- 0:06especially after such uh Josh Dubin and
- 0:08Derek Hamilton uh from the Innocence
- 0:10Project let's take a look at what they
- 0:11had so tell me your story like how what
- 0:13happened to you well thanks for having
- 0:15me and Josh thanks for the accolades
- 0:18um you know I was 17 year old kid
- 0:20running around Brooklyn at a time when
- 0:22Brooklyn was uh terrible and I was a
- 0:25product of my environment I was doing
- 0:27little robberies and you know a little
- 0:29stump stuff that adolescents do and I
- 0:32got on the radar Police Department uh
- 0:35they used to search me all the time pat
- 0:37me down you know throw me up on the car
- 0:38regular stuff that happened in our
- 0:40community
- 0:41um one day A man was killed about 5 a.m
- 0:45by some older guys in the neighborhood
- 0:47uh the police had an identification of
- 0:50their car they called the guy in and he
- 0:53somehow told them he rented me the car
- 0:56and that I was the one that bought the
- 0:58car back and told him that I had
- 0:59committed the crime and that I had shot
- 1:01the guy by accident
- 1:04um and that was my first real experience
- 1:06with the criminal justice system because
- 1:08it was a murder
- 1:09um I'm like murder you know I did a
- 1:11couple of robberies I you know I did
- 1:12some petty stuff but murder that's not
- 1:15me so um you know what was amazing to me
- 1:18is number one
- 1:20um nobody would have gave me they caught
- 1:2117 years old right he caught would have
- 1:24known that this guy wouldn't gave me his
- 1:25car
- 1:27um but they arrested me and they charged
- 1:28me with murder
- 1:30um and I I wonder why the police
- 1:33uh I wonder why the police did that I
- 1:36just I can't
- 1:39I can't for the life of me think of why
- 1:42the police would do that to a young
- 1:44black uh 17 year old boy hmm I was
- 1:48convicted uh by his jury because they
- 1:51admitted grand jury testimony of a
- 1:53witness who came before the court and
- 1:55said I never seen this guy at all the
- 1:58police made me lie in the grand jury and
- 2:01said that I seen this guy I'm not
- 2:02testifying I refuse to testify I'm not
- 2:04going to get up there and purging myself
- 2:05uh the judge told the prosecutor that
- 2:08day that they were dismissing the case
- 2:09that if they don't get another witness
- 2:11this case is going out of here
- 2:13um judge Davis Lombardo back then this
- 2:15was 1983.
- 2:17um I went back to Rikers Island that day
- 2:19we came back the next day and the judge
- 2:21said that he thought about this all
- 2:23night
- 2:24and he felt that the only person would
- 2:26benefit from this witness not testifying
- 2:28would be me therefore he was going to
- 2:30allow the prosecutor to admit their
- 2:32grand jury testimony as evidence in
- 2:35Chief at my trial and I would forfeit my
- 2:37right to confront the witness and let
- 2:39the jury hear the truth that she never
- 2:41saw the crime so that was my first real
- 2:43experience I was a young knucklehead the
- 2:45lawyer that I had at the time Candace
- 2:47Curry said look young man get your head
- 2:49out your ass and you better read these
- 2:50cases and you better see what's going on
- 2:52like they're arrowing you she took the
- 2:54stand and told the judge what the
- 2:55witness told her
- 2:57um and and I was convicted I was
- 2:58sentenced to 25 years of life
- 3:01um and it was at that moment that I know
- 3:03that I had to study law that I had to
- 3:05really dig deep in in the books and I
- 3:07did at New York State uh thank God had a
- 3:11law library they had all the books in
- 3:12the world how long you had to supply
- 3:13yourself and I spent the next five and
- 3:16six years working on my case uh in 1987
- 3:19the appeal division in that case found
- 3:21that the judge had no evidence
- 3:23whatsoever I'm no advocate for Hammurabi
- 3:25[ __ ] but like honestly that judge should
- 3:27go to jail
- 3:30like you know if fair is fair you go to
- 3:34jail uh you go to jail for the duration
- 3:39and me or anybody acting on my behalf
- 3:41that threatened this witness that
- 3:43anything improper unless the judge was
- 3:44right there was no evidence that they
- 3:46can prove that so they reversed the
- 3:48conviction uh and I was able to get out
- 3:50of prison uh after six and a half years
- 3:52unbeknownst to me it was a real cop by
- 3:55the name of Louis garcella
- 3:57who felt that I didn't do enough time
- 3:59for this conviction he didn't like the
- 4:00Appellate Division decision eight months
- 4:03later I was in New Haven Connecticut at
- 4:05a Unisex Salon that I had on at the time
- 4:07uh he came in that store and arrested me
- 4:09told me I was going back to Brooklyn for
- 4:12a murder
- 4:13um and I'm like a murder like this can't
- 4:15be true like again like how many times
- 4:17has happened I went to New York
- 4:20um I was processed uh about a year later
- 4:24I went to trial I was convicted they
- 4:26brought a witness in by the name of Jew
- 4:28Smith who said that she was present at
- 4:31the murder when her boyfriend was killed
- 4:32that I was a gunman I had a gun in my
- 4:34hand and I shot this individual several
- 4:36times with this gun
- 4:38um but her original statement to the
- 4:39police said she wasn't there that she
- 4:42never saw this crime she was around the
- 4:44corner at a store when she came back her
- 4:46boyfriend was dead the jury never heard
- 4:47that statement but in any event
- 4:50um the ballistics evidence proved that
- 4:52this guy was shot with two different
- 4:53guns that he wasn't shot in the building
- 4:55when she said he was shot at but he was
- 4:57shot outside in the street uh despite
- 5:00his evidence I was convicted after I was
- 5:03convicted was when I learned that she
- 5:06had first told the cops at the crime
- 5:07scene she never saw the crime but she
- 5:10had told her to a different detective so
- 5:12I made a pro se motion to set aside the
- 5:13verdict and in the motion I argue that
- 5:16this detective that never came in that
- 5:18she gave the statement uh to could prove
- 5:20my innocence and the judge ordered a
- 5:22hearing for a year he said I can't give
- 5:24this guy a day in jail let alone uh 15
- 5:27years which is the minimum I want this
- 5:29witness to come back the prosecutor said
- 5:31I'm not calling him and the judge said
- 5:33if you don't call her back this case is
- 5:35going to a new trial right they called
- 5:37the bat and she admitted that she never
- 5:39saw the crime not to detective Lewis
- 5:41Godzilla told her what happened and told
- 5:43her that if she didn't get up here and
- 5:44say that occupated the crime she was
- 5:47going to jail she was on Parole her
- 5:49boyfriend was a felon that just got out
- 5:50she had kids they said you're going to
- 5:52jail she said what was I supposed to do
- 5:54here's the system telling me this that
- 5:56if I don't come in and say this I'm
- 5:58going to jail and I came in and said it
- 6:00uh the judge ruled a year later that
- 6:03again he felt that I was guys
- 6:09if the criminal justice system can
- 6:11extract classified documents from
- 6:13Mar-A-Lago
- 6:14I mean of course this is going to happen
- 6:16you know what I mean on the one hand you
- 6:18have this which is uh whatever a man's
- 6:21uh uh life is taken from him
- 6:25unjustifiably by an an unjust criminal
- 6:28justice system that is designed to churn
- 6:30out these sorts of results and on the
- 6:32other hand you have a billionaire fail
- 6:35son
- 6:36who failed upwards his entire life
- 6:40uh
- 6:42have uh have a little bit of trouble
- 6:44with the federal authorities because he
- 6:48he took some classified information and
- 6:51then refused to give it back when asked
- 6:53kindly
- 6:55for the record this is why I say these
- 6:57people are [ __ ] ridiculous like the
- 6:59people who are like oh my God if it can
- 7:00happen to them it can happen to me it's
- 7:02like dude shut the [ __ ] up okay it's
- 7:04already happening it was
- 7:06he said there was a Common Thread of
- 7:08strings I manipulated this evidence
- 7:10again I called the detective the
- 7:12detective came in and said exactly what
- 7:13the witness said that she told him she
- 7:16didn't see the crime that she was beat
- 7:18up and took to the priesthood and told
- 7:20she was going to jail and I had that
- 7:21jury all those cases and more of a cop
- 7:23disliking him for various reasons oh
- 7:25yeah totally
- 7:26it's just one cop let's not examine the
- 7:29system that has allowed one cop to be
- 7:31Petty in this regard or let's not
- 7:33examine the system that allows a cop
- 7:35like that to continue operating let's
- 7:38just look at One Cop
- 7:43yeah just One Bad Apple
- 7:45you heard that could have been different
- 7:46results at the at the trial they told
- 7:49the jury that her first statement was
- 7:51the most important statement in this
- 7:52case and that when the police arrived on
- 7:54the scene she didn't hesitate even when
- 7:55a dude is describing
- 7:57every single aspect of a system that
- 7:59failed him that unjustifiably took his
- 8:03freedom away you're still like well I
- 8:05mean I don't know it was just a cop
- 8:07a cop did this take she said Derek
- 8:10Hamilton somebody I know my entire life
- 8:11committed to Crime which wasn't true in
- 8:13fact she said the truth which she didn't
- 8:15see the crime because she was somewhere
- 8:16else
- 8:18um I was sentenced to 25 years of life I
- 8:21filed enormous post-conviction motions
- 8:22after post-conviction motions every time
- 8:24a judge gave me a hearing every time he
- 8:26said he controlled a case out every time
- 8:28he said he was troubled by this
- 8:30conviction uh the prosecutor would come
- 8:32in and tell him I'm a bad guy that this
- 8:33is not somebody you want to release that
- 8:35you know they put imagine harms they
- 8:37make a judge think that I was the most
- 8:38terrible person in the world
- 8:41multiple judges failed him prosecutors
- 8:44failed him well not even failed him like
- 8:46they unjustifiably kept him in detention
- 8:49multiple cops
- 8:52he even has empathy for the [ __ ]
- 8:54other person who offered false testimony
- 9:00that's insane with time
- 9:02um you know I found numerous motions
- 9:04numerous post-convictions I did
- 9:05everything you could imagine uh to prove
- 9:07my innocence but to no avail
- 9:09I just began going to parole board
- 9:11around 2009
- 9:13uh it was a very traumatic experience
- 9:15for me because at that time the parole
- 9:17board wanted me to a [ __ ] and I wasn't
- 9:19going to do that I'm not going to come
- 9:20in and see how I killed somebody didn't
- 9:22kill I'm not doing that I don't care
- 9:24what you say and I had to challenge them
- 9:25and fight them for two years uh and then
- 9:28my family went out and protest and we
- 9:30got a daily news article put out that
- 9:32said that I would be free if the court
- 9:34would just basically give me Justice if
- 9:36they just give this guy a fair shot he'd
- 9:37be home so it changed the the mentality
- 9:40of the parole board they look at all my
- 9:42evidence and they said you know based on
- 9:44the evidence that you presented here
- 9:46um we believe in your innocence like
- 9:48this evidence speaks for itself even the
- 9:49judge said she was innocent I don't know
- 9:51what you're doing in all these years and
- 9:52they released me and at that point I
- 9:54began a crusade because when I was in
- 9:56prison there were several guys we built
- 9:58something called the actual innocence
- 9:59Team guys who I was working in law
- 10:01library so I would read God's case and
- 10:03check them out so what I had to do was
- 10:06get families together get people to come
- 10:09together and bring their families and
- 10:10say look let's send these people to City
- 10:11Hall let them know there's a lot of us
- 10:13in here it's not just me it's white it's
- 10:15black there's a bunch of us in here they
- 10:16got the same issue that they're
- 10:18procedurally borrowing us they're not
- 10:19looking at our case it's chicken into
- 10:21the garbage we don't want to hear it get
- 10:22out of here right because they can they
- 10:24have the power so when we start bringing
- 10:26attention to these cases to change the
- 10:28whole dynamic so when I got out I joined
- 10:30that group family and friends of the
- 10:32Romans convictions uh we had the pr God
- 10:34by the name of Lonnie sorry who was
- 10:36helping us keep it together and we just
- 10:38began blasting the prosecutors began
- 10:40protesting outside their offices and
- 10:42getting rid of them uh the first one we
- 10:43was able to get rid was Charles Hines in
- 10:45Brooklyn the prosecutors sent me to
- 10:46prison he was able to remove him and put
- 10:49a progressive prosecutor and that agreed
- 10:51that he would look at these convictions
- 10:53if he was elected so he got in and then
- 10:55two years he has underrated 22 people
- 10:58and he found that it was a systemic
- 10:59racist problem in Brooklyn that was
- 11:01convicting the wrong people uh
- 11:03fortunately for me uh the New York oh
- 11:06[ __ ] I I guess I guess it wasn't oh [ __ ]
- 11:09I guess it wasn't just one One Bad Apple
- 11:11I guess it was a couple bad apples times
- 11:13reported caught me and I believe it's
- 11:15two thousand I need you to understand
- 11:17that conviction or that investigation
- 11:22saying investigation to even conduct you
- 11:24end up literally investigating the very
- 11:27same people that are all you the police
- 11:29end up policing the police okay which is
- 11:31precisely why in so many of those
- 11:32circumstances uh plenty of them get to
- 11:35have long and wonderful careers and get
- 11:37fat pensions by the end of it okay
- 11:41the idea that like the idea that they
- 11:44actually concluded or conclusively found
- 11:46uh racism within the way that policing
- 11:50was occurring in this situation implies
- 11:52that it had gotten so out of [ __ ]
- 11:54control that a larger Federal agency or
- 11:57federal government had to step in and
- 11:58say you got to stop dude what the [ __ ]
- 12:00are you doing you're doing too much
- 12:01racism not the uh not the the level of
- 12:05racism that is allowed or we can like
- 12:07kind of look the other way in 12. and
- 12:09they said why are people afraid of the
- 12:11police I just thought you kidding me why
- 12:14are they afraid of the police and I told
- 12:16them names of guys that I knew that was
- 12:18in prison that this cop set up
- 12:20and a lawyer had contacted me and said
- 12:23he was working on a case which this cop
- 12:25framed another guy by the name of David
- 12:27ranta and he said in two weeks there's
- 12:29going to be an article in New York Times
- 12:31that exposed this cop and I told New
- 12:33York Times reported that and I said look
- 12:35two weeks if it comes out you come back
- 12:37to me and I take it to these guys and
- 12:39she came back Francis Road but she came
- 12:41back and I took her to these guys she
- 12:43got the prosecutor to agree to look at
- 12:4550 of these cops cases 50 of them and um
- 12:49you know 20 was exonerated so far those
- 12:51guys and um I was exonerated in 2015 in
- 12:552014 for the first time in New York
- 12:58history the Appellate Division second
- 13:00apartment ruled in my case that a
- 13:02freestanding action innocence claim
- 13:04could be recognized on the
- 13:06post-conviction motion and they said to
- 13:07anybody that's innocent the course could
- 13:09no longer procedurally buy you they got
- 13:11to reach the merits of your contentions
- 13:13they just can't say well you should have
- 13:14raised this before or your lawyer failed
- 13:16to do this before or you should have did
- 13:18you got to reach the merits of it get to
- 13:20the bottom line this guy innocent or not
- 13:21and when they gave me that opinion it
- 13:24kind of like in itself exonerated me
- 13:26because a prosecutor now had to hear my
- 13:28Witnesses I had Alibis I had police
- 13:30officers who said look this guy was in
- 13:31New Haven Connecticut not Brooklyn when
- 13:33this murder happened we know because
- 13:34seen a minute it was at a party with him
- 13:36at a hotel receipts I had many witnesses
- 13:38to verify where I was at on a date in
- 13:40Italian cap for the record
- 13:45police or prosecutor misconduct is at
- 13:47the root of half of exoneration cases
- 13:51at the hat at half
- 13:55specifically just prosecutorial
- 13:57misconduct is one in 20 but when you add
- 13:59police misconduct into the matter that's
- 14:01half
- 14:03you understand [ __ ] half dude
- 14:07that's insane those people should be
- 14:09going to jail
- 14:15like we're not talking like a witness
- 14:17[ __ ] up
- 14:18we're not talking like uh you know
- 14:21additional evidence came out
- 14:24this is straight up like
- 14:27wrongly convicted black Defenders were
- 14:29slightly more likely than wise to be
- 14:30victims of misconic especially in drug
- 14:31and murder investigations
- 14:38official misconduct
- 14:58yes is murdered the course is just
- 15:01throwing evidence in the garbage we in
- 15:02fact prove who committed the crime the
- 15:04real murder was present when the cops
- 15:06arrived he was on Parole for
- 15:08manslaughter they took his name down but
- 15:10never even investigated who he was so we
- 15:12had a lot of evidence we had a witness
- 15:14who was there who identified who was
- 15:15there identified why the guy was shot
- 15:17there was a 9-1-1 call that said three
- 15:19male blacks cleaned in the red car he
- 15:21admitted they was in a red car so they
- 15:23was just overwhelming evidence in my
- 15:24innocence but courts was just throwing
- 15:26it into garbage because of the
- 15:27prosecutor lied to them and said he's a
- 15:29bad guy so my experience has taught me
- 15:32that you know there's a lot of innocent
- 15:33people I was in prison man look one
- 15:35thing about prison and I tell people
- 15:37they say hey everybody says the innocent
- 15:39that's not true right they may tell a
- 15:41lawyer that but they're not going to
- 15:43tell a guy in the neighborhood with them
- 15:44I know you're guilty you know I was with
- 15:46you I know what you did you told me
- 15:47everybody tells me from the same
- 15:49neighborhoods so it's a small minority
- 15:51of people that's in the Lord by the way
- 15:53this is part of the reason why I always
- 15:54laugh at [ __ ] who say like oh
- 15:56Gavin Newsom is releasing 75 000
- 15:58criminals into the streets tomorrow
- 16:00bro you don't understand the process in
- 16:02which like there is a parole board that
- 16:04looks at your [ __ ] good behavior you
- 16:07don't know how many [ __ ] awful
- 16:08situations you've had to dodge to even
- 16:11get to that level
- 16:12okay you have no [ __ ] idea when you
- 16:16go into prison you're automatically a
- 16:17criminal even if you went to prison uh
- 16:20under uh you know improper filings or a
- 16:24prosecutorial misconduct or whatever it
- 16:25doesn't matter you go into prison now
- 16:27you're criminal you have to do crimes to
- 16:29survive in prison
- 16:31okay
- 16:33that means you were able to dodge all of
- 16:35that
- 16:36despite of all of the uh despite of your
- 16:39your interest in surviving prison
- 16:42that causes you to do literal [ __ ]
- 16:44crimes
- 16:46okay
- 16:50you then get in front of a [ __ ]
- 16:52parole board
- 17:00you get in front of a [ __ ] parole
- 17:01board and they still don't let you out
- 17:03Library every single day if you go to
- 17:06the yard guys working out in the way pal
- 17:07right they playing basketball but the
- 17:09innocent guys is in that law library
- 17:11every single day trying to find a way
- 17:14out and that was me
- 17:15um every single day and I studied every
- 17:17book in there I taught law classes
- 17:19um and I became very good at it I mean I
- 17:21was surprised I mean I know I went to
- 17:23college right the lawyer gave me the
- 17:25first two cases and I read them I was
- 17:27surprised how well I knew the cases I
- 17:28was surprised how I comprehended them
- 17:30and it was because of that
- 17:31um that I kept going and I found the
- 17:33civilian who liked me uh he's working a
- 17:35little librarian and the first test I
- 17:36got was a 44 and he said look man I'm
- 17:38not gonna waste my time you gotta
- 17:39explain what that is what's a 44. uh a
- 17:4344 was my grade on the test
- 17:46um I particular test the first test he
- 17:48gave me was on the Constitution of the
- 17:49United States I had to learn the fourth
- 17:51fifth sixth eighth and 14th Amendment
- 17:54um and I I failed I was playing and he
- 17:56said look you're not gonna waste my time
- 17:57you're smarter than that he challenged
- 17:59me next time I came back I got a 97. so
- 18:02from that point on I just started
- 18:04studying I started start you know
- 18:05gravitating to the older guys that knew
- 18:07more than me because I was young they
- 18:09was willing to teach me and I was like a
- 18:10young sponge and I just I just loved
- 18:12what I did I became passionate about it
- 18:14and that's why I'm here now Derek what
- 18:16kind of repercussions are there for cops
- 18:19that do things like this none I mean in
- 18:22our case uh the statue of limitations
- 18:25had ran out in this cop and let me just
- 18:27tell you about this copy he didn't just
- 18:29do it in the police department he left
- 18:31the police department went into the doe
- 18:33Department of Education he did it there
- 18:35he framed the guy in the doe they later
- 18:38found out that God did nothing wrong
- 18:40they had to reinstate them this is just
- 18:42his name age in his character
- 18:44um he just gets away with it he gets
- 18:46away what's his name Louis garcella and
- 18:48he's out there still he's out there he's
- 18:50still getting the pension the city is
- 18:51still paying this guy uh we still got
- 18:53cases today that we are fighting in
- 18:55court for him James Jenkins Nelson Cruz
- 18:57are they still at your cases are we
- 19:00litigating how many people do you think
- 19:01that guy wrongfully put in prison you
- 19:03know I tell you something I didn't tell
- 19:05you Josh about this one and it's gonna
- 19:08this guy
- 19:10by the way uh for those of you who don't
- 19:12know uh he is
- 19:15a retired detective for New York City
- 19:17Police Department who initially came to
- 19:18Providence during the crack epidemic of
- 19:20the 90s and 80s earning frequent
- 19:23commendations before many of his
- 19:24investigations were overturned in the
- 19:262010s
- 19:30but he's got a [ __ ] he's got a
- 19:32[ __ ] Wikipedia page for his his
- 19:34misconduct
- 19:51worked on it with 200 cases my father
- 19:54was killed in 1988. he was the detective
- 19:57on that case I mean I'll tell you
- 19:59something about that
- 20:00um
- 20:01he said that one of the guys snatched a
- 20:04confession on his hand and ate it
- 20:06I didn't believe that
- 20:08I said as much as I want people who may
- 20:10be responsible for my father I can't
- 20:13trust this guy I can't take nothing he
- 20:16say to be truth right just recently that
- 20:20case was overturned Samuel Edmondson
- 20:22case because of his
- 20:23sloppy police work so I he says 200
- 20:26cases he worked on I would like to
- 20:28believe at least half of those guys
- 20:31uh I understand well a lot of them have
- 20:34been exonerated how many scarcella
- 20:36exonerations have there been 20 today
- 20:39how does a guy not just get locked up
- 20:42immediately for that oh I wonder how
- 20:46well maybe it has something to do with
- 20:48the attitude that rich guys like you
- 20:50constantly [ __ ] Channel Through
- 20:52massively popular media Outlets about
- 20:55backing the blue and how difficult of a
- 20:57job the police have and they're out
- 20:59there scaring the big bad guys black
- 21:02guys specifically that are breaking
- 21:04windows and rioting all the [ __ ] time
- 21:06hmm maybe the reason
- 21:10maybe the reason why they get away with
- 21:12this is because their entire purpose is
- 21:15to defend rich people against the
- 21:17scourge of poor people hmm
- 21:21seems real difficult to frame hundreds
- 21:22of people is not
- 21:24when the system allows it not when you
- 21:27get commendations for it I don't really
- 21:29think Joe baxton blew that heart oh come
- 21:31on dude since [ __ ] since covid since
- 21:34he moved to Austin that [ __ ]
- 21:35hasn't been back in the blue he's been
- 21:37backing that ass directly into the blue
- 21:39[ __ ] okay every [ __ ] every day
- 21:43God damn dude the only time he's like
- 21:45not back in the blue is when it was like
- 21:46you know uh the the George Floyd Derek
- 21:49Chauvin case that's it
- 21:58and when he says and when he testifies
- 22:01he has two lawyers with him now right
- 22:03I've never seen a witness come to court
- 22:05and have two lawyers standing with him
- 22:08we object to it all the time but I mean
- 22:10this is how much of criminal he is he
- 22:11had two lawyers standing with him all
- 22:13the time I'm trying to protect his
- 22:15rights and he don't remember anything
- 22:16now like he don't remember you know what
- 22:20police are defunded too much if they had
- 22:22more funds maybe they could do more
- 22:24racist uh actions like this you know
- 22:26what I mean but of course you don't
- 22:27recall nothing uh you gotta bring the
- 22:29police reports to them and says that's
- 22:31your second [ __ ] did you do this but he
- 22:32don't remember anything of course
- 22:33selectively you don't even need
- 22:37what's wrong with back in the blue
- 22:40man I don't even know where to [ __ ]
- 22:42begin dude I don't even know where to
- 22:44[ __ ] begin holy [ __ ] what's wrong
