  20. 1:02involving that particular comment um why
  21. 1:07was that comment made as indicated in
  22. 1:09that document calls for
  23. 1:13speculation sustained as phrased well

  25. 1:20bottom what is he complaining about what
  26. 1:24page was that against eight at the
  27. 1:25bottom four lines from the
  28. 1:28bottom uh reference to being used
  29. 1:31sexually by Miss Aras what is he saying

  73. 3:56millimet kilom what are they uh the
  74. 3:59large section
  75. 4:00the small ones
  76. 4:02millimeters and how many millim are
  77. 4:06there in an
  78. 4:07inch uh approximately
  79. 4:1125 is it's a little bit more than 25 is
  80. 4:14it yes how
  81. 4:16much uh well there's
  82. 4:182.4 cm in an inch and then there's 10 so
  83. 4:22it's 2.54 or yeah

  99. 5:08the interior of Travis Alexander's house
  100. 5:11uh more in particular uh his bedroom and
  101. 5:15part of the bathroom near the
  102. 5:17shower and were those taken back at the
  103. 5:21time of the investigation of the crime
  104. 5:22in June of 208
  105. 5:25yes exibit 6381

  108. 5:37admitted take a look at exhibit
  109. 5:4263 what are we looking at
  110. 5:45here uh a photograph of Travis
  111. 5:48Alexander's bedroom and
  112. 5:53specifically what is this item here
  113. 5:56those are uh throw pillows and what's
  114. 5:59around around the corners of those throw
  115. 6:01pillows um tassel like uh
  116. 6:06fibers those tassel like fibers if we
  117. 6:08take a look
  118. 6:11at exhibit number
  119. 6:19265 you were there can you tell us
  120. 6:22whether or not they similar to
  121. 6:26those yes they are and let me show
  122. 6:31you another exhibit it's exhibit number
  123. 6:37271 you see this that's on
  124. 6:42there this item here you see that yes I

  129. 7:04and accurate depictions of an area and
  130. 7:06an item from the scen that existed back
  131. 7:08when the investigation was being

  140. 7:51door you can actually see the door on
  141. 7:53the right hand side door handle and
  142. 7:55you're
  143. 7:56looking what direction kind of like a
  144. 7:59northe East Direction into the bedroom
  145. 8:01what does this door lead to that one is
  146. 8:04actually to the closet that parallels
  147. 8:06the hallway into the
  148. 8:09bathroom and exhibit
  149. 8:12number and there is something in the
  150. 8:14middle here this Photograph the first
  151. 8:16one 2 64
  152. 8:18correct right there yes the sandals
  153. 8:23Okay then if we take a look at exhibit
  154. 8:2568 that's a closeup of what the sandals
  155. 8:29in in the middle of the room and with
  156. 8:31regard to these
  157. 8:38sandals do they have any covering on
  158. 8:41them where a person would
  159. 8:42step yes uh full of fibers and you see
  160. 8:46this right here what is this these items
  161. 8:48that are sticking out from around the
  162. 8:49sandals those are the uh the actual
  163. 8:52fibers that the sandals are covered
  164. 8:57with and then if we take a look at
  165. 9:00exhibit number
  166. 9:04271 what is that in your opinion could
  167. 9:07that be is that consistent with having
  168. 9:09come from those shoes yes it is
  169. 9:11consistent and looking through this
  170. 9:15whole house was there ever a rope that
  171. 9:18was found no so if there had been a rope
  172. 9:23there and you didn't find it what would
  173. 9:27have happened to the Rope objection C
  174. 9:29ation is beyond the scope of
  175. 9:31cross
  176. 9:33overed uh we would have taken it I know
  177. 9:36but it wasn't there would you have taken
  178. 9:38it no if somebody had taken it before
  179. 9:40you would you have taken it no I
  180. 9:42couldn't have but did you find any long
  181. 9:46lengths of rope or anything like that
  182. 9:47when you were there
  183. 9:49no and did you find for example in
  184. 9:52exhibit 63 was
  185. 9:55that bedroom
  186. 9:57examined yes it was was the area here
  187. 10:00around the bed examined yes was the
  188. 10:06area exhibit number 64 was the area
  189. 10:10right around here examined yes and I
  190. 10:13mean I mean the lower portion was did
  191. 10:16any officers look underneath the bed yes
  192. 10:19did they look behind the headboard yes
  193. 10:22was there ever a knife found anywhere
  194. 10:25near there no was there ever any rope
  195. 10:27found anywhere near there in other words
  196. 10:29words any of these little strands that
  197. 10:31we're talking about were any of those
  198. 10:32found anywhere near the bed
  199. 10:36no you talk about cording off the street
  200. 10:40and that sort of thing when you got
  201. 10:41there and the house being coined off do
  202. 10:43you remember that yes I do what's the
  203. 10:45purpose of that to secure the the
  204. 10:47residents to keep anybody from going in
  205. 10:49and disturbing any evidence so that from
  206. 10:52the time that the police received the
  207. 10:53call till the time the police first
  208. 10:55police officer came that meant that
  209. 10:57nobody had access to him that place
  210. 11:00correct that's correct and how long did
  211. 11:01you keep the scene open or how long was
  212. 11:03the scene secured so to speak uh almost
  213. 11:06three days I don't have any other

  240. 12:34depicts what you saw at the crime scene
  241. 12:35on June 9th and or June 10th is that
  242. 12:38correct yes okay and it would appear
  243. 12:41that those pillows are in an unmolested
  244. 12:44state would you
  245. 12:45agree yes
  246. 12:51okay and you recall Mr Martinez also
  247. 12:54asked you about pair sandals or flips
  248. 12:57with some fibers on cor yes
  249. 13:00okay let me step back a bit um Mesa P
  250. 13:05Mesa Police Department you're how long
  251. 13:07have you been employed there uh 19 years
  252. 13:09okay so you're pretty familiar with the
  253. 13:11practices and the procedures and those
  254. 13:12sort of things correct yes okay um and I
  255. 13:17suspect then uh could you tell us
  256. 13:18whether Mesa police department has a
  257. 13:20crime lab yes we do okay and what sort
  258. 13:24of things does that crime lab do uh
  259. 13:26everything from uh DNA typing uh
  260. 13:30fingerprint
  261. 13:31analysis uh blood work uh those kinds of
  262. 13:35things okay so if they had known fibers
  263. 13:39for example from these pillows or from
  264. 13:41sandals or that sort of thing they could
  265. 13:44compare that against items you found at
  266. 13:46the crime scene correct um our lab does
  267. 13:49not do that okay so you there there
  268. 13:51would be no way for you to compare we
  269. 13:53would have to send those out to another
  270. 13:56lab okay was that done no okay so the
  271. 14:00estimation you're making that these
  272. 14:02These are similar characteristics are
  273. 14:03just based on your observation not any
  274. 14:07actual data testing is that correct
  275. 14:09that's correct okay thank
  276. 14:12you Mr Martinez those three exhibits or
  277. 14:16the three DVDs that you have in front of
  278. 14:17you those were from the same
  279. 14:19conversation correct yes they were what
  280. 14:21date was the conversation that you had
  281. 14:23of those three DVDs they were uh June
  282. 14:2710th
  283. 14:29and who initiated that in other words I
  284. 14:31know you made the call but were you

  300. 15:15do you work for I work for the Mesa
  301. 15:17Police
  302. 15:18Department and how long have you worked
  303. 15:20for the Mesa Police Department I was
  304. 15:22hired in June uh or excuse me September
  305. 15:25of 2004 and what were your duties when
  306. 15:28you were ini hired when I was originally
  307. 15:31hired at the Mesa Police Department I
  308. 15:32was hired as a crime scene technician I
  309. 15:34was promoted in June of 2005 to lat and
  310. 15:37print
  311. 15:41examiner and what kind of uh do you have
  312. 15:43to have a degree for that sort of thing
  313. 15:45what kind of experience did you have or
  314. 15:46education prior to being hired I hold a
  315. 15:49Bachelor of Science degree in
  316. 15:51anthropology and journalism I have an
  317. 15:53associate of science degree in forensic
  318. 15:56technology
  319. 15:59and what were your duties back in June
  320. 16:02of
  321. 16:032008 in June of 2008 I was a Laton print
  322. 16:07examiner among my duties includes the
  323. 16:10Performing the comparative analysis of
  324. 16:13unknown finger and palm prints that are
  325. 16:16recovered from crime scenes and items of
  326. 16:19evidence to known subjects prints I also
  327. 16:23process evidence in the laboratory using
  328. 16:26various chemicals and powders and I
  329. 16:29respond to Major crime scenes I take
  330. 16:31photographs collect evidence and process
  331. 16:34for Laten prints with regard to this
  332. 16:36issue of a latent fingerprints um what
  333. 16:39is a latent
  334. 16:40fingerprint a latent fingerprint is a
  335. 16:42chance impression on the polymer sides
  336. 16:45of your hands and the soles of your feet
  337. 16:48we have a specialized type of skin
  338. 16:51that's called friction Ridge
  339. 16:53skin it's very similar to Corduroy in
  340. 16:56that there are Peaks and valleys to that
  341. 16:58skin
  342. 17:00and throughout the day you can collect
  343. 17:02different materials on the surface of
  344. 17:04your skin including oils from your face
  345. 17:07or hair grease from the food that you
  346. 17:09eat or other things um throughout your
  347. 17:11day and when you touch a surface you can
  348. 17:15leave an impression of the arrangement
  349. 17:18of friction ridges on your hands or
  350. 17:20Palms onto that surface so as I
  351. 17:22understand what you're saying is that
  352. 17:24these Impressions that are left behind
  353. 17:27wow let me ask it this way are they left
  354. 17:29behind every single time that a person
  355. 17:31for example touches a surface like I'm
  356. 17:33doing here on this Podium no there are
  357. 17:36many reasons of print may or may not be
  358. 17:38left behind well does environment have
  359. 17:40anything to do with whether or not this
  360. 17:41impression is going to be left behind
  361. 17:44yes ex specifically what would what
  362. 17:47environmental factors affect whether or
  363. 17:49not a print is going to be left behind
  364. 17:51if it's a very warm day most of the
  365. 17:54perspiration on your fingers is water it
  366. 17:58can evaporate so if it's a very warm day
  367. 18:01you may not leave an impression behind
  368. 18:03you may have very dry hands the residue
  369. 18:06Left Behind could evaporate from the
  370. 18:08surface if it's been raining the residue
  371. 18:12could be washed away environmental
  372. 18:15factors like that can affect whether a
  373. 18:17print is Left Behind or not how about a
  374. 18:20surface for example if I get a hold of
  375. 18:22something that's made out of wood and I
  376. 18:23put my hands all over it and my more or
  377. 18:26less likely to leave a CH or L
  378. 18:29fingerprint
  379. 18:32behind depend it's got a lot of holes in
  380. 18:35it just a piece of wood I would say in
  381. 18:38that case you're less likely to leave a
  382. 18:40lat and print behind on a very rough
  383. 18:43holy surface than a smooth hard surface
  384. 18:46if you think of a fingerprint as a
  385. 18:49rubber stamp and think about if you ink
  386. 18:51up a rubber stamp and press it on a very
  387. 18:54rough surface you don't get a very clear
  388. 18:55impression of that stamp left behind a
  389. 18:57fingerprint is the same sort of thing
  390. 19:00what about movement what if I'm for
  391. 19:03example going through something and I'm
  392. 19:05moving very quickly and I slide my hand
  393. 19:08against the surface like I did of the
  394. 19:10podium there am my less or more likely
  395. 19:13to leave a
  396. 19:15fingerprint you may leave a fingerprint
  397. 19:18behind in that circumstance but you
  398. 19:20could be smearing the fingerprint and
  399. 19:22the the arrangement won't be visible it
  400. 19:24won't be very clear based on the
  401. 19:27movement so you get these fingerprints
  402. 19:30let's assume that you actually lift them
  403. 19:32um how do you go about determining who's
  404. 19:36the person that left the behind let's
  405. 19:38say in this world where you have
  406. 19:40billions and billions of
  407. 19:41people you don't know who the person was
  408. 19:44that left it behind that's why you're
  409. 19:45checking so how is it that you go about
  410. 19:48affecting an
  411. 19:50identification the methodology that we
  412. 19:52use to compare fingerprints it goes by
  413. 19:55the acronym ACV that's a c
  414. 19:59e-v that stands for analysis comparison
  415. 20:04evaluation and
  416. 20:05verification in the analysis phase what
  417. 20:08an examiner will do is examine the
  418. 20:11latent impression to determine its
  419. 20:13overall suitability for comparison the
  420. 20:16overall Ridge flow of that print can I
  421. 20:19tell if it's a finger or a palm can I
  422. 20:21tell the orientation of the print how
  423. 20:23clear is the information is there a
  424. 20:27great deal of difficult ulty in
  425. 20:29distinguishing between the raised
  426. 20:31portions which would be the ridges and
  427. 20:33the
  428. 20:34furrows we're looking for three levels
  429. 20:36of detail in a fingerprint uh level one
  430. 20:39detail is the overall Ridge flow and in
  431. 20:42the fingers will be pattern type and
  432. 20:45we're looking for level two detail
  433. 20:48that's called Ridge characteristics
  434. 20:51there's many other terms that can be
  435. 20:52used such as minutia Galt and detail
  436. 20:55things like that that's going to be
  437. 20:57where a ridge is flowing flowing along
  438. 20:59and abruptly ends call that an ending
  439. 21:01Ridge you also have ridges that flow
  440. 21:03along and then Branch into two ridges
  441. 21:04and that's called a bifurcation so
  442. 21:06that's the second level of detail that
  443. 21:08we're looking at in the analysis phase
  444. 21:11the third level of detail is pores on
  445. 21:14the friction Ridge surfaces there are
  446. 21:17pores that exude sweat the location
  447. 21:20shape and size of those pores is visible
  448. 21:23in some Impressions and the other part
  449. 21:25of third level detail would be the the
  450. 21:28shapes of the edges of The Ridges
  451. 21:31themselves so in the analysis phase
  452. 21:34we're looking for all of that
  453. 21:35information it's fact Gathering we're
  454. 21:37looking to see do we have level one
  455. 21:39detail do we have level two detail do we
  456. 21:41have level three
  457. 21:42detail that's all with just the latent
  458. 21:44impression then we move to the known
  459. 21:47Impressions or exemplars and we're
  460. 21:48performing an analysis let me stop you
  461. 21:51there okay what if you don't know who
  462. 21:52the person is when you go out to a scene
  463. 21:54you really don't know correct that's
  464. 21:56correct so are you familiar with
  465. 21:58something called aph yes what is aphis
  466. 22:01is an acronym correct it is and what
  467. 22:03does it aphis stand for aphis is the
  468. 22:06automated fingerprint identification
  469. 22:09system and without talking about the
  470. 22:12actual bank that's involved just I'm
  471. 22:15just talking about the machine I don't I
  472. 22:17don't want to know how the known go in
  473. 22:19there okay do you understand what I'm
  474. 22:20saying yes okay uh does this machine
  475. 22:24help you then make a comparison to other
  476. 22:28known that may be around yes or no yes
  477. 22:31and what is the advantage of having the
  478. 22:35AP system as opposed to a human being
  479. 22:38sitting down and making this
  480. 22:41comparison the apis system is a
  481. 22:43searching database so we're able to
  482. 22:46enter a latent print into the database
  483. 22:48the first joint of the fingers and the
  484. 22:50palms and it will create a mathematical
  485. 22:53algorithm and bring back 10 candidates
  486. 22:56that the computer believes are close to
  487. 22:58the lat an impression The Examiner then
  488. 23:01is able to well then let me stop you
  489. 23:02then are you telling me that the
  490. 23:04advantage of aphis is speed yes because
  491. 23:06it can go through thousands upon
  492. 23:08thousands of fingerprints within a very
  493. 23:10short period of time right yes and if
  494. 23:13any of them are similar then it spits it
  495. 23:15out right yes but as an examiner that's
  496. 23:19not an identification correct no it's
  497. 23:22not because then that's when the the
  498. 23:24human person comes in right yes and then
  499. 23:28the human person does what with those
  500. 23:32candidates that have been spit out the
  501. 23:35examiner initially views the latent and
  502. 23:38the known impression on the screen one
  503. 23:40at a time and determines whether or not
  504. 23:42they've um they have a hit if a hit is
  505. 23:46declared then a known Exemplar that
  506. 23:49known Exemplar will be obtained by The
  507. 23:51Examiner and a one one comparison will
  508. 23:53be performance between the latent and
  509. 23:54the known The Examiner is the one who
  510. 23:56does that compar final comparison
  511. 23:59in our talk today uh one of the things
  512. 24:02that we keep referring to is that the
  513. 24:04fingerprints and we've been talking
  514. 24:05about that how about palms for example
  515. 24:08are Palms also unique to individuals or
  516. 24:11is it a situation where the only
  517. 24:13comparison that can be done is involving
  518. 24:15the fingerprints no the arrangement of
  519. 24:19of skin on all the Palmer surface of the
  520. 24:21hands is unique and so once you let's
  521. 24:25say that you
  522. 24:26have does this apis system also have the
  523. 24:30palm prints in it that can be used or
  524. 24:32not yes it does when you look at a
  525. 24:35fingerprint and you're doing this
  526. 24:36comparison are you then also able to
  527. 24:38orient it and find out what part of the
  528. 24:42uh hand is involved whether it's one of
  529. 24:45the fingers or in the Palm can you do
  530. 24:46that it depends on the quality of the
  531. 24:49the latent well let's assume it's a
  532. 24:51great quality the best quality you ever
  533. 24:52had can you do it
  534. 24:54then in many cases yes and uh if you
  535. 24:58have the Palm you can tell what part of
  536. 25:01the Palm it is then right if there are
  537. 25:03certain if there's enough information in
  538. 25:05the Palm you can use those to help
  539. 25:08determine where the latent is from so in
  540. 25:11other words are you saying that if you
  541. 25:13have a palm print you cannot tell what
  542. 25:15part of the palm print it is what part
  543. 25:16of the Palm it is there are latent
  544. 25:19Impressions that are palm prints that
  545. 25:20are very clear that you cannot tell
  546. 25:22necessarily where it originates from on
  547. 25:25the hand on the yes correct but there's
  548. 25:27some that you can right yes so you are
  549. 25:30so that's part of what you do then
  550. 25:32correct that is part of is that done out
  551. 25:34at the scene or is that done somewhere
  552. 25:36else the entry of latent into aphys and
  553. 25:39the comparison of prints is done in the
  554. 25:40lab and so that the Gathering of these
  555. 25:44latent fingerprints how is that done out
  556. 25:46at the
  557. 25:47scene a majority of the processing that
  558. 25:50we'll do at a scene in order to collect
  559. 25:52Laten prints is done with powder and
  560. 25:54lift tape and the others which indicates
  561. 25:58that may be others what are the other
  562. 26:00processes that are out there there is
  563. 26:02some chemical uh processing techniques
  564. 26:04that we can use at the scene uh
  565. 26:06depending on the type of residue that we

  567. 26:10been left in in this particular case for
  568. 26:13example was black powder the only method
  569. 26:18that was used at the scene to attempt to
  570. 26:19gather lightning prints no it was not
  571. 26:22why don't you tell me what those other
  572. 26:23processes were in this case lucco
  573. 26:26Crystal Violet and what is that
  574. 26:29that is a chemical um that is that
  575. 26:32reacts to the heem in hemoglobin to
  576. 26:34stain a dark purplish blue color if it
  577. 26:38comes into contact with it and what is
  578. 26:41the advantage of that what is the
  579. 26:43advantage of this Luc Crystal Violet
  580. 26:46lucco Crystal violet or
  581. 26:48lcv um is spec does not react with the
  582. 26:54regular constituents of fingerprint
  583. 26:55residue so if there's an impression that
  584. 26:58I believe is left potentially in oils or
  585. 27:02fats
  586. 27:03or lipids that sort of thing I would not
  587. 27:06use luuc crystal Violet lucco Crystal
  588. 27:09Violet would be used to search for
  589. 27:11potential Impressions that are left in
  590. 27:14blood for
  591. 27:16example so the value of Luco Crystal
  592. 27:19Violet is that the print may have been
  593. 27:22left in medium other than for example
  594. 27:25sweat or Oils or something like that
  595. 27:27correct that's correct and the way you
  596. 27:28sort of seem to say it it's specifically
  597. 27:30designed when you believe that perhaps
  598. 27:32the print is left in blood that's
  599. 27:35correct in this case also again as part
  600. 27:38of going to the scene lifting
  601. 27:40fingerprints and that sort of thing do
  602. 27:42you do anything with the evidence or
  603. 27:43items that are going to be taken back to
  604. 27:45the lab for future examination whether
  605. 27:47they be Laten fingerprints or whether
  606. 27:49they be anything else yes all items of
  607. 27:52evidentiary value are photographed and
  608. 27:54then collected by Meat which are then in
  609. 27:56turn impounded into our evidence section
  610. 27:58it would seem to me though that if you
  611. 28:00have all these items of evidence out
  612. 28:01there and if you're just photographing
  613. 28:03them and collecting them that you're not
  614. 28:04going to know where which is where you
  615. 28:06found something so for example if
  616. 28:08there's some shoes over there there's a
  617. 28:09gun over there how are you going to know
  618. 28:11what number what which is which the way
  619. 28:15in which we will document evidence to be
  620. 28:17collected is it will be marked typically
  621. 28:20with a an identifier such as a number we
  622. 28:23have what we call placards they look
  623. 28:26like small plastic tents that have
  624. 28:28numbers on them and we will typically
  625. 28:31put those next to an item of evidence
  626. 28:34photograph it with that placard to
  627. 28:37document how it will be identified
  628. 28:39later um that's with regard to items
  629. 28:42that you can take what about if there's
  630. 28:43an item one of the things that we've
  631. 28:44been talking about is L fingerprints or
  632. 28:46blood smears that sort of thing um how
  633. 28:48is it that do you also put a number by
  634. 28:50those or do you put a different sort of
  635. 28:52designation so that you know that what
  636. 28:53you have is something that you didn't
  637. 28:55take but you took a sample of certainly
  638. 28:58in in some cases a different type of
  639. 29:00identifier will be used in this case I
  640. 29:02used letters for those things that were
  641. 29:04photographed that could not be collected
  642. 29:07directly let me show you an exhibit you
  643. 29:10recognize exhibit
  644. 29:13249 yes I do what is
  645. 29:16it that is a diagram of a portion of the
  646. 29:20scene that I responded to which portion
  647. 29:23of the scene are we talking about it
  648. 29:25appears to be the master bedroom when
  649. 29:28it sounds like you're not sure are you
  650. 29:30sure or are you not sure yes it is it's
  651. 29:32the master bedroom closet and bathroom
  652. 29:35is this a true and accurate depiction of
  653. 29:37the scene as it existed when you were
  654. 29:40there and you conducted your work yes it
  655. 29:42is and how long were you there
  656. 29:44conducting your
  657. 29:46work we spent over three days at the
  658. 29:50crime scene when you say we it's sort of
  659. 29:51a royal thing I'm I'm not interested in
  660. 29:53what others may have done how long were
  661. 29:55you at the scene because that's what
  662. 29:56really is testifying
  663. 29:58three days all right and uh there were
  664. 30:01others that were there with you correct
  665. 30:03yes there were were there also
  666. 30:06technicians there with you yes and who
  667. 30:08else would have been there with you
  668. 30:09assisting throughout this
  669. 30:11event in what capacity in any capacity
  670. 30:15there were several detectives there at
  671. 30:17at various times um officers there was
  672. 30:21members of the biology unit of the Mesa
  673. 30:24Police Department and also another Laten
  674. 30:26print Examiner when you say uh the
  675. 30:30members of biolog biology unit what do
  676. 30:32they concentrate on uh DNA evidence and
  677. 30:36in this particular case you can see that
  678. 30:38there's a variety of numbers here and
  679. 30:41there's also red areas embodying that
  680. 30:44sort of thing is this a true and
  681. 30:45accurate depiction of all the items that
  682. 30:47were at seeing at the time that we were
  683. 30:49there during those three days in June of
  684. 30:502008

  688. 31:03this but just um your view area
  689. 31:12there where it says 44 and 24 do you see

  707. 32:02take a look at this right here what is
  708. 32:05this that's marked this 45 I mean what
  709. 32:07are we looking at there 45 is a piece of
  710. 32:11carpeting that was at the
  711. 32:13entry to the hallway leading to the
  712. 32:16master bathroom that had a large area of
  713. 32:18red staining on it that was collected
  714. 32:20and did you walk down that hallway yes
  715. 32:23and as you walk down that hallway
  716. 32:28where did it take you to the master
  717. 32:30bathroom and once in the master B
  718. 32:34bathroom where is the tub in comparison
  719. 32:37to the door as you walk in it would be
  720. 32:39to your left and is that where the body
  721. 32:42was from the body was found in the
  722. 32:44shower that was to the left yes and just
  723. 32:46just to make clear they had both a
  724. 32:48bathtub and a shower correct yes was the
  725. 32:52body found in the shower I think is what

  856. 40:0316 exhibits 8 through 16 are admitted
  857. 40:07first of all let's take a look at
  858. 40:09exhibit number six that's the one that
  859. 40:13uh we just talked
  860. 40:19about and what is this right here that
  861. 40:23is a dryer and this right here washing
  862. 40:26machine all
  863. 40:31right exhibit number eight shows us what
  864. 40:35what are we looking at
  865. 40:38here that is a reddish stain that was on
  866. 40:42top of the the edge of the washing
  867. 40:48machine exhibit uh number nine what are
  868. 40:53we looking at there that is looking at
  869. 40:55the same area of the washing machine
  870. 40:57pulled back a little bit with some label
  871. 41:00some stickers to label and identify some
  872. 41:02stains seen on the washing
  873. 41:04machine are these the reddish stains
  874. 41:06that you guys were looking at or just
  875. 41:08stains generally reddish brown
  876. 41:14stains there's a red number on there you
  877. 41:19see
  878. 41:22that I'm red I'm sorry black you see
  879. 41:25that yes um um I thought in our previous
  880. 41:29discussion we indicated that if it's
  881. 41:31something that you can't seize or that
  882. 41:34you take a swab from that you would
  883. 41:36actually would give it a
  884. 41:37letter what's going on with these ones
  885. 41:40in
  886. 41:41Black these particular stains were
  887. 41:44labeled by a member of the biology unit
  888. 41:46so that presumptive testing could be
  889. 41:49performed I wasn't involved in these
  890. 41:52labels so in other words these are
  891. 41:54labeled by somebody from the D the
  892. 41:56biology unit to see see whether or not
  893. 41:57this was blood or something right
  894. 42:04correct exhibit number 10 is a closeup
  895. 42:08of one of those ones correct yes it is
  896. 42:11and if we bring it in a little bit
  897. 42:13closer it has something to the side of
  898. 42:16it you see that I do what is that the
  899. 42:19letter B so for example then if we go to
  900. 42:22the previous
  901. 42:24exhibit there are two ones there
  902. 42:28one would be either well we can look at
  903. 42:33it we can see that they're labeled with
  904. 42:35letters also correct this one is yes and
  905. 42:39then if you take a look at the other
  906. 42:41one doesn't seem to have a letter on
  907. 42:43there though right it does
  908. 42:51not exhibit number 11 what are we uh
  909. 42:55give you a better view of that
  910. 43:03what are we looking at there that is a
  911. 43:06photograph into the washing machine when
  912. 43:08the lid was lifted during the entry
  913. 43:10photos and there are some items in there

  917. 43:27digital camera that was found inside of
  918. 43:30the washing machine and for the sake of
  919. 43:32completeness is this the way the camera
  920. 43:35was at the time that you guys went into
  921. 43:39it and started taking photographs of it
  922. 43:41yes it was and uh you were there on what
  923. 43:46dates June 10th 11th and 12th and it ran
  924. 43:51into the 13th on the 12th all right

  1467. 1:20:03Appliance the unlocking mechanism is a
  1468. 1:20:07key hole okay the locking
  1469. 1:20:12mechanism is a flat piece that's turned
  1470. 1:20:16which one was on the inside and which
  1471. 1:20:18one was on the outside of that door the
  1472. 1:20:20inside was the locking mechanism which
  1473. 1:20:23has the flat piece that turn turns and
  1474. 1:20:25the exterior door knob was the one that
  1475. 1:20:28has the unlocking key mechanism on it so
  1476. 1:20:31in order to get into that room if if it
  1477. 1:20:33had been locked from the inside would a
  1478. 1:20:35person need a
  1479. 1:20:36key yes and in order to lock it if you
  1480. 1:20:40were inside would a person need a key or
  1481. 1:20:43would they just need to turn the knob or
  1482. 1:20:45the item
  1483. 1:20:48there a key would not NE be necessary so
  1484. 1:20:53does that mean that the person could
  1485. 1:20:55just turn the little knob there or bump
  1486. 1:20:58or whatever and close it from the inside
  1487. 1:21:01and lock it

  1548. 1:25:51the way the bed was found when you were

  1679. 1:32:58looks kind of black or dark is that mold
  1680. 1:33:00or what is that this item was processed
  1681. 1:33:03in the laboratory for lat prints and you
  1682. 1:33:06indicated that there was a couple of
  1683. 1:33:08processes that could be used one of them
  1684. 1:33:09being uh powder and and the other one
  1685. 1:33:13being nuc Crystal W
  1686. 1:33:16correct those were types of processing
  1687. 1:33:19that we do at a scene right yes but in
  1688. 1:33:21this one powder was used right
  1689. 1:33:24this item was brought back to the
  1690. 1:33:26laboratory and was processed with a
  1691. 1:33:27variety of different things all right
  1692. 1:33:30and we any results
  1693. 1:33:33obtained refer to my reports
  1694. 1:33:53no no Laten prints were developed on the
  1695. 1:33:55plastic cut one of the things that you
  1696. 1:33:57told us was that there were
  1697. 1:33:58environmental factors that would affect
  1698. 1:34:00whether or not not an individual leaves
  1699. 1:34:02a lat and fingerprint do you remember we
  1700. 1:34:04discussed that earlier yes I do with
  1701. 1:34:06regard to water if water is run on an
  1702. 1:34:08item is will that affect the ability to
  1703. 1:34:10later obtain a latent fingerprint it can
  1704. 1:34:13yes why in some cases if water is run
  1705. 1:34:18over a surface it may obscure that
  1706. 1:34:20latent impression that was left behind
  1707. 1:34:22it could wash away the res res do or
  1708. 1:34:25something of that
  1709. 1:34:26nature and how about if the person is
  1710. 1:34:28turning the cup as they're doing
  1711. 1:34:31whatever it is they're doing with it
  1712. 1:34:32would that also affect whether or not
  1713. 1:34:34they might uh leave behind a usable
  1714. 1:34:37Laten fingerprint how an item is handled
  1715. 1:34:40will always affect how whether or not a
  1716. 1:34:42latent print is is Left Behind or not I
  1717. 1:34:45move for the admission

  1721. 1:35:05at it's a lower view of the victim
  1722. 1:35:08inside of the shower
  1723. 1:35:10stall and what is this right
  1724. 1:35:13here is that the wall I guess is what
  1725. 1:35:15I'm saying yes it's the wall of the
  1726. 1:35:17shower stall
  1727. 1:35:20and is his this is his right foot
  1728. 1:35:22correct
  1729. 1:35:24yes it is is that touching that wall yes
  1730. 1:35:27it is how about the left knee is that
  1731. 1:35:29also touching the wall yes and if we
  1732. 1:35:32look over here to the right uh what
  1733. 1:35:35portion of his Anatomy is that it's his
  1734. 1:35:37right knee is that touching the wall
  1735. 1:35:39also it looks like it is I don't know
  1736. 1:35:42specifically if it is or not if we go
  1737. 1:35:45back to exhibit number
  1738. 1:35:4876 his head correct yes it is is that up
  1739. 1:35:51against the um
  1740. 1:35:54portion of the the shower there yes it
  1741. 1:36:01is now exhibit 78 we're starting to see
  1742. 1:36:05first of all the victim's body here
  1743. 1:36:06correct that is the victim inside the
  1744. 1:36:08shower stall yes and two three and four
  1745. 1:36:11what what are we looking at there those
  1746. 1:36:14were some hair and fiber like materials
  1747. 1:36:16that were found around the shower stall
  1748. 1:36:19that were designated to be collected as
  1749. 1:36:20items of
  1750. 1:36:21evidence and exhibit number 79 we're
  1751. 1:36:25also looking at this area here right two
  1752. 1:36:29is actually just indicating the hairs
  1753. 1:36:31that you see here on the floor right but
  1754. 1:36:34you can see the red staining in this
  1755. 1:36:37Photograph and this is what is this the
  1756. 1:36:39trim right here baseboard trim of some
  1757. 1:36:42kind yes and there's also some staining
  1758. 1:36:44up here correct yes and there's also
  1759. 1:36:46staining here
  1760. 1:36:49yes exhibit number 80 is
  1761. 1:36:56what that's a fiberlike material that
  1762. 1:36:59was found on the floor in the bathroom
  1763. 1:37:01that was collected as item number three
  1764. 1:37:05lb and exhibit number 82 we're now
  1765. 1:37:08looking at what you can see a small
  1766. 1:37:11portion of the shower stall with the
  1767. 1:37:12victim inside the bathtub and a doorway
  1768. 1:37:16leading into what I call the toilet room
  1769. 1:37:18the toilets contained in that room
  1770. 1:37:20there's a door and then a portion of the
  1771. 1:37:23bathroom B um to the right side of the
  1772. 1:37:25photograph what's this right here it's a
  1773. 1:37:31towel take a look at exhibit number 228
  1774. 1:37:35see if you recognize it yes I recognize
  1775. 1:37:37it what is it this is that same towel
  1776. 1:37:40from the master bathroom was there one
  1777. 1:37:42or two towels
  1778. 1:37:44there I believe there's only one when
  1779. 1:37:47you say you believe it means you're not
  1780. 1:37:48sure I why don't you go ahead and open
  1781. 1:37:49it and take a look at it and make sure

  1805. 1:39:40they from do the labels match how about

  1819. 1:40:22was seen on the wall by by the B by the
  1820. 1:40:24shower
  1821. 1:40:27stall exhibit number 84 we're looking at
  1822. 1:40:31what that is a view of the bathtub
  1823. 1:40:33inside the master bath bathroom and this
  1824. 1:40:35room was what again I called it the
  1825. 1:40:37toilet room it's the room that contained
  1826. 1:40:39of the toilet in the bathroom and what
  1827. 1:40:40is this right
  1828. 1:40:41here that is red staining reddish brown
  1829. 1:40:44staining that was seen on the on the
  1830. 1:40:46wall and or door jam I may have to show
  1831. 1:40:48you the photograph because of the glare
  1832. 1:40:50on this one you know what this is down
  1833. 1:40:52here
  1834. 1:40:54if you want I'll bring the photograph up
  1835. 1:40:56there that's a a bath mat

  1846. 1:41:31and down here in the ground is more
  1847. 1:41:33reddish brown substance and this right
  1848. 1:41:36here it's also a reddish brown stain on
  1849. 1:41:39the mat correct correct and this right
  1850. 1:41:43here is what right there additional
  1851. 1:41:47staining the the towels that we looked
  1852. 1:41:49at are where are they in relationship to
  1853. 1:41:51this staining right here where I'm
  1854. 1:41:52pointing too the towel that is in front
  1855. 1:41:55of me is directly above maybe slightly
  1856. 1:41:58further back from that it's it's hanging
  1857. 1:42:01from that wall in the
  1858. 1:42:05photograph exhibit uh
  1859. 1:42:0986
  1860. 1:42:12um what are we looking at here that's a
  1861. 1:42:15view of some of the staining on the
  1862. 1:42:17walls and tile floor of the master
  1863. 1:42:19bathroom showing the entry into the
  1864. 1:42:21toilet room and you can see see more of
  1865. 1:42:24the bathroom itself and this up here
  1866. 1:42:27that's this towel
  1867. 1:42:28here exhibit uh 87 is
  1868. 1:42:35what that's a more mid-range close-up
  1869. 1:42:38view of the reddish staining that's on
  1870. 1:42:40the door jam and some of the floor
  1871. 1:42:42leading into the toilet room you see
  1872. 1:42:45that right back there yes I do what is
  1873. 1:42:48that more reddish brown staining that
  1874. 1:42:51was on the bottom bottom pedestal of the
  1875. 1:42:54toilet

  1884. 1:43:23including staining shows the sink area
  1885. 1:43:26and and the interior of the linen closet
  1886. 1:43:28that's also in the bathroom are they
  1887. 1:43:30true and accurate dep piics of the scene
  1888. 1:43:31when you worked on it back in June of
  1889. 1:43:332008 Yes they
  1890. 1:43:42are8 objection exhibits 88 through 116
  1891. 1:43:46are
  1892. 1:43:48admitted start with 88 and we are
  1893. 1:43:52looking at what here that's a view of
  1894. 1:43:55the toilet inside of the room the toilet
  1895. 1:44:00room 89 we're looking at what now that's
  1896. 1:44:05showing the reddish staining that's on
  1897. 1:44:07the pedestal of that toilet and that
  1898. 1:44:09would be right there yes it yes it is
  1899. 1:44:13number 90 is
  1900. 1:44:15what a closer view of those those
  1901. 1:44:19stains and these are at right here
  1902. 1:44:21correct yes they are
  1903. 1:44:2591
  1904. 1:44:29is what is this here this is showing
  1905. 1:44:32staining on both the tile floor and the
  1906. 1:44:35wall um you can see the entry to the
  1907. 1:44:37toilet room on the left side of the
  1908. 1:44:39photograph and that's the wall that
  1909. 1:44:42would be along the side of the toilet
  1910. 1:44:44room that we've seen in other
  1911. 1:44:45photographs and this is is this the wall
  1912. 1:44:47where the towel is yes and this is the
  1913. 1:44:50staining that you're talking about yes
  1914. 1:44:52that's correct
  1915. 1:44:55and is this also a stain here on the
  1916. 1:44:56left yes it
  1917. 1:45:00is 92 if we go to the upper right what
  1918. 1:45:03do we see up here that's this towel and
  1919. 1:45:11point 93 is what that is a view of one
  1920. 1:45:15of the corners of the bathroom from
  1921. 1:45:18around the area where the shower stall
  1922. 1:45:20would be from that direction to the
  1923. 1:45:22corner of bathroom and what is this
  1924. 1:45:24right here the sinks within the
  1925. 1:45:28bathroom 94 shows us what some of the
  1926. 1:45:33floor in that master bathroom the walls
  1927. 1:45:36the reddish staining and um two scales
  1928. 1:45:39that were inside that
  1929. 1:45:42bathroom
  1930. 1:45:4495 that is a mid-range photograph of one
  1931. 1:45:47of the scales with placard number 15
  1932. 1:45:49because that item was collected as 15 lb
  1933. 1:45:52by me
  1934. 1:45:56and Number
  1935. 1:45:5996 that uh depicts the the scale and
  1936. 1:46:03also what was beyond the the the vanity
  1937. 1:46:07in the bathroom containing the sink so
  1938. 1:46:09you can see a a trash can and some
  1939. 1:46:11staining near that scale and is this
  1940. 1:46:13staining here too or not I don't
  1941. 1:46:17recall 97
  1942. 1:46:19is
  1943. 1:46:21what that is view of the vanity and
  1944. 1:46:24sinks in the master
  1945. 1:46:25bathroom and you found this this was
  1946. 1:46:28open when you were there
  1947. 1:46:30correct to the best of my recollection
  1948. 1:46:34yes 98 what are we looking at here that
  1949. 1:46:39is reddish brown staining and reddish
  1950. 1:46:41brown substance that was inside and on
  1951. 1:46:43top of the sink in the master bathroom
  1952. 1:46:5499 is what what are we looking at
  1953. 1:46:59here that's another view of the right
  1954. 1:47:02side sink in the master bathroom with
  1955. 1:47:04staining there's also scales in the
  1956. 1:47:07photograph that were placed in order to
  1957. 1:47:10um do additional documentation
  1958. 1:47:11photographs of that staining within the
  1959. 1:47:14mirror and sink
  1960. 1:47:19areas and 100 is what
  1961. 1:47:24another view of of the same staining
  1962. 1:47:27with the scales for reference and it
  1963. 1:47:30also shows us the edge here doesn't it
  1964. 1:47:33yes it does and it does have red does it
  1965. 1:47:35have red staining on it yes it does
  1966. 1:47:38there is something here on the upper
  1967. 1:47:39left what is that that is a letter
  1968. 1:47:43marker D to to indicate which
  1969. 1:47:48area was photographed
  1970. 1:47:53and exhibit 101 shows us
  1971. 1:47:57what a closer view of the staining that
  1972. 1:47:59would be within that D area or
  1973. 1:48:08quadrant
  1974. 1:48:10102 that's an overhead view of the sink
  1975. 1:48:14on the right side and the staining
  1976. 1:48:16within on top of the sink and countertop
  1977. 1:48:19this looks like a wipe pattern are you
  1978. 1:48:21familiar with like wiping or not I I
  1979. 1:48:24don't do blood spatter okay
  1980. 1:48:33interpretation
  1981. 1:48:36103 shows us what
  1982. 1:48:38now a closer view of some of the
  1983. 1:48:41staining on the sink that's actually
  1984. 1:48:43inside the sink with the outlet valve
  1985. 1:48:46there right that's correct it was both
  1986. 1:48:48inside the sink and on top of the sink
  1987. 1:49:01104 what are we looking at there that's
  1988. 1:49:04another overhead view of the staining on
  1989. 1:49:06the sink and the the vanity top with
  1990. 1:49:08some scales and a letter and number
  1991. 1:49:12designators this bottle that's here do
  1992. 1:49:15you see whether or not it has any
  1993. 1:49:18staining on it can you
  1994. 1:49:20tell I see staining around it I'm not
  1995. 1:49:22sure if there's any on the bottle take a
  1996. 1:49:24look at exhibit 104 the
  1997. 1:49:27deer
  1998. 1:49:32okay it appears that they're standing on
  1999. 1:49:34the bottle
  2000. 1:49:36yes the bottle is not knocked over right
  2001. 1:49:39no it's
  2002. 1:49:42not and
  2003. 1:49:47105 we're looking at these patterns
  2004. 1:49:50whatever they may be on a different
  2005. 1:49:52portion of the sink right
  2006. 1:49:56yes in terms of coloring these on the
  2007. 1:49:59left look a lot darker than the ones on

  2042. 1:51:53larger stain yes and were these also
  2043. 1:51:57stains

  2045. 1:52:01are and while I have this this of course
  2046. 1:52:08is what's this white thing here that's
  2047. 1:52:12the door to that closet in the master
  2048. 1:52:14bathroom do you know what this is right
  2049. 1:52:17here yes I do I'm going to bring it in a
  2050. 1:52:21little bit
  2051. 1:52:23what is that that is a cartridge casing
  2052. 1:52:26that was found on the floor in the
  2053. 1:52:28master bathroom and did you seiz that
  2054. 1:52:30yes I
  2055. 1:52:46did want you to take a look at the
  2056. 1:52:49exhibit number 260
  2057. 1:53:12what is it that's the cartridge casing
  2058. 1:53:14that I collected as number one

  2072. 1:54:02believe it's the caliber but I don't
  2073. 1:54:03work in fire that's not your area
  2074. 1:54:06okay let's look a little bit at a wider
  2075. 1:54:10view of this that's the
  2076. 1:54:13casing and then we've looked at
  2077. 1:54:17this area

  2081. 1:54:34here that's the cartridge casing and
  2082. 1:54:37this up here
  2083. 1:54:39is the right side
  2084. 1:54:47sink exhibit number 110 shows us what
  2085. 1:54:52that's a closer view of the cartridge
  2086. 1:54:53casing on the bathroom floor and it also
  2087. 1:54:56shows us that there's what you see this
  2088. 1:54:58right up
  2089. 1:54:59here there's red staining and red
  2090. 1:55:01substance all over the floor as
  2091. 1:55:05well and exhibit 111 shows us a closer
  2092. 1:55:09view of the cartridge
  2093. 1:55:11casing and this right here is just some
  2094. 1:55:13red staining correct yes
  2095. 1:55:22it may be stating the obvious but I'm
  2096. 1:55:26going to ask you to the naked eye your
  2097. 1:55:30eye and you were
  2098. 1:55:31there is there any
  2099. 1:55:35staining on the top of this casing
  2100. 1:55:39that's in this red
  2101. 1:55:42stain not that I
  2102. 1:55:47see see that it's a little blurry but I
  2103. 1:55:51I still don't see any red standing on
  2104. 1:55:52the
  2105. 1:56:00top exhibit number

  2107. 1:56:07starting with this corner here what is
  2108. 1:56:09that that's the sink or a portion of the
  2109. 1:56:11sink pedestal and this down here is
  2110. 1:56:15that's the cartridge casing and it's
  2111. 1:56:17photographed with evidence placard
  2112. 1:56:18number one and up here that's a to
  2113. 1:56:23and down here that's the hallway that
  2114. 1:56:26leads from the master bedroom to the
  2115. 1:56:27master bathroom or vice versa and right
  2116. 1:56:30here that is the doorway leading from
  2117. 1:56:33the bathroom into the
  2118. 1:56:35closet exhibit uh 113 is the staining
  2119. 1:56:40and what a view a mid-range view of item
  2120. 1:56:44number one lb with placard one and it
  2121. 1:56:47shows some staining there also right it
  2122. 1:56:50does 114
  2123. 1:56:53is the placard and a a closeup of the
  2124. 1:56:56casing correct yes it
  2125. 1:56:58is exhibit number
  2126. 1:57:02115 shows us the box
  2127. 1:57:06right correct and then it shows us the
  2128. 1:57:10items in the closet uh number 11 what is
  2129. 1:57:14number
  2130. 1:57:1711 it's a USB thumb drive that was a
  2131. 1:57:21Targus brand that was collected from
  2132. 1:57:22inside that that closet a what now a
