- 0:00hey guys what's up my name is sky webb
- 0:01and i'm here to talk about a two gram
- 0:03story that i cannot
- 0:04get off my mind but before i get started
- 0:07i just want to put out
- 0:08a little disclaimer that i mean no harm
- 0:10to any of the victims or the victims
- 0:12families and i wish everyone who was
- 0:14hurt within this story that most peace
- 0:15and saw this iron rest or in
- 0:17recovery with that out of the way happy
- 0:19true crime thursday
- 0:21welcome back to my channel or just
- 0:23welcome if you've never been here before
- 0:25i'm not gonna waste any time today i'm
- 0:27gonna get straight into the story
- 0:29actually i do have to waste a little bit
- 0:30of time i just need to put out a
- 0:32disclaimer
- 0:33that this case involves children so if
- 0:35you don't
- 0:36like the murder of children do not watch
- 0:38this video today's case is about diane
- 0:42downs
- 0:45diane downs was actually born elizabeth
- 0:47diane downs and she was born in phoenix
- 0:49arizona on the 7th of august
- 0:521955. we don't know a whole lot about
- 0:54diane's childhood but from the people
- 0:56who knew her we can pretty much gather
- 0:58that she was a little bit of a wild card
- 1:00she was very
- 1:01energetic and out there and she
- 1:04liked to have fun and she liked to get
- 1:06her own way she claims that when she was
- 1:0812 years old she was sexually assaulted
- 1:10and she actually did testify
- 1:12to that um but it's it's unclear whether
- 1:16or not that's the truth or not
- 1:19purely because diane has a very long
- 1:21history of
- 1:23lying and you'll you'll see
- 1:26a demonstration of that very shortly she
- 1:28met her husband steve downs in high
- 1:30school and they dated for a couple of
- 1:32years before
- 1:33she went off to college but she was only
- 1:36in college for a year before she was
- 1:38kicked out for being
- 1:40too promiscuous but it was a baptist
- 1:43bible college so i mean
- 1:45take that with a grain of salt the word
- 1:47promiscuous but anyway
- 1:48then in 1973 she married steve and she
- 1:51actually ran away from home
- 1:53the following year the couple had their
- 1:55first baby christy
- 1:56anne and then in 1976 they had cheryl
- 1:59lynn
- 2:00followed by stephen daniel in 1979.
- 2:03unfortunately steve believed that their
- 2:05only son who they nicknamed denny
- 2:08he believed that denny was the result of
- 2:11an affair
- 2:12so he wasn't very happy and he left
- 2:16the couple got divorced and i'm not
- 2:18entirely sure about the custody like
- 2:20agreement that they had
- 2:22but from what i can see diane had the
- 2:24kids majority
- 2:26of the time she worked for the postal
- 2:28service
- 2:29and she did provide for her kids but her
- 2:32kids also spent a fair
- 2:33chunk of time with their grandparents
- 2:35because
- 2:37diane liked to go out and do what she
- 2:39wanted to do
- 2:40the kids were at the grandparents so
- 2:42often that they actually
- 2:43developed relationships with their
- 2:46neighbors with the grandparents
- 2:47neighbors that's how
- 2:48often they were there and like
- 2:49socializing with everyone
- 2:51and one of the kids actually told her
- 2:53neighbor that they were afraid of their
- 2:55mum
- 2:56diane for the most part remained single
- 2:58but she was
- 2:59known for playing the other woman quite
- 3:02a lot so
- 3:03when she did date she was usually dating
- 3:06married men
- 3:07then in 1982 she fell pregnant and she
- 3:11actually gave birth
- 3:12but this time it was as a surrogate so
- 3:14she gave birth to a beautiful
- 3:16little girl and she was able to name her
- 3:18jennifer before giving her to the
- 3:20parents
- 3:20on the 19th of may 1983 diane and the
- 3:24kids
- 3:24left home at around 9 30 p.m and they
- 3:27went to go visit one of diane's friends
- 3:30on the way home diane decided to take
- 3:33the back roads instead of going
- 3:36you know directly home uh and she said
- 3:39she did this because her and the kids
- 3:41were sightseeing
- 3:43even though it was late at night and it
- 3:44was dark uh
- 3:46she said that that's something that they
- 3:48did quite often was ghost sightseeing
- 3:50at night time about halfway through
- 3:53their sightseeing trip going home she
- 3:55said that the kids had fallen asleep and
- 3:57she saw a man on the side of the road
- 3:59like flagging her down
- 4:00so she stopped and asked like what's
- 4:02that how can i help you
- 4:04and she claims that this man
- 4:07asked for the keys and in response she
- 4:09said you've got to be kidding
- 4:11so he pulled out a gun uh got diane out
- 4:14of the car reached into the car and shot
- 4:16the three children
- 4:17in the back seat before she pretended to
- 4:21throw her keys
- 4:22and he's turned around to go and try and
- 4:24find this case that
- 4:25she didn't actually really throw and
- 4:26then she's jumped in the car
- 4:28and sped off she said that he fired one
- 4:31last bullet and that hit her arm
- 4:33and then you know she was out of there
- 4:35so she drove to the hospital and she
- 4:37started yelling out hey my kids are
- 4:39being shot my kids are being shot
- 4:40unfortunately by the time she got there
- 4:43her seven-year-old
- 4:44cheryl had already died her
- 4:46eight-year-old christy
- 4:48she had suffered from a really really
- 4:49bad stroke um
- 4:51so she was in a very poor way and then
- 4:53the three-year-old denny
- 4:56he was paralyzed from the waist down
- 4:59christy had been so badly injured that
- 5:02her surgeon actually thought like she
- 5:05was dead
- 5:05like her vitals were so low she was in
- 5:07such a poor state she was in such a bad
- 5:09way
- 5:10no one really thought that she would
- 5:13like
- 5:14pull through like they all thought she
- 5:16was gonna die all the nurses
- 5:18who were there that night they were all
- 5:19in tears for these children it was a
- 5:21really really horrific
- 5:22scene and it was just horrible and this
- 5:25is where things start to get a little
- 5:26bit
- 5:27weird because the police show up and
- 5:29they obviously
- 5:30talk to diane and they want to know what
- 5:32happened and she was just very flat and
- 5:34very emotionless
- 5:36like she knew that her daughter had died
- 5:38she knew that her other daughter was
- 5:39clinging to life and her three-year-old
- 5:41was paralyzed he's three years old
- 5:44like that that should evoke some kind of
- 5:47emotion surely and it didn't and the
- 5:50police thought that that was weird
- 5:52then the surgeon came and spoke to her
- 5:53about christy and he was very emotional
- 5:56about how badly injured christie was
- 6:00and so he was expecting a really
- 6:01emotional response from her mother
- 6:03but again she was emotionless she was
- 6:05very just
- 6:07flat and didn't really seem like she
- 6:09cared
- 6:10and she said something that he found
- 6:12really really really inappropriate and
- 6:14he was just taking him back by
- 6:15and she was complaining that she got
- 6:19blood
- 6:21all throughout her new car
- 6:24of all the things to whinge about in
- 6:26this moment
- 6:27it's not your car despite her really
- 6:30weird demeanor the police took her story
- 6:32very very seriously
- 6:34and they started a manhunt for this man
- 6:37with shaggy hair who she described
- 6:40that flagged her down they went out to
- 6:41that location they were searching for
- 6:43clues
- 6:44they found like shell casings
- 6:47and they were just surveying the entire
- 6:50area looking for
- 6:51anything that could assist them to
- 6:53trying to find this guy
- 6:54i'm not sure how the public came to this
- 6:57conclusion that they sort of
- 6:58came to the conclusion that this man was
- 7:01only dangerous to kids
- 7:03uh for the fact that the kids were all
- 7:04so badly injured and she was just like
- 7:07scraped on the arm type of thing and so
- 7:10the community was like terrified they
- 7:11were really petrified
- 7:12and like kids weren't allowed to go out
- 7:14in the streets no one was allowed go out
- 7:16by themselves they had to stay close
- 7:18like
- 7:18everyone was just very guarded and
- 7:20protective at the moment because they
- 7:22thought there was a crazy dangerous
- 7:25happy go lucky shooter like out in the
- 7:28world
- 7:28i meant to say trigger happy not
- 7:30happy-go-lucky
- 7:33that's fine so at this point police were
- 7:36knocking on doors they were literally
- 7:37going from door-to-door asking if anyone
- 7:39had seen anything suspicious they were
- 7:41stopping cars that were going back and
- 7:42forth on those roads
- 7:44checking boots searching cars they had
- 7:46uh divers
- 7:47in the lakes looking for the murder
- 7:49weapon looking for the gun to match the
- 7:51casings
- 7:52they were surveying all throughout the
- 7:54grass and wooded areas and
- 7:55everything they also drew a police
- 7:58sketch of this man with shaggy hair
- 8:00uh and i don't know how anyone ever gets
- 8:03caught
- 8:04with place sketches because they
- 8:06literally never look like anyone
- 8:08let alone the suspect like um anyway
- 8:11so at this point the police really
- 8:12wanted to try and like cement
- 8:14in diane's story because they hadn't
- 8:17found anything they had nothing else to
- 8:19go off other than
- 8:21her story and so they asked her could we
- 8:23do a reenactment
- 8:24and this reenactment was going to be
- 8:27broadcasted on tv
- 8:29and she said yes she was happy more than
- 8:31happy to do it
- 8:33this was probably a poor decision on her
- 8:35part because she was a total narcissist
- 8:37and
- 8:38literally anyone could see that she was
- 8:40seen on tv
- 8:41in the car fixing her hair checking her
- 8:44makeup like making sure
- 8:46she looked her best before she went on
- 8:48which
- 8:50i mean i probably would too i don't know
- 8:51if i had just lost
- 8:53a child whether i would do that i don't
- 8:55think i would give a [ __ ] but
- 8:57each to their own i guess and then when
- 8:59they start she's like
- 9:00laughing and giggling and like she goes
- 9:03to throw her keys because it's a
- 9:04reenactment and then she's like laughing
- 9:06about the fact that she goes to throw
- 9:07her keys
- 9:08and again i could understand that if you
- 9:10had not have just lost
- 9:11a child and you were reenacting how you
- 9:14lost a child and how your children were
- 9:16shot i could understand
- 9:17that you like awkwardly giggling because
- 9:19like you're on tv and everyone's
- 9:21watching you and you feel silly but not
- 9:23in that circumstance and then she jumps
- 9:25in the car and she hits a cast and she's
- 9:27laughing because she hit
- 9:28her cars and she's like oh that really
- 9:30hurt and then
- 9:31while she's still laughing and like
- 9:33getting out of the car she's like that
- 9:36was worse then
- 9:37and then stops and just laughs again and
- 9:39doesn't say anything
- 9:40and detectives at this point assumed
- 9:44that what she might have been about to
- 9:46say was this is worse than when i shot
- 9:48myself
- 9:49which i don't know if that's like a big
- 9:53connection to sort of draw from that but
- 9:57so instead of like cementing in her
- 9:59story they kind of just really
- 10:03had like a concrete suspicion of her now
- 10:06they went and searched a house and they
- 10:07found letter after letter after letter
- 10:09addressed to a man called robert
- 10:10nicobacca
- 10:12and this was a man that she was totally
- 10:14obsessively in love with
- 10:16and he was married she called him nick
- 10:19with a k and
- 10:23they worked together at the post office
- 10:25and as i said he was married
- 10:27he and his wife had been like on and off
- 10:29they'd had their issues and been up and
- 10:31down
- 10:32but there's no mistake in this they were
- 10:35having an affair
- 10:36they started to really sort of hone in
- 10:38on the forensics at this point
- 10:40because again they had nothing else to
- 10:42go off um and
- 10:44they realized that the blood spatter was
- 10:46really inconsistent with diane's story
- 10:48so in diane's story
- 10:49the man came in through the driver's
- 10:51side and shot the kids in the back
- 10:53so all the shooting was done inside the
- 10:55car
- 10:56and yet there was a specks of blood
- 10:59found
- 10:59on the lower door frame of the passenger
- 11:02side at the front
- 11:04uh which didn't make sense at this point
- 11:08diane was pretty aware of the fact that
- 11:11she was looking suspicious she was aware
- 11:14that the
- 11:15police were sort of taking a look at her
- 11:17and not necessarily believing her story
- 11:19and so she actually decided
- 11:21to make her own appeal to the public
- 11:24which is very different so she had a
- 11:27news broadcaster
- 11:29come to her house and she appealed for
- 11:32any information she asked this man this
- 11:34suspect
- 11:35to come forward and you know like
- 11:39hand himself in she also retold her
- 11:41story and said that she wanted to make
- 11:42it very very clear
- 11:44what happened and then she goes on to
- 11:46try and defend herself by saying
- 11:49if i was going to shoot my children
- 11:51wouldn't i have done a better job at it
- 11:53when i have done a good job at it
- 11:55like wouldn't have killed them all and
- 11:57she did this a lot she did interview
- 11:58after interview press conference
- 12:01talked to reporters she loved the
- 12:04limelight and she wanted to get her
- 12:05story out and she wanted to be ahead of
- 12:07it she wanted to be the one
- 12:09uh telling this story essentially
- 12:12she didn't want anyone else to have a
- 12:14say or a spin on it
- 12:16she really wanted exposure and i think
- 12:18out of everything she really wanted
- 12:20sympathy she did one interview in
- 12:22particular that was really kind of
- 12:24detrimental to her downfall and she was
- 12:26actually
- 12:27invited to bring her lawyers with her
- 12:29but she declined this offer which is
- 12:33not the brightest thing anyone could
- 12:34really do and again she was seen as a
- 12:37massive narcissist
- 12:38she had the audacity to sit there and
- 12:40say everyone keeps telling me
- 12:42i'm lucky but i don't think i'm very
- 12:44lucky
- 12:45like my arm hurts like i i couldn't pick
- 12:48things up
- 12:49she's like i couldn't tie my shoelaces
- 12:51for such and such amount of time
- 12:53i'm not the lucky one i think my
- 12:55children are lucky which is
- 12:57literally [ __ ] mental she kept saying
- 12:59that her daughter christy
- 13:00would get her out of this and like she
- 13:03would explain
- 13:03that she's not the one who shot them and
- 13:05it was this other guy and she was just
- 13:07waiting for christy to wake up from
- 13:09uh or not wake up but like regain the
- 13:12ability to speak because at this point
- 13:14she couldn't speak due to the stroke
- 13:16and she just kept saying wait for
- 13:17christy wait for christy despite the
- 13:19fact
- 13:20that christy couldn't yet speak the
- 13:22nurses
- 13:23did notice and they made a note of this
- 13:26that every time diane walked into the
- 13:28room poor little christie's vitals would
- 13:31just like
- 13:31[ __ ] spike through the [ __ ] roof
- 13:34and it was
- 13:35very apparent that she was scared of her
- 13:37mother
- 13:38luckily the kids weren't ever placed
- 13:40into her custody they both remained in
- 13:42hospital
- 13:42uh until you know later by now the
- 13:45police were starting to piece together a
- 13:47story
- 13:48or a theory of what might have really
- 13:49happened and they believed that diane
- 13:52had planned this she'd turned around and
- 13:54shot all three children
- 13:56they believed that uh poor cheryl
- 13:58actually managed to open the door and
- 14:00try and
- 14:00like climb out and so diane has
- 14:04climbed across the passenger seat opened
- 14:06that door
- 14:07and then bent outside of the car and
- 14:09shot her and then she's
- 14:11obviously gone around the side put
- 14:13cheryl back in the car who was already
- 14:15dead
- 14:16and then drove to the hospital on top of
- 14:19this
- 14:20they discovered that diane had a handgun
- 14:23and she had from
- 14:24day dot uh denied ever having a handgun
- 14:28or having any gun for that matter um and
- 14:32this handgun it matched the crime so
- 14:35they obviously
- 14:36examined this gun and they determined
- 14:38that the shell casings and this gun and
- 14:40the bullets and all that
- 14:41it all matched up it all it
- 14:44added up and then they found a witness
- 14:47and obviously this case was sort of
- 14:49plastered all over
- 14:50the town all over the place it was all
- 14:52over the news and everything else and so
- 14:54this person
- 14:55saw her car on the news and came forward
- 14:58and said hey i was actually driving
- 15:00behind that car
- 15:02on that night on that road he said
- 15:05that he drove up behind this car and
- 15:08they were driving so
- 15:09slowly that his speedo
- 15:12wouldn't even register because that's
- 15:15how [ __ ] slow they were driving
- 15:17and that obviously contradicted with
- 15:19diane's story
- 15:20who said she was speeding there as fast
- 15:22as she could like pedal to the metal
- 15:24that wasn't the case according to this
- 15:27witness
- 15:27the only thing they needed now really to
- 15:30hold against her was a motive and that's
- 15:32where those letters from earlier to nick
- 15:34come in handy because she was
- 15:38obsessed and in love with nick but nick
- 15:41didn't want to be like a dad or a father
- 15:45to someone else's kids let alone like
- 15:47any kids at this point in his life
- 15:49and she wrote to him saying like my kids
- 15:52are so easy like they're no
- 15:53trouble they're no trouble at all like
- 15:55it's fine like they're
- 15:56fine and but he he just didn't
- 16:00want that and so she felt like perhaps
- 16:03if she didn't have the kids he would
- 16:07fully commit to her and leave his wife
- 16:10she really viewed her kids as like a
- 16:12hindrance to her relationship at this
- 16:14point and she thought
- 16:15there's no way he'll ever commit to her
- 16:16with all this baggage the package being
- 16:18the poor kids
- 16:19and so she just thought if if they
- 16:21weren't there
- 16:22she'd have him all to herself so at this
- 16:25point the police finally like
- 16:27really come down on her and they stop
- 16:28even entertaining her story
- 16:30and they say to her like diane your
- 16:33story stinks your entire story
- 16:35stinks and it has from the start and the
- 16:38audacity of this [ __ ]
- 16:40she says without missing a [ __ ] bee
- 16:43well
- 16:44you better go get some deodorant then
- 16:46and your story stinks
- 16:48this whole
- 16:50[Music]
- 16:53which i know should make me like really
- 16:55angry
- 16:56but it's just so stupid like how can one
- 16:59person
- 17:00say something so stupid like it's
- 17:03so hilariously dumb of a thing to say
- 17:07in such a serious circumstance like by
- 17:10now little christy
- 17:11was seeing a therapist and she was
- 17:14really working
- 17:15on her communication skills and she was
- 17:18starting to
- 17:19regain her ability to speak but at this
- 17:22point she was
- 17:23still too afraid to sort of like talk
- 17:26about the accident or not the accident
- 17:27obviously was an accident
- 17:29but she was too afraid to speak about
- 17:30the incident that's what i meant to say
- 17:33uh because obviously she was very
- 17:35traumatized and so this therapist said
- 17:37to her
- 17:38write down who shot you and we'll put it
- 17:40in an envelope and we'll burn it in my
- 17:42fireplace
- 17:43and we'll keep doing that until you're
- 17:44ready so every visit with this therapist
- 17:46she would do that she would write it
- 17:47down
- 17:48on a piece of paper they'd put it in an
- 17:49envelope and then they'd chuck it in the
- 17:51fireplace
- 17:52finally when she was ready she handed
- 17:54over the envelope and
- 17:58it said my mom nine months after
- 18:00shooting her kids
- 18:01diane downs was finally arrested at this
- 18:04point
- 18:05diane was actually hugely
- 18:08pregnant and not only had she planned
- 18:11this pregnancy she actually completely
- 18:13orchestrated it she she found this guy
- 18:17on her postal route and decided that he
- 18:19was attractive he had good features
- 18:21high cheekbones and things that could be
- 18:24passed down to a child
- 18:25and she decided to go and visit him
- 18:29with a bottle of alcohol and some weed
- 18:33and she said that she knew her cycle so
- 18:35well that if she had sex with him just
- 18:37one time
- 18:38she knew she'd fall pregnant and she
- 18:40[ __ ] did
- 18:41she was pregnant as [ __ ] so while she's
- 18:45on trial
- 18:46for shooting her own children she's got
- 18:49a massive baby bump which is like the
- 18:51most bizarre
- 18:52terrifying thing to see she was charged
- 18:56with first-degree murder and two counts
- 18:58of attempted murder
- 18:59and she pled not guilty she was seen by
- 19:02psychologists and she was actually
- 19:04diagnosed with narcissistic personality
- 19:06disorder which i just got to say i
- 19:08[ __ ] caught it
- 19:09and then she was found guilty on all
- 19:11counts and sentenced to life in prison
- 19:14plus 50 years with the chance of pearl
- 19:16after 25 years
- 19:18so what's the point of adding 50 years
- 19:20if she has a chance of parole i don't
- 19:22[ __ ] know
- 19:23so diane's children christy and danny
- 19:25they were actually adopted by
- 19:27the lead prosecution
- 19:30man and his wife which i think is such a
- 19:32beautiful
- 19:33like wow like it goes to show how much
- 19:36he he genuinely cared
- 19:38to get justice for these poor [ __ ]
- 19:41kids
- 19:41shortly after her trial uh diane gave
- 19:44birth
- 19:45to her daughter
- 19:48unfortunately her daughter and she named
- 19:50her amy elizabeth but she was taken away
- 19:52from her immediately and
- 19:54given to adoptive parents who
- 19:56immediately changed her name to rebecca
- 19:58rebecca was told from a pretty young age
- 20:00who her mum was
- 20:01and she actually wrote to uh diane when
- 20:04she was younger but since she's grown up
- 20:06she lives to regret that
- 20:08unfortunately she really really regrets
- 20:10ever trying to communicate
- 20:12and contact her and she thinks her mom
- 20:14is just like a vile
- 20:16disgusting human being which she's not
- 20:18wrong and she's had a lot of issues
- 20:20like admitting that that's her mom
- 20:23which is really sad it really is a shame
- 20:25but she's done a lot of interviews and
- 20:26she's done a lot of work on herself and
- 20:28within herself
- 20:29and she's got a bright future ahead of
- 20:31her diane
- 20:32actually ended up escaping prison in
- 20:341987
- 20:35insane and she was recaptured 10 days
- 20:38later
- 20:39that's a long time to have a crazy
- 20:42kid-shooter
- 20:43like out in the open she was only 66
- 20:47miles or like
- 20:48around 100 kilometers i don't exactly
- 20:50know the conversion
- 20:52um away from where christy and danny
- 20:55lived with their new parents
- 20:57so they were petrified that this woman
- 21:00diane would come and try and make
- 21:03contact with the kids or try and hurt
- 21:05them
- 21:05even and so when she was recaptured
- 21:08uh their dad their adoptive dad the
- 21:12lead prosecutor he really petitioned and
- 21:15fought hard
- 21:16for her to be transferred to a different
- 21:18prison because it was just too close to
- 21:19home and it petrified them
- 21:21and so he won that luckily and she was
- 21:24moved
- 21:24she applied for parole in 2008 and 2010
- 21:28but luckily both times she was denied as
- 21:29she still claims innocence which i don't
- 21:31think she'll ever get out if she's still
- 21:33claiming that because everybody knows
- 21:35she's not innocent so it goes to show
- 21:36she hasn't learned or changed or evolved
- 21:38in
- 21:39any way shape or form her next parole
- 21:41hearing was supposed to be 2020
- 21:44this year but i believe it was
- 21:46rescheduled for 2021 but it could
- 21:48actually be later than that i'm not
- 21:49entirely sure
- 21:51um and that's due to the pandemic and
- 21:53the virus and the virus is something she
- 21:55was actually very very vocal about this
- 21:57year she did an interview
- 21:59um and back in february of this year she
- 22:02claimed she had the virus
- 22:05because she loves the tension that much
- 22:06she claimed that she had the virus
- 22:08despite there being two negative tests
- 22:12and no one else in the entire prison
- 22:14being tested
- 22:15positive for it she plucked it out of
- 22:19thin air she must have
- 22:21which is wild she also said that
- 22:24she watched uh the oregon map
- 22:27very very closely of like where um
- 22:30positive
- 22:31tests were popping up um and she claims
- 22:34that she
- 22:34she was doing that to keep an eye on her
- 22:37children that she still loves and cares
- 22:39about very very deeply
- 22:40and it's a shame that uh she'll never be
- 22:42able to show that to them and they'll
- 22:44never believe that
- 22:45of course they're never gonna [ __ ]
- 22:46believe it you shot them you tried to
- 22:48kill them you psycho [ __ ]
- 22:50that is the story of elizabeth diane
