0:22to do a videotape reenactment sitting in
0:26the car is Elizabeth Diane ballons
0:48I just hit my kids started the cup and
1:00left the car door shut itself
1:03she was giddy she laughed she cracked
1:06jokes
1:07I mean she's reenacting the gruesome
1:11shootings of her three children she
1:13doesn't seem at all upset we were just
1:28out I guess sightseeing I guess you'd
1:30say and the kids got tired they fell
1:32asleep in the car
1:33so I decided to just head on home but I
1:36saw a road I hadn't been on before we
1:38like to take back roads and just went
1:40down that road and there was a guy
1:41standing in the road flagging me down so
1:44I stopped everything was done in a
1:46matter of five or ten seconds he swung
1:47himself around and fired twice one
1:50cotton in the arm the other one I went
1:52off somewhere
1:53Danny cried the whole way I could hear
1:55him softly just moaning and Kristi was
1:59dying all the blood all the pain
2:04emotionally she was flat I kept trying
2:07to tell her touched rail over so she
2:09wouldn't choke on the blend it didn't
2:11dawn on me at the time that the blood
2:12was coming from her lungs her behavior
2:14was not anything that you would expect
2:16for a mother who'd gone through this and
2:20as I say she may be the only one to get
2:21me out of this what I have brought her
2:23to the hospital wouldn't she be the one
2:24that I would make sure is dead there are
2:26too many holes in it if I had shot my
2:29own children would I not have done a
2:31good job of it why would I have taken my
2:33kids to the hospital wouldn't I have
2:35made sure they were dead and then cried
2:36crocodile tears that's insane to think
2:38that I would do such a thing and then
2:40bring the witnesses in against myself
2:42that's crazy I'm here just to appeal for
2:47people out there to if they know
2:49anything to call in anything to help out
2:53find the guy that shot my kids somebody
2:56took her
2:57but we have to get better
3:12Danny's gonna walk again I don't care if
3:14we just have to willing to walk I think
3:16he's gonna walk the doctors all say he
3:18won't and I know that your mind controls
3:20your body and if I can love him enough
3:21and encourage him enough I believe her
3:23walk please arrest me so that I can
3:27prove I'm innocent so my kids can come
3:28home and they wouldn't

4:03this man shot my daughter my first
4:05reaction was to snap back to my
4:08childhood to the pain that had happened
4:10to me back then my marriage my
4:13entrapment by society this man was
4:15bigger than me he was stronger than me
4:17he had more power because he had a gun
4:19and I stood there and I looked at
4:20Christie reaching and the blood that
4:24just kept gushing out of her mouth and
4:26and what do you do the gun kept firing
4:31and firing and firing and it made it was
4:34monotonous just kept going it was like a
4:36slow-motion picture when he swung around
4:40he was pointing when he swung around it
4:43hit the tips of my fingers the gun hit
4:45the tips of my fingers and that snapped
4:46me and I went I'm not trapped by society
4:50I don't care if he is bigger if I stand
4:53here and I say yeah here take the keys I
4:57mean there's nothing I can do you win
4:58because you have the gun my kids are
5:00gonna die and I'm not gonna let my kids
5:03die and so instead of getting him the
5:05keys I feigned throwing the keys
5:11he did not take time to point the gun
5:13and shoot me obviously because he would
5:15have shot me the same way he did the
5:17kids when he was swinging in the
5:19direction of the keys firing the gun he
5:22hit my arm everybody says you sure were
5:25lucky well I don't feel very lucky I
5:27couldn't tie my damn shoes about two
5:29months it is very painful it is still
5:32painful the scar is gonna be there
5:34forever I'm gonna remember that night
5:35for the rest of my life whether I want
5:37to or not I don't think I was very lucky
5:38I think my kids were lucky if I had been
5:42shot the way they were we all would have
5:43died the blood splatters on the outside
5:46of the car showing downs shot Cheryl
5:48outside of the car we saw pictures of
5:50this so-called spatter its drops when
5:55they took the kids they took Chris and
5:56Cher out of the driver's side of the car
5:58and it's blood droplets which I see most
6:03is blood coming out of Christie's mouth
6:05because that's what I see I I can't see
6:09Danny and I can't see cher Sherry's Liam
6:12or Danny is just crying real real soft
6:15so so that sound stays in my mind when I
6:18go to bed I cry at night even now I
6:20still cry I dream about Cheryl but at
6:22night when I close my eyes I can see
6:24Christie reaching her hand out to me
6:25while I'm driving and the blood just
6:28keep coming out of her mouth and that
6:30maybe it'll fade too with time but I
6:32don't think so
6:34that haunts me the most
6:38but what have downs is fourth child the
6:42baby about to be born I'd like to see
6:44them try to take this baby from me and
6:47ah I got pregnant because I miss Christy
6:52and I miss Danny and I miss Cheryl so
6:54much I'm never gonna see Cheryl on earth
6:56again and I just you can't replace
7:00children but you can replace the effect
7:02that they give you and they give me love
7:05they give me satisfaction to give me
7:06stability they give me a reason to live
7:08and a reason to be happy and and that's
7:10gone they took it from me but children
7:13are so easy to conceive the Father know
7:16who he is
7:17oh yeah yeah and that's why I won't talk
7:19about it because he feels us privately
7:21about this child his eyes

7:34there it was it wasn't like a movie when
7:36I was telling him I was telling them
7:37what happened
7:38but inappropriate behavior and a story
7:40full of holes is not evidence of murder
7:43man your story stinks this whole thing
7:51and then somehow and she said I think it
7:54was somebody that meaning you changed it
7:56by saying that this guy knows you know
7:58he knew your tattoo he knows about you
8:00he threatened you that's a hell of a
8:03change from what you say the first time
8:04there was no reason for you not to say
8:07that at the very beginning when I'm
8:11sitting here looking at me with the face
8:13of stuff another man oh they're smoking
8:16a cigarette 90 miles an hour and tasting
8:18jenoff my best buddy though when you go
8:20hunting with us for sure
8:22feel guilty about what you did Diane no
8:24I didn't do anything wrong and I
8:27wouldn't change it if I could my kids
8:29and I always took the back road trying
8:31to find out who shot your kids the
8:42interview went for approximately two
8:45hours and towards the end there her
8:47frustration level was rising Diane
9:07thought she was too smart for us and
9:10that there wasn't anything that could
9:12trip her up
9:14come on Diane it's you return it back
9:17since you guys seem to think that I
9:19should have brought the Diane with me I
9:21will get my stuff good I never do it
9:23you do know what I do I damn sure do
9:27do you know what I saw what you did yeah
9:31Freeport
9:32I thought grabbed my arm and yanked my
9:34arm out and shoot my arm inside now try
9:37to deal with it and I'm leaving cuz I
9:40know who did it
9:41ah the time is now 17:46 and Diane is
9:49just a part of the office work including
9:51the paper

10:32you were pregnant at trial why did you
10:35get pregnant again
10:36I was extremely lonely I miss my kids
10:38desperately I had just seen Christie on
10:40the 2nd of October and it just it's like
10:44opening a wound and pouring salt and I
10:46was extremely lonely beyond belief and
10:48beyond explanation and on October 13th I
10:51just went and got pregnant because I was
10:54so lonely I love my children I miss my
10:56children and I know that sounds
10:58simplistic it really does and I have to
11:00admit that and that's why I say there's
11:02so much more feeling inside that I can
11:04give in two minutes my whole life even
11:07as a child all I really thought of that
11:10I used to carry dolls around on a pillow
11:12and I wanted to be a mom I got pregnant
11:14when I wasn't allowed to and I'm not
11:17saying here forbade me to get pregnant
11:18but I didn't consult him I wanted to
11:21have children and so I got pregnant
11:22without asking permission two years time
11:25I had 10 separate lovers 2 years that's
11:30not very many and less than half of them
11:32were married according to police she
11:34became obsessed with trying to get him
11:37writing him letters every day but they
11:39would come back unopened he would change
11:43his mind on a daily basis I'm coming I'm
11:45going I'm coming I'm going I want a
11:47divorce I've changed my mind I don't
11:48want a divorce a week and a half later
11:50he changes his mind you doesn't want a
11:51divorce

11:58as you can remember what did he tell you
12:01if you say anything about what happened
12:04here if they'd come back and kill me
12:06it wasn't an attentional lawyer though I
12:08didn't see what changed your story oh
12:10yeah yeah I I agree I mean you know
12:15you've heard it it's obvious doesn't
12:17that make it seem kind of tough to
12:18believe what you're saying
12:20if you change your story two months
12:22after the shooting I'm sorry
12:24I mean I'm not saying that you have to
12:27believe me I'm not saying that anybody
12:28has to believe me but I know within
12:30myself I can sit here with a clear
12:31conscience and know that I did not shoot
12:34my kids this weird person came about an
12:36hour and shot us for no reason and just
12:38left I mean it's not a believable story
12:41I could have if I had done this I could
12:43have come up with a believable story it
12:44really happened I could smell the blood
12:46I could smell the Gunpowder I could it
12:49was just a really really horrible
12:51feeling but Diane says she's sure I
12:53could I could sit here and cry and be
12:55all upset and what's it gonna prove it
12:58proves nothing
12:59I am Who I am and I can't I can't prove
13:01that I'm anybody other than what I am if
13:04I did it if they really had this
13:07evidence I said they didn't have the
13:08evidence serving only three years in
13:10prison she escaped by scaling over a bob
13:13wire fence diam was now on the run and a
13:16threat once again but she says she was
13:19looking for the bushy-haired stranger I
13:22wanted revenge
13:23at that time I I wanted to do some
13:25really obscene things to his body but
13:28instead eleven days later she was
13:30apprehended hiding in a nearby house
13:33with a former cellmates husband
13:35Diane Downs is now held in a
13:38maximum-security prison in New Jersey
13:39where she's working on her latest appeal
13:43why are you here
13:49I don't know
13:53doesn't like you know what I'm a
13:58survivor I have spent the past 25 years
14:00trying to find answers as opposed to
14:03learning how to cut hair or repair air
14:04conditioning unit in 2008 Downes had her
14:07first parole hearing her hair grayer her
14:11face heavier her claims of innocence
14:13unchanged all I know is that I did not
14:16murder my children and one year after my
14:18uncle was murdered my children and I
14:20were attacked for no reason at all
14:22her story of that night stranger than
14:25ever
14:26why is my uncle and his contact from the
14:29State Department and their Israeli
14:33contact in this book down cz's request
14:36for parole was denied that he did not
14:42commit these murders or the murder and
14:45the other crimes you were convicted of
14:47absolutely I didn't commit them and I
14:50still maintain my innocence somebody in
14:53the road flagged us down I stopped and
14:56got out of the got out of my car
14:58and he said something to the effect of I
15:02want your car and I laughed at him and I
15:05said you've got to be kidding because in
15:08my mind those kinds of things don't
15:10happen in Arizona those things don't
15:12happen I don't know about Oregon but in
15:14Arizona those things don't happen and so
15:17he jumped into the car leaned into the
15:21car and started firing the weapon and it
15:24happened so quickly that by the time he
15:26stood up and faced me it was over I mean
15:32it was just that fast he said something
15:36about the car again and I struggled with
15:37him the gun discharged he fell back I
15:41jumped in the car put the keys in the
15:43ignition and took off the car door shut
15:46by itself that's it and I went to the
15:49hospital Christie and Dan Christie and
15:52Danny were in the backseat when we got
15:54to the hospital they were still crying
15:57the nurses reported that they were still
15:59crying
16:00the state says I that I was the one that
16:05shot them and that I wanted them dead
16:06if that was the case I would not have
16:08taken to the hospital still crying there
16:11are so many other ways to accomplish
16:15such a horrific deed if I was going to
16:17do it and certainly bright enough to
16:19figure out another way besides some way
16:22that looks so absolutely insane and
16:24hokey that nobody would believe it I'm
16:28not dumb ultimately you told several
16:36different versions of the story when
16:37when law enforcement investigated this
16:40correct when you were when you talk
16:42about courage
16:43ultimately well what have you told the
16:49law enforcement that this was done by
16:51two men with ski masks this is what
16:55somebody told me this it how do I
17:00explain this
17:02after my children and I were attacked
17:04the police kept saying Diane you must
17:07have lapses in your memory because
17:08there's holes in this she could drive a
17:10semi truck through none of this makes
17:12sense you're forgetting something
17:15I believed because I'd never had any
17:18dealings with authorities and I believe
17:20the authorities and so I thought they
17:22did that I had lapses of memory I can't
17:27tell you how the towel got around my
17:28arms so I know from my own personal
17:30experience that I did have at least that
17:32much of a lapse of memory I don't know
17:34how the towel got around my arm so when
17:38I I would have what people would call me
17:40up and people would say I know so-and-so
17:43and he said such-and-such
17:46do I have an 8 another guy would call
17:49and say I have a neighbor and he has a
17:51car that just looks just like that and
17:52he's been talking these kinds of things
17:55were being said to me either by phone
17:58people would stop me on my mail route
18:00they would I worked in Cottage Grove and
18:02people would drive all the way to
18:03Cottage Grove just to meet me on my mail
18:06route and tell me these kinds of things
18:08so I would call the police or I would go
18:11to the police and I would say these I
18:13would say this is what's being told to
18:15me those are the kinds of things they
18:17would say that I changed my story
18:20I wasn't changing my story I was trying
18:22to the police kept saying I had lapses
18:24of memory people were calling me and
18:27telling me things that I thought well
18:28maybe this is what happened that I don't
18:30know and so I would tell the police
18:32believing that I was helping them
18:34investigate they didn't tell anybody
18:36that these are reports that I was giving
18:39them reports from other people they
18:40would simply say Diane came in and said
18:42such-and-such the one about the ski mask
18:45was dreams that I was having and they
18:47kept saying well maybe you forgot
18:49something so when I would have a dream
18:51and I would wake up I would think well
18:52maybe that's what I would forget and so
18:54I the ski mask story I didn't tell the
18:57police I was talking to somebody on the
19:00phone and I was trying to and I was
19:02sharing this dream this thought was
19:05somebody trying to understand in the
19:07same way that you would talk to a
19:08psychologist or a psychiatrist so that
19:11you can because if you talk maybe you
19:13can reach something maybe you can find
19:15something that's inside you that's
19:17locked off and so I was sharing this
19:19with somebody else and the police were
19:21tape recording those phone calls and
19:23then said oh there she goes she changed
19:25her story and that wasn't it and they
19:27know that wasn't it
19:28okay well ma'am I guess perhaps you
19:30could clarify it for me because as you
19:31said I'm I am the newest person here and
19:34I'm asking you new questions but when
19:35I'm reading the pre-sentence
19:37investigation and says subsequently
19:39defendant gave a total of three
19:40different versions of the shooting
19:42including that it was done by two men
19:43wearing ski masks and also that she knew
19:45the person who shot them did you not
19:48give three different versions of the
19:49story
19:51the police said strangers don't shoot
19:54strangers for no reason so I believe
19:58this had to be somebody who knew me they
20:00also at one point the last day that I
20:02got to see Christie in the hospital I
20:04believe it was June 15th of 83 Doug
20:08Welch came to the hospital and said
20:10Steve Downes did this we know Steve
20:13Downes did this you need to give us you
20:15need to be willing to testify against
20:17him I said how do you know Steve downs
20:19my ex-husband how do you know Steve
20:21downs did this give me the evidence he
20:24said don't worry about the evidence just
20:26be willing to testify I said if you
20:28can't prove to me he did it he's not the
20:30one that fired the gun
20:32he said but he was behind it I said I
20:35cannot testify against somebody unless
20:37you can prove to me that he did this I
20:39know he hates me but why would he hurt
20:41the kids
20:42Doug Welch said you better be willing to
20:44play ball
20:45or you'll never see your kids again and
20:46I said I cannot testify against somebody
20:48unless you can prove to me that he did
20:50it the next day when I went to see my
20:52children I was not allowed to see my
20:54children ever again that gave me the
20:58belief that the police were absolutely
21:00convinced that somebody I knew did this
21:02and if the police believed it then I
21:04believed it now if they want to turn
21:07this all around and say Diane changed
21:09her story that's not what happened and
21:11you guys are on the parole board and I
21:14know you work with the legal authorities
21:17you work with police you work with the
21:18with the district attorneys and so you
21:21know how they work it's how they I know
21:23now what they were trying to do they
21:25were trying to scoop me into a corner so
21:28that I don't know so that I would say or
21:30do something that would incriminate me
21:31which certainly worked but but that's
21:34not what happened though what I'm
21:36telling you is exactly what happened
21:38Doug Welch came to the Mackenzie no to
21:40the the hospital and Springfield no I
21:44can't even think Mackenzie moment no
21:46anyway to the Springfield hospital he
21:49sat right there he caught me when I was
21:50coming through the front door he pulled
21:52me into the lobby and these are the
21:54things he said to me I went to see
21:56Christie for 15 minutes because that's
21:57all I was allowed I left and he was
22:00standing there and he goes I'm not
22:01playing Diane and I said prove to me
22:04Steve did this he says let us worry
22:06about the proof and I said I can't
22:08testify against him unless she can prove
22:10to me he did this and I left the next
22:13day I did not see my children ever ever
22:16again until court and that was it and so
22:20I believed I believed what the police I
22:24thought the police believed now maybe
22:26they did believe that maybe to this day
22:28they still believe it because Fred huger
22:30was another time he told my attorney Jim
22:32Jagger Jim Jagger said Fred you know
22:36Diane is innocent he said I know that
22:39and you know that but she's covering for
22:41somebody and as long as she's going to
22:43cover for somebody she's
22:45gonna do that person's time Jim set Jim
22:48Jagger said go ahead I said so is it
22:51yours is it is what you're saying today
22:53is that the the prosecuting your case
22:56the prosecutor in your case knew you
22:59were innocent yet in order to get
23:03someone else to convict someone else for
23:06this he basically threatened to keep
23:10your kids from you in order to get you
23:12to make incriminating testimony against
23:14somebody else is that what you're saying
23:16I'm not saying I'm not saying that I'm
23:19saying that Jim Jagger told me Fred
23:21huger said this to him
23:23I don't know that Fred huger said this I
23:24have no reason to believe Fred he had
23:26you said this now but that's what jim
23:29jagger told me Fred huger said so from
23:31that point on I believed should be from
23:35that point on I believed that Fred huger
23:39believed that it was somebody that I
23:42knew that's what I'm telling you it that
23:44is what shaped my belief patterns and so
23:46when I would talk to the police I spoke
23:48to the police as if it was somebody that
23:51was familiar to me not because I
23:54believed they were familiar to me but
23:56because fred huger told Jim Jagger and
23:58jim jagger jim jagger told me that fred
24:00huger told him this i have no reason to
24:03believe Fred huger would do that I don't
24:05brett huger adopted my children I think
24:08during the trial can I go ahead and jump
24:11ahead with this sure okay during the
24:15trial at the very end of the trial fred
24:18huge they brought in a mock-up of the
24:20car and fred huger got a gun and he was
24:24reenacting crime and when he was going
24:28through the motions of firing the gun at
24:31the christy doll and at the Cheryl doll
24:33and at the Danny doll he couldn't shoot
24:35the Danny doll because the Derry doll
24:38was back here and he raised up and he
24:42looked at me and I went like this and he
24:46went he his face he had a fate a look of
24:49incredulous on on his face and his mouth
24:51started to open and I nodded my head yes
24:55and he had to switch the gun to the left
24:57and a right-handed person could not have
25:00shot the Danny doll it was at that time
25:02I don't think any time before that did
25:04Fred huger believed that he was doing
25:07anything wrong I think that he believed
25:09full-bore that what he was doing was the
25:10right thing but I'm not inside Freddie's
25:14head I don't have the right to speak for
25:16him and I won't speak for him but it was
25:18after that he adopted my children and
25:20according to Christy never said a bad
25:22word against me ever that was at a
25:25Christie's mouth fred huger and all the
25:28time that he raised her never spoke ill
25:30of me I believed that Fred huger knows
25:32that there is a man out there that was
25:34hunting my children and it wasn't until
25:36after Christy told her school mates that
25:41I'd she she drew pictures in school and
25:43she said this is the man who shot us
25:46I didn't I lied in court because they
25:49wanted me to say this and they wouldn't
25:51leave me alone dr. Peters she said dr.
25:53Petersen kept pressuring me and he
25:55wouldn't leave me alone those children
25:57the and race ins told their mother their
25:59mother told her the the apartment
26:03manager and the apartment manager told
26:06somebody now he oh he didn't tell my
26:09attorney until 1991 but he apparently
26:11told somebody before that but it was at
26:14that time when Christy was in that
26:16school and classmates with the Andreasen
26:18twins that Fred huger decided to adopt
26:20my children so yeah we talked about that
26:23you've had I mean you had conversations
26:25about your needs but have you thought
26:27about their needs because your case
26:28obviously has it attracts some attention
26:30how will it be for this with all these
26:33potential attention that you living with
26:36them might bring upon them have you have
26:38you thought about their needs in this
26:41yes every time I call home I ask them
26:44can we please move I want them to move
26:47to another place what when I used to
26:50file legal work back before I finally
26:52got my answers and you check and see
26:54when my legal work all stopped it's when
26:56I finally got the answers and I was
26:57finally able to calm down and just be me
26:59again about 2005 the back in the day
27:02when my dad would file I would I would
27:05write everything my dad would type it
27:06my mom would copy it and she would do
27:08the filing for all of my league
27:10or well my dad on this filing page
27:13that's the certificate of mailing yet my
27:16dad you have to sign your name my dad
27:18would always put his address so
27:21everybody knows where my parents live
27:22and so every time I would talk to my
27:25parents on the phone not every time at
27:28least once a month when I talked to my
27:29parents on the phone I would say please
27:31can we move someplace else I would like
27:34to live someplace else where nobody can
27:36find you because people are going to be
27:38coming by the house all the time wanting
27:41to peek in the windows wanting to heaven
27:43knows what and I don't want us to have
27:45to deal with heaven knows what might my
27:47dad's 80 he had a stroke two years ago
27:50he's very thin he's lost 30 pounds he
27:52stumbles he falls my goodness gracious
27:56when they were here in August his whole
27:57arm was bruised I was scared to death
27:59that my mom was going to be arrested for
28:01battery of an elder because and I asked
28:03what happened to you my mom says he
28:06falls now and I I do not want my parents
28:13to have to worry about when my mom has
28:17to go out and get groceries cuz Mike she
28:18can't get my dad to get it to go in the
28:20car it's easier for my dad to just stay
28:22at home I don't want my mom to have to
28:25worry about when she has to go grocery
28:27shopping is somebody at the end of
28:28quarter mile road gonna be there
28:31throwing tomatoes at the car or wanting
28:34a signature can you sign my my book or
28:38whatever I don't want mine so I would
28:41ask them please please just move and it
28:46wasn't until May of this year when it
28:47was finally time they know that they
28:51know about our s14 4.28 that my Mac my
28:55parole date was May night and so in
28:57April my mom said I've decided we're
29:00gonna move and not tell the kids where
29:01we're going I said okay okay but so my
29:08parents finally said yes that they will
29:10move unfortunately for me to move I have
29:15to tell you guys where I'm moving and
29:16it's the same as telling the media where
29:18I'm moving in
29:19the media is telling the wackos because
29:21somehow the wackos always seem to know
29:23everything and the only thing that I can
29:25ask is please if you do parole me and
29:29you allow us to transfer to another
29:31state someplace
29:33please don't tell anybody where we are I
29:36mean it's the only way that I can keep
29:38my parents say I'm not worried come on I
29:40live with 4,000 of the worst people in
29:43humanity and it's a washing machine it
29:45keeps turning over and turning over we
29:47in California we parole 11,000 people a
29:50month I mean a year and they come right
29:53back so I I'm not concerned about my
29:56safety but my parents are old if you
30:00think that it's better for me to parole
30:02someplace and never seem like there and
30:05never see my parents again
30:07that's the only way to keep him safe
30:08then I would do that but I don't want to
30:10not see my parents again I love my
30:13parents I mean my dad needs me to take
30:16care of him he's 80 and he falls he's a
30:18big man my mom's a little woman she
30:20doesn't when he finally comes time to
30:22start bathing him and taking care of him
30:24my mom isn't going to be able to do that
30:26by yourself sending me someplace away
