I Warned HOA 3 Times "My Lake Has Alligators" — They Opened It Anyway, I Watched From My Porch — Transcript

- 0:00Get out of my office.
- 0:02You're tracking filth everywhere.
- 0:05>> Ma'am, I came to warn you.
- 0:07That lake has alligators.
- 0:10>> Your disgusting little swamp, nobody
- 0:13asked.
- 0:16>> There's an 11-ft bullgator in that
- 0:18water. If you put families down there,
- 0:22>> Oh, stop.
- 0:24>> She looked me up and down like something
- 0:26rotting on her doorstep.
- 0:29>> You reek like cattle.
- 0:32This is a half-million-dollar community.
- 0:37Frankly, I'm embarrassed you're sitting
- 0:39in this room.
- 0:41>> I'm begging you, ma'am.
- 0:42Please don't do this.
- 0:45>> Beg all you want.
- 0:46We're cutting your fence.
- 0:48We're building that beach. And some
- 0:50backwards fairy tale about a swamp
- 0:53lizard isn't going to stop a thing.
- 0:55>> That was warning two.
- 0:57I gave her three.
- 0:58She built it anyway. Eight days later, I
- 1:01poured my coffee, sat on my porch, and
- 1:03watched.
- 1:04Have you ever watched karma crawl out of
- 1:06the water on four legs and claim what's
- 1:08hers? Because you are about to drop a
- 1:10comment, hit that like, and let me take
- 1:13you back to where this whole mess
- 1:14started.
- 1:15Stay with me on this one. Let me take
- 1:18you back to how this started. My name's
- 1:20Wade Colton, and I was born on this
- 1:22land, not in a hospital, actually on
- 1:24this land.
- 1:26My mother went into labor 3 weeks early
- 1:28during a thunderstorm that knocked the
- 1:29power out. And by the time my father got
- 1:32the truck running, the road was flooded.
- 1:33So, a neighbor who'd been a Navy
- 1:35Corpsman delivered me on the kitchen
- 1:36floor of the ranch house while lightning
- 1:39turned the windows white every 10
- 1:41seconds.
- 1:42My father always said I came into the
- 1:44world the same way I'd live in it,
- 1:45stubborn, loud, and refusing to leave
- 1:48the property.
- 1:49My grandfather, Cecil Colton, bought 80
- 1:52acres in Polk County, Florida, in 1961.
- 1:55Cattle land that had been in continuous
- 1:57agricultural use since the 1920s.
- 2:01Sandy loam soil over a limestone shelf
- 2:04flat enough for pasture, rolling enough
- 2:06for drainage, and anchored at the center
- 2:09by a 15-acre spring-fed lake that the
- 2:12original survey simply called the lake
- 2:15because in 1961 nobody thought a body of
- 2:17water on a cattle ranch needed a
- 2:19marketing name.
- 2:21Over the years it became Colton Lake,
- 2:23which wasn't official and wasn't on any
- 2:25map, but that's what the neighbors
- 2:27called it and that's what the county
- 2:28clerk's office penciled into the margin
- 2:30of the tax rolls in 1974, so it stuck.
- 2:35The lake is spring-fed and artesian vent
- 2:37at the north end pushes clear water up
- 2:39through the limestone at a steady rate
- 2:41that keeps the level stable even in
- 2:43drought years.
- 2:45At the north shore the water is gin
- 2:47clear over a white sand bottom and you
- 2:49can see bluegill and largemouth bass
- 2:52cruising 6 ft down like fish in an
- 2:54aquarium.
- 2:56Farther south the bottom turns to clay
- 2:58and muck, the water darkens to tea color
- 3:00from tannins, and bald cypress trees
- 3:03ring the shoreline with root systems so
- 3:05tangled they look like wooden fists
- 3:07gripping the bank.
- 3:09Spanish moss hangs from every branch.
- 3:12Great blue herons stand motionless on
- 3:14fallen logs.
- 3:15Osprey work the deeper pools in the
- 3:17afternoon hitting the surface feet first
- 3:20and coming up with fish in their talons
- 3:22scattering silver drops of water that
- 3:24catch the sun like thrown coins.
- 3:27At dusk the barred owls start calling
- 3:29that low liquid who cooks for you that
- 3:32rolls across the water and sounds like
- 3:34the lake itself is asking a question.
- 3:37My wife Jolene and I have lived in the
- 3:39ranch house rebuilt in '92 after
- 3:42Hurricane Andrew tore the original roof
- 3:44off and dropped a live oak through the
- 3:46living room for 32 years.
- 3:49Jolene was the Polk County Clerk of
- 3:50Courts for 24 years before she retired.
- 3:54Quiet woman, sharp as a box cutter, and
- 3:56twice as dangerous if you tried to file
- 3:58something improperly.
- 4:01She runs the house, the books, and my
- 4:02schedule with the efficiency of someone
- 4:04who managed 14,000 court filings a year
- 4:08and never lost one.
- 4:10The house sits on a limestone rise about
- 4:12200 yards north of the lake.
- 4:14The front porch faces south, looking
- 4:16straight across the water.
- 4:19On a clear morning, you can sit in the
- 4:21rocker with a cup of coffee and see the
- 4:23entire lake, the cypress line, the heron
- 4:26rookery, the dark water going amber in
- 4:29the sunrise, and every living thing in
- 4:31it.
- 4:32That includes the alligators.
- 4:34My grandfather used to say, "You don't
- 4:37own a lake in Florida. You share it with
- 4:39whatever was here first, and what was
- 4:41here first has more teeth than you."
- 4:44He wasn't being colorful. He was being
- 4:46accurate.
- 4:47Colton Lake has had alligators in it for
- 4:49as long as anyone in my family can
- 4:51remember, and since my family goes back
- 4:53to 1961 on this land, and the alligators
- 4:56go back to the Cretaceous period,
- 4:58they've got seniority.
- 5:00At any given time, the lake supports six
- 5:03to eight American alligators, Alligator
- 5:05mississippiensis if you want the Latin,
- 5:08though I've never heard one respond to
- 5:10it.
- 5:11They range from 4-ft juveniles to mature
- 5:13adults in the 8-9 ft range, and they
- 5:16occupy the lake the way any territorial
- 5:18predator occupies its range, with
- 5:20established basking sites, patrol
- 5:23routes, and a clear hierarchy enforced
- 5:25by size aggression, and the occasional
- 5:27midnight bellowing contest that sounds
- 5:30like someone started a Harley-Davidson
- 5:32underwater.
- 5:34The big one, the one at the top, I call
- 5:36Judge.
- 5:37Judge is an 11-ft bull gator with a head
- 5:40wider than a truck tire and a jaw lined
- 5:42with 80 teeth that interlock like the
- 5:44world's most efficient zipper.
- 5:47He's been in the lake for at least 18
- 5:49years. I first logged him in my field
- 5:51notebook in 2006 when he was already
- 5:54well over 9 ft and clearly dominant.
- 5:57He's dark olive across the back, almost
- 6:00black when he's wet, with pale scarring
- 6:02along his flanks from territorial fights
- 6:05he's won. So many times the other males
- 6:07don't bother challenging him anymore.
- 6:10There's a deep notch in his tail, chunk
- 6:12missing from the left side about 2 ft
- 6:15from the tip that I've always assumed
- 6:17came from a fight with the second
- 6:18largest male in the lake back when Judge
- 6:20was still proving his claim.
- 6:23That was years ago.
- 6:25Nobody argues with Judge now.
- 6:27I call him Judge because of the way he
- 6:28moves, slow, deliberate, unhurried. Like
- 6:33every decision has been considered from
- 6:35every angle before he commits.
- 6:37He doesn't lunge. He doesn't startle. He
- 6:40slides into the water and out of it with
- 6:42a patience that makes you understand in
- 6:44your bones why his species has survived
- 6:47for 65 million years while everything
- 6:49else came and went.
- 6:52He basks on the south bank every morning
- 6:54where the clay holds the sun's heat from
- 6:56the day before.
- 6:57He submerges to the deep water near the
- 6:59cypress bend by noon.
- 7:01He patrols the perimeter at dusk,
- 7:03cruising just below the surface with
- 7:05only his eyes and the ridge of his snout
- 7:07visible, leaving a V wake so subtle
- 7:10you'd miss it if you blinked.
- 7:12He's predictable. He's territorial. And
- 7:14he's massive.
- 7:16I've never had a problem with Judge
- 7:18because I respect the lake's rules. I
- 7:20don't swim after dark. I keep cattle
- 7:22fenced 50 yards from the water's edge. I
- 7:25fish the north end where the spring fed
- 7:27water is clear and you can see the
- 7:29bottom. And I never wade deeper than my
- 7:31knees.
- 7:33Over the years I've pulled more than one
- 7:34calf carcass from the shallows, Judge's
- 7:37tax I call it, cost of doing business
- 7:39when your pasture shares a fence line
- 7:41with an apex predator.
- 7:43The lake isn't dangerous if you
- 7:45understand it. It's only dangerous if
- 7:47you don't.
- 7:49In 2020, the 120-acre ranch to the east,
- 7:52owned by the Kimball family who'd been
- 7:54trying to sell since old Roy Kimball's
- 7:56knees gave out in 2017, was bought by a
- 7:59developer out of Tampa named Meridian
- 8:01Communities.
- 8:03Within 18 months, they'd clear-cut the
- 8:05live oaks, graded the pastures flat, and
- 8:08built Palmetto Lake Estates.
- 8:10144 homes, starting price 425, tile
- 8:14roofs, three-car garages, zero lot line
- 8:17setbacks, community fitness center,
- 8:19paved walking trails with solar-powered
- 8:21bollard lights, and an HOA with monthly
- 8:24dues of $385,
- 8:26and bylaws so thick they shipped with
- 8:28the closing documents in a separate box.
- 8:31The marketing was heavy.
- 8:33Billboards on Highway 17, full-page ads
- 8:36in the Lakeland Ledger, a website with
- 8:38drone footage and soft piano music, and
- 8:41the tagline, "Florida lakeside living at
- 8:43its finest."
- 8:45Every brochure featured sunset photos of
- 8:47a lake my lake with the light going gold
- 8:50across the water and cypress silhouettes
- 8:52framing the horizon like a nature
- 8:53documentary.
- 8:55One rendering showed kayaks on the
- 8:57water.
- 8:58My water. On my lake.
- 9:00Another showed a family on a dock with
- 9:02fishing poles. There was no dock. There
- 9:05was no family. There was Judge somewhere
- 9:07below the surface doing what he'd been
- 9:08doing since before the marketing team
- 9:10was born.
- 9:12I called the developer's office and told
- 9:13them the lake was private property, and
- 9:15they had no right to use it in
- 9:17advertising.
- 9:18A marketing coordinator named Brittany
- 9:20with an upbeat phone voice told me
- 9:22they'd adjust the imagery going forward.
- 9:26They didn't.
- 9:27By the end of 2021, all 144 homes were
- 9:31sold. Most buyers were transplants. New
- 9:34Jersey, Ohio, Virginia, Georgia. Good
- 9:37people mostly. Young families, retirees.
- 9:40The kind of people who see a Florida
- 9:42lake on a brochure and think beautiful
- 9:44without once thinking about what lives
- 9:46in it.
- 9:48Then, Vanessa Langford became HOA
- 9:50president.
- 9:52Vanessa was 46, originally from Fairfax,
- 9:55Virginia.
- 9:56Her husband, Keith, was a defense
- 9:58contractor who worked remote and spent
- 10:00most of his day in a home office on Zoom
- 10:02calls with people at the Pentagon.
- 10:05She had a Virginia real estate license
- 10:07she'd never actively used and a
- 10:09personality built for running things.
- 10:11Specifically running things her way.
- 10:15Brunette highlights that framed her face
- 10:16like parentheses.
- 10:18White Range Rover she washed every
- 10:20Sunday with a detailing kit that cost
- 10:22more than my monthly feed bill.
- 10:24Sunglasses that probably had a designer
- 10:26name I couldn't spell and a price tag I
- 10:28wouldn't believe.
- 10:30She ran the HOA the way certain people
- 10:32run small countries with total
- 10:34conviction that her vision was the only
- 10:36one that mattered and anyone who
- 10:38disagreed simply hadn't been educated
- 10:40yet.
- 10:41In her first year, she fined a retired
- 10:43postal worker for having a garden pot
- 10:45that disrupted the entryway aesthetic
- 10:47silhouette.
- 10:49She ordered a family to remove a
- 10:50backyard swing set because it was
- 10:52architecturally inconsistent with the
- 10:54community's visual covenant.
- 10:56She sent a certified letter to an
- 10:5882-year-old veteran named Hank Pressler
- 11:00demanding he remove an American flag
- 11:02because it was not the approved shade of
- 11:05navy per the community color palette.
- 11:07Hank told her she could come take it
- 11:09down herself and he'd be waiting on the
- 11:11porch with his dog and his opinion.
- 11:14She didn't come.
- 11:15But she didn't stop. Vanessa was the
- 11:17kind of woman who confused taste with
- 11:19authority and control with community
- 11:21service.
- 11:23And from the day she took over, she had
- 11:24her eye on my lake.
- 11:26It started with a letter. Official
- 11:28Palmetto Lake Estates HOA letterhead.
- 11:31Embossed cream cardstock, the kind of
- 11:33paper that feels like it costs more per
- 11:35sheet than what I pay per bale of hay.
- 11:38Community enhancement proposal lake
- 11:40access initiative.
- 11:42The letter outlined a plan to create a
- 11:44community lakefront recreation area on
- 11:47the south shore of Colton Lake. A 40-ft
- 11:50floating dock, a graded sand beach, a
- 11:53kayak launch, wooden benches, a fire
- 11:56pit, and a paved walking path connecting
- 11:58to the subdivision's existing trail
- 12:00system.
- 12:01The letter acknowledged that the lake
- 12:03was situated on adjacent private
- 12:05property, but described it as a shared
- 12:08natural resource and cited community
- 12:11benefit and property value enhancement
- 12:13as justification for pursuing an access
- 12:16arrangement.
- 12:17I drove to the HOA office, a model home
- 12:20converted into a clubhouse with recessed
- 12:23lighting, engineered hardwood, and a
- 12:25reception desk that looked like a
- 12:26boutique hotel lobby.
- 12:28I brought my deed, my survey plat with
- 12:31boundaries highlighted in yellow, and 63
- 12:34years of property tax receipts showing
- 12:36continuous Colton family ownership since
- 12:381961.
- 12:40I sat across from Vanessa at a
- 12:42conference table that smelled like
- 12:44eucalyptus candles and explained calmly
- 12:46and specifically that Colton Lake was
- 12:48private property.
- 12:50There were no easements, no public
- 12:52access rights, no shared use agreements,
- 12:54and no legal mechanism by which an HOA
- 12:57could claim recreational access to a
- 12:59body of water on someone else's land.
- 13:02Then, I told her about the gators.
- 13:05Ms. Langford, that lake has alligators.
- 13:08At least six that I can confirm,
- 13:09probably eight.
- 13:11The biggest one is 11-ft long. I've
- 13:13watched him pull a white-tail deer off
- 13:15the bank by its throat.
- 13:17I've seen what he does to a 60-lb calf
- 13:19that wanders too close to the water.
- 13:22If you put a dock on that shoreline and
- 13:23start sending families down there with
- 13:25their children and their dogs.
- 13:28She held up one manicured hand.
- 13:30"Mr. Colton, we appreciate your local
- 13:33knowledge, but our homeowners purchased
- 13:35properties with the expectation of
- 13:36lakefront amenities.
- 13:38The lake enhances the value of this
- 13:40entire community.
- 13:42I'm sure we can find a solution that
- 13:44works for everyone."
- 13:46"The solution is to stay away from the
- 13:47lake."
- 13:49"That's not really a solution. That's
- 13:50just a refusal."
- 13:52"Man, when someone tells you there's a
- 13:54man-eater in the water, refusal is the
- 13:56smart answer."
- 13:58She thanked me for my time,
- 14:00shook my hand with a grip that was firm,
- 14:02the way a handshake is firm when the
- 14:04person has already decided you don't
- 14:06matter.
- 14:07I left my documentation on the table.
- 14:09She didn't open any of it.
- 14:11That was warning one.
- 14:143 months later, the HOA board held a
- 14:16community meeting to discuss what they
- 14:18were now calling lake access phase two.
- 14:22The agenda item was titled "Realizing
- 14:24Our Lakefront Vision."
- 14:26I attended, stood in the back row during
- 14:28the presentations.
- 14:30Vanessa had put together a slideshow
- 14:32with aerial photos of the lake, artist
- 14:34renderings of the proposed dock and
- 14:36beach, and a bar chart showing projected
- 14:38property value increase from lakefront
- 14:41amenities that I'm fairly sure was
- 14:43pulled from thin air and formatted in
- 14:45PowerPoint.
- 14:46During the comment period, I walked to
- 14:48the front of the room.
- 14:50106 residents, folding chairs, air
- 14:53conditioning losing its fight with
- 14:55Florida evening, and a room full of warm
- 14:57bodies.
- 14:58I was carrying a Manila folder. I opened
- 15:01the folder and held up photographs,
- 15:03printed 8 by 10 full color.
- 15:05The first was Judge basking on the south
- 15:07bank in morning light, 11 ft of armored
- 15:10reptile with his jaw cracked open
- 15:12showing 80 teeth. His body so wide
- 15:15across the shoulders, he cast a shadow
- 15:17the size of a door.
- 15:19The second was a 7-ft female I called
- 15:22Mama, photographed from my dock, her
- 15:24body half submerged near a cypress root
- 15:27where she'd built a nest, mound of mud
- 15:29and vegetation the previous spring.
- 15:32The third was a trail camera still from
- 15:35the South Meadow timestamped 2:14 a.m.
- 15:38A 6-footer crossing the open ground
- 15:40between the lake and the cattle pond,
- 15:42eyes glowing white in the infrared
- 15:44flash, like a demon walking through the
- 15:46grass.
- 15:48This is what lives in that lake, I said.
- 15:51These are not stock photos. I took them
- 15:53from my dock and my trail cameras within
- 15:55the last 60 days.
- 15:57That big one in the first picture has
- 15:59been there for at least 18 years. He's
- 16:01territorial, he's patient, and he
- 16:04considers the South Bank his front
- 16:05porch.
- 16:07If you build a dock on that shore and
- 16:08put people on it, you are putting them
- 16:10in his living room, and I want to be
- 16:12very clear about this. He does not
- 16:14share.
- 16:15Vanessa stood at the podium in a seafoam
- 16:17blazer.
- 16:19Mr. Colton, we appreciate the visual
- 16:21aids, but this community was marketed as
- 16:23lakeside living. Our residents deserve
- 16:26access to the natural beauty they were
- 16:28promised.
- 16:29The natural beauty includes an 11-ft
- 16:31alligator, ma'am.
- 16:33Florida has alligators everywhere, Mr.
- 16:36Colton. We're not going to let one
- 16:37animal hold an entire community hostage.
- 16:41Someone in the audience clapped.
- 16:43Vanessa's lips curved upward.
- 16:45I looked at the room.
- 16:47Some faces were sympathetic, an older
- 16:49couple in the third row who'd been
- 16:50nodding the entire time, a woman in the
- 16:53back who was shaking her head slowly.
- 16:55Most just looked excited about the
- 16:57beach. They saw the brochure version of
- 16:59the lake. They didn't see the version
- 17:01that comes out at night.
- 17:04I've warned you, I said. That's twice
- 17:06now. If you go ahead with this, someone
- 17:08will get hurt, or you will spend more
- 17:10money fixing the problem than you did
- 17:12creating it. Probably both.
- 17:15I picked up my folder and left.
- 17:18The board voted 4 to 1 to pursue
- 17:20community lake access through all
- 17:22available channels.
- 17:24The one dissenting vote was a retired
- 17:26insurance adjuster named Donna Hatch,
- 17:28who told me afterward, "I'm the only
- 17:30person on that board who reads liability
- 17:32assessments. They don't want to hear
- 17:34what I have to say."
- 17:36That was warning two. I sent the
- 17:38certified letter two weeks later, 14
- 17:40pages, addressed individually to every
- 17:42board member. I'd spent three evenings
- 17:45at the kitchen table writing it while
- 17:46Jolene sat across from me correcting my
- 17:49grammar and occasionally looking up from
- 17:51her reading glasses to say, "You spelled
- 17:53liability wrong again."
- 17:55Attached to the letter, my property
- 17:57survey with boundaries marked in red,
- 17:59photographs of every documented
- 18:01alligator in the lake with approximate
- 18:03sizes and known basking locations,
- 18:05Florida statute 379.3015
- 18:09establishing alligators as protected
- 18:11non-game wildlife, Florida statute
- 18:14823.14
- 18:16on landowner liability for attractive
- 18:18nuisances, and a formal legal warning
- 18:20that any unauthorized construction on my
- 18:22property would constitute criminal
- 18:24trespass and result in immediate law
- 18:26enforcement notification and civil
- 18:28action. The final paragraph said, "To be
- 18:31absolutely clear, if you construct any
- 18:33structure on my property, create any
- 18:35access point to this lake, or direct any
- 18:38person toward this body of water for
- 18:40recreational use, you will be
- 18:41trespassing on private land, creating an
- 18:44unsafe condition by routing pedestrian
- 18:46traffic into documented alligator
- 18:48habitat, and exposing your homeowners
- 18:50association to civil and criminal
- 18:52liability that I will pursue to the
- 18:54fullest extent. This is my third and
- 18:56final warning."
- 18:58Jolene proofread the whole thing. She
- 19:00set it down, took off her glasses, and
- 19:02said, "This is clear, thorough, and
- 19:04legal. She's going to ignore every
- 19:06word." She was right.
- 19:09Four weeks after the certified letter,
- 19:12the return receipts came back signed by
- 19:14three of the five board members. The
- 19:16other two were attempted not claimed.
- 19:19I was running fence on the north pasture
- 19:21when I heard diesel engines from the
- 19:23south end of the property.
- 19:25Heavy equipment. The kind of sound you
- 19:27feel in your chest before you hear it in
- 19:29your ears. I drove down in my truck
- 19:32bouncing across the pasture road with
- 19:34dust trailing behind me and found a
- 19:36flatbed trailer parked at the property
- 19:38line with a mini excavator already
- 19:40offloaded and a crew of four men in hard
- 19:42hats cutting through my cattle fence.
- 19:44The four-strand barbed wire my father
- 19:47had strung in 1978. The same fence I'd
- 19:50walked and repaired every spring for 30
- 19:52years. I got out of the truck. The
- 19:54foreman, a heavy-set man in a yellow
- 19:57vest, showed me a work order.
- 19:59The header read Palmetto Lake Estates
- 20:01HOA Community Lakefront Development
- 20:03Phase 1.
- 20:05Signed by Vanessa Langford, HOA
- 20:07President.
- 20:09"This is my property." I said.
- 20:11"Ma'am told us there was an easement."
- 20:13The foreman said.
- 20:15"There is no easement. I need you to
- 20:17stop and leave."
- 20:18The foreman called Vanessa. I could hear
- 20:21her voice through the phone, thin,
- 20:23sharp, impatient.
- 20:25The foreman hung up and said, "She says
- 20:27the project has been authorized by the
- 20:29HOA board and you need to take it up
- 20:31with them."
- 20:32I called the Polk County Sheriff's
- 20:34Office. A deputy arrived 40 minutes
- 20:36later.
- 20:3740 minutes in which the crew stood
- 20:39around smoking while I stood by my truck
- 20:41watching 200 ft of my father's fence lie
- 20:44in the dirt like a dead snake.
- 20:46The deputy looked at the work order,
- 20:48looked at my deed, and told the crew
- 20:50they needed to stop work until the
- 20:51property dispute was resolved.
- 20:54They packed the excavator onto the
- 20:55flatbed and left.
- 20:58The next morning, while I was at my
- 21:00attorney's office in Lakeland filing a
- 21:02formal trespass complaint, a different
- 21:04crew showed up.
- 21:05They came early. They worked fast. By
- 21:08the time I got home at 2:15 that
- 21:10afternoon, there was a 40-ft wooden dock
- 21:13extending into Colton Lake from the
- 21:15south shore, a cleared and graded area
- 21:17of imported white sand they were calling
- 21:19a beach, two cedar benches, a
- 21:22pressure-treated kayak rack holding four
- 21:24bright yellow rental kayaks, and a paved
- 21:27asphalt path connecting to the
- 21:28subdivision's walking trail. A laminated
- 21:31sign at the trailhead read, "Welcome to
- 21:33Palmetto Lake Community Beach, a
- 21:35Palmetto Lake Estates amenity. Enjoy
- 21:38responsibly."
- 21:40They built it on my land without my
- 21:42permission, without permits, without
- 21:44environmental review, and without any
- 21:46regard for the 11-ft apex predator who'd
- 21:49been patrolling those waters since
- 21:50before half the HOA board members had
- 21:53Florida driver's licenses.
- 21:55I stood on my porch that evening and
- 21:57looked across the water at the dock. The
- 21:59wood was fresh-cut pine, bright yellow
- 22:02against the dark cypress and tea-colored
- 22:04water. The beach sand was blinding
- 22:06white, trucked in from a supplier, stark
- 22:09and artificial against the natural clay
- 22:11bank like a bandage on a wound. Two of
- 22:13the yellow kayaks had already been
- 22:15dragged to the water's edge. Someone had
- 22:17left a beach towel on one of the
- 22:18benches. Jolene came out with two
- 22:20glasses of iced tea and stood beside me.
- 22:23"How long?" she said. "For what?" "For
- 22:25Judge to find it." I took a sip, watched
- 22:28the lake go flat and dark as the sun
- 22:30dropped behind the cypress line.
- 22:31Somewhere on the south bank, in the
- 22:33shadows where the water met the muck and
- 22:35the reeds, something very large and very
- 22:38old was watching the same dock I was.
- 22:40"He already knows it's there," I said.
- 22:43"He's just deciding what to think about
- 22:44it."
- 22:46The HOA announced a community lake day
- 22:48for the following Saturday, a grand
- 22:51opening celebration with kayaking dock,
- 22:53fishing, a barbecue on the new beach,
- 22:55and a family nature walk along the south
- 22:57shore. The flyer featured a stock photo
- 23:00of a family laughing on a dock, not
- 23:02their dock, because their dock didn't
- 23:04exist 2 weeks ago, and described the
- 23:06event as a celebration of the lakeside
- 23:08lifestyle that makes Palmetto Lake
- 23:10Estates the premier community in Polk
- 23:12County. It did not mention alligators.
- 23:15It did not mention that the lake, the
- 23:17dock, and the beach were on private
- 23:19property, currently subject to a
- 23:20trespass complaint. It did not mention
- 23:23that the landowner had sent three
- 23:24documented warnings describing in
- 23:27specific and vivid detail exactly what
- 23:29was going to happen. I could have driven
- 23:31down there Saturday morning and told
- 23:33every person to get off my land. I could
- 23:35have called the sheriff again. I could
- 23:37have blocked the path with my truck and
- 23:39my tractor and every piece of farm
- 23:41equipment I owned. Instead, I pulled my
- 23:43rocking chair to the south end of the
- 23:45porch, poured a cup of coffee, and sat
- 23:47down. I'd lived on this lake for 58
- 23:50years. I knew what was coming, and I
- 23:52knew it wasn't going to take long. 73
- 23:55people showed up for Community Lake Day.
- 23:57Families with coolers and folding
- 23:59chairs, kids in swimsuits and water
- 24:01shoes, dogs on retractable leashes, the
- 24:04kind that give the animal 30 ft of
- 24:06slack, which, near a lake with
- 24:08alligators in it, is about 29 ft too
- 24:10many. Someone brought a portable
- 24:12Bluetooth speaker playing Jimmy Buffett
- 24:15so loud it carried across the water to
- 24:17my porch. Margaritaville echoing off the
- 24:19cypress trees while toddlers waited in
- 24:22the shallows of an alligator lake.
- 24:25Vanessa was there in a coral sundress in
- 24:27the white Range Rover parked at the
- 24:29trailhead like a parade float, handing
- 24:31out laminated maps of the lakefront
- 24:33recreation area, and accepting
- 24:35congratulations like she'd personally
- 24:37invented the concept of water.
- 24:40For 2 hours, nothing happened.
- 24:42Kayakers went out. Two of them paddled
- 24:44to the center of the lake, which is
- 24:46about 6 ft deep and sits directly over
- 24:48the channel where Judge does his midday
- 24:50submerge, and I watched through my
- 24:52binoculars with the same feeling you get
- 24:54watching someone walk across a frozen
- 24:56pond in March.
- 24:58Kids built sand castles in the imported
- 25:00sand. A man caught a bluegill off the
- 25:02dock and held it up like he'd landed a
- 25:04marlin. Someone's golden retriever went
- 25:06swimming. The speaker switched to the
- 25:08Eagles. Then at 11:47 a.m. I checked my
- 25:12watch because I'd been waiting the
- 25:13surface of the lake. About 60 ft south
- 25:16of the dock went flat. Unnaturally flat.
- 25:19The kind of flat that if you've lived on
- 25:21Florida water your whole life makes the
- 25:23hair on the back of your neck stand up.
- 25:25The small ripples from the kayakers have
- 25:27been moving across the surface all
- 25:29morning and suddenly a patch of water
- 25:31just stopped moving entirely the way air
- 25:33goes still before a tornado. Then two
- 25:36eyes appeared. Just eyes and the ridge
- 25:38of a snout breaking the surface so
- 25:40slowly they might have been there all
- 25:41along. Patient, deliberate, judicial.
- 25:45Judge. He floated for a full minute
- 25:47motionless watching the dock the way a
- 25:49landlord watches someone parking in his
- 25:51reserved spot. A woman on the dock saw
- 25:54him first. She stopped mid-sentence
- 25:56pointed and screamed with a sound that
- 25:57carried 200 yards across the water and
- 26:00arrived at my porch with perfect
- 26:01clarity. I took a sip of coffee.
- 26:05What happened next was exactly what I
- 26:07had described in specific and clinical
- 26:10detail in three separate warnings in
- 26:12three separate settings over the course
- 26:14of 14 months.
- 26:16Panic.
- 26:18The dock cleared in under 10 seconds. I
- 26:20know because my trail camera on the
- 26:22south fence post recorded the whole
- 26:24thing with a time stamp.
- 26:26Parents grabbed children. A man in swim
- 26:28trunks knocked over the kayak rack and
- 26:31two $400 kayaks went into the water.
- 26:34Dogs barking, kids screaming, the golden
- 26:37retriever still in the lake started
- 26:39swimming toward Judge because golden
- 26:40retrievers are beautiful loyal animals
- 26:43with absolutely no survival instinct.
- 26:46Its owner went waist deep to grab it
- 26:48which is the kind of decision that gives
- 26:50wildlife officers nightmares.
- 26:52Someone called 911.
- 26:54The dispatcher asked, "How big is the
- 26:57alligator?" The caller said, "It's the
- 26:59size of a car."
- 27:01It wasn't the size of a car. It was 11
- 27:04ft. But when you're standing on a dock
- 27:06that shouldn't exist on a lake you were
- 27:08warned about three times, watching an
- 27:10apex predator surface 60 ft away with
- 27:12more teeth than your entire neighborhood
- 27:14has opinions, 11 ft feels like the size
- 27:17of a car.
- 27:19Judge didn't charge. He didn't even
- 27:21move. He floated 60 ft out, eyes above
- 27:24the surface, watching the pandemonium
- 27:26with the ancient calm of an animal whose
- 27:28species outlasted the dinosaurs, the ice
- 27:31ages, and the Roman Empire.
- 27:34He'd simply existed in his lake, in his
- 27:36territory, in the water he'd been
- 27:38patrolling for 18 years while a woman in
- 27:40a coral sundress sold the view.
- 27:43I rocked gently in my chair.
- 27:46Jolene came out with the coffee pot,
- 27:48refilled my mug, and stood there
- 27:49watching the crowd flee up the path
- 27:51toward the subdivision like a parade in
- 27:53reverse.
- 27:55"Is that Judge?" she asked squinting
- 27:57across the water.
- 27:59"That's Judge."
- 28:00"He's on the dock now."
- 28:02I lifted my binoculars. She was right.
- 28:06While the crowd ran, Judge had glided in
- 28:09and hauled himself up onto the pine
- 28:10planks, all 11 ft of him, dark and heavy
- 28:13and slow. His claws gripping the fresh
- 28:16wood like he was testing the
- 28:17construction quality. He settled onto
- 28:19the dock with his jaw open,
- 28:21thermoregulating in the noon sun. His
- 28:23tail hung off the edge. He looked
- 28:25comfortable. He looked permanent. "They
- 28:27spent $62,000
- 28:29on that dock," I said. "How much does
- 28:32Judge weigh?" "About 500 lb." "$62,000
- 28:36for a 500-lb gator's sunning platform?"
- 28:39Jolene poured herself a cup of coffee
- 28:41and sat in the other rocker. "That might
- 28:43be the most expensive lounge chair in
- 28:44Polk County." By the time FWC arrived, a
- 28:48young officer named Deputy Kayla Tanaka
- 28:50and her supervisor Captain Marcus Webb,
- 28:53a 22-year veteran I'd crossed paths with
- 28:55at county wildlife briefings, Judge had
- 28:58been on the dock for 3 hours. He showed
- 29:00no interest in leaving. Captain Webb
- 29:02walked the shoreline, reviewed my
- 29:04documentation, I brought a copy of
- 29:06everything including the three warnings,
- 29:08and made two phone calls. Then he drove
- 29:11to the HOA office and delivered FWC's
- 29:13assessment directly to Vanessa. Ma'am,
- 29:15that lake has an established population
- 29:17of at least six alligators including an
- 29:1911-ft dominant male. You constructed
- 29:22recreational facilities directly in his
- 29:24primary habitat on property you don't
- 29:26own without any wildlife management plan
- 29:29and without consulting our office. FWC
- 29:32will not relocate these animals. They
- 29:34are resident wildlife in a natural
- 29:36freshwater system. You brought people to
- 29:38them, they didn't come to you. Vanessa
- 29:40demanded Judge be trapped and removed.
- 29:43Captain Webb explained that under
- 29:45Florida law, nuisance alligator permits
- 29:48require documented threat behavior in a
- 29:50specific location and that deliberately
- 29:53constructing a beach in established
- 29:55gator habitat then asking the state to
- 29:57remove the gators wasn't a nuisance
- 30:00situation. It was a planning failure.
- 30:02You can haze him off the dock
- 30:04temporarily, Webb said, but without a
- 30:06physical barrier or the removal of the
- 30:08structure, he'll be back. He's not a
- 30:11visitor. He lives here. You're the
- 30:13visitor.
- 30:14Vanessa asked to speak with his
- 30:16supervisor. Captain Webb said, "I'm the
- 30:18regional captain. My supervisor is the
- 30:20executive director in Tallahassee. I can
- 30:23give you that number, but I'll tell you
- 30:24right now, she's going to say the same
- 30:26thing because it's the same law."
- 30:28Judge was hazed off the dock that
- 30:30afternoon by a two-person FWC team with
- 30:33catch poles and bang sticks. He slid
- 30:35into the water without protest, a smooth
- 30:38unhurried descent into the dark lake.
- 30:40His tail leaving a single ripple that
- 30:42traveled all the way to the north shore.
- 30:45He surfaced once about 40 ft out and
- 30:48floated there watching the dock
- 30:50considering.
- 30:51He was back the next morning
- 30:53and the morning after that and every
- 30:55morning for the next 9 weeks.
- 30:57Within days Judge had established a new
- 31:00routine. Morning bask on the dock he
- 31:02liked, the south-facing planks where the
- 31:05pine absorbed the first heat of the day.
- 31:07Midday submerge into the deep water near
- 31:09the cypress bend. Afternoon patrol along
- 31:12the south shore cruising the exact
- 31:14corridor where the HOA had cleared the
- 31:16vegetation for their nature walk.
- 31:19By the second week a 7-ft female mama
- 31:22started using the imported beach sand as
- 31:24a basking spot.
- 31:25By the third week a 6-ft I didn't even
- 31:28have a name for was sunning on the
- 31:30concrete slab near the kayak rack.
- 31:33The beach wasn't a beach anymore. It was
- 31:35a reptile resort.
- 31:36Residents were terrified.
- 31:39The dock was closed yellow caution tape
- 31:41wrapped around the railing like a crime
- 31:43scene.
- 31:44Children couldn't play in backyards that
- 31:47face the lake. Dog walkers carried air
- 31:49horns and walked in pairs along the
- 31:51paved trail glancing toward the water
- 31:53every few seconds.
- 31:55Two families on Heron Court put their
- 31:57houses on the market within a month of
- 31:59the first sighting both at a loss.
- 32:02Their listings didn't mention lakeside
- 32:04living. One said motivated seller. The
- 32:08other said nothing at all.
- 32:10A petition with 104 signatures demanding
- 32:13immediate wildlife removal and lake
- 32:15safety measures was submitted to the HOA
- 32:17board.
- 32:18Vanessa responded with a newsletter
- 32:20blaming pre-existing ecological
- 32:22conditions that predate community
- 32:24development and promising professional
- 32:26wildlife management solutions currently
- 32:28under evaluation.
- 32:30She used the phrase working tirelessly
- 32:33twice in a document that described doing
- 32:35nothing.
- 32:36While Vanessa was calling every
- 32:37government office in the state trying to
- 32:39find someone who'd remove an alligator
- 32:41from a dock that shouldn't exist on a
- 32:43lake that wasn't hers, my attorney
- 32:45Katherine Reeves was doing what
- 32:46attorneys do, pulling threads.
- 32:49What she found was the reason the dock
- 32:51existed in the first place.
- 32:53In the 18 months since Vanessa took over
- 32:55the HOA, 12 homes in Palmetto Lake
- 32:58Estates had been sold.
- 33:00Every single listing, all 12, was
- 33:02handled by the same agent, a woman named
- 33:04Brooke Chisholm of Chisholm Premier
- 33:06Properties.
- 33:07Every listing described the property as
- 33:09having direct access to a private
- 33:11community lake with dock, beach, and
- 33:13kayak amenities.
- 33:15Every listing featured photos of the
- 33:17dock and beach structures built on my
- 33:18land without my permission.
- 33:21The average sale price for homes
- 33:23marketed as lake access lots was $47,000
- 33:26higher than comparable homes on the west
- 33:28side of the subdivision farther from the
- 33:30water.
- 33:32$47,000
- 33:34times 12 homes, $564,000
- 33:38in inflated property value built
- 33:40entirely on a lie.
- 33:42Katherine pulled Brooke Chisholm's
- 33:44business filings with the Florida
- 33:45Division of Corporations. There it was.
- 33:48A company called Palmetto Premium
- 33:50Properties LLC
- 33:52filed 16 months before the first lake
- 33:55access initiative letter was sent to me.
- 33:58Registered agent Vanessa Langford.
- 34:00Vanessa wasn't building a community
- 34:02amenity. She was building a sales
- 34:04funnel.
- 34:05The dock, the beach, the kayak rack, the
- 34:07imported sand, all of it was a stage set
- 34:10designed to make 12 listings look like
- 34:12lakefront properties so she and her
- 34:14partner could collect commissions on
- 34:16nearly $600,000 in phantom value.
- 34:19The HOA's community enhancement budget
- 34:22paid for the construction.
- 34:24144 families monthly dues funded a real
- 34:27estate scheme that benefited two people.
- 34:30And the three warnings from the man who
- 34:31owned the lake obstacles, noise, the
- 34:34inconvenient opinion of a cattle rancher
- 34:36who didn't understand that property
- 34:38values were more important than apex
- 34:40predators.
- 34:41The HOA's financial records obtained by
- 34:43Donna Hatch, the insurance adjuster
- 34:46who'd cast the only dissenting vote
- 34:47under the Florida Homeowners Association
- 34:50Act, confirmed it.
- 34:51The $62,000 dock and beach construction
- 34:55was listed under community enhancement
- 34:57lakefront recreation area.
- 34:59An additional $28,000 had been paid to
- 35:02Chisholm Premier Properties for
- 35:04community marketing consultation.
- 35:06Vanessa had been funneling HOA money
- 35:08directly to her real estate partners
- 35:10company, $90,000 total.
- 35:14From 144 families who trusted their HOA
- 35:17president to manage their dues
- 35:19responsibly.
- 35:21Every dollar spent while an 11-foot
- 35:23alligator sat on the dock she'd built to
- 35:25sell the lie.
- 35:27The community meeting was held on a
- 35:29Wednesday evening in the Palmetto Lake
- 35:30Estates clubhouse.
- 35:32The air conditioning was set to 68° and
- 35:35losing.
- 35:36126 homeowners showed up, every chair
- 35:40taken. People lining the walls with arms
- 35:42crossed.
- 35:44Someone had taped a handwritten sign to
- 35:45the front door that read, "Lake Day
- 35:48canceled indefinitely. Ask the board
- 35:50why."
- 35:52Vanessa opened in a white blazer and
- 35:54gold earrings, reading from a prepared
- 35:56statement about temporary wildlife
- 35:59management challenges and our
- 36:01community's resilient spirit in adapting
- 36:03to Florida's natural environment.
- 36:06She used the word proactive three times.
- 36:09She did not mention the dock. She did
- 36:11not mention me.
- 36:12She did not mention that the community
- 36:14beach had been closed for 9 weeks
- 36:16because an 11-foot alligator treated it
- 36:18like his personal resort.
- 36:20Donna Hatch stood from the second row.
- 36:23Vanessa, can you explain the $90,000 in
- 36:26payments connected to the lakefront
- 36:27project and Chisholm Premier Properties.
- 36:31Vanessa's smile thinned to a line.
- 36:34That's a standard vendor relationship,
- 36:35Donna. Community marketing enhances
- 36:37property values for everyone.
- 36:40I stood, third row, work boots, ranch
- 36:43khakis, and a sun-faded ball cap I took
- 36:46off and held in my hand, because my
- 36:48mother raised me to remove my hat
- 36:50indoors.
- 36:51I was carrying a folder thick enough to
- 36:53use as a doorstop.
- 36:55May I address the room?
- 36:57Mr. Colton is not a homeowner in this
- 36:59community. He doesn't have speaking Let
- 37:02him talk.
- 37:03It started with five voices, then 20,
- 37:07then the entire room.
- 37:10Someone in the back started clapping in
- 37:11a slow, steady rhythm that Vanessa's
- 37:13coffee mug, she was banging it on the
- 37:15podium like a gavel she didn't have,
- 37:17couldn't drown out.
- 37:19Fine, she said. Two minutes.
- 37:23I walked to the front, set the folder on
- 37:25the podium, looked at 126 faces, some
- 37:28angry, some scared, most just beginning
- 37:31to understand what had been done to
- 37:32them.
- 37:33My name is Wade Colton. My family has
- 37:36owned the lake your HOA calls a
- 37:38community amenity since 1961.
- 37:41I warned your board three times in
- 37:42person, at a public meeting, and by
- 37:44certified letter, that the lake
- 37:46contained alligators, including an 11-ft
- 37:49bull gator I've been tracking for 18
- 37:51years. Each warning was ignored. Your
- 37:54HOA cut my fence, trespassed on my
- 37:56property, and built a dock and beach
- 37:58without my permission, without county
- 38:00permits, and without an environmental
- 38:02review. They told you it was a community
- 38:04enhancement.
- 38:06I held up the LLC filing. This is the
- 38:08real reason.
- 38:10The room went quiet the way a room goes
- 38:12quiet when people realize they've been
- 38:14lied to and endangered in the same
- 38:16breath. I showed them everything. The
- 38:18deed, the three warnings dated,
- 38:20documented, signed for, The LLC
- 38:23connecting Vanessa to Brooke Chisholm.
- 38:25The sales data showing the $47,000
- 38:27premium on 12 transactions. The HOA
- 38:30financial records showing $90,000 routed
- 38:33to the scheme. And the trail camera
- 38:35footage Judge hauling himself onto the
- 38:37dock in morning sunlight. Judge basking
- 38:40on the beach sand. Judge floating in the
- 38:42shallows while a child's pink water
- 38:44shoes sat abandoned on the imported
- 38:46white sand like a still life titled
- 38:48somebody's grandchild almost died here.
- 38:51Patricia Angle, the woman whose golden
- 38:53retriever had nearly become a nature
- 38:55documentary, stood in the fourth row and
- 38:58said in a voice shaking with a fury that
- 39:00was quiet and therefore more frightening
- 39:02than shouting. I let my 7-year-old
- 39:04daughter walk down to that beach with
- 39:06her friends.
- 39:07Unsupervised because you told us it was
- 39:10safe. You told us it was ours. And there
- 39:12was an 11-foot alligator in the water
- 39:14the entire time.
- 39:16The vote to remove Vanessa was 119 to 3.
- 39:20Four abstentions. Vanessa voted for
- 39:22herself. It was the last official act of
- 39:24her presidency. She walked out of the
- 39:26clubhouse into the parking lot, gold
- 39:29earrings catching the fluorescent light,
- 39:31and found Captain Marcus Webb leaning
- 39:33against an FWC truck with his own
- 39:35folder. He'd been waiting. I'd called
- 39:37him before the meeting. Ms. Langford, we
- 39:39need to discuss the unpermitted
- 39:41construction of recreational facilities
- 39:43within established alligator habitat
- 39:45along a class three freshwater body. I'd
- 39:48recommend having your attorney present.
- 39:50The white Range Rover sat in the parking
- 39:52lot overnight. She didn't drive it home
- 39:54until the next morning. The aftermath
- 39:56unfolded the way water finds its level,
- 39:58slowly, steadily, and into every crack.
- 40:02Polk County code enforcement cited the
- 40:04HOA for unpermitted construction within
- 40:06a designated waterway buffer zone. Fines
- 40:09$2,500 per day retroactive to the
- 40:12construction date. At 71 days and
- 40:14counting, that was $177,500.
- 40:19FWC issued citations for construction of
- 40:21an unauthorized recreational facility in
- 40:24documented alligator habitat without a
- 40:27wildlife management plan or agency
- 40:29consultation. Fines $52,000.
- 40:33Katherine Reeves filed my civil lawsuit,
- 40:36criminal trespass, destruction of
- 40:38property, 200 ft of cattle fence my
- 40:41father built, unauthorized construction
- 40:43on private land, and negligent creation
- 40:46of a wildlife hazard.
- 40:48The dock, beach path, and amenities were
- 40:50appraised at $62,000 in construction
- 40:53costs, money spent on my property
- 40:55without my knowledge or consent.
- 40:58My fence damage, $9,200.
- 41:01Katherine filed for treble damages under
- 41:03Florida's property destruction statute.
- 41:06Total claim, $213,600
- 41:10plus attorney's fees and investigative
- 41:12costs.
- 41:13The Polk County Sheriff's opened a fraud
- 41:16investigation into Palmetto Premium
- 41:18Properties LLC.
- 41:20Both Vanessa and Brooke Chisholm were
- 41:22named. The investigation documented
- 41:24$90,000 in misappropriated HOA funds and
- 41:28$564,000
- 41:30in artificially inflated property sales.
- 41:33Four families who'd purchased lake
- 41:35access homes at the premium price filed
- 41:38separate fraud claims against Vanessa,
- 41:40Brooke, and the HOA.
- 41:43The Florida Department of Business and
- 41:44Professional Regulation opened a
- 41:46parallel investigation into Brooke's
- 41:48real estate license for undisclosed
- 41:50conflicts of interest and material
- 41:52misrepresentation in listing
- 41:54descriptions.
- 41:55Vanessa pleaded no contest to the fraud
- 41:58and embezzlement charges. Two years
- 41:59probation, full restitution of
- 42:02misappropriated HOA funds, though the
- 42:04actual repayment timeline stretched into
- 42:06years given the mountain of legal costs
- 42:08she was buried under.
- 42:10Community service and permanent
- 42:13disqualification from serving on any HOA
- 42:15board in the state of Florida.
- 42:17She sold the white Range Rover to cover
- 42:19legal fees. She and Keith put their home
- 42:22on the market 6 weeks later.
- 42:24The listing did not mention lake access.
- 42:27It said "Motivated seller."
- 42:30Brooke Chisholm surrendered her real
- 42:31estate license rather than face the
- 42:33disciplinary hearing.
- 42:35Palmetto Premium Properties LLC was
- 42:37dissolved. The website for Chisholm
- 42:39Premier Properties went dark the same
- 42:41week.
- 42:42The dock was condemned by the county and
- 42:44removed at the HOA's expense $18,000
- 42:48for a demolition crew, an environmental
- 42:50waste disposal permit, and a waterway
- 42:52debris cleanup that took 4 days because
- 42:55chunks of pine and hardware had to be
- 42:57extracted from the lakebed without
- 42:59disturbing the cypress roots or the nest
- 43:01mound that Mama had rebuilt 50 ft from
- 43:04where the dock used to be.
- 43:06The beach sand was trucked out. The
- 43:08kayak rack was dismantled. The Welcome
- 43:10to Palmetto Lake Beach sign was taken
- 43:13down by a maintenance worker named
- 43:15Gerald, who told me later he'd been
- 43:17wanting to pull that sign out of the
- 43:18ground since the morning he watched an
- 43:2111-ft gator walk across the sand and
- 43:23settle onto the dock like he was
- 43:25checking in at a hotel.
- 43:27The new HOA board led by Donna Hatch,
- 43:30the insurance adjuster whose sole
- 43:31dissenting vote looked less like caution
- 43:34and more like prophecy in hindsight,
- 43:36sent me a formal written apology and a
- 43:39check for the fence repair.
- 43:41They hired an independent forensic
- 43:42accountant. The full audit confirmed the
- 43:4490,000 in misappropriated funds and
- 43:47identified an additional 14,000 in
- 43:50vendor payments Vanessa had approved
- 43:52without competitive bidding or full
- 43:54board oversight.
- 43:56They installed a new fence along the
- 43:57property line, 6-ft chain link with
- 43:59concrete posts and locked gates, and
- 44:02posted signs every 30 ft that read
- 44:04"Private property. No lake access.
- 44:07Active wildlife habitat. Do not enter.
- 44:10Judge, of course, didn't notice any of
- 44:12this.
- 44:14Every morning, and I mean every single
- 44:16morning, he climbs out of the lake on
- 44:18the South Bank, crosses the cleared
- 44:20ground where the beach used to be, and
- 44:22basks on the concrete slab that was
- 44:24poured as the kayak rack foundation and
- 44:26never removed because the new board
- 44:28couldn't justify the cost of
- 44:30jackhammering a concrete pad that wasn't
- 44:32hurting anything except Vanessa's
- 44:34legacy. He lies there in the morning sun
- 44:36with his jaw cracked open and his tail
- 44:39stretched across the warm surface, the
- 44:41same way he's been basking on that
- 44:42shoreline for 18 years before the
- 44:44subdivision, before the HOA, before
- 44:47Vanessa Langford decided that an 11-foot
- 44:49alligator was less important than a real
- 44:51estate commission. The neighborhood kids
- 44:53gave him a name. They call him the
- 44:55landlord, as in, you can build whatever
- 44:58you want, but he decides who stays. I
- 45:00didn't teach them that, but I'm not
- 45:02going to pretend I didn't laugh when I
- 45:04heard it. And every morning I sit on my
- 45:06porch with my coffee and watch him. Same
- 45:08chair, same view I've had for 58 years
- 45:11except now there's a concrete pad where
- 45:13a beach used to be and a row of no
- 45:15trespassing signs where a dock used to
- 45:17stand. Jolene joins me most mornings. We
- 45:20don't talk much. The lake makes its own
- 45:22conversation. Herons calling from the
- 45:24rookery, fish dimpling the surface, the
- 45:27low rumble of a bullgator's territorial
- 45:29call vibrating across the water like the
- 45:31earth clearing its throat. Last Tuesday
- 45:34morning Jolene set her coffee down and
- 45:36said, "He's on the slab again." I looked
- 45:38through my binoculars. Judge was
- 45:40stretched out on the concrete, jaw open,
- 45:43eyes half closed, absorbing the sun like
- 45:45a king on a throne he never asked for
- 45:47but was never going to give up. "You
- 45:49know," she said, "for a creature that
- 45:51can't read, he's got better judgment
- 45:53than anyone on that board. That's why I
- 45:56named him Judge."
- 45:58I thought you named him Judge because
- 45:59he's slow.
- 46:01Slow and right beats fast and wrong
- 46:03every time. Ask Vanessa.
- 46:06She picked her coffee back up.
- 46:08We sat there and watched the sun climb
- 46:10over the cypress line and the water go
- 46:12from black to bronze to gold.
- 46:15The landlord basked, the herons fished,
- 46:17the lake did what it had always done,
- 46:19existed patiently and completely on its
- 46:21own terms.
- 46:22Vanessa looked at that water and saw a
- 46:24marketing opportunity.
- 46:26The developer looked at it and saw a
- 46:28brochure photo.
- 46:29The HOA looked at it and saw a community
- 46:31amenity.
- 46:33Judge looked at it and saw a home.
- 46:36I gave them three warnings, three
- 46:38chances to listen, three opportunities
- 46:40to understand that some places belong to
- 46:42things older and more patient than an
- 46:44HOA president with a Range Rover and a
- 46:47real estate side hustle.
- 46:49They chose the brochure. They got the
- 46:51gator.
- 46:52And every morning I sit on this porch,
- 46:54drink my coffee, and watch the most
- 46:56honest resident in Polk County enjoy the
- 46:58most expensive sunning platform anyone
- 47:01has ever accidentally built for an
- 47:02alligator.
- 47:04Some warnings exist for a reason.
- 47:06I gave them three.
