- 0:00I mean I pulled up and I could see him
- 0:02and you know I knew something was bad I
- 0:05ran out I knew it was really bad
- 0:09my boy over there I could see
- 0:13it was

- 0:52actually I think I tried to turn Paul
- 0:54over first
- 0:57um
- 0:59you know I tried to turn him over and uh
- 1:02I don't know I figured it out
- 1:05um
- 1:06his cell phone popped out of his pocket
- 1:08that's
- 1:09started to try to do something with it
- 1:12thinking maybe but then I put it back
- 1:15down really quickly
- 1:17um then I went to my wife and uh
- 1:21I mean I could see
- 1:26[Music]
- 1:30Maggie at all I did I touched them both
- 1:32okay I tried to take I mean I tried to
- 1:35do it as limited as possible but I I try
- 1:38to take their pulse on both of them
- 1:43is there anybody that you can think of
- 1:46that we need to talk to tonight
- 1:49is there a name that comes to mind
- 1:51I mean I can't tell you anybody that I'm
- 1:55overly suspicious of
- 1:58off the top of my head okay you know
- 2:01um I mean this is such a stupid thing
- 2:04I'm even embarrassed to say it
- 2:07but it just didn't
- 2:09make any sense I just hired a guy out
- 2:12here and
- 2:16it really he wasn't cutting the mustard
- 2:18but I hadn't told him this yet Paul's
- 2:20been working with him a lot he killed
- 2:22the sunflower seeds in our dove field
- 2:24just recently which is why Paul was here
- 2:26doing this he told Paul a story the
- 2:29other day about how when he was in high
- 2:32school he got in a fight with some black
- 2:35guys
- 2:36and FBI undercover team observed him
- 2:40fighting those guys and put him on an
- 2:44undercover team with three Navy Seals
- 2:47and their job was to kill radical Black
- 2:50Panthers and they did that from Myrtle
- 2:52Beach to Savannah
- 2:55now I really don't think this guy
- 2:59you know
- 3:01is probably the person but
- 3:05that's just so freaking yeah that's kind
- 3:08of far-fetched story weird but he was
- 3:10off today okay he took his daddy to the
- 3:13doctor
- 3:15what's his name CB Rowe
- 3:19have y'all been having any problems out
- 3:21here
- 3:21trespassers are breaking in none that I
- 3:25know of the only thing
- 3:27that what comes to my mind is my son
- 3:30Paul was in a boat wreck
- 3:32a couple years ago and there's been a
- 3:37you know he was charged with being
- 3:39arrested for being a driver there's been
- 3:42a lot of negative publicity about that
- 3:44and there's been a lot of people online
- 3:47just really vile stuff but when Paul's
- 3:51out and about I mean people routinely I
- 3:55don't think I know the full story
- 3:57um because I don't think they give it to
- 4:00me but I mean he's been punched and hit
- 4:03and just attacked a lot
- 4:06all right still with me criminal defense
- 4:08attorney former prosecutor Franz Bogart
- 4:10and Franz you know first and foremost
- 4:11he's an attorney
- 4:14um it's always it always surprises me
- 4:16but people in general but especially
- 4:18attorneys don't follow the cardinal rule
- 4:20and don't talk to police but I guess
- 4:22under these circumstances
- 4:24in in the situation that he is
- 4:26presumably in
- 4:28um I guess you can understand it
- 4:31well you know
- 4:33he didn't have much of a choice right so
- 4:36if he would have said I don't want to
- 4:37talk to you guys then he immediately
- 4:40becomes a suspect right even though he
- 4:42has the constitutional right to remain
- 4:43silent and what we get is we get some
- 4:47good nuggets for him which is the I
- 4:49tried to touch them as little as
- 4:50possible you heard him say that right
- 4:52which may be something the defense uses
- 4:55to address the blood on the clothes on
- 4:57the other hand Michael what we get is it
- 5:00was the radical black panthers in the
- 5:03library with the candlestick holder that
- 5:05may have done the murder which is so
- 5:08ridiculous yeah that it's just like I
- 5:11don't even know what to say now
- 5:13here's the thing what would anybody
- 5:16let's assume that he didn't do it for a
- 5:18second what would be anybody in his
- 5:20position if he really didn't do it and
- 5:23he encountered what he encountered what
- 5:24would be their demeanor what would be
- 5:26the things they would say would would
- 5:28they be saying ridiculous things
- 5:30possibly
- 5:32um I just don't know I don't know about
- 5:33everything I'm seeing here I don't know
- 5:36that this helps him as much as it hurts
- 5:37him yeah no one knows what you say under
- 5:40those circumstances that's part of the
- 5:41problem we're going to sit here and pick
- 5:43this thing apart we don't know what you
- 5:45would say you don't know what's running
- 5:46through your mind one of the things
- 5:47obviously running through his mind is
- 5:50that boat accident we heard it again it
- 5:52was the first thing out of his mouth
- 5:53when the First Responders came and it
- 5:56took a while to get to it during this
- 5:57particular interview but he goes to it
- 5:59again and here's my question about that
- 6:01that's the part that I think possibly
- 6:03could be helpful to defense only because
- 6:05they don't necessarily have to develop
- 6:07that very much much but it's out there
- 6:09and it's a good story and it gives them
- 6:11inadvertently uh something to think
- 6:14about when I say them I mean the jury
- 6:15something to think about about the
- 6:18possibilities of what else could have
- 6:19happened here
- 6:20so the best part of this for the defense
- 6:23is this is their client testifying
- 6:25without testifying right
- 6:27um he doesn't have to get on the stand
- 6:28although he might not be able to resist
- 6:31Michael uh but he doesn't have to get on
- 6:33the stand he's he's provided through his
- 6:38his reasonable doubt that the jury might
- 6:41be able to sink its teeth in if
- 6:42developed by the defense so that is a
- 6:45positive right the negative is the
- 6:47negative is is the jury's going to watch
- 6:50these videos and then watch his
- 6:52courtroom demeanor and see if those two
- 6:54emotional reactions align and if they
- 6:57don't align he has a problem yeah and
- 7:00and you know they're watching them
- 7:01because we all are I mean it's it's the
- 7:03natural reaction but you threw up a
- 7:05softball I gotta knock it out to park
- 7:06here you said he may not be able to
- 7:09resist testify there's no way you think
- 7:12he's testifying in this case
- 7:14so remember we've talked about this in
- 7:16the past Michael the only decision that
- 7:18the client gets to make regardless of no
- 7:20matter how much I'm begging and pleading
- 7:22for them not to testify is they get the
- 7:25right to take to stand against my advice
- 7:27now sometimes sometimes in certain cases
- 7:30we tell them hey you should testify I
- 7:32think it's a good idea and we work on it
- 7:34we work on it and work on it but some
- 7:36clients Michael
- 7:37especially clients that are lawyers they
- 7:40just can't help themselves even in the
- 7:42face of good advice from Council now
- 7:45look he has a really good he's a really
- 7:48good defense attorney who's doing some
- 7:50good leg work right now so maybe it's
- 7:52something that they've talked about and
- 7:54he's convinced him not to do it he
- 7:56doesn't need to do it I think there's
- 7:57Reasonable Doubt here uh if the jury
- 8:00wants to find it and I think he get up
- 8:02gets on the stand he's only going to
- 8:03hurt himself yeah I have to agree but I
- 8:05go back to the the arraignment where he
- 8:07gets up and says I'm gonna defend myself
- 8:09in front of God and Country like you
- 8:11said just the Persona of this guy
- 8:12suggests there's there's a little nugget
- 8:14there that he may want to get on the
- 8:16stand and tell his
