  14. 1:21Mr murder
  15. 1:24on June 7th
  16. 1:262021 did you take this gun or any gun
  17. 1:29like it
  18. 1:31and shoot your son Paul in the chest in
  19. 1:34the feed room at your property off
  20. 1:35Moselle Road no I did not
  21. 1:38Mr Marty could you take this gun or any
  22. 1:42gun like it
  23. 1:43and blow your son's brains out on June
  24. 1:467th or any day or anytime
  25. 1:49no I did not

  30. 2:02and fired into your wife Maggie's
  31. 2:06leg torso or any part of her body no I

  40. 2:457th the night Maddie Maggie and Paul
  41. 2:47were murdered it is
  42. 2:49were you in fact at the kennels at 8 44
  43. 2:52pm on the night Maggie and Paul were
  44. 2:54murdered I was
  45. 2:56did you lie to sled agent Owen and
  46. 2:58deputy Laura Rutland
  47. 3:02on the night of June 7th
  48. 3:04and told them that you stayed at the
  49. 3:06house after dinner
  50. 3:07I did lie to them did you lie to agent
  51. 3:10Owen and agent Croft on the follow-up
  52. 3:12interview on June 10th
  53. 3:15that the last time you saw Maggie and
  54. 3:17Paul was at dinner
  55. 3:20I did lie to them
  56. 3:22and then the interview of August 11th
  57. 3:25did you tell agent Owen and agent crawl
  58. 3:29did you lie to them by telling them that
  59. 3:33you were not down at the Kennels
  60. 3:35on that night yes
  61. 3:40Alec why did you lie
  62. 3:43to agent Owen agent Croft and Deputy
  63. 3:45Rutland about the last time you saw
  64. 3:47Maggie and Paul
  65. 3:48as my addiction evolved over time
  66. 3:54I would get any situations or
  67. 3:56circumstances where I would get paranoid
  68. 3:59thinking and it could be anything that
  69. 4:03that triggered it might be a look
  70. 4:04somebody gave me it might be a reaction
  71. 4:06somebody had to something I did
  72. 4:08um it might be a policeman following me
  73. 4:10in in a car
  74. 4:12um
  75. 4:14that night June 7th
  76. 4:17after finding
  77. 4:22mags and Paul Papa
  78. 4:26don't talk to anybody without Danny with
  79. 4:29you
  80. 4:31all my partners were just repeatedly
  81. 4:33telling me that
  82. 4:35I had a deputy share taking gunshot
  83. 4:39tests from my hands
  84. 4:42I'm sitting in a
  85. 4:45police car
  86. 4:47with David Owen asking me about my
  87. 4:50relationship with my wife and my son
  88. 4:54and all those things
  89. 4:56coupled together after finding them
  90. 4:59coupled with my distrust for sled
  91. 5:02caused me to have paranoid thoughts
  92. 5:05normally
  93. 5:08when these paranoid thoughts would hit
  94. 5:10me I could take a deep breath real quick
  95. 5:14just think about it reason my way
  96. 5:16through it and just get past it really
  97. 5:18quickly
  98. 5:21on June the 7th
  99. 5:32I wasn't thinking clearly
  100. 5:35I don't think I was capable of reason
  101. 5:41and I lied about being down there
  102. 5:47and I'm so sorry that I did
  103. 5:54I'm sorry to my son buster
  104. 5:59I'm sorry to Grandma Papa t
  105. 6:07I'm sorry to both of our families
  106. 6:12foreign
  107. 6:19I'm sorry to Max
  108. 6:21and Papa
  109. 6:24I would never
  110. 6:26intentionally do anything
  111. 6:29to hurt either one of them
  112. 6:39ever
  113. 6:44foreign
  114. 6:52lying after
  115. 6:54that night did you not but once I lied I
  116. 6:57continued to lie yes sir why
  117. 7:04you know oh what a tangled web we weave
  118. 7:07but once I told a lie
  119. 7:10I mean I told my family I
  120. 7:15had to keep mine
  121. 7:20foreign
  122. 7:28Alex tell the jury
  123. 7:30what happened on the evening though
  124. 7:32June 7th starting when you met him for
  125. 7:35Paul
  126. 7:38been at work that day
  127. 7:42a fairly normal day
  128. 7:44um
  129. 7:48you may start in the morning or
  130. 7:50sure start in the morning
  131. 7:53um
  132. 7:55just a regular morning Maggie was
  133. 7:57leaving to go
  134. 7:58out of town
  135. 8:00um
  136. 8:01she was she was going to a doctor's
  137. 8:03appointment
  138. 8:04and
  139. 8:06um
  140. 8:07she had some stuff to do at Edisto where
  141. 8:09she was having some work done on our
  142. 8:12house that head of stuff
  143. 8:14um
  144. 8:15so but Maggie was there that morning she
  145. 8:18went to leave and she told me she was
  146. 8:21doing these things
  147. 8:23um
  148. 8:24always
  149. 8:26always ask Maggie to come back home and
  150. 8:30stay with me but anyway Maggie had left
  151. 8:34she did her thing I went to work did
  152. 8:40work I learned from Paul Paul that who's
  153. 8:44Paul Paul
  154. 8:45that's Paul my son Papa my son Paul
  155. 8:48murdered and your name for him was
  156. 8:51pawpaw
  157. 8:53yeah we I mean we called him Papa okay
  158. 8:55go ahead I'm sorry and um
  159. 8:58it may Buster mag I pretty I call him
  160. 9:01Paul Paul or Paul Terry
  161. 9:03um
  162. 9:04but Max caught him pawpaw bus called him
  163. 9:08Papa
  164. 9:09um a lot of people called him Papa
  165. 9:13but anyway
  166. 9:14I learned about the I had known that CB
  167. 9:18the guy that worked for us had sprayed
  168. 9:20the sunflowers I I knew about that but
  169. 9:23I'd been out of town
  170. 9:25um
  171. 9:28I didn't know they were dead Paul let me
  172. 9:30know they had died so we had to replant
  173. 9:32the dove feel that that's not the field
  174. 9:34which the the dove feels just a big it's
  175. 9:37a big social part of of of having
  176. 9:40property people would come and it's just
  177. 9:42a social big part of it so the Duffield
  178. 9:43was a big deal so when when the
  179. 9:46sunflowers got killed Paul was when we
  180. 9:49knew they were dead Paul was coming home
  181. 9:51and I learned that early
  182. 9:53Monday morning
  183. 9:56and did um
  184. 9:59and we'll we'll catch back up but at
  185. 10:02some point in time did you meet out with
  186. 10:03Paul yeah after work I met Paul Paul at
  187. 10:06the at the property and and I'm and
  188. 10:10we're gonna backfill and talk about more
  189. 10:12of the day but I just want to focus in
  190. 10:13on that evening right now okay when Paul
  191. 10:15gets to the property what do y'all doing
  192. 10:18first thing we do is we go to the field
  193. 10:20and and we look at the duff feel and
  194. 10:23um how'd you get to the duck field
  195. 10:26uh he had come in uh my brother's truck
  196. 10:31we got in my sunbusters black pickup
  197. 10:35truck we called it Buster struck or the
  198. 10:38black pickup truck you've heard it
  199. 10:39called too but I I call it Buster's
  200. 10:41truck
  201. 10:42okay so you're in Buster's truck and you
  202. 10:44and you go to the dove field tell the
  203. 10:47jury what else well that's the first
  204. 10:48thing we do we we go to the dove field
  205. 10:50and we look and it was clearly
  206. 10:52it didn't you could tell they were I
  207. 10:54mean you could tell they've been
  208. 10:55spraying you could tell they were dead
  209. 10:57uh I mean they might have still had a
  210. 11:00tiny bit of light but they were dead so
  211. 11:01we knew that so we knew we had to
  212. 11:03re-plant the whole field
  213. 11:05um
  214. 11:06so that didn't take but a second
  215. 11:08um
  216. 11:09but after that pawpaw
  217. 11:15thank you
  218. 11:22we just rode the property we spent time
  219. 11:24together
  220. 11:26we
  221. 11:28fish we rode around and we spent time
  222. 11:31together on the property
  223. 11:34did you go to the duck pond oh yeah we
  224. 11:37went uh we went to several food plots we
  225. 11:40went to um single oak stand we called it
  226. 11:44which is across the road
  227. 11:47um I know we went to the bridge stand we
  228. 11:50went to the um we went to the duck pond
  229. 11:53where we stayed for a minute
  230. 11:55and
  231. 12:02did you um I can remember the duck pond
  232. 12:05specifically
  233. 12:06because
  234. 12:08I had helped Paw Paw plant the dove feel
  235. 12:11and and the corn in the duff field so
  236. 12:15the sunflowers corn sunflowers going and
  237. 12:18I'd help him plant the Sun the corn in
  238. 12:20this in the dove field
  239. 12:22pawpaw had planted the duck pond by
  240. 12:25himself and he's making a really big
  241. 12:28deal to me about how much better the
  242. 12:30corn was doing in the
  243. 12:33duck Bond than it was in the duff field
  244. 12:37we stayed there for a little while we
  245. 12:39rode we were at the cabin for a little
  246. 12:41while we rode around the cabin looking
  247. 12:43at it
  248. 12:44the cabinet is what
  249. 12:46that's um it's just a a little small
  250. 12:50it's truly a cabin it's a it's a four
  251. 12:53room
  252. 12:54uh structure it's got a little living
  253. 12:56area a little kitchen it's got two
  254. 12:59little bedrooms and one little bathroom
  255. 13:00and this what you've heard talk about
  256. 13:02where the kids stayed some Summers and
  257. 13:05um as I want the jury seen some overhead
  258. 13:08pitchers it's just right there on
  259. 13:09Moselle road yeah it's right it's right
  260. 13:11up on Moselle Road and it's very close
  261. 13:13to the um the the driveway that goes to
  262. 13:17the shop and the Kennels
  263. 13:20did you spend any time at the shop what
  264. 13:21do you think oh yes I mean the shop was
  265. 13:25I mean that was sort of um
  266. 13:27The Hub that that was the main place if
  267. 13:30you weren't at the house you might be
  268. 13:32out going to
  269. 13:34this field or this food plot or this
  270. 13:37duck pond or or this part of the the
  271. 13:40river but the the the shop
  272. 13:43is where the kennels were located you
  273. 13:46know that was
  274. 13:48you were always there something was
  275. 13:49always going on there you're always
  276. 13:51doing something there that's where all
  277. 13:52the tools were that's where all the
  278. 13:54equipment was kept I mean that was
  279. 13:57that was the main Hub right
  280. 13:59and so we were there that day I mean
  281. 14:01there was a point in time where we
  282. 14:03unloaded the bulldozer that um that that
  283. 14:06had been on a different part of the
  284. 14:08property was on a trailer we Lo unloaded
  285. 14:10it and sprayed it down real quick that
  286. 14:12was just one of the many things we did
  287. 14:13that day
  288. 14:14one of the things the jury's seen uh
  289. 14:17Alec is is a Snapchat video of you and
  290. 14:20and
  291. 14:21doing something with a tree dude you
  292. 14:23remember that
  293. 14:25oh yeah so what what was happening there
  294. 14:28that's just part of when we were we were
  295. 14:30riding that that particular location
  296. 14:32where that was is at a food plot that
  297. 14:36that we called Sawtooth Oaks and it was
  298. 14:39named that because there were some
  299. 14:40Sawtooth Oaks that were planted there
  300. 14:42that you can't see in the in the picture
  301. 14:44but uh what that tree is and all these
  302. 14:47food plots there's an area where
  303. 14:50it's not as big as the field but it's
  304. 14:53like a field where you plant vegetation
  305. 14:56for for wildlife like it might be cow
  306. 14:59peas or soybeans but you plant and then
  307. 15:02there's a feeder to to attract deer then
  308. 15:05we planted these little fruit trees on
  309. 15:08these stands and what you see me doing
  310. 15:10is fooling with a fruit tree that I'd
  311. 15:13been tending to it had fallen over I had
  312. 15:16straps on it I had strings on it that
  313. 15:18were holding it up one of the strings
  314. 15:19popped I undid the other string and it
  315. 15:22was falling over and pawpaw was laughing
  316. 15:24at me trying to get it back up right and
  317. 15:27that was
  318. 15:28it's just a fruit tree that I've been
  319. 15:30dealing with for
  320. 15:31really for years
  321. 15:33and it wouldn't stand up straight and
  322. 15:35were you and Paul having a good time at
  323. 15:37that point
  324. 15:43you could not be around Papa
  325. 15:52you could not be around him and not have
  326. 15:54a good time
  327. 15:56where are you where are you close to
  328. 15:57Paul
  329. 16:01foreign
  330. 16:03closer
  331. 16:05then Papa
  332. 16:07and uh and Buster and I
  333. 16:10were in our
  334. 16:15he's just wonderful
  335. 16:18one
  336. 16:21and one of the things you enjoyed doing
  337. 16:22together was just riding the property I
  338. 16:24love doing anything with pawpaw
  339. 16:27it was an absolute Delight
  340. 16:30but yeah one of the things I mean Paul's
  341. 16:34passion
  342. 16:37I mean Paul was passionate about a lot
  343. 16:38of things but that property was really a
  344. 16:41passion to his I mean he loved to do he
  345. 16:43loved to work it he loved to work with
  346. 16:45Fields he loved to work the food plots
  347. 16:47he loved to hunt I mean he
  348. 16:51he'd work on the roads I mean
  349. 16:54he would he would work on all of it I
  350. 16:58mean he would work on
  351. 17:00destruction and he would he he worked on
  352. 17:02the whole property
  353. 17:04it was it was his passion
  354. 17:07so in the evening of the seventh you
  355. 17:11know
  356. 17:12Jerry's been in
  357. 17:14undated with data from various different
  358. 17:18sources but just ballpark can you
  359. 17:22I mean knowing
  360. 17:24you know what we know now after
  361. 17:25reviewing everything but roughly when do
  362. 17:27you remember Paul getting there and you
  363. 17:29getting there and starting to ride the
  364. 17:30property
  365. 17:32now that I've had the benefit of of
  366. 17:34seeing all of these records
  367. 17:38um
  368. 17:40Papa got home I believe a little bit
  369. 17:43before seven o'clock
  370. 17:45and I got home a little bit before him I
  371. 17:47think the details had been that I got
  372. 17:49home around 6 40 2 or 6 45 or something
  373. 17:52like that and Paul got there
  374. 17:56you know very quickly thereafter and
  375. 17:58then by seven o'clock
  376. 18:00so you rode the property for a while
  377. 18:03um do you remember when Maggie arrived
  378. 18:06yeah it was it was later than that it
  379. 18:09was
  380. 18:10eight or after eight
  381. 18:12I think it was after eight and looking
  382. 18:14at the records a little bit after eight
  383. 18:16and and do you remember
  384. 18:18um do you remember her arriving or where
  385. 18:20you were when she arrived I believed
  386. 18:22that I was at the shop when when she
  387. 18:24came through
  388. 18:27which would not be unusual for her
  389. 18:28having been away if Blanca had gotten
  390. 18:31the mail or somebody got in the mail
  391. 18:33maybe not but if somebody had not gotten
  392. 18:35a mail it would be perfectly normal for
  393. 18:37her to pull through that and I believe
  394. 18:39she did pull through there that day
  395. 18:41and Paul and I were at the shop I
  396. 18:43believe and then what what did you do
  397. 18:45after Maggie arrived
  398. 18:48Maggie went to the house and I know that
  399. 18:52um but shortly after however I learned
  400. 18:55that Maggie got home I went to the house
  401. 18:57when when Maggie got home and I left
  402. 18:59Paul at the shop
  403. 19:01so um and what'd you do when you got to
  404. 19:04the house I saw Max talk to Max
  405. 19:08um and I took a shower
  406. 19:11um the the clothes that we saw in that
  407. 19:13Snapchat video was uh is that the
  408. 19:15clothes you had on at work
  409. 19:17that day yes those are the clothes I had
  410. 19:21on that work that day and the and the
  411. 19:23jury's seen you and um
  412. 19:25in those clothes and and what's
  413. 19:28on June 7th
  414. 19:30how tall were you and how much did you
  415. 19:31weigh
  416. 19:34um on June 7th well I'm I'm six a little
  417. 19:36I'm a hair over six four right at six
  418. 19:38four on June the 7th I was about
  419. 19:42265 pounds 264 265.
  420. 19:47and um and this was in June June 7th yes
  421. 19:51sir
  422. 19:52when you're outside
  423. 19:54riding around and doing some do you get
  424. 19:56hot and sweaty absolutely I mean Paul
  425. 19:58and I have done some things we we
  426. 20:01unloaded bulldozer clean the bulldozers
  427. 20:04we fooled around yeah I mean I sweated I
  428. 20:07was
  429. 20:09you know I was heavy and
  430. 20:12taking prescription pills also makes you
  431. 20:16sweat worse or at least taking oxycodone
  432. 20:18makes you sweat more than you normally
  433. 20:20do
  434. 20:22so was it unusual for you to take a
  435. 20:24shower when you got back to the house
  436. 20:25not at all
  437. 20:28and that when you
  438. 20:31after you took a shower what did you
  439. 20:33change into
  440. 20:34I changed into the clothes
  441. 20:38that
  442. 20:39you've seen in this trial shorts in the
  443. 20:43shirt okay
  444. 20:47when you got out of the shower
  445. 20:50um you changed clothes what'd you do
  446. 20:52next
  447. 20:54I went back out where Max and papa were
  448. 20:57and uh for dinner what's going on Max
  449. 21:01had figured as you've heard Blanca had
  450. 21:04prepared
  451. 21:06dinner but uh it had been cooked earlier
  452. 21:09mags had fixed
  453. 21:11I know Max had fixed mine and her plate
  454. 21:14because I didn't fix a plate she may
  455. 21:15have fixed Papa Papa was eating and Papa
  456. 21:17was almost done eating by the time I got
  457. 21:20back out which also
  458. 21:24wasn't unusual I mean Papa was always on
  459. 21:28the go I mean he he never
  460. 21:31sat still and you know he'd sit down to
  461. 21:34eat but then he's going on to his next
  462. 21:37item
  463. 21:38and uh so the Maggie and I ate
  464. 21:41and you already at the table you eat the
  465. 21:44dinner what's your normal habit oh we
  466. 21:46would do both but I mean when we ate at
  467. 21:48the table it was really sort of more
  468. 21:51formal or or not formal but just more of
  469. 21:54an organized thing our normal what we
  470. 21:57would normally do on a regular evening
  471. 21:59is we would eat in the den in front of
  472. 22:01the TV and that's where we ate that day
  473. 22:03I ate on the couch
  474. 22:06the table Maggie had a little um
  475. 22:10a TV tray that she kept over there and
  476. 22:14and pawpaw would usually sit in a
  477. 22:15recliner and and eat off of the Ottoman
  478. 22:19it was a TV on yes
  479. 22:22was that normal for the TV to be on yes
  480. 22:25TV if we were in the House TV was on
  481. 22:31so what what happened next Alan
  482. 22:33uh Papa
  483. 22:35moved on doing whatever he was doing I
  484. 22:38don't know if he was in The Gun Room
  485. 22:39doing something or he was
  486. 22:41in his room doing something he was
  487. 22:44outside doing something I actually
  488. 22:46thought he'd gone to the shed but in
  489. 22:48looking at to the shop but in looking at
  490. 22:51the the benefit of having these records
  491. 22:54um that we have I know he was still at
  492. 22:57the house or somewhere around the house
  493. 22:58doing something but he wasn't in there
  494. 23:00with Maggie and I
  495. 23:02um
  496. 23:03but Maggie wanted to go to the kennels
  497. 23:06and uh I had eaten dinner
  498. 23:09I laid back on the couch where I was
  499. 23:12sitting my Maggie wanted to go to the
  500. 23:13kennels and she asked me to go and and
  501. 23:18I didn't I didn't go at that time I
  502. 23:20didn't want to go why didn't you want to
  503. 23:22go oh it was hot
  504. 23:24um I just had a shower
  505. 23:27I knew I'd end up doing more work uh
  506. 23:30sweating more and and
  507. 23:33the dogs is always a chaotic scene and
  508. 23:38I just didn't want to go right there
  509. 23:39well
  510. 23:41let me ask you what what had you done
  511. 23:43the
  512. 23:44previous days like Friday and Saturday
  513. 23:47and Sunday
  514. 23:49um
  515. 23:50start with Friday or go backwards yeah
  516. 23:53yeah start start with Friday all right
  517. 23:55on that just briefly so seventh sixth
  518. 23:58fifth fourth so June the fourth uh
  519. 24:02my dad was in the hospital and
  520. 24:06Savannah Georgia at Memorial Hospital
  521. 24:10and I went down to visit him Friday
  522. 24:14afternoon
  523. 24:16and I stayed with him
  524. 24:18in the hospital I spent the night there
  525. 24:21you know he was real sick I mean he was
  526. 24:24having a hard time
  527. 24:26um did you get much sleep Friday night
  528. 24:29no I mean I had a
  529. 24:32real sweet nurse found me at first it
  530. 24:34was just a hard chair in there like this
  531. 24:36but a nurse found me a soft chair sort
  532. 24:39of like a recliner so I mean I I'm sure
  533. 24:42I slept but
  534. 24:43I didn't sleep well you know I didn't
  535. 24:45get a night's sleep no sir
  536. 24:48and then Saturday and Sunday Saturday
  537. 24:51we had plans with um
  538. 24:55with um Buster in Brooklyn I've heard
  539. 24:58about Brooklyn there's Buster's
  540. 25:00wonderful little
  541. 25:01girlfriend
  542. 25:02and Max and I had plans with them to
  543. 25:06meet them in Colombia to go to the South
  544. 25:10Carolina
  545. 25:11uh it was a regional baseball tournament
  546. 25:14and South Carolina was playing Virginia
  547. 25:17I believe so when I got back from
  548. 25:20Savannah
  549. 25:21and met up with mags
  550. 25:26at some point we we had we headed to
  551. 25:28Colombia so I mean it wasn't a lot
  552. 25:31going on in between there we headed up
  553. 25:33to Columbia met bus in Brooklyn
  554. 25:35and then and you stay did you stay in
  555. 25:37Columbia Saturday night we did we went
  556. 25:40to the Ball Game and I remember it was
  557. 25:42an evening game
  558. 25:43um we went
  559. 25:45pretty early and tailgated Maggie and
  560. 25:48Maggie had reconnected with the college
  561. 25:50friend
  562. 25:52um who coincidentally had married
  563. 25:55a college friend of mine
  564. 25:58um and they had a son that played for
  565. 26:00Carolina he was a first baseman a really
  566. 26:04good little player and
  567. 26:06we met them and tailgated with them and
  568. 26:10it was a lot of fun they had a lot of
  569. 26:12the parents of the players that um were
  570. 26:16playing for Carolina and uh it was just
  571. 26:19it was it was it was a fun time we
  572. 26:23tailgated and then we went to and it was
  573. 26:25a night game so we went to the game and
  574. 26:27the game got over
  575. 26:29um you know it was fairly late into the
  576. 26:32evening and after that
  577. 26:35bus Brooklyn and Max and I
  578. 26:40uh
  579. 26:42believe we went to the restaurant in the
  580. 26:45hotel where we were staying but we went
  581. 26:47had dinner and
  582. 26:50and and then bus and Brooklyn went home
  583. 26:53and of course Maggie and I went to our
  584. 26:54room and then you know the next day was
  585. 26:57there another game another game the next
  586. 26:59day
  587. 27:00um
  588. 27:01that's right and uh
  589. 27:04and then you after that you head back to
  590. 27:07Moselle with Maggie yeah we went to the
  591. 27:09game
  592. 27:10um

  595. 27:19I think Ms Ras talking about you
  596. 27:21bringing Krispy Kreme Donuts to your dad
  597. 27:24Maggie loved
  598. 27:26she
  599. 27:27spoiled my dad and always
  600. 27:31I'm always taking him something my dad
  601. 27:33loves sweets and she and I picked up
  602. 27:36donuts and took Krispy Kreme donuts
  603. 27:40uh to him and then um you'll both spend
  604. 27:44the night together at Moselle on Sunday
  605. 27:46night did you both spend the night at
  606. 27:49Moselle on Sunday night yes
  607. 27:52and then the seventh was a work day
  608. 27:56that's right
  609. 27:57it's a Monday Monday June the 7th
  610. 28:00I'll rephrase it oh I'm sorry it was
  611. 28:02Monday
  612. 28:04The Seventh-Day work day for you yes
  613. 28:08and and I just wanted to give that
  614. 28:11background into moving forward to
  615. 28:14when you testified previously about
  616. 28:16Maggie asking you to go to the kennels
  617. 28:18were you tired
  618. 28:19oh yes I was tired
  619. 28:21and you had just had a shower just had a
  620. 28:23shower
  621. 28:25and um and you said that well
  622. 28:30did you go with Maggie to the Kennels
  623. 28:33immediately no I did not what'd you do
  624. 28:36what did she leave yes she did
  625. 28:40she left and pawpaw was gone
  626. 28:42you know how she got to the kennel at
  627. 28:44the time I didn't but now looking at
  628. 28:46these condensed records
  629. 28:49um and and understanding the timeline is
  630. 28:51clear to me that she rode with Papa
  631. 28:56and uh
  632. 28:57and did you stay in the house yes for
  633. 29:00how long not long I laid back on the
  634. 29:03couch put my feet up and like many times
  635. 29:06when Maggie asked me to do something
  636. 29:08that I didn't want to do or didn't start
  637. 29:11out doing I changed my mind and decided
  638. 29:14I'm gonna ride up there
  639. 29:17and I did and how did you get to the to
  640. 29:21the kennels I went on the golf cart
  641. 29:25uh
  642. 29:26was it was a golf cart at the house the
  643. 29:28main house yeah
  644. 29:32and it was there most of the time
  645. 29:34and when you got down to the kennels
  646. 29:37what was happening uh it just what I
  647. 29:40thought it was
  648. 29:41um it was a little bit of chaos I mean
  649. 29:44it was clear to me that mags had just
  650. 29:47let the dogs out
  651. 29:49um
  652. 29:50okay the two dogs that were out were
  653. 29:54really her pet dogs one is Grady you've
  654. 29:58heard about a black lab that's Grady
  655. 30:00that's Buster's dog and the other is the
  656. 30:03yellow lab that you've heard about
  657. 30:05that's Bubba Bubba was mine and Maggie's
  658. 30:08dog but it was really mine Maggie's bus
  659. 30:10and Papa's dog it was a family dog but
  660. 30:15Bubba's a dog I hunted
  661. 30:18um
  662. 30:18I mean Maggie loved Bubba she loved
  663. 30:22Grady too but I mean she had a special
  664. 30:24place for Bubba but anyway when the dogs
  665. 30:26first were let out the first thing they
  666. 30:28would do is they would run you if you
  667. 30:31look at the overhead
  668. 30:34um
  669. 30:34picture that you've seen there were
  670. 30:36planted Pines right behind the Kennels
  671. 30:39so you got the kennels and and and the
  672. 30:42chicken coop sort of form an L-shaped
  673. 30:44and in in that L with some planted Pines
  674. 30:47first thing the dogs would do is go out
  675. 30:49in that
  676. 30:50um
  677. 30:51kennel and you know Bubba
  678. 30:54and and and Grady I think learned this
  679. 30:57from Bubba but Grady would do it too but
  680. 30:59Bubba had to Mark every tree I mean he
  681. 31:01he would go and
  682. 31:04he do a little numeral history and
  683. 31:07actually you know dogs do and it's
  684. 31:08marking his territory
  685. 31:10um and so that was the first thing those
  686. 31:12dogs did when they came out when I got
  687. 31:15there those dogs were in that area so
  688. 31:18that's why I believed that it hadn't
  689. 31:20been long before they've been let out
  690. 31:23um Grady was chasing guineas
  691. 31:26um which was a normal thing to do
  692. 31:30uh guinea fowl is a guinea fowl is like
  693. 31:34um
  694. 31:35it's like a chicken it's a domestic bird
  695. 31:37that you know we had them I
  696. 31:40they make a lot of Racket it's like a
  697. 31:43you know I know this sounds silly but
  698. 31:44it's like a a guard bird
  699. 31:47um because anytime you know they just
  700. 31:50make a lot of Racket anytime anything
  701. 31:51unusual is going on if anything if
  702. 31:54anything disturbs them it could be a
  703. 31:55person it could be somebody driving up
  704. 31:57whatever they're gonna make a lot of
  705. 31:59Rapids so Grady's chasing the guineas
  706. 32:03um
  707. 32:05you know Paul's fooling with um
  708. 32:08Rogan's doll cash
  709. 32:11um Maggie's just kind of standing there
  710. 32:13watching the dogs which is normal and
  711. 32:16they were in that place as as the dogs
  712. 32:19were out longer they Branch out more
  713. 32:22um but at that point in time they were
  714. 32:23they were right there so that told me
  715. 32:25they hadn't been out
  716. 32:27um
  717. 32:28a long time
  718. 32:30Bubba Bubba catches a chicken
  719. 32:35um
  720. 32:36oh
  721. 32:38I'm talking to Maggie for just you know
  722. 32:41a short time before Bubba catches the
  723. 32:43chicken
  724. 32:45I take the chicken
  725. 32:47put it when Bubba Bubba didn't chase
  726. 32:51these dogs didn't chase the chickens to
  727. 32:53kill them and they didn't normally kill
  728. 32:55them they did kill them sometimes but it
  729. 32:57was about to chase with those dogs and
  730. 33:00and they were proud when they caught one
  731. 33:02you could just tell by the way bubble
  732. 33:04with Prince to you when he brought
  733. 33:06chicken to you he was proud that he had
  734. 33:08caught it but he wasn't trying to kill
  735. 33:10it and so most times the chicken wasn't
  736. 33:12dead and that chicken wasn't dead but a
  737. 33:16lot of times they would be stunned and
  738. 33:18they would be just real lethargic so you
  739. 33:21had to take the chicken and you had to
  740. 33:22put it up somewhere where you know the
  741. 33:25chicken could be by itself for a minute
  742. 33:27and
  743. 33:29and it would eventually usually
  744. 33:32you know come back to normal and going
  745. 33:34about its
  746. 33:36you know whatever chicken does
  747. 33:38did you get the chicken out of Bubba's
  748. 33:41mouth I did I took the chicken from
  749. 33:42Bubba and I put it
  750. 33:44um
  751. 33:46on top of that
  752. 33:49no no we've seen you know this video of
  753. 33:52Paul
  754. 33:54um with cash rogenstall did you know
  755. 33:59did you know that was going on what do
  756. 34:01you remember about that about yeah I
  757. 34:04knew Paul was I knew Paul was fooling
  758. 34:06with um
  759. 34:07when I pulled up on the golf cart Maggie
  760. 34:09was standing
  761. 34:11back sort of
  762. 34:12where the driveway would be
  763. 34:15um it sort of runs out at the feed room
  764. 34:18um storage rooms what we call has been
  765. 34:20called the feed room
  766. 34:22um
  767. 34:23but it sort of ran out Maggie was a
  768. 34:25little bit further up where she could
  769. 34:27see back in that angle where the dogs
  770. 34:29were Paul was fooling with um Rogan's
  771. 34:31dog back towards the kennel if I
  772. 34:34remember when I first got there Paul was
  773. 34:36more in the driveway but then
  774. 34:40I knew Paul was in the kennel fooling
  775. 34:42with cash yes but did I know what he was
  776. 34:44doing I didn't know exactly what he was
  777. 34:46doing now did um you I knew he was
  778. 34:48fooling with us I knew he was fooling
  779. 34:50with his tail
  780. 34:52what was was Cash in the kennel when
  781. 34:54when you pulled up you think not when I
  782. 34:57first got there
  783. 34:59um did Bubba or Grady have any uh
  784. 35:02collars on yes
  785. 35:04which both dogs one dog do you remember
  786. 35:06I don't know about Grady but I know
  787. 35:08Bubba had on his what we call a tracking
  788. 35:10collar Paul for his hunting dogs
  789. 35:14um Paul had a system a series of
  790. 35:17tracking collars and I think there were
  791. 35:19five that might have been six but it's a
  792. 35:21tracking collar
  793. 35:23um that had a a device
  794. 35:27that would tell you where that column
  795. 35:29was so that because Bubba was bad about
  796. 35:32you know he would he would stay close
  797. 35:35for a minute but then he would take off
  798. 35:36and he especially do that on Maggie he
  799. 35:39would he would take off and run and so
  800. 35:41he had on the tracking collar that if he
  801. 35:44did that you could
  802. 35:46you know you you could know okay he's
  803. 35:49you know a half a mile down here it's
  804. 35:51not going to follow him but so far but
  805. 35:54it would follow a good long distance so
  806. 35:56you could go get the dog
  807. 35:58um
  808. 35:59if he ran off which Bubba frequently
  809. 36:01would do especially when it was just
  810. 36:04mags and Bubba
  811. 36:07um and so Paul
  812. 36:09Paul probably would have been the one to
  813. 36:11put that on bubba
  814. 36:14so you've got to swear you've gotten
  815. 36:18to checking out of Bubba's mouth and put
  816. 36:20it up on a doghouse or something I
  817. 36:23believe I believe what I put it on
  818. 36:25this but I've seen pictures in all this
  819. 36:28and I saw the chicken sitting on top of
  820. 36:30the um
  821. 36:32what looks to me like a portable dog
  822. 36:34crate whatever wherever it was sitting
  823. 36:36on there is where I would have put it up
  824. 36:37there you know any reason to believe
  825. 36:39anybody else moved that chicken and It
  826. 36:41ultimately that chicken did die
  827. 36:44and um what'd you do after you got the
  828. 36:48chicken out of Bubba's mouth I got out
  829. 36:49of there I I I I left I went back to the
  830. 36:53house
  831. 36:54well look before we do that um
  832. 36:57we've seen that
  833. 36:59dog kennel video with cash and
  834. 37:04Mr Davis
  835. 37:06we slowed it down for him do you see the
  836. 37:08water hose in that video on the ground
  837. 37:11if you remember seeing that
  838. 37:13uh yes I do was a water hose out and
  839. 37:17obviously
  840. 37:19um in the video but can I I I don't
  841. 37:23specifically remember that but I can
  842. 37:25look in that video and see it right but
  843. 37:27that's not something that I noticed so
  844. 37:29but
  845. 37:31you've seen it in the video here yes sir
  846. 37:34and then the two dogs were out
  847. 37:36absolutely Bubba and Grady and then you
  848. 37:41you head behind you get back to the
  849. 37:42house
  850. 37:44same route I mean same route I'd come on
  851. 37:46I came down the driveway made a left on
  852. 37:50uh you saw my route
  853. 37:53um in the car I made I drove that same
  854. 37:56route
  855. 37:58question was obviously wasn't clear
  856. 38:00enough what were you in a vehicle you
  857. 38:02walked
  858. 38:03what mode of transportation did you use
  859. 38:05to get back to the house same way I came
  860. 38:07I went back in the golf cart
  861. 38:10and it is the golf cart if you remember
  862. 38:12that Mark Ball
  863. 38:15testified that he saw
  864. 38:18where we normally would park it you pull
  865. 38:20up and pull along the front
  866. 38:23entrance and it either you come in from
  867. 38:26the left and you'd go just past it and
  868. 38:28be on the right or you come in from the
  869. 38:29right and you'd be just past it on the
  870. 38:31left and that's where I got in it
  871. 38:33and that's where I put it back did you
  872. 38:36do anything else
  873. 38:39before leaving
  874. 38:41after you took
  875. 38:43the chicken out above his mouth
  876. 38:46no
  877. 38:47we've heard
  878. 38:49about Bubba being stubborn how long did
  879. 38:51it take you to get chicken out above his
  880. 38:53mouth Obama could be stubborn but Bubba
  881. 38:55would listen to me and uh and and
  882. 38:58another thing when Bubba had on that
  883. 38:59collar one of the other features of that
  884. 39:01collar was what did Bo have on the
  885. 39:04collar or was it great Bubba hat on the
  886. 39:06collar Bubba had the Color Bob I know
  887. 39:08Bubba had a collar on and I'm not sure
  888. 39:11about Grady okay go ahead if I misspoke
  889. 39:13on that there's no question about it
  890. 39:16Bubba had on a collar
  891. 39:17I assume Grady did too
  892. 39:20um
  893. 39:21but I didn't I I didn't even I saw Grady
  894. 39:24I didn't notice for a fact that Grady
  895. 39:27had on the collar okay but he probably
  896. 39:28did
  897. 39:30so makes sense to me that he did how
  898. 39:33long did it take to get the chickens out
  899. 39:34of no chicken out of Bubba's mouth it
  900. 39:36didn't take it didn't take long number
  901. 39:38one Bubba's coming back there to show me
  902. 39:40hey I caught this chicken so he's not
  903. 39:43running from me he's proud of that fact
  904. 39:45that he caught this chicken so I mean
  905. 39:47he's he comes right up to me
  906. 39:51um Bubba was really strong uh but you
  907. 39:54know you just
  908. 39:56you take your thumb
  909. 39:58when the dog's clenched and his mouth a
  910. 40:01little bit open all you do is you take
  911. 40:02your thumb and you push his gum in
  912. 40:04really tight against those sharp teeth
  913. 40:06and his mouth opens right up
  914. 40:09took the chicken out and put it on
  915. 40:12I believe the portable dog kennel and
  916. 40:14then left
  917. 40:15and then I left then leave okay
  918. 40:19and
  919. 40:21did you go back to the house I went
  920. 40:24straight back to the house to the air
  921. 40:26conditioner and what'd you do when you
  922. 40:28got back to the house I laid down on the
  923. 40:30couch
  924. 40:32and then what
  925. 40:34well I mean it was TV on when he went
  926. 40:35back
  927. 40:38yeah I mean the TV never got cut off
  928. 40:44so he went back to the house she laid
  929. 40:45down on the couch and then what happened
  930. 40:47next I'm not uh I'm not positive I dozed
  931. 40:50off for a minute or didn't doze off for
  932. 40:52a minute but I got up off of the couch
  933. 40:56uh and I was I made up my mind I was
  934. 41:00going to visit my mom
  935. 41:02had you spoken to Barbara Mixon earlier
  936. 41:04in the day I did
  937. 41:06I talked to Barbara most days if I
  938. 41:08didn't see her I talked to her
  939. 41:10and what was your understanding of of
  940. 41:12your mother's
  941. 41:14condition on
  942. 41:16late on the afternoon of the summer she
  943. 41:19was agitated which she got agitated uh
  944. 41:23when my dad you know I mean we were
  945. 41:25putting my dad in the hospital
  946. 41:29I mean he had a lot over to
  947. 41:3318 months
  948. 41:38two years I mean my dad was in the
  949. 41:40hospital
  950. 41:41he was in the hospital a lot and my mom
  951. 41:48I believe my mom knew when my dad wasn't
  952. 41:51there because
  953. 41:53I mean she would get agitated I mean
  954. 41:55that's just the only term you can think
  955. 41:56of she get agitated she she cried a lot
  956. 41:59she'd um
  957. 42:01she'd be fussy when she normally
  958. 42:03wouldn't be fussy I mean she was I know
  959. 42:06Alzheimer's patients are unpredictable
  960. 42:07but
  961. 42:09I'm convinced she knew because it
  962. 42:11happened frequently and Barbara Ann told
  963. 42:13me
  964. 42:15your mom's agitated you need a check on
  965. 42:17her I gave her medicine she's resting
  966. 42:21so it wasn't anything
  967. 42:23urgent
  968. 42:24but she's resting so what what Barbara
  969. 42:27would do and Barbara could handle her
  970. 42:30Barbara could handle her better than I
  971. 42:33mean my mama we all love Barbara my mama
  972. 42:36love Barbara my mama could get I mean
  973. 42:38Barbara could get my mom to do things
  974. 42:40that nobody else when she fussed for
  975. 42:43anybody else including me or my brothers
  976. 42:45or my sisters Barbara could get her you
  977. 42:48know
  978. 42:49in in order and
  979. 42:53um but Barbara giving her medicine and
  980. 42:55and to settle her down and calm her down
  981. 42:57and and that would sometimes make her go
  982. 43:00to sleep
  983. 43:01for a little while but then she
  984. 43:04be agitated when she woke up
  985. 43:07the um so did you go check on your mom I
  986. 43:11did
  987. 43:13um
  988. 43:14did um
  989. 43:17where did you park when you got there
  990. 43:20and
  991. 43:21you saw the pictures there's two exits
  992. 43:25off of that
  993. 43:26um deck
  994. 43:27one of them to the right one of them
  995. 43:29straight out that back door I would have
  996. 43:31parked to the left if you if you're
  997. 43:34coming down these steps if these are the
  998. 43:35steps it would be to the left and back
  999. 43:38over there all right um
  1000. 43:41which is where I always park for where
  1001. 43:44we always Park
  1002. 43:46anytime you were going in that entrance
  1003. 43:48all right I'm gonna stop there and ask
  1004. 43:53Doug if you don't mind pulling up States
  1005. 43:55exhibit 524 which is the GM OnStar data
  1006. 43:58and the slide 38.
  1007. 44:01um
  1008. 44:02which is in evidence
  1009. 44:10can you can you see this uh
  1010. 44:16the slide with those dots yes sir I can

  1019. 44:41all right you see that you you see the
  1020. 44:44open area with the green grass that's

  1023. 44:50the front door if you look at closely at
  1024. 44:53the house you can see a big Dormer right
  1025. 44:55in the middle of the roof that's right
  1026. 44:56over the front door
  1027. 44:58the white thing to the left of the house
  1028. 45:00that's like a parking pad where the
  1029. 45:04where the driveway ends and there's a
  1030. 45:07parking pad like so you go if you follow
  1031. 45:10the driveway all the way to the house
  1032. 45:11you're gonna run straight into a carport
  1033. 45:13all right by the by the carport door
  1034. 45:17just to the left before you get to the
  1035. 45:19carport is this
  1036. 45:22area that you can see here that's that's
  1037. 45:24part driveway mainly parking pad
  1038. 45:28all right I'm gonna um like if you'll
  1039. 45:31pull up Defender exhibit 130 which is in
  1040. 45:34evidence please sir
  1041. 45:37foreign
  1042. 45:44and from this photo can you
  1043. 45:47point out roughly where where you
  1044. 45:50normally where you park that evening all
  1045. 45:53right this is the this is the entrance
  1046. 45:55to the right that I'm talking about
  1047. 45:56there's an exit and an entrance uh right
  1048. 45:59in front of that door that you see there
  1049. 46:01so if you came down those steps walk to
  1050. 46:04your left
  1051. 46:05would be down there would be where I
  1052. 46:07parked
  1053. 46:09oh we would you have parked on the grass
  1054. 46:11uh
  1055. 46:13uh the grass back there there's there's
  1056. 46:15some grass there for sure but it's not
  1057. 46:19it's not the area up here by the house
  1058. 46:21where it's sodded and sure this this
  1059. 46:25grass that you can really see in this
  1060. 46:27picture so it may be on the edge of the
  1061. 46:29grass yes in relation to the satellite
  1062. 46:32dish
  1063. 46:33are you looking at this photo are you to
  1064. 46:35the right of that yeah you'd be to the
  1065. 46:37right of that satellite dish okay yes
  1066. 46:41and and
  1067. 46:42the way that satellite dish is right on
  1068. 46:45the edge of the um
  1069. 46:47you know there's there's a hedge and
  1070. 46:50like you you see the I don't know what
  1071. 46:52you call it a border like a border where
  1072. 46:55the grass ends and the flower bed or
  1073. 46:58whatever it is starts right I think you
  1074. 47:01can't see it but I think that
  1075. 47:02satellite's probably
  1076. 47:04close to that border all right well
  1077. 47:06let's um so it'd be tipping let's write
  1078. 47:08it out in this picture Doug uh when you
  1079. 47:11pull up a defendant's exhibit 134 see if
  1080. 47:13this is a
  1081. 47:15foreign
  1082. 47:25are those the ones where you would enter
  1083. 47:28right these are the steps that I used
  1084. 47:31that night that we always used and and
  1085. 47:33one of the reasons being is
  1086. 47:36my dad
  1087. 47:39this this door goes into what we call
  1088. 47:42the Breakfast room the breakfast room
  1089. 47:44leads right into the kitchen and
  1090. 47:49so straight through this door
  1091. 47:51all of the breakfast room is kind of to
  1092. 47:54the left that door goes straight through
  1093. 47:56another door way there's no door there
  1094. 47:58but it's like a just opening it goes
  1095. 48:01into the kitchen immediately to your
  1096. 48:03right of that
  1097. 48:05entrance into the kitchen is the
  1098. 48:08entrance into where my Mom and Dad's
  1099. 48:10rooms were so you if you went through
  1100. 48:12that door you were in a little area that
  1101. 48:14had my mom's closet my Dad's closet
  1102. 48:17um
  1103. 48:19a little bit further you go into my
  1104. 48:21mom's bedroom if you went to the right
  1105. 48:23you would go my dad and my mom didn't
  1106. 48:27sleep in the same room at this point but
  1107. 48:30the bedrooms were
  1108. 48:32you know they were back to back there
  1109. 48:33was a door going from one to the other
  1110. 48:34and it was blocked but it was there and
  1111. 48:36then there was a bathroom so this is
  1112. 48:39really
  1113. 48:40this is really the part of the house
  1114. 48:42that at their age was getting used so
  1115. 48:45that's why you went in this entrance
  1116. 48:47because my mom and whoever was caring
  1117. 48:49for her was always in her bedroom which
  1118. 48:52would be just on the other side of the
  1119. 48:54room that has these windows that you see
  1120. 48:56to the right
  1121. 48:58all right that those would be the
  1122. 49:00windows for the room where my dad slept
  1123. 49:01right and then my mom's right on the
  1124. 49:03other side the kitchen's right there
  1125. 49:05this is the part of the house they were
  1126. 49:07always in and
  1127. 49:09are you the only one that would pull up
  1128. 49:11in the back like that no
  1129. 49:14common for your brothers and your sister
  1130. 49:16to do the same oh we all did it I mean
  1131. 49:18we all
  1132. 49:19we all part in in the same way if you
  1133. 49:22knew you were going to the front of the
  1134. 49:23house or if you knew there was a crowd
  1135. 49:25there or
  1136. 49:26for whatever you you may park on the
  1137. 49:28driveway but if you knew
  1138. 49:31under normal circumstances my dad always
  1139. 49:34stayed in the breakfast room where he
  1140. 49:37had a recliner and a TV that's where my
  1141. 49:39dad always was my dad never
  1142. 49:43you would never go catch him sitting in
  1143. 49:45the den up front or in a in a living
  1144. 49:49room he he just wasn't up there he was
  1145. 49:52in this room watching TV or either he
  1146. 49:55was on his back deck and my mom was
  1147. 49:58either in her room which was just off of
  1148. 50:00that or
  1149. 50:02she might be in the kitchen
  1150. 50:04or the breakfast room
  1151. 50:08and
  1152. 50:10when you got to the house who was there
  1153. 50:13your mother's house on the night of June
  1154. 50:157th my mom was there and Shelly Smith
  1155. 50:18was there and and what did you do when
  1156. 50:20you got there
  1157. 50:22uh the first thing I did was
  1158. 50:24I tried I tried to I knocked on the door
  1159. 50:27the door was locked I knocked on the
  1160. 50:29door Shelly didn't hear me
  1161. 50:31and then what'd you do next I called
  1162. 50:34called what I called my mom's house to
  1163. 50:38let Shelley know I was there
  1164. 50:40please come let me in and set the house
  1165. 50:44phone that's been referred to yes okay
  1166. 50:46and did she let you in sure and then
  1167. 50:49what happened next I went in and I
  1168. 50:51visited with my mom I mean let me go
  1169. 50:54into detail on that well just briefly
  1170. 50:56yeah what'd you do I went in the house

  1172. 51:02my mom had a bed that was where she
  1173. 51:04slept
  1174. 51:06in normal times it's like uh you know a
  1175. 51:10bed with um
  1176. 51:12you know the poles coming out of the
  1177. 51:13corner a poster bed that um coming out
  1178. 51:15of the corners and she had a bed like
  1179. 51:18that that where she slept but she didn't
  1180. 51:20sleep there anymore
  1181. 51:21but it was in the room it was a hospital
  1182. 51:23bed so when you when you walked in the
  1183. 51:26room her bed was to the right
  1184. 51:28against the wall to the left was a
  1185. 51:31hospital bed like a single bed but a
  1186. 51:34hospital bed
  1187. 51:35and a TV and then there was a recliner
  1188. 51:38where whoever was helping her
  1189. 51:41would would usually sit so I went in
  1190. 51:45and I sat down on my mom's
  1191. 51:50hospital bed and
  1192. 51:53I just talked to her for a minute my mom
  1193. 51:55was awake and I held her hand
  1194. 51:58and what kind of condition was she in uh
  1195. 52:02she was I mean her condition was not
  1196. 52:05good at any time but given her overall
  1197. 52:09condition she seemed to be doing pretty
  1198. 52:11well I mean she wasn't
  1199. 52:14agitated like I thought she would be or
  1200. 52:18like I was worried she would be or like
  1201. 52:20Barbara had described her at that point
  1202. 52:22so she she wasn't agitated and uh you
  1203. 52:26know I just talked to her anytime
  1204. 52:30we talked to my mom we always tried to
  1205. 52:32be real positive and
  1206. 52:35um you know upbeat and just
  1207. 52:41and I just talked to him you know I just
  1208. 52:44talked to him made sure she was okay
  1209. 52:46um did you stay seated on the side of
  1210. 52:49her Hospital style bed or did you move
  1211. 52:52around I mean I stayed there for a few
  1212. 52:54minutes you know I stayed there and I
  1213. 52:57talked to her more than just a few
  1214. 52:59seconds and then but but I didn't stay
  1215. 53:02there
  1216. 53:03um she was uh she she did look tired
  1217. 53:08um
  1218. 53:10so I I got up and I went and I I think I
  1219. 53:14sat on my mom's bed for a minute to
  1220. 53:15start with and then I laid down on my
  1221. 53:18mom's bed which is you know that's what
  1222. 53:20I I normally did when I went in there it
  1223. 53:23wasn't like a lot of chairs to sit in
  1224. 53:26um and I just laid back on the bed now
  1225. 53:28when I talked to Shelly and we watched
  1226. 53:30TV and when you're talking about your
  1227. 53:32mom's bed or you're referring to her
  1228. 53:33regular bed that's right
  1229. 53:36not not her hospital bed not the bed she
  1230. 53:38was in but her
  1231. 53:39her bed the one I was talking about
  1232. 53:41would like post right
  1233. 53:45um
  1234. 53:47the um
  1235. 53:52let me skip something
  1236. 53:55um
  1237. 53:56was
  1238. 53:57Maggie planning to go over to your
  1239. 53:59mother's with you that night no she
  1240. 54:01wasn't planning to go with me that night
  1241. 54:04okay no in fact
  1242. 54:06Maggie didn't really like to visit my
  1243. 54:10mom
  1244. 54:11um
  1245. 54:12it was
  1246. 54:16she loved to visit my dad
  1247. 54:18and she loved to spend time with my dad
  1248. 54:21and she spent a lot of time with my mom
  1249. 54:23when my mom was healthy but you know I
  1250. 54:26mean by this point my mom
  1251. 54:28and she was a chef
  1252. 54:33and she was a chef of her old self
  1253. 54:36and
  1254. 54:42I mean it was kind of I mean it was kind
  1255. 54:45of sad to go and visit her anytime I
  1256. 54:48mean she she just she wasn't healthy and
  1257. 54:50Maggie didn't like to go and just visit
  1258. 54:54my mom
  1259. 54:55when when you when you left
  1260. 54:58Mozelle the Hat had to Almeida
  1261. 55:01um the evening after you
  1262. 55:03go back to the house at Moselle what
  1263. 55:08what exit did you use
  1264. 55:11of the Moselle property when you're
  1265. 55:13going to Almeda on the evening of June
  1266. 55:167th I went out the main gates which
  1267. 55:18would be straight
  1268. 55:19ahead the um
  1269. 55:21you've heard about two gates there's
  1270. 55:23there's the shop entrance there's
  1271. 55:26actually
  1272. 55:28several entrances but the main ones we
  1273. 55:30used it was an entrance by the dove
  1274. 55:32field that was an inches further down by
  1275. 55:33Sawtooth Oaks but the main ones we used
  1276. 55:36were the shop entrance and what we call
  1277. 55:39the main entrance where the brick Gates
  1278. 55:41were
  1279. 55:42did you go why didn't you go by the
  1280. 55:45kennels on your way home
  1281. 55:47there wasn't a reason to go by the
  1282. 55:49kennels at that point and I was going to
  1283. 55:52Almeda which
  1284. 55:54that the main gate would be to the gates
  1285. 55:58that were closer
  1286. 56:04did you notify Maggie
  1287. 56:07uh in some form that you were leaving to
  1288. 56:10go to uh see your mom I tried to call
  1289. 56:13her
  1290. 56:15and
  1291. 56:16and did she answer no
  1292. 56:19and what'd you do after that I think I
  1293. 56:21tried to call her again
  1294. 56:23and
  1295. 56:25did she answer no she didn't answer and
  1296. 56:27at some point I texted her after that
  1297. 56:32the fact that she didn't answer on two
  1298. 56:34times from to that concern you at that
  1299. 56:36time right it didn't concern me at all
  1300. 56:39number one
  1301. 56:43she was with pawpaw
  1302. 56:50so
  1303. 56:52no I mean
  1304. 56:54number two I mean it's not unusual
  1305. 56:58to not be able to get somebody all the
  1306. 57:01time
  1307. 57:02when
  1308. 57:04they're at the house or they're just on
  1309. 57:06the property I mean you've heard all the
  1310. 57:08testimony about how spotty cell service
  1311. 57:10was so no at the time
  1312. 57:13it didn't strike me as anything
  1313. 57:15unusual
  1314. 57:19now I'm moving back to Almeda you've
  1315. 57:23spent time with your mother and then
  1316. 57:24then you'll have to head head back to
  1317. 57:26mosell is that correct
  1318. 57:28that's correct
  1319. 57:29did you write did you drive straight
  1320. 57:31back to Moselle I did
  1321. 57:35no Alec there's some um
  1322. 57:37information from the Telemetry data off
  1323. 57:41your suburban and perhaps some of this
  1324. 57:43OnStar GPS data that indicates that at
  1325. 57:46some point in time in your mother's
  1326. 57:47driveway you stop for about a minute do
  1327. 57:50you recall seeing that data I did
  1328. 57:54what were you doing when you stopped did
  1329. 57:56you recall I was getting my phone that
  1330. 57:59uh I I my phone had gotten there's a
  1331. 58:03console in the middle of my car and my
  1332. 58:05phone had gotten down in the console
  1333. 58:07between the console and the seat where
  1334. 58:09you couldn't get to it
  1335. 58:14were you
  1336. 58:16during that minute or however long it
  1337. 58:19was were you disposing of murder weapons
  1338. 58:21Alan no
  1339. 58:23were you disposing of bloody clothes no
  1340. 58:32and your your ride back to uh
  1341. 58:35Mozelle was it uh
  1342. 58:39when you're driving faster than normal
  1343. 58:40normal
  1344. 58:43I was driving however I drive the normal
  1345. 58:46way did I drive okay
  1346. 58:58when you got
  1347. 59:00back to the Moselle property how did you
  1348. 59:02enter the property what entrance did you
  1349. 59:05use came right back through the main
  1350. 59:07gate
  1351. 59:08and what'd you do then went straight to
  1352. 59:10the house
  1353. 59:12and when you got to the house what'd you
  1354. 59:13do
  1355. 59:16I went inside
  1356. 59:19we're lights on when you pulled up or
  1357. 59:23lights were on in the house for sure I
  1358. 59:25can't remember if there were flood
  1359. 59:27lights on or not I I don't believe there
  1360. 59:29were any flood lights on but
  1361. 59:31they were definitely likes all the
  1362. 59:35all the lights in the house were on yes
  1363. 59:38and when you um
  1364. 59:42how long do you stay inside the house
  1365. 59:43roughly
  1366. 59:44uh now that I've seen the benefit of
  1367. 59:48these records I was in there several
  1368. 59:50minutes
  1369. 59:53obviously
  1370. 59:54I mean
  1371. 59:56were you surprised that Paula Maggie had
  1372. 1:00:00not made it back to the house
  1373. 1:00:01you know I don't know surprise is the
  1374. 1:00:04right word but I mean I would have I
  1375. 1:00:07thought they would have been back by
  1376. 1:00:08then
  1377. 1:00:09you know but I mean did it cause me to
  1378. 1:00:12go into any
  1379. 1:00:14it wasn't like I was shocked
  1380. 1:00:18but I mean I thought they would be there
  1381. 1:00:19I mean I I distinctly remember uh
  1382. 1:00:24you know I went and looked sometimes
  1383. 1:00:27I was very hot natured number one I was
  1384. 1:00:31hot that was heavy and I was taking
  1385. 1:00:33pills so I was always hot Maggie was
  1386. 1:00:36always cold sometimes she would watch TV
  1387. 1:00:40we had a TV in the um hunting room you
  1388. 1:00:43see on the wall there sometimes Maggie
  1389. 1:00:45would be in there watching TV where she
  1390. 1:00:47could have the thermostat different than
  1391. 1:00:49we always kept it cold in the in the
  1392. 1:00:52main part of the house so I know I I
  1393. 1:00:54know I went in there and and looked in
  1394. 1:00:57there for her it's not unusual for
  1395. 1:00:59Maggie to be taking a bath and be
  1396. 1:01:02not able to hear me so I went back there
  1397. 1:01:04and and I know I did those two things
  1398. 1:01:07and and looked in those two places
  1399. 1:01:10and they weren't there and so you know I
  1400. 1:01:13knew they'd been at the kennels and I
  1401. 1:01:16assumed they were still up there
  1402. 1:01:18so what'd you do I went to the Kennels
  1403. 1:01:22I may have tried to call them in fact I
  1404. 1:01:24probably did try to call them we I I
  1405. 1:01:26would think I called them
  1406. 1:01:28um
  1407. 1:01:29but as I sit here right now I'm not
  1408. 1:01:31positive but I would think I did would
  1409. 1:01:33think I tried to call them to see
  1410. 1:01:36and now like when you
  1411. 1:01:38did you drive down to the kennels in
  1412. 1:01:40your suburban foreign
  1413. 1:01:54what'd you see
  1414. 1:02:05so much y'all have seen pictures up

  1430. 1:04:04trying to tend to fall ball I was trying
  1431. 1:04:06to tend to Maggie
  1432. 1:04:10and I just went back and forth between
  1433. 1:04:12them
  1434. 1:04:15were you
  1435. 1:04:16um
  1436. 1:04:18going to Paul and Maggie while you were
  1437. 1:04:20on the phone with the um 911 operators
  1438. 1:04:24yes yes
  1439. 1:04:30and in a little bit I'm going to play
  1440. 1:04:34the 911 tape and I just want to ask you
  1441. 1:04:36and and you've told law enforcement has
  1442. 1:04:39been played here in the court
  1443. 1:04:42um did you
  1444. 1:04:46what did you do when you went up to Paul
  1445. 1:04:48at some point in time
  1446. 1:04:54involved
  1447. 1:05:01oh so
  1448. 1:05:04you're so bad
  1449. 1:05:08at some point
  1450. 1:05:10I know I mean I know I tried to check
  1451. 1:05:12him for a pulse

  1469. 1:06:12his phone popped out of this I mean his
  1470. 1:06:14phone popped out and
  1471. 1:06:17she picked it up and I put it right back
  1472. 1:06:19there do you have any idea how it popped
  1473. 1:06:22out
  1474. 1:06:23I mean I know it came out of his pocket
  1475. 1:06:26when I pulled on his belt loop
  1476. 1:06:29when I when I pulled him to turn him
  1477. 1:06:31over
  1478. 1:06:32and it just popped out and I mean it
  1479. 1:06:33popped right beside him it sat right
  1480. 1:06:35beside him
  1481. 1:06:39where you at were you able to
  1482. 1:06:42turn Paul at all
  1483. 1:06:45I mean I I did it if I was able to I did
  1484. 1:06:49it during the moment then
  1485. 1:06:55what what side of the um
  1486. 1:06:58what side of Paul were you when you were
  1487. 1:07:01doing this

  1630. 1:15:06called 9-1-1 and attend to Maggie Paul

  1733. 1:20:29conversation with 9-1-1 operators

  1735. 1:20:34knowing everything we know now I mean
  1736. 1:20:36was it roughly an hour and a half the
  1737. 1:20:38last time you saw him it was that would
  1738. 1:20:41with the time of however long it took to
  1739. 1:20:43get to this point how many minutes that
  1740. 1:20:45is
  1741. 1:20:4610 10
  1742. 1:20:47how however many you can look exactly
  1743. 1:20:50and see what point this is and know what
  1744. 1:20:52time it is but it's between 10 and 10
  1745. 1:20:5415. and so I've seen them around
  1746. 1:21:008 45

  1779. 1:22:56know the gun had a shell in it
  1780. 1:22:59um
  1781. 1:23:00that I loaded and I I know I had a few
  1782. 1:23:02shells so
  1783. 1:23:04have you seen in this case where there's
  1784. 1:23:07a 16 gauge shelf put in that gun I've
  1785. 1:23:10seen in the records and I've seen and
  1786. 1:23:12heard in the testimony that put a 16
  1787. 1:23:14gauge shell in the gun is that a
  1788. 1:23:1716 gauge shotgun it's not a 16 gauge
  1789. 1:23:21shotgun so why did you put a 16 gauge
  1790. 1:23:23shell in it I obviously didn't realize
  1791. 1:23:26what I was doing
  1792. 1:23:28I mean I know you can't put a 16 gauge
  1793. 1:23:31shell in a 12 gauge gun and not I mean
  1794. 1:23:34I've been hunting my whole life I know
  1795. 1:23:36you can't do that that's
  1796. 1:23:38it's not a mistake I would have met

  1931. 1:33:10students um
  1932. 1:33:12but anyway
  1933. 1:33:14he reached out to Papa and wanted to
  1934. 1:33:16talk to him and um I mean at first we
  1935. 1:33:19were concerned you know why did they why
  1936. 1:33:21they want to talk to him and I mean even
  1937. 1:33:25I believe I had Paul come talk to you
  1938. 1:33:28about that because we were concerned
  1939. 1:33:30what are they going to talk to him about
  1940. 1:33:31but when Paul and Jim got there it turns
  1941. 1:33:35out that
  1942. 1:33:36it was really just
  1943. 1:33:44I mean they were wanting to make sure he
  1944. 1:33:45was okay
  1945. 1:33:47but you know
  1946. 1:33:49this make sure he was okay and and know
  1947. 1:33:53that you know they were aware of the
  1948. 1:33:55threats or some level of threats and so
  1949. 1:33:59yeah I mean
  1950. 1:34:00it had already been reported to them

  2025. 1:37:40Michael Gunn right after you got off
  2026. 1:37:41with the 911 operator I heard them ask
  2027. 1:37:43that question I can promise you I wasn't
  2028. 1:37:45reading any text messages
  2029. 1:37:55there's also an entry
  2030. 1:37:59outlet that says
  2031. 1:38:03at 10 40 P.M
  2032. 1:38:05you did a Google search or Safari
  2033. 1:38:08browser search
  2034. 1:38:09for Whaley's at Edisto
  2035. 1:38:11while your wife and son are laying dead
  2036. 1:38:13on the ground did you do that no
  2037. 1:38:16Whaley's is a restaurant at Edisto that
  2038. 1:38:18we ate at a lot of times we got take out
  2039. 1:38:21from a lot of times so I'm assuming it
  2040. 1:38:23was in my search history pulling up the
  2041. 1:38:26restaurant and obviously was trying to
  2042. 1:38:29call people or dialing and I I hit that
  2043. 1:38:31I wasn't doing any Google searches
  2044. 1:38:35and as one of the persons that you
  2045. 1:38:37dialed that night of a wedding
  2046. 1:38:39photographer
  2047. 1:38:41well it's a guy named Brian White I saw
  2048. 1:38:43that on the call log Brian White's a guy
  2049. 1:38:46who was in my
  2050. 1:38:47um
  2051. 1:38:48what do you call it
  2052. 1:38:50um contacts that
  2053. 1:38:52is a um a videographer that I've used in
  2054. 1:38:56cases I haven't used him in two years
  2055. 1:38:57and he's a good guy but we're not
  2056. 1:39:00personal friends so I certainly wasn't
  2057. 1:39:02calling him
  2058. 1:39:05so were you
  2059. 1:39:10what what does that indicate to you that
  2060. 1:39:12those actions on your phone what how do
  2061. 1:39:15you account for that you know obviously
  2062. 1:39:17they're unintentional I mean I'm doing
  2063. 1:39:19something with my phone trying to call
  2064. 1:39:21people but I'm not trying to call those
  2065. 1:39:23people I'm not doing a Google search for
  2066. 1:39:26any Whaley's restaurant and I'm
  2067. 1:39:27certainly not reading any texts
  2068. 1:39:34I want to ask you um
  2069. 1:39:37Jury Room for a break for about 10
  2070. 1:39:41minutes please do not discuss the police
