HOA Karen Parked Her Mercedes In My Workshop — I Welded The Doors Shut And Vanished For 3 Days — Transcript
Full transcript
- 0:00That ugly shop has to go. I'm parking
- 0:02here till you fix it.
- 0:04>> That's what the HOA president screamed
- 0:06as she drove her Pearl Mercedes straight
- 0:08into my open workshop bay. She slammed
- 0:11it in park 3 ft from my welding bench. I
- 0:14was at the hardware store buying flux
- 0:16when my 16-year-old daughter called.
- 0:18Britney Cole Whitfield had kicked over a
- 0:20live MIG rig and was photographing my
- 0:22shop like she owned it. By the time I
- 0:24got home, my daughter had locked the bay
- 0:26door behind her. Britney stood outside
- 0:28the gate, still pretending she had
- 0:30authority over a parcel that wasn't even
- 0:32in her HOA. That's the kind of woman she
- 0:35was, the kind who confused control for
- 0:38class and cruelty for leadership. What
- 0:40she didn't know was that my workshop had
- 0:42four cameras and two angles on her
- 0:44Mercedes. It also had a man inside who
- 0:47used to weld bridge plates for the
- 0:49United States Marines. Tell me, would
- 0:51you have called the cops or done what I
- 0:54did? Eight years ago, I bought a twoacre
- 0:56parcel on the eastern edge of Niwat,
- 0:58Colorado with the only money my late
- 1:00wife and I had ever saved together.
- 1:03Joanne had stage three breast cancer
- 1:05when we signed the deed. She died 11
- 1:07months later in the upstairs bedroom of
- 1:09the house I built with my own hands. She
- 1:12made me promise three things before she
- 1:14passed. Finish the workshop, raise
- 1:16Cassie like she was the most stubborn
- 1:18welder in the county, and never give up
- 1:21the land. I kept all three. My name is
- 1:24Wesley Hartwell. I'm 47 years old, a
- 1:27former combat engineer with the Marines
- 1:29and a custom metal fabricator. I weld
- 1:32trailer frames, gates, garden
- 1:34sculptures, and the occasional custom
- 1:36motorcycle part. The shop is a 30x50
- 1:39steel building behind the house, and it
- 1:41smells the way every good shop should.
- 1:43Hot iron, machine oil, and the faint
- 1:45sweetness of acetylene. My daughter
- 1:48Cassie is 16 now. She started welding
- 1:50the summer after her mother died, mostly
- 1:52because she couldn't sit still in a
- 1:54house that had suddenly gone quiet.
- 1:56Today, she's better with a TIG torch
- 1:58than I was at her age. And she runs the
- 2:00front office of my business like a calm
- 2:02little drill sergeant. We live just
- 2:04outside the boundary of an HOA called
- 2:07Spruce Hollow Estates. Outside it, not
- 2:10inside it. The plat map drawn in 1987 is
- 2:13very clear about that line. Our parcel
- 2:16is unincorporated Boulder County land,
- 2:18and the only people with legal authority
- 2:20over what I do here are the county
- 2:22clerk, the county sheriff, and the
- 2:24planning department. Nobody told that to
- 2:26Britney Cole Whitfield. Britney is the
- 2:28president of Spruce Hollow Estates, and
- 2:30she has been for 9 years. She's 52,
- 2:33blonde, heavy set in that way that
- 2:36always carries a linen blazer over yoga
- 2:38pants like a uniform. She drives a pearl
- 2:40white Mercedes GLS with a personalized
- 2:43plate that reads HA president. Her
- 2:47husband Drew sits on the Boulder County
- 2:49Planning Commission. Together, they
- 2:51treat our subdivision the way feudal
- 2:53lords used to treat a peasant village.
- 2:55They collect tolls. They issue edicts.
- 2:58They decide whose fence is the wrong
- 3:00color. I met her for the first time at
- 3:02the mailbox cluster a year after Joanne
- 3:05died. She introduced herself by handing
- 3:07me a welcome to the community packet for
- 3:09a community I didn't belong to. I tried
- 3:12to be polite. I told her my parcel
- 3:14wasn't part of her hoa. She smiled the
- 3:17way some people smile when they're
- 3:18already deciding to ignore you and said,
- 3:21"Oh, we consider the whole hollow our
- 3:23community." She made the word community
- 3:25sound like a leash. The next month, a
- 3:28violation notice appeared on my gate.
- 3:30The complaint was that my workshop
- 3:31produced industrial-grade noise that
- 3:33disturbed the aesthetic harmony of
- 3:35Spruce Hollow Estates. The fine was
- 3:38$200. The notice was on Spruce Hollow
- 3:41letterhead signed by Britney. I taped it
- 3:44inside my office wall and laughed. 3
- 3:46weeks later, another one, then another.
- 3:49By the end of that first year, I had 11
- 3:51of them. Each one was about something
- 3:53different. the corrugated metal roof,
- 3:55the forklift in the sideyard, a pile of
- 3:58scrap I'd been organizing for a
- 4:00sculpture, the wedding band welds on a
- 4:02piece of fence Cassie had practiced on
- 4:04after school. I never paid a scent.
- 4:07Every notice went into a manila folder
- 4:09marked H- H O A, the same way my Marine
- 4:14buddies used to organize after action
- 4:16reports. Joanne used to tease me about
- 4:18my filing habit. She said I treated
- 4:20paperwork like a religion. Turns out
- 4:22that habit was about to save my
- 4:24workshop, my livelihood, and possibly my
- 4:27daughter's future. I just didn't know it
- 4:29yet. The pattern got bolder in the
- 4:31second year. It was a Tuesday in late
- 4:33April when Britney pulled into my
- 4:34driveway uninvited. I just lit a brazing
- 4:37rod when I heard the Mercedes door slam
- 4:39and her voice cut across the gravel like
- 4:41a circular saw hitting a nail. Wesley.
- 4:44Wesley, we need to talk about your
- 4:46situation. She had a clipboard. The
- 4:48clipboard always meant trouble. She wore
- 4:51a salmon linen blazer and white slip-on
- 4:53sneakers that were already showing break
- 4:55dust. And she walked into my open bay
- 4:57like she was inspecting a kitchen at a
- 4:59four-star restaurant. You can't be in
- 5:02here, I said. It's an active workshop.
- 5:04There's slag on the floor. I'm
- 5:06performing a community compliance
- 5:08walkthrough. She said, "On private
- 5:10property that isn't part of your
- 5:12community." She laughed at that.
- 5:14Actually laughed like I'd said something
- 5:16charmingly stupid. Then she pulled out a
- 5:19typed letter on Spruce Hollow Estates
- 5:21letterhead and held it out as if it were
- 5:23a court order from God. Cease and
- 5:25desist. You have 30 days to remove all
- 5:28commercial fabrication equipment from
- 5:30the premises or the association will
- 5:32pursue legal action. I read it. I didn't
- 5:35say anything for a long moment. The
- 5:37brazing rod cooled on the bench. Then I
- 5:39walked her gently back through the bay
- 5:42door. I shut it behind us. I went into
- 5:44the office. I came back with a copy of
- 5:47my recorded deed in the 1987 plat map,
- 5:50both folded and creased from a 100 prior
- 5:52arguments. I laid them on the hood of
- 5:55her Mercedes. Read the boundary line,
- 5:57Britney, the dotted one. You see this
- 5:59little notch where the road bends?
- 6:01That's the edge of your HOA. My property
- 6:03starts 10 ft east of that notch. It has
- 6:06never been inside Spruce Hollow Estates.
- 6:08Not in 1987, not in 1995, not now. You
- 6:12have no authority to issue a cease and
- 6:14desist. She squinted at the map for
- 6:16about 4 seconds. Then she folded her
- 6:18arms across the salmon blazer and said,
- 6:21"We consider the parcel functionally
- 6:23part of our jurisdiction." That was the
- 6:25first time I heard the phrase
- 6:27functionally part of our jurisdiction. I
- 6:29would hear variations of it 63 more
- 6:31times over the next 2 years. You
- 6:34consider it that way, I said. The county
- 6:36doesn't. You don't want to fight the
- 6:38association on this, Wesley. Drew sits
- 6:40on planning. Things can become very
- 6:42inconvenient very quickly. That was the
- 6:44first open threat. I filed it in my head
- 6:47the way I'd been trained to file an
- 6:48afteraction note. Time of statement,
- 6:512:47 p.m. Witnesses, none. But I had a
- 6:55Ring camera on the porch eaves that
- 6:57picked up the audio perfectly. I checked
- 6:59it that night and saved the clip to two
- 7:01different drives. The next week, three
- 7:04sheriff's deputies showed up at 6:00 in
- 7:05the morning. Britney had filed a noise
- 7:07complaint about my workshop operating
- 7:09commercial machinery before sunrise. The
- 7:12deputy on point was a tall man named
- 7:14Caleb Sterns, who I'd actually played
- 7:17softball with the previous summer. He
- 7:19looked at my unlit shop, the cold
- 7:21welder, my coffee cup still steaming on
- 7:24the porch rail, and exhaled through his
- 7:26nose. Wes, I'm going to level with you,
- 7:29he said. This is the third call she's
- 7:31made about you this month. None of them
- 7:33have checked out, but once a complaint
- 7:35is filed, I'm required to roll on it. I
- 7:37know you might want to start
- 7:39documenting. I already am. He smiled a
- 7:42little. He'd seen the type before. He
- 7:45told me off the record that the
- 7:46department had unofficially flagged
- 7:48Britney's calls as habitual. He also
- 7:51told me off the record that wouldn't
- 7:53stop her. 3 days later, I came home from
- 7:55a hardware run to find a Spruce Hollow
- 7:57Estate sticker plastered across the
- 8:00front of my gate sign. Big yellow
- 8:02letters, violation, unauthorized
- 8:04commercial activity. The sticker was
- 8:06glued so hard with industrial adhesive
- 8:09that it took me an hour with acetone and
- 8:11a razor blade to remove. Cassie watched
- 8:13me from the porch with that quiet,
- 8:15focused look she gets when she's
- 8:17deciding to remember something. Dad, she
- 8:19said. Yeah, sweetheart. She's going to
- 8:22keep doing this, isn't she? I dropped
- 8:24the last shred of yellow vinyl into a
- 8:265gallon bucket and capped the lid. Yes,
- 8:29I said. She is. What are we going to do?
- 8:32I looked at her. 16 years old, blue
- 8:35welding goggles pushed up on her
- 8:36forehead, her mother's same stubborn
- 8:38jaw. We're going to keep every single
- 8:41one, I said. And we're going to wait.
- 8:44The waiting got harder in year three. By
- 8:46then, I had 41 violation notices in my
- 8:49ha folder. None of them had ever been
- 8:52ruled valid by the county. Britney
- 8:54didn't care. She was playing a different
- 8:56game. She was playing for fatigue. That
- 8:59summer, she pivoted to a new tactic. She
- 9:01started warning my customers off. The
- 9:03first I heard of it was from a longtime
- 9:05client named Hal Vickers, a retired
- 9:07rancher out near Hygiene who'd ordered a
- 9:10custom gate for his property line. Hal
- 9:12called me on a Friday afternoon, his
- 9:14voice sandpapered with awkwardness. Wes,
- 9:17I had a strange visit from a lady this
- 9:19morning. Said her name was Britney
- 9:20something and she's the HOA president
- 9:23out by your shop. She said she felt
- 9:25obligated to let me know there's an
- 9:26ongoing safety investigation into your
- 9:29workshop and that any orders placed with
- 9:31you might be subject to seizure as
- 9:32evidence. I closed my eyes. My fingers
- 9:35found the edge of the bench. The metal
- 9:37was cool. I made myself breathe. Howal,
- 9:40I want you to know two things. First,
- 9:42there is no investigation. Second, she
- 9:45has no jurisdiction over my property.
- 9:47She's lying to drive my business under.
- 9:49Hal was quiet for a minute. Then he
- 9:52said, "Son, I figured I've known three
- 9:55women like her in my life, and they all
- 9:57ended the same way. Fence post deep in
- 9:59their own hole. You finish my gate, I'll
- 10:02pay you cash up front, and if you need
- 10:04somebody to swear out an affidavit about
- 10:06what she told me, you let me know. I'll
- 10:08let you know." I hung up and stared at
- 10:11the wall for a full minute before I
- 10:12could move. Cassie came in. She'd heard
- 10:15the tone. She sat on the corner of my
- 10:17desk and said nothing. Just waited.
- 10:19She's going after my customers now, I
- 10:21said. Like a coward, Cassie said. Like a
- 10:24coward. Over the next two months, four
- 10:26more clients got the same visit. Two
- 10:29stuck with me. Two quietly canceled
- 10:31their orders. I watched my June revenue
- 10:33drop 40%. I started skipping lunches to
- 10:36keep the bills paid. I sold a vintage
- 10:38Cherry Red 1968 Norton motorcycle that
- 10:42Joanne and I had restored together. Sold
- 10:44it to a collector in Fort Collins for
- 10:46$9,000. The alternative was missing a
- 10:49payment on Cassy's college savings
- 10:51account. That sale hurt in a way that
- 10:53doesn't have a clean name. I drove home
- 10:56from Fort Collins with empty hands and a
- 10:58cashier's check in my pocket, and the
- 11:00smell of WD40 stuck to my fingers the
- 11:03whole way. A week after that, Britney
- 11:06escalated again. She showed up at my
- 11:08gate with a man in a Navy polo who
- 11:10introduced himself as a compliance
- 11:12inspector with the Boulder Foothills
- 11:14Community Safety Authority. That isn't a
- 11:16real agency. I checked 12 hours later.
- 11:19The agency was a private LLC registered
- 11:22to the same Shell consulting firm that
- 11:24filed her HOA paperwork. He had a badge
- 11:27that he'd ordered off Amazon for $38. He
- 11:30demanded to inspect my shop for fire
- 11:32code violations. I asked for his
- 11:34certification number. He didn't have
- 11:36one. I asked for the warrant. He didn't
- 11:38have one. I asked him to leave. He
- 11:41didn't until I picked up my phone and
- 11:43dialed the actual Boulder County Sheriff
- 11:45while standing in front of him on my own
- 11:47driveway. Then he and Britney hustled
- 11:49back to her Mercedes like raccoons hit
- 11:51by a porch light. The deputy who came
- 11:54out again, Caleb, took one look at the
- 11:56fake badge photographed on my ring
- 11:58camera and shook his head slowly. Wes,
- 12:01he said, I'm going to level with you
- 12:03again. The department can't act on
- 12:05individual incidents like this without a
- 12:06pattern complaint. But if you build a
- 12:08pattern, we can build a case. How big a
- 12:11pattern? 20 solid incidents documented
- 12:14minimum. Photos, timestamps, witnesses,
- 12:17the works. I went inside and counted my
- 12:20folder. 43. I went back out and told him
- 12:22I'd be ready when he was. That night,
- 12:25Cassie set the table while I welded a
- 12:27new hinge on the front gate. The sun was
- 12:29setting through the cottonwoods and the
- 12:31gold light caught the grinding sparks
- 12:33like fireflies coming home. She didn't
- 12:36ask me about the Norton. She knew. She
- 12:38just brought me a glass of cold water
- 12:40and stood beside me until the hinge
- 12:42cooled. Dad, she said, "Yeah, you should
- 12:46start writing this down. Like all of it,
- 12:48not just the notices, everything she
- 12:50says, everything she does." I looked at
- 12:53my 16-year-old daughter and thought, "My
- 12:55god, your mother would be so proud."
- 12:57You're right. I said, "I will." I
- 13:00started a yellow legal pad that night,
- 13:02and I never stopped. Year four was the
- 13:04year she touched the gate. I had
- 13:06reinforced it twice by then. The Norton
- 13:08money paid for the steel. I bolted 3/8
- 13:11in plate across the gate face, installed
- 13:13a coated keypad, and ran the camera
- 13:16system through a battery backup, so even
- 13:18a power cut couldn't blind it. The shop
- 13:20got the same treatment. Four cameras
- 13:22outside, two inside. every angle saved
- 13:25to local storage and to the cloud.
- 13:28Britney must have seen the upgrades
- 13:29because the next month she shifted
- 13:31tactics again. This time she didn't come
- 13:34herself. She sent two men. It was a
- 13:37Wednesday in October. The aspens up on
- 13:39the foothill behind the property were
- 13:40the color of new copper and the smell of
- 13:43wood smoke from the McConnell place down
- 13:44the road had been drifting across the
- 13:46field all morning. I was in town picking
- 13:49up an order of stainless rod when Cassie
- 13:51called. Dad," she said. Her voice was
- 13:54very level. "Two men just pulled up to
- 13:56the gate. They have bolt cutters.
- 13:58They're saying they are here on HOA
- 14:00orders. My truck was 3 mi out." I turned
- 14:03around. "Stay inside the house," I said.
- 14:05"Lock the doors. Record everything from
- 14:08the window. Do not engage them." "I
- 14:10won't. I love you." "I love you, too.
- 14:13Drive safe." I made it home in 5
- 14:15minutes. By then, they'd cut through my
- 14:17outer keypad housing and were starting
- 14:19on the steel plate. They were two men in
- 14:21their 30s, work boots and oil stained
- 14:24jeans. Neither one looking entirely sure
- 14:26of why he was there. I rolled my window
- 14:28down before I hit the brake. Gentlemen,
- 14:31step away from the gate now. They
- 14:33turned. The bigger one, red bearded,
- 14:35lowered the bolt cutters. We were told
- 14:37this property had a court order for gate
- 14:39removal. HOA hired us. You were told a
- 14:42lie. This property is not part of any
- 14:45HOA. I have it on recorded deed. You are
- 14:48committing criminal property
- 14:49destruction. The smaller one pald
- 14:51visibly. The bigger one frowned. We got
- 14:54a work order. Says right here. He held
- 14:57up a tablet. The screen showed a fake
- 14:59order on Spruce Hollow Estates
- 15:01letterhead. The signature line blank
- 15:03where a court signature should have
- 15:04been. That document is forged. I said I
- 15:08kept my voice flat the way I used to
- 15:10talk down young Marines about to make a
- 15:12bad decision. I am going to call the
- 15:14sheriff in approximately 30 seconds. If
- 15:17you are still here when I do, you become
- 15:19defendants. If you leave now, you stay
- 15:21witnesses. I have video of everything
- 15:23you've done so far, and I'm willing to
- 15:25share that video with your employer,
- 15:27your defense attorney, or both. Your
- 15:30call. They didn't even argue. They threw
- 15:32the bolt cutters in the back of their
- 15:33truck and were gone in under 90 seconds.
- 15:36I got a clean license plate, a clean
- 15:38shot of both faces, and audio of the
- 15:40bigger man saying on camera, "Yeah, the
- 15:43HOA lady hired us. Britney said it was a
- 15:46compliance job. I stood there a long
- 15:49time after they pulled away. Cassie came
- 15:51out of the house. She stopped about 10
- 15:53feet from me and stood, hands shoved
- 15:55deep in her jacket pockets. Looking at
- 15:57the cut housing and the scuff marks on
- 15:59the plate. The sun behind her made her
- 16:01hair shine the same red as her mother's.
- 16:04"Are you okay?" she asked. "Yeah." They
- 16:07cut mom's gate. I had welded that gate
- 16:09the year after Joanne died. Her
- 16:11initials, J LH, were tucked behind the
- 16:14lower hinge, so you couldn't see them
- 16:16unless you were lying on your back in
- 16:18the gravel looking up. Cassie knew about
- 16:20them. Brittney did not. It's just steel,
- 16:23I said quietly. We can fix steel, but
- 16:25something turned over in my chest. Not
- 16:27anger, not even outrage. More like the
- 16:30quiet click of a tumbler in a lock
- 16:32falling into place. I called Caleb. He
- 16:35showed up 45 minutes later. He watched
- 16:38the footage twice. He looked at the cut
- 16:40housing, the fake work order I'd
- 16:42photographed off the tablet, the audio
- 16:44recording. He sighed the long sigh of a
- 16:47man who has seen far too much human
- 16:50stupidity dressed up as authority. Wes,
- 16:52he said, I think you might have what we
- 16:54need. I know I do. What are you going to
- 16:57do? I'm going to file the complaint and
- 17:00then I'm going to start asking questions
- 17:02about how she's funded. He raised an
- 17:04eyebrow. Britney doesn't have a job, I
- 17:07said. Drew makes maybe 90,000 at the
- 17:09county. They drive match Mercedes and
- 17:11just put in a heated pool. Where's the
- 17:13money coming from? Caleb looked at me
- 17:16for a long moment. Then he said, "Wes,
- 17:18I'd love to see what you find. That
- 17:20weekend, I drove to the Boulder County
- 17:22Clerk's office and filed my first formal
- 17:24records request. The records request
- 17:26changed everything. Public records
- 17:29requests in Colorado are governed by the
- 17:31Colorado Open Records Act, the Kora.
- 17:34Most counties have to respond within
- 17:35three working days. Most people don't
- 17:38bother to ask. Most HOA presidents who
- 17:40skim a little money on the side count on
- 17:43the fact that nobody is ever going to
- 17:45look. If you ever suspect a small town
- 17:47official is dirty, here's the takeaway
- 17:49worth keeping. The paperwork they have
- 17:52to file is almost always public and
- 17:54almost nobody ever reads it. I asked for
- 17:56three things. One, every recorded
- 17:59compliance fee Spruce Hollow Estates had
- 18:01collected in the last eight years with
- 18:03attached invoices. Two, every approved
- 18:06boundary expansion ever filed by Spruce
- 18:09Hollow Estates with the county
- 18:10acknowledgement. Three, any vendor
- 18:13contracts the HOA had with a consulting
- 18:16firm called Wildflower Strategy LLC,
- 18:20which I had noticed appeared at the
- 18:22bottom of every official notice Britney
- 18:24had ever sent me, printed so small I'd
- 18:27missed it for three full years. The
- 18:29clerk, a friendly woman named Eileene
- 18:31Brooks, who'd been on the job since the
- 18:33Clinton administration, raised an
- 18:35eyebrow at the third one. Wildflower
- 18:37strategy, she said. Drew Cole
- 18:39Whitfield's name comes up on that
- 18:41filing. Pardon? It's registered to him.
- 18:44Soul Member LLC filed in 2016. I felt
- 18:48that quiet tumbler click again. The
- 18:51records came back 6 days later. I sat on
- 18:53my porch with a mug of coffee, the box
- 18:55of paper across my knees, and started
- 18:58reading. Here is what I found. The HOA
- 19:00had collected approximately $312,000
- 19:04in compliance fees over 8 years. Roughly
- 19:07207,000 of that had been paid out to
- 19:10Wildflower Strategy LLC for consulting
- 19:14services. Wildflower Strategy LLC
- 19:18was registered to Drew Cole Whitfield,
- 19:20husband of Brittany Cole Whitfield, HOA
- 19:23president. Drew sat on the Boulder
- 19:25County Planning Commission, the same
- 19:27body that approved any expansion the HOA
- 19:29tried to claim. There was never a
- 19:31boundary expansion filing on the books.
- 19:34Not one. The 1987 platt had never been
- 19:37amended. That meant every expanded
- 19:39jurisdiction violation notice Britney
- 19:41had issued to me and to at least 19
- 19:44other nonha homeowners I would later
- 19:47identify had been issued without legal
- 19:49authority. Every fee collected on that
- 19:51authority was at minimum conversion
- 19:54under Colorado civil law. At worst, it
- 19:56was a coordinated embezzlement scheme
- 19:58using a fictitious jurisdiction as
- 20:01cover, and every dollar of it had been
- 20:03laundered through her husband's shell,
- 20:05LLC, contracted by an HOA sheared,
- 20:09signed off by a planning commission he
- 20:11sat on. I sat on that porch a long time.
- 20:14The coffee got cold. The cottonwoods
- 20:16rustled. Somewhere down the road, a
- 20:18chainsaw started up and stopped. I
- 20:20finally got up and walked back to the
- 20:22shop. Cassie was in the bay running a
- 20:24TIG bead on a brake pedal mount for a
- 20:26customer. She looked up when she heard
- 20:28me come in. She killed the torch. He
- 20:31died. I found it. How bad? 300 grand. 8
- 20:36years. 20 homes. Her husband's shell
- 20:38company. Cassie set down the torch. Her
- 20:41welding hood flipped up. Her eyes,
- 20:43Joannne's eyes, held mine. What do we
- 20:46do? She said. We don't move yet. She
- 20:49doesn't know. We know. If we move too
- 20:50early, Drew warns her. They shred
- 20:52records and the case evaporates. So we
- 20:55wait. We wait and we build. She nodded
- 20:58slowly. Then she said something I have
- 21:00replayed in my head ever since. Mom
- 21:02would have loved this. I laughed. It
- 21:05came out a little wet around the edges.
- 21:07Yeah, I said. She would have. Joanne had
- 21:10been a parallegal for 16 years before
- 21:12the cancer. She would have read every
- 21:14page of those records over coffee and
- 21:16circled the parts that mattered with a
- 21:18red pen. She would have known exactly
- 21:20what to do. Now her daughter and I were
- 21:22going to do it for her. The next eight
- 21:24months were the quietest of my adult
- 21:26life. I did three things in that time. I
- 21:28built a case. I built a structure and I
- 21:31built a community. The case came first.
- 21:34I scanned every violation notice into a
- 21:36single binder. Organized chronologically
- 21:39cross-indexed to the audio and video
- 21:41clips that backed each one. I drove out
- 21:44and visited every nonha landowner whose
- 21:47name appeared on a Spruce Hollow
- 21:48compliance invoice. There were 19 of
- 21:51them. 16 still lived in the area. 12 had
- 21:54paid Britney at some point, mostly in
- 21:57amounts between $200 and $800 because
- 22:00they were either intimidated or just
- 22:02tired. Two had been driven entirely out
- 22:04of their homes by her noise and code
- 22:06campaigns and were renting in Longmont.
- 22:09I took statements from every one of
- 22:11them. Joannne's old parillegal habits
- 22:13surfaced as I worked. I made each
- 22:15witness sign and date their statement,
- 22:17attached photographs, and tagged
- 22:19everything in a master index. If you
- 22:21ever go after someone like Britney,
- 22:23here's a thing worth knowing. A single
- 22:25complaint is a grievance. 20 parallel
- 22:27complaints signed and dated is a
- 22:29pattern. Patterns are what move district
- 22:32attorneys. The structure came second. I
- 22:35retained an attorney out of Longmont
- 22:36named Pamela Whitam, an older woman with
- 22:39a gray bob and the unhurried smile of
- 22:42someone who had once worked civil rights
- 22:44cases in the 70s and never quite
- 22:46stopped. She read my binder in 3 hours
- 22:48and called me back the same afternoon.
- 22:51Mr. Hartwell, she said, this is the
- 22:53cleanest civil RICO predicate I have
- 22:55read in a decade. I'd like to take it on
- 22:57contingency. What does that mean for the
- 22:59criminal side? The criminal side is the
- 23:02district attorney's call, but I have a
- 23:04friend in that office who would, I
- 23:05suspect, find this very interesting if
- 23:07it landed on her desk. Make the call,
- 23:11she did. Meanwhile, I started
- 23:13reinforcing the shop. Not aggressively,
- 23:16just enough. I rebuilt the gate with a
- 23:18code activated steel crossbar, the kind
- 23:21that has to be retracted before the gate
- 23:23can swing. I doubled the cameras inside
- 23:25the workshop, including one on the main
- 23:27bay door that pointed into the shop in
- 23:29case anyone ever tried to enter while I
- 23:31was gone. I installed a clean MIG setup
- 23:34near the front of the bay. A setup that,
- 23:36if you didn't know better, looked like
- 23:38it had been left in mid job. The truth
- 23:40was that it was bait. The sort of detail
- 23:42my old commanding officer used to call a
- 23:44trip wire of opportunity. I never
- 23:46explained to anyone why I left it there.
- 23:48I just kept it there. Cassie and I
- 23:51welded together every Saturday that
- 23:52winter. She was working on a piece, a
- 23:55row iron sculpture of a horse rearing
- 23:56for the regional youth metal art
- 23:58competition. The horse was nearly 4 feet
- 24:01tall. She had been working on it for a
- 24:03year. The detail in the mane alone took
- 24:05her 70 hours. I have never been more
- 24:08grateful for any 70 hours of my life.
- 24:10The community came third. I started
- 24:13inviting the other nonha land owners
- 24:15over on Sunday afternoons. We sat on the
- 24:18porch and we talked. We were not any of
- 24:21us particularly political people. We
- 24:24were retired ranchers, a small engine
- 24:26mechanic, two school teachers, a woman
- 24:29who restored antique pianos, and a
- 24:32Vietnam veteran who farmed honey. What
- 24:34we had in common was that Britney Cole
- 24:36Whitfield had pretended to govern us for
- 24:38years. We compared notes. We compared
- 24:41invoices. We compared the small
- 24:44humiliations she had inflicted, one
- 24:46envelope at a time. By February, I had
- 24:48not only 19 statements, but a coalition.
- 24:52We named ourselves, half- jokingly, the
- 24:54East Hollow Owners Association. We
- 24:57elected the Vietnam veteran, a quiet man
- 24:59named Earl Pendergast, as our
- 25:01chairperson. We started a shared file.
- 25:04We started a small monthly potluck. None
- 25:06of this was illegal. None of it was even
- 25:08adversarial. It was on its face
- 25:10neighbors getting to know each other,
- 25:12but it gave us a structure and it gave
- 25:14us solidarity. In late March, Pamela
- 25:17called me. The Boulder County DA's
- 25:19office had reviewed the materials. They
- 25:21had quietly opened an investigation into
- 25:23Wildflower Strategy, LLC, and Spruce
- 25:27Hollow Estates compliance fees. They
- 25:29asked us to sit on the information and
- 25:31keep doing exactly what we were doing.
- 25:33How long? I asked. 60 to 90 days, Pamela
- 25:37said. They want a clean predicate. Don't
- 25:39tip her off. I won't. I hung up the
- 25:42phone. The shop was quiet. Cassie was
- 25:44sitting on the bay step sanding the
- 25:46horse's hoof. The sun was warm on the
- 25:49gravel. The whole property smelled like
- 25:51cut iron and pine. I went outside, sat
- 25:54down on the step next to my daughter,
- 25:56and said nothing. She didn't ask. She
- 25:58just handed me a piece of sandpaper.
- 26:00Britney sensed the silence. Predators
- 26:03almost always do. They get suspicious
- 26:05when the prey stops twitching. By April,
- 26:08she could see that I had stopped
- 26:09responding to her notices, that her
- 26:11violation stickers were being calmly
- 26:13removed and filed without protest, that
- 26:16two of her favorite intimidation tools
- 26:18had simply stopped producing the
- 26:19reactions she had built her authority
- 26:21on. She didn't know about the records
- 26:23request. She didn't know about Pamela.
- 26:26She didn't know about Earl. But she knew
- 26:28the way an old shark knows a current has
- 26:30shifted that something was wrong. So,
- 26:33she escalated hard. The first move was
- 26:36social. She posted on the neighborhood
- 26:38Facebook group, the one Drew manage as
- 26:40moderator, a long, careful, plausible
- 26:42sounding statement of concern. It
- 26:44accused me by name, of operating an
- 26:46unlicensed industrial hotwork facility
- 26:49within 500 ft of family homes. It
- 26:52described my workshop as a fire hazard
- 26:54and a potential explosive risk. It
- 26:56implied, without quite saying, that
- 26:58Cassie was being raised in an unsafe
- 27:00environment by a mentally unwell
- 27:02veteran. That last part was underlined.
- 27:04The post was shared 492 times in 3 days.
- 27:08I did not respond to it. Pamela had told
- 27:11me not to. The post went into the
- 27:13binder. The second move was
- 27:15bureaucratic. She filed a formal
- 27:17complaint with the Colorado Department
- 27:19of Public Health and Environment
- 27:20alleging illegal hazardous waste storage
- 27:23at my shop. CDPH sent an inspector out
- 27:27within a week. The inspector was a woman
- 27:29in her 60s named Lena Brock, who had
- 27:32been doing the job since the 80s and
- 27:33could spot a frivolous complaint from a
- 27:35county away. She walked my shop, looked
- 27:38at my labeled, dated, properly stored
- 27:40containers, looked at my OSHA placards,
- 27:43looked at the spotless floor Cassie had
- 27:45mopped 3 days earlier, and said, "Mr.
- 27:48Hartwell, I'm filing this as unfounded.
- 27:51Whoever sent this in has done it before,
- 27:53hasn't she?" A yes, ma'am.
- 27:56She wrote me a courtesy copy of the
- 27:58unfounded finding and added off the
- 28:00books a comment that CDPH was beginning
- 28:04to track Britney's complaint pattern
- 28:05across multiple homeowners. That copy
- 28:08went into the binder, too. The third
- 28:10move was where she crossed a line that
- 28:12no parent ever forgets. On the morning
- 28:14of April 17th, a Boulder County social
- 28:17worker named Terresa Hallebertton
- 28:19knocked on my door. She was holding an
- 28:21iPad and looked deeply uncomfortable.
- 28:23She explained gently that a report had
- 28:25been filed alleging that my 16-year-old
- 28:27daughter was being exposed to dangerous
- 28:29industrial chemicals and engaging in
- 28:32unsupervised heavy machinery operation
- 28:35and that Cassie had been observed
- 28:36working barefoot near welding equipment.
- 28:39Cassie has never welded barefoot in her
- 28:41life. She has a pair of steeltoed Wesco
- 28:43boots she saved up 6 months to buy and
- 28:46treats like an heirloom. Teresa wanted
- 28:48to interview Cassie. Cassie agreed. She
- 28:51walked Teresa through the shop point by
- 28:53point, explaining her PPE rituals, her
- 28:56welding log book, her American Welding
- 28:58Society Junior certification, yes, that
- 29:01is a real thing. Cassie earned hers at
- 29:0415, and her competition schedule. She
- 29:07showed Teresa the locked chemical
- 29:09cabinet, the eyewash station, the fire
- 29:11suppression system, the certified
- 29:13ventilation hood. She showed her the
- 29:16frame photo of Joanne on the office wall
- 29:18and explained calmly why she had started
- 29:20welding. Teresa closed her notebook a
- 29:23quarter of the way through. Mr.
- 29:25Hartwell, she said, I am required to
- 29:27follow up on every report, but I want
- 29:30you to know on the record that this
- 29:32report was, in my professional judgment,
- 29:34malicious. I'm going to mark it as such
- 29:37in my final assessment. Whoever filed
- 29:39this against you and your daughter
- 29:41abused a process that exists to protect
- 29:43actual children in actual danger. She
- 29:46gave us her direct line. She told us to
- 29:48call if anything else happened. She
- 29:50left. I stood on the porch and watched
- 29:52her drive away. Cassie came out and
- 29:54stood next to me. She was very still.
- 29:57Dad, she said. Yeah. She tried to take
- 30:00me away from you. I couldn't speak for a
- 30:02moment. Yes, I said finally. She tried.
- 30:06I want to be there when it ends. You
- 30:08will be promise. I promise. That night I
- 30:12called Pamela. I told her about the CPS
- 30:14report. I told her about Terresa
- 30:16Hallebertton's statement. There was a
- 30:18long silence on the other end of the
- 30:19phone. Wesley, she said, I want you to
- 30:22listen to me very carefully. The DA's
- 30:25office has just completed their
- 30:26pre-charging review. They have enough.
- 30:29Enough for what? Enough to indict on six
- 30:32counts. theft, conspiracy to commit
- 30:35theft, filing false reports, attempted
- 30:38intimidation of a witness, two counts of
- 30:40forgery. They want one more documented
- 30:43incident, anything fresh, anything new
- 30:45to lock in the timeline. After that,
- 30:48they'll move. How long? As long as it
- 30:51takes for her to do one more stupid
- 30:53thing. I looked at Cassie across the
- 30:55kitchen. She had heard. Pamela, I said,
- 30:58she always does. It happened on a Friday
- 31:00in early May. Cassie was in the shop. I
- 31:03was 20 minutes away at the hardware
- 31:05store in Longmont, buying a fresh tank
- 31:07of argon and a box of welding tips. The
- 31:10bay door was open because Cassie was
- 31:12finishing the patina on her horse
- 31:14sculpture, which required a south breeze
- 31:16to evaporate the chemical evenly. The
- 31:19horse stood on a wooden plinth at the
- 31:20center of the bay, hooves planted, mane
- 31:23lifted, eyes raised, 57 lbs of
- 31:26handformed row iron that represented one
- 31:29year of her young life. I would learn
- 31:31the rest of the story from cameras, from
- 31:33Cassie, and from Britney's own mouth. At
- 31:3611:47 a.m., a pearl white Mercedes GLS
- 31:40came up my driveway. The gate was open
- 31:42because I had been moving steel earlier
- 31:44and hadn't reset the bar. The Mercedes
- 31:47slowed at the gate. Britney leaned out
- 31:49the driver's window, looked at the shop,
- 31:51saw the bay door open, saw Cassie alone
- 31:54inside, and made a decision. She drove
- 31:56the Mercedes straight into the workshop.
- 31:58She didn't stop at the bay opening. She
- 32:00rolled the SUV all the way in, parked it
- 32:033 ft from my welding bench, and shut off
- 32:05the engine. She got out. She tossed her
- 32:08purse on the bench, knocking a roll of
- 32:09welding wire onto the floor. She walked
- 32:12to the patina soaked horse, looked it up
- 32:14and down, and said audibly on camera,
- 32:17"This whole place is a violation."
- 32:19Cassie was standing 5t behind her,
- 32:22holding a soft brush in one hand.
- 32:24"Ma'am," Cassie said. "You can't be in
- 32:26here." Britney turned. She saw Cassie.
- 32:29Her face went through three expressions
- 32:31in quick succession. Surprise,
- 32:33calculation, then a kind of sharp, mean
- 32:36delight. Oh, she said, "You, the little
- 32:39welding princess. Where's your father,
- 32:42sweetheart?" "He's not home. Please
- 32:44leave." Britney ignored her. She walked
- 32:46deeper into the shop. She started
- 32:48photographing the chemical cabinet, the
- 32:51MIG bait setup near the front, the rack
- 32:54of finished gates waiting for pickup.
- 32:56She kicked a coil of TIG filler rod with
- 32:58the toe of her sneaker, then
- 33:00deliberately kicked over the live MIG
- 33:01welder I had left in the front of the
- 33:03bay. The welder fell sideways. The wire
- 33:06feed jammed. The tip sparked once
- 33:08against the concrete, and a thin curl of
- 33:11smoke rose. Cassie was already moving,
- 33:13not toward Britney, toward the wall. You
- 33:16can't operate this kind of equipment
- 33:18without proper. Cassie hit the bay door
- 33:20button. The bay door is a 15 ft rolling
- 33:23steel panel on a chain drive. It takes
- 33:2519 seconds to come all the way down.
- 33:28Britney heard the chain start. She
- 33:30turned. Her face shifted into a fourth
- 33:32expression. Confusion, then anger. What
- 33:35are you doing? Stop that. Cassie didn't
- 33:38say anything. She walked to the side
- 33:40door, the one that exits into the back
- 33:41of the shop and out toward the house.
- 33:44She stepped through. She locked it
- 33:45behind her. She locked the front office
- 33:47door. She locked the rear bay door. She
- 33:50walked into the kitchen, picked up her
- 33:52phone, and called me. is dad. What's
- 33:55wrong? Britney's locked in the shop. She
- 33:57drove the Mercedes inside. She kicked
- 34:00over the MIG. I missed the exit ramp. I
- 34:03had to take the next one and double
- 34:04back. By the time I pulled into the
- 34:06driveway 26 minutes later, the Mercedes
- 34:09was still inside. The bay was sealed.
- 34:11And Britney, I could hear her, was
- 34:13pounding on the inside of the steel
- 34:15panel like an animal in a trap. Cassie
- 34:17was on the front porch with her arms
- 34:19folded, watching the shop like a cat
- 34:21watching a mouse trap she had personally
- 34:23set. I parked. I got out. I walked up to
- 34:26the porch. "Are you okay?" I said. "I'm
- 34:29fine." "Show me the footage." She had
- 34:31already pulled it up on her phone. We
- 34:33watched the whole thing. The Mercedes
- 34:35rolling into the bay, the kicked welder,
- 34:37the threats to Cassie, the moment my
- 34:3916-year-old daughter had calmly walked
- 34:41to the wall and pressed the button that
- 34:43closed the trap. Cassie, what? You did
- 34:47the right thing. I know. I walked slowly
- 34:50around to the side door of the shop. I
- 34:52could hear Britney on the other side
- 34:54threatening lawsuits, threatening the
- 34:56sheriff, threatening her husband,
- 34:58threatening Drew's planning commission
- 35:00seat. I did not open the door. I called
- 35:02Pamela. I told her exactly what had
- 35:05happened. There was a long silence. And
- 35:07then, for the first time in 8 months, I
- 35:09heard my attorney laugh. Wesley, she
- 35:12said. She just gave us the last
- 35:13predicate. Pamela, I said, I'm not
- 35:16calling the sheriff yet. Why not? I
- 35:18looked through the side window of the
- 35:20shop. I could see between the boxes the
- 35:22pearl flank of the Mercedes. I could see
- 35:25the welding bench. I could see my tools.
- 35:27Because I said, I think it's time we
- 35:30talked about evidence preservation. What
- 35:32I did over the next 90 minutes will be
- 35:34argued about in Boulder County for the
- 35:35next 10 years. Pamela has explained it
- 35:38twice in deposition. I will explain it
- 35:40here exactly as it happened. I called
- 35:42the sheriff's department. I asked
- 35:44specifically for Caleb Sterns. I told
- 35:47him there had been a criminal trespass
- 35:48at my shop and a forcible entry of the
- 35:50curtilage by a passenger vehicle and
- 35:53that the suspect was currently inside my
- 35:55secured workshop and refusing to leave.
- 35:57He asked if anyone was hurt. I said no.
- 36:00He said he would be there in 20 minutes
- 36:02with backup. He asked me not to engage
- 36:04further. I told him I would not. Then I
- 36:07went into the shop through the side
- 36:08door. I did not approach Britney. She
- 36:11was sitting in the driver's seat of her
- 36:13Mercedes on her phone screaming at
- 36:15someone. I would later learn it was Drew
- 36:17about how I had kidnapped her vehicle.
- 36:20She did not see me. The shop is large
- 36:22and full of stacked materials. And I
- 36:24moved quietly along the back wall. I did
- 36:27three things in those minutes. I
- 36:28retrieved my professional camera and
- 36:30photographed every angle of the scene.
- 36:33the Mercedes inside the workshop, the
- 36:35kicked over MIG welder, Britney's purse
- 36:37on my bench, the patina supplies on the
- 36:39horse, the bay door sealed. I retrieve
- 36:42my arc welder and four 3/8 in steel
- 36:45plates, each cut to the dimensions of a
- 36:47Mercedes door seam, and I made a single
- 36:50decision that Pamela would later
- 36:51describe in court as creative, lawful,
- 36:54and deeply ill- advised, but creative. I
- 36:57welded the steel plates over the door
- 36:59seams of her Mercedes, front and rear,
- 37:02all four doors. I used thin tack welds
- 37:05on the plates only, not on the paint,
- 37:07not on the metal of the car itself. The
- 37:09plates clamped over the seams. They did
- 37:11not touch the body panels. They could be
- 37:14removed in 20 minutes by any certified
- 37:16torch operator without ever marking the
- 37:18vehicle, but they could not be opened by
- 37:20a Mercedes Cole Whitfield with a key
- 37:22fob. The whole time, Britney sat inside
- 37:25the car on her phone with the windows
- 37:28rolled up, screaming at Drew. She never
- 37:30looked back. When I was done, I taped a
- 37:32single piece of paper to the inside of
- 37:34the driver's window. It read, "This
- 37:37vehicle is being preserved as material
- 37:39evidence pursuant to civil complaint and
- 37:41pending criminal investigation.
- 37:43Please contact the Boulder County
- 37:45Sheriff's Office before attempting
- 37:47removal." Wesley T. Hartwell. I walked
- 37:49out. I locked the side door behind me.
- 37:52Caleb arrived 11 minutes later with two
- 37:54deputies and a body camera. I walked him
- 37:56through the footage. I walked him
- 37:58through the binder. I walked him through
- 38:00Cassy's call, the timeline, the welded
- 38:02plates, the careful protection of the
- 38:04paint. I gave him a signed sworn
- 38:07statement. I gave him Pamela's number. I
- 38:09gave him 8 years of records. Caleb
- 38:11watched all of it. Then he looked at the
- 38:13welded Mercedes through the shop window.
- 38:15Then he looked back at me. Then he said
- 38:18very quietly, "Wesley, you magnificent
- 38:22son of a gun. Am I in trouble? You
- 38:24weren't supposed to do what you did, but
- 38:26the plates didn't damage the car. The
- 38:28car damaged your equipment. She drove
- 38:30that thing into your shop and she's
- 38:32still sitting in it. I'm going to take
- 38:34my daughter camping for 3 days." I said,
- 38:36"I'm taking her up to a fishing cabin in
- 38:38the Pudra Canyon. I'll be unreachable. I
- 38:41want everything that needs to happen to
- 38:43happen without us." Caleb tilted his
- 38:45head. You're going to vanish, he said.
- 38:48For 72 hours, while the Mercedes sits in
- 38:51your shop, welded shut. With your
- 38:53permission, Caleb looked back at the
- 38:55shop. He looked at the sky. He took a
- 38:58deep breath. "Wes," he said, "if anybody
- 39:01asks, I told you to leave for your
- 39:03daughter's safety. I'll preserve the
- 39:04scene. We'll get an evidence team out
- 39:06here. The DA's office is already on
- 39:08standby for the indictment. Go take her,
- 39:11get some sleep." I took Cassie. I drove.
- 39:14We packed in 20 minutes. We were in the
- 39:16Pudra Canyon by sundown. The Mercedes
- 39:19stayed where it was. What happened in
- 39:21the next 3 days, I learned mostly from
- 39:23the news. The story broke Saturday
- 39:25morning on the front page of the Daily
- 39:27Camera with a photograph of a pearl
- 39:29white Mercedes welded inside a private
- 39:31workshop. By Saturday afternoon, it had
- 39:33been picked up by Channel 9. By Sunday,
- 39:36the DA had filed indictments. Britney on
- 39:39seven counts, Drew on four. By Monday,
- 39:42Drew had been suspended from the
- 39:43planning commission and Wildflower
- 39:45Strategy LLC had been administratively
- 39:48dissolved. Britney sat in a county
- 39:50holding cell for 41 hours before her
- 39:52bond was set. The Mercedes was cut free
- 39:54at 9:14 a.m. on Tuesday by two certified
- 39:58torch operators under the supervision of
- 40:00three deputies, an evidence tech, two
- 40:03attorneys, and a Channel 9 cameraman.
- 40:06Not a single panel of paint was damaged.
- 40:08When Cassie and I drove back down out of
- 40:10the canyon on Tuesday afternoon, the
- 40:12gravel at the foot of my driveway was
- 40:14lined with parked cars. I will admit, my
- 40:16first thought was that something else
- 40:18had gone wrong. Earl Pendergast met me
- 40:20at the gate. He had his Vietnam veteran
- 40:22cap pulled low against the sun and a
- 40:25smile I had not seen on his face in 3
- 40:27years. "That's Wes," he said. "We've
- 40:30been waiting for you." It wasn't a media
- 40:32crowd. The reporters had come and gone.
- 40:34This was the East Hollow Owners
- 40:36Association. All 19 of us, plus a few
- 40:39new faces, neighbors I hadn't even met
- 40:42yet, folks who had heard the story and
- 40:44wanted to shake my hand. Howal Vickers
- 40:46was there, the honey farming Vietnam
- 40:48vet, the piano restorer with paint on
- 40:51her knuckles. Lana Brock from CDPH
- 40:54off the clock. Teresa Hallebertton, the
- 40:57social worker in jeans and Iraqy's cap.
- 41:00Cassie hopped out of the truck. She
- 41:02looked at the gathering. She looked at
- 41:03me. Dad, she said, "Is this for us?" I
- 41:07think it might be. The settlement in the
- 41:09end was not the part of the story I
- 41:11remember most. Britney pled to four
- 41:13counts and served 18 months in a women's
- 41:16correctional facility in Canyon City.
- 41:18Drew lost his planning seat, lost his
- 41:20consulting LLC, and now sells insurance
- 41:24out of an office near the Pearl Street
- 41:25Mall. The HOA was restructured under
- 41:28courtappointed receiverhip and bylaws
- 41:31that explicitly bar any expanded
- 41:33jurisdiction claims. The compliance fees
- 41:35were ordered returned to every homeowner
- 41:37who had been build. My share alone
- 41:40between civil settlement and recovered
- 41:42fees came to a little over $240,000.
- 41:46I gave most of it away. Cassie and I sat
- 41:49down at the kitchen table the week after
- 41:50the receivers's order. We talked for 3
- 41:53hours. Then we drove down to Niwat High
- 41:55School and met with the principal, a
- 41:57tired and kind man named Hector Marsh,
- 42:00and we proposed something. We called it
- 42:02the Joanne Hartwell Trade Scholarship.
- 42:04It funds full tuition, certification
- 42:07fees, equipment, and PPE for two female
- 42:10students each year at the Boulder County
- 42:12Trade School. Welding, machining,
- 42:15electrical, plumbing, automotive, two
- 42:18girls, every year for at least the next
- 42:2120 years. The first scholarship was
- 42:23awarded the following May. The recipient
- 42:25was a 17-year-old named Marisol Buchanan
- 42:28who wanted to learn diesel mechanics
- 42:30because her mother drove a longhaul rig
- 42:33and she wanted to ride along someday.
- 42:35She cried when she opened the envelope.
- 42:37I cried watching her. Cassie won the
- 42:39regional youth medal art competition
- 42:41with her row iron horse. She is now 18
- 42:44in her second year at Colorado School of
- 42:46Mines studying materials engineering and
- 42:49she still runs my office on weekends
- 42:51like the calm little drill sergeant she
- 42:53has always been. I still weld every day.
- 42:56The shop is still standing. The gate has
- 42:58Joannne's initials behind the lower
- 42:59hinge. The cottonwoods still rustle. A
- 43:02few weeks ago, on a Sunday afternoon,
- 43:04the East Hollow owners association met
- 43:07for our quarterly potluck. Earl brought
- 43:09venison chili. The piano restoer brought
- 43:11cornbread baked in a cast iron pan that
- 43:14had belonged to her grandmother. Terresa
- 43:16Hallebertton brought her two daughters.
- 43:18We sat on my porch and we ate and we
- 43:20laughed and we watched the light turn
- 43:22copper on the foothill behind the shop.
- 43:25Cassie sat next to me on the porch swing
- 43:27for a few minutes between conversations.
- 43:29She bumped my shoulder with hers. Dad,
- 43:31she said, "Yeah, sweetheart." That mom
- 43:34would have loved this. I looked out
- 43:36across my land, the shop, the gate, the
- 43:39neighbors on the porch, the horse
- 43:41sculpture polished now and standing on a
- 43:43stone pedestal beside the front walk.
- 43:46Yeah, I said she would have. If you've
- 43:48made it this far, do me one small favor.
- 43:51If you've ever been bullied by a fake
- 43:53HOA, a fake authority, or a fake
- 43:56jurisdiction, drop a line in the
- 43:58comments below and tell me about it.
- 44:00Tell us what happened. Tell us what you
- 44:02wish you had done. Someone reading this
- 44:04needs to hear your story. And if you
- 44:06want to see the next case, the one about
- 44:08the HOA treasurer who tried to seize a
- 44:11Korean War veteran's pickup and ended up
- 44:13in federal court, make sure you're
- 44:15subscribed. We post a new story every
- 44:18week. I'll see you on the next one.
- 44:20>> If you boil this whole story down, what
- 44:23really happened is simple. Brittany Co.
- 44:26Whitfield didn't lose because Wesley got
- 44:28angry. She lost because Wesley kept
- 44:32record for three full years. She scouted
- 44:35on the same thing every petty tyrant cow
- 44:38song that the people she was bullying
- 44:41would get tired and start fighting.
- 44:45What she never understood is that a
- 44:47quiet man with a mana folder and a
- 44:50daughter to protect is more dangerous
- 44:52than any loud one. Every notice she
- 44:55sense became evidence. Every field's
- 44:59complaints became a pattern. Every
- 45:01threat became proof. The lesson tucked
- 45:05inside this one was saying out loud. If
- 45:08somebody is abusing fake authority over
- 45:11you, don't agree with them. Document
- 45:14them. Fire the public request request.
- 45:18Talk to your neighbors. Build the ber.
- 45:22The law does work, but it's work for the
- 45:25people who show up to is prepared.
- 45:29If you ever been bullied by a natural
- 45:31way or a fake jurisdiction of any kind,
- 45:35drop a comment and tell us about it. And
- 45:38if you want to see next week's story,
- 45:41the one about the HOA treasurer who
- 45:44tried to see a Korean War veteran pick
- 45:47up and ended up in federal court. Make
- 45:51sure you subscribe. I see you on the
- 45:54next one.
