- 0:45neighborhood outside of
- 0:49Dallas stand baby
- 0:52stand 911 operators receive a disturbing
- 0:55call oh my God
- 1:00police find 6-year-old Deon roer and his
- 1:035-year-old brother Damon stabbed to
- 1:05death on a living room floor their
- 1:0726-year-old mother dolly roer is alive
- 1:10for bleeding profusely from multiple
- 1:12stab wounds and a gash across her
- 1:15throat her husband Darren is unharmed
- 1:18but in severe shock the couple's third
- 1:20child Drake only 7 months old is found
- 1:23safe upstairs in his
- 1:26crib Charlie's rushed to the hospital
- 1:29despite massive of bleeding doctors are
- 1:31able to save her
- 1:33life with a Grizzly double murder on
- 1:36their hands and the community in panic
- 1:39detectives frantically search for the
- 1:41killer 11 days later the police
- 1:44announced that darly roer has been
- 1:46arrested for the ruthless coldblooded
- 1:48killing of her own two children after
- 1:51only a single day of deliberations she's
- 1:54found guilty and sentenced to death by
- 1:56lethal
- 1:57injection for over 10 years roer has
- 2:00maintained her innocence claiming that
- 2:03she and her children had been attacked
- 2:04during a botched robbery and that the
- 2:07real killer is still out
- 2:10[Music]
- 2:13there my name is Jerry Palace I'm a
- 2:16private investigator and former
- 2:18detective with the New York City Police
- 2:20Department this is the transcript the uh
- 2:22part that they blacked out mm Court TV
- 2:24has asked me and my partner former NYPD
- 2:27homicide detective Reggie Brit to
- 2:30investigate this is this is really one
- 2:31way this testimony the case became big
- 2:34news and erupted into a media
- 2:36Circus the question on everyone's mind
- 2:39could a mother really have done
- 2:41something like this to her own children
- 2:43established the time of death between
- 2:45130 and 2 a.m. you got to look at when
- 2:48did he base the uh time of death on you
- 2:50testified the
- 2:52trial before heading down to Dallas we
- 2:55read through the transcripts police
- 2:57records and other court documents in our
- 2:59New York City office office but
- 3:01successful investigations aren't about
- 3:03documents and records the truth isn't in
- 3:06the folders it's in the eyes of the
- 3:08people who know what really
- 3:10[Music]
- 3:23happened they take their death row down
- 3:25here very seriously in Texas but this is
- 3:28not the place to commit a murder cuz
- 3:30you're going to go meet your maker for
- 3:35[Music]
- 3:39sure at the time of the murders dary's
- 3:42husband Darren was upstairs asleep their
- 3:45third son in a nearby
- 3:48crib Darren told investigators that when
- 3:50he heard his wife scream he jumped out
- 3:53of bed and ran downstairs assuming that
- 3:56an attacker was in the house he's been
- 3:59the controvers ual figure ever since
- 4:02some say he was involved in the crime
- 4:04can you take us back to that night June
- 4:066th
- 4:071996 we were all watching TV downstairs
- 4:10and darl had pop some popcorn and
- 4:12everything well the boys went upstairs
- 4:14and got their blankets and their pillows
- 4:16and it all laid down on the
- 4:17floor and me and darly talked you know
- 4:20about different things
- 4:22so I went up back upstairs and it was
- 4:25probably you know 11:00 or so after the
- 4:28news probably and uh climbed into bed
- 4:32and went to sleep and the next thing I
- 4:35hear was this glass break like you know
- 4:38but far
- 4:39away and then I hear D darly just
- 4:43screaming you know Daren daring daring
- 4:45Dar I mean just freaking out I mean you
- 4:47know yeah it jarred me and you know I
- 4:50jumped up I run down the stairs as fast
- 4:53as I can I looked up I'm yelling at her
- 4:56what the hell happened you know she
- 4:57grabs the phone she's running back back
- 4:59and forth I'm trying to give Deon CPR
- 5:02and as soon as I blow into his mouth I
- 5:04mean air just comes out of his chest Jes
- 5:06Christ I didn't know what to do you know
- 5:09I mean you know you're just you're just
- 5:12freaking I mean just trying to do
- 5:14everything that you can trying to
- 5:17logically think about what just happened
- 5:20and then you're you know and all you can
- 5:22do is just set there on the curb and
- 5:24watch your whole life just be gone
- 5:29is this little town right small little
- 5:31town yeah nothing like this ever
- 5:34happened the stranger came in at my
- 5:35house stranger came in and killed my
- 5:38kids took my kids and almost took my
- 5:40wife and if darly had died I'd be on
- 5:41death row you would be with this Police
- 5:44Department that's exactly true because
- 5:46the truth has nothing to do with it
- 5:48somebody had to be responsible for it
- 5:51did the police question you as a suspect
- 5:53did you think that they thought you were
- 5:55a suspect I think I was so stupid I
- 5:57didn't even think that they thought that
- 5:59was possibility well how did you feel
- 6:02when they arrested your wife
- 6:05devastated and in shock
- 6:08and wanting to
- 6:11prove that they were wrong you said you
- 6:14didn't realize she was hurt until you
- 6:16came back in the house right is that
- 6:17true yeah what did you say to her
- 6:20then you remember I made her
- 6:22promise when I helped her get on the
- 6:24gurnie I made her a promise that I would
- 6:26find out who did this she asked you for
- 6:29that
- 6:30right yeah because she didn't think she
- 6:32was going to make it
- 6:34really I didn't what what did she say to
- 6:36you that you promised of that what did
- 6:38she say do you remember her words she
- 6:39said I want you to promise me that you
- 6:41find out who did this and take care of
- 6:49it I was looking at him and looking into
- 6:52his eyes realizing just how much he's
- 6:55still in love with his wife and when he
- 6:58talked about those boys
- 7:01he's
- 7:05suffering at her trial dary's defense
- 7:08attorney relied on evidence found at the
- 7:10house which he argued pointed towards an
- 7:13attempted Breakin but the jury didn't
- 7:16buy

- 7:18it I think she's got one more one more
- 7:22appeal about her DNA that's what the
- 7:24unknown male it was an unknown male's
- 7:26DNA found yeah they did elimination and
- 7:29some unknown male and they haven't been
- 7:31able to put a name to
- 7:34that now dar's lawyers claim that the
- 7:37cops missed critical forensic evidence
- 7:39including a bloody fingerprint that
- 7:41contained unknown male
- 7:44DNA Steve Cooper heads up darley's new
- 7:47defense team the state theory was that
- 7:50darly Lyn murdered her sons then staged
- 7:54the crime scene and then inflicted the
- 7:58wounds on herself but we have a couple
- 8:01of things that match to an intruder that
- 8:03only for instance this bloody
- 8:05fingerprint uh then we can paint a
- 8:07picture that would demonstrate that in
- 8:09fact there was a non-family member in
- 8:12the house that night this is all new
- 8:14evidence this basically right and it
- 8:16wasn't in record at all no the
- 8:18improvements in DNA testing in 10 years
- 8:21is just incredible well if Dolly Lynn
- 8:24didn't do it then who did or why I think
- 8:28it's quite likely that it was a burglary
- 8:32uh attempt and somebody wasn't expecting
- 8:34to find an adult and two children on the
- 8:36living room floor at 3:00 in the morning
- 8:39but this is a crime that went terribly
- 8:41wrong right I believe so I think it's
- 8:43the most likely U probability the
- 8:46state's case was entirely
- 8:49circumstantial and mostly in involving
- 8:52around character assassination wanting
- 8:54to claim that these children were in her
- 8:57way and she was just this uh large
- 9:00breasted blond-haired you know Floy in
- 9:03in a Dallas suburb who was you know
- 9:06trying to get rid of these bothersome
- 9:08kids how confident do you feel that the
- 9:11courts may give you this I mean we're in
- 9:15the state of Texas where um we like to
- 9:17kill people and our courts um uh uphold
- 9:21the vast majority of death
- 9:27sentences you're looking at the evidence
- 9:30uh there's some fingerprint evidence
- 9:32there that that doesn't match right
- 9:35anybody right then the supposedly The
- 9:37Intruders could have been a set up for a
- 9:39burglary or something like that the
- 9:41burglary that went real bad it's all
- 9:43circumstantial you really doesn't have a
- 9:45motive what's the motive that's the
- 9:47possibility that you might be the wrong
- 9:50person so far the picture being painted
- 9:53for us wasn't pretty no motive outdated
- 9:56DNA testing and new evidence that true
- 10:00pointed to an unknown male Intruder but
- 10:033 weeks into our investigation we'd
- 10:06already spent more time looking into
- 10:08this case than the original detectives
- 10:10had and at this point we had serious
- 10:12doubts if dolly roer was the right
- 10:15person

- 10:43you could please give me a call we were
- 10:44trying to get in touch with the
- 10:46detectives who had been involved with
- 10:48the case we wanted to know what they had
- 10:51to say about the new DNA evidence that
- 10:53pointed to a male perpetrator neighbors
- 10:56this is a direct life for but so far we
- 10:58weren't having much luck finding them it
- 11:00must be a small department when
- 11:02investigators first arrived on the scene
- 11:05they found darly bleeding from wounds to
- 11:07her arms and neck screaming hysterically
- 11:10that someone had broken into her home
- 11:11and killed her two
- 11:13sons a search of the residents found
- 11:16nothing missing but the police did find
- 11:18the murder weapon a knife from roer's
- 11:21own kitchen then something puzzling in
- 11:25an alley almost a football fields
- 11:27distance from the house lay one of her
- 11:28husband and socks splattered with spots
- 11:31of blood later identified as belonging
- 11:33to their two murdered sons from all our
- 11:36years on the force Reggie and I had come
- 11:39across some strange pieces of evidence
- 11:41but this one stumped us it just didn't
- 11:44make any sense there have been an
- 11:46intruder yeah there could have been an
- 11:47intruder the only thing I don't like
- 11:48about it as far as the Intruder Theory
- 11:50goes is the fact that somebody broke in
- 11:54goes in there commit some sort of
- 11:56burglary kills two kids nearly kills the
- 11:58mother and leaves and 75 yards away down
- 12:02an alley is a sock is a sock belonging
- 12:05to the husband that has some blood on it
- 12:08at trial the prosecution set out to
- 12:10prove that Dolly had murdered her two
- 12:12boys rans sack the living room so it
- 12:14would look like a
- 12:16Breakin DED one of her husband's socks
- 12:18in blood from both of her dead Sons ran
- 12:21down an alley to plant the sock then
- 12:23came back stabbed her arm with a knife
- 12:26used the same knife to slash her own
- 12:27throat then called
- 12:29911 and this is where the sock was found
- 12:32this is an overhead view of the house
- 12:33you can see it here's the house three
- 12:35four houses down about four houses down
- 12:38here's where the sock is
- 12:40found it's got Devon and Damon's blood
- 12:42on it and this is Darren
- 12:48sock beautiful homes man look at
- 12:51this this has got to be on your side
- 12:54right here yeah there it is right on
- 12:56left it's all lit up that's it right
- 12:57there y
- 12:59sock was found in this Alleyway this is
- 13:01highend District here there's some
- 13:03alarms lights motion detectors and
- 13:05things you know I think lights will be
- 13:06popping on and off
- 13:09here you know regie this the thing that
- 13:11gets me is why does a socket attached to
- 13:13this murderer and dropped here in this
- 13:15alley and where do you go from here if
- 13:17you're not from this neighborhood this
- 13:18house where it's at the way it's
- 13:20secluded It Don't Fit the other side of
- 13:24they ran through the back out the
- 13:26alleyway the sock it just doesn't fit
- 13:29any bad guy I'll tell you they're always
- 13:31looking for a way out you know they
- 13:33don't want to be cornered and you back
- 13:35here you would get
- 13:41cornered right near the karate
- 13:44artery Dolly rouer had no criminal
- 13:46record in fact up to this point she
- 13:49never had much involvement with the
- 13:50police aside from watching Lauren
- 13:53order could she really be the kind of
- 13:55person who would kill her own children
- 13:58and then slash her own
- 14:01throat the 911 call seemed like it
- 14:04should have been a critical part of
- 14:05dary's
- 14:07[Music]
- 14:10defense's me you listen to the call
- 14:12sounds it sounds like a legit call I
- 14:14mean you could hear a real frantic woman
- 14:17her emotions are really running
- 14:19[Applause]
- 14:22High Toby shook who prosecuted darly
- 14:25never bought into the 911
- 14:28call to him it was all an act a
- 14:30desperate woman who resorted to
- 14:32Desperate Measures to get what she
- 14:34wanted I think what got the
- 14:36investigator's attention first very low
- 14:38crime neighborhood not no no violent
- 14:40crimes occurs in the neighborhood and
- 14:42it's obvious in this crime that the
- 14:44object of the attack were the boys these
- 14:46were devastating wounds penetrating
- 14:48knife wounds that went through their
- 14:49entire bodies Charlie rer had a
- 14:51superficial wound to her neck and one to
- 14:54her arm 2 days after she was released
- 14:57from the hospital she came to the police
- 14:58station and this would be about four or
- 15:005 days after the murder and showed up
- 15:02with these massive bruises on the inside
- 15:04of her arms how many days later she
- 15:07showed up two days after being released
- 15:08hospital I believe she she realized the
- 15:10police weren't believing her story we
- 15:12showed all those bruises to the nurses
- 15:15who attended her and the uh the
- 15:17Physicians that attended her they said
- 15:19that these bruises weren't there my
- 15:22argument uh and maintained also is that
- 15:25if this supposed to be some guy who's in
- 15:26there who wants to to kill darly rouer
- 15:30uh and he's hitting her so hard that
- 15:31he's calling these massive bruises on
- 15:33the inside of arms how come he didn't
- 15:34smash her in the face you know how come
- 15:36he didn't bust her in the nose and the
- 15:37mouth she can identify why do you leave
- 15:40her alive so she can identify but of
- 15:42course darling got amnesia it's luckiest
- 15:45killer in the world the witness who can
- 15:46put you on death row she gets amnesia
- 15:48and can't remember anything about you I
- 15:51agree with you I mean there somebody
- 15:52breaking in killing two kids and she's
- 15:54left with a cut why isn't she finished
- 15:56off right just didn't make sense and her
- 15:59story just wasn't adding up no stranger
- 16:02would come in the house that way it's
- 16:03very illogical uh you know he said first
- 16:06of all we look at uh it's a very low
- 16:08crime area these kinds of killings don't
- 16:10happen secondly this neighborhood is
- 16:12hard to get in and get out of uh if
- 16:14you're going to commit a crime like this
- 16:16especially or even a burglar you want
- 16:18some easy access you had to kind of
- 16:19wander around through the neighborhood
- 16:21you had the Andrea yat is that that was
- 16:23in Texas correct where she drowned her
- 16:25children I mean and they attribute that
- 16:27something to the postpartum depression
- 16:28question would did you ever think of
- 16:30that in these terms at all no psychotic
- 16:32there was no evidence she was suffering
- 16:34from anything like Andrea Yates had a
- 16:36long psychological history and was
- 16:38hearing voices this was a this is a
- 16:40killing that you have then you want to
- 16:41cover the crime up I know you're not a
- 16:44doctor but how would you sum up her
- 16:46behavior and describing her how would
- 16:48you describe her as a
- 16:50person she's a
- 16:54[Music]
- 16:56psychopath I got I got to tell you you
- 16:58this is some hell of a bruise isn't it
- 17:00how does you hold somebody down I don't
- 17:02know that's and create a bruise like
- 17:04that it look like a truck ran over this
- 17:06guy was holding it down she had to be
- 17:08struggling to create bruises like this
- 17:09because they run from here down to the
- 17:13wrist we only got circumstantial aidence
- 17:15got no witness statements but his
- 17:17circumstantial aidence and the way he
- 17:19explained it makes it look very bad for
- 17:23DOL a close friend of Dolly's testified
- 17:26that she had become depressed after the
- 17:28birth of her third son and had even
- 17:30threatened to commit
- 17:32suicide and several other people told us
- 17:35that darly and Darren had been having
- 17:37problems including arguments about money
- 17:41keeping up with the Joneses was tearing
- 17:42them
- 17:44apart there's a lot of evidence here I
- 17:46mean you know I I just don't buy the
- 17:48bloody sock 75 yards away found in the
- 17:50alley I don't buy the Intruder you know
- 17:54guys come in what do they do you know
- 17:56one or two whoever it was comes in and
- 17:59kills two kids like that and she gets
- 18:02slashed how come they don't kill
- 18:04her 5 weeks into our
- 18:07investigation Reggie and I had
- 18:09completely changed our opinion of darly
- 18:11we began thinking more and more that she
- 18:14was where she belonged behind
- 18:18bars but we' soon come across evidence
- 18:21that would take everything we' learned
- 18:23about this case so far and turn it on
- 18:25its head somebody came into my home and
- 18:28murdered my children and me dead
- 18:31somebody you left your children for
- 18:34[Music]

- 18:53dead look at that blank St man at this
- 18:56point in our investigation we had
- 18:58learned a lot about Dolly roer we knew
- 19:01that at the time of the murder she and
- 19:03her husband Darren had been fighting
- 19:04about
- 19:05money was it the mom
- 19:09darly even though she sustained some uh
- 19:13some wounds right near the karate artery
- 19:16supp he missed it by a few
- 19:19[Music]
- 19:24millimeters a few days after they were
- 19:26murdered 5-year-old Damon and 6-year-old
- 19:29Devon were laid to
- 19:34rest Devon and Damon
- 19:38[Music]
- 19:42yep Devin Damon little
- 19:48kids cemetery West Haven Memorial par
- 19:53the final resting place in those small
- 19:56little boys Deon and Damon man
- 20:00one of the most vicious murders in Texas
- 20:03in our town in the country 8 days before
- 20:05his
- 20:07[Music]
- 20:09birthday just days after the burials a
- 20:12local news station broadcast footage of
- 20:15Dolly at the grave site the prosecution
- 20:17used the tape as proof that dolly was a
- 20:20Sinister monster out of control and out
- 20:22of touch of
- 20:24reality but dar's mother and sister say
- 20:27the tape was taking completely out of
- 20:32context we met them at their home in
- 20:34Plano Texas Two Towns over from where
- 20:37the murders took
- 20:40place the big story about this is the
- 20:43Silly String that was your idea for the
- 20:45Silly String you're the one that bought
- 20:47that and brought that there and you can
- 20:49tell us about it it was the most
- 20:51ridiculous thing you know Devon was
- 20:54fixing to be seven we were having a
- 20:57birthday party for him he was so so
- 20:58excited and then all this happened you
- 21:01know his friends had gone out and bought
- 21:03gifts and then we had to explain to his
- 21:05friends and the neighborhood children
- 21:08that someone had come in and killed them
- 21:10and I mean how do you explain that to
- 21:11Little Children You know little children
- 21:14don't understand the grieving process
- 21:16like adults they don't understand death
- 21:18and you know these horrible things that
- 21:21happen so what children they that day in
- 21:24addition to yourselves we had a prayer
- 21:26service a prayer service and we planned
- 21:29to be there at the grave site that
- 21:31evening so all the kids could come and
- 21:34since obviously we weren't going to have
- 21:36the party it was just a way for us to
- 21:38all gather and to be together and to
- 21:40feel close and comfort and it wasn't a
- 21:44celebration of their death oh yay
- 21:47they're dead woohoo it
- 21:49was it's their birthday you know you see
- 21:52that that's the thing that was looked at
- 21:55examined by so many people people said
- 21:57was wrong it was appropriate it was so
- 22:00ridiculous they sat there and they
- 22:01watched that tape over and over and over
- 22:03again who watched it the jurs the jurors
- 22:05they didn't watch anything but the Silly
- 22:07String part so you believe I was never
- 22:10allowed to testify nobody ever asked me
- 22:12a single question about that that's too
- 22:14bad so darly sets in in death row
- 22:17because of silly string and overzealous
- 22:19prosecutors and bad police
- 22:22work she was wonderful she really was
- 22:25and it's very lonely without her
- 22:29[Music]
- 22:33she's walking around with a lot of guilt
- 22:35she really feels that she put her sister
- 22:40on death row with that silly stream
- 22:42incident meant so much to the jurors
- 22:44that they watch it so many times during
- 22:45a conviction of Dary and if it would
- 22:48have been explained the way she did I
- 22:51think they would have seen it in a lot
- 22:52different way later that evening we met
- 22:55with Tom Holland's head the retired DEA
- 22:58agent troubled by what took place at
- 23:00dar's trial he spent the past few years
- 23:03taking a look at the case for himself he
- 23:05agreed that at 22nd tape of a woman
- 23:07shooting Silly String was the final blow
- 23:10that convicted dolly
- 23:12rouer when the defense attorney was
- 23:15cross-examining the lead
- 23:17investigator he got a half about halfway
- 23:20through and the judge advised him to
- 23:22take the fifth which investigator was
- 23:25that this was Jimmy Patterson because
- 23:27Patterson had wir tap and the the grave
- 23:30site looking for a gravite confession
- 23:33the fact that a police officer took the
- 23:35Fifth Amendment to me as a jury that
- 23:37would be the end of their credibility I
- 23:39have never and I've testified I can't
- 23:41take hundreds of homicide trials I have
- 23:44never took a fifth amendment sitting on
- 23:46the web it's against self-incrimination
- 23:48and you're the you're the you're the
- 23:49you're the officer the lead officer in
- 23:51the case I can't imagine the judge
- 23:53allowing a capital murder case to
- 23:56continue when you can't cross-examine
- 23:58the lead investigator because he took
- 24:00the Fifth Amendment that's incredible
- 24:02but I'm going to tell you there's not
- 24:04one piece of direct
- 24:06evidence not really one piece of
- 24:08credible evidence why she should spend
- 24:1110 years on death row or certainly be
- 24:17executed you don't do that without a
- 24:19court order you just can't WAP somebody
- 24:22listen to a conversation let alone the
- 24:25uh the video the Audio I mean that's
- 24:27police work 101 you know that stuff I
- 24:29think that it should have been thrown
- 24:31that that whole thing should have been
- 24:33thrown out based on the investigator
- 24:35taking the Fifth Amendment if those
- 24:36things are true I think it's really big
- 24:38I mean uh to me it it sounds like darly
- 24:41could be the wrong woman in prison
- 24:46really and something like this we have
- 24:49all circumstantial evidence I say you
- 24:51know what go through everything whatever
- 24:54it is if there's some DNA evidence blood
- 24:57fingerprints whatever it take it all do
- 24:59it all test everything so we could then
- 25:01we could at least say listen we did
- 25:03everything the defense asked we checked
- 25:05it all out they got the Unexplained
- 25:07print and they they believe they have
- 25:09some DNA on the sock and I think that's
- 25:11why they got exhaust all these things
- 25:14because imagine putting somebody there's
- 25:15no taking her back once you execute her
- 25:17it's
- 25:19[Music]

- 25:25tried to follow up with the cops

- 25:42patteron police department this is Jerry
- 25:45pal from Court TV I'd like to leave a
- 25:47message for James patteron our
- 25:49investigation took on a new sense of
- 25:52urgency Reggie and I were becoming more
- 25:54and more convinced that an innocent
- 25:56woman might be sitting on death row and
- 25:59the Clock Was ticking it's about these
- 26:01two kids I mean they're the real victims
- 26:04in this they their life was cut so short
- 26:06so fast Reggie what does it mean if
- 26:08Dolly's innocent they got the wrong
- 26:10person in jail yeah and the right and
- 26:13the right person is still out there
- 26:14that's the real scary part man that a
- 26:17monster like that can be out there I
- 26:19tell you one thing I'd be locking my
- 26:23doors the next day we met with skip
- 26:26hollandsworth a local journalist who has
- 26:28covered dar's case from the very
- 26:30beginning beautiful area nice home he
- 26:32claimed to have information about dar's
- 26:34husband Darren that would blow our
- 26:36investigation wide open
- 26:40thanks if darly the victim says my
- 26:43husband Darren had nothing to do with it
- 26:45and the evidence and the prosecution
- 26:47goes with her why would they go after
- 26:49Darren why would they go after Darren
- 26:51yeah I got to know this defense attorney
- 26:54that was handling the appeals named
- 26:55Steven Cooper and he said to me Darren's
- 26:58father-in-law Bob key has suddenly
- 27:00remembered Darren coming to him a few
- 27:02weeks before the murder and
- 27:04saying I am broke I need to find someone
- 27:09who's going to break into my house steal
- 27:11all my stuff my furniture my jewelry my
- 27:14valuables hide it away in a U-Haul I
- 27:17will claim the insurance get the
- 27:19insurance money and I'll be back to even
- 27:22and then load up my house with this
- 27:23furniture that's been hidden away and I
- 27:26said well is that true and Cooper says
- 27:29go ask Darren go ask Darren so I meet
- 27:32Darren at a
- 27:33restaurant and I
- 27:35said did you hire somebody to try to
- 27:38break into your home and burglarize it
- 27:40and there was this long silence and he
- 27:42says are you going to print this and I
- 27:44said yeah and he said okay I did it I
- 27:49was asking
- 27:50around and I said did you hire anybody
- 27:52he said I never hired anybody but I did
- 27:56let the word out the story changes
- 28:00everything if true because it provides a
- 28:04motive it provides an answer to a
- 28:07question that has haunted everyone why
- 28:09would someone break into a nicely lit
- 28:11home in the middle of the night on the
- 28:13CAC of a pleasant little sub Suburban
- 28:16neighborhood and just walk in and stab
- 28:19two kids to death and cut the throat of
- 28:21their mother and slice her across the
- 28:23arm and then walk out well did you buy
- 28:26the story do you think it was for real
- 28:27that did you Darren was hardly blameless
- 28:30there had been evidence that he had uh
- 28:32tried to get someone to steal his jaguar
- 28:35and take it to a Chop Shop when he was
- 28:36going broke in
- 28:381996 and there's always been the
- 28:40question of what did Darren do after he
- 28:44discovered that his children had been
- 28:47stabbed to death mhm
- 28:50and that mystery which the prosecutors
- 28:54never went into during the trial because
- 28:57their trial was focused solely on darly
- 29:01and what was your next question to him
- 29:03are you making up this story to give
- 29:05darly some wiggle room so when the court
- 29:08of appeals hears about this they might
- 29:10give her a new trial and what was his
- 29:12reply he said no and I said do you
- 29:17realize that this story if found to be
- 29:20true could put you on the spot and right
- 29:23in the hair trigger of The Da he goes
- 29:27with the pause I want to tell you the
- 29:29truth but I don't want to do anything
- 29:32that might get me arrested and
- 29:34railroaded like darling
- 29:39did the outside chance that this could
- 29:42be true and maybe he set up his home to
- 29:45be burglarized and the word went out
- 29:47yeah this guy's looking to get his house
- 29:49burglarized and two guys one guy
- 29:51whatever comes out and does this you
- 29:54know and it turns bad and he winds up
- 29:55killing two kids and and trying to kill
- 29:58darly you know and it also leads to the
- 30:01other side of the right man wrong man
- 30:04who committed his homicide there is some
- 30:06Reasonable Doubt about this whether
- 30:09Dolly did this herself was she whether
- 30:11she was helped by her husband or whether
- 30:13he orchestrated this whole thing with a
- 30:16a burglary attempt that went terribly
- 30:19bad and two children wound up dead as a
- 30:24result after a little asking around it
- 30:26was easy enough to fine f it seemed
- 30:29everyone either knew him or knew someone
- 30:32who knew
- 30:36him you're Barry five can we ask you a
- 30:39question yeah we wanted to talk to you
- 30:42about the The Dol Rodier case do you
- 30:45remember that yeah there were my
- 30:46neighbors over there well apparently
- 30:48there were allegations made about you
- 30:51and Daron that he wanted to maybe
- 30:55arrange for a burglary of his own house
- 30:57do you remember
- 30:58he didn't talk to me about it do you
- 31:00think darly is the right person do you
- 31:02know anything about Dary what kind of
- 31:03person she was I think he did it I think
- 31:05he did it the whole time you think he
- 31:06did it I think Darren did it I just
- 31:08think he snapped you think Darren
- 31:10snapped yeah and when I went over there
- 31:13the first thing he told me he said uh he
- 31:17said rough night rough he called it a
- 31:19rough night that's it that's it didn't
- 31:21say anything about the kids or anything
- 31:23but if he I he did it ran upstairs and
- 31:25acted like he was sleeping or whatever
- 31:26he did or you know why why why but why
- 31:29didn't he kill
- 31:30Dary I think he tried and she just lived
- 31:33that's what I
- 31:38think he thought that Darren is the one
- 31:41that killed his children and C he kind
- 31:44of denied the stolen C thing that Darren
- 31:48ever came to him about his
- 31:52Jaguar F told us that he believed Darren
- 31:55had snapped due to his declining
- 31:57Financial situation and had killed his
- 32:00two young boys in a blind rage the other
- 32:03thing we have to find out about Darren
- 32:04is any involvement with the Barry F you
- 32:07know what about that is there any truth
- 32:09to that and if so uh what was it I think
- 32:12at this point he also knows that his
- 32:14name is being dropped around oh yeah he
- 32:17knows you know that he's could be
- 32:18involved in this somehow had some jugle
- 32:21things at it that weren't explored right
- 32:23supposedly The Intruders could have been
- 32:25a setup for a bur that went real bad
- 32:28course Darren was out there you know he
- 32:30had done an insurance scan before or at
- 32:32least contemplated one this could have
- 32:34been another one and just went ugly it
- 32:36went real ugly you know so there's a few
- 32:38things here as two former NYPD
- 32:42detectives we had done the sort of thing
- 32:44hundreds of times before but with this
- 32:47investigation nothing was what it seemed
- 32:50around Each corner instead of answers we
- 32:52only found more
- 32:54questions questions that can only be
- 32:56answered by darly
- 32:59herself it was time to go face to face
- 33:01with darling several people who had
- 33:04previously spoken to her Wonders that
- 33:07she was a pro at telling her story over
- 33:09and over again after all she's been
- 33:12doing it for over 10 years they're sure
- 33:14waiting the Frid this young lady because
- 33:16it's been since
- 33:181996 yeah it's 10 years already she's
- 33:21almost at the end of her appeals at this
- 33:23point you know I I would think this
- 33:26death sentence is going to be carried
- 33:28out uh probably the next few years
- 33:30that's the last that's say a few more
- 33:32years and that's about it the prison had
- 33:34strict rules about interviews we'd only
- 33:37have 40 minutes and would have to talk
- 33:39to her through bulletproof glass darly
- 33:42knew this was one of her last chances to
- 33:44convince people of her innocence if her
- 33:47final appeal is denied she'll likely be
- 33:50executed by lethal
- 33:52injection can I ask you one question yes
- 33:55do you still love your husband
- 33:58I still have love for my husband if you
- 34:00were to leave here today would you be
- 34:02with your husband no I would not why
- 34:05because I found out things that I didn't
- 34:07know about back then like
- 34:10what well I found out that Darren was
- 34:15talking to somebody about having the
- 34:17house set up for an insurance scam an
- 34:20insurance hit whatever it's called Barry
- 34:24five yes Barry five and and and they had
- 34:28talked about having his car stolen and
- 34:33Barry took the
- 34:34car and I was mad so if we're to believe
- 34:39that somebody broke in to burglarize
- 34:40your home that night and I you know I
- 34:43did I worked on a lot of cases I was in
- 34:45the police department 20 years I saw a
- 34:47lot of burglaries this is a this is a
- 34:49night burglar it's a cat burglar they
- 34:51rarely come in looking for weapons they
- 34:53have their own weapons and they take
- 34:55care of business they just come in here
- 34:56to kill two little innocent children
- 34:59kill them and almost leave you for dead
- 35:02we have to believe that right if you
- 35:04didn't do it then who did are you you're
- 35:07trying to implicate your husband in this
- 35:09no I'm not trying to implicate my
- 35:11husband at all I'm trying to tell the
- 35:14facts and no I hear the facts but it
- 35:15sounds like you're trying to implicate
- 35:17your husband doesn't it sound like that
- 35:19to you for answers maybe you had some
- 35:21financial problems is that enough to
- 35:23kill someone I know I did not kill my
- 35:25children and if you will talk to to
- 35:28other doctors and psychiatrists people
- 35:30that have been tacked people that have
- 35:32been in severe trauma evidence points to
- 35:36nobody being in that house but you
- 35:38Darren and your children somebody came
- 35:40into my home and murdered my children
- 35:43and me that is actually they didn't
- 35:46murder you doly they didn't Mur me for
- 35:48dead somebody you left your children for
- 35:51dead no I you left your children for
- 35:53them you're sitting there and you're
- 35:54lying to us no I'm not you're lying to
- 35:56us L I'm not
- 35:58we're looking at the killer right now
- 36:00doly ly Routier you haven't shed one
- 36:03tear since we're sitting here so that
- 36:06makes me not one not a tear you can well
- 36:09up theise but you can't make a tear come
- 36:11down you don't know what I do in the
- 36:13tears I've cried when I am by myself if
- 36:15you didn't kill your children who killed
- 36:18them I don't
- 36:22know Reggie and I purposely put dolly
- 36:25through the ringer and she held up well
- 36:28but we still weren't sure you're lying
- 36:31to us later that evening we popped in
- 36:33the tape of the interview and watched it
- 36:35to see if there's something we
- 36:37missed you know this scenario is
- 36:39possible and burglar one real bad look
- 36:42at the emotions she's showing I know
- 36:45maybe there's some maybe some truth to
- 36:46this thing this the thing that gets me
- 36:48about death penalty cases you have to
- 36:50review these things before you put
- 36:51someone to death you make sure I mean
- 36:53the bloody fingerprint that youan know
- 36:56about there's no taking it back when
- 36:58execute her it's

- 37:16complete stranger or if the murder
- 37:18somehow involved Darren both Reggie and
- 37:20I had a hunch that killing the two young
- 37:22rouer boys wasn't supposed to happen but
- 37:26it did and both darly and Darren have
- 37:28paid a high price as a shadow will hang
- 37:31over each of them for the rest of their
- 37:34lives in the end despite dar's
- 37:37conviction Reggie and I weren't
- 37:39convinced she was put away largely on
- 37:41circumstantial evidence to thin and
- 37:43flimsy to put someone to death
