- 0:00However, under no circumstances should
- 0:02the 1966 election
- 0:06of members of the Maryland legislature
- 0:08be permitted to be conducted pursuant to
- 0:11the existing or any other
- 0:13unconstitutional plan. We therefore
- 0:18reverse the judgment of the Maryland
- 0:20Court of Appeals and remand the case to
- 0:22that court for further proceedings.
- 0:28The legislature elected in 1966
- 0:32under the redrawn districts was known
- 0:34and is still known as the redistricting
- 0:36class. Its members included three future
- 0:40speakers, Thomas Hunter Lowe, John
- 0:43Hansen Brisco, and Benjamin L. Carden.
- 0:47Four future Senate presidents, Stenny
- 0:50Hoyer, James Clark, Melvin Steinberg,
- 0:54and William P. James. We miss James.
- 0:58Among the future members of Congress,
- 1:01Stenny Hoyer, Goodlo Byron,
- 1:04Glenn Bell Jr., Paul Sarbain, and Ben
- 1:08Carden. Perhaps there are members of
- 1:11this body today with such ambitions.
- 1:17May the work that we do
- 1:20in this special session
- 1:22merit
- 1:24a a a place of honor in the history of
- 1:27our state. Amen.

- 2:42assembly of Maryland in extraordinary
- 2:43session at Annapolis, Maryland,
- 2:45commencing August 3rd, 2026.

- 3:00So good morning colleagues.
- 3:04Before we start our business,
- 3:07I honestly pray that you and your loved
- 3:09ones have been well since we last
- 3:12adjourned in April.
- 3:14I know that you had a lot of us had our
- 3:17elections. You have your family
- 3:20responsibilities
- 3:21and you're here today. So, I thank you
- 3:23for doing that.
- 3:26It's always better to get our work done
- 3:28in April than in August. But here we
- 3:31are. The House always sends ready to
- 3:34meet the moment and we're going to do
- 3:35that. Today we have the opportunity to
- 3:38finish the work our constituents sent us
- 3:40here to do. Past is prologue. We know
- 3:45there will be vigorous debate.
- 3:48That is democracy in action and I
- 3:50welcome it.
- 3:52And my actions show that I welcome it.
- 3:55For 89 days,
- 3:5823 hours,
- 4:00five minutes last session,
- 4:04I gave respect to everyone.
- 4:07No one can say that. No one can say that
- 4:10I didn't do it. My office was open.
- 4:14Both sides of the aisle had
- 4:16unprecedented unprecedented access to my
- 4:19office and myself.
- 4:22Whether you had a personal problem,
- 4:24whether you had a p a problem in
- 4:26committee, whatever it was, I didn't
- 4:29care who you were, I took care of it.
- 4:32And I give respect and I expect respect.
- 4:36So today, we're going to have a debate.
- 4:41And I will allow like I did the debate
- 4:45to take place
- 4:47on both sides.
- 4:51Okay? We're not going to push any
- 4:53anything through cuz we didn't do that
- 4:55for 89 days, 23 hours, and 5 minutes.
- 4:58Okay? So, we're going to do it. But what
- 5:01I do expect is that like any debate that
- 5:05I preside over, I ask for us, including
- 5:08myself,
- 5:11to conduct ourselves with dignity,
- 5:14discipline, and respect. And I did that
- 5:17for the 90 days actually.
- 5:20So we can be passionate about our views
- 5:23while maintaining order and the quorum
- 5:26because this institution and the people
- 5:28we serve deserve no less.
- 5:34I want you to get up, make your
- 5:36arguments based on the law, on the rule,
- 5:39cite it eloquently,
- 5:42behave in a way that you want your kids,
- 5:45if you have kids or you an auntie or an
- 5:47uncle would like them to behave.
- 5:50Okay? Because the whole world is
- 5:52watching.
- 5:54Please don't leave your seat. Don't come
- 5:57to the aisle. If that happens, I'm going
- 6:00to look to my left. Bobby,
- 6:02Sergeant-at-Arms, will you please raise
- 6:04your hand? And I'm going to call on him
- 6:07and he's going to go to you and you're
- 6:09going to leave the the chamber. Okay?
- 6:14Plain and simple. We're going to be
- 6:16respectful. Okay? That's what we're
- 6:18going to do. And I give you my word that
- 6:20we will have the debate.
- 6:23And like I did before, I'm going to
- 6:24allow the debate because that's just how
- 6:27I am. It's how I ran HO. It's just how I
- 6:29am. Period. Okay.
- 6:33So, let's start the the business. Okay.

- 6:39>> Thank you. I I appreciate you lecturing
- 6:41us on respect. Um the very fact that
- 6:44we're here, Madam Speaker, um is a is a
- 6:47real sign of disrespect for an entire
- 6:49region of our state. So I can't
- 6:50guarantee that we may or may not have
- 6:53respect over the next three days. And
- 6:54this is deeply personal. You know, we're
- 6:56we're putting national politics ahead of
- 6:58Marylanders. We're putting national
- 7:00politics ahead of over 400,000 people of
- 7:03my family, my friends, my constituents.
- 7:06So that's deeply personal for me. deeply
- 7:10personal for many of us that are sitting
- 7:11in this section. And so, Madam Speaker,
- 7:14you set the tone already with respect by
- 7:17just having this special session to
- 7:18begin with. I just want to make that
- 7:20crystal clear. So, moving forward over
- 7:22the next three days, I can't make any
- 7:23promises to you. I honestly can't.
- 7:25>> Well, you know, I understand and I
- 7:28respect your view and you do you do you.
- 7:32You do what you need to do and I do what
- 7:34I need to do. Let's get started. House
- 7:37rules. Mr. PL will read the order.

- 7:40Maryland that the rules of the House of
- 7:41Delegates in effect at the end of the
- 7:43regular session of 2026 be adopted for
- 7:45the special session of 2026. By order

- 10:20order of business, I want to thank

- 10:53I also want to take a minute to thank my
- 10:56team.
- 10:58My office has been open five days a
- 11:02week. There's always someone covering it
- 11:06because I require it because I want to
- 11:09make sure that we're here for everyone.
- 11:11And they work really hard. They answer
- 11:14your messages. They answer your emails,
- 11:16your co your calls. And I want to thank
- 11:19them because they are a hardworking,
- 11:21dedicated team.

- 11:57Our first order of business, are you
- 12:00ready? Is veto house bill calendar
- 12:02number one. The clerk will read the
- 12:04bill.

- 12:10Madam Speaker,
- 12:11>> recognizing the vice chair of the
- 12:12committee.
- 12:13>> Thank you, Madam Speaker. Colleagues, I
- 12:16rise to respectfully request your
- 12:18support to override the veto of House
- 12:20Bill 862, commonly known as the
- 12:23twoperson crew bill. We've heard this
- 12:26one a few times in this chamber. Your
- 12:28vote to override this veto will
- 12:30proactively protect Marylanders from
- 12:33dangerous derailments and accidents by
- 12:36requiring two crew members on every
- 12:39freight train that also shares commuter
- 12:42rail lines in Maryland. So requiring a
- 12:46second crew member is a common sense
- 12:48safety measure and it's already in the
- 12:50regulations of our Federal Railroad
- 12:52Administration. Why do we need to do
- 12:54this? In the event of an accident, if
- 12:57there is only one crew member on a
- 13:00freight train, and you guys have seen
- 13:01this as well as I, they can be miles and
- 13:03miles and miles long, right? That crew
- 13:07member is required to stay with the
- 13:09train, right? They cannot assess damage.
- 13:13They cannot help assist first responsor
- 13:16responders. And uh and so this is
- 13:18something that we feel very strongly
- 13:20will benefit Marylanders um if we need
- 13:23to invoke this legislation. So versions
- 13:26of this bill have been before us for
- 13:28many many years. It's passed this body
- 13:30in previous sessions, but the bill
- 13:32before us today is very very narrowly
- 13:34tailored. Right? It does not change any
- 13:38current practice. I'm going to say it
- 13:40again. It does not change any current
- 13:44practice. Right? It only goes into
- 13:47effect under two in two situations. One
- 13:51is that the Federal Railroad
- 13:53Administration rescends its rules that
- 13:56already require two crew members on a
- 13:58freight train. And the second is that if
- 14:02Virginia, New York, and Pennsylvania
- 14:04also passed similar legislation, and
- 14:06this provision was intentionally
- 14:08included in the bill to protect our port
- 14:11of Baltimore from competition from our
- 14:14neighbors who also have very large
- 14:16ports. Right. So finally, I want to
- 14:19address some concerns about federal
- 14:21preeemption that have been noted both in
- 14:23the governor's letter of veto and also
- 14:25by members on this floor during debate
- 14:28in the past. This bill does not regulate
- 14:32interstate commerce. It does not. This
- 14:35bill does however protect the public and
- 14:39worker safety. And that is something
- 14:42that as a state we are legally allowed
- 14:44to do. We have a letter from April 16th
- 14:47from our attorney general that agrees
- 14:49with that. So, not only are we able to
- 14:52do it, I believe it's our responsibility
- 14:54to do it. So, I am asking you to stand
- 14:57with me and vote to support the override
- 14:59of House Bill 862 to help protect
- 15:03Marylanders from future possibly
- 15:06devastating accidents. Thank you so
- 15:08much, Madam Speaker.

- 15:11>> You're welcome. So, House Bill
- 15:12recognizing the gentleman from Baltimore
- 15:15County.
- 15:16>> Thank you, Madam Speaker. I would just
- 15:18like to echo the comments of the vice
- 15:20chair of uh the ENT committee. This bill
- 15:24is all about safety. It always has been
- 15:27>> and just to emphasize a couple points
- 15:29the vice chair made, having a minimum of
- 15:32a twoerson crew operating trains
- 15:34throughout the state is vital to ensure
- 15:36those trains run safely. In the event of
- 15:38an emergency, having a second crew
- 15:40member on board the train to serve as
- 15:43the incident commander is crucial. And
- 15:46the movement
- 15:48nationally by many states to enact this
- 15:50important rail safety measure was born
- 15:52out of tragedy. This legislation has
- 15:55been enacted in several states following
- 15:58in other jurisdictions following tragic
- 16:00train derailments that led to the
- 16:02destruction of property, towns being
- 16:04evacuated, and lives lost here in the US
- 16:07and abroad. So for all those reasons, I
- 16:09urge that the veto be overridden.

- 16:27>> Good morning. Good.
- 16:28>> Good. So, um, uh, the good delegate from
- 16:30Baltimore County just talked about the
- 16:32fact that basically this is already the
- 16:34law of the land. So, why why are we here
- 16:36doing this? Why do we need this if this
- 16:37is already the law of the land?
- 16:39>> It's a rule. It's a federal rule. As we
- 16:42know, rules can be repealed, resented,
- 16:44end. And so this is a backs stopped in
- 16:47the event that that federal rule is is
- 16:50is repealed is no longer in force. Isn't
- 16:54it more than just a federal rule though?
- 16:55Haven't the the unions and the the
- 16:57companies also agreed in their
- 16:59arbitration process as well? So doesn't
- 17:01it seem like both sides uh agree that
- 17:03this is is the right practice? So So I
- 17:05hear what you're saying about the
- 17:06federal rule, but it seems like it's
- 17:07more than that because it seems like the
- 17:08companies also agree that this is the
- 17:10right practice. So again, why are we
- 17:12doing this?
- 17:13>> The you're you're correct. The current
- 17:15collective bargain agreement between the
- 17:16unions and uh the railroads does say
- 17:19that there should be a twoperson crew.
- 17:21That collective bargain agreement
- 17:22currently ends in 2030. It has to be re
- 17:25renegotiated. We don't know what any
- 17:27future collective bargain agreements
- 17:29might yield.
- 17:30>> And what was the reason that the
- 17:32governor decided to veto this
- 17:34legislation?
- 17:34>> I I just I couldn't tell you. I'd have
- 17:37to I just have to refer you to the uh
- 17:39the veto override ladder.
- 17:40>> Okay. I think it was because it's
- 17:42already the law of the land. So he he
- 17:44thought that it was duplicative. But uh
- 17:45for those reasons, because this is
- 17:47already the law of the land, I will be
- 17:48voting no on this just like I have uh
- 17:50many times in the past. Thank you.

- 17:58>> Thank you, Madam Speaker. Um just to
- 18:00support the comments of the floor
- 18:02leader, I just would like to point out
- 18:04that while the jargon has been that it's
- 18:06the law of the land, it's actually a
- 18:08regulation. And we all know that
- 18:10regulations can be changed. So, we have
- 18:12an obligation to keep Marylanders safe
- 18:14on our rail lines. We can't leave it to
- 18:17the whim of federal regulators. And so,
- 18:20that's why one of the reasons we need
- 18:21this bill. The other point that was made
- 18:23is that yes, it is in the collective
- 18:25bargaining agreement. That collective
- 18:27bargaining agreement expires in 2030. We
- 18:30don't know what's going to happen to
- 18:31future collective bargaining agreements.
- 18:33It's collective bargaining. They sit
- 18:34down at the table and they negotiate.
- 18:37and the outcome of those negotiations
- 18:39are not in control of this chamber. So,
- 18:43I think that we should make sure that
- 18:45the people of Maryland are safe and that
- 18:47they have the same asurances of being
- 18:50safe that those crews have under the
- 18:52collective bargaining agreement at least
- 18:54until 2030. We need to make sure that
- 18:56that safety continues long after that.
- 18:59Thank you, Madam Speaker.
- 19:01>> House Bill A62 has been vetoed by the
- 19:03governor. The question before the house
- 19:04is, shall the bill pass now withstanding
- 19:07the objections of the chief executive?
- 19:10A green vote overrides the governor's
- 19:12veto. 85 votes are needed. The clerk
- 19:15will call the role.
- 19:16>> Madam Speaker,
- 19:24has everyone recorded their vote? Will
- 19:27anyone like to change their vote? If
- 19:30not, the clerk will take the call.
- 19:34There being 99 votes in the affirmative
- 19:36and 30 votes in a negative, the veto is
- 19:39overridden.

- 23:19So many of us don't get to enjoy the
- 23:22benefits of being born during session.
- 23:25Rarely do we get the opportunity to
- 23:29really celebrate one of our very
- 23:31favorite members.
- 23:34This member grew up in Baltimore.
- 23:37He sometimes
- 23:40will allow your phone to connect to his
- 23:42towers so that you can text crappy texts
- 23:44to people like me. Sometimes
- 23:47he raised a beautiful family whenever I
- 23:49get triggered on the floor. I can always
- 23:51go to his office. His door is always
- 23:53open to listen to my adnauseium
- 23:56complaints.
- 23:58He loves to giggle and laugh when things
- 24:00are said that are totally off the cuff
- 24:03and off color on the floor.
- 24:06and he loves to fight and champion for
- 24:09children in Maryland, not to just get an
- 24:11education, but to get a real quality
- 24:15education. It is his greatest passion.
- 24:18So, without further ado, body, please
- 24:21recognize my very good friend.

- 25:18someone my a friend who will not be
- 25:21returning when we reconvene in uh

- 25:31acknowledge my dear friend, Delegate
- 25:33Frank Conaway Jr. uh because of the fact
- 25:37that many of you probably don't know
- 25:39this, but he has been uh so good to me.
- 25:42for example, many nights uh the
- 25:46judiciary committee was running late and
- 25:49so the shuttle was closed and as you
- 25:51know I don't drive and so what he would
- 25:54do because he was such a good man is
- 25:56follow me to my um hotel to make sure I
- 25:59got home okay and he always also on
- 26:03those late nights um made sure I had
- 26:06something to eat and he was also one of
- 26:09the first friends I made when I came to
- 26:13this body. So, I'll miss I'll miss him
- 26:15very much. And I just want to thank him
- 26:18for his 20 years of service to the body
- 26:21and always looking out for me. Thank
- 26:23you, delegate.

- 27:18else. But I just want to have the body
- 27:20to take the time to wish not only this
- 27:24delegate, delegate Julian Ivy, not only
- 27:27a happy birthday, but also the born of
- 27:30his new son. Happy birthday, Julian.
