- 0:10james bain was only 19 years old
- 0:13when he was convicted of raping and
- 0:16kidnapping
- 0:17a nine-year-old boy in florida and then
- 0:20sentenced to life in prison
- 0:21for the crime that he did not commit
- 0:25it wasn't until 35 years later when he
- 0:27was finally found innocent and set free
- 0:36on march 4th 1974 in lake wales florida
- 0:40a nine-year-old boy was kidnapped from
- 0:42his home through a window
- 0:47the attacker dragged the boy to a nearby
- 0:50baseball field
- 0:51where he was then sexually assaulted
- 1:26the boy returned home and only a white
- 1:28shirt and his underwear
- 1:31the attacker was described as having a
- 1:34mustache and bushy sideburns
- 1:36and was known as jimmy
- 1:41after hearing the description the family
- 1:43member of the nine-year-old boy
- 1:46thought the description would match
- 1:48james bain who he had known for many
- 1:52years
- 2:04the police showed up at baines's house
- 2:07that night
- 2:08but baines claimed that he had been home
- 2:10watching tv since 10 30 with his sister
- 2:13but despite having an alibi he was still
- 2:15arrested
- 2:21after the victim gave the description
- 2:23and his family member was convinced it
- 2:25was james bane
- 2:26that got into the boy's head that it was
- 2:28too
- 2:29when a photo was in line with four
- 2:31others for the witness to identify
- 2:33james baine's photo was the only one
- 2:35with sideburns
- 2:37the police also suggested and borderline
- 2:39instructed him
- 2:40to pick out bain's photo instead of
- 2:43asking him to pick out the photo
- 2:45of his own
- 2:52when the underwear the boy was found
- 2:54wearing after the attack
- 2:57was sent to the lab for a serology test
- 3:00it confirmed that the attacker left a
- 3:02semen sample
- 3:03the fbi analysis testified that the
- 3:06semen
- 3:07was of the blood group b but james bain
- 3:10was blood a b
- 3:12then they testified that he had a weak a
- 3:15which has since been proven wrong
- 3:24the crime occurred in march and by the
- 3:26beginning of may the trial had started
- 3:28by the end of may the trial had ended
- 3:32and james bain was sentenced to life in
- 3:34prison
- 3:43in 2001 fame seeked for further testing
- 3:46of the evidence
- 3:47but it wasn't until 2005 when the
- 3:50innocence project
- 3:51picked up his case and found
- 3:54any success
- 3:58in 2009 dna testing showed no match to
- 4:01james bain
- 4:02at the crime he was finally released on
- 4:06december 17
- 4:072009 35 years later
- 4:17a man walks free after 35 years behind
- 4:19bars for a crime
- 4:20he didn't commit dna evidence cleared

- 4:44convicted and sentenced
- 4:45it was the same month that president
- 4:46richard nixon resigned and gerald ford
- 4:48moved into the white house
- 4:50in fact jamie baine has been in prison
- 4:52so long he's gone from a teenager
- 4:54to an aarp member before winning his
- 4:56freedom
- 4:58you are a free man congratulations
- 5:02with those words jamie baine knew he was
- 5:04headed to a new phase of his life
- 5:06one as a free man after spending 35
- 5:09years behind bars
- 5:10wrongly convicted of the rape of a
- 5:12nine-year-old boy in 1974.
- 5:14and uh have you thought about what you

- 5:26this case
- 5:27led to bain's free
- 5:39james bain served a total of 35 years in
- 5:42prison
- 5:42missing the prime years of his life all
- 5:45due to witness misidentification
- 5:47including family and police peer
- 5:49pressures
- 5:50and faulty and lacking lab analysis that
- 5:54wasn't up to current advancements

- 6:19and raping a nine-year-old boy
- 6:21he was freed by modern technology dna
- 6:24evidence that proved
- 6:25he couldn't have done it i know from the
- 6:27moment they
- 6:28took the test on me it's going to do one
- 6:30of the two lock me or free me
- 6:33james bain becomes the 248th inmate
- 6:36freed nationwide
- 6:37by dna evidence hallelujah it's not a
- 6:40sign that the system worked
- 6:42that's a sign that the system is in many
- 6:44ways broken
- 6:45and absolutely has to be remedied bane
- 6:48had been convicted solely on the
- 6:49eyewitness testimony of the young victim
- 6:51who defense lawyers said was steered by
- 6:53police to pick bain out of a lineup
- 6:56the james bond case tells us that we get
- 6:58it better get serious about
- 7:00eyewitness identification reform it's
- 7:02the single greatest cause of the
- 7:04conviction of the innocent
- 7:05florida law grants former inmates found
- 7:07innocent 50
- 7:08000 for each year they spend in prison
- 7:11that means james baine is entitled to
- 7:131.75 million dollars
- 7:16well i i can't even imagine that type of
- 7:18money right now
- 7:19my family is the only thing i can
- 7:20imagine at this moment
- 7:22the first thing he did as a free man was
- 7:24call his mother
