  1. 0:19Good evening everybody and welcome to
  2. 0:21the September 16th, 2026 meeting of the
  3. 0:24Hide Park Planning Board. If you could
  4. 0:26please stand with me to say the pledge
  5. 0:28of allegiance.
  6. 0:32I pledge allegiance to the flag of the
  7. 0:34United States of America and to the
  8. 0:36republic for which it stands. One nation
  9. 0:40under God, indivisible, with liberty and
  10. 0:42justice for all.
  11. 0:49>> Our first item on the agenda is a new
  12. 0:52public hearing. This one is for the
  13. 0:54Goran Timber Harvest. This is on 959
  14. 0:58Violet Avenue in Hide Park. Uh they are
  15. 1:01looking to do another round of timber
  16. 1:03harvest. Uh do we have any
  17. 1:05representatives attending tonight? Ah
  18. 1:07come on down
  19. 1:10here.
  20. 1:10>> Oh excellent.
  21. 1:11>> Very good.
  22. 1:12>> Good evening. Just for the record state
  23. 1:16your name.
  24. 1:18>> Uh my name is Christopher Apprentice. Um
  25. 1:21uh Lower Hudson Forestry Services.
  26. 1:24>> Thank you. And uh you were at the last
  27. 1:26meeting we just discussed the overall
  28. 1:28plan, right?
  29. 1:30Yep. We uh went over the plan, um what
  30. 1:34we're proposing to do, um the DEC
  31. 1:38permits that have already been obtained,
  32. 1:41um as well as the fact that the property
  33. 1:43is managed under the 48A forest tax law
  34. 1:46program.
  35. 1:47>> Yep. Okay. Um before we go any further,
  36. 1:50may I get a motion to open the public
  37. 1:52hearing?
  38. 1:52>> I'll make that motion.
  39. 1:54>> Second.
  40. 1:54>> All in favor, please say I.
  41. 1:56>> I.
  42. 1:57>> Thank you.
  43. 1:59All right. So,
  44. 2:01let me just ask Miss Moss if she has any
  45. 2:05comments on this. Oh, for some reason,
  46. 2:07you do not have a a microphone.
  47. 2:11>> She's being punished. [laughter]
  48. 2:13>> Um, I don't I don't have any comments.
  49. 2:15We're going to need something from DOT
  50. 2:18regarding the access at the time of the
  51. 2:20harvest, but other than that,
  52. 2:22>> and that's been included in the
  53. 2:23resolution.
  54. 2:23>> Okay. Okay.
  55. 2:25>> Good. Excellent. Um, Mr. Mr. Harvey, any
  56. 2:28comments?
  57. 2:29>> No, we didn't review the project.
  58. 2:30>> Okay. And Miss Pauladoro?
  59. 2:32>> No comments
  60. 2:33>> other than we have a resolution
  61. 2:35prepared, right?
  62. 2:36>> Well, yeah. So, you have a resolution
  63. 2:38prepared for tonight. Um, you do have to
  64. 2:41go through the EAF.
  65. 2:42>> Oh, okay.
  66. 2:44>> On listed action. So, we'd have to go
  67. 2:45through part two.
  68. 2:46>> Oh,
  69. 2:47>> and I can pull it up.
  70. 2:48>> That would be great.
  71. 2:49>> Talk through it.
  72. 2:49>> We get that.
  73. 2:52>> Okay. Which is why we're going to do it
  74. 2:54now. So the um the other thing to note
  75. 2:56is that because it's a timber harvest
  76. 2:59and not a traditional development
  77. 3:02project, there's not a a traditional
  78. 3:04site plan. And so one of the things that
  79. 3:07you would be doing tonight if you are
  80. 3:09ready to do that is to accept what
  81. 3:11they've submitted as a site plan and
  82. 3:13wave all the other requirements.
  83. 3:15>> Okay. Well, and that makes sense because
  84. 3:17um but they do show, you know, access
  85. 3:20and where they're going and any stream
  86. 3:22crossings and they do and limits of
  87. 3:24disturbance and
  88. 3:25>> you know they're not showing the trees
  89. 3:27at at
  90. 3:27>> Yes. Right. which we would Yeah.
  91. 3:29Correct. Okay. So, and is that mentioned
  92. 3:31in the
  93. 3:32>> It's all in the resolution. All right.
  94. 3:34So, so let's pull up pull up to Yeah.
  95. 3:37from the bottom.
  96. 3:50Okay.
  97. 3:51All right. So, um, will proposed action
  98. 3:54create a material conflict with adopted
  99. 3:56land use plan or zoning?
  100. 3:58>> No.
  101. 3:59>> No.
  102. 4:00>> Will proposed action result in a change
  103. 4:01in the use or intensity of land?
  104. 4:04>> No.
  105. 4:05Well, minimal, right? I mean,
  106. 4:07>> no or small.
  107. 4:08>> Yeah.
  108. 4:09>> Any any change in the use, I guess,
  109. 4:11would be temporary.
  110. 4:13>> Temporary
  111. 4:14>> period of the harvest.
  112. 4:15>> Yes.
  113. 4:17>> Um,
  114. 4:18>> can you can you put the um microphone a
  115. 4:19little bit closer?
  116. 4:20>> Sure. Doesn't
  117. 4:21>> change the use. Will
  118. 4:22>> No, that's correct. Right.
  119. 4:25>> Doesn't change the use.
  120. 4:26>> No, it doesn't change the use.
  121. 4:28>> Right.
  122. 4:29>> Will the proposed action impair the
  123. 4:31character or quality of the existing
  124. 4:32community?
  125. 4:33>> No.
  126. 4:35Will it have an impact on a critical
  127. 4:37environmental area?
  128. 4:38>> No,
  129. 4:40>> it is not a critical environ.
  130. 4:42>> It's not within one.
  131. 4:44>> Right.
  132. 4:45>> Uh will proposed action result in an
  133. 4:46adverse change in the existing level of
  134. 4:48traffic or affect existing
  135. 4:50infrastructure for biking or walkways?
  136. 4:52>> No.
  137. 4:54>> Will proposed action cause an increase
  138. 4:55in the use of energy and it fails to
  139. 4:57incorporate reasonably available energy
  140. 4:59conservation opportunities?
  141. 5:02>> No.
  142. 5:03Will the action
  143. 5:06uh affect existing public or private
  144. 5:08water supplies or wastewater?
  145. 5:10>> No.
  146. 5:11>> Will it impair the character or quality
  147. 5:13of important historic, archaeological,
  148. 5:15aesthetic or architectural resources?
  149. 5:18>> No.
  150. 5:19>> Will it result in an adverse change to
  151. 5:21natural resources, wetlands, water
  152. 5:23bodies, groundwater?
  153. 5:25>> No. That's the whole point of doing
  154. 5:26this,
  155. 5:27>> right? You you're reviewing it to ensure
  156. 5:29that it's not going to have an impact.
  157. 5:32Will it result in an increase in
  158. 5:34potential for erosion, flooding, or
  159. 5:35drainage problems?
  160. 5:37>> No.
  161. 5:39>> Uh, will it create a hazard to human
  162. 5:41health?
  163. 5:42>> No.
  164. 5:44>> Is the potentially affected
  165. 5:45disadvantaged community identified as
  166. 5:47having a comparatively higher burdens or
  167. 5:49vulner vulnerabilities by DACA
  168. 5:51assessment tool?
  169. 5:53>> I don't think it's in a it's not in or
  170. 5:55adjacent to a disadvantage community.
  171. 5:57>> Okay.
  172. 5:59>> So, Henry's going to follow up. Is it I
  173. 6:02think it was just north. Okay.
  174. 6:04>> So it is a DACA.
  175. 6:06>> It so it is a DACA but is it going to
  176. 6:08have a small impact?
  177. 6:10>> No.
  178. 6:10>> Small.
  179. 6:10>> Yeah.
  180. 6:13>> And then will the proposed action cause
  181. 6:15or increase pollution burden within a
  182. 6:17disadvantaged community? No. Or small.
  183. 6:19>> No.
  184. 6:21>> Okay. So that's that's that. And now you
  185. 6:23after you've heard from everyone, we can
  186. 6:26close the hearing and go through the
  187. 6:28resolution.
  188. 6:29>> Okay. Mr. Total. Any comments?
  189. 6:32>> No.
  190. 6:32>> No comments.
  191. 6:33>> Mr. Waters?
  192. 6:34>> No comments.
  193. 6:35>> Mr. Lee. Mr. Olive.
  194. 6:37>> No comments.
  195. 6:38>> Miss Lee?
  196. 6:38>> No comments.
  197. 6:39>> Mr. Garcia?
  198. 6:40>> No comments.
  199. 6:41>> Then may I get a motion to Oh, I'm
  200. 6:43sorry. Is there anybody in the public
  201. 6:44that would like to
  202. 6:47make comments on this application?
  203. 6:51Okay. There being none, may I get a
  204. 6:52motion to close the public hearing?
  205. 6:54>> I'll make that motion. Second.
  206. 6:56>> All in favor, please say I.
  207. 6:58>> I.
  208. 6:58>> I. And we do have a resolution prepared.
  209. 7:01>> Yes, I have this.
  210. 7:02>> Go ahead.
  211. 7:03>> A resolution granting conditional
  212. 7:04special use permit and site plan

  220. 7:23environmental impacts and hereby issues
  221. 7:25a negative declaration pursuant to
  222. 7:27seeker. Be it further resolved that the
  223. 7:29planning board, having reviewed the
  224. 7:31project materials and the application

  226. 7:35108-8.4A
  227. 7:374A of the zoning code hereby makes the
  228. 7:40following findings. Number one, the
  229. 7:42proposed timber harvesting complies with
  230. 7:45the requirements of articles 4 and five

  239. 8:09not wrong. Let me just repeat that.
  240. 8:12>> [clears throat]
  241. 8:12>> Uh the the planning board has considered

  267. 9:13arrangements are appropriate for the
  268. 9:15operation, and the gravel pad will
  269. 9:16reduce the tracking of mud and debris
  270. 9:18onto the public road. Number five, the
  271. 9:21property is suitable for the proposed
  272. 9:23harvesting considering its size,
  273. 9:25location, topography, vegetation, soils,
  274. 9:28natural habitat, and water resources.
  275. 9:30The planning board has reviewed the

  309. 10:49and provide a copy of the to the zoning
  310. 10:52administrator.
  311. 10:53>> Second.
  312. 10:54>> Is there any discussion?
  313. 10:56>> I just have one item correction. Um the
  314. 10:59site is within a critical environmental
  315. 11:01area.
  316. 11:01>> It is.
  317. 11:02>> Yeah. The Marici kill critical
  318. 11:03environmental area.
  319. 11:05>> But I I don't know if that changes your
  320. 11:07answer. It won't it won't have it.
  321. 11:08>> Might change the answer. So, we can keep
  322. 11:10that the same. Just wanted to note it.
  323. 11:11>> Thank you. Appreciate that. I didn't
  324. 11:13know there was another one.
  325. 11:16>> Reach.
  326. 11:17>> Yeah. Uh is there any other discussion?
  327. 11:21>> All in favor, please say I.
  328. 11:22>> I.
  329. 11:23>> Any nays or abstensions? Motion passes
  330. 11:26unanimously. Thank you very much. Good
  331. 11:29to see you.
  332. 11:30>> Appreciate it.
  333. 11:36Have a good night.
  334. 11:37>> You too.

  338. 11:51condos.
  339. 11:56>> I get a motion to open the public
  340. 11:57hearing.
  341. 11:59>> So moved.
  342. 11:59>> Second.
  343. 12:00>> All in favor, please say I. I
  344. 12:03>> motion carries.
  345. 12:13>> So bear with me one moment.
  346. 12:15>> Yep. Oh, wait. Is that Oh, that's all.
  347. 12:29>> Ah, good.
  348. 12:36in the area.
  349. 12:41>> Welcome back.
  350. 12:43>> Thank you. Hi. Uh, thank you for having

  352. 12:49Um,
  353. 12:49>> yeah. Where's your posi?
  354. 12:52>> Uh, we're getting ready to go fishing
  355. 12:54tomorrow.
  356. 12:55>> Are you going on a three-hour tour?
  357. 12:58>> 12. I am 12 [laughter] hours. Yeah,
  358. 13:00>> that's old school for some of us.
  359. 13:02Three-hour tour.
  360. 13:04>> Got it.
  361. 13:06>> Very nice.
  362. 13:07>> He's he's going he's going out getting
  363. 13:08all the food. So, um
  364. 13:10>> Ah, good good.
  365. 13:13>> So, uh yes. Um thank you for having us.
  366. 13:15Larry Budro with Bellefield. At the last
  367. 13:18meeting, we presented um five plan
  368. 13:22sheets that we had to revise and working
  369. 13:25with the Roosevelt Fire District. They
  370. 13:27wanted us to add some things which we
  371. 13:31did. I presented those uh five plans
  372. 13:34last week and uh after that meeting we
  373. 13:38compiled this set and submitted an
  374. 13:41electronic uh set to to the town. Um and
  375. 13:46I can review these five sheets that we
  376. 13:48sent that I reviewed last week. Uh in
  377. 13:51addition to that, uh we just received
  378. 13:55the fire district's uh Roosevelt Fire
  379. 13:57District's letter of approval a couple
  380. 14:00hours ago. So working with them, we u um
  381. 14:05we were able to work through some of
  382. 14:07their concerns and we got their approval
  383. 14:09letter.
  384. 14:10>> Those were very productive meetings that
  385. 14:12we had.
  386. 14:13>> They were they were
  387. 14:14>> and they were very efficient. very
  388. 14:16productive uh efficient and we you know
  389. 14:19are very thankful that they uh were able
  390. 14:21to um work with us to get the uh sign
  391. 14:24off.
  392. 14:26>> Yeah, that was good to see come through.
  393. 14:28>> So I can go through what what we did.
  394. 14:30One of the requirements was we listed in
  395. 14:32bold the sheets that we've uh added to
  396. 14:34the uh set
  397. 14:37that that that were changed. Uh there
  398. 14:39was a big note that fire department
  399. 14:41wanted. That's note 10 on the cover
  400. 14:43sheet. They wanted to make sure that was
  401. 14:46on that and once that was on that I
  402. 14:48believe along with the other items they
  403. 14:50uh they signed off.
  404. 14:55This is the site plan and again what
  405. 14:57they wanted was uh you might remember
  406. 14:59the stair access was out into the
  407. 15:01courtyard. They wanted to do it the
  408. 15:03other way uh bringing it out uh to the
  409. 15:07curb side which which we did. I can zoom
  410. 15:09in here.
  411. 15:14But this is the stair access now. So you
  412. 15:17have direct access in the event you're
  413. 15:19on the curb side or parking side instead
  414. 15:21of the courtyard side. What the issue
  415. 15:24there was capacity of the courtyard to
  416. 15:28handle a fully engaged fire. Um, so we
  417. 15:32switched one there, one here, and then
  418. 15:35one here, one there, and then same on
  419. 15:37the other side.
  420. 15:41The other concern was the way the
  421. 15:44amenity building was
  422. 15:46was positioned. So, we rotated it 90° to
  423. 15:50allow more space between the building
  424. 15:54and the amenity
  425. 15:56uh building. So,
  426. 15:58>> and they match on both sets of buildings
  427. 16:00now, right?
  428. 16:00>> Yeah. Yeah, they're the same. Um, and
  429. 16:03they're uh I believe 25 by 35. And the
  430. 16:06elevations I did issue today slight
  431. 16:09revision on them, but um I sent that
  432. 16:13over to
  433. 16:15you and
  434. 16:17>> and the reason for rotating them, Larry,
  435. 16:18what was the reason that
  436. 16:20>> he was concerned of the pinch point?
  437. 16:22>> Yeah.
  438. 16:22>> Okay. for for e exiting from the
  439. 16:24courthouse.
  440. 16:26>> He was worried about pe firemen with
  441. 16:27ladders carrying them up the hill
  442. 16:29against people trying to exit the
  443. 16:30building in a skinny area between the
  444. 16:32buildings.
  445. 16:32>> Okay.
  446. 16:33>> Okay. So, this one was rotated and also
  447. 16:36when we rotated it uh it was getting
  448. 16:39over
  449. 16:40onto a sloped area. So, uh we shortened
  450. 16:43it up 5T to keep it on a on a level pad.
  451. 16:47>> Larry, that you provided us with
  452. 16:50renderings of that building. Um,
  453. 16:52>> okay.
  454. 16:53>> Yeah,
  455. 16:54>> I I hear in one ear, so I can't
  456. 16:55>> sure
  457. 16:56>> where sounds going.
  458. 16:57>> Uh, you provided us with elevations for
  459. 16:59that building.
  460. 17:00>> It's the same elevation.
  461. 17:01>> Which side is the is the windowless
  462. 17:04side?
  463. 17:05>> Okay.
  464. 17:05>> The the windowless side.
  465. 17:07>> The windowless side. Yeah.
  466. 17:09>> The unfenistrated side.
  467. 17:11>> So, I have that on here. So, let me pop
  468. 17:14down there.
  469. 17:15>> Right. I know. Yeah, I've seen them. I'm
  470. 17:17just trying.
  471. 17:17>> No, there there are two of them and they
  472. 17:19face in slightly different directions.
  473. 17:20So when you say
  474. 17:21>> let's see if we can figure it out which
  475. 17:25>> it would make sense.
  476. 17:37>> So there you are. That's the windowless
  477. 17:39side.
  478. 17:42>> Right. So on the plan which
  479. 17:44>> Okay. All right. So let me see.
  480. 17:50And is that an extended roof that's
  481. 17:53coming out?
  482. 17:54>> No, no, no, no, that's not. That's um
  483. 17:58>> No, it's not.
  484. 18:00Otherwise, it would be dimensioned.
  485. 18:07>> Looks like that's the road.
  486. 18:13>> So, it says west elevation
  487. 18:15>> amenities. Where did you want to enter
  488. 18:17from the court?
  489. 18:18>> That guy. All right. So, let's go back
  490. 18:20to the site plan.
  491. 18:27>> From by the pool. You want to enter from
  492. 18:28by the pool. So, the I'm thinking
  493. 18:30>> and the amenities building was something
  494. 18:32that was for the residents, right?
  495. 18:34>> Yes.
  496. 18:34>> Okay.
  497. 18:35>> Something the blank wall is probably
  498. 18:37what's facing the street.
  499. 18:38>> Seen the street and maybe they're going
  500. 18:39to put a sign on it. So then I just want
  501. 18:41to know if there's gonna be other under
  502. 18:42other treatment or landscaping or
  503. 18:44anything instead of just a blank wall
  504. 18:45facing the street there.
  505. 18:46>> Yeah. One of the things we don't like is
  506. 18:48when a building turns its back
  507. 18:50>> on the on the public.
  508. 18:53>> Yep. Uh well, let me uh
  509. 18:57make sure we know.
  510. 18:58>> Put a waterfall on there.
  511. 19:00>> Yeah. [laughter] Yeah. We'll get a
  512. 19:02waterfall in somewhere.
  513. 19:03>> I like how you think.
  514. 19:05>> I mean, it's such a small building.
  515. 19:07I'll add um more clarification on it,
  516. 19:10but I would say
  517. 19:11>> it it makes sense that you'd want to
  518. 19:13enter it from the from the pool side,
  519. 19:15but could there be some kind of
  520. 19:17treatment or landscaping or something
  521. 19:18that
  522. 19:19>> Now, what we did do is we did revise the
  523. 19:21landscape plan. That was one of the
  524. 19:22plans.
  525. 19:25>> Let's see if we got it right.
  526. 19:26>> Yeah, landscaping could probably work.
  527. 19:28>> It's only one story, right?
  528. 19:30>> Yes.
  529. 19:31>> It's not going to be super visible.
  530. 19:35We added a little bit in front there
  531. 19:37>> landscaping there. You can see
  532. 19:39>> think of it like a pool house really.
  533. 19:41>> And then this one back of the pool house
  534. 19:44>> CCR.
  535. 19:46>> So north is to the left.
  536. 19:48>> Correct. Cabana.
  537. 19:49>> So this would be the west side here,
  538. 19:54>> but [snorts] I'll I'll clarify that.
  539. 19:56>> Yep.
  540. 20:00Anything
  541. 20:04else?
  542. 20:05>> So, we uh updated the grading plan
  543. 20:07because we had to put spot grades on
  544. 20:09where the egress came out. We updated
  545. 20:12the lighting plan. There were a few
  546. 20:13issues on the lighting plan that we
  547. 20:15updated.
  548. 20:17Um and then of course um we updated the
  549. 20:20landscape plan.
  550. 20:22>> And the lighting with the lighting plan,
  551. 20:24Larry, did you did you incorporate the
  552. 20:26pool the effects of the pool or then
  553. 20:27not?
  554. 20:28>> We did. We added uh two uh 12T uh light
  555. 20:32poles. We didn't add add any ballards in
  556. 20:33there. Uh then on the pool, we added a
  557. 20:35note. We talked about adding a note. Uh
  558. 20:38it'll have to get through DO and they
  559. 20:41have a stringent lighting.
  560. 20:42>> Okay.
  561. 20:43>> Protocol.
  562. 20:44>> Okay.
  563. 20:45And then we did correct that one area by
  564. 20:47the dumpster on the souththeast side of
  565. 20:51the
  566. 20:56which is um
  567. 21:02come on baby.
  568. 21:04Yeah. Right here. So uh this pole was
  569. 21:07taken out. We added it back in and reran
  570. 21:10the phototric.
  571. 21:13That poll was gone previously.
  572. 21:15>> Did Did you get my comments? Like when
  573. 21:18you send that PDF, it gives us a way to
  574. 21:20send it. Put comments and send it goes
  575. 21:23back. It says it's submitting it to some
  576. 21:25place.
  577. 21:26>> Is it going to
  578. 21:29>> Did you send me an email? [laughter]
  579. 21:30>> Well, I put
  580. 21:31>> No, it it's in the PDF.
  581. 21:34>> Okay.
  582. 21:35>> It says comments. So, I can It goes
  583. 21:38>> So, you put some comments. I put
  584. 21:39comments on the
  585. 21:40>> Oh, does it go back to me? Yeah. Yeah.
  586. 21:43It updates the whole entire file
  587. 21:44actually.
  588. 21:46>> Oh, so you might have to send the file
  589. 21:48back to him.
  590. 21:49>> I I have to know.
  591. 21:49>> It might be like a marked up word doc.
  592. 21:51>> Okay. So then I have to
  593. 21:53>> if it's on cloud, you might have revised
  594. 21:55the vision. You might be able to see the
  595. 21:57comments.
  596. 21:57>> I think I think he doesn't I think it's
  597. 21:59already updated as soon as he makes a
  598. 22:01comment. Oh, so that in the cloud in the
  599. 22:04cloud.
  600. 22:05>> Just shoot me a note. Let me know. Yeah.
  601. 22:08So, not like a Microsoft.
  602. 22:10>> It was that you know I I see that you re
  603. 22:13uh relocated the generators.
  604. 22:15>> Yes.
  605. 22:15>> And on the one building, they're on the
  606. 22:17back side of the I think the east side.
  607. 22:20I I could be wrong.
  608. 22:21>> Yeah.
  609. 22:22>> Or they're facing the pond.
  610. 22:24>> Right.
  611. 22:24>> Right.
  612. 22:25>> They're hidden out of sight. And then on
  613. 22:27the other one, they're facing the
  614. 22:28parking lot. And I was just concerned
  615. 22:30about, you know, why they both weren't
  616. 22:34on the
  617. 22:35>> in similar places.
  618. 22:36>> Yeah. In similar places around the pond.
  619. 22:39>> Okay. Okay. Well, the reason why
  620. 22:42uh So, where are they? I'm going to get
  621. 22:44to this site. [snorts]
  622. 22:45>> It should be up at the north, right?
  623. 22:47>> Yeah.
  624. 22:47>> Yeah. I'm I'll show you. Yeah.
  625. 22:49>> So, one's here and one's here, right?
  626. 22:53>> Yeah.
  627. 22:54>> Right. And and on the other one,
  628. 22:56>> they're on the parking
  629. 22:59>> now. I think the
  630. 23:00>> Yeah.
  631. 23:01>> Yeah.
  632. 23:01>> There.
  633. 23:02>> They had been at the end there and
  634. 23:03there.
  635. 23:04>> Yeah.
  636. 23:04>> Now, we don't have the room to stick
  637. 23:07them here.
  638. 23:09>> No, but could you put them on the on
  639. 23:12what I'm saying is on the east side on
  640. 23:14that if that's if that's
  641. 23:17>> east side of the 30 3,3100
  642. 23:19>> 3100 that Yeah, that was my note. I just
  643. 23:22didn't know if there was a reason why
  644. 23:24not.
  645. 23:24>> So, well, I'm sorry. You don't like it
  646. 23:26here?
  647. 23:27>> Well,
  648. 23:31>> it's that they don't match, right?
  649. 23:33>> Yeah. Yeah. I just didn't know why
  650. 23:34they're not all in the back and
  651. 23:36>> Oh, okay.
  652. 23:37>> You know, for sound for sound and things
  653. 23:39if they kick on and
  654. 23:41>> Okay. The
  655. 23:43rule of thumb, Tom, I'm sure can verify
  656. 23:47this, but you try to, you know, you
  657. 23:50know, you're running primary to it,
  658. 23:52>> right? And then you're running it out.
  659. 23:54The longer that run is, it's pretty
  660. 23:56expensive.
  661. 23:56>> I I
  662. 23:57>> So you try to keep it near the
  663. 24:00electrical room so you're not,
  664. 24:02>> you know, running that now. Um, so when
  665. 24:05you first saw it was right by the door,
  666. 24:07just off the door. That's why cuz the
  667. 24:09electrical room. So, you're saying the
  668. 24:10electrical room is right in the middle
  669. 24:12of that?
  670. 24:12>> Yes, it is.
  671. 24:13>> It Okay.
  672. 24:14>> It is.
  673. 24:14>> That That's what I was trying to convey
  674. 24:16to you in my my comment,
  675. 24:18>> right? So, you know, so to head it off
  676. 24:20so I didn't have to waste time at the
  677. 24:21meeting.
  678. 24:22>> You know what I would do when you do
  679. 24:24that? Send them an email that says go
  680. 24:26take a look and see if you can see my
  681. 24:27comment.
  682. 24:27>> Yeah.
  683. 24:28>> I also again comments need should be
  684. 24:31part of the record too. And I don't I
  685. 24:33don't know if I'm not sure on this
  686. 24:36technology if like
  687. 24:37>> Yeah, if there was an article 78 if I
  688. 24:40would be able to import those comments
  689. 24:42into the record.
  690. 24:43>> Yeah, I think I think we always want to
  691. 24:45try to leave a paper trail.
  692. 24:46>> Well, that's why I was hoping that he
  693. 24:48would have had the comments. I could
  694. 24:49have
  695. 24:50>> She's saying I didn't see it and she
  696. 24:51doesn't see it and nobody else sees it.
  697. 24:53>> I don't have it.
  698. 24:54>> Cynthia doesn't see.
  699. 24:56>> But I think there's a way to do it. So,
  700. 24:58let me let me check on that. Yeah,
  701. 25:01unless he knows to look, it will just
  702. 25:03look like one comment until he double
  703. 25:05clicks it and then he'll see a string of
  704. 25:07comments.
  705. 25:07>> String of comments because you you could
  706. 25:09talk about that comment, too.
  707. 25:11>> Yeah.
  708. 25:12>> Yeah.
  709. 25:13I think that's more of an internal
  710. 25:14working,
  711. 25:15>> but I think that's what our attorney is
  712. 25:17trying to tell us is that you're then
  713. 25:19having a private conversation that not
  714. 25:20on the record.
  715. 25:21>> Well, well, if it goes to everybody, it
  716. 25:23should be circulated to everybody.
  717. 25:25>> Yes. But unless because then everybody
  718. 25:27can comment and that's good for us,
  719. 25:28>> right? Right. And it is it is it
  720. 25:31apparently it is in the PDF form. If you
  721. 25:34have pro, I guess if if you don't have
  722. 25:37pro and you don't have pro, then then we
  723. 25:40should kind of not do that.
  724. 25:42>> I think there's got to be a way to set
  725. 25:44it to red line.
  726. 25:46>> What?
  727. 25:47>> You want to send it to red [laughter]
  728. 25:48line
  729. 25:51>> because there's no way you're going to
  730. 25:53but if they're offering that service,
  731. 25:57it's like a document. a word doc or
  732. 26:00excel
  733. 26:02send a red line.
  734. 26:03>> I mean if you want to do that maybe you
  735. 26:05just copy I could just send it to you
  736. 26:08make a list of the comments and export
  737. 26:10them.
  738. 26:12>> Yeah I'll just copy and I could copy and
  739. 26:14past there's a lot of ways I could do
  740. 26:15it. I just
  741. 26:16>> but I think the point is is not to have
  742. 26:18a um a dialogue that is not part of the
  743. 26:21record.
  744. 26:22>> I don't know.
  745. 26:22>> Right. Right. Is is there an issue with
  746. 26:25the quorum rules? Like if one person is
  747. 26:28talking
  748. 26:29>> Oh, interesting.
  749. 26:30>> What was that?
  750. 26:31>> Um, is there an issue with the quorum if
  751. 26:34if they're making comments on on a cloud
  752. 26:37document?
  753. 26:38>> I mean, it's it's new technology. I'm
  754. 26:41not sure I'll be able to get an opinion
  755. 26:42on it, but yes, I think it it's
  756. 26:44potentially open meetings violation
  757. 26:45because you're having discussions open
  758. 26:48dialogue the public isn't able to log
  759. 26:50into and see. [clears throat] You're not
  760. 26:51having it at an open meeting.
  761. 26:54Interesting.
  762. 26:54>> But how is that different than a a
  763. 26:56meeting like if you're talking if you're
  764. 26:59talking to Larry about something if if
  765. 27:01one of us is talking to Larry about
  766. 27:03something that you know comes up.
  767. 27:06>> No, no. If it's you and Larry, that's a
  768. 27:09conversation. But if it's you and Larry
  769. 27:13>> in the cloud
  770. 27:13>> and Gigi and Chris and Dylan, that's a
  771. 27:16meeting,
  772. 27:17>> right? I Okay, I understand. So the
  773. 27:19question is is the fact that it's the
  774. 27:21cloud where everyone can see and comment
  775. 27:23and comment to your comment. Does that
  776. 27:25make it a dialogue?
  777. 27:27>> I'll have to talk to Adobe to see if
  778. 27:29they shut that off. Then
  779. 27:30>> the question too is if you marked the
  780. 27:33document as a red line document and the
  781. 27:35and the comments are on top microphone,
  782. 27:37please
  783. 27:38>> and the comments are on top of the
  784. 27:39document where everybody can see it when
  785. 27:41they open it,
  786. 27:42>> then it might not be
  787. 27:44>> interesting
  788. 27:44>> because then everybody can see it. Well,
  789. 27:47I'm glad I'm glad it happened because
  790. 27:49that's why you know it.
  791. 27:50>> Well, and and also he's not and if they
  792. 27:52don't know to look and they're not even
  793. 27:54getting your comments. So,
  794. 27:55>> right. So, it's a m it's a moot point
  795. 27:56from that.
  796. 27:57>> Okay. So, I'll hear your comments when
  797. 27:59we go around.
  798. 28:00>> Yeah. Well, yeah, that I mean that was
  799. 28:02the thing was
  800. 28:03>> he was trying to give you a heads up and
  801. 28:05get there early.
  802. 28:06>> But he was trying to get get
  803. 28:07>> so that you would have an answer for my
  804. 28:10comment basically.
  805. 28:11>> No, I I do. But I I would say that it I
  806. 28:14like the idea of getting early comments,
  807. 28:17but that
  808. 28:19>> they should either you should like send
  809. 28:20them to Cynthia and have her send them
  810. 28:22or something so that there is this
  811. 28:25record so that we know.
  812. 28:26>> Yeah.
  813. 28:27>> Okay.
  814. 28:29>> So that's it for me.
  815. 28:31>> Really? Okay. [laughter]
  816. 28:35>> He wants out.
  817. 28:37>> All right.
  818. 28:37>> No, no, I don't don't want out. I want
  819. 28:39to get it done.
  820. 28:40>> Yep. Yep. So, Miss Moss, what comments
  821. 28:43do you have on this phase phase four?
  822. 28:46>> None at the moment. No.
  823. 28:48>> Okay. Miss Franson, we've all been quite
  824. 28:50busy in the last day or so.
  825. 28:52>> Yes. So, in terms of comments, the
  826. 28:55anything that hadn't been addressed is
  827. 28:58been requested to be a condition.
  828. 29:00>> Uh, but the one thing I would like to
  829. 29:02highlight is the lighting plan is still
  830. 29:04off. Um, when I looked at it, the 99
  831. 29:06version, there's a foot candle around
  832. 29:0910.1
  833. 29:11and we needed to be under five. So, and
  834. 29:15the table, the chart on the lighting
  835. 29:17plan says that it's under five, but it
  836. 29:19the actual numbers imply that. So, so
  837. 29:22that's just something that we have to
  838. 29:23review, continue to review for
  839. 29:26>> there's almost always something like
  840. 29:27that in these lighting plans. And then
  841. 29:29as we make the changes, it just turns
  842. 29:31out that there might be other revisions
  843. 29:32that have to be made for consistency
  844. 29:34purposes, but that was the one
  845. 29:36highlight. Um, we also had already
  846. 29:38discussed and uh I think decided at a
  847. 29:42prior meeting that the recreation plan
  848. 29:44will come back to the board. There were
  849. 29:46just so many potential changes and
  850. 29:49design options. It's not something that,
  851. 29:51you know, consultants should really
  852. 29:53weigh in on. It's really something that
  853. 29:54the board has to. So
  854. 29:56>> there was like no uh lighting on the
  855. 29:58buildings and
  856. 30:00>> yeah that has to so all of that's going
  857. 30:01to be built into recreation plan that um
  858. 30:05the planning board will get to review
  859. 30:07again. So lighting recreation I think
  860. 30:09were the the highlight
  861. 30:10>> show condition.
  862. 30:12>> Yeah. Others some were addressed um
  863. 30:14>> good.
  864. 30:15>> So I think we I think there's progress
  865. 30:17made and these will just be final review
  866. 30:19>> and we're going to have a discussion
  867. 30:20after everybody's comments of how to
  868. 30:22pull this
  869. 30:23>> all together. Yes. Sounds good. Thank
  870. 30:25you, Mr. Harvey.
  871. 30:27>> Yeah. So, I didn't have a chance to
  872. 30:28review the whole plan set that came in
  873. 30:30on 99, but a couple things I noticed is
  874. 30:32that um in a in addressing the fire
  875. 30:35department's comments with the new
  876. 30:36exits, we don't have any walkways to or
  877. 30:39from those exits.
  878. 30:40>> No, no walkways.
  879. 30:41>> So, those exits only used in event of
  880. 30:43emergency or could they be used by
  881. 30:45anybody anytime?
  882. 30:46>> No. No, that is intended to be
  883. 30:48emergency. They'll they'll be locked, I
  884. 30:50think, on the outside.
  885. 30:51>> So, an alarm will go off, right? Like a
  886. 30:53landing.
  887. 30:54>> It has a landing. I guess my concern was
  888. 30:55like in the winter snow removal if
  889. 30:57someone if a fire happened in the winter
  890. 30:59is that going to prevent a
  891. 31:00>> door open if there's a Yeah.
  892. 31:02>> I and that's I just wanted to ask the
  893. 31:03question if the planning board wanted to
  894. 31:05consider walkways or something there or
  895. 31:06even just make sure that the landscape
  896. 31:08>> should be signage at least right
  897. 31:09>> of the route.
  898. 31:10>> I don't know I don't know how that gets
  899. 31:11handled.
  900. 31:13>> Yeah. Well, we we have a landing and a
  901. 31:15and a spot right on it but no sidewalk.
  902. 31:18>> It's not intended to be
  903. 31:20>> No, understood. But but if in the winter
  904. 31:23they're pushing all their snow up
  905. 31:24against it.
  906. 31:25>> Well, no, no, it won't be pushed. The
  907. 31:27snow won't be pushed up against the
  908. 31:28door. It just be whatever naturally
  909. 31:30falls.
  910. 31:31>> Okay.
  911. 31:31>> Yeah. Yeah. But what we will do is we'll
  912. 31:34shovel the landing.
  913. 31:36>> Yeah, you clear the landing.
  914. 31:37>> Yeah, we're going to clear the landing
  915. 31:38so you can get out
  916. 31:40>> and get out.
  917. 31:42>> It looked like some of the landscaping
  918. 31:43conflict with that that route, too. So,
  919. 31:45we're just making sure there's a clear
  920. 31:46way out, I think, is is what we need to
  921. 31:48see. And I think landscaping is almost
  922. 31:51always a condition also
  923. 31:53>> uh for these final as we get closer and
  924. 31:57>> finalize the plans.
  925. 31:58>> So the other thing that went with that I
  926. 31:59think was um the floor plan adjustments
  927. 32:01to move the stairwells to exit on the
  928. 32:03parking lot sides. So I don't know if we
  929. 32:05saw did we see the updated floor plans
  930. 32:07and how that ended up working.
  931. 32:09>> Did you end up sending something to the
  932. 32:10fire department?
  933. 32:11>> Yeah. No, we we sent the um
  934. 32:15uh
  935. 32:17>> Yeah. Yeah. The floor, the stair tower
  936. 32:19gets moved from the inside courtyard
  937. 32:23side to the outside.
  938. 32:25And if you want to see floor plans Yes.
  939. 32:28>> The fire department wanted to see those,
  940. 32:30right?
  941. 32:30>> Yeah. So, you should send them over.
  942. 32:32>> Yeah. Okay.
  943. 32:33>> That would be good.
  944. 32:34>> I just wanted the plan to get a chance
  945. 32:35to see them if they've changed.
  946. 32:37>> Yep.
  947. 32:37>> They're changed
  948. 32:38>> cuz they're done. Yep.
  949. 32:39>> Um that was all I had on that.
  950. 32:41>> Okay, good. Miss Badoro.
  951. 32:46So um we have collated comments uh from
  952. 32:50the planner and the engineer although
  953. 32:52the engineer has not finished the review
  954. 32:54of the newest plan set.
  955. 32:57>> Um so I think we are like this close
  956. 33:01we're very close this close to pulling
  957. 33:03it all together. Um I just want to make
  958. 33:06sure that we're not overlooking little
  959. 33:07details that got switched when the plans
  960. 33:09were updated on September 9th.
  961. 33:12>> I think that's a fair point. Um, but I
  962. 33:14do want to I do want to commend
  963. 33:16everybody for um diligently trying to
  964. 33:20get uh take a look at the original 68
  965. 33:23conditions and going through all the new
  966. 33:26plans sets even with the there was new
  967. 33:29ones and then there were even newer
  968. 33:30ones. So I appreciate though the level
  969. 33:33of detail and um effort that has gone
  970. 33:36into getting us to this point.
  971. 33:39Um, I'd like to get our uh comments from
  972. 33:41the board and then we need to talk about
  973. 33:43next steps. So, Mr. Tuttle, what
  974. 33:45comments do you have?
  975. 33:47>> Um, I had the same comment about the
  976. 33:50egress as Tom particularly. It seemed
  977. 33:53like it was a cleared area right around
  978. 33:55the door, but that the landscaping there
  979. 33:57was still landscaping in between.
  980. 34:00>> Um, I had a similar comment about the
  981. 34:02lighting. It seems like the the building
  982. 34:04mounted lights are the problem,
  983. 34:05especially in the courtyard. You're
  984. 34:07getting spots of 14 foot candles.
  985. 34:10>> Oh, is that where you get the 14?
  986. 34:11>> That's where I saw the highest numbers
  987. 34:13was in the courtyards underneath the the
  988. 34:15building mounted can lights.
  989. 34:17>> Oh, those guys.
  990. 34:18>> Yep.
  991. 34:18>> All right, let me see. [snorts]
  992. 34:22>> Yeah, there we go.
  993. 34:37underneath these guys.
  994. 34:38>> Yep. Got a 14 right next to that one.
  995. 34:40Got an 11 right next to that one.
  996. 34:41>> I'm sorry. Where's that right there?
  997. 34:44>> Yep.
  998. 34:45>> There's just a few that are Oh, these
  999. 34:47are sort of spotlight can lights.
  1000. 34:49>> Yeah.
1001. 34:50>> Um that are going to create these hot
1002. 34:52spots. So, it might be a fixture issue
1003. 34:54that might need to update the
1004. 34:55>> Okay, got it. Got it.
1005. 34:58>> I don't know how anybody can read those
  1006. 34:59numbers. [laughter]
  1007. 35:01>> Need a computer.
  1008. 35:08Okay.
  1009. 35:09>> Uh, that's that's all I have. The Rob
  1010. 35:12just raised a a good point about the
1011. 35:13courtyards that that he can talk about
1012. 35:15here, but I might chime in on as well.
  1013. 35:17>> Okay. Mr. Waters.
1014. 35:19>> Okay. Uh, one of the comments I had,
  1015. 35:22like I I said I had submitted, but it
1016. 35:25went into space somewhere. Um, it was
  1017. 35:29from the amen amenities building. I'm
1018. 35:31What is the amenities building? What is
1019. 35:33it? Is it for party parties? Is it
  1020. 35:36barbecues? Uh
  1021. 35:37>> it's mainly um
1022. 35:40a place to barbecue that kind of thing
  1023. 35:42out of the rain. It's a shelter.
1024. 35:43>> So So certain tenants could could they
1025. 35:46book that like for part like Okay. Okay.
1026. 35:48So here here was my question with that
1027. 35:50and it's just again it might be a might
1028. 35:54have to stay the way it is because I
  1029. 35:56know you're constrained with space is
1030. 35:59when you come out of that building you
1031. 36:02have a straight you have to pass through
1032. 36:03the pool you have to go around the pool
  1033. 36:06to get to the fire pit. I it's just a
1034. 36:09silly question without having some kind
1035. 36:11of foot path along in in a garden maybe
  1036. 36:15in a in a you know u uh you know
1037. 36:18butterfly garden or whatever along the
1038. 36:21building or wherever your landscaping
1039. 36:23is. So, so in other words, my concern
  1040. 36:26was suppose somebody's in a wheelchair
1041. 36:28or ADA and they have to go from that
1042. 36:30building, they have to go through around
  1043. 36:33the pool,
  1044. 36:33>> right? So, you're here
1045. 36:34>> because you're going to have lounges,
1046. 36:35lounge chairs there and things like
  1047. 36:37that.
1048. 36:37>> So, you're here and you want to go to
  1049. 36:39here.
  1050. 36:39>> Yeah.
1051. 36:40>> You got to go through the pools.
1052. 36:42>> Yeah. Yeah. And that's going to be
  1053. 36:43gated, right, and locked. So, you're
1054. 36:45going to have to have a path, you know,
1055. 36:46it's going to it might create an issue.
1056. 36:48>> Is there a walkway though between the
1057. 36:50wall and the fence? No, this is 50 ft
  1058. 36:54wide.
  1059. 36:55>> Oh, wow. Okay.
1060. 36:56>> How How wide is it?
  1061. 36:57>> 50.
1062. 36:58>> The whole thing is 50 ft.
1063. 36:59>> The whole thing is 50 yard.
  1064. 37:01>> But still, it's just
1065. 37:02>> the pool is 20 by 40, then you get the
  1066. 37:0410 decks on it.
1067. 37:05>> I mean, are little kid, you know, if mom
1068. 37:07and dad are down by the fire pit and the
1069. 37:10child was over here and they're going to
1070. 37:11go through, do they have to go around
  1071. 37:13the pool and
  1072. 37:14>> Yeah. Yeah.
  1073. 37:16>> way this would Yeah. No, that's a
  1074. 37:20>> Okay.
  1075. 37:21That's all
1076. 37:23>> from a I mean we already we could get
1077. 37:24the sign off from the fire chief. It's a
1078. 37:26little surprising like there is that
1079. 37:28sort of space issue for fire too going
1080. 37:31through there I would think. Right. You
  1081. 37:33got these narrow
  1082. 37:33>> go through here.
  1083. 37:34>> Yeah.
  1084. 37:35>> And they're okay with that. I mean
1085. 37:36you've talked to him about that. I mean
  1086. 37:38>> I didn't talk to him but I
  1087. 37:40>> he
1088. 37:42can't they go out both ways. I mean they
1089. 37:43can go out both ends of the building on
1090. 37:45that one because they made more room by
1091. 37:47rotating the amenity building and they
1092. 37:49could still go out to the left. They
1093. 37:51could come in from the other side. You
  1094. 37:52mean?
  1095. 37:52>> Yeah.
  1096. 37:52>> Yeah.
1097. 37:53>> So, they could go either way to get out,
1098. 37:55I guess. It looks like
  1099. 37:56>> Sure. So, I mean, that's good if it's
1100. 37:57not a fire issue. It's just sort of if
1101. 37:59if if you live on the other side of that
1102. 38:01building, you come out that door, you've
1103. 38:04got to go through the area.
  1104. 38:05>> Yeah. To get
1105. 38:06>> But I suppose what we could do is narrow
1106. 38:08a deck on the not, you know, on the the
1107. 38:13shade side, right? So, it wouldn't be
1108. 38:15this side. It would be this side. You
1109. 38:17could narrow that deck and squeeze in
1110. 38:18the walk here. Uh that that was just you
  1111. 38:20know like I said I
1112. 38:22>> I don't know if you want to do that
  1113. 38:23though Larry because then you're
  1114. 38:24bottlenecking
  1115. 38:26>> the people around
1116. 38:27>> the people in the pool area. Yeah.
1117. 38:29>> Yeah. And you can't move the fire pit
1118. 38:31closer to the building because then you
  1119. 38:32have a
1120. 38:33>> then that is a fire issue.
  1121. 38:35>> Fire issue. I you know I think
  1122. 38:38>> I don't know.
1123. 38:38>> It might have to be the way it is. I but
  1124. 38:41it was a it was something I I noticed
1125. 38:44and I said to myself that's kind of like
1126. 38:46now you're going to have to have
  1127. 38:48everybody who's a guest is going to have
1128. 38:50to have a key card to get through the
1129. 38:53gate to get down to the fire pit unless
1130. 38:55they just walk on the lawn or through
  1131. 38:56the gardens.
1132. 38:59That's why I was saying maybe there
1133. 39:00could be a you know little foot path in
  1134. 39:02there
1135. 39:04>> to get around the pool.
  1136. 39:05>> Yeah. So,
  1137. 39:08I mean, that's a good that's a good
  1138. 39:10point. Um,
1139. 39:15like I said, we could narrow one side of
1140. 39:17the deck and and put a walk. Uh,
1141. 39:21>> I got to I got to think about that.
  1142. 39:22>> Yeah.
  1143. 39:25Like I said, I'm I don't I I just It was
  1144. 39:28just something I saw, that's all. And
1145. 39:30I'm not It's not going to be something
1146. 39:33I'm like going to that's it, you know?
  1147. 39:37[laughter] Do it. I mean cuz you're
  1148. 39:39done.
  1149. 39:40>> Yeah. You're That's it. No.
1150. 39:42>> And No. For me,
1151. 39:44>> it's you've got more space on the other
  1152. 39:46courtyard.
  1153. 39:46>> Yes.
  1154. 39:47>> And and it's a similar situation where
1155. 39:50the doors on the east side of the
  1156. 39:52building.
  1157. 39:52>> Yeah.
1158. 39:53>> And the doors on the west side. The only
1159. 39:56accessible path sort of connecting
1160. 39:58through the courtyard is through the the
  1161. 39:59pool area. And
  1162. 40:01>> yep.
  1163. 40:06>> Yeah. Same thing.
  1164. 40:08>> Yeah. I know this is a maybe it's a dumb
  1165. 40:11question. I'm not sure. But
1166. 40:13if you push the pool all if you push the
1167. 40:16pool all the way down
1168. 40:18>> and put the fire pit between the
  1169. 40:19building and the pool,
1170. 40:21I mean, is that really a fire issue?
1171. 40:25I mean, between the amenity building and
1172. 40:27the uh and the pool.
1173. 40:28>> No, he's saying if you switched it, this
1174. 40:30>> guy stick it here and move the pool down
  1175. 40:32here.
1176. 40:33>> Yeah. Move it down and you create a
1177. 40:35courtyard in front of the amenity
1178. 40:36building, which is kind of nice with a
1179. 40:39fire pit and people It's like And you
1180. 40:41have, you know, the building opens up
1181. 40:43into a mini courtyard with the fire pit.
  1182. 40:48>> I don't want to change anything. I'm
  1183. 40:49just
  1184. 40:51>> I don't know. I mean,
1185. 40:53>> you're going to dig a hole for the pool.
  1186. 40:55>> I mean, it's not just circulation on
  1187. 40:56these amended spaces. It's also
  1188. 40:58accessibility. I mean, this is really
1189. 41:01the issue. So, it there might be a a way
1190. 41:05to mix it up, Larry, where you switch
  1191. 41:08the components, but I think your
1192. 41:10accessibility issue is is still going to
1193. 41:14be an issue in these spaces.
  1194. 41:21Think
  1195. 41:22>> food for thought.
1196. 41:23>> Got to think about it.
  1197. 41:24>> Okay.
  1198. 41:26>> Anything else, Rob?
  1199. 41:28>> No. Okay.
  1200. 41:29>> I hate it,
  1201. 41:30>> Mr. [laughter] Oliver.
1202. 41:32>> Good comments. Good comments.
  1203. 41:34>> No comments.
  1204. 41:35>> Okay. Miss Lee,
1205. 41:36>> no other comments. Sorry. Thank you.
  1206. 41:37>> Okay. Thank you,
  1207. 41:38>> Mr. Garcio.
  1208. 41:39>> None.
1209. 41:41>> Okay. Um, my only uh question is, so the
1210. 41:46pool lighting is dictated by Department
  1211. 41:48of Health.
  1212. 41:49>> Mhm. Um, and I think I saw
1213. 41:52>> and the whole per pool permit
1214. 41:54>> the whole permitting. Right. Right. So,
1215. 41:56from a lighting perspective, it could be
1216. 41:58pretty bright around the pool, right?
1217. 42:01>> Yeah. They have pretty high.
1218. 42:03>> Yeah. You don't want people stumbling
  1219. 42:04around at night.
  1220. 42:07>> So, we'll concern
1221. 42:08>> that's not on here, right? We don't know
  1222. 42:10what that is.
  1223. 42:11>> Okay.
1224. 42:11>> This is not a pool permit plan.
  1225. 42:14>> Gotcha.
1226. 42:17>> Okay. Um, is there anybody here from the
1227. 42:20public that would like to speak to this
  1228. 42:21application?
1229. 42:23>> Okay. So, let's talk about next steps.
1230. 42:26>> Um, we did have a draft resolution
1231. 42:29pulled together at the 11th hour this
  1232. 42:31afternoon, but nobody's really had a
1233. 42:33chance to review it, and we know that
1234. 42:36there's been five [clears throat]
1235. 42:37revised plan sheets that have come out
1236. 42:40in the last week. So, we were talking
1237. 42:42before uh tonight's meeting about how we
1238. 42:46move and get to a signed conditional
  1239. 42:49approval.
1240. 42:51>> So consultants, we would like to see if
  1241. 42:53we could get
1242. 42:56everyone here and do a page turn with
1243. 42:58the final plan set because like Tom has
1244. 43:01not done that and match them up against
1245. 43:05the resolution as it stands
  1246. 43:07and just it's a great opportunity to
  1247. 43:10just um figure out
1248. 43:12the final list of res uh conditions on
  1249. 43:15the resolution. So because it's 3 weeks
1250. 43:19now between the next meeting so we don't
  1251. 43:21want to wait 3 weeks.
1252. 43:23>> I just want to ask a question. Are we
1253. 43:24are we basing that on the 99 submission
1254. 43:26or are we expecting something new?
  1255. 43:28>> 99
  1256. 43:30>> 99. Uh yes.
1257. 43:35So we have the electronic plan set and
1258. 43:37we have a do we have the physical plan
  1259. 43:39set
1260. 43:40>> and the five sheets
1261. 43:42>> and the five updated sheets. Right.
  1262. 43:45because it was 91 and 99.
  1263. 43:48>> I have five sheets,
1264. 43:50>> right? So, those are the sheets.
1265. 43:51>> So, we're trying to figure out how to do
  1266. 43:52a page turn.
1267. 43:52>> So, that's the current paper set.
  1268. 43:58>> The five pages,
1269. 43:59>> five pages plus the uh the [snorts] set
1270. 44:02full set that was submitted prior to it
  1271. 44:05was submitted um
  1272. 44:07>> is that 91?
1273. 44:08>> I think they never got paper.
  1274. 44:11August 18th.
1275. 44:13>> We got digital copies of the whole 99.
  1276. 44:16Yeah.
1277. 44:16>> Right. But that's hard to do a page
  1278. 44:18turn.
  1279. 44:18>> August 18th [snorts] was the
1280. 44:20>> Okay. So that there was an August 18th
  1281. 44:23full submission, right?
1282. 44:24>> Yeah. For the September 2nd planning
  1283. 44:27board. Then we
1284. 44:28>> then five updated sheets, right? met
1285. 44:31with the fire chief during that period
  1286. 44:33of
1287. 44:34and then we presented those sheets uh
1288. 44:37the changes at the September 2nd meeting
1289. 44:41and we reissued the electronic set last
  1290. 44:45week.
  1291. 44:46>> Okay.
1292. 44:46>> With those five set sheets.
1293. 44:48>> So if we take the August 18th submission
1294. 44:50and we have the five updated plan
  1295. 44:53>> Y
  1296. 44:53>> sheets
1297. 44:54>> that we swap out
1298. 44:56>> and the two elevations
1299. 44:57>> and the two elevation sheets that were
1300. 44:59submitted. You can do a page turn
  1301. 45:02and and be
  1302. 45:05comfortable that you're looking at all
1303. 45:06of the most recent submissions
1304. 45:10>> and then that way
  1305. 45:11>> if if you want Cynthia, I'll run a a
  1306. 45:14clean full set
  1307. 45:15>> if that's helpful.
1308. 45:16>> I think we can manage. Okay,
1309. 45:19>> we can't manage I would say we can
1310. 45:20manage with just those seven sheets to
  1311. 45:22swap out, but
  1312. 45:24>> I've been overruled there.
1313. 45:26>> But it is different. There's lighting
  1314. 45:27changes. That's what I'm I'm challenged
  1315. 45:28by. It doesn't seem complete.
1316. 45:30>> No, the lighting changes are in the
  1317. 45:34five.
1318. 45:35>> They're in the five that were submitted
  1319. 45:37on the second,
1320. 45:38>> but those were incorporated in 99,
1321. 45:41right? Those are part of the 99 set.
  1322. 45:43>> Yes. Correct.
  1323. 45:44>> Yes.
  1324. 45:44>> And there's still issues,
  1325. 45:46>> right? So,
  1326. 45:47>> so that's the page.
1327. 45:48>> So, they don't go away. I mean, they
1328. 45:49don't go away. They just
1329. 45:51>> you'll be you'll be able to detail the
  1330. 45:53condition maybe more fully.
1331. 45:55>> We're not making any new changes. We
1332. 45:56just need a final set that we can write
  1333. 45:58our conditions.
  1334. 45:59>> I'm happy to do that.
  1335. 46:04>> That's the digital set.
1336. 46:06>> Are we sure? [laughter]
1337. 46:09>> That's my concern is just are we certain
1338. 46:11that more comfortable having a print of
1339. 46:13the 99 set all one set so we don't have
  1340. 46:15to mix and match
1341. 46:16>> just in case. Okay. Yeah.
1342. 46:19>> At least one. So then so then the next
1343. 46:22question is when can we meet?
1344. 46:26Then again, this is all your calendars.
1345. 46:30I don't think we're going to be able to
1346. 46:31do it for Friday mornings, Victoria,
  1347. 46:33because I don't think we'll have a full
  1348. 46:34plan set by then.
  1349. 46:38>> I I mean, I was saying I'm free all day
1350. 46:40Friday if we wanted to do it this
  1351. 46:42Friday.
  1352. 46:42>> I can I can get you a full plan this
  1353. 46:44Friday. I can't
  1354. 46:46>> by Friday.
  1355. 46:47>> Yeah, I'll have I'll have
  1356. 46:51>> I can't.
  1357. 46:54>> All right. So
1358. 46:56talk did you how do your calendars look?
1359. 46:59>> Are we looking to include the applicant
  1360. 47:01and the planning board?
1361. 47:02>> No, no, this is just consultant page
1362. 47:04turn to define a definitive set of
1363. 47:08conditions for the this resolution that
1364. 47:11we would like to do. And then when you
1365. 47:14do, you can go off and get that
1366. 47:16resolution written. And then we would
1367. 47:19like to set we would like to set a
  1368. 47:21special meeting
  1369. 47:23to approve the conditional
1370. 47:25approval. I can do Tuesday and Thursday
  1371. 47:28of next week.
  1372. 47:29>> Tuesday and Thursday.
1373. 47:30>> Yeah. My Fridays I have events going on.
  1374. 47:34>> I could do Thursday the 24th.
1375. 47:36>> How are you in the morning?
  1376. 47:38>> 24th.
  1377. 47:39>> How early?
  1378. 47:41>> I could be here early.
  1379. 47:43>> What's 9:39?
  1380. 47:45>> Bonnie's driving the farthest. I I can
1381. 47:48come up early if that's what everybody
  1382. 47:49needs.
1383. 47:51>> So, what time on the 24th?
  1384. 47:54>> 8:30 or 9ine?
  1385. 47:55>> 9. [laughter]
  1386. 47:56>> Okay.
1387. 47:58>> Okay. So, no. No. No. Next week is fine,
1388. 48:02Larry, to bring in that full plan set.
  1389. 48:04So, Thursday
  1390. 48:0624th is a week from tomorrow.
1391. 48:08>> Yep. So, if you can get a full plan set
1392. 48:09in by Friday or Monday, that would be
  1393. 48:11great.
  1394. 48:12>> Okay.
1395. 48:14That way it's just here in case anybody
1396. 48:16want to get wants to get a preview.
1397. 48:18>> So then the next question is
1398. 48:20>> if you guys do page turn
1399. 48:24>> and you get the list of conditions,
1400. 48:27when would we have a prepared resolution
1401. 48:30because I would like to adjourn our
1402. 48:33public hearing to a date where we can
  1403. 48:35have a special meeting
1404. 48:37and consider the approval of that
1405. 48:40resolution. So for me the idea is that I
1406. 48:43would we would we would try to craft the
1407. 48:46conditions based on this discussion at
1408. 48:48the page turns kind of real time
1409. 48:51>> and then clean it up and send it around.
1410. 48:53So I would think we would have a final
  1411. 48:55resolution by Monday the 28th.
1412. 49:04So then I have to ask my playing board
  1413. 49:07colleagues
  1414. 49:09so I'm I'm out.
1415. 49:12>> I'm wondering if we did something at
  1416. 49:14five o'clock would we have
1417. 49:16>> or is during the day. How is everybody's
  1418. 49:19schedules looking?
1419. 49:20>> That's actually open for me right now.
1420. 49:23>> Day is fine for me.
1421. 49:25>> Okay. Uh what time?
  1422. 49:31>> There's a there's a chance I might get
  1423. 49:32something scheduled I can't miss between
1424. 49:34now and then, but at the moment it's
  1425. 49:36totally open. So,
  1426. 49:37>> okay.
1427. 49:39So when should we what
  1428. 49:40>> what day?
  1429. 49:41>> Uh Monday the 28th
1430. 49:44are we confident about the this or
1431. 49:46should we buy us ourselves a little bit
  1432. 49:48of time?
  1433. 49:49>> I prefer
1434. 49:50>> it's I think you guys are really close.
  1435. 49:51So I I think that
  1436. 49:53>> it's it's really cleaning it up.
1437. 49:55>> We were just talking about
1438. 49:57>> whether the cons I'm out that week but I
1439. 49:59don't necessarily have to be here if you
  1440. 50:01just have a resolution. Yeah. Okay.
1441. 50:03>> And we only need four, right?
1442. 50:04>> And we only we need four planning board
  1443. 50:06members. We need Cynthia.
  1444. 50:09>> Yeah.
1445. 50:09>> And if possible, it'd be nice to have
  1446. 50:12this video, but
1447. 50:14>> but it would be noticed. It would be
1448. 50:15public. It would be the
1449. 50:16>> right. I'd like to adjourn the public
1450. 50:17hearing to whatever date we choose and
  1451. 50:19time.
  1452. 50:20>> I'll make sure I make myself available
  1453. 50:22for whatever time.
1454. 50:22>> So, is there a feel for time?
1455. 50:24>> On the 28th. I could only do the evening
  1456. 50:27and I
1457. 50:28>> Okay, we might have But we might have
  1458. 50:29four if
1459. 50:32one, two, three. Don probably can.
1460. 50:35>> Yeah. And if not, so if we do it later
  1461. 50:38in the day,
1462. 50:40>> what when you say evening?
1463. 50:41>> Um, anytime after like uh
  1464. 50:45>> 10:00 at night,
  1465. 50:46>> like after 4 p.m.
  1466. 50:48>> After 4.
  1467. 50:55>> So maybe 5:00 on Monday the 28th.
  1468. 51:00>> I Madam Secretary, that
  1469. 51:04>> unless they
1470. 51:05But they are the other names.
  1471. 51:07>> Okay.
1472. 51:08>> Do we want to try that then?
  1473. 51:10>> Hold on.
1474. 51:10>> So, do we want to close the hearing
1475. 51:12tonight and then if that doesn't work,
  1476. 51:14you can
1477. 51:16>> have to continue the hearing to a
  1478. 51:18specific date.
  1479. 51:19>> So, we'd like to Yeah.
  1480. 51:21>> Monday the 28th at 5:00 p.m.
  1481. 51:22>> If we
1482. 51:24Why not close the hearing
  1483. 51:27>> today?
  1484. 51:28has a new submission
1485. 51:29>> if there's no new submission coming.
1486. 51:32That way if something does go wrong with
1487. 51:34the date, we're not having to like
1488. 51:36>> show up scramble scramble
1489. 51:38>> scramble open the open and close the the
  1490. 51:40>> do a full full-blown scramble.
1491. 51:42>> Right. Right. Keep it simple.
  1492. 51:43>> Yeah.
  1493. 51:43>> I don't know.
  1494. 51:44>> I am I'm fine with that.
  1495. 51:46>> I I mean I think the public has had a
  1496. 51:48ample opportunity to comment.
  1497. 51:50>> Yep. Um
  1498. 51:50>> agreed.
1499. 51:51>> No one came tonight.
1500. 51:53>> Yep. And if you're not and there's no
1501. 51:55new no new changes between now and the
  1502. 51:57next meeting.
  1503. 51:58>> Correct.
1504. 51:59>> Okay. Yes. I mean, we've given you food
1505. 52:01for thought, but we didn't say go change
  1506. 52:03something,
  1507. 52:04>> right?
  1508. 52:04>> Okay.
  1509. 52:05>> Oh.
1510. 52:06>> All right. So, I'm comfortable with
1511. 52:07that. Closing it tonight and then
  1512. 52:09shooting for Monday the 28th
  1513. 52:13>> 5 p.m.
  1514. 52:13>> at 5.
  1515. 52:14>> I can't do five. I can do anytime during
1516. 52:17the day. So, if you need
1517. 52:18>> Okay. So, it looks like we could
1518. 52:20>> we can make it. And what about you and
1519. 52:22you for time during the day?
1520. 52:24>> Five is probably ideal because if
1521. 52:25something does come up during the day
1522. 52:27then I it would have to take president
1523. 52:28but um yeah but five is good
1524. 52:32>> and you could do five. All right. So we
1525. 52:33>> I could do here tonight we would have
  1526. 52:35four at five.
1527. 52:37>> Whatever it takes to get it done.
1528. 52:39>> Okay. No worries. But thank you for
  1529. 52:41that.
1530. 52:42>> And I may be able to come.
1531. 52:44>> Yep. Yep. Okay. So, we have a page turn
1532. 52:46scheduled for next Thursday at 9:00 and
1533. 52:50then a resolution to be ready and uh
  1534. 52:53considered for approval on 9:28 at 5:00
  1535. 52:56p.m.
1536. 53:01>> Any other comments on that?
1537. 53:03>> Close the hearing tonight.
1538. 53:04>> So, we would be closing the public
  1539. 53:05hearing tonight.
1540. 53:07>> Yeah, I think that I mean that works.
1541. 53:09>> Okay. Did I ask does anybody from the
1542. 53:12public want to have one last chance to
  1543. 53:15comment on this application?
1544. 53:18If not, may I get a motion to close the
  1545. 53:21public hearing?
  1546. 53:21>> So move. Second.
1547. 53:23>> All in favor, please say I.
  1548. 53:24>> I.
1549. 53:25>> Thank you everybody. So
1550. 53:27>> great. Thank you very much.
  1551. 53:29>> We're looking at uh the 28th.
1552. 53:31>> Yep. Sounds like a great plan.
1553. 53:33Appreciate uh you making that happen.
  1554. 53:37>> Thank you.
  1555. 53:38>> Have a great time.
1556. 53:38>> Enjoy your day tomorrow. Yes. Enjoy the
  1557. 53:40fishing.
  1558. 53:41>> Yeah. Well,
  1559. 53:44>> I am uh
1560. 53:45>> just remember you might need a bigger
  1561. 53:46boat.
1562. 53:47>> I'm going home, changing, and then
  1563. 53:50driving through
  1564. 53:52through London.
  1565. 53:53>> Yep.
  1566. 53:58[laughter]
  1567. 54:00>> Thank you.
1568. 54:01>> Thank you. All right. There are no more
1569. 54:03public hearings scheduled. Our next item
1570. 54:06on the agenda is a workshop with
  1571. 54:08Vanderbilt Lane Morton additional
  1572. 54:11dwelling.
  1573. 54:24Excuse me.
  1574. 54:34>> He's got it.
  1575. 54:35>> Yeah.
  1576. 54:39>> Yeah. I think Yeah.
  1577. 54:44>> Yeah.
1578. 54:46Take a picture of that and send it over.
1579. 55:03and the blue mouse should work
  1580. 55:05>> great
1581. 55:05>> from there on that. Good evening.
1582. 55:08>> Hi, thank you so much for having us for
1583. 55:10this workshop. Uh my name is Jane Elasa.
1584. 55:12I'm the project manager at River
  1585. 55:14Architects.
1586. 55:16>> Hi. Uh good to see you again, James
  1587. 55:17Hartford, River Architects. Um you've
  1588. 55:20seen this project before. Um there's
1589. 55:23been some uh uh pretty uh major changes
1590. 55:26uh due to some personal um issues um
1591. 55:29that the clients have uh endured. Um but
1592. 55:33um we've uh rethought the project um
1593. 55:35kind of scaling it down. Um uh if you
  1594. 55:39recall earlier we had a a um a larger
1595. 55:42swimming pool very close to the uh
1596. 55:44wetlands buffer zone um and uh a larger
1597. 55:49kind of pool house facility as well as
1598. 55:51quite a large um personal uh wood shop
1599. 55:54and ceramist uh studio um as well as a
1600. 55:58guest house. And now we've kind of
1601. 56:00scaled all of those things back. Um a
1602. 56:02much smaller pool keeping it away from
1603. 56:05the uh steep slopes area as well as the
1604. 56:07wetlands uh setback. And then um a
1605. 56:10smaller guest house um kind of a a small
1606. 56:13kind of uh uh special uh kitchen for uh
1607. 56:18personal events there. Um as well as um
1608. 56:21a pool house uh with a you know again
1609. 56:23the scaleback uh pool. That's sort of
  1610. 56:26the nut
1611. 56:26>> and they'll make it a little bit easier
  1612. 56:28to
1613. 56:29>> to work with. Right.
1614. 56:30>> Great. Yeah. And also with us is Rahul,
  1615. 56:33our uh civil engineer.
1616. 56:35>> Rahul Verma as [clears throat] the site
  1617. 56:37civil engineer.
  1618. 56:38>> Thank you.
1619. 56:38>> Working with the river architect team.
  1620. 56:39>> Welcome.
  1621. 56:40>> Welcome.
1622. 56:41>> Yeah. So um much smaller impervious area
1623. 56:45and um we've also removed the driveway
1624. 56:48that was in the original application.
1625. 56:51So, because of the smaller scale and
1626. 56:54just that the owners felt like they
  1627. 56:56didn't need a secondary driveway, we're
  1628. 56:58using the current driveway to 9
1629. 57:01Vanderbilt Lane, the existing house
1630. 57:02there. And we just have a banked parking
1631. 57:05area for uh meeting the code requirement
1632. 57:08for that. We've also spoken with the
1633. 57:10fire department and they have uh we we
1634. 57:14staked all of the buildings kind of
1635. 57:16where they would be on site as they are
1636. 57:17on the site plan and reviewed how that
1637. 57:20access would work. And so the um what he
1638. 57:23had asked and we had shown on this site
  1639. 57:25plan.
  1640. 57:27Maybe I shouldn't have made it full
  1641. 57:28screen.
1642. 57:34I just scroll. Um, what he'd asked for
  1643. 57:38instead is
  1644. 57:47get there in a second.
1645. 57:54Is this uh fire access that's going to
1646. 57:57be brick paved, which is in keeping with
1647. 58:00some of the brick paving, like permeable
1648. 58:02paving that they have around the site.
1649. 58:04And so this shoots off of the existing
1650. 58:08driveway. And he was happy with the
1651. 58:10access, making sure that a fire hose
1652. 58:13could get to any point in the building.
1653. 58:15Um, and he just asked that the buildings
1654. 58:18had some sort of label on them like ABC
1655. 58:21D so that if there's a fire, he knows
1656. 58:23he's going to Vanderbilt Lane, but he
1657. 58:25knows also which building. So the fire
1658. 58:27alarms will correspond to good fire
1659. 58:29department. So, we spoke about that and
1660. 58:31um are making sure to incorporate uh
1661. 58:34that ask. And so, this is that bent
1662. 58:36parking area. We don't want to add more
1663. 58:38hardscape. So, this is just um enough
1664. 58:41space for the cars to park there in case
1665. 58:44they do have more, but it's more of like
  1666. 58:46a I I just I doubt that they'll really
1667. 58:48use it, but we have it just in case.
1668. 58:51>> We're also removing less trees than we
1669. 58:53were last time. I think previously we
1670. 58:54were thinking of removing 11 trees. Now,
1671. 58:57there's only two. Um, actually the
  1672. 58:59buildings don't remove that. It's just
1673. 59:01for the fire access that we're removing
1674. 59:03those two by the uh kind of like
  1675. 59:06driveway uh tea. Um,
1676. 59:11what else? Yeah, the pool the pool is
  1677. 59:13much smaller. It's a saltwater pool
  1678. 59:15here. There's a brick paving around and
1679. 59:17there will be a pool fence around that
1680. 59:18as well. We'll make sure to have alarms
1681. 59:21as code requires for the two doors that
1682. 59:24leave the pool house and go towards the
1683. 59:26pool area. There's no other access into
1684. 59:27the pool house except for except for
  1685. 59:30those. Um,
1686. 59:32yeah, I think Oh, and we filed the plat
1687. 59:35the minor subdivision that we went
1688. 59:37through last time, that was all filed
1689. 59:38with the county, and that's actually the
1690. 59:40first page of our PDF application. So,
1691. 59:43all of that, including the deed, was
1692. 59:45filed and straightened out um as part of
1693. 59:47our last kind of round of reviewing with
  1694. 59:49you all.
1695. 59:50>> Excellent. That makes makes this phase a
  1696. 59:52little bit easier.
1697. 59:54>> Um, yeah. So, we're looking forward to
1698. 59:55your comments and any questions you
1699. 59:57have. Um, thank you so much for
  1700. 59:59considering the application.
1701. 1:00:00>> Thank you. Uh, well, thank you for all
1702. 1:00:02the work that you've done on this,
  1703. 1:00:03especially contacting the fire
  1704. 1:00:04department. That's always very helpful.
1705. 1:00:06I, as you may remember the last time, we
1706. 1:00:08spent a lot of time with them. Um, so
  1707. 1:00:11Miss Moss,
1708. 1:00:15>> um, I I'm happy to see that the pool has
1709. 1:00:18been moved a little bit away from that
  1710. 1:00:20slope and the impervious,
1711. 1:00:22uh, is being dealt with. Um, you're
1712. 1:00:25including some pvious areas. Um, and I'm
1713. 1:00:29happy that you contacted the fire
1714. 1:00:31department in advance and I have no
  1715. 1:00:34other comments.
  1716. 1:00:35>> Okay, great.
  1717. 1:00:36>> Thank you,
  1718. 1:00:37>> Miss Ransom.
1719. 1:00:39Are there any material changes to the
1720. 1:00:41buildings or they're the same as what
  1721. 1:00:43was previously reviewed?
  1722. 1:00:44>> Uh, that's a great question. So,
1723. 1:00:45previously we were going to do a black
  1724. 1:00:48painted wood vertical siding, but we've
  1725. 1:00:50actually switched to a black cedar
1726. 1:00:52shingle, like a pine tar cedar shingle,
  1727. 1:00:55cuz it's actually really similar to
  1728. 1:00:56another building on a neighboring site
1729. 1:00:59that has a a cedar shake. So, we want to
1730. 1:01:01kind of be a little bit more in keeping
1731. 1:01:03with that tone, a little bit more
1732. 1:01:06traditional style. Um, and the roof will
1733. 1:01:08also be a cedar shingle. Before we had a
1734. 1:01:10standing seam or no, a corrugated black
1735. 1:01:12metal roof and now it's going to be
  1736. 1:01:14cedar shingle as well.
1737. 1:01:15>> So, I would only ask whether the
1738. 1:01:17planning board needs to see some kind of
1739. 1:01:20>> detail, you know, material detail.
1740. 1:01:22>> We generally do you usually ask for some
1741. 1:01:25kind of material board. So if you're
1742. 1:01:27making changes, probably use be useful
1743. 1:01:28to show the board what what those are
1744. 1:01:32>> and and sometimes that can be as much as
  1745. 1:01:34just like a link to the
1746. 1:01:36>> uh manufacturer site with the you know
  1747. 1:01:38identification of which
  1748. 1:01:40>> shape.
1749. 1:01:41>> Yeah. And then the trees themselves were
1750. 1:01:45those previously proposed to be removed
1751. 1:01:47or these are different trees?
1752. 1:01:49>> These are two different trees.
1753. 1:01:50>> And then what kind of trees are they
  1754. 1:01:53diameter? Um, let me
  1755. 1:01:56>> Was that shown?
1756. 1:02:00>> Um, I might not be able to see it
  1757. 1:02:03completely. I'll I'll I'll follow up on
  1758. 1:02:05that. It's It's a little like too light
1759. 1:02:08in this do have them measured.
  1760. 1:02:10>> I appreciate that there's fewer trees
  1761. 1:02:12being removed, but we don't necessarily
1762. 1:02:13then want to have two large specimen
  1763. 1:02:16trees removed. I don't know what they
1764. 1:02:18are, so I'm just asking. They they are
  1765. 1:02:19conifers and they're adjacent to the
1766. 1:02:22power lines there and then they get
1767. 1:02:24periodically lpped off on side every
1768. 1:02:27time the power company comes through. So
  1769. 1:02:29they're actually harm trees. They're not
  1770. 1:02:31healthy trees.
  1771. 1:02:32>> Yeah.
1772. 1:02:32>> Even even if you could take a picture
1773. 1:02:34and just send it to the board, that'd be
  1774. 1:02:35useful.
  1775. 1:02:36>> Absolutely. We'll do that.
  1776. 1:02:37>> Thank you.
1777. 1:02:38>> Thank you. Thank you, Mr. Harvey.
1778. 1:02:42>> So I asked um Pete Sero to look at this
1779. 1:02:43briefly since he was familiar with it
1780. 1:02:45before and he gave me some thoughts. Um
1781. 1:02:47he had a recollection of uh one of the
1782. 1:02:49buildings having a basement. Do any of
  1783. 1:02:50the buildings have a basement anymore?
1784. 1:02:52>> Yes, there's one small basement in the
1785. 1:02:54uh in the kitchen uh and dining uh
  1786. 1:02:57building. Um it's, you know, residential
  1787. 1:03:00in scale.
1788. 1:03:01>> Any walkouts from that?
  1789. 1:03:02>> No.
1790. 1:03:03>> Okay. Just cuz if there was, we'd want
1791. 1:03:04to see the spot grades and make sure
1792. 1:03:06that was clear how that was working out.
1793. 1:03:08>> Um and then in terms of the uh the
  1794. 1:03:10septic, it appears there's a new
  1795. 1:03:12nine-bedroom septic proposed.
1796. 1:03:14>> Um that's true. It's not clear to me
1797. 1:03:17entirely how many bedrooms are in each
1798. 1:03:19building that serve into that.
1799. 1:03:21>> I can that James um so I can speak to
1800. 1:03:24that. The the ninebedroom calculation
1801. 1:03:26was with the previous engineer
1802. 1:03:29>> that they were using. I have not been
1803. 1:03:30able to replicate that calculation
  1804. 1:03:32myself just yet.
  1805. 1:03:33>> Okay. Um I I will tell the board I am
1806. 1:03:36going out tomorrow to start doing some
1807. 1:03:37perk tests in this in the area shown
1808. 1:03:39here and another area and as well go
  1809. 1:03:41through the um the health department's
1810. 1:03:43um loading chart to determine which with
1811. 1:03:45these revised uses what the correct
  1812. 1:03:47application rate is
  1813. 1:03:49>> to to design.
1814. 1:03:50>> Are there nine bedrooms total on the
  1815. 1:03:52site or that's changed too?
1816. 1:03:53>> Four in the main residence, right? uh
1817. 1:03:55four in the main residence. And then
  1818. 1:03:57we're adding we're considering each
1819. 1:03:59project or each property having one
  1820. 1:04:02dwelling unit even though there's no
  1821. 1:04:04bedrooms.
1822. 1:04:05>> Just in case in the future if the next
1823. 1:04:07person coming in wants to use a space as
1824. 1:04:10a bedroom. We just don't we want to make
1825. 1:04:12sure we have that approved at this
  1826. 1:04:15point. So there's actually only one
1827. 1:04:17bedroom in the small studio ADU
  1828. 1:04:19building.
1829. 1:04:20>> Mhm. Um, so our recommendation would be
1830. 1:04:22that you develop some kind of table or
1831. 1:04:24notes to include on the plan to make it
1832. 1:04:25clear how many bedrooms or how many
  1833. 1:04:27bedrooms you're using for your
  1834. 1:04:28calculations in each building so it's
1835. 1:04:31clear how that works out for you.
1836. 1:04:32>> Yeah. As I get into a conversation with
1837. 1:04:33the health department engineer that will
1838. 1:04:34be uh on those plans.
1839. 1:04:36>> Okay. And then regarding the erosion
1840. 1:04:38controls, I know you did an erosion
1841. 1:04:40control plan. You identified the
1842. 1:04:41disturbances mainly around the buildings
1843. 1:04:43and the structures. What we would need
1844. 1:04:45is those disturbance limits to be
1845. 1:04:47including any trenching, any tanks and
  1846. 1:04:49be being done. And I know if you're
  1847. 1:04:51reworking the septic, you'll need to
1848. 1:04:52look at that again. But we just need to
1849. 1:04:54make sure the limit disturbance that are
1850. 1:04:55shown in the plans cover all the
  1851. 1:04:56disturbance.
1852. 1:04:57>> Yeah, that will be updated again as we
  1853. 1:04:59finalize the septic plan.
1854. 1:05:01>> Um, obviously the sites served by
1855. 1:05:03Duchess Water and Waste Authority. Do we
  1856. 1:05:05know where that's metered from them?
1857. 1:05:07>> Yes, there's a meter pit uh just to the
1858. 1:05:10right of the driveway, maybe 30 ft to
  1859. 1:05:12the right.
1860. 1:05:13>> Okay. Could that be depicted on the
  1861. 1:05:14plans? So, we have
1862. 1:05:15>> it is lab it's labeled on the plans and
1863. 1:05:17as it turns out it's a dual meter pit
1864. 1:05:19for both this property and for three
1865. 1:05:22Vanderbilt Road which is just to the
  1866. 1:05:24left.
1867. 1:05:24>> Okay. So, in theory the the new uses and
1868. 1:05:26the new buildings and everything will be
1869. 1:05:28picked up based on that meter.
1870. 1:05:29>> Correct. Okay. Um and then the other
1871. 1:05:32thing that Pete mentioned is that
1872. 1:05:34previously and maybe it was due to the
1873. 1:05:35other driveway is that the trees along
1874. 1:05:37the Hunter property there was some notes
1875. 1:05:39or line work included in the plans to
1876. 1:05:40make sure they were retained. So, I
1877. 1:05:42don't know if the planning board or
1878. 1:05:43anybody wants to consider that. Now,
1879. 1:05:45>> I think they got rid of
  1880. 1:05:46>> Say that again.
1881. 1:05:47>> The driveway got rid of it, but I don't
1882. 1:05:48know if if if they want to have notes to
  1883. 1:05:51make sure the trees don't get cut. I
  1884. 1:05:53mean, I guess by seeing limited
  1885. 1:05:54disturbance, if it's outside of limited
  1886. 1:05:55disturbance, it's covered.
1887. 1:05:56>> Yeah, that that should be good.
  1888. 1:05:57>> Okay.
1889. 1:05:58>> Y and then um obviously Duchess Health
1890. 1:06:00Department approval will be required for
  1891. 1:06:02the septic. So, I think that's all I
  1892. 1:06:04have.
1893. 1:06:05>> That's great. I'm glad you were able to
1894. 1:06:06uh get get with Pete on that. He spent a
1895. 1:06:09lot of time on on the previous plan.
  1896. 1:06:12Excellent. Miss Polodoro.
1897. 1:06:15>> Hi. Um, so we have a resolution to
1898. 1:06:18classify it and referred out tonight. It
1899. 1:06:21does need to go to Duchess County
  1900. 1:06:23Department of Planning because it's near
1901. 1:06:25uh Route 9 and also uh be referred to
1902. 1:06:28historic preservation office, the fire
1903. 1:06:30department, should say fire district,
1904. 1:06:32and the Duchess County Department of
1905. 1:06:33Health uh just so we can start getting
  1906. 1:06:35all those referrals going.
  1907. 1:06:37>> Okay.
1908. 1:06:38>> Last time there was consultation with
  1909. 1:06:39Shipo,
1910. 1:06:40>> right? on the the house and the
  1911. 1:06:42materials.
1912. 1:06:43>> Does water and waste get included in
  1913. 1:06:45that?
1914. 1:06:48>> Are they in the water district?
1915. 1:06:50>> They are. They're served by the their
  1916. 1:06:51water system.
1917. 1:06:51>> Yeah, they have. So, let's add them.
  1918. 1:06:53>> I think it'd be a good idea.
  1919. 1:06:55>> Good catch.
  1920. 1:07:04>> Oh, DCW.
  1921. 1:07:07Okay. and DC.
  1922. 1:07:15They're both
  1923. 1:07:21Oh, sorry.
1924. 1:07:24>> John, you're going to have to add that,
  1925. 1:07:25too. Okay, got it.
  1926. 1:07:26>> It is
  1927. 1:07:33fine.
  1928. 1:07:34>> Any other comments?
  1929. 1:07:38Uh,
1930. 1:07:38>> no, just when the new information comes
  1931. 1:07:40in, we'll all evaluate it.
1932. 1:07:41>> Yep. Yep. Thank you.
1933. 1:07:42>> What exactly do you want John to add to
  1934. 1:07:44the resolution, please?
1935. 1:07:45>> All he needs to add is at the end and
1936. 1:07:47Duchess County Water and Wastewater
  1937. 1:07:48Authority.
  1938. 1:07:50>> We
1939. 1:07:51>> You just put DCWWEA. Okay.
1940. 1:07:53>> Despite being Yes. Hide Park Fire
  1941. 1:07:55Department is correct. So, we'll leave
  1942. 1:07:56that even though it's also
  1943. 1:07:58>> Yep.
  1944. 1:08:00>> That's okay.
1945. 1:08:03>> This This will be the official Yeah,
1946. 1:08:05>> we can check that box.
  1947. 1:08:07>> WW is AWA.
  1948. 1:08:11>> Okay, thank you.
1949. 1:08:12>> Yeah, they they I'm sure they know that.
  1950. 1:08:16>> Yeah,
  1951. 1:08:17>> I forget how many W's are.
1952. 1:08:18>> So, you guys will have to actually
1953. 1:08:20upload into the Chris system for
1954. 1:08:23consultation for Shipo because they
1955. 1:08:24won't accept if if we just mail it to
  1956. 1:08:26them.
  1957. 1:08:30Anything else?
1958. 1:08:33Thank you very much. Uh, Mr. Tuttle,
1959. 1:08:35>> I have no comments. Thank you,
  1960. 1:08:37>> Mr. Waters.
  1961. 1:08:39>> I just had a couple things. I did the
1962. 1:08:41same thing to yours that I did to the
  1963. 1:08:44previous [laughter]
1964. 1:08:46>> comments to the PDF.
  1965. 1:08:48Okay. So,
1966. 1:08:49>> so go ahead and check the class.
  1967. 1:08:50>> I Yeah, it's somewhere out there. So,
1968. 1:08:53[laughter] um but um the my question was
1969. 1:08:57one of the questions was an I I believe
1970. 1:08:59it was answered the basement uh whether
1971. 1:09:02they were you know I didn't know if it
1972. 1:09:04was a slab on grade with a you know
1973. 1:09:05frost wall or or how it was being
1974. 1:09:08treated. So that was one thing. Um then
1975. 1:09:10the uh siding is are those like 18inch
1976. 1:09:14perfection? I mean not it shake or is it
  1977. 1:09:18perfections or shakes?
1978. 1:09:19>> Yeah. Okay. hand splits or whatever.
1979. 1:09:22Yeah. Okay. Yep. All right. Uh so that's
1980. 1:09:25that. Uh debris piles were they were
  1981. 1:09:27cleared I think in previously.
1982. 1:09:30>> Yes, that was all.
1983. 1:09:31>> I thought so. Driveway issue that we
1984. 1:09:33don't have that lining up anymore
  1985. 1:09:35because you're not putting in that
1986. 1:09:37second. Right. Okay. This is just for
1987. 1:09:40comment to just review what we had uh
1988. 1:09:44what the concerns were the last time.
1989. 1:09:46And how how far back off the road is it?
1990. 1:09:48I mean just can you even see it off the
1991. 1:09:52>> Yeah, you can see it.
  1992. 1:09:52>> You can see
1993. 1:09:53>> we have actually a page that kind of
1994. 1:09:56shows what the current view of the road
1995. 1:10:00is. And so the edge of the pool house or
1996. 1:10:03the pool paving actually is behind that
1997. 1:10:06big oak tree about 20 ft past it.
1998. 1:10:09>> Okay. Yeah. Okay. So you barely could
1999. 1:10:12it's it's not going to be highly
  2000. 1:10:13visible. It'll be nice to see. planted a
2001. 1:10:15row of like hedges here too that are
2002. 1:10:18bushing up. So, it's making it harder.
2003. 1:10:20>> Yeah. So, and uh that was it. And I
2004. 1:10:24apologize for the comments not getting
2005. 1:10:26[laughter] so but I did do my due
  2006. 1:10:28diligence and review your comments. I
2007. 1:10:31love the drawing. The drawings were very
2008. 1:10:33nicely done, too. So, thank you.
2009. 1:10:35>> Thank you, Mr. Oliver.
2010. 1:10:37>> Uh, no comments. Thank you,
2011. 1:10:38>> Miss Lee. Uh, cool project and great
2012. 1:10:42edits and no other comments.
2013. 1:10:44>> Thank you, Mr. Garcio. Uh, no comments.
  2014. 1:10:47>> Okay. Uh, I'm happy to I'm I'm sad to
2015. 1:10:50see you back, but I'm happy to see you
2016. 1:10:52back. Um, again, this is going to be a
2017. 1:10:54beautiful project and just fitting in so
2018. 1:10:57nicely with that little section of
2019. 1:10:58Height Park. Um, we really appreciate
2020. 1:11:01the level of detail that that you're
2021. 1:11:02bringing to the to that area. So, thank
  2022. 1:11:05you. Uh
2023. 1:11:07so we do have a resolution prepared
  2024. 1:11:11for this evening. That's me.
  2025. 1:11:18>> Ready?
  2026. 1:11:18>> Yep. Go ahead.
2027. 1:11:19>> Resolution to classify the project under
2028. 1:11:21seeker and to refer Duchess County
2029. 1:11:23Department of Planning and Development
2030. 1:11:25Bard Rock Creek at 9 Vanderbilt Lane.
  2031. 1:11:28Resolution 2024-29C.
2032. 1:11:32Whereas, whereas, whereas, whereas Now,
2033. 1:11:34therefore, be it resolved that the
2034. 1:11:36planning board hereby classifies the
2035. 1:11:37project as a type two action. Be it
2036. 1:11:40further resolved that the planning board
2037. 1:11:42hereby directs its secretary to refer
2038. 1:11:44the project to Duchess County Department
2039. 1:11:45of Planning and Development pursuant to
  2040. 1:11:47general municipal law 239-m
2041. 1:11:51further resolved that the planning board
2042. 1:11:53hereby directs the secretary to send a
2043. 1:11:55courtesy referral of the project to the
2044. 1:11:57state historic preservation office of
2045. 1:11:59Hide Park I mean of office and hide park
2046. 1:12:02fire department and the Duchess County
2047. 1:12:04Department of Health and DCWA
  2048. 1:12:06Duchess County Wastewater Authority.
  2049. 1:12:08Second.
2050. 1:12:10>> Any discussion? All in favor, please say
  2051. 1:12:12I.
  2052. 1:12:12>> I.
  2053. 1:12:13>> I.
2054. 1:12:14>> Okay. And if we can, we'd like to set a
  2055. 1:12:16public hearing for October 7th, 2026.
  2056. 1:12:21Does that work?
  2057. 1:12:22>> Can I get a motion?
  2058. 1:12:24>> So moved. Second.
2059. 1:12:25>> All in favor, please say I.
  2060. 1:12:27>> I.
2061. 1:12:28>> Excellent. So you we'll be back for our
  2062. 1:12:31public hearing on the 7th.
  2063. 1:12:34>> Great.
2064. 1:12:35>> Thank you so much.
2065. 1:12:37>> Thank you so much. very excited to see
  2066. 1:12:38the project.
  2067. 1:12:40>> Thank you.
  2068. 1:12:48>> Our next item,
2069. 1:12:49>> do they want to tell me
2070. 1:12:51>> colors or the right way?
2071. 1:12:54>> Did you see anything materials?
2072. 1:12:55>> Yeah, they said they're going to
  2073. 1:12:57>> submit the materials.
2074. 1:12:58>> The the thing that might hold us up is
2075. 1:13:00the Chris response from Shipo. So, just
2076. 1:13:04make sure to try to get that in as
2077. 1:13:05quickly as you as you can.
  2078. 1:13:07Thank you.
2079. 1:13:07>> Yeah, we have an extra week this month.
2080. 1:13:09>> Yes, which is nice.
2081. 1:13:10>> And please add me as a contact on that
  2082. 1:13:13submission.
2083. 1:13:14>> Then that way she gets to see him.
  2084. 1:13:16>> Great.
2085. 1:13:16>> And then we get to see him
2086. 1:13:18>> on the first submission.
  2087. 1:13:19>> Yes.
2088. 1:13:20>> The one thing I'm curious about is that
2089. 1:13:22we had previously submitted the much
2090. 1:13:24larger project um the an archaeological
  2091. 1:13:28report. Um I'm wondering if I don't
  2092. 1:13:32know. I know it's Shipo that we're
2093. 1:13:33dealing with. It's not you, right? Um,
2094. 1:13:35so I'm just kind of thinking out loud if
2095. 1:13:38that we do, you know.
2096. 1:13:40>> Is there any new disturbance area?
  2097. 1:13:42>> No, actually we've shrunk the
2098. 1:13:44>> but it hasn't shifted anywhere else,
  2099. 1:13:46>> right?
  2100. 1:13:46>> So they'll probably consider that
  2101. 1:13:49>> except they should they'll comment,
  2102. 1:13:51[laughter] right?
2103. 1:13:52>> But when you I mean if you have a map
2104. 1:13:55that shows the limits of disturbance
2105. 1:13:56before and then after, it might help
  2106. 1:13:58them
  2107. 1:13:59>> do that.
2108. 1:14:00>> Yeah. Do a comparison and then that can
2109. 1:14:02be sent along with the referral.
2110. 1:14:04Yeah. That way they won't treat it as
  2111. 1:14:06brand new.
2112. 1:14:07>> They can say, "Oh, you were here
  2113. 1:14:08before." Oh, look. It's much smaller.
2114. 1:14:12>> Thank you for doing the cedar shake
  2115. 1:14:14roof, too. That's
  2116. 1:14:15>> That's [laughter]
2117. 1:14:17the way it should be done.
  2118. 1:14:18>> Great. Thank you.
  2119. 1:14:21>> That's That's
2120. 1:14:22>> our next item on the agenda is site plan
2121. 1:14:24waiver uh for Harrington. They are
2122. 1:14:27putting in uh HVAC and generator.
2123. 1:14:33I believe you have this one. I do.

2142. 1:15:16>> second any discussion on this all in
  2143. 1:15:18favor please say I
