4. 0:06Lauren Giddings seven years ago at the
5. 0:08making apartment complex where they both
6. 0:09lived in June of 2011 crime-scene tape
7. 0:12went up at the barristers Hall
8. 0:14Apartments on Georgia Avenue at the time
9. 0:16both McDaniels and getting's lived in
10. 0:18the building
11. 0:18police found part of getting's body in a
12. 0:20trash can outside the building three
13. 0:22years later McDaniels confessed to
14. 0:24killing Giddings and pleaded guilty but
15. 0:26now says his constitutional rights were
16. 0:28violated in the investigation and
17. 0:30pretrial process McDaniel tried to argue
18. 0:33that case today the Gustaw our zach
19. 0:35merchant tells us what went on inside

22. 0:40here in Augusta and his bid for a
23. 0:42do-over in his case well ran into
24. 0:44problems almost from the start
25. 0:45McDaniel was trying to convince Richmond
26. 0:47County Judge John Flay his rights were
27. 0:49violated throughout his time in the
28. 0:51justice system but his lengthy
29. 0:53repetitive questioning of his first
30. 0:54witness
31. 0:55making Chief Assistant District Attorney
32. 0:57Nancy Scott malkor drew a rebuke from
33. 1:00the judge

35. 1:07I'm not sure that's McDaniel used mal
36. 1:14Coors testimony largely to set up his
37. 1:16next and final witness his former
38. 1:18defense attorney Frank Hogue who he
39. 1:20claimed was part of a pair of attorneys
40. 1:22who did not effectively represent him
41. 1:31McDaniel also tried to argue that a
42. 1:33judge that presided over part of his
43. 1:35original case was not impartial and some
44. 1:37legal research McDaniel did while in the
45. 1:39Bibb County Jail had been improperly
46. 1:41reviewed by the Macon district
47. 1:42attorney's office but Joseph lathe
48. 1:44wasn't buying it the ruling was a relief
49. 1:55for Lauren Giddings aunt Kathy man who
50. 1:57said after what he did to her McDaniel
51. 1:59never deserves to be free she was a
52. 2:02breath of sunshine she was a lot of
53. 2:04laughter but she was serious and she was
54. 2:08Steven McDaniels next-door neighbor and
55. 2:10classmate and she was kind to him and
56. 2:13Kathy says closure is a luxury her
57. 2:16family just will not get but she says it
58. 2:19is some measure of comfort that at least
59. 2:20for now Stephen McDaniel is still behind
60. 2:23bars in Augusta Zach merchant 13 WM a

62. 2:28hand out a more extensive written ruling
