  3. 0:04that stand out in your mind when it
  4. 0:05comes to Diane and things like the
  5. 0:08gunpowder residue that we were going
  6. 0:09over this morning
  7. 0:11I'd really like to start well
  8. 0:15first win this
  9. 0:18first I heard somebody say that I knew
  10. 0:22who did it
  11. 0:23and they asked me to come
  12. 0:26they actually had contacted by him I
  13. 0:29went and met with him
  14. 0:31and
  15. 0:32she gave me the first
  16. 0:36affidavit
  17. 0:37that Diane didn't treat the children
  18. 0:41her son-in-law did
  19. 0:45that was that was a start
  20. 0:49it's been a long time since then
  21. 0:54Russia to
  22. 0:57the have been one absolutely other
  23. 1:00controlled with it friend Huerta is the
  24. 1:02uh the Mother-in-law of James Haynes who
  25. 1:06most people that have paid attention to
  26. 1:08the story believe he is indeed the
  27. 1:09person that pulled the trigger that
  28. 1:11night yes
  29. 1:12that's right and he died very recently
  30. 1:14yes
  31. 1:16yes in June but you have several people
  32. 1:19that were very close to James Haynes who
  33. 1:22have told you they do believe he is
  34. 1:24indeed the one matter of fact
  35. 1:27Clinton I asked him was his partner
  36. 1:31and his partner told me
  37. 1:37let's see
  38. 1:39but it's it's hard to get anybody to
  39. 1:41listen
  40. 1:43at least that people who have the power
  41. 1:46to do something about it
  42. 1:47yeah
  43. 1:49just choose to
  44. 1:52ignore it
  45. 1:54better let us know nothing said that
  46. 1:57they don't have to do anything about it
  47. 2:00in your mind they knew just what they
  48. 2:01were going to do before the trial ever
  49. 2:03started that they were going to have
  50. 2:05their convictions no questions about it
  51. 2:07the question about it and the fact that
  52. 2:09Ann Rule who you know is so well known
  53. 2:11after writing so many books when she
  54. 2:14showed up that obviously uh let people
  55. 2:17know that she was believing the police
  56. 2:19at that point Andrew yeah
  57. 2:22I unbelievable police in Eugene anymore
  58. 2:27that's fine someone came from
  59. 2:30from some country see I think Diane did
  60. 2:33when they don't know anything right
  61. 2:36and you were a retired postmaster you
  62. 2:39had you had quite a dazzling career with
  63. 2:41the Postal Service didn't you yeah
  64. 2:44yeah
  65. 2:46and you had relocated to Springfield
  66. 2:48yourself and that yeah I got a promotion
  67. 2:51to just thinking okay yeah
  68. 2:55and Diane worked as a postal delivery
  69. 2:57worker I think many people don't realize
  70. 2:59that that was yes she's she's working in
  71. 3:02Eugene
  72. 3:03and Eugene is a Twin City to Springfield
  73. 3:07right yeah and it was during that time
  74. 3:10that she was approached by a man who
  75. 3:12described himself as a federal
  76. 3:14investigator
  77. 3:16named coffin yes right and he asked her
  78. 3:20to go into a party one night and
  79. 3:22and observe what what she saw yeah and
  80. 3:26can you describe what she saw
  81. 3:29what she did is she went into a room
  82. 3:32where a drug trade or something she'd
  83. 3:36been told that you can go every place
  84. 3:38any place you want but don't go in this
  85. 3:41area here because there's some limits
  86. 3:45my my daughter is very strange that was
  87. 3:48just
  88. 3:50ified at home
  89. 3:52but she shouldn't find that she went
  90. 3:54into the room and
  91. 3:57there we go but they can't get there
  92. 4:02and see it
  93. 4:04because quite a record super manufacture
  94. 4:09chased around them get up it's not your
  95. 4:12place
  96. 4:15Jay
  97. 4:17and that's where we believe she saw Pat
  98. 4:20Horton who was a prosecutor for the
  99. 4:23state of Oregon out of out of Lane
  100. 4:25County right
  101. 4:26and this is a prosecutor who
  102. 4:30after the case was over went to work for
  103. 4:32the basically the same people he had
  104. 4:34been convicting or not convicting but
  105. 4:37yeah that that's an amazing story
  106. 4:40um with James Haynes you have a number
  107. 4:42of people that knew him who have who
  108. 4:43have said they believe that he is the
  109. 4:45killer yeah
  110. 4:47so that's friend word to the
  111. 4:48Mother-in-law that's his partner uh that
  112. 4:52you just mentioned
  113. 4:54plate nice and now what happened to him
  114. 4:58and when did he die how was it it was in
  115. 5:01a motor motorcycle accident
  116. 5:03okay
  117. 5:05out near his his place in
  118. 5:09your country in Tennessee
  119. 5:14okay was there anything suspicious about
  120. 5:17his death that you know of
  121. 5:20I've been told that he
  122. 5:23actually he went in the motel to stay in
  123. 5:28a motel to recuperate I don't have any
  124. 5:31way to prove it oh he survived the
  125. 5:32accident
  126. 5:33it's Advanced action that is a bad shape
  127. 5:39I've been told that the police say that
  128. 5:42it felt in the
  129. 5:44room and broke his neck
  130. 5:48okay I don't know if that's true too
  131. 5:52but at any rate he he ceased to exist at
  132. 5:55that point I was told by the people what
  133. 6:00James 10 came and
  134. 6:03didn't matter
  135. 6:06they both were they both were karate
  136. 6:08Buddies
  137. 6:10that's how they met okay and James
  138. 6:14Haynes had a nickname of animal
  139. 6:17and he
  140. 6:18proved it many times right after
  141. 6:22um after the shooting and everything
  142. 6:23happened
  143. 6:24um
  144. 6:25I understand he was driving a brand new
  145. 6:27vehicle all of a sudden and that lent
  146. 6:29it's it's uh or that lent weight to the
  147. 6:31theory that he had been given a pretty
  148. 6:33big payment to
  149. 6:35to commit the act against Diana and your
  150. 6:37grandchildren I don't know about that
  151. 6:40okay I think that's something that James
  152. 6:43and I had run into that he had a some
  153. 6:46time type of a brand new red car at any
  154. 6:49rate
  155. 6:50um after all these years Diane's been
  156. 6:53convicted in in prison and it obviously
  157. 6:55hasn't been easy but she has stuck to
  158. 6:58her uh story this entire time hasn't she
  159. 7:01she's never done anything to indicate
  160. 7:04that she was involved in that crime no
  161. 7:06she hadn't the matter of fact the
  162. 7:09governor said uh
  163. 7:11two two different times
  164. 7:19something I didn't do
  165. 7:23this is a rotten prison for the
  166. 7:26it's a big statement yeah
  167. 7:29yeah it's
  168. 7:31I was just somewhere around it
  169. 7:34I think anyone who knows the story uh
  170. 7:36knows that you've stood by her from from
  171. 7:38the beginning of this whole thing and
  172. 7:40you're still standing by her today still
  173. 7:41hoping
  174. 7:43yeah
  175. 7:44I do hope so
  176. 7:46true it's wrong because there's too many
  177. 7:49things
  178. 7:49she the tests that they ran on her
  179. 7:54ballistic says she had no gunshot
  180. 7:59wrestler the runner she had no blood
  181. 8:01sweater on her and the case metal was
  182. 8:04negative
  183. 8:06Express all those and we know for a fact
  184. 8:08that she drove to the hospital in a
  185. 8:10mighty big hurry she didn't take time
  186. 8:13along the way to wash off I don't think
  187. 8:15you can wash off those residents well
  188. 8:17she was she was actually followed
  189. 8:19from the site back there by someone
  190. 8:23I don't remember the name now but uh
  191. 8:25it's in the record
  192. 8:27uh
  193. 8:28as you've made a way to town so that
  194. 8:31they verified but you came that wrong
  195. 8:34right
  196. 8:37and she drove straight to the hospital
  197. 8:38which is not the act of one who's trying
  198. 8:41to take life away you don't you don't
  199. 8:43drive him to the hospital as fast well
  200. 8:45that's the one that always stood out in
  201. 8:46my mind and I know you know I've read
  202. 8:49about the trial I wasn't there but my
  203. 8:51friend Eric was there and he's gone over
  204. 8:52it with me in great detail and
  205. 8:54you know he was shaking his head as a as
  206. 8:57a young reporter throughout the whole
  207. 8:58thing he couldn't believe what he was
  208. 9:00seeing also the lawyer Jagger
  209. 9:03um seems okay well you just we went over
  210. 9:06the uh the one court document that was
  211. 9:09the uh the police officer that ran the
  212. 9:11forensic test that indicated that she
  213. 9:13hadn't used a weapon and he didn't um he
  214. 9:16didn't ask any questions in regard to
  215. 9:18that did he
  216. 9:20was that maybe the best opportunity that
  217. 9:22he had I think he had several
  218. 9:24opportunities just like that and it just
  219. 9:28no no further questions right let's talk
  220. 9:31about Oregon for just a moment I've as a
  221. 9:33reporter covered many stories about
  222. 9:35Oregon's legal system that uh that show
  223. 9:38how flawed it can be and how corrupt it
  224. 9:40can be
  225. 9:41but what do you say to the average
  226. 9:43person who's watching this and they're
  227. 9:45thinking but this is a court this is a
  228. 9:48you know
  229. 9:49it is corrupt isn't it I mean it is I
  230. 9:52think so
  231. 9:54people do things for personal gain yeah
  232. 9:56now that's where the grandchildren fall
  233. 9:58into this story again with the
  234. 9:59prosecutor adopting the grandchildren
  235. 10:01have you ever heard of a story like that
  236. 10:03no never before
  237. 10:06if that wasn't a conflict of interest I
  238. 10:08don't honestly know this is Fred huge
  239. 10:10yeah
  240. 10:12then
  241. 10:14Fred Hughes
  242. 10:15was a prosecuted
  243. 10:18the state awarded him for children
  244. 10:23they were we had people all
  245. 10:26and several several cities that would
  246. 10:30have taken them that were family members
  247. 10:32right
  248. 10:34we didn't even receive any consideration
  249. 10:37how about the testimony of uh
  250. 10:40Danny it is Danny right yeah you didn't
  251. 10:44uh he didn't test it it didn't have him
  252. 10:46testify in court
  253. 10:48in the hospital
  254. 10:50he asked why that man shot me
  255. 10:53those are his words
  256. 10:54by that man shot me
  257. 10:57completely amazing that that was not
  258. 11:00allowed in that would have initially
  259. 11:02wrote down in the hospital records
  260. 11:05United States and me
  261. 11:08they have it from him around here too
  262. 11:12and Jagger didn't use these tools so to
  263. 11:15speak
  264. 11:17I think it's intention for us to get out
  265. 11:19of it as easy as it could
  266. 11:22and his wife became a judge right after
  267. 11:24this
  268. 11:25yeah unfortunately yes
  269. 11:28and I I advice suspicious
  270. 11:31right
  271. 11:32organ has a way of awarding people
  272. 11:35from a coffin became a judge and
  273. 11:42David's wife became the judge yep and
  274. 11:45then Horton went on to no longer be a
  275. 11:48prosecutor but a representative for the
  276. 11:50very
  277. 11:50people he had been yeah
  278. 11:53well he had
  279. 11:54I think he had to leave because I think
  280. 11:57the question was on yeah there was
  281. 11:59pressure on him over the drugs having
  282. 12:01disappeared all independent from
  283. 12:03everything else we're talking about yes
  284. 12:08what is he practicing today's first you
  285. 12:10know still is he is he still an attorney
  286. 12:13I don't know I've kind of lost session I
  287. 12:16know who he is yeah
  288. 12:23so how often do you hear from Diane do
  289. 12:25you are you in in contact fairly
  290. 12:26regularly I did have
  291. 12:29a phone working
  292. 12:33she could call home if she wanted she
  293. 12:35for some reason she has a blade
  294. 12:38and been unable to contact us
  295. 12:42by by phone
  296. 12:44and it's not it's not money because I
  297. 12:47have plenty of money to to
  298. 12:50she says that they have a block I can't
  299. 12:55you know I've called and they said no
  300. 12:57it's a box but she says
  301. 12:59telling me it's locked
  302. 13:02well she's the one who would know if
  303. 13:03it's not working because she's
  304. 13:05so we
  305. 13:07we write her letters instead yeah
  306. 13:10he's waiting every every day
  307. 13:13we hope to hear her we even got a
  308. 13:17separate telephone we'll try another
  309. 13:19phone
  310. 13:21so we had two telephones on the house
  311. 13:22now so just so you can be sure and get
  312. 13:25her calls yeah
  313. 13:27wow well you know as I said earlier I
  314. 13:30think every parent should be able to
  315. 13:32relate to this you know their child uh
  316. 13:34is accused of something where it just
  317. 13:36doesn't make sense and then put away for
  318. 13:38so long what would you say to the Oregon
  319. 13:41governor or attorney general if you
  320. 13:43could sit down with them right now what
  321. 13:45would you say to them
  322. 13:46look at the circumstances and look at
  323. 13:49the the
  324. 13:50what the report was from the court not
  325. 13:55what the judge said about the the
  326. 13:57investigators found no no
  327. 14:01let's find no no
  328. 14:03any any sign of
  329. 14:06no chase metal no gunshot wrestler no
  330. 14:10blood sweater yep and I don't mean to
  331. 14:12sound rude but the car was a mess I mean
  332. 14:14the headliner of the car was soaked with
  333. 14:16blood it looked to me from the photos
  334. 14:17that anybody who would have been
  335. 14:19anywhere near that shooting would have
  336. 14:21had plenty of evidence of it and the
  337. 14:22headliner says that Christy was lying
  338. 14:25down too because it's
  339. 14:28bladder went up
  340. 14:30right well as if she had been sitting
  341. 14:32behind the seat driver's seat as she
  342. 14:35said
  343. 14:35had been shot the the subjected
  344. 14:39trajectory would have been done with and
  345. 14:42the irrelevance spray Olive blood free
  346. 14:44all over the sea and it was not
  347. 14:48and the prosecution obviously implied
  348. 14:50that Diane's gunshot injury was
  349. 14:52self-inflicted it was a fairly Serious
  350. 14:54injury wasn't it I understand it it
  351. 14:56broke the bones not one but both both
  352. 14:59bones not a minor injury the media even
  353. 15:02refers to it as a minor injury I wonder
  354. 15:04how those reporters would feel if they
  355. 15:05had a bullet through their arm they
  356. 15:07might not refer to it the same way
  357. 15:11yeah it's really unfortunate now some of
  358. 15:13the newspaper coverage seemed somewhat
  359. 15:16Fair of the of the trial does that is
  360. 15:18that true
  361. 15:20well did the newspaper the Eugene
  362. 15:23Register Guard they they covered parts
  363. 15:25of the story that that uh
  364. 15:28show that maybe they were trying to be
  365. 15:30fair do you agree with that no no
  366. 15:33did they have different writers working
  367. 15:35on it over the years I imagine oh I
  368. 15:39I think they perhaps were fairly okay
  369. 15:41they reported what what they knew but
  370. 15:45I I didn't mean to say it
  371. 15:49the writers were doing the best in uh
  372. 15:53they had to work with but I don't think
  373. 15:56the courts were friends no I don't think
  374. 15:58the courts were fair either in looking
  375. 15:59back at this but but it is the Register
  376. 16:01Guard where we can go read about certain
  377. 16:03parts of this case that really make you
  378. 16:04shake your head yeah
  379. 16:07and Jagger um
  380. 16:10the fact that he didn't choose to
  381. 16:12challenge any of that material that came
  382. 16:14across now you did get him a few years
  383. 16:16later to say that 300 and some odd pages
  384. 16:18of exculpatory evidence
  385. 16:2063 I think it was
  386. 16:23that seems like it should bring a trial
  387. 16:25all by itself a new trial
  388. 16:28right the judges don't think so it's
  389. 16:31important no
  390. 16:33I guess that would rock their boat those
  391. 16:36people they hadn't one of the things
  392. 16:38they had in there was that uh an
  393. 16:41employee at the west side post office
  394. 16:43says he knows where it's shot
  395. 16:47person
  396. 16:49other kids
  397. 16:54they never followed them right
  398. 16:57people who are watching this
  399. 16:59um if they want to uh if if attorneys
  400. 17:01that are watching this have any great
  401. 17:03thoughts
  402. 17:04um can they email you is that okay sure
  403. 17:06okay we'll put your email on the screen
