the
- 14:48other?
- 14:49white t-shirt and a cordovan type maroon
- 14:53shoes, leather type shoes, and
- 14:55blue socks.
- 14:56Describe whether or not the body had a
- 14:58belt buckle on.
- 15:00A belt, excuse me.
- 15:03The um
- 15:06Yeah, look at the pictures.
- 15:07was a brown leather belt.
- 15:08What was the condition of the
- 15:09individual's pants?
- 15:12They were um
- 15:14Okay, go eat dinner, friend.
- 15:16Go and enjoy your dinner. I'm just
- 15:18watching a court case about the murderer
- 15:20who is long gone now.
- 15:22um the pockets of the were turned inside
- 15:24out
- 15:26So that I'm interested, so.
- 15:29Yes.
- 15:30That was immediately upon the body being
- 15:31turned over?
- 15:32Yes. Yes, sir.
- 15:34How about the individual zipper? Did you
- 15:35look at it at that time?
- 15:39No, I didn't I didn't observe that, no.
- 15:41Was anything done to disturb in any way
- 15:44the individual's clothing
- 15:46as you removed the body?
- 15:47No.
- 15:49Those photographs states Q, states L,
- 15:51and states E5 fairly inaccurately depict
- 15:54the body as you first observed it in the
- 15:56downward position and then after it was
- 15:58rolled over
- 15:59into the upper position.
- 16:01Yes, sir, they do.
- 16:02And that do they fairly accurately
- 16:04depict the condition of the pants, the
- 16:06shirt,
- 16:07and the belt, as well as the zipper that
- 16:09is contained in the photograph?
- 16:11So.
- 16:11Yes, sir, they do.
- 16:13Now, what if anything did you do
- 16:15with the individual that you found at
- 16:18the scene on that day?
- 16:20What is the next procedure?
- 16:22Uh
- 16:23we then place a um
- 16:25body bag that we use for removal
- 16:28and the sheet is wrapped around the body
- 16:31and then the body in the sheet is placed
- 16:33into the body bag and the zipper is
- 16:35placed closed on it for the removal,
- 16:38which we did at this at this scene.
- 16:40And now once the body is removed, where
- 16:41does it go?
- 16:45Normally we take it to Halifax Hospital.
- 16:48The medical examiner is a lot more
- 16:50consistent with his answers than the
- 16:52officer.
- 16:53Due to the advanced state of the
- 16:55decomposition in this particular case,
- 16:57we have rules with Halifax that we
- 16:59couldn't do that, so it was removed and
- 17:00placed in the cooler at Bellevue Cedar
- 17:02Hill Funeral Home for the night.
- 17:04And did you attend the autopsy in regard
- 17:06to the remains that were found at the
- 17:08scene on December the 13th, '89, the
- 17:11following day?
- 17:11The following day, yes, sir, I did.
- 17:13Let me show you, sir, what is marked for
- 17:14exhibit purposes as states M1 through 4.
- 17:17May I approach, sir?

- 17:27Sir, do you recognize those photographs?
- 17:29Yes, I do.
- 17:30Are those photographs fair and accurate
- 17:32representations of the remains that were
- 17:35removed from the scene on December 13th,
- 17:371989 to the medical examiner's office
- 17:39for autopsying purposes on December the
- 17:4114th, 1989?
- 17:42Yes, they are.
- 17:43I feel like these are all the
- 17:45It is.
- 17:46Are they fair and accurate
- 17:47representations
- 17:48prosecution's star witnesses.
- 17:49of the autopsy procedures themselves
- 17:51beginning?
- 17:51Yes.
- 17:51I'm I'm always interested in hearing how
- 17:54they respond to the opposition because
- 17:56that's really where you get a lot of
- 17:58what their personality is.
- 18:00Are they still in substantially the same
- 18:02condition as they were when you first
- 18:03saw them at the scene on December the
- 18:0513th, 1989?
- 18:06Yes, that's exactly the same way they
- 18:08were.
- 18:08Were they not disturbed or removed in
- 18:09any
- 18:10No, sir, they were not.
- 18:14Now, can you describe, sir, what if any
- 18:16procedure would have followed by the
- 18:17medical examiner's office
- 18:20in regard to Mr. Mr. Mallory's
- 18:25From the from this point here?
- 18:26Yes, sir.
- 18:27Okay, we would um
- 18:32uh Dr. Boning, the medical examiner at
- 18:34that time, would have uh
- 18:36instructed us uh after these photographs
- 18:39were taken uh to remove the clothing.
- 18:42Uh which was done and um
- 18:47Well, it was taken in
- 18:48uh sections. The first thing to have
- 18:50been removed in this case would have
- 18:51been the shirt.
- 18:55By the shirt.
- 18:55Do you know what if anything was done
- 18:56with the shirt?
- 18:57By the shirt.
- 18:58It was uh placed into a uh paper bag.
- 19:02It was and mark the bag was marked and
- 19:04sealed.
- 19:06Uh and all of the clothing at the uh at
- 19:08the end of the autopsy was turned over
- 19:10to the Volusia County Sheriff's
- 19:11Department.
- 19:13Are you familiar with investigator Law?
- 19:15Yes, sir.
- 19:15Do you know whether or not you turned
- 19:16the bag over to him?
- 19:17Yeah, everything everything all the
- 19:18evidence in this case was turned over to
- 19:19Jim Law.
- 19:22I don't really understand what his
- 19:24purpose is, like what he's showing for
- 19:26the prosecution other than yes, this man
- 19:29is dead, which we knew.
- 19:31The shirt, the pants, the shoes, and the
- 19:32socks were all turned over to Jim Law on
- 19:35that day 12 14 of 89.
- 19:39Now, were you present at the room in the
- 19:40old hospital?
- 19:41Yes, sir, I was.
- 19:42And during the course of that autopsy,
- 19:43were the victim's hands removed for
- 19:45fingerprint identification purposes?
- 19:46Yes, they were.
- 19:47And whose hand and to whom did you give
- 19:50those hands?
- 19:51Uh I released them also to investigator
- 19:53Jim Law.
- 19:54And subsequent to
- 19:56Do we see Jim Law in this?
- 19:59given back to your office as to the
- 20:00identity of the victim, Mr. Mallory?
- 20:02Yes, they were.
- 20:03And was his death certified by the
- 20:04medical examiner's office?

- 22:19How was it that you knew
- 22:21this woman that you described as Aileen
- 22:24Carol Wuornos with the aliases that you
- 22:26you told us about?

- 23:03And I I worked quite a bit and she

- 31:11history's first female serial killer is
- 31:14macabre enough, even without its
- 31:16supporting cast of characters.

- 31:43mother.
- 31:44She befriended Lee after her arrest and

- 37:12Her case wasn't helped by the more
- 37:15now very much her ex-lover turned star
- 37:18witness for the prosecution.
- 37:20She was a star witness.
- 37:22wanted her to. She lied to you.

- 37:26But it gets worse. Tyria had another
- 37:29deal going with the arresting police.
- 37:31They were trying to sell Hollywood the
- 37:33movie rights to Aileen Wuornos's life
- 37:36and crazy times.
- 37:38Why did you lie to her about those
- 37:41numbers?

- 37:43Cuz I wanted her to keep talking
- 37:45about the offenses so I would be
- 37:47cleared.
- 37:48District Attorney Rick Ridgeway is one
- 37:50of the only
- 37:51She [ __ ] her over, which I mean, she
- 37:53did murder people.
- 37:55The police said
- 37:56that, but damn.
- 37:59There was a tremendous amount of
- 38:02Selling the rights to her story?
- 38:04On her story.
- 38:06A scoop on the next guy about the case,
- 38:09and there were so many people who were
- 38:12willing to pander to that in an order to
- 38:15be the one who gets quoted or who gets
- 38:17the movie made about them.
- 38:18People from your own sheriff's office?
- 38:20Well, unfortunately, yes, they did.
- 38:23As the prosecutor,
- 38:25were you dismayed by that?
- 38:27Well, to put it mildly, we went through
- 38:29the roof when we found out about it.
- 38:32Oh, really?
- 38:34In the end, it was only the producers of
- 38:36this American TV movie who were able to
- 38:38cash in on Lee's story. Tyrie
- 38:41They did eventually make a movie about
- 38:43her.
- 38:43get rich quick came to nothing once they
- 38:45were caught.
- 38:48But, that hasn't stopped Lee Werners
- 38:50suspecting that someone, somewhere,
- 38:53wants to exploit her name.
- 38:56Yeah.
- 38:56making me get
- 38:58bitter,
- 38:59evil, angry I've never been before in my
- 39:02life.
- 39:03Wow.
- 39:04even out there with those men.
- 39:06This is evil what those people have done
- 39:08to me.
- 39:09Do you feel anger or even hatred towards
- 39:12men?
- 39:12I never hated men,
- 39:14but now I do.

- 39:16They're all I have a category.

- 39:37The final twist in this already mad tale
- 39:41was when Lee Werners decided to plead no
- 39:44contest to the remaining six murder
- 39:46charges.
- 39:48you in case number 91-463
- 39:51to death for the murder of Troy Burris.
- 39:54Her lawyer, Steve Glazer, found himself
- 39:56in the bizarre position of helping his
- 39:59client take the express route to the
- 40:02electric chair.
- 40:03And
- 40:04I sentence you to death for the murder
- 40:05of David Spears.
- 40:07I think she was ready, though.

- 40:43what people were saying about her. And
- 40:44she knows if she goes to go to trial
- 40:46five more times,

- 40:48she's going to be in the for the next 10
- 40:50years.
- 40:50Do you still believe she was competent
- 40:52to make that decision?
- 40:53Without a doubt.
- 40:55Okay, there will be an automatic appeal.
- 40:57You have the right to an appeal. Mr.
- 40:58Glazer, is that going to be handled by
- 41:00you or the
- 41:00and your wife and kids get raped.
- 41:02I would ask that you would appoint

- 41:06I'll appoint the public defender's
- 41:07office to handle the appeal. There's one
- 41:10other thing that I want to say that I
- 41:11think needs to be said.
- 41:13I know I was raped. You ain't nothing

- 41:16Therefore, these proceedings are now
- 41:17complete.
- 41:17Putting somebody who was raped to death
- 41:24Do you still want the chair?

- 41:32when I don't deserve to be tormented.

- 42:30that no human being had the right to
- 42:32tell another human being what to do with
- 42:33their life.

- 42:36True. Okay, okay, friend. Do what you
- 42:38got to do. I'm just going to watch a
- 42:39couple more of these and then I'm going
- 42:40to bed.
- 42:44Not the three heart attacks he's
- 42:46suffered since taking on this case.
- 42:49Nor the criticism he's endured for
- 42:51seeking Aileen Wuornos' execution.
- 42:53They're making him look like a bad
- 42:55lawyer.
- 43:01Has this case been good for your career?
- 43:04I don't understand.
- 43:05But that's life, you know, you take a
- 43:07deal a deal life goes on you try
- 43:08something else.
- 43:09Is there anyone in this cast of
- 43:11characters who isn't a little bit crazy,

- 43:18Steve Glazer has done his job. Aileen
- 43:20Wuornos could be executed in this chair
- 43:24within 3 years.
- 43:26She's waived her right to appeal.
- 43:29If he hears no last minute stays from
- 43:30the governor's office,
- 43:32the electrode then is placed on top of
- 43:34the inmate's head.
- 43:36It's an actual
- 43:36They ended up doing
- 43:38uh
- 43:39lethal injection.
- 43:41One of these electrodes here is then
- 43:44fastened onto the top of the headpiece.
- 43:47Ouch.
- 43:49Alone and lost in her own nightmare,
- 43:52Aileen Wuornos is an American horror
- 43:55story.
- 43:56Wow.
- 43:56She could escape death row, but her
- 43:58bitterness and hate will see Lee become
- 44:01the first woman in over a century to be
- 44:04executed in Florida.

- 46:40beginning, did you know that you were
- 46:42going to kill them?
- 46:44When they picked you up in their cars?

- 46:51selected that they were going to die.
- 46:53But, when you're saying that um
- 46:58there was no self-defense.

- 47:38I was a homeless person all my life. And
- 47:40then the hitchhiking hooking I learned
- 47:41off the homelessness and and cruising
- 47:44all over the United States of America
- 47:45and stuff.
- 47:46And so, learning how to be a hooker as a
- 47:49hitchhiker
- 47:50Right.
- 47:51eventually got tiring at in the end. I
- 47:54carried the gun for a protection, but
- 47:56then I got
- 47:57where I was getting a real problem and
- 47:59our rent was
- 48:00due, $1,200 behind. Tyra was doing a lot
- 48:04of beer drinking and stuff. She wanted
- 48:05to go out all the time, so she was
- 48:06burning up the money I was
- 48:07Do it.
- 48:09I I was making good, about two or three
- 48:11hundred a day sometimes. Sometimes I was
- 48:13earning fifty
- 48:13she know what you were doing?
- 48:15Oh, yeah. Tyra always knew everything I
- 48:17was doing.
- 48:18So, you were very close.

- 49:31had happened with
