  1. 0:00so it's been almost 7 years now since
  2. 0:02Travis Alexander was killed finally we
  3. 0:04are getting to the point where we're
  4. 0:05going to have a sentence in place for
  5. 0:08Jody Aras it's an unusual case because
  6. 0:10it's taken so long to bring it to trial
  7. 0:13it's cost so much money and I think a
  8. 0:15lot of people are wondering why why is
  9. 0:18this trial dragged on for so long when
  10. 0:20other murder trials don't necessarily
  11. 0:22last that long that's a great I mean
  12. 0:24that's a great question but we have to
  13. 0:25go back to the fact that we're doing
  14. 0:27this over again so the jury hung on the
  15. 0:31penalty phasee under the law the state
  16. 0:34elected and had the the right to
  17. 0:36basically present its evidence again so
  18. 0:38that added now is this the typical do
  19. 0:40all murder trials do all penalty phases
  20. 0:42go this long they don't they don't
  21. 0:44conservative conservatively it's about a
  22. 0:4760-day uh 60-day maybe even 90 days um
  23. 0:51complex evidence you have computer
  24. 0:52evidence you may have experts that are
  25. 0:54going to testify you may have a
  26. 0:56multitude of uh mitigating witnesses
  27. 0:59that are going to that are come forth
  28. 1:00and testify here though again I think
  29. 1:04you have issues here with did the judge
  30. 1:06really have the right control the right
  31. 1:09control measures in place to make sure
  32. 1:12this is moving along at a pace that it
  33. 1:13should go judges are not supposed to be
  34. 1:15necessarily conscientious of the
  35. 1:16spotlight or the or or the attention
  36. 1:19that's being played publicly in this in
  37. 1:20in any case because they're supposed to
  38. 1:22adjudicate everything pretty much the
  39. 1:24same way but judges have to be
  40. 1:26conscientious of that and and perhaps
  41. 1:29does this judge uh look back in this and
  42. 1:32say I I allowed a lot of things to
  43. 1:33happen in this trial because there was
  44. 1:35so much attention being played to it
  45. 1:37this judge is human just like everyone
  46. 1:38else she sits there on the bench um
  47. 1:41there's no doubt that as she spans
  48. 1:44across that jury room she's seen a
  49. 1:46camera op to her far right she's seen
  50. 1:48reporters that have just absolutely
  51. 1:50taken every seat in that courtroom so
  52. 1:52that does it it has to play on her and
  53. 1:54in making sure that she's viewed as
  54. 1:58giving both sides opportunity to present
  55. 2:00their evidence and first and foremost I
  56. 2:02think that um this judge is taking that
  57. 2:04position she if if we could interview
  58. 2:07her I think this judge would say I
  59. 2:09wanted to make sure that both sides had
  60. 2:11an opportunity to present their evidence
  61. 2:13because we're talking about life or
  62. 2:15death here yeah when we look at some
  63. 2:17other high-profile cases you can take
  64. 2:19the American Sniper trial in
  65. 2:20Stevensville Texas me two weeks week and
  66. 2:23a half somewhere in that nature so the
  67. 2:25judge doesn't necessarily have to do
  68. 2:27this um what I don't think anybody wants
  69. 2:30to see this kind of circus happen again
  70. 2:32so so what do we do to prevent it in
  71. 2:34terms of our Judicial System you know
  72. 2:35that's a great that's a great point
  73. 2:37there are some judges that from the from
  74. 2:38the outset in pre-trial motions when
  75. 2:41it's clear that a judge that a matter is
  76. 2:42going to trial they will lay out for you
  77. 2:45a calendar and say Here's when we're
  78. 2:47starting and here's where we're going to
  79. 2:48be done and if your Witnesses are not
  80. 2:50ready if you're having issues getting
  81. 2:52your witnesses to court too bad and
  82. 2:55we're going to keep moving and so uh
  83. 2:58maybe a little more in regard regards to
  84. 3:00um keeping people on task that would
  85. 3:02that would go a long way but again first
  86. 3:04and foremost everybody is especially
  87. 3:06when we're dealing with the death
  88. 3:07penalty case due process is such an
  89. 3:09important concept the the court has to
  90. 3:11in the back of its mind um recognize
  91. 3:14that if I don't allow this to come in
  92. 3:16now it's only going to come in later on
  93. 3:18in appeal we we've allowed all kinds of
  94. 3:20things to come into this and the costs
  95. 3:22have run up tremendously too I don't
  96. 3:23know if we have the final total but even
  97. 3:25after the first trial it was in excess
  98. 3:27of $2 million probably approaching three
  99. 3:30or more should cost be a factor in in
  100. 3:34determining how these trials are
  101. 3:36adjudicated I think if you ask the
  102. 3:38lawyers no it shouldn't and and the
  103. 3:41reason is because this is such an
  104. 3:42important issue this is again this is
  105. 3:45our judicial process and the concern is
  106. 3:48that if we do allow cost to come in are
  107. 3:50they going to cut Corners are they not
  108. 3:52going to call experts that otherwise
  109. 3:54would have allowed the jury to make a
  110. 3:55determination an important determination
  111. 3:57so that's I mean that's a real concern
  112. 4:00now recognizing if we allow every death
  113. 4:02penalty case to run in the $3 million
  114. 4:05figures um we're going to go bankrupt
  115. 4:07our because we're the ones paying the
  116. 4:08bill here absolutely and so I think what
  117. 4:11you're going to see is you're going to
  118. 4:12see the state Sit down you're going to
  119. 4:14see the prosecutors you're going to see
  120. 4:16defense attorneys sit down and evaluate
  121. 4:18this is going to be a lesson we're going
  122. 4:20to learn many lessons from this case
  123. 4:21going forward in the Years um moving
  124. 4:24away from this trial and one of the big
  125. 4:26questions is going to be how can we
  126. 4:27avoid this issue and it may be here's
  127. 4:29your budget this is what you can spend
  128. 4:31for this and if you deviate from this
  129. 4:34too bad and or at least having more
  130. 4:36judicial oversight in regards to those
  131. 4:39costs great Hector thanks appreciate it
