  10. 0:17whether milky will ever see the inside
  11. 0:19of a prison cell again so Mary Ellen
  12. 0:20what our attorneys saying about that you

  16. 0:27the retrial of Debra milke for the
  17. 0:29murder of her four-year-old son at the
  18. 0:30end of this month but defense experts
  19. 0:33say he's got an uphill battle especially
  20. 0:36with a sketchy key witness to people
  21. 0:39know what happened in that interrogation
  22. 0:41room detectives saw that day and Debra
  23. 0:45milke jurors in the retrial will have to
  24. 0:47decide who to believe in a classic he
  25. 0:49said she said case she is Debra milke
  26. 0:52now free after 24 years in prison for
  27. 0:55plotting the murder of her four-year-old
  28. 0:56son he is a retired Phoenix police
  29. 0:59detective Armando soldati who claims
  30. 1:01milky confessed to him but never
  31. 1:03recorded it so there's no evidence it
  32. 1:06demonstrates how much weight the average
  33. 1:10person who's serving on jury duty gives
  34. 1:13to the statements of a police officer
  35. 1:14but defense expert Russ richel soft says
  36. 1:17a conviction in 2013 won't be so easy
  37. 1:20prosecutors could face what attorneys
  38. 1:22call the CSI effect jurors now demand
  39. 1:25more physical evidence they expect it
  40. 1:28because you know popular TV shows like
  41. 1:30law and order and CSI have created those
  42. 1:34expectations in the public plus in 1990
  43. 1:36jurors weren't told about detective
  44. 1:38Salty's history of misconduct according
  45. 1:41to court papers it ranges from lying
  46. 1:43under oath to rights violations jurors
  47. 1:45in 2013 will be told which has attorneys
  48. 1:48believing milky may never see a jail
  49. 1:51cell again my hope would be that based
  50. 1:53on that they would find her not guilty
  51. 1:55now to hearing later this month a judge
  52. 1:58will decide whether or not detective Sal
  53. 2:00Dante's testimony will be allowed in the
  54. 2:03retrial and even if it is so wealthy
  55. 2:05himself may decide to plead the fifth
  56. 2:07mainly because of at ninth circuit court
  57. 2:09order into a civil rights investigation
  58. 2:12surrounding him
  59. 2:13and a lot riding on that one witness
