  1. 0:07Hello everyone. In this video, we are
  2. 0:10going to study training contracts. The
  3. 0:12goal of these contracts is for workers
  4. 0:15to acquire the training or experience
  5. 0:17necessary to perform a profession.
  6. 0:21There are two types: the work-study
  7. 0:23training contract and the professional
  8. 0:25practice contract. The work-study
  9. 0:29training contract aims to combine paid
  10. 0:33employment with educational processes
  11. 0:37in vocational training, university
  12. 0:40studies, or professional certifications
  13. 0:44. Recipients of this contract must not
  14. 0:47possess a professional qualification
  15. 0:49recognized by degrees or certificates
  16. 0:52that would allow for a professional
  17. 0:54practice contract. A contract we will
  18. 0:57study later in this video. Also, a
  19. 1:00work-study contract cannot be signed
  20. 1:03with workers who have held the same job
  21. 1:05at the same company for more than 6
  22. 1:08months. If the contract is signed for
  23. 1:12obtaining level one or two professional
  24. 1:14certificates, the hired individuals
  25. 1:16cannot be over 30 years old. The
  26. 1:19minimum duration of this contract is 3
  27. 1:21months, and the maximum is 2 years. If
  28. 1:25the contract is agreed upon for less
  29. 1:27than 2 years, it can be carried out as
  30. 1:29a single contract intermittently over
  31. 1:32several years to coincide with studies.
  32. 1:36In other words, if the associated
  33. 1:38studies have vacation periods, the
  34. 1:40contract can be interrupted during
  35. 1:42those times without needing to sign a
  36. 1:44new one upon resuming. If the
  37. 1:47employment contract was set for a
  38. 1:49duration shorter than the legal maximum
  39. 1:52, and the related degree was not
  40. 1:54obtained, it can be extended until that
  41. 1:56degree is reached, never exceeding 2
  42. 1:59years. In the event of temporary
  43. 2:02disability, birth, adoption, foster
  44. 2:04care, risk during pregnancy or
  45. 2:06breastfeeding, or gender-based violence
  46. 2:08, the contract duration count is
  47. 2:10interrupted. This type of contract
  48. 2:14combines work attendance with training
  49. 2:16related to that job. During the first
  50. 2:20year of the contract, working time
  51. 2:22cannot exceed 65%of a full-time
  52. 2:23schedule, and during the second year,
  53. 2:26it cannot exceed 85%. Individuals hired
  54. 2:30under this modality are prohibited from
  55. 2:33working overtime, except to prevent or
  56. 2:35address accidents. They are also
  57. 2:38prohibited from working night shifts,
  58. 2:40unless the nature of the activity
  59. 2:42cannot be carried out during any other
  60. 2:44time. Remuneration will be that
  61. 2:46established in the collective
  62. 2:47bargaining agreement for this type of
  63. 2:48contract. If not specified in the
  64. 2:51collective bargaining agreement, it
  65. 2:53cannot be less than 60%of that set for
  66. 2:55their professional group in proportion
  67. 2:58to time worked during the first year
  68. 3:00and 75%during the second. And in no
  69. 3:03case may it be lower than the minimum
  70. 3:04interprofessional wage in proportion to
  71. 3:06the time worked. The second type of
  72. 3:09training contract is the contract for
  73. 3:11the acquisition of professional
  74. 3:12practice. The purpose of this contract
  75. 3:15is to facilitate access to employment,
  76. 3:17thus allowing them to acquire
  77. 3:19professional experience suitable to
  78. 3:20their level of studies. For those who
  79. 3:24have earned a professional degree, this
  80. 3:27type of contract can be offered to
  81. 3:30workers holding a vocational,
  82. 3:32university, or professional certificate
  83. 3:35, provided the work relates to their
  84. 3:38studies. Furthermore, to use this type
  85. 3:42of contract, the degree must have been
  86. 3:44obtained within the last 3 years. This
  87. 3:47period is extended to 5 years for
  88. 3:49workers with disabilities. The contract
  89. 3:53for professional practice shall have a
  90. 3:55minimum duration of 6 months and a
  91. 3:57maximum of one year, and one cannot be
  92. 3:59hired under this modality in the same
  93. 4:01or a different company with the same
  94. 4:03degree for more than a year. This means
  95. 4:07that if a worker has been hired under
  96. 4:09this type of contract by one company
  97. 4:11for 6 months and is later hired by
  98. 4:13another, they can only be hired for
  99. 4:15another 6 months under a professional
  100. 4:17practice contract. Nor can they be
  101. 4:21hired for more than a year under this
  102. 4:23type of contract at the same company to
  103. 4:26fill the same position, even if it
  104. 4:28involves a different degree. There is
  105. 4:31no maximum duration for these types of
  106. 4:33contracts if they are entered into with
  107. 4:34disabled persons or those at risk of
  108. 4:36social exclusion. Leave for temporary
  109. 4:39disability, birth, adoption, risk
  110. 4:41during pregnancy or breastfeeding, or
  111. 4:43gender-based violence interrupts the
  112. 4:45maximum duration of this contract. The
  113. 4:47remuneration shall be that set in the
  114. 4:49applicable collective bargaining
  115. 4:50agreement for these types of contracts.
  116. 4:52If not established in the agreement, it
  117. 4:54will be that of the corresponding
  118. 4:56professional group, and in no case may
  119. 4:58it be lower than the minimum
  120. 5:00interprofessional wage. The trial
  121. 5:02period established in this type of
  122. 5:04contract may not exceed one month. I
  123. 5:08hope you found this video tutorial
  124. 5:10interesting. Best regards and see you
  125. 5:12soon.
