- 6:19[clears throat]
- 6:24Alhamdulillah.
- 6:33So today inshallah we're going to
- 6:34continue commenting on
- 6:37inance
- 6:40or in the Islamic Jewish students
- 6:42according to the
- 6:46uh and we reached the book where it is
- 6:49titled the book of zakat.
- 6:52He says [clears throat] the zakat is
- 6:55obligatory for five things. First
- 6:58livestock. Second currency.
- 7:01third
- 7:03crops, fourth fruits,
- 7:06fifth and goods for sale or trade.
- 7:11Then he continued,
- 7:13so the author is talking about the book
- 7:16of zak and definitely a zak is
- 7:20an important topic. It's a pillar of
- 7:23Islam
- 7:26and zak
- 7:27it's one of the pillars of Islam the
- 7:32differ regarding a person who is not
- 7:35paying zaka out of steness
- 7:40after they have agreed that if anybody
- 7:43who does not pay zaka out of denial he
- 7:46says he says that it's not legislated
- 7:50it is not Islamic ically obligated. They
- 7:53have agreed that if that person
- 7:57is
- 7:59he lived amongst Muslims, he grew up as
- 8:02as a a Muslim. They have come to the
- 8:06conclusion unanimously or they have
- 8:08agreed it's not they they have come to
- 8:10the conclusion they have agreed
- 8:11unanimously that that person is not a
- 8:14believer. If a person who says that it's
- 8:16not obligated upon us to give zakat
- 8:22the scholars of
- 8:26from the time of all the way down agreed
- 8:29that that person is not a believer even
- 8:31if he still pays it even if he even if
- 8:35he gives a if he denies its obligation
- 8:38its legislation
- 8:40they have differed however regarding a
- 8:42person who does not pay it out of
- 8:44stinginess.
- 8:47He does not want to pay it out of a
- 8:48stinginess. Some scholars, the likes of
- 8:52the likes of Jubham,
- 8:55they are of the opinion he's not a
- 8:57Muslim. He's taken out of the fold of
- 9:00Islam and the most direct opinion which
- 9:02is the opinion of the vast majority of
- 9:04Sahabah that he is still Muslim but he
- 9:07has committed a major sin.
- 9:10If a person does not pay zaka while he's
- 9:13eligible to pay zaka, he is committing a
- 9:15major sin but he is still be being a
- 9:18Muslim. One of the evidences that we can
- 9:21utilize that he is not that he is still
- 9:24being a Muslim that the prophet
- 9:27sallallahu alaihi wasallam when he was
- 9:28speaking about those who didn't give
- 9:30zaka on the day of judgment as a Muslim
- 9:34he says then
- 9:37after he would be punished by his
- 9:39livestock they would tread on him they
- 9:41would step on him the prophet sallallahu
- 9:42alaihi wasallam said then it would be
- 9:46considered whether that he will go to
- 9:47the hellfire or he will go to Jenna. If
- 9:51he was a a disbeliever, then there is no
- 9:54two options. There is only one option
- 9:56this Muslim. So this tells us that he is
- 9:59e Muslim but he's committing a major
- 10:02sin. He is missing a pillar of Islam but
- 10:05won't take him out of the fold of Islam.
- 10:07As long as he has a salat then the rod
- 10:11or the the the the major pillar is still
- 10:14there. The house does not collapse
- 10:16entirely. Still the house exist.
- 10:20Now what is zaka? Zaka linguistically in
- 10:24the Arabic language is to grow.
- 10:27To grow and to purify.
- 10:31In the Arabic language we say
- 10:36plant
- 10:38they grow. Also to purify like when we
- 10:42say you do zaka for yourself and you you
- 10:44purify yourself. you grew yourself and
- 10:47you purify. So this is the meaning of
- 10:50linguistically it is related to the to
- 10:54and its
- 10:58usage because
- 11:01the zak it causes your wealth to grow
- 11:05and also purifies your wealth. You
- 11:08purifies your soul from stinginess. It
- 11:11grows you in being merciful and
- 11:13cheering, not stinginess, selfish and so
- 11:16on so forth. So then it purifies, causes
- 11:19your will to grow as says
- 11:30the prophet said
- 11:32that charity does not reduce your
- 11:34wealth. Indeed it increases it. Indeed
- 11:37it increases it. Indeed it increases it
- 11:44charity. It increases your wealth. It
- 11:46blesses your wealth. It purifies your
- 11:48heart. Purifies your your habit. It
- 11:50takes from your character being a
- 11:53stingy, selfish, individualistic,
- 11:57careless.
- 12:00However, what is the juristic meaning of
- 12:03a zak which the author is talking about
- 12:06here? We say a zaka
- 12:10it's
- 12:15the delivery
- 12:17of
- 12:20certain
- 12:22zatable wealth or zatable assets
- 12:30delivered
- 12:32to a particular categories
- 12:35of people or entities.
- 12:47This is how it is juristically defined.
- 12:49It is a right. It is a right
- 12:55or let's call it it's a specific right
- 13:03taken
- 13:05from a specific type of wealth
- 13:10delivered
- 13:12to a specific categories of people
- 13:16or to a specific
- 13:19you know
- 13:21categories or you know brackets of
- 13:24people
- 13:26if you put it this way. Do you
- 13:29understand? So this is a zak. So it's a
- 13:32specific type of charity.
- 13:35When we talk about a zak we're talking
- 13:37about a prescribed
- 13:40it is done. It is a financial it's
- 13:43related to your wealth but it's it is
- 13:46prescribed in a specific way
- 13:49delivered in a specific way in a
- 13:52specific wealth to a specific categories
- 13:55of people or entities or actions. This
- 13:59is the meaning of a zaka.
- 14:03Zaka according to the most correct
- 14:04opinion has been legislated in Mecca.
- 14:10However, it was legislated in Mecca. And
- 14:13the reason we know that it was
- 14:14legislated in Mecca because Allah in
- 14:17multiple Mecci verses and suras he
- 14:20mentioned.
- 14:22So we know that it was legislated in
- 14:24Mecca. However, when it was legislated
- 14:27in Mecca, it was legislated
- 14:30not with its spec species, its people,
- 14:35how it is delivered, what is the
- 14:36threshold and so on so forth without
- 14:38details. Just there was an obligation to
- 14:41give charity up to what extent it is up
- 14:44to the believer.
- 14:46Up to the believer to who? Up to the
- 14:48believer.
- 14:50when up to the believer. From which type
- 14:52of will? Up to the believer. But there
- 14:55is there was an obligatory charity
- 14:59but without specification.
- 15:02When the prophet sallallahu alaihi
- 15:03wasallam immigrated to Al Medina then as
- 15:05zaka was not legislated. It was already
- 15:09legislated but it was more detailed
- 15:12specified conditions stipulations and so
- 15:15on so forth were were given and this was
- 15:17according to the most correct opinion in
- 15:19the second year in the second year after
- 15:22he sallallahu alaihi wasallam immigrated
- 15:29the author
- 15:33for five things
- 15:37a zaka
- 15:38When a zakat is taken from your
- 15:42from you, it is not taken from your
- 15:44income,
- 15:46it's taken from your wealth and it's not
- 15:50taken from any type of wealth. What we
- 15:53usually call assets you call it here
- 15:55assets.
- 15:57It is taken from a particular types of
- 16:00wealth. We call it zakatable assets or
- 16:05zable money.
- 16:08There are things that they are not
- 16:09zakatable, nonzakatable, unzakatable.
- 16:13Zaka is only taken from your is taken
- 16:16from your wealth in its totality. And
- 16:19it's not from every single
- 16:22item in your wealth. It's only taken
- 16:26from zakatable types of wealth.
- 16:30How do we know that? How do we know?
- 16:33Through the evidences. The evidence is
- 16:35in the book of Allah and in the sun of
- 16:36the prophet sallallahu alaihi wasallam.
- 16:38He says the zaka therefore is obligatory
- 16:42for five things. Now he's not saying
- 16:46upon whom it is obligated but the type
- 16:50of wealth and is possessing a microphone
- 16:54is this zeicatable
- 16:56possessing livestock is it zatable? If I
- 17:00have stocks is it zatable? If I have
- 17:03cash,
- 17:05silver, gold,
- 17:08is it zakatable and so on so forth.
- 17:12He says the zaka is obligatory for five
- 17:15things. We know that through
- 17:18investigating and doing exhaustive
- 17:21investigation through through the text
- 17:24and we come to this conclusion. He said
- 17:27first life is stuck.
- 17:31livestock and there is a unanimous
- 17:33agreement
- 17:34there is no difference whatsoever that
- 17:37if a person possesses livestock then he
- 17:40is obligated to pay zakat or to give
- 17:43zakat usually I prefer the verb to give
- 17:46better than pay
- 17:49so
- 17:52is it for any livestock you have
- 17:57it must be the livestock they are
- 18:01camels,
- 18:04sheep
- 18:06and cows
- 18:09or we can put them this way. Camels,
- 18:12cows, sheep unanimously.
- 18:16So if you have life is like you have
- 18:18horses.
- 18:20If you have horses, is it the catal? No.
- 18:24Unless you intend them intend them for
- 18:26trade
- 18:27or you rent them, then you're going to
- 18:31pay zaka on the on the rent. But just
- 18:35having a horse, it won't be zak.
- 18:39What about having chicken?
- 18:42No. So it's only
- 18:48unanimously. There is no disagreement
- 18:51whatsoever.
- 18:53And we're going to be talking about the
- 18:55the conditions for them to be oblig
- 18:59how to give zak from them. What's the
- 19:01age if there is if there is any
- 19:04what's the percentage? What's the
- 19:06threshold and so on so forth then he
- 19:09said currency
- 19:12again I'm trying my best to make things
- 19:14so easy for you. who want to provide a
- 19:16lot of evidences but there is a
- 19:19unanimous agreement and the evidence for
- 19:21the livestock is
- 19:25through the
- 19:28taken to from
- 19:30taken from an
- 19:32okay there are multiple hadith regarding
- 19:35so life is stuck then he said currency
- 19:40when he speaks of currency he speaks of
- 19:44silver and gold
- 19:47because this is the actual currency.
- 19:50It's only a recent time where we are not
- 19:55pegging our currency to to gold or
- 19:59silver when we had what we call fiat
- 20:02fiat currency. It's only by the United
- 20:05States. That's what they did.
- 20:07the United States, they went to war with
- 20:09Vietnam because after World War II,
- 20:13you know, the major powers,
- 20:16those who won the world, the the the
- 20:18war, they had a, you know, uh, a
- 20:23conference or a meeting
- 20:27in Britain, New Jersey. They came to the
- 20:29conclusion that we're going to peg the
- 20:32currency to the American dollar and the
- 20:34American dollar is going to be pegged to
- 20:3725 ounces of gold. Okay. When the United
- 20:41States went to war, this is called the
- 20:43Britain wood system.
- 20:47When the United States went to war with
- 20:49Vietnam, they run out of gold as they
- 20:52claim.
- 20:54So that they cannot cover up the dollar.
- 20:58They cannot back it up with with gold.
- 21:01So what they decided to do, they
- 21:05actually
- 21:06untie the dollar to gold and they make
- 21:09the dollar in of itself the standard. So
- 21:12that when we exchange currencies, we
- 21:14exchange currencies
- 21:16in
- 21:19in exchange of dollar. Yeah. We peg the
- 21:22currency according to the dollar. And
- 21:25then after the oil crisis, they pegged
- 21:27the dollar to oil. They call it the
- 21:30dollarization.
- 21:32The oil dollarization
- 21:35when they agreed with the Saudis.
- 21:38So then the it is a new phenomenon that
- 21:41the currency is actually
- 21:44it's not pegged yeah any related to
- 21:47connected to tied to actual actual
- 21:50currency gold or silver. So now in order
- 21:54so what's the um what's the currency in
- 21:57Somalia
- 22:00>> shill so the shillin is packed to the
- 22:02dollar it's not packed to an actual goal
- 22:06it's it's according to the fed the c the
- 22:11central bank in the United States they
- 22:14decide the price the value of of the um
- 22:21of the currency And then you either you
- 22:23appreciate or d appreciate according to
- 22:26that currency. What I'm saying to you
- 22:28here currency here we're talking about
- 22:30what silver
- 22:31>> silver or gold and anything that is
- 22:33going to function the same paper note
- 22:38now we now even we have digital currency
- 22:41cryptocurrencies. So anything that is
- 22:43going to function as a currency that
- 22:45it's going to function like silver or
- 22:47gold then it is zakatable.
- 22:51It's a capital because the reason for
- 22:53them to be zakatable because they are a
- 22:56medium of exchange
- 22:59and they are a measurement of value of
- 23:01things.
- 23:03So silver and gold they are a medium of
- 23:06exchange in a state of
- 23:09doing what we call battery
- 23:13we do we exchange a commodity or good
- 23:16with currency. So it's a medium of
- 23:19exchange and by which we know the value
- 23:21of these items of these goods
- 23:23commodities this is the function of
- 23:24them. So therefore anything that is
- 23:26going to function like silver or gold
- 23:28then it's going to be zable and we're
- 23:30going to know inshallah the threshold
- 23:32for it.
- 23:34Then he say
- 23:37crops.
- 23:38The third type of zakatible web is it
- 23:41crops.
- 23:43Now crops
- 23:48is it any sort of crops? We're going to
- 23:50know later inshallah. The crops that
- 23:52they are going to be is a carable
- 23:54according to the Mus according to
- 23:57they say that as long as it is stable
- 24:01stable food
- 24:03and it is
- 24:06saved
- 24:08storeable and it's also the food that
- 24:11everybody eats in
- 24:14a particular you know area now if you
- 24:17think about it most of the food here in
- 24:19the United States essentially is going
- 24:21to be made of wheat.
- 24:25Wheat
- 24:27if you have Yeah. The wheat is
- 24:31essential,
- 24:32right? It is essential for any for many
- 24:36of the food that we consume. Wheat is
- 24:38essential.
- 24:40What about rice?
- 24:42Yes,
- 24:44rice we eat it is it is storeable. It is
- 24:48storeable and also it is
- 24:52You eat
- 24:56you eat rice also here. What do you call
- 25:01it in English?
- 25:04>> What do you call it?
- 25:05>> Corn. Corn.
- 25:08You are in the land of corn.
- 25:12And accord in the United States is
- 25:14essential
- 25:16that these the things that they are
- 25:20storeable to
- 25:23essential in a particular area.
- 25:28These are these crops.
- 25:32But what about
- 25:34fruits?
- 25:36Again, if these fruits are going to be
- 25:40storeable, not consumable,
- 25:44dates,
- 25:45raisin,
- 25:48dried uh figs,
- 25:51if they are storeable, we can we can
- 25:53store them. We don't consume them like
- 25:55you know watermelon,
- 25:57like a pomegranate,
- 26:00you know, cucumber.
- 26:02These are consumable.
- 26:04So then if they are if the crops if they
- 26:08are storeable and they are essential put
- 26:14and also the fruits and for the fruits
- 26:17they need to be dried because we can
- 26:20store we can store them and at the and
- 26:23at the same time we can utilize them as
- 26:26essentials. We eat them as essentials.
- 26:29Like now many people what's their main
- 26:32meal?
- 26:37>> Raisins. They have raisins and milk.
- 26:39They woke up in in the morning. Many
- 26:42people had
- 26:50what do you call it?
- 26:52>> It's it's composed of what?
- 26:56>> Yeah. essentially storeable things and
- 27:00food essentials like wheat, flour, mash,
- 27:03mash.
- 27:05>> Okay. So the this is what people eat.
- 27:07This is what usually people consume
- 27:10irrespective of how it is delivered put
- 27:12in cans or in you know boxes. It's it's
- 27:15it's about the type of food and how it
- 27:18is consumed.
- 27:20All right. Then he said crops and fruits
- 27:24and we just talked about fruits y they
- 27:26are dried stoable essential
- 27:30and then he say and goods for sale or
- 27:34trade merchandise
- 27:39anything that you have
- 27:43intending to trade it anticipating a
- 27:47return on it profit your anticip ipating
- 27:51a profit on it immediately. The moment
- 27:54that you have that intention, it's going
- 27:56to be accountable if the value
- 27:59reaches the threshold and one full year
- 28:02the duration passes.
- 28:05Yeah. For example, I have a car for
- 28:07personal usage. Is itable?
- 28:10And then I go to Instagram,
- 28:15I say I have a car for sale. From that
- 28:18moment, that car is what? The cat.
- 28:22Because I want to profit in it. Look, if
- 28:25I want to say to sell it to get rid of
- 28:27it, I don't want it. Is it the cat?
- 28:31Because I'm not looking for profit. What
- 28:34I'm looking for just to get it out of my
- 28:37face. I don't want it. I don't want this
- 28:39car.
- 28:41Okay. Every day, every day I wake up, I
- 28:43see this car in the garage. I feel sad.
- 28:47So then I want to get out of it or to
- 28:52yeah I don't want it then the intention
- 28:55has a huge effect on a zak that's why a
- 28:59zak has some role in the state and is
- 29:03still
- 29:04the eligible person the one who is
- 29:06legally juristically capable he has
- 29:09relationship with allahel
- 29:11so then what about this table is it
- 29:14accountable not at
- 29:16The moment that I want to sell it with
- 29:19the intention to profit on it, we call
- 29:22that merchandise
- 29:25immediately.
- 29:29We call it
- 29:33and the best hadith we have in this in
- 29:36regarding this this type of zakatable
- 29:40will is hadith.
- 29:42He said that the prophet sallallahu
- 29:44alaihi wasallam used to command us to
- 29:46give zaka on any type of wealth we
- 29:49prepare it
- 29:51for sale and to profit on it. Is that
- 29:56clear in
- 29:58so then livestock? What is livestock?
- 30:05>> Currency. What do you mean by it?
- 30:10>> Exactly. Crops
- 30:17>> stable food, storeable food and they are
- 30:19essentials. Food
- 30:23>> fruits,
- 30:25>> dried,
- 30:26>> stoable and essential
- 30:32as opposed to they say that they must be
- 30:35weighed. They are scaled. If they are if
- 30:39they are sold by number but by counting
- 30:43then they are not going to be
- 30:47considered to be zakat. They must be
- 30:49weighed a type of food that must be
- 30:52weighed. But without like what is said
- 30:54here just to introduce you to the to the
- 30:57concept and later inshallah you're going
- 30:58to know more
- 31:02goods for sale or trade
- 31:04>> anticipating for a profit.
- 31:05>> Anticipating for a profit. The moment
- 31:08you intend them for a prophet, then they
- 31:11are automatically going to be
- 31:13>> as
- 31:15again it's not just you say you sell you
- 31:20intending a profit. You turn that that
- 31:23commodity profitable. You make that item
- 31:26profitable.
- 31:29This is the mean of capital. You can
- 31:30make everything capital. You can make
- 31:32air capital.
- 31:34You you can make
- 31:37you can make air capitalized. They call
- 31:39it capital. You you can
- 31:44the the the the can.
- 31:48Now I can just take it and throw it when
- 31:51I finish. I just threw it either in the
- 31:53in the recycle or the the trash.
- 31:56Correct? But I can turn that very thing
- 31:59as capital because what is capital in a
- 32:02very simple terms? Anything that is
- 32:04going to produce another capital. So
- 32:06then what is capital? What is capital?
- 32:09Any any item that is going to produce
- 32:13profit.
- 32:15So you you if you produce profit we call
- 32:18you human capital. We can we capitalize
- 32:22the humans because they can produce
- 32:25capital. they can produce profit,
- 32:29right?
- 32:31Anything that you make that you can turn
- 32:34into capital and you can you can make a
- 32:37profit in it, it's going to to have zaka
- 32:40or it's going to be zakatable with other
- 32:43conditions.
- 32:47Any question so far?
- 32:50Yes.
- 32:54>> If you have account and you have money
- 32:57in it
- 32:58>> is that
- 32:59>> if you have a saving account yes
- 33:01absolutely if you have a saving account
- 33:04then it's going to be the cat because
- 33:07you can you can withdraw whenever you
- 33:10want and you can because it is function
- 33:12like a currency
- 33:14yes
- 33:17>> is goats going to be
- 33:20>> we will say she because if we you have
- 33:23she you have goats and what's the other
- 33:25One
- 33:28not lamb. Lamb is the meat
- 33:35you know. Yeah. Sheep they are of two
- 33:38types. Yeah. This species is of two
- 33:41types. In any place in the world there
- 33:43are different types but they they
- 33:46essentially are they are sheep is a
- 33:48genus under which you have two types. We
- 33:52have
- 34:00he told us that there are two
- 34:01categories. You have a button. What is a
- 34:04button?
- 34:06A button.
- 34:08You see that they the
- 34:12a button is the you know their um their
- 34:17wool is is not straight.
- 34:22You know what I'm what I'm talking
- 34:23about. They're not straight. It's
- 34:26fluffy. You call it. Okay. Also that
- 34:30their tail
- 34:32their t they don't have t they have any
- 34:35fat.
- 34:37Yeah. Their tail is fat. But the goat
- 34:40and also usually their ears they are
- 34:45>> short.
- 34:47This is called a button. Please
- 34:50translate it.
- 34:53Maybe is a goat.
- 34:57Okay.
- 34:59We call this
- 35:02and it's either to be male or female.
- 35:05Like what about almaz
- 35:08almaz usually their their ears are
- 35:14long
- 35:16their their um any wool is straight
- 35:22and their tail
- 35:26they don't have fat they have any tails
- 35:28you see them usually they they go up
- 35:32you see so I think now you you know what
- 35:34I'm talking about. So what is
- 35:37>> sheep with?
- 35:38>> Sheep with wool.
- 35:39>> Okay. And the other one with hair.
- 35:42>> Yeah. The goat is with hair.
- 35:46So the is with wool.
- 35:50Al is with hair. This is one of the
- 35:52differences. Usually also
- 35:57al they have you know a little beard.
- 36:02you especially the the the male the male
- 36:04one. So you understand now what we're
- 36:07talking about. Okay.
- 36:15They are as long as it is.
- 36:20Yes.
- 36:22>> For what? part of a business that you
- 36:24share
- 36:27partners share those
- 36:30>> we're going to talk about inah
- 36:33if you if you have ass if you
- 36:37if you have a partnership if you have a
- 36:39business what we're going to pay z on is
- 36:43on the profit according to the share of
- 36:46each owner but we're going to talk about
- 36:48it inshallah
- 36:50>> so what if I sell my car make a profit,
- 36:54but my intention is also to buy.
- 36:57>> So essentially, you would like to sell
- 37:00your car to profit from it and then
- 37:02you're going to use that capital to buy
- 37:04another car. It's a capital. You're
- 37:06going to pay even if that car.
- 37:10Let's suppose that you show your car,
- 37:12you have the car in the in the
- 37:13dealership, you have it for one year
- 37:16intending to pay it to to uh to sell it.
- 37:19Then after one year, it was not sold.
- 37:22Then you're going to pay zakat on on the
- 37:24value of it. You're going to see the
- 37:25value of it. Then you're going to you're
- 37:27going to pay the cat on the on it. 0
- 37:302.5% 0.025%.
- 37:34You divide it by and you pay. Or you
- 37:35multiply by 0.005
- 37:39and you're going to get the zakat the
- 37:42percentage. Yes.
- 37:47>> You're going to pay zakat every single
- 37:48year.
- 37:50Zakat zak. We're going to be talking
- 37:52about these like now ask about the and
- 37:55you understand now the meaning of
- 37:57zakatable will
- 38:00it's wrong it's wrong you understand the
- 38:02zaka to be only on the currency a lot of
- 38:06people they think of zak only to be what
- 38:10>> on on on cash on money on your bank
- 38:13account
- 38:14there's only one type of wealth if you
- 38:17have life is stuck if you have life
- 38:19stuck with the conditions in we're going
- 38:20to talking later. We're going to be
- 38:22talking about later. You're going to pay
- 38:24zakat.
- 38:25If you have your own car intending to
- 38:27sell it, your your house intending to
- 38:30profit on it, you're going to pay zakat.
- 38:33Okay? Bear in mind that is it's on your
- 38:37wealth, not on your income.
- 38:40Yes. So if you have stored food in your
- 38:42cupboard, they can all be
- 38:44>> if you have what
- 38:45>> like stored food like
- 38:47>> you have stored food intending to profit
- 38:51on it or you're just in
- 38:52>> you're just stoing it the moment look
- 38:57it's it's not the food that you buy the
- 38:59poo you grow
- 39:01you're going to pay zaka on the crops if
- 39:04you grow that that uh that the yield
- 39:09you're going going to pay zaka on the y.
- 39:11If you grow it, you're going to pay zaka
- 39:12on the y immediately. This is one. You
- 39:15don't need to wait a year. We're going
- 39:17to be talking about it in crops and the
- 39:19fruits. You pay zaka the moment you
- 39:22harvest them.
- 39:26What about moving on? Because it seems
- 39:28to me most of the questions they're
- 39:30going to be answered in later. Let's
- 39:32let's continue. He says, "As for the
- 39:35livestock, it is obligatory for three
- 39:38types."
- 39:39And we just talked about it. He said
- 39:41camels.
- 39:43>> Sheep.
- 39:44>> Yeah. He said cattle and sheep. Cattle
- 39:47had cow.
- 39:49>> Cow. Okay. But he is using a very formal
- 39:52Englishman.
- 39:54He's an Englishman.
- 39:57Yes, sir.
- 40:00[laughter]
- 40:02Very formal.
- 40:04to show that you are you are educated.
- 40:09Definitely definitely the you know the
- 40:12British the British accent is formal and
- 40:15they know how to speak. They're so
- 40:17educated educated in their language not
- 40:20necessarily in the substance
- 40:23you know unless that you speak in
- 40:25Cambridge or Oxford and exterior they
- 40:28speak in a very formal language. If
- 40:31you'd like to hear how they speak to
- 40:33compare to compare the level of language
- 40:36and education between the
- 40:38representatives in England, see, you
- 40:42know, how they discuss in Winminster,
- 40:45you know, the the British Parliament and
- 40:48how Congress they discuss. see the the
- 40:51the level of language, the level of uh
- 40:53you know etiquate and uh they are very
- 40:57you know eloquent and how they speak
- 41:00here this camera from Texas. What do you
- 41:03expect?
- 41:09He says
- 41:12that that's the problem. You have very
- 41:14uneducated people. They can determine
- 41:17nuclear bomb.
- 41:21But the British you find that they are
- 41:23educated. If you go there, if you go
- 41:24over the their background
- 41:28you find that because the commons they
- 41:31are appointed by the monarch
- 41:33about twothirds of the commons they are
- 41:36appointed by the by the monarch and then
- 41:39the church the church of England they
- 41:41also appoint not not for the commons for
- 41:44the lords because they they have two
- 41:46chambers. One is the lords, one is the
- 41:49commons. What do you call them here?
- 41:52The house of representatives and the
- 41:54house of and the and the
- 41:58senators.
- 42:00The senate
- 42:03definitely there is a level a difference
- 42:04of language. You see it. It's very
- 42:06obvious.
- 42:08Even the Australians the Australians
- 42:10when they speak in their parliament that
- 42:12you see more more educated better
- 42:14language. here sometimes you you see
- 42:17some slang guy slang very uniform
- 42:22so the standard is very low here as long
- 42:24as you have a corporate behind you you
- 42:26tell them you tell them I will give you
- 42:28whatever you want you're going to be in
- 42:30Congress you never even attended the
- 42:32school
- 42:36he says there are six conditions for it
- 42:39to be obligatory
- 42:43what he's talking about livestock. How
- 42:46did he know about it? Through exhaustive
- 42:49investigation.
- 42:52He said first Islam
- 42:55and I wish that he make these conditions
- 42:57and the conditions of zaka at the
- 42:59beginning. Then he talks about the types
- 43:02of wealth that is zakable like we're
- 43:04going to go about. Yeah. And we're going
- 43:06to go with what he presented. He started
- 43:08with Islam definitely unanimously. So
- 43:11there is no zak in any in any shape or
- 43:14form upon
- 43:15>> a even if he is he he lives with us
- 43:21there is no zak
- 43:24if he is a dimmi they will pay but jiza
- 43:28is it's only upon
- 43:31>> male
- 43:32who is reaching the age of puberty who
- 43:35has the capacity to participate in the
- 43:38army
- 43:41So if he's an elderly he won't be he
- 43:43won't pay he won't pay women children
- 43:46they won't pay
- 43:49but but even Muslim children in their
- 43:52wealth they will pay zak
- 43:57now they used to say we don't want
- 44:0140% you're taxed you're taxed 40% and
- 44:05this is for what
- 44:07only for your income. So what about your
- 44:10property tax? What about the sale tax?
- 44:13You are stolen publicly
- 44:16and you're going to pay pay.
- 44:20Yeah, you will pay. You can't even give
- 44:23up one cent otherwise you're going to be
- 44:26imprisoned and would be taken from you.
- 44:31The the the the thing here is that Islam
- 44:34definitely for zaka
- 44:37any type of zakat any wealth that is
- 44:41zeatable or any zakatable asset any
- 44:44zakatable type of wealth it's going to
- 44:47be mandatory or obligatory upon a Muslim
- 44:50this the first condition
- 44:52because how do we know that because he
- 44:54sallallahu alaihi wasallam when he sent
- 44:58to the people of Yemen he Say to them
- 45:01the first that you call them to. After
- 45:03they accept, you ask them to pray salah.
- 45:06After they accept, you ask them zak. And
- 45:10also when you send them to Yemen, you
- 45:11say that this is what you take from
- 45:13Muslims and this what you take from
- 45:25type of gowns.
- 45:29Muim
- 45:31it's Islam unanimously.
- 45:38Freedom. Freedom here is the opposite of
- 45:41what?
- 45:42>> Slaves. Slavery.
- 45:49The if a person is a slave
- 45:52then he's not required to be zak. The
- 45:55reason is that he does not own the
- 45:59differed. If his master enables him to
- 46:02own, can he own? The scholars differ.
- 46:05The most correct opinion is that if his
- 46:08master enables him to own, then he will
- 46:10pay zakat. Then then he would own. Then
- 46:13he would own. But if he owns, is he
- 46:16required to pay zakat? The most correct
- 46:18opinion is not.
- 46:21All right. This is the opinion of Malik.
- 46:25A slave does not pay zak because he
- 46:27cannot own. And the vast majority of the
- 46:29scholar they see that he even if his
- 46:31master enables him to own he won't own.
- 46:34But the most correct opinion is that if
- 46:36his master enables him to own and he he
- 46:38he says to him I give you m and this car
- 46:42it's yours he can own but is it going to
- 46:46be zakatible? The most correct opinion
- 46:48is no.
- 46:51Then you say complete ownership,
- 46:55full ownership.
- 46:57What do you mean by complete ownership?
- 47:01Complete ownership.
- 47:05You
- 47:07the anytime you want the money to be
- 47:10available, you can have it.
- 47:13This is the meaning of full ownership.
- 47:16If you don't know
- 47:18whether that you're going to own it or
- 47:20not,
- 47:22we call it unstable
- 47:27unstable wealth. So then it needs to to
- 47:30have full ownership
- 47:34full ownership
- 47:36available for withdrawal, available for
- 47:39usage.
- 47:41What would you do as a as a result of
- 47:44had methan
- 47:48if you have
- 47:50if
- 47:52if you are actually the creditor.
- 47:56Okay, you're giving me part portion of
- 48:00your livestock to someone else.
- 48:04Okay,
- 48:06he he took them as
- 48:10debt.
- 48:13Are you going to be required
- 48:16and and he will give them back? Look,
- 48:19not
- 48:21Yeah. And he's he's not um because look,
- 48:24when you when you have you take
- 48:28something and you return the you return
- 48:30it back. Exactly. If you take a loan, if
- 48:34you take something as a loan, you don't
- 48:35borrow it, then you give it. If I borrow
- 48:37from you this battle, I will give it
- 48:39back. If I take a loan, I will give I
- 48:42will take this battle and it will give
- 48:45you an alternative of the same value.
- 48:48Okay? So if someone now if if he is
- 48:54taking your
- 48:57livestock methan cows
- 49:00he has taken them as a loan. Okay,
- 49:06there is accountable
- 49:08we say wait we say there are details
- 49:12if that person has the capacity to give
- 49:16you back when when it's the time of
- 49:19maturity when it's due
- 49:22and he is also going to give he is not
- 49:25going to postpone and make your life
- 49:27miserable
- 49:29then we say that you're going to pay zak
- 49:31on them
- 49:33when you get them back
- 49:36for whatever years they they have
- 49:38passed.
- 49:40Are you with me?
- 49:42So now imagine
- 49:45for example,
- 49:47you have 500 cows.
- 49:51You give 200 to a person. You say that
- 49:54I'd like to take them. I'd like to take
- 49:57these 200 and these 200s he might use
- 50:00them for whatever
- 50:03but he wants to invest with them. He
- 50:04would like to get their milk. He want to
- 50:06enhance his business. Whatever.
- 50:09So he has a reason to take them from
- 50:11you.
- 50:13I will give them back to you in two
- 50:16years.
- 50:17Now one year passed.
- 50:21Are these cows counted in the total of
- 50:25what you possess?
- 50:27So it depends
- 50:29if that person has the capacity when
- 50:32it's due to give it back to you and we
- 50:35know that
- 50:38we know that he has the capacity if he
- 50:40is sued he will attend the court.
- 50:43This is the meaning that he has the
- 50:45capacity to give back and to be
- 50:48available.
- 50:50Okay. He won't he has the capacity to
- 50:53give you back and he would be available.
- 50:56If this is the case then then you when
- 51:01after two years after he gives you back
- 51:03and after you have them now they are in
- 51:06your farm back then you're going to pay
- 51:09a zaka on what? On the two years passed
- 51:13but only when you possess them when you
- 51:15get them back. If however you know that
- 51:18he is bankrupt
- 51:20now he's bankrupt or he's not bankrupt
- 51:23but he is he's a you know fraudulent he
- 51:27traveled overse you know no we don't
- 51:30know where he is he's a fraudulent
- 51:33person then you don't pay you don't pay
- 51:35zaka because you don't have full
- 51:38ownership
- 51:40because they are not available not
- 51:42available for you and milk tam milk. All
- 51:48right.
- 51:50Then he says
- 51:52that they need to reach and is
- 51:56threshold. Yeah. The minimum threshold
- 52:00when the life is stuck and we're going
- 52:02to be knowing we're going to know in
- 52:04about the life about the threshold if
- 52:06they reach nab is not age nab is a
- 52:10threshold of how many you have.
- 52:14So then he says the threshold because he
- 52:18sallallahu alaihi wasallam says
- 52:22we know that we have we have evidences
- 52:25there is a unanimous agreement there is
- 52:28a unanimous agreement that they must
- 52:30reach they must reach a threshold
- 52:33and then he says the completion of one
- 52:36year the completion of one year the
- 52:39passing of one year with that full
- 52:41ownership from the time you own them
- 52:46not necessarily they are on your farm.
- 52:48The moment you own them, they are they
- 52:51are in you are the owner.
- 52:55If you are the owner and you have full
- 52:57and you have full ownership in the sense
- 52:59that they are available for possession
- 53:01then from that time you start counting
- 53:04one year and that year is counted
- 53:06according to the Islamic lunar calendar
- 53:10not according to the Gregorian calendar
- 53:13as if you're here or if you're in China
- 53:14you count by the Chinese calendar you
- 53:17count it according to the Islamic lunar
- 53:20calendar because look any ruling any
- 53:24ruling that is Islamic related to months
- 53:27is going to be counted by what?
- 53:29>> By the Islamic lunar calendar
- 53:32waiting period. We count it according to
- 53:35the to the lunar calendar to the Islamic
- 53:38lunar calendar
- 53:42a person has you say if that month
- 53:44passes meth
- 53:48according to the Islamic lunar calendar
- 53:49you don't count them according to
- 53:51January February
- 53:53you count them according to the Islamic
- 53:55lunar calendar and then lastly he says
- 53:59and gra as opposed to malik grazing that
- 54:04they need to graze.
- 54:06But if the
- 54:09they graze and when they graze, they
- 54:13graze
- 54:15more than half of the year.
- 54:18If they graze less than half of the
- 54:20year, then they are not the
- 54:26need to graze half, six months or more
- 54:29of the year. Now, what is the opposite
- 54:32of a grazing? You are the one who is
- 54:34going to provide for them. You are the
- 54:37one who bringing the hay and you are the
- 54:40one who taking care of them. You don't
- 54:43and let them go and graze
- 54:47as opposed to Malik. Malik he says
- 54:49whether that you are actually taking
- 54:51care of them or they are grazing.
- 54:54They're going to be you're going to pay
- 54:55his account. The most correct opinion is
- 54:57that we stipulate to be grazing as the
- 55:00author mentioned. Any
- 55:03question?
- 55:05Do you understand what we say?
- 55:08>> Yes. What's your name?
- 55:10>> No, I'm Muhammad.
- 55:14>> For the merchandise or they intend to
- 55:16sell
- 55:18>> if you buy shoes that you're going to
- 55:19wear, but someday you're willing to
- 55:21resell it.
- 55:23>> So you bought you bought shoes. You are
- 55:26actually intending for personal
- 55:30>> usage. But in case in case someone is
- 55:33going to
- 55:35give me a profit on them, I am willing
- 55:38to sell them.
- 55:39>> Right? But did you show them? Did you
- 55:43then you didn't pay his account? You
- 55:45know, because you are actually intending
- 55:47them intending them for personal usage.
- 55:50They're not merchandised.
- 55:52You know,
- 55:53now
- 55:56>> Yeah. What is it?
- 55:57>> Seeds.
- 56:02seeds again they are going to be eatable
- 56:07edible
- 56:12>> if they eat they need for for them to be
- 56:15zatable they must be edible we eat them
- 56:24>> yes
- 56:25>> if you rent a home um for like a year or
- 56:28over a Yeah.
- 56:29>> What would the amount
- 56:33>> on the on the on the on the on the what
- 56:36do you call it the the occupant?
- 56:39>> No. For the person
- 56:42the owner of the property. He will pay
- 56:44zaka on on the rent when he receives it.
- 56:48>> The full or the full year worth of the
- 56:51rent after after one year. after
- 56:54>> after one year because this is because
- 56:58it's going to be added to the already
- 57:01capital he has and then he will pay his
- 57:02account on the total.
- 57:06>> Yes.
- 57:07>> I intend to sell items
- 57:09>> but I have not sold anything yet. Yes.
- 57:11>> Trouble selling it.
- 57:12>> Yeah.
- 57:12>> Am I still required?
- 57:13>> Yes. Yes. Because you have turned it
- 57:15into capital. But this is a trade. Trade
- 57:17is either your profit or lose. This is
- 57:19how trade works.
- 57:23Yes.
- 57:28>> Yeah.
- 57:34>> Then you it it is not now the cate
- 57:39if you actually about two or three
- 57:41months you change your mind. Do you
- 57:42start a new year from the new intention
- 57:46or you or you resume
- 57:50according to the most correct opinion?
- 57:51you start a new year, you don't resume,
- 57:53you don't build on the previous
- 57:56intention. So let's assume for 11 months
- 58:00you wanted to sell your house. Then you
- 58:02change your mind. You married now you
- 58:04would like to live in the house and then
- 58:08after after you married methin by half
- 58:12of the month, you know, you decided to
- 58:15go to an apartment. You didn't need the
- 58:16house. So then you intended to sell it
- 58:18for a profit, not to get rid of it. you
- 58:21want to profit from it. We say now you
- 58:23start
- 58:24although you you had only one month you
- 58:27were about about just one month to pay
- 58:28zakat on it because you have changed the
- 58:31intention however and Allah knows what
- 58:33is in your intention if you are
- 58:34intending if you are playing around you
- 58:36are actually intending to divert from a
- 58:38zakat you're going to pay you're going
- 58:40to pay you're going to pay zakat
- 58:43>> now
- 58:48>> get it
- 58:51After one year,
- 58:54you have a car, you intended to sell it,
- 58:56and since the time you you intended, one
- 58:59year passed and then after one year,
- 59:02there was a damage. You had a a car
- 59:04accident. Yes. You're going to pay
- 59:06account on the value on it before the
- 59:08damage.
- 59:12>> Yes. Over there. And now
- 59:17zak have to be paid on can someone
- 59:20before you meet the threshold.
- 59:24>> Can can they pay zaka before the wealth
- 59:28reaches the the threshold
- 59:33but you can pay it as a charity. It's
- 59:36the same as if a person says I'd like to
- 59:38pray before it's time because the reason
- 59:41for it [clears throat] to be zak and
- 59:43obligated it needs to reach the
- 59:45threshold but before the time of you can
- 59:48pray you can give charity.
- 59:54>> Yes.
- 59:56Yes. You
- 59:58>> what's the threshold for?
- 1:00:00We're going to talk about it. It's going
- 1:00:03[clears throat] to be 85
- 1:00:06grams of gold. Pure gold.
- 1:00:1324. You know what we categorize gold?
- 1:00:17The pure gold which is 99.9%
- 1:00:20is going to be the 24. Not the 18, not
- 1:00:24the 14,
- 1:00:25not the 12, the 21, the 24. the pure
- 1:00:29gold, the pure silver, the the one that
- 1:00:32is going to be 99.9%.
- 1:00:37>> Yes.
- 1:00:38>> So when you say anticipating a profit on
- 1:00:39it, is it strictly just a positive
- 1:00:41profit and no negative like a negative
- 1:00:45profit?
- 1:00:45>> As long as it is profitable either that
- 1:00:48you you profit on it 0.00001%
- 1:00:51or you profit on it 1% 2% 3%.
- 1:00:54>> No, no, you lose money actually.
- 1:00:56>> Yeah.
- 1:00:57This is later. This is after. We're
- 1:00:59talking about the intention. You're
- 1:01:00intending for this property to be
- 1:01:02profitable, to be capital. You want to
- 1:01:05turn it into capital. Whether that you
- 1:01:07lose or your profit, this it's going to
- 1:01:10be you're going to pay zakat on it.
- 1:01:12>> Yes. Over there.
- 1:01:14>> What is the ruling for a loan that you
- 1:01:16gave up that's not easily available?
- 1:01:19>> So, so you are actually lending someone
- 1:01:21else
- 1:01:23>> and then that person is not giving you
- 1:01:25back. We're going to be talking about it
- 1:01:26inshallah. So if that person is not
- 1:01:28giving it back to you and he he's not
- 1:01:31willing to give it back to you, then you
- 1:01:33only going to pay zaka the moment that
- 1:01:35is in your hand in your bank account and
- 1:01:37you're going to pay zaka only for one
- 1:01:40year
- 1:01:41that year where you received it. That's
- 1:01:43it. But if he is actually willing to
- 1:01:46pay, willing to pay and if you sue him
- 1:01:49to court, he's going to be available. As
- 1:01:51well as he has the the the the capacity,
- 1:01:54the financial capacity to pay, then
- 1:01:56you're going to again pay it pay zaka
- 1:02:01when you receive it, when you have it,
- 1:02:03but for the whole years,
- 1:02:06four years, five years or 10 years?
- 1:02:11>> Yes.
- 1:02:14something like you shred something you
- 1:02:16still
- 1:02:17>> the the scholars differed regarding this
- 1:02:20issue. Can is it still mandatory to pay
- 1:02:23zaka on a profit earned through haram
- 1:02:26means or not? And and for me if you are
- 1:02:31actually doing it if you are actually
- 1:02:33doing it with the intention to avoid
- 1:02:36zaka
- 1:02:38you you will pay zakah but if you don't
- 1:02:41have that intention to pay zakah I'm
- 1:02:43still reluctant but in order to be in
- 1:02:44the safe zone a person should pay zakah
- 1:02:47even it's own through haram means the
- 1:02:50likes of prostitution
- 1:02:54gambling
- 1:02:56and so on and so forth.
- 1:02:59Yes.
- 1:03:01>> Because you have by the way prostitution
- 1:03:04is everywhere through what?
- 1:03:08>> A social media.
- 1:03:10Now
- 1:03:12any brilliant men and women they are
- 1:03:15deciding to quit school and to go there
- 1:03:17because they can be millionaires in a
- 1:03:20month. Why you need to work and just
- 1:03:22show your body and that's it. You're
- 1:03:25going to get millions. This is what they
- 1:03:26have turned them. And believe it or not,
- 1:03:28here in the United States now, I think
- 1:03:31no less than 5 million girls, this is
- 1:03:34how they earn their profit.
- 1:03:38This is the society you are in. Yes.
- 1:03:42>> You said you need to have something for
- 1:03:47>> Say it again.
- 1:03:48>> You need to have something to like for
- 1:03:51one year in calendar.
- 1:03:53>> Yes. Exactly.
- 1:03:55You need to have it one year to pay
- 1:03:57zakat
- 1:03:59and one year passing and you still have
- 1:04:02the threshold. If one year passes and
- 1:04:05the the amount you have is below
- 1:04:09below and then it goes again then you
- 1:04:11don't pay his account it need one full
- 1:04:14loan or year passing and whatever you
- 1:04:18have does not go below the threshold.
- 1:04:24In we're going to be back and continue.
