- 0:00You don't get to open their door.
- 0:01I didn't open his door.
- 0:02You did three times.
- 0:03No, he was trying to close his door.
- 0:06He closed it because you kept opening
- 0:07it. All you want me to do is arrest him
- 0:09and take him to jail.
- 0:10I want him I was hoping he
- 0:12Your word alone.
- 0:13Yeah. And I'd be willing to come to
- 0:15court or somebody.
- 0:16Do you want me to arrest him?
- 0:17Can he be arrested? So then I can later.
- 0:21Can I call the district attorney and
- 0:23press charges? Really? Do I have to go
- 0:25to court for this?
- 0:27You're kidding me. Yeah.
- 0:29All right.
- 0:32Are you separate separate sides of the
- 0:34parties?
- 0:34Yes.
- 0:34Okay. If you'll stand over there by
- 0:36those those
- 0:37cars complaining party.
- 0:38Fantastic.
- 0:39Can I tell you what happened?
- 0:40Fantastic. Will you go stand over there
- 0:41for a second? I appreciate it.
- 0:46Over by the the cars. I don't want you
- 0:47guys in here shot of each other cuz it
- 0:50just amps things up.
- 0:52Don't let him leave. He tried to leave
- 0:54already.
- 0:55Sir, I'm right here. Thank you.
- 1:003K27. Copy plate.
- 1:07Tango 953 kilo golf. All right. Do you
- 1:11have some ID on you?
- 1:12I do, sir.
- 1:22Negative. I'm K for. How about you? Were
- 1:25you involved? I I literally just came
- 1:28here. We were going to skate.
- 1:29Okay. All right. Let me go talk to him,
- 1:33find out what his complaint is,
- 1:35and I'll come back and talk to you.
- 1:36Okay. You're not free to leave at this
- 1:38point.
- 1:38I won't leave. And then
- 1:40as far as my ID goes, are you going to
- 1:43identify me to him?
- 1:45No. This is
- 1:46for you to identify to me.
- 1:48Okay. I was wondering. Nope.
- 1:57Okay. My first responsibility is to get
- 2:00everyone away so it doesn't keep amping
- 2:02up.
- 2:02Yes. Okay.
- 2:02Okay. So, I get you're the complainant,
- 2:05but you he's standing at his car with
- 2:07his door open.
- 2:08Yeah.
- 2:08I'm not going to let him leave.
- 2:10He tried to leave.
- 2:11I know, but I'm I'm here.
- 2:13Okay, fine.
- 2:14And so for you to get a little upset
- 2:16with me and tell me
- 2:17I'm sorry. I was just walking away. I
- 2:19wanted to make sure you heard me. I'm
- 2:21sorry I yelled. Okay. Do you have some
- 2:23ID on you?
- 2:24Yeah.
- 2:30So, what happened?
- 2:32What happened is I'm just riding my bike
- 2:35in the bike zone in right here.
- 2:38Mhm.
- 2:38And this guy comes within, you know, a
- 2:41foot of me just total. I ride my bike
- 2:44for 30 years. I know when somebody
- 2:45either doesn't see me or is trying to or
- 2:48doesn't care. So he pulled into this
- 2:51parking lot. So I came by and I said,
- 2:53"Did you see me?" And he says, "Well, I
- 2:56saw you on the right." And I said,
- 2:57"Well, you were too close to me." "No, I
- 3:00wasn't." He says he has a dash cam.
- 3:02Okay.
- 3:02So you should take I He said he was
- 3:04recording it. I doubt if he was, but you
- 3:06can. Did he mention that he had a dash
- 3:09cam?
- 3:09I haven't even talked to him yet.
- 3:11Okay. So So then I came over and I said,
- 3:13"What's your name?"
- 3:14Try try and
- 3:16I get It's emotional.
- 3:17Okay. It is. I'm
- 3:19John. He said, I said, "What's your last
- 3:20name?" "I'm not going to tell you." I
- 3:22said, "Well, I have your license plate."
- 3:25Dude, I'm leaving.
- 3:28I'm going to the skate park. And I said,
- 3:29"No, you're not leaving. I'm calling the
- 3:31police." He said, "I'm leaving." And he
- 3:34tried to push me out of the car. I
- 3:36pushed him back to try to keep him in
- 3:38the car.
- 3:39But he tried to get out of the car. I
- 3:40said, "No, you're not getting out of the
- 3:42car till the police came." So, you came.
- 3:46Uh, and then this other guy comes
- 3:48and he's standing here and these two
- 3:50are, you know, they're obviously
- 3:53friends. So, I'm getting more and more
- 3:55concerned that there's two teenagers
- 3:57here and me alone. I'm 73 years old.
- 4:00Okay.
- 4:01But yeah, so that's everything that
- 4:03happened. The guy uh I thought he was
- 4:06too aggressive.
- 4:08Okay.
- 4:08On the road and then he wouldn't give me
- 4:10his name.
- 4:11Okay.
- 4:12Well,
- 4:14I was going to report him to the police.
- 4:16I I understand that.
- 4:17He just gave me his last name and his
- 4:20his uh license, I would have just
- 4:22reported.
- 4:23He's not obligated to give his
- 4:25information to you. He is obligated to
- 4:26give them to me.
- 4:27Okay.
- 4:28If if I if I'm able to determine a
- 4:30crime,
- 4:31okay?
- 4:32Well, I'm making a complaint that he was
- 4:34within 3 ft of me.
- 4:35Just hang.
- 4:36Okay.
- 4:38Don't don't fight me on this. Okay. I'm
- 4:40just trying to get the information. Yes.
- 4:42And I'm explaining why he might not want
- 4:44to give his information to you who's
- 4:47upset. Obviously,
- 4:50if if he cut that close to you, by all
- 4:53means, you'd be upset. But don't come
- 4:55over here and instigate a fight. You get
- 4:58his plate number and we can track him
- 4:59down like it's nobody's business. Okay?
- 5:01I I don't believe that's ever going to
- 5:03happen. But it could happen. But I'm
- 5:05just saying generally you guys are going
- 5:07to say no way to prove that he was 3 ft
- 5:09in front of you or or close to you.
- 5:12Sorry, we can't do anything.
- 5:13You're right. It is difficult to prove
- 5:15cuz I wasn't there to witness it. So
- 5:16that's what I wanted. It's your witness.
- 5:18I I understand that. But if you start a
- 5:21fight over something that happened out
- 5:23there, you're now to blame on that.
- 5:25I didn't start a fight. I just I'm just
- 5:27saying
- 5:28you said
- 5:29do I have a right to keep him to leave
- 5:30when I believe that he had a criminal uh
- 5:33traffic violation?
- 5:35Traffic is not criminal. It's an
- 5:37infraction. It's not criminal.
- 5:38But I don't have the right to keep him
- 5:39here.
- 5:40No, you call us and we we do that.
- 5:43Well, I did, but he was leaving.
- 5:46But you let him leave because
- 5:49it's not worth if if it starts getting
- 5:52physical, then what? I have to assume
- 5:54worst case situation.
- 5:56Then he goes to jail for hitting me.
- 5:58Unless you started and then you go to
- 5:59jail.
- 5:59I didn't hit him.
- 6:00So you already told me that you kind of
- 6:02he was trying to leave you and that
- 6:04right there kept him from leaving the
- 6:05car. But he was touching me also.
- 6:07Okay.
- 6:09I'm I'm only going off of what you've
- 6:11told me.
- 6:11I'm standing in front of the door and
- 6:12he's trying to push me through like this
- 6:14and I'm telling no, you're not leaving.
- 6:17So So
- 6:19ask him if he tried to leave when I was
- 6:20in front of the door. Okay. Go ahead.
- 6:22Hang hang tight. I get you're upset.
- 6:24You're directly involved. Emotions are
- 6:26high.
- 6:27What can we do about this kind of case
- 6:29where a teenage driver is being
- 6:31negligent and can kill somebody?
- 6:33There are people killed in Park City
- 6:36every year from negligent drivers. And
- 6:38I've been hit by a car twice already.
- 6:40Okay.
- 6:41Okay. So, yes, I'm very sensitive.
- 6:44Just ride my bike. I don't want any
- 6:45trouble. But when I
- 6:46Do you want me to let you vent or do you
- 6:48do you want want an answer to your
- 6:49question?
- 6:50I would like to know what you can do
- 6:51about this. Can I can I make a lodge a
- 6:54complaint?
- 6:54Absolutely. You already did.
- 6:56But you didn't. I'm here. But then what?
- 6:58You You come here. You get his license
- 7:00plate.
- 7:01Yeah.
- 7:01And you say, "Don't leave. I have the
- 7:03cops coming."
- 7:04Yeah.
- 7:04And if he leaves, so what? Because I
- 7:07will go find him.
- 7:08Okay.
- 7:09Okay. I know you don't believe that.
- 7:11But I didn't know that. But okay.
- 7:12I I told you I told you that just a
- 7:14minute ago, and you're like, "And I
- 7:15don't believe that
- 7:15time."
- 7:16Oh, okay.
- 7:17Okay. So that's the better way rather
- 7:19than coming here and adding to the
- 7:22situation.
- 7:23I didn't have his license plate. There's
- 7:25no way for me to get his license plate.
- 7:27You drove in here, right?
- 7:28Yes. But generally just drive off.
- 7:31Okay. Once once he drives off, there's
- 7:33You're right.
- 7:34I just want to admonish him for coming
- 7:36too close to me.
- 7:37Okay. Well, that's not your job.
- 7:40Okay. And I I know. And trust me, I feel
- 7:44you.
- 7:44You ride a bike?
- 7:45Absolutely.
- 7:46A road bike. Absolutely. I feel you when
- 7:49somebody almost hits you.
- 7:50Okay. Do you want to do you want to vent
- 7:51or do you want
- 7:52I'm just asking questions.
- 7:53I know. I'm trying. You ask me what do I
- 7:55do? And I'm I'm trying to tell you how
- 7:57we want you to handle it.
- 7:59Yes.
- 7:59Cuz I don't want to come out here and
- 8:01have a fight or worse a murder because
- 8:03he doesn't like your aggressive tone.
- 8:05We have a case in Wasatch right now
- 8:07about road rage where a guy is dead. Is
- 8:10it worth
- 8:11being a close call and you end up dead
- 8:13here because he does something? I'm not
- 8:15saying he's going to.
- 8:17That's the worst case that I come
- 8:18looking for.
- 8:19But let me ask you this.
- 8:20So, no, no, no, no, no, no. I want you
- 8:22to answer my question for a second.
- 8:23Yeah.
- 8:24Is that the Is is it worth it being dead
- 8:27over proving a point because you want to
- 8:28admonish him?
- 8:30Is it not worth being dead?
- 8:32I agree. But, however,
- 8:35are we going to just let people that
- 8:38have any kind of infraction, we call it
- 8:40an infraction, an infraction, just go
- 8:43and do it again unless somebody
- 8:46reprimands him or somebody
- 8:47Do you want me to arrest him?
- 8:49Can he be arrested?
- 8:50Do you want me to arrest you off his
- 8:52statement?
- 8:53No.
- 8:53You wouldn't appreciate that, right?
- 8:55No.
- 8:55So, we have to operate on evidence,
- 8:57right?
- 8:58And I get that it's very tricky.
- 8:59Well, he has evidence cuz he recorded
- 9:01it. I get it's and I'm gonna ask I
- 9:03haven't even talked to him yet
- 9:04because you were so worked up. I wanted
- 9:06to get his ID and then come over here
- 9:07and talk to you.
- 9:08Okay.
- 9:09Okay.
- 9:10I'm here to calm down.
- 9:12I'm here in the middle of this trying to
- 9:13sort it out and all you want me to do is
- 9:14arrest him and take him to jail.
- 9:16I want him I was hoping your word alone.
- 9:19Yeah. And I'd be willing to come to
- 9:21court and have somebody listen to my
- 9:23side and his side and decide.
- 9:25And there's a time and a place, but here
- 9:26in the parking lot's not the time or the
- 9:28place.
- 9:28Okay.
- 9:29Okay.
- 9:30Yeah. So, and I get that often times
- 9:32they just keep driving and you can't you
- 9:34can't get their license plate, but where
- 9:37you did
- 9:37Yeah.
- 9:38You saw them pull in here.
- 9:39Only times I've ever been able to catch
- 9:41somebody that has been unsafe.
- 9:43So, don't add fuel to the fire. The fire
- 9:47already happened and it's still burning
- 9:49and it's hot. It's in your heart and you
- 9:51want
- 9:52you want justice.
- 9:53My adrenaline's flowing. You know, I'm
- 9:56trembling because you know the police
- 9:58are here.
- 9:58Even if he leaves. Yeah.
- 10:02So be it. Had you Have you just let him
- 10:05He He parked. Cool. Typically, people go
- 10:07to a parking lot. They're not going
- 10:08anywhere for a minute.
- 10:11Ride in here. Remember which car it is.
- 10:13Let him go about his business.
- 10:16Okay.
- 10:16And get his plate and let us come here
- 10:17instead of we're on another domestic
- 10:20over here and then I get a report of a
- 10:22fight happening.
- 10:23Yeah. And so I have to now put my guys
- 10:26in in a very vulnerable state, leaving
- 10:28them in the middle of a potential fight
- 10:30to come to another potential fight that
- 10:32doesn't that doesn't necessarily need to
- 10:34be a fight.
- 10:36Okay.
- 10:36Okay.
- 10:37So, I want to tell you one more fact.
- 10:39Okay.
- 10:40When I went up to his window, he
- 10:41wouldn't roll his window down.
- 10:43I wouldn't either.
- 10:44Why not? I'm just knocking on the
- 10:46window. I want to talk to you. to know
- 10:48that I I just had an involvement with
- 10:51someone who I know is going to be
- 10:53unhappy with me.
- 10:54Yes. So then that's that's
- 10:55why why would I?
- 10:56Because that's what I'm saying is that
- 10:59is a tiny tiny piece of evidence that
- 11:03says that he knew that he did something
- 11:04wrong.
- 11:05No.
- 11:05If he wouldn't roll down the window,
- 11:06that doesn't count as evidence.
- 11:07It's not evidence, but it's an
- 11:09indication.
- 11:10So and and
- 11:11it's an inference. If someone just
- 11:13happens to walk
- 11:13circumstance,
- 11:16I I I get it. It's all-encompassing, but
- 11:19he's not he's not obligated. And I
- 11:21because he doesn't want to talk to you
- 11:23doesn't mean that he's guilty of all
- 11:25sorts of crimes. It means
- 11:29you you have already said that you're
- 11:31pretty worked up about it.
- 11:32I am.
- 11:33Is it fair to say you're probably worked
- 11:35up at his window?
- 11:36Yeah, because he wouldn't roll down his
- 11:38window. Why would you if someone comes
- 11:41to your door and is knocking on your
- 11:42door and you can see them visibly worked
- 11:44up? Are you going to open that door for
- 11:46them?
- 11:46I not the door, but I'd roll down my
- 11:48window.
- 11:49Okay.
- 11:49I have rolled down my window.
- 11:50Okay. I've watched people get punched
- 11:51for doing that.
- 11:52Really?
- 11:52Yeah. So, I don't fault him for
- 11:54Park City, but Okay.
- 11:57We're pretty safe here.
- 11:59Until someone's aggressive.
- 12:01Well, yeah, but
- 12:03Okay.
- 12:04We We got a guy dead over in Wasachford.
- 12:06I'm assuming the same thing.
- 12:08just roll down the window.
- 12:11Yeah.
- 12:12Well, why did
- 12:12that's not evidence.
- 12:14Sorry.
- 12:15Right. But but it it it's part of the
- 12:18situation. It's not evidence of the
- 12:19crime, but it's it's evidence for the
- 12:21fuel on the fire.
- 12:22Yeah.
- 12:24So, I don't I don't fault anyone for
- 12:26wanting to stay safe when when someone
- 12:28else is, no, I'm just going to sit here
- 12:29in my car. And it had you just said,
- 12:31"Cool, hang tight. I'm going to have the
- 12:33cops come." No, I'm going to leave.
- 12:35Cool. I got your plate number. They're
- 12:36going to come find you
- 12:37right away. He gets his phone out, then
- 12:39he says, "I recorded everything on my
- 12:41camcorder and I didn't come close to you
- 12:44and blah blah blah blah." So, I mean,
- 12:48yeah. Okay.
- 12:49Okay.
- 12:49You have any more questions?
- 12:51Hang tight for a second. Let me go talk
- 12:52to him, see what he's got.
- 12:54Um, and I'll I'll see if he'll share
- 12:57that dash cam with me if it exists. All
- 12:59right. Go ahead.
- 13:00But I I also don't want you
- 13:03communicating back and forth because it
- 13:04just, like I said, it amps things up.
- 13:06Okay. All right.
- 13:08He has my name. I'd like to have my
- 13:10name. His name.
- 13:12You can. We'll get that here in a
- 13:14minute. Did you give him your name?
- 13:15When I call the police, they asked for
- 13:17my name in here.
- 13:18Okay. That's That's fine. That He's not
- 13:22obligated to give his name to you. He's
- 13:24obligated to give it to me.
- 13:25Okay. Can you give it to me?
- 13:26I I will not give it to you cuz he's
- 13:28asked me not to.
- 13:29He did?
- 13:30Mhm.
- 13:30Why?
- 13:31Because you're so adamant about wanting
- 13:33his name.
- 13:34He doesn't want you to have it.
- 13:35Yeah. Okay. So it is it is a part of the
- 13:38report.
- 13:38So then I can later can I call the
- 13:42district attorney and press charges? Is
- 13:44this to press charges over?
- 13:47I know it's a small incident.
- 13:49Well, and and here's the thing.
- 13:51Yeah.
- 13:51People don't press charges. I don't
- 13:53press charges. Mhm.
- 13:54There is the law and I provide that
- 13:56information to the attorneys and then
- 13:58it's determined unless I make an arrest
- 14:01off of probable cause which just one
- 14:04side of the story very rarely is
- 14:06probable cause where there's no obvious
- 14:08injuries. No, it's it's your word that
- 14:10he was 3 ft versus
- 14:12he has a camcorder which he says he
- 14:13does. Let's look at it. You can look at
- 14:15it.
- 14:15Mhm. Absolutely. Go ahead.
- 14:17I already told you I was going to I was
- 14:18going to ask for it.
- 14:19Okay.
- 14:19So, it's you can request the report.
- 14:23Absolutely. And his name is part of that
- 14:25report.
- 14:25Oh, fantastic.
- 14:26But with that,
- 14:28you you can't reach out to him. You
- 14:29can't contact him. And it's
- 14:31if something happens, I want to know if
- 14:34something happens to my house or my car.
- 14:36Well, he's just as concerned.
- 14:38Yeah.
- 14:39Okay. It's It's a two-way street.
- 14:40Yeah. Check my police record. I don't
- 14:42know what his police records are.
- 14:44Well, I don't know either of you, so I'm
- 14:45going to treat you the same. So, I'm
- 14:47going to offer him the same respect that
- 14:49I've offered you.
- 14:50Thank you. confusing the situation.
- 14:53I'm not going to try and automatically
- 14:55throw everyone in cuffs,
- 14:57okay?
- 14:57Cuz that that doesn't make people
- 14:59cooperate together. All right? I I've
- 15:02learned that 20 years in this. It's
- 15:05easier when people are volunteering
- 15:07information than being forced to give
- 15:09information. Okay? So, give me just a
- 15:11minute. Let me go talk to him. Um, where
- 15:14exactly was it that he passed you
- 15:16by the buses? By the bus stop.
- 15:20All
- 15:26right, give me just a minute.
- 15:37Okay,
- 15:44it's a good phone number for you.
- 15:59So, walk me through what happened.
- 16:00Okay. Um, I was coming to the skate
- 16:04park.
- 16:04Mhm.
- 16:05And right at that bus stop area
- 16:08Mhm.
- 16:09Um, I was passing this gentleman
- 16:13Mhm. And from my understanding and by
- 16:17the looks of it, um, he was kind of
- 16:20stepping off of like I guess like kind
- 16:22of leaning.
- 16:24I don't really know how to explain it.
- 16:26It felt like as if he was like departing
- 16:28from his bicycle by like the crosswalk
- 16:30here. And so I felt like I had enough
- 16:34room to pass him. I have a dash cam as
- 16:36well. Um, and then I pull into this lot,
- 16:39park here, and I notice in like my
- 16:43rearview mirror, he's like biking next
- 16:45to me. I was like, "Oh, like, did I do
- 16:47something?" He like hits my window. He's
- 16:49like, "Roll down your window." And so I
- 16:52was like, "Okay, this might be a
- 16:54problem." So, I felt a little unsafe to
- 16:58start recording just not to like raise I
- 17:00guess um tension, but more so just to
- 17:03kind of like
- 17:04Hey, sorry it's like really blank.
- 17:05No, you're like if we go over here that
- 17:08way you're not staring into the sun.
- 17:10Okay, cool. So then uh I just start
- 17:12recording cuz I was like he already hit
- 17:14my window. I don't want him to like
- 17:15damage my property. And so I just start
- 17:18recording and I rolled out my window to
- 17:19talk to him and he's like telling me to
- 17:21get out and that I almost hit him and I
- 17:23said I'm sorry or I guess we'll see what
- 17:26I said in the video. I was like a little
- 17:28nervous. So then I was like he's like
- 17:31get out. And I was like I'm just trying
- 17:32to go skate and so I roll up my window.
- 17:34He like opens my door and then I'm just
- 17:36like dude. And then I was like stop. And
- 17:39then I try to close my door. He opens it
- 17:41again. I close it. He opens it one more
- 17:44time. And so I tried to stand up, but he
- 17:46put his hand on me, trying to like maybe
- 17:48like have me stay sitting down, but like
- 17:50leave the door open, but I stood up
- 17:52anyway. And then he's like pressing me
- 17:54into my car. And I was like, "Can I have
- 17:56some space, please?" And then he was
- 17:58talking like, "Did you like not see me
- 18:00over there? You were really close. Do
- 18:01you know the laws? Like 3 ft minimum."
- 18:04He's just very aggressive. Kind of like,
- 18:07"All right, let's like like I'm going to
- 18:10call the cops. I'm going to sue you for
- 18:12a lawsuit, get you arrested. I was like,
- 18:15"All right, I'm sorry."
- 18:18And I was like, I don't want to get
- 18:19physical. Like, but if I was like, can I
- 18:22have my space? And then he was like
- 18:24making sure my door was open and stuff.
- 18:26And I was like, can we like separate
- 18:28like some space here?
- 18:29And you do you have that all in
- 18:30recording?
- 18:30I have it on my phone. I can show you. I
- 18:32have it on my dash cam as well. If I
- 18:35could get both of those, that that'll
- 18:36help me kind of understand exactly what
- 18:39cuz he's saying you were on the other
- 18:40side. Just the second you pulled in, you
- 18:42were trying to leave.
- 18:43Okay. I mentioned I was going to skate.
- 18:46Um I don't know if you want to see it
- 18:47now, but I just basically have um the
- 18:52whole like altercation. Okay.
- 18:58Did you see me? Hold on to the side. I
- 19:01did. I had it on dash cam. Good. You see
- 19:05how close you came to me? You know what
- 19:06the line is? 3 ft [ __ ]
- 19:09I was.
- 19:09No, you weren't. You want to check your
- 19:11dash cam?
- 19:14Take it. What's your name?
- 19:16My name is John.
- 19:17Last name. I don't need that.
- 19:18What's your last name?
- 19:19You don't need my last name.
- 19:21I don't need I perfect.
- 19:24Okay. I'm going to call this.
- 19:26Why? I have it on dash cam. You fine?
- 19:29I'm going to go skate. No, you're not.
- 19:31Yes, I am.
- 19:33You're not You're not going anywhere.
- 19:35Please stop, dude. Stop. No. You're
- 19:38[ __ ]
- 19:40dude. Literally, stop. No. I'm calling
- 19:42the police. You're not leaving. You're
- 19:44not leaving. You're not leaving. Got his
- 19:47[ __ ] hands on
- 19:50the police. Look at this dude. What are
- 19:53you doing? Why you so crazy? Call the
- 19:57police. Why you so crazy? No, you're not
- 19:59going anywhere. I'm not going anywhere.
- 20:02I don't want to be aggressive with you,
- 20:03dude. And you already are. You pushed
- 20:05into me. I asked you to wait. You
- 20:07didn't. You did. How'd you get out of
- 20:09the car? You
- 20:11Yeah. I've got a very aggressive
- 20:13teenager here that almost hit me in the
- 20:15car and now he won't give me his last
- 20:17name. And now he's trying to leave.
- 20:21I'm in Park City near the Park City
- 20:24Park, but the skate park. He's in a
- 20:28Subaru.
- 20:30He's in a Subaru. Yeah, he's a license
- 20:32plate.
- 20:37The license plate is T953
- 20:41KG. And he's he's recording me because
- 20:45he's a jerk.
- 20:48And I want you to come and give this guy
- 20:50a ticket. I'll be going to testify in
- 20:52court against this guy.
- 20:57He came way too close to me.
- 21:00Huh? He came. He did not hit me. There's
- 21:04a law in in Utah that says you have to
- 21:06stay 3 ft from a cyclist. He did not. He
- 21:10just went right next to me. I wouldn't
- 21:12bother pulling over if this guy were not
- 21:15safe.
- 21:18Yes, I'm still on my bicycle. He's here.
- 21:21Gary Peacock, you you send a policeman
- 21:24for this guy right now.
- 21:26Okay. Thank you.
- 21:29Thank you. All right.
- 21:33Yes. He tried to leave. He tried. He
- 21:35said he was leaving. I said I was going
- 21:37to escape. He said you were leaving.
- 21:40Go ahead. Ran left and right pal. It's
- 21:43all on video. You tried to leave. You
- 21:45said I'm leaving. I said I'm going to
- 21:47escape. That's the same thing. I didn't
- 21:49say I'm leaving.
- 21:51So, could you please send a policeman?
- 21:53He's just being aggressive and uh
- 21:57obnoxious.
- 22:03Can you can you send that to me?
- 22:04Yeah.
- 22:05Either airdrop it to me or
- 22:08I would love to attach that.
- 22:10And then if there's some way I could get
- 22:13the uh the dash cam.
- 22:15Yeah. Incident.
- 22:16That's on a a SD card. So I have to run
- 22:19that to my laptop.
- 22:20Okay. So just whenever I get the chance
- 22:23to do that, I can do that for sure. And
- 22:25then is your air drop by?
- 22:28For some reason, it it defaults to uh
- 22:32only my contacts.
- 22:33Yeah, same with mine. I don't think
- 22:34there's a permanent setting to actually
- 22:36allow it to.
- 22:37I wish it would, but funny stuff happens
- 22:39that way.
- 22:41True, I guess. True. Okay, it should be
- 22:44on. Okay. Um,
- 22:54maybe if I Have you seen the new one
- 22:56where like if you go like this? No.
- 22:59Maybe mine's off.
- 23:01Oh, yeah. Mine's still on contact. Maybe
- 23:04if I
- 23:06Do you have a number I could text you?
- 23:08Oh, but it's 6 minutes long. Maybe
- 23:09that's the reason
- 23:11is because it's a very long.
- 23:12Let's do this. I will email you a link.
- 23:14Okay. Um, so you can upload that. Okay.
- 23:18And the dash cam direct to our case.
- 23:21Um, so I so I can have that. Is it Is
- 23:23there any way to view it before?
- 23:25I wish. It's kind of an older one
- 23:27though. So it's just like there's no
- 23:28like Bluetooth like phone link app for
- 23:31this one and it's something I need to
- 23:33probably upgrade to.
- 23:34Cool. If you want to hang tight right
- 23:36over here for a second.
- 23:37Yeah.
- 23:37Um,
- 23:39I'm going to get you guys' information
- 23:41put into the computer.
- 23:42Um, he's asked for your name. I said,
- 23:44"I'm not going to give it to you." He
- 23:45can request
- 23:47um a copy of the report and your name
- 23:49will be on it that way.
- 23:50So, it's potentially he could he could
- 23:52still have access to it, but
- 23:53he he's just upset that he gave his name
- 23:56and you got to hear it, but he didn't
- 23:57get yours. I explained you're not
- 24:00obligated to give your name to anyone
- 24:01but us.
- 24:02We have potentially a crime that
- 24:04occurred or an infraction. If you if you
- 24:06were too close to him, he says you are.
- 24:09he is eligible to basically sign this
- 24:12citation as a witness of the of the
- 24:14infraction. Um and I I um he wants a
- 24:18ticket issued. So I'm I will be giving
- 24:20you a ticket today. But instead of me
- 24:23saying, "Hey, I saw this h like if I
- 24:25caught you speeding, I'm the one I'm the
- 24:27witness of that."
- 24:28So it will be there will be a court date
- 24:31you can call and set up and then arrange
- 24:33to uh get that taken care of.
- 24:35Mhm. You'll get to share your side. That
- 24:38video evidence, I'm going to add it to
- 24:40the case and then he'll get to share his
- 24:42side. So, it's it's going both ways.
- 24:44Okay.
- 24:44In court.
- 24:45In court because Well, or you could just
- 24:48pay the ticket,
- 24:49right?
- 24:50That's that's that's the option.
- 24:51How much is this?
- 24:52I'm not certain. Okay.
- 24:53But, um let let me let me go get your
- 24:56information in there.
- 24:57All right. Sounds good.
- 24:58Um
- 24:59I'm going to issue him a citation for
- 25:01disorderly conduct as well.
- 25:02Okay. So, um, cuz he shouldn't be
- 25:05opening your door and then kind of
- 25:08pushing you, holding there.
- 25:11It's It's Yeah, it's going both ways.
- 25:13It is what it is. So, all right.
- 25:15You hang tight for a minute. All right.
- 25:16Sounds good.
- 25:26Thank you.
- 25:28Sign his citation that you were present
- 25:30for it. And then I'm going to issue one
- 25:33for disorderly conduct as well.
- 25:36So
- 25:36So if you'll just hang tight over on the
- 25:38sidewalk over there,
- 25:39then I won't I won't press charges.
- 25:41It's too late.
- 25:43Why am I getting up for what?
- 25:45Because you were aggressive to him.
- 25:47Yes, I was. But he was trying to leave.
- 25:50Okay, go wait over there. I'll explain
- 25:52it here in a second.
- 25:52Can't we just
- 25:53Nope.
- 25:54Oh, come on, man. I was the I was the
- 25:56victim here.
- 25:57All right, watch out. We can go a
- 25:59different way and you can be arrested
- 26:00for disorderly conduct.
- 26:02That's an arrestable offense.
- 26:03What's What kind of disorderly conduct
- 26:05is it?
- 26:06You opened his door three times. Okay.
- 26:09He doesn't have to get out of his car
- 26:10for you. He doesn't have to identify for
- 26:12you. You are not law enforcement. You
- 26:14don't get to come out here and enforce
- 26:16things. You call us and let us do it.
- 26:18He didn't say he was going to leave in
- 26:20his vehicle. He's like, "I'm here to
- 26:21skate. I'm going to go skate." He didn't
- 26:23believe he did anything wrong.
- 26:25He's going to provide me the dash cam.
- 26:27Okay.
- 26:27He showed me the recording and you were
- 26:29the aggressive one, not him.
- 26:31Yes. Because he
- 26:32Yes. And you don't get to be aggressive
- 26:33with people like that. That's
- 26:35disorderly.
- 26:36That's why you were getting a citation
- 26:37as well.
- 26:38Is it Why is it too late? What does it
- 26:40mean? What does it mean disorderly? Do I
- 26:42have to go to court for this?
- 26:45You're kidding me.
- 26:46Yeah. You're adamant that this and you
- 26:49were the one causing the the stir here.
- 26:52What if I apologize?
- 26:54It's too late. I've already seen the
- 26:55evidence. I am obligated.
- 26:57Oh, come on, man.
- 26:58Okay. So, if you'll wait over here on
- 27:00the sidewalk.
- 27:02You have got to be kidding me. This What
- 27:05can we do to resolve this? I mean, this
- 27:07is
- 27:07not act like that in the future is how
- 27:09we can
- 27:10I understand.
- 27:10And it's not going to fix today, but
- 27:12it's going to fix the future.
- 27:13I am going tomorrow.
- 27:15That's fantastic.
- 27:17I'm going to issue You're not going to
- 27:18jail. You're You're getting a citation,
- 27:20so you get to deal with it on your own
- 27:22time. You sort that out between you and
- 27:24the court. Is he coming to court?
- 27:26Yeah, cuz he's getting a ticket, too.
- 27:29What's he getting a ticket for?
- 27:31I'm going to give him a ticket.
- 27:32For what?
- 27:33For the violation that you swear up and
- 27:35down that he did on your word.
- 27:38Okay. What if we just
- 27:39Nope.
- 27:40What if we just resolve this?
- 27:41You asked for it over there. He showed
- 27:44me evidence. He's going to provide me
- 27:46the evidence of that. It's either going
- 27:48to substantiate it or discredit it. And
- 27:51his ticket may or may not go away based
- 27:53on that. Yours, however, I have evidence
- 27:55of.
- 27:57So you're I'm gonna have a Is this a
- 27:59misdemeanor?
- 28:01So I'm going to have a misdemeanor on my
- 28:03Yes. Because of your behavior.
- 28:05Because I got hot.
- 28:07Yes.
- 28:07And that's justifiable.
- 28:09Yes. Absolutely.
- 28:12Look,
- 28:13you don't get to demand people's names.
- 28:15You don't get to demand that they don't
- 28:17go anywhere.
- 28:18You don't get to open their door.
- 28:20I didn't open his door.
- 28:21You did three times. No, he was trying
- 28:23to close his door.
- 28:24He closed it because you kept opening
- 28:26it. I watched the video of it
- 28:27because I was talking to him.
- 28:29No, he you're not. He's under no
- 28:31obligation to you.
- 28:32I don't know.
- 28:33I get I You should know that.
- 28:35If he has
- 28:36Do I get to just come Do I get to just
- 28:38walk up to your door and start yelling
- 28:39at you?
- 28:40People do.
- 28:41Yeah, but you're not allowed to. That
- 28:43That's not That's disorderly conduct.
- 28:45That's absolutely disorderly.
- 28:48That's unreasonable argument. No,
- 28:50because you think you you have the right
- 28:52to do that and I'm here to protect his
- 28:54rights as much as I'm here to protect
- 28:55your rights.
- 28:56Angry,
- 28:56which Yes.
- 28:57But you could
- 28:58you need to control your temper at that
- 29:00point.
- 29:00I understand.
- 29:01Okay.
- 29:02So, we can drag this out and we can keep
- 29:04arguing or I can get to work, get you a
- 29:07ticket, and get you on your ride.
- 29:08What if we both agree that neither one
- 29:10of us wants a ticket?
- 29:12At this point, I've seen what I've seen.
- 29:14I've seen the evidence. You were adamant
- 29:16that you asked for a ticket and now
- 29:18because you're getting one, you want him
- 29:19to get out of it,
- 29:20right?
- 29:21No, you're both getting one today.
- 29:22Okay. So, if you'll just wait over on
- 29:24the sidewalk
- 29:44descend
- 30:02Okay. Operated a motor vehicle near
- 30:04vulnerable user or vehicle. That's you.
- 30:08Um he's getting infraction.
- 30:10That's his infraction.
- 30:11That is the infraction. That's the
- 30:13charge. That's the level.
- 30:14This is the This is the thing.
- 30:15Yep.
- 30:15So I have you there listed as the
- 30:17complaintant. If you'll sign it right at
- 30:19the bottom just down at the bottom
- 30:23right here.
- 30:23Yep. This whole thing is getting
- 30:25submitted.
- 30:28Did you look at his camcorder?
- 30:30Uh, it needs a a laptop to get to. He's
- 30:32going to provide it to me and we're
- 30:34going to follow up on that.
- 30:34How do I follow up on this?
- 30:36So, you can reach out to the court or
- 30:38sorry, reach out to the the police
- 30:40department and request a copy of the
- 30:42report.
- 30:42Yeah. Um or and I'll here let me just
- 30:47get you yours now and I can explain all
- 30:51of that.
- 30:55Okay. Disorderly conduct.
- 30:56All right. As I explained earlier, you
- 30:59opened his door multiple times. He's
- 31:00trying to shut it. He didn't want to
- 31:02roll. He He doesn't want anything to do
- 31:04with you. I get that what happened over
- 31:07here.
- 31:08He wasn't trying to leave. He was trying
- 31:10to go skate.
- 31:10That's leading that
- 31:13the way.
- 31:13How do I know that's the case?
- 31:15Cuz it's not your job to worry about
- 31:17that.
- 31:17It's my worry. It's my job to make sure
- 31:20that somebody that has an infraction
- 31:22stays here so you can arrive.
- 31:24Okay.
- 31:24I do believe that I have a right to do
- 31:26that. You say I don't, but I think I do.
- 31:28You don't get to detain people.
- 31:31All right.
- 31:32He drove near you. You got the license
- 31:35plate number. Then you started opening
- 31:38his door demanding his name. Yeah.
- 31:40Because he wouldn't give me his last
- 31:42name. Yes.
- 31:42He doesn't have to. He's not obligated.
- 31:44He was leaving.
- 31:45He said, "I'm here to skate."
- 31:46And you said, "No, you're not."
- 31:49I watched the video. I know. Okay.
- 31:51So, that's why you're being charged with
- 31:52this. Okay. Phone number for the courts
- 31:54right there.
- 31:54Okay.
- 31:55Give them a couple days.
- 31:56Is this a fine or
- 31:58what? What is it?
- 31:59This is a ticket.
- 32:00A ticket?
- 32:02It's an infraction.
- 32:03Is it a traffic ticket?
- 32:05No, it is a noncrim It's a non-tra

- 33:25edit videos. So, like as
- 33:27So, sending a video is not going to be a
- 33:29big deal for you.
- 33:29Yeah. I can like decompress it into a
- 33:31smaller file and make it go like I guess
- 33:33your email or whatever. the I'm I'm I'm
- 33:35going to give you a link to the case and

- 34:20you never know with technology.
- 34:22Yeah. And so when I call that number,
- 34:24that's just to
- 34:27um what do I do when I call the number?
- 34:30Yeah. So if you just want to pay it, You
- 34:33can pay it over the phone if you want to

- 35:14Kudos to you and for not antagonizing
- 35:17him anymore. He was antagonized already.
- 35:20You You stayed calm. At his age, he

- 35:26Yeah.
- 35:26Hey, man. You were too close to me. Oh,
- 35:28I'm sorry. I didn't realize it. Look,
- 35:30I've got video. I'm happy to share it
- 35:31with you. I don't think I was that

- 35:58You don't get the, "No, I feel I have a
- 36:00right." I'm like, "Well, you're wrong."

- 36:04like that
- 36:06because someone did something over
- 36:08there. You come over and act like this.
