- 1:18you know our podcast basically what we
- 1:20do is we shed light on individuals who
- 1:22was incarcerated before
- 1:24and when after their incarceration what
- 1:27they're doing now to help their
- 1:28communities with that being said you
- 1:30know we're going to start this interview
- 1:32with mr bush we appreciate all the
- 1:34listeners for speaking through the
- 1:35problem to tune in because this is a
- 1:37good episode and bring a whole nother
- 1:39dynamic to our podcast welcome to

- 1:44your name where you from and a little
- 1:45bit about yourself
- 1:47my name is derek hamilton again my name
- 1:51is derek hamilton i'm from brooklyn the
- 1:53better establishment section lafayette
- 1:55gardens housing projects
- 1:57i spent over 30 years incarcerated
- 2:00throughout new york state correctional
- 2:02facilities
- 2:03uh
- 2:04from a young kid
- 2:06about 17 years old i was charged with
- 2:08murder
- 2:09i went to prison
- 2:11and i had to become accumulated with the
- 2:13law library to learn a criminal justice
- 2:16system that would unjustly prosecute me
- 2:19for a crime i did not commit
- 2:21so from that time into the present i've
- 2:23been engaged in
- 2:25uh fighting the legal system that have
- 2:27been
- 2:28uh unjust to blacks and hispanics
- 2:30underprivileged people
- 2:32and i've just been trying to level the
- 2:33playing field for people look like you
- 2:35and me so they're in a nutshell you know
- 2:37i got an organization
- 2:39uh called family and friends of the
- 2:40world be convicted
- 2:41we try our best
- 2:44to help people out that's
- 2:45underprivileged man to get them out of
- 2:46jail or to get them to just do in any
- 2:49facets of the criminal justice system
- 2:51uh and that's just who i am man i'm just
- 2:53a soldier for the people around the
- 2:55street soldier that fight all levels of
- 2:58government land and let them know that
- 3:00you know you and i need to be
- 3:01represented in a way that when the white
- 3:03america is represented so i just did my
- 3:06best to look at the plan for that
- 3:07regards
- 3:09all right all right all right so you
- 3:11know growing up in brooklyn at a young
- 3:13age and being charged with a murder like
- 3:16what was your mentality when you first
- 3:17got incarcerated
- 3:20well you got to remember i was
- 3:21adolescent i was 17 years old so you
- 3:23know i was running around robbing people
- 3:25man and and you know i was doing a young
- 3:2717 years old didn't like the zone
- 3:30cutting people man you know and and and
- 3:32being caught up in the system that was
- 3:34abusing us so we in return was abusing
- 3:37each other i mean correction officers
- 3:39was beating us up at a young age
- 3:41and we were just young
- 3:43you know adolescents men young kids
- 3:45ignorant
- 3:46uh and just doing what the young kids
- 3:48did when they when they when they
- 3:50treated like animals
- 3:51but it was a lawyer
- 3:53who kind of like hit me and said young
- 3:55man
- 3:56like get your head out of your ass man
- 3:57these people are trying to well you like
- 4:00they're about to give you life in jail
- 4:02and i know you didn't commit this crime
- 4:03like you better wake up man and she gave
- 4:05me two cases
- 4:07to study
- 4:08and i studied those cases and i
- 4:10understood what they was actually doing
- 4:11to me and it kind of like changed my
- 4:14whole outlook on what was more important
- 4:16than me uh did i want to be you know in
- 4:18prison running around trying to get a
- 4:20reputation
- 4:21or you know did i want to get out of
- 4:23jail one day all my friends was getting
- 4:24two to six years of booking you know it
- 4:26was y'all
- 4:27and he was getting another shot i didn't
- 4:28have that other shot but growing up in
- 4:30brooklyn it was you know it was brooklyn
- 4:32it was it was 8 19 81 82 83
- 4:36uh you know and it was neighborhoods
- 4:38against neighborhoods as it is today
- 4:41but uh it was just a whole different
- 4:42dynamic because you didn't have all the
- 4:45resources that was just today so it was
- 4:47violent um you know you had to hold your
- 4:49own and and you had to meet south if it
- 4:51wasn't tough you'd be taking manager
- 4:53that's just the way it was how much did
- 4:56you know about jurisprudence when you
- 4:58first got incarcerated
- 5:01i knew absolutely nothing about jewish
- 5:04people i i was i didn't even have a gd
- 5:07or high school diploma but i was i knew
- 5:09nothing i had a good reading
- 5:10comprehension i knew absolutely nothing
- 5:13about love nothing
- 5:15all right yeah i understand man because
- 5:17me myself i studied law like very heavy
- 5:19man and i didn't know nothing when i
- 5:22first when i first came in the 10th
- 5:24century so i understand how dedicated
- 5:26you got to be in order to learn
- 5:27jurisprudence
- 5:28but you want you like you on the other
- 5:30hand you know you help others fight
- 5:32their case and you still was fighting
- 5:33your case at the same time
- 5:35like
- 5:36knowing what you know now like how
- 5:38dedicated did you have to be in order to
- 5:40learn everything you know
- 5:42well i mean you have to study every
- 5:44single day
- 5:46i mean to learn that i know there's no
- 5:48breaks and studying
- 5:49when people was going outside playing
- 5:51basketball or going to the yard to tell
- 5:54royal stories i was in the cell reading
- 5:56criminal procedure laws and rules of
- 5:57evidence and things of that nature
- 5:59because i knew
- 6:01that i had to be the smartest person
- 6:02i've ever got back in that courtroom
- 6:04i knew that i couldn't depend on
- 6:07somebody else to speak up for me and
- 6:09articulate things in the manner in which
- 6:11i had to articulate it in order to be
- 6:13free so i mean it's a dedication it's a
- 6:16sacrifice
- 6:19you're speaking up kind of the google
- 6:20again man and um i would like to start
- 6:23with the present moment also as far as
- 6:26your affiliation with the innocent
- 6:28project and with the crew movement the
- 6:30criminal review unit
- 6:32um listeners please like pay attention
- 6:35to what we're listening to today what
- 6:36this man is saying i'm sure we oh i'm
- 6:38not the only fan of the tv show for life
- 6:42mr derek hamilton's story is just as
- 6:44inspiring if not more respectfully i'm
- 6:47saying so
- 6:49please like let us know all your
- 6:51affiliation with the innocent project
- 6:54and with the
- 6:55criminal review unit please
- 6:58so
- 6:58i was paroled
- 7:01i was enrolled in 2011
- 7:03uh from auburn corrections facility
- 7:06when i left prison i had a mandate
- 7:09of the brothers who i was in the law
- 7:11library with every day
- 7:13like myself
- 7:15were fighting their convictions were
- 7:17pledging their innocence
- 7:18and they felt as if the brooklyn va
- 7:21charles hines wasn't giving us
- 7:24a good enough shake
- 7:25uh prior to getting out we already have
- 7:27again all the lines in our families and
- 7:30having them go down to city hall with
- 7:33lonnie sorry our pr director and a few
- 7:35others to protest against
- 7:38being just uh
- 7:40conditions in which we were living in
- 7:42number one but more than anything the
- 7:44unjust way that the criminal justice
- 7:46system was treating us they were
- 7:47throwing our emotions in the garbage it
- 7:49wasn't looking at the evidence it was
- 7:51just disregarding the facts that proved
- 7:54that some of us was innocent some of us
- 7:56unconstitutionally convicted
- 7:58it just didn't care
- 7:59so when i got out in 2011 i began
- 8:02joining
- 8:03others who was disgruntled with charles
- 8:06hines and we began
- 8:08orchestrating
- 8:09a strategic movement to remove them from
- 8:11office
- 8:12against all the naysayers that said we
- 8:14couldn't get rid of were incumbent but
- 8:16it would never happen we were successful
- 8:19in getting rid of charles hines and
- 8:21elected a new d.a ken thompson into
- 8:24office
- 8:25and one of the mandates we had to ken
- 8:27thompson when he got in office was that
- 8:30he would
- 8:31put a criminal review unit together that
- 8:33he would put together a unit that would
- 8:36review the wrongful convictions that was
- 8:38in brooklyn and we had to listen to them
- 8:40uh and we asked
- 8:42his promise that once he get in he would
- 8:45do that and one of the
- 8:46cheap people was a guy by the name of
- 8:48dave george
- 8:49who was running against ken thompson and
- 8:52charles hines who helped put this unit
- 8:55together who helped make sure that the
- 8:57bridge was got and they would keep their
- 8:59word
- 9:00uh in april of the year that ken
- 9:02thompson was elected
- 9:04uh they didn't have a unit together by
- 9:06them he went out to city hall again and
- 9:08protested against him and made him put
- 9:10the unit together and he began
- 9:12exonerating people within two years he
- 9:14has dominated about 22 people in this
- 9:17unit me being one
- 9:18uh and he he admitted as a prosecutor
- 9:21that there was a systemic racist problem
- 9:24with the office and how he was treating
- 9:26blacks on the spot
- 9:27and he went on to
- 9:29you know change the dynamics in the way
- 9:31that we were receiving justice in the
- 9:33brooklyn da's office
- 9:34unfortunately he had cancer and he died
- 9:37within the two years women's family and
- 9:39was never able to finish his work as you
- 9:42know a different type of prosecutor from
- 9:44brooklyn
- 9:46but from his actions we knew
- 9:48that
- 9:49a prosecutor who was fed
- 9:52can change the whole denial of the
- 9:54criminal justice system that we once
- 9:55knew it
- 9:56and we had that
- 9:58motto to follow
- 10:00and so we made sure that when melinda
- 10:02cash was running in queens we sat down
- 10:03with her and said look you need to put
- 10:05this model together and she did it and
- 10:07since she's been here a few years
- 10:09they've been struggling raising my
- 10:10office
- 10:11um you know we have more discussions
- 10:13with
- 10:14alvin bragg in manhattan right now whose
- 10:16pledge and promise to the unit together
- 10:18the same way so the manhattan to keep
- 10:20that type of justice
- 10:22uh my work with the innocent project has
- 10:23been primarily in legislative actions we
- 10:26work together to change the way that
- 10:28identifications have been held in
- 10:30precepts that the cop will let you no
- 10:32longer know that you're going to be in
- 10:34the lineup so he can't tell the victim
- 10:36pick out number two or three or
- 10:38suggestion about pointing you out or
- 10:39anything of that nature uh we also
- 10:41changed the way that interrogations were
- 10:43being conducted
- 10:44that you know cops can no longer just
- 10:46interrogate you uh doing a portion of
- 10:48your video recording and nobody knows
- 10:51what happened prior to that whether they
- 10:52beat you up whether they lie to you
- 10:54whether they promise you the world or
- 10:56whatever prior to you getting on that
- 10:58video taking profession uh we also
- 11:00changed the discovery layers
- 11:02uh how the prosecutor now was a day
- 11:04wrapping it back but not to turn over
- 11:07all the discovery materials so they
- 11:08can't hide no more you need to know
- 11:10everything that's happening with your
- 11:11case any video any document that is this
- 11:14your lawyer should have so you should be
- 11:15able to mount your defense
- 11:18previously they was holding it to the
- 11:19last moment giving it to you in an evil
- 11:21trial when you know you didn't have the
- 11:22time to investigate or prepare for trial
- 11:25so my work with the innocence project
- 11:26has been primarily in that regards at
- 11:29present we're working on
- 11:31changing the way
- 11:32that cops interrogate
- 11:34uh juveniles right the law by the
- 11:37supreme court so they can lie to you
- 11:38when they interrogate you they can tell
- 11:40you they got your dna they can tell they
- 11:42got you on video they can tell you
- 11:43whatever they need to tell you to get
- 11:44you to confess
- 11:46we're working to change that so crops
- 11:47getting around a lot and to see people
- 11:49doing the interrogation process
- 11:51so that's my advantage project in
- 11:54nutshell we do a lot of legislative
- 11:55action
- 11:56uh sometimes i call them
- 11:58when prosecutors are being pig-headed
- 12:00and don't want to listen we actually
- 12:02join in and try to speak reason for
- 12:04prosecutors
- 12:05and things of that nature
- 12:08okay okay okay that's right that's right
- 12:10appreciate you brother appreciate you a
- 12:13lot now
- 12:14um
- 12:16i've seen you on tv i've seen you with
- 12:18the black hat on awfully convicted i've
- 12:21seen you in the courtroom
- 12:22when john bond got exonerated
- 12:25um
- 12:26and i'm like wow look at bush you know
- 12:27that's my judge george simpson you know
- 12:30and um
- 12:32like
- 12:34you open the doors exposing detectives
- 12:36call
- 12:39you know it's like
- 12:41once once once you came down in a
- 12:43reversal and once you got your case
- 12:45straight kids like a whole bunch of
- 12:46brothers also started coming down that
- 12:48was arrested and wrongfully convicted by
- 12:50that man
- 12:51you know and he he's like nothing right
- 12:53now with his tension and everything
- 12:56you know how do you feel about that
- 12:59well
- 13:00you know i feel that the system races as
- 13:02it is
- 13:03was about to
- 13:06release when they released john rancho
- 13:08david ramsey let me get the name right
- 13:10david ranta a white guy who was
- 13:12convicted of killing a jewish robot
- 13:15a scarcella victim
- 13:17and once they released to david lanter
- 13:18he was going to be quiet
- 13:20about all the blacks and the spanish
- 13:22that was subjected to the same type of
- 13:24criminality by this cop
- 13:26um
- 13:27fortunately for me
- 13:28i was working on another case julio
- 13:30acevedo's case
- 13:32uh and the new york times reporter had
- 13:34asked me
- 13:35why would julio be afraid of the cops
- 13:38and i was in a position to say that the
- 13:40cops are corrupt and i said in two weeks
- 13:42you're going to see exaggeration by god
- 13:44i didn't know david ran the name at that
- 13:46time because lawyer had called me
- 13:48but he wouldn't tell me his name but he
- 13:50told me that it was going to release his
- 13:52car selling guy but they didn't want to
- 13:53overturn my conviction that he don't
- 13:55understand why i had no evidence of
- 13:57anybody but they just was pig-headed
- 13:59when it came to me so when i shared this
- 14:02information
- 14:03with the new york times reporter she
- 14:05agreed to do an investigation
- 14:07and based on her investigation francis
- 14:09rivers in the name
- 14:11the d.a at that time charles hines
- 14:14agreed to look at 50 of these scarcely
- 14:16cases
- 14:18um and that opened the door for all the
- 14:20brothers
- 14:21who couldn't get their cases heard
- 14:23and simultaneously by the time that that
- 14:25happened the television for the first
- 14:28time in new york history had overturned
- 14:30my conviction
- 14:31and ruled that an innocent person in new
- 14:34york can come before
- 14:36on a post-eviction motion 440.10
- 14:39and argue a claim of actual innocence so
- 14:42that was very important because prior to
- 14:44this case coming out my case
- 14:46courts were procedurally barring you
- 14:48they were saying well you should have
- 14:49read this before or you could have read
- 14:51this before we don't want to hear it
- 14:52don't come in here now with this claim
- 14:55saying you're innocent when you should
- 14:56have took it on a pill or you could have
- 14:58raised any previous motion
- 15:00uh the television and people was in
- 15:01hamilton changed that uh they said that
- 15:04if you have a primary phase of evidence
- 15:06of innocence or the court must give you
- 15:08a hearing and that in itself the doors
- 15:11with so many dudes who couldn't get in
- 15:12the court previously
- 15:15um
- 15:16right that's right that's right that's
- 15:17right you see you've been you've been in
- 15:19the you've been in so many battles with
- 15:21these people in these court homes i
- 15:23don't need me personally growing up in
- 15:25brooklyn here in your name
- 15:27you know coming to jail since i was 18
- 15:29years old as a child too this is my
- 15:30second statement
- 15:32i did 13 straight on the first one i got
- 15:34seven in down on the second one
- 15:37i don't even feel like calling you bush
- 15:38anymore you know i feel like
- 15:42you i have to call you derek hamilton
- 15:44now you know i got old i print out your
- 15:46cases when i'm in special housing unh i
- 15:49i look to you for for strength i'm
- 15:51saying i read your cases and
- 15:55you've been
- 15:56convicted not once but twice
- 15:59and was sentenced for life sentences
- 16:00correct
- 16:01absolutely absolutely
- 16:04all right moving forward um
- 16:08me and mr clean um
- 16:11look up to you you inspire us a lot you
- 16:13know we always have a little live
- 16:14therapy we both have our appeals in
- 16:18and
- 16:19you know
- 16:20i just appreciate having a brother like
- 16:22you on the outside you know what i'm
- 16:24saying that we could look up to
- 16:26and say well you know
- 16:28he's he's been through worse than what
- 16:30we're going through right now
- 16:32you know
- 16:33and um i've seen that brothers like toby
- 16:36came home and cardi came home and
- 16:38chewbacca came home and hook came home
- 16:41and mel was getting ready to come home
- 16:43soon so congratulations on mel also
- 16:47helping mail out
- 16:49um
- 16:50i would like to ask you like
- 16:53what advice would you give to a brother
- 16:55or sister that's actually appealing a
- 16:57conviction right now or to a person even
- 16:59in the street right now fighting a case
- 17:02well the first thing i would say is
- 17:05don't trust
- 17:06your adversary um don't trust
- 17:09your lawyer um don't trust anybody
- 17:13um you got to understand that
- 17:15the system is designed to railroad us
- 17:18right and don't repeat that the system
- 17:19is designed to railroad us so when you
- 17:22know
- 17:23that a system is operating to get to a
- 17:26dysfunction when it comes to you you got
- 17:28to go in with a distrust right we have
- 17:30to trust them we listen to lawyers uh we
- 17:33believe what they say
- 17:34uh when a lyme prosecutor that person
- 17:38that comes into court and being unjust
- 17:40to you
- 17:41uh when they're not being fair your
- 17:43lawyer has an obligation and a duty to
- 17:46go to their bosses obligation to go
- 17:48upstairs and say look this is not fair
- 17:51a lot of times you are discriminated
- 17:53against because you got a previous
- 17:54conviction that's not fair they bump the
- 17:57charges up on you charge you with a
- 17:58higher charge because you got a previous
- 18:00conviction that's not fair so the most
- 18:03important advice i can give you to
- 18:04litigate
- 18:06every sense of the way if you think
- 18:08something is not right protest it follow
- 18:10motion against it don't sit back and be
- 18:13idle under those circumstances you have
- 18:15to be actively engaged and fighting for
- 18:17your life
- 18:18right because at the end of the day you
- 18:20know if a god came up on you in the
- 18:22street and swung at you you're gonna
- 18:23fight back that's a reflex that's a
- 18:25natural reflex to defend yourself it's
- 18:27the same thing with the law um read the
- 18:30criminal procedure law understand the
- 18:33criminal procedure we have very good
- 18:34when you want to pill you want to read
- 18:36from 460 cpr on down because you want to
- 18:39understand what the rules are
- 18:41of the occult division you want to know
- 18:43what you can do and what you cannot do
- 18:45and you want to read griefs of other
- 18:47people who have similar situations like
- 18:49yours you want to get the briefs of the
- 18:50lawyers submitted and you want to study
- 18:52those briefs you want to read them the
- 18:54ones that want and the ones that lost
- 18:56but now you know what you can do what
- 18:58you can do what the god lost that didn't
- 19:00do right and what the guy that one did
- 19:02like right you just want to arm yourself
- 19:05with as much knowledge as possible so
- 19:07that you can
- 19:08tell your lawyer what you think the
- 19:10issues may be and help him when you're a
- 19:13pill because nobody's gonna fight
- 19:16as hard
- 19:17as you and you've got more time than
- 19:18anybody else to do it because it's your
- 19:20life right you're not gonna find
- 19:22somebody uh uh you know like me that's
- 19:24gonna say you know what i've been there
- 19:26man i'm gonna take my time with this
- 19:27cave man you know i'm gonna call some
- 19:29people up and say yeah what you're doing
- 19:30in the shooting right man that's [ __ ]
- 19:32up what y'all doing here right and
- 19:34you're gonna be in their face every
- 19:35chance of the way or you're gonna have
- 19:37dedicated lawyers that get it and that's
- 19:40gonna go on your television and argue
- 19:42like hell will get you out
- 19:44most lawyers are not like that
- 19:46uh emotional
- 19:48uh a part of the system that enslaves us
- 19:51right most of them right and i'm not
- 19:54saying that you don't have some good
- 19:55lawyers but i'm saying you have more bad
- 19:57lawyers than you have good and that's
- 19:59the fact
- 20:01thank you everybody for tuning in and
- 20:03sitting back and listening to this
- 20:04interview that we just did
- 20:06with derek bush hamilton
- 20:09the work that he put in the work that he
- 20:11had to put in let me start off with
- 20:13saying that the work that he had to put
- 20:16in
- 20:17to gain back his actual innocence to
- 20:19actually change the law
- 20:23that helped affect thousands of people
- 20:25behind him
- 20:27we appreciate the work that he did we
- 20:29appreciate him for coming through and
- 20:31doing part one of this interview
- 20:33and we can't wait to put part two of the
- 20:35interview back out there because
- 20:37the things that the brother got to talk
- 20:39to man talk about
- 20:41i think we need to hear
- 20:43it was a good time sitting here asking
- 20:46you know mr bush you know the questions
- 20:47that we got to ask because
- 20:49i got to learn
- 20:51stuff about him i didn't know personally
- 20:54as far as him being a part of getting
- 20:56the juvenile life off and how he pushed
- 20:59for legislation for us out there we need
- 21:02him to elaborate more on what we
- 21:05as the least listeners are speaking of
- 21:07the bars have to do in order to help
- 21:09some of this legislation get pushed
- 21:11through man it's so much more that we
- 21:13want to talk to them about you know
- 21:15being in the situation we in
- 21:17it's like you know we limited to our
- 21:19time but we appreciate
- 21:21him coming through and taking the time
- 21:23out of his busy day to sit down
- 21:27and have a discussion with us and
- 21:28enlighten us on the things that he got
- 21:30going on in his life
- 21:32it's the inspiration to see a black man
- 21:36out there working
- 21:38to help defeat a system that's not for
- 21:42us and when i say us i mean
- 21:45minority period as a system against you
- 21:48period if you're struggling in this
- 21:50system period if you're looking for the
- 21:52better you with inside you period that's
- 21:54what i mean when i say us
- 21:57because at the end of the day well i
- 21:58like to say at the beginning of the day
- 22:00because you can't entertain your own
- 22:02beginning
- 22:03but at the beginning of the day
- 22:08you only as great as you allow yourself
- 22:11to be
- 22:13and your greatness gonna come from
- 22:14within first you got to believe in
- 22:16yourself first
- 22:20in order to make it to where you want to
- 22:22be in life and that's what we try to do
- 22:24as speaking of the bronze speaker
- 22:26through the box podcast we try to bring
- 22:28stories to
- 22:30individuals who listen to this podcast
- 22:33and let them hear
- 22:35the underdog story the story of people
- 22:37coming from the bottom and never giving
- 22:39up like derek hamilton bush
- 22:42that life sentence didn't give up he
- 22:45didn't he could have easily
- 22:49been in the yard everywhere he could
- 22:51have easily
- 22:53been willing to put in some work to make
- 22:54some money
- 22:56every day it could have been easily
- 22:58indulging in all the extra-curricular
- 23:01activities there's the indulgence and
- 23:03incarceration in prison and the
- 23:06penitentiary but that man stayed focused

- 23:19be that mouthpiece in order to speak the
- 23:21lord that he's putting up because he's
- 23:24his argument was new
- 23:27we never seen an argument with somebody
- 23:29using us law to challenge the innocence
- 23:33that wasn't put there for them to do it
- 23:35and they create a way for everybody else
- 23:37to do it now so i just want to say man
