10. 0:20uh kevin michael has been a long time

12. 0:24i wanted to they said the
13. 0:28transcripts were uh
14. 0:32we're messed up and there are errors all
15. 0:34in them and
16. 0:35and that you know
17. 0:37i just wanted to clear it up here and
18. 0:38this is the best way to do that

22. 0:46stenographer there
23. 0:47who was brought up on uh charges
24. 0:50uh
25. 0:52about that transfer
26. 0:54but here is
27. 0:56halsey didn't certify the transcript she
28. 0:58didn't even finish transcribing her
29. 0:59notes so that first transcript wasn't
30. 1:01even certified that's what they were
31. 1:02using
32. 1:04her scopus was her daughter for some
33. 1:05reason chainsaws custom lexicon to
34. 1:07confirm to her transcription rather than
35. 1:10alter our transcription to concur with
36. 1:13the lexicon this would and did cause
37. 1:16errors to multiply
38. 1:17you have to look into what lexicons are
39. 1:20for that to understand that better but i
40. 1:22understand
41. 1:25the initial investigation found that all
42. 1:26these notes were within the acceptable
43. 1:28range albeit at a lower threshold they
44. 1:31were pushing it
45. 1:33discovery of the tapes uncovered more
46. 1:35errors but the panel concluded that with
47. 1:37the tapes
48. 1:38the transcript could be corrected
49. 1:41the defense agreed to this
50. 1:45and to the recommendation of simmons as
51. 1:48the person to do it
52. 1:50see the tapes don't lie
53. 1:53there's no record of halsey scopus
54. 1:57using the tapes to transcribe the tapes
55. 1:59were locked away in a storage unit
56. 2:02at the end of the process all parties
57. 2:04agreed that sims transcript was an
58. 2:06accurate record of the trial severe j

60. 2:10who claimed he couldn't do it without an
61. 2:11accurate record of the trial but he's
62. 2:13always had one
63. 2:15the defense
64. 2:16then argued that they were entitled to a
65. 2:18transcript certified by the original
66. 2:20court recorder
67. 2:22halsey had been
68. 2:24had by this time had her license revoked
69. 2:26so the court ordered simmons to certify
70. 2:28in accordance
71. 2:30with established texas rules
72. 2:36at this point the defense claimed that
73. 2:38the
74. 2:3933k errors were grounds for appeal
75. 2:41however they didn't offer a single
76. 2:43example of a material error in the
77. 2:45simmons transcript
78. 2:49which was done by tape
79. 2:52the transcript was held up on state
80. 2:53appeal
81. 2:59habeas corpus
82. 3:01federal appeal and then
83. 3:03and an appeal to the supreme court it's
84. 3:05all held up by all these
85. 3:09uh
86. 3:09higher courts
87. 3:11so this explains
88. 3:13and explains a way
89. 3:16that the transcript was messed up and
90. 3:18everything else this explains why
91. 3:20and how they fixed it now the law all
92. 3:23the way up to the screen
93. 3:24court agreed with it so darling
94. 3:26supporters can't have that argument
95. 3:30you can't have it
