- 3:40USA Today ran an article about parents
- 3:42who killed their children or philicide
- 3:45the article cites three decades of FBI
- 3:48homicide data that shows on average 450
- 3:52children are killed every year by their
- 3:54parents
- 3:55Northeastern University criminologists
- 3:58Applied statistical models to the
- 4:01records USA Today analyzed the database
- 4:04for a detailed look at who kills who is
- 4:07killed and how
- 4:09several patterns are apparent the vast
- 4:12majority of child victims three out of
- 4:14four are under five years of age
- 4:17nearly half of all victims died from
- 4:20physical beatings or other injuries at
- 4:22the parents hands
- 4:24fathers are more likely to kill
- 4:27quote violence is a masculine Pursuit
- 4:29says Jack Levin a Northeastern
- 4:32University criminologist
- 4:34when mothers kill they are far more
- 4:37likely to kill victims under the age of
- 4:39one than children of any other age
- 4:42psychiatrists and criminologists say
- 4:45parents who killed their children tend
- 4:47to fit one of five categories
- 4:50a parent suffering a psychotic break
- 4:53a parent who thinks he is killing out of
- 4:55altruism
- 4:56because he doesn't want a child to grow
- 4:58up without him a parent acting out of
- 5:01revenge against a spouse or partner a
- 5:04parent who kills an unwanted child a
- 5:07parent who kills from neglect or
- 5:09recklessness
- 5:10quote they are all twisted perspectives
- 5:13of Love loyalty and altruism Levin says
- 5:17there are mixed motives in many of these
- 5:20cases when a parent is accused of
- 5:22killing a child it dominates headlines
- 5:24in social media
- 5:26people are fascinated by this says Sarah
- 5:29West a forensic psychiatrist at
- 5:31University Hospital's Case Medical
- 5:33Center in Cleveland
- 5:35it's an unfathomable concept
- 5:38this week we examine one of the most
- 5:40highly debated cases to come out of the
- 5:42great state of Texas
- 5:44a case that had everyone asking did the
- 5:47mommy do it
- 5:49Darley rotier was a young wife and
- 5:52mother of three but did she murder two
- 5:54of her sons
- 5:55that will be for you to decide this is
- 5:59true crime garage and this is the case
- 6:02of darlie rotier
- 6:07foreign
- 6:12[Music]
- 6:16True Crime writers is the great almost
- 6:20legendary status skip hollandsworth who
- 6:24writes for Texas monthly magazine and
- 6:27I'm using some paragraphs from a piece
- 6:29he did for Texas monthly's special crime
- 6:32issue back in July of 2002. here skip
- 6:36briefly takes us through some events
- 6:39leading up to the attack as well as
- 6:41events after the murder of two small
- 6:44boys the people in this True Crime Story
- 6:47are parents Darren and Darley rotier and
- 6:50their three sons Damon Devin and Drake
- 6:54on June 5th the boys played in the hot
- 6:57tub and that evening Damon and Devin
- 7:00huddled under blankets in front of a
- 7:02television Darren had just installed in
- 7:05the living room Darley and Darren would
- 7:08later say that they stayed up talking
- 7:10past midnight they kissed each other
- 7:13good night
- 7:14Darren went upstairs to the master
- 7:16bedroom where Drake then just seven
- 7:18months old was asleep while Darley
- 7:21curled up on the couch downstairs next
- 7:24to the two older boys
- 7:26she had been sleeping on the couch that
- 7:28week she said because she wanted to
- 7:31watch over Damon and Devin who had been
- 7:33spending the night downstairs since
- 7:35school let out and because she was a
- 7:38light sleeper and would sometimes be
- 7:40awakened by Drake turning over in his
- 7:42crib
- 7:43a few hours later a 9-1-1 dispatcher in
- 7:47roulette received a frantic call
- 7:50someone came in here Darley screamed
- 7:53they just stabbed me in my children
- 7:55in the early morning hours of June 6
- 7:591996. Devin rotier who was six and Damon
- 8:03five were murdered as they slept on the
- 8:05ground floor of the family's well-kept
- 8:07brick home and roulette a suburb east of
- 8:11Dallas
- 8:12Devin was stabbed twice in the chest
- 8:14with such force that the knife almost
- 8:16went all the way through his body
- 8:19Damon was stabbed half a dozen or more
- 8:21times in the back
- 8:23Darley who was also sleeping downstairs
- 8:25had two slice wounds to her right
- 8:28forearm and one in her left shoulder and
- 8:31her throat had been cut
- 8:33doctors said she survived only because
- 8:35the knife stopped two millimeters short
- 8:37of her carotid artery
- 8:40in a written statement given to the
- 8:42police a few days later Darley then 26
- 8:45told the following story
- 8:48she was awakened by Damon's cries of
- 8:50mommy mommy
- 8:52in the dark she didn't even notice she
- 8:54was hurt
- 8:55she saw a man moving through the kitchen
- 8:57and followed him as he went toward the
- 8:59garage
- 9:00when she got to the utility room she saw
- 9:03a knife and picked it up
- 9:05only then she said did she return to
- 9:07find Devin and Damon and realized that
- 9:10she had been stabbed too
- 9:12darley's husband Darren who was sleeping
- 9:14upstairs with their infant son Drake
- 9:16came downstairs after hearing his wife
- 9:19screams and began administering CPR to
- 9:22Devin
- 9:23by then the assailant had disappeared
- 9:26twelve days after Damon's and Devin's
- 9:29deaths the police arrested Darley for
- 9:31their murders
- 9:32they had no eyewitnesses no confession
- 9:34and no motive what they did have was an
- 9:37intriguing trail of circumstantial
- 9:39evidence that suggested there was no
- 9:41Intruder that night
- 9:43physical evidence suggested that Darley
- 9:45had staged the crime doctor's statements
- 9:47suggested her wounds were self-inflicted
- 9:49and there was a peculiar scene caught on
- 9:52videotape a few days after the murders
- 9:54on what would have been Devin's seventh
- 9:57birthday Darley drove to the cemetery
- 9:59with friends and family wished her son a
- 10:01happy birthday and then sprayed Silly
- 10:03String all over his grave
- 10:05quote here's a mother who has supposedly
- 10:08been the victim of a violent crime said
- 10:10Dallas County assistant district
- 10:12attorney Greg Davis the lead prosecutor
- 10:14in the case
- 10:16she has just lost two children and yet
- 10:19she's out there literally dancing on
- 10:22their graves after the murders Darley
- 10:25gave conflicting accounts of what
- 10:27exactly the Intruder had done to her
- 10:30one officer said she told him that she
- 10:33had struggled with her assailant on the
- 10:34couch
- 10:35another officer said she told him the
- 10:38struggle was at the kitchen counter a
- 10:41friend who talked to Darley while she
- 10:44was in the hospital said Darley told her
- 10:46that she remembered lying on the couch
- 10:48as the man was running the knife over
- 10:50her face but in her formal written
- 10:53statement to police Darley said her only
- 10:56view of the man came as he was walking
- 10:58away from the couch she said she just
- 11:01couldn't remember any distinct details
- 11:04about the attack or the killer except
- 11:07that he was wearing dark clothes and a
- 11:10baseball cap was it really possible that
- 11:13Darley who could be awakened by her baby
- 11:16moving in his crib had slept through the
- 11:19stabbings of her sons a few feet away
- 11:21now Captain roulette PD were suspicious
- 11:24regarding darlie early in their
- 11:27investigation saying that they were
- 11:29tipped off by a few different things one
- 11:33being the 9-1-1 call
- 11:34darley's Behavior and the crime scene
- 11:38evidence versus darley's account of the
- 11:41events of that night we're gonna play a
- 11:43little clip of her 911 call it's really
- 11:46hard to make out what's happening but
- 11:48just so you can hear her energy on the
- 11:50call and then how intense the call is

- 13:27and that was just the brief start of a
- 13:31call that came into the Rowlett Police
- 13:33Department June 6 1996 at 2 31 A.M
- 13:39and because the police are saying that
- 13:42this is one of the things that pointed
- 13:44them toward Darley as being their prime
- 13:47suspect in the murder of her two sons I
- 13:50think that we should go through the
- 13:52transcript of that call to see if we
- 13:54agree with their assessment and reading
- 13:56for the responders will have the captain
- 13:58and reading for Darley rotir you have

- 14:04emergency somebody came here they broke
- 14:07in ma'am they just stabbed me and my
- 14:09children what they stabbed me and my
- 14:12kids my little boys who who did my
- 14:15little boy is dying hang on hang on hang

- 16:09dying what is going on somebody came in
- 16:12while I was sleeping me and my little
- 16:14boys were sleeping downstairs some man
- 16:16came in stabbed my baby stabbed me I
- 16:19woke up I was fighting he ran out
- 16:21through the garage threw the knife down
- 16:23my babies are dying they're dead oh my
- 16:25God okay stay on the phone oh my God
- 16:28what happened hold on honey hold on who
- 16:32was on it was the white phone hold on
- 16:35they are wondering when we need to
- 16:38dispatch so I sent a double team oh my
- 16:41God oh my God
- 16:43okay thanks oh my God oh my God ma'am
- 16:47who's there with you Karen ma'am what is
- 16:51there anyone in the house besides you
- 16:53and your children no my husband he just
- 16:56ran downstairs he's helping me but they
- 16:58are dying oh my God they're dead okay
- 17:00okay how many little boys is it two boys
- 17:04there's two of them there's two
- 17:07what's a cross street on the address on
- 17:10Eagle oh my God who would do this listen
- 17:12to me calm down I feel really bad I
- 17:16think I'm dying when are they going to

- 17:24be here going to be a stabbing when are
- 17:27they going to be here ma'am they're on
- 17:29their way I gotta just sit here forever
- 17:32oh my God

- 17:36ma'am how old are your boys what how old
- 17:39are your boys
- 17:40seven and five okay oh my God oh my God
- 17:44oh he's dead calm down can you oh God
- 17:48Devin no oh my God is her name Darley
- 17:51yes this is her is your husband's name
- 17:54Darren yes please hurry God they're
- 17:57taking forever there's nobody in your
- 17:59house there was was you don't know who
- 18:03did this then a police officer is on the
- 18:06scene and you can hear him say look for
- 18:08a rag Darley replies they killed our
- 18:12babies the police officer says lie down
- 18:14okay just sit down darlie rotier says no
- 18:17he ran out uh they ran out in the garage
- 18:20I was sleeping my baby's over here
- 18:22already cut can I phone is right here
- 18:25you all look out in the garage look out
- 18:28in the garage they left a knife lying on
- 18:31there's a knife don't touch anything I
- 18:34already touched it and picked it up
- 18:35who's out there is anybody out there I
- 18:38don't know I was sleeping okay ma'am
- 18:40listen there's a police officer at your
- 18:42front door is your front door unlocked
- 18:45yes ma'am but where's the ambulance
- 18:47okay they're barely breathing
- 18:51if they don't get it here they're going
- 18:53to be dead my God they're hurry please
- 18:56hurry okay there there police officer
- 18:59says what about you is 82 out on Eagle
- 19:03huh they took they ran
- 19:07Eagle 5801 Eagle my God
- 19:1082 are you out police officer nothing's
- 19:14gone Mrs rotier
- 19:15oh my God oh my God why would they do
- 19:18this police officer the problem Mrs
- 19:20rotier would he say why would they do
- 19:24this I'm okay listen ma'am need to need
- 19:28to let the officers in the front door
- 19:30okay ma'am
- 19:32what what need to let the police
- 19:35officers in the front door his knife was
- 19:37lying over there I already picked it up
- 19:39okay it's all right it's okay God I bet
- 19:43if we could have gotten the prince maybe
- 19:45maybe ma'am hang on hang on a second
- 19:48somebody who did it intentionally walked
- 19:50in here and did it Darren there's
- 19:52nothing touched
- 19:54okay ma'am there's nothing touched oh my
- 19:57God ma'am is the police officer there
- 19:59yes okay go talk to him okay the total
- 20:03length of the call is 5 minutes and 44
- 20:06seconds long

- 20:48obviously but what's your thoughts
- 20:50captain on Darley rotier you've had a
- 20:53chance to actually listen to the 9-1-1
- 20:55call she's hysterical through most of it
- 20:59it's very chaotic but it's five minutes
- 21:03long so it's long enough to really get a
- 21:06feel for what's going on and probably
- 21:08have an opinion on what it is you're
- 21:11hearing and deduce maybe some of the
- 21:14emotions the thoughts or even suspicions
- 21:16going on with her on the call yeah it's
- 21:19hard to tell if she's acting or reacting
- 21:22because it is a mom supposedly coming
- 21:26out of her sleep and seeing her kids
- 21:29dying in front of her and the amount of
- 21:32blood that's probably at the scene
- 21:35but it seems like there's no coherent
- 21:38thought that she's giving to the
- 21:40dispatcher
- 21:42except for a couple lines
- 21:45and those seem to be the lines that are
- 21:48suspicious
- 21:50where she you know his knife was laying
- 21:53there and I already picked it up I bet
- 21:56if we could have gotten the fingerprints
- 21:58Maybe
- 22:00that line almost seems to me that she's
- 22:04about to say well I bet if
- 22:07if I hadn't touched the knife we could
- 22:09have got fingerprints
- 22:10but also she is basically establishing
- 22:15a reason why she touched the knife and
- 22:18why her fingerprints would be on the
- 22:20murder weapon and that's what law
- 22:22enforcement will point out as well as
- 22:24the prosecutors later that this is the
- 22:27problem with her 911 call that she's
- 22:28referencing the knife does not need to
- 22:31mention the knife does not need to
- 22:32mention that she picked it up it's
- 22:34almost like she's planting that
- 22:36information for everybody to be aware of
- 22:39hey you'll probably find my fingerprints
- 22:42on this knife because I'm telling you
- 22:43now I picked it up and you might not
- 22:46find in intruder's fingerprints on the
- 22:49knife because I picked it up after he
- 22:52threw it down
- 22:53the thing is though it's a little
- 22:55difficult when you review the transcript
- 22:58of the 9-1-1 call and after you've heard
- 23:01the actual audio for the call itself
- 23:05because the first time that she mentions
- 23:07really finding the knife or that
- 23:09somebody
- 23:10threw down a knife she's responding to
- 23:14she's answering the operator's question
- 23:16the operator's question was what is
- 23:18going on
- 23:19to which she says someone came in while
- 23:21I was sleeping me and my little boys
- 23:23were sleeping downstairs the other issue
- 23:25with the transcript too is you have
- 23:27multiple dispatchers or operators
- 23:30communicating there at times in the 911
- 23:33call communicating with each other and
- 23:35not Darley
- 23:36you know they're responding to oh we
- 23:39need emergency services to this address
- 23:41and then you have the other dispatcher
- 23:43or operator saying something to the
- 23:46effect of Emergency Services have been
- 23:48dispatched or have been dispatched at
- 23:50this time and one of the things we
- 23:52weren't able to do because it was just
- 23:54us two reading the transcript and I
- 23:57don't think the transcript is that clear
- 23:59but if you listen to the 911 tape
- 24:03at some point when her husband comes
- 24:06downstairs and she's going oh my God oh
- 24:09my God he starts going oh my God oh my
- 24:13God
- 24:14reacting the same level of intensity she
- 24:18is
- 24:20so for somebody to say that she's acting
- 24:23I would say well then I guess the
- 24:25husband's acting as well which is
- 24:27difficult again because as
- 24:30you know you hear him come into the
- 24:32scene
- 24:33the way that he's behaving
- 24:36suggests to me that he might be seeing
- 24:39this all for the very first time right
- 24:41he's walking into some [ __ ] and he's
- 24:43like oh my God what what the hell is
- 24:45going on
- 24:46yeah I have no clue and I've just walked
- 24:49into pure chaos blood all over my family
- 24:53yeah so the first time she mentions that
- 24:56knife
- 24:57it's her reacting to the operator's
- 25:00question of what is going on and at that
- 25:03point when she says
- 25:06that the man he ran out through the
- 25:09garage that threw the knife down my
- 25:12babies are dying they're dead oh my God
- 25:15she makes no mention of her picking up
- 25:18the knife on that first go around of
- 25:21that question
- 25:22which is interesting to me because if it
- 25:24was information that she really thought
- 25:26that she needed to plant and get out
- 25:27there and provide to everyone in the
- 25:30Heat of the Moment well she's certainly
- 25:31passed on it on the first opportunity
- 25:34well and then the other one she says uh
- 25:37you all look out in the garage look out
- 25:39in the garage they left a knife laying
- 25:42on there's a knife don't touch it and
- 25:45that's when she says why I already
- 25:47touched I picked it up
- 25:48but but I think it's weird though and I
- 25:51don't know what she's actually intending
- 25:54to mean when she says somebody who did
- 25:57it intentionally walked in here and did
- 26:00it
- 26:01that's odd then intentionally there's
- 26:04nothing touched and I don't know if she
- 26:07she meant that the Intruder came in and
- 26:10didn't touch anything
- 26:12but that's an odd line to me but again
- 26:16she I mean she stabbed over four times
- 26:19how much of her body is in shock how
- 26:22much is she in shock from seeing her not
- 26:25just her kids dead but they're dying
- 26:29they're dying in front of her yeah if
- 26:31she's not guilty she's 100 in shock
- 26:34regardless of injuries or or what have
- 26:36you she would be absolutely in shock
- 26:39just at the sight of her children being
- 26:41bloodied like that and you can hear
- 26:43let's pretend for a moment that she is
- 26:45in fact innocent
- 26:46you can hear that she is fully aware the
- 26:50visuals that she is waking up to and
- 26:52seeing
- 26:53that she is aware that they are dying
- 26:56and that is that's the gotta be the
- 26:59complete shock but to address the first
- 27:01thing that you had mentioned back to the
- 27:04knife when it's brought up the second
- 27:06time
- 27:07as you pointed out that the information
- 27:10is prompted by the operator don't touch
- 27:14anything well I already touched it
- 27:16you know she doesn't mention touching it
- 27:18until it's brought up by someone else
- 27:20and then as you pointed out I think
- 27:23the difficult thing here is at some
- 27:25point there's a lot going on in in very
- 27:29quickly in the call there's a lot going
- 27:31on because What You Can Hear What I Hear
- 27:33anyway and I'm sure everybody will have
- 27:34a slightly different opinion on what
- 27:36they are hearing and what they believe
- 27:38after reviewing the transcript what I am
- 27:41hearing or believe that I am hearing is
- 27:44that Darley is trying to give the proper
- 27:47information to the operator
- 27:49but she's also kind of running and
- 27:52scrambling around the house I mean
- 27:54Envision this if if she is innocent
- 27:57she's waking up to the children dying
- 27:58and she's got injuries herself
- 28:01probably doesn't fully understand what
- 28:03had happened if she did in fact see or
- 28:06chase someone as they were leaving out
- 28:09of the home there's probably a lot of
- 28:11running around to make sure they're not
- 28:12coming back but also she doesn't know
- 28:15what happened to her husband or what
- 28:18happened to her her newborn and she's
- 28:21also trying to tend to the children from
- 28:24time to time I mean you can hear her
- 28:25kind of checking in on the children even
- 28:28though we will have officers and People
- 28:30First Responders later saying that she
- 28:32didn't seem to want to tend to the
- 28:34children but they weren't there for the
- 28:36early parts of this call this is very
- 28:38similar of a 9-1-1 call to me as as the
- 28:42Michael Peterson where he's talking to
- 28:46the dispatcher and then going back and
- 28:49checking on his wife and then going back
- 28:51and talking to the dispatcher it seems
- 28:54very similar
- 28:55but it's it's tough because I think your
- 28:58gut tells you if if they're over
- 29:01dramatic that they're putting on a show
- 29:03but if they're under dramatic about it
- 29:07then they're cold-hearted so it's almost
- 29:09like you can't win either way
- 29:12as far as what your gut reaction is
- 29:15going to be to a 9-1-1 call like this
- 29:17still on some of the things that you had
- 29:19brought up here Captain the portion of
- 29:21saying someone intentionally came in
- 29:23here nothing was touched nothing was
- 29:24touched I don't know we can if we can
- 29:27understand what she means by that first
- 29:29of all
- 29:30and second of all
- 29:32I don't think we know who she's even
- 29:35speaking to when she's saying those
- 29:37words right because we also don't know
- 29:39if the police officer that's there
- 29:41that's where it's confusing too is the
- 29:44transcript states that the police
- 29:45officers are there way before the
- 29:48dispatcher is able to get Darley to
- 29:51confirm that the police officers are
- 29:53there so did the police officer say
- 29:55something did her husband say something
- 29:57to her to prompt that like maybe the
- 30:00police officer says to her don't touch
- 30:02anything and she says nothing's been
- 30:05touched
- 30:06like other than the knife nothing's been
- 30:09touched I haven't touched anything right
- 30:10and again she we don't know who she's
- 30:12speaking to because we have Darren that
- 30:15arrives downstairs at some point she is
- 30:17interacting with him at portions of the
- 30:19call she's interacting with the operator
- 30:21and then you can hear operator and
- 30:23additional dispatchers on so there's
- 30:25some confusion there as well and again I
- 30:29hear Parts where she's clearly at least
- 30:32looking over or tending to the children
- 30:34in some form or fashion so we don't know
- 30:37who those words were intended for so it
- 30:39gets difficult to say that she's
- 30:41planting information for people later to
- 30:46use that as part of their investigation
- 30:49and then there's one part that became a
- 30:52point of contention in this case and
- 30:55that was where she says some man came in
- 30:58stabbed my baby stabbed me I woke up I
- 31:00was fighting he ran out through the
- 31:03garage threw the knife down my babies
- 31:04are dying they're dead oh my God okay so
- 31:07the reason why this is a point of
- 31:09contention is because the law
- 31:11enforcement and the prosecution will
- 31:13point out that oh you told the
- 31:16dispatcher you were fighting with the
- 31:18Intruder so how do you not have
- 31:21a description of this guy
- 31:24if you if you remember if you were
- 31:27actively fighting with him you should
- 31:29have some kind of description to provide
- 31:31to us and we know that she had such a
- 31:34very vague description she said later
- 31:38that and would you agree that the
- 31:41quality of the call the audio for the
- 31:43call is not the best it's awful it's
- 31:46it's it's not good so if she says that
- 31:49she said I woke up and I was frightened
- 31:52or it was frightening I don't know
- 31:55exactly what she says I've listened to
- 31:57it a bunch and I could be swayed either
- 32:01way I could be swayed either way the
- 32:03audio quality is so poor
- 32:05I can't tell if she's saying it was
- 32:07frightening I was frightened or I was
- 32:09fighting tell me if I'm wrong in this
- 32:11statement but investigating this a
- 32:14couple things jump out as far as her
- 32:17story whether
- 32:19her story changed or not we have police
- 32:21officers saying that she told them
- 32:23different stories we have friends saying
- 32:25that she Twisted her stories here and
- 32:27there like little tiny details
- 32:30altered
- 32:31her husband is saying whatever statement
- 32:34that she gave to the police the final
- 32:35statement that's the statement she's
- 32:38stuck with all these years
- 32:41and they even have
- 32:43you know defense attorneys and and
- 32:45lawyers saying hey whatever story she
- 32:48initially told that's the story she
- 32:50stuck with she's never changed it so one
- 32:54could she have just messed up uh some of
- 32:57the details because she was in shock and
- 32:59because of all this stuff that was going
- 33:01on
- 33:02we know that eyewitnesses can be wrong
- 33:05so are these people just reporting the
- 33:08information wrong that she told them
- 33:10well and we have to keep in mind what's
- 33:13going on at the scene when she calls
- 33:16when she first places the call again the
- 33:18call is five minutes 44 seconds long
- 33:21before she hangs up the phone before the
- 33:24end of the call police are on the scene
- 33:27and she's unaware that they are there
- 33:29the officer's probably calling into
- 33:32dispatch saying hey I'm here but the
- 33:34front door's locked
- 33:36yeah they're saying ma'am or the police
- 33:38there and she says yes and she says well
- 33:40there's a front door unlocked and she
- 33:42says yes and she then the dispatcher
- 33:45comes back and says you're going to have
- 33:46to unlock the front door so one thing in
- 33:49I think in her favor here for her to be
- 33:52innocent
- 33:53is the fact that the the call is this
- 33:56length of time and she's on the phone
- 33:59with the dispatcher still when police
- 34:01arrive on the scene so we we have we we
- 34:04can't see what she's doing right we
- 34:07don't know exactly what she's doing
- 34:09physically during the course of this
- 34:11call however we do know that she is at
- 34:13least busy with the call itself for this
- 34:16amount of time so during this time it
- 34:18would be it makes it a little extra
- 34:19difficult for her to be further staging
- 34:22the scene while on the phone and police
- 34:26are arriving before the end of the call
- 34:28plus as you pointed out at some point
- 34:30Darren comes downstairs after he hears
- 34:32the commotion she does not it doesn't
- 34:35sound like she woke him you know
- 34:37intentionally
- 34:38went upstairs and woke him that he heard
- 34:42the commotion and came down on his own
- 34:44to walk into this horrific scene one
- 34:46just to let everybody know to understand
- 34:50the way in which this Intruder entered
- 34:54the house they they cut a screen and a
- 34:57window
- 34:58in the garage
- 35:01got through that window in that garage
- 35:03got inside the garage and then went
- 35:06through the house
- 35:07that way so I think the fact that the
- 35:10police show up in the front door is
- 35:12locked
- 35:13at least leads more towards her story
- 35:16making sense
- 35:19and when they show up on scene
- 35:22we have Devin
- 35:24who is already dead we have Damon who is
- 35:27still alive when First Responders get to
- 35:30the scene
- 35:31we have Darley who's bloodied she's
- 35:33running around and we have Darren who is
- 35:35downstairs performing CPR on Damon and
- 35:39baby Drake is still upstairs at this
- 35:42point yeah so hold on for one second
- 35:44because
- 35:45okay postpartum depression
- 35:49what's the motive here
- 35:51can anybody give me
- 35:54a motive of why she'd want to do this
- 35:57you want to get rid of to your kids but
- 36:00not all of the kids
- 36:02you
- 36:04you didn't try to kill your kids and
- 36:06then blame it on your husband to get rid
- 36:09of him you don't you didn't try to
- 36:10attack him
- 36:12nobody else was attacked other than who
- 36:15was in that front room
- 36:19and
- 36:21if if she's guilty
- 36:24and she wanted to kill her kids
- 36:27why would she wake her husband up
- 36:31before
- 36:32the kids were dead
- 36:36well you see what I'm saying because but
- 36:39again she doesn't actively it doesn't
- 36:42show any intention of her purposely
- 36:44waking Darren
- 36:47what I where where my questions go to is
- 36:50if she were to kill her sons
- 36:53and Stage the scene
- 36:57right why would she call 9-1-1 when one
- 36:59of them is still alive right because now
- 37:01you're running a huge risk of you know
- 37:04these kids are old they're still little
- 37:05kids but they're old enough that they
- 37:07could tell yeah my mom stabbed me yeah
- 37:10if they're still alive they could tell
- 37:11the First Responders what what actually
- 37:13went down so
- 37:15you can hear her on the phone she is
- 37:18aware that one of them is still alive
- 37:20so why would she call why wouldn't she
- 37:23just wait a few more minutes right and
- 37:26then call and act all hysterical and and
- 37:29I guarantee you she was being hysterical
- 37:32way before the 9-1-1 call
- 37:37and
- 37:39again that points towards why would you
- 37:42want to wake
- 37:44I mean look
- 37:46you don't know if the
- 37:49she's not a medical expert so if she
- 37:52again if the purpose is just to kill
- 37:54these kids and to get rid of them
- 37:57then her husband comes down
- 37:59but at the time he comes down aren't
- 38:02both of the boys alive
- 38:04so that would give I2 chances for the
- 38:07victims to say mom did this
- 38:11that I don't know I all I can say is
- 38:14that when
- 38:15well in fact actually we do have some
- 38:18evidence toward that that thought there
- 38:21captain and we will get into that a
- 38:24quick little timeline here before we get
- 38:26to what I believe are two very key parts
- 38:30of this whole story which would be the
- 38:32statements of Darley and the statements
- 38:35of Darren okay that's going to add us a
- 38:37little more insight into what is
- 38:39actually going on and you already
- 38:41referenced some items at the crime scene
- 38:43itself and we'll get into those as well
- 38:45but real quick here captain on June 6
- 38:481996 that is when Devin and Damon ages
- 38:53six and five were murdered again Damon
- 38:56is still alive at the point when the
- 39:00First Responders get to the scene Darley
- 39:02is taken immediately to the hospital
- 39:05because she has suffered some injuries
- 39:07during the course of this attack then we
- 39:10have a situation where on June 8th
- 39:12Darley gives a written statement to
- 39:15police okay so this statement that she
- 39:18provides to police
- 39:20the information I have says that it took
- 39:22her approximately 30 minutes to write
- 39:25this statement for the police and this
- 39:28she gave to them a written statement
- 39:30once she was released from the hospital
- 39:32so she's released from the hospital and
- 39:35she is immediately directly taken to the
- 39:38police station at the police request to
- 39:40provide this statement
- 39:43and in her statement she says Darren and
- 39:46Dana
- 39:47her husband and my sister came home from
- 39:50working at the shop
- 39:52the boys were playing with the
- 39:54neighborhood kids outside I was
- 39:56finishing up dinner Damon came home and
- 39:58Devin called and I told him to be home
- 40:01soon because we were going to eat Darren
- 40:04played with the baby this is the infant
- 40:06Drake
- 40:07with Dana her sister while I pulled
- 40:10everything together to eat Devin came
- 40:12home and we all ate dinner together it's
- 40:14too many people with d names after we
- 40:17ate we cleaned all the plates I changed
- 40:19I was changing Drake while Darren put
- 40:22everything in some containers for
- 40:24leftovers
- 40:25we all talked a little bit about how
- 40:28happy we were that the shop had been so
- 40:30busy for the past three weeks as that we
- 40:33had hoped it would continue since work
- 40:35had been slow for a couple of months
- 40:37Devin and Damon asked if they could play
- 40:40with one of their friends a little
- 40:42longer so we said okay
- 40:44Darren Dana and I sat around and watched
- 40:49a little TV
- 40:50later I'm not sure of exact time I asked
- 40:54Darren to drive Dana home because I
- 40:57wasn't feeling too well while Darren was
- 40:59gone the boys brought down their
- 41:02blankets and pillows and asked if they
- 41:04could watch TV I said yes
- 41:06they came downstairs and played on the
- 41:08floor in front of the TV with Drake
- 41:10while I made some popcorn about 20 to 25
- 41:13minutes later Darren came Darren came in
- 41:17and sat down with us while we watched TV
- 41:19Drake started to get fussy so I made him
- 41:22a bottle
- 41:23soon after the boys fell asleep Darren
- 41:26took the baby upstairs and put him in
- 41:28his crib and came back downstairs
- 41:31we talked about a few problems we were
- 41:33having with the car and the boat and had
- 41:36a few words between us
- 41:38since I had the baby I have been having
- 41:40some depression I told Darren I was
- 41:43depressed because I hadn't been able to
- 41:45take the boys anywhere because we only
- 41:48had one car
- 41:49he told me he loved me and asked me if I
- 41:52wanted him to sleep downstairs with me
- 41:54because I wanted to stay up and watch a
- 41:57little TV I told him no because I didn't
- 42:00think he would be able to sleep on the
- 42:02couch and get any sleep I had been
- 42:04sleeping on the couch the past week or
- 42:06so off and on because the baby slept in
- 42:09our room in the crib and when he moved
- 42:12he woke me up
- 42:14Darren and I laid together for a little
- 42:16bit while then decided to go to sleep
- 42:20because he had to work the next day this
- 42:23was around 12 30 or 1. I'm not sure he
- 42:27kissed me and said he loved me and I
- 42:29told him I loved him and would see him
- 42:31in the morning
- 42:33after a while I started to get sleepy
- 42:35the next thing I wake up and I feel
- 42:38pressure on me I felt Damon press on my
- 42:41right shoulder and heard him cry
- 42:44this made me really come awake and I
- 42:47realized there was a man standing down
- 42:49at my feet walking away from me
- 42:52I walked after him and heard glass
- 42:54breaking I got halfway through the
- 42:57kitchen and turned back around to run
- 42:59and turn on the light
- 43:01I ran back towards the utility room and
- 43:03realized there was a big white handled
- 43:05knife lying on the floor it was then
- 43:08that I realized I have blood all over me
- 43:11and I grabbed the knife thinking he was
- 43:13in the garage so I thought he might
- 43:16still be there and I yelled for Darren
- 43:19I ran back through the kitchen and
- 43:21realized the entire living area had
- 43:23blood all over everything I put the
- 43:26knife on the counter and ran into the
- 43:28entrance turned on the light and started
- 43:30screaming for Darren I think I screamed
- 43:33twice and he ran out of the bedroom with
- 43:36his jeans on and no glasses and was
- 43:38yelling
- 43:39what is it what is it I remember saying
- 43:42he cut them he tried to kill me my neck
- 43:45he ran down the stairs and into the room
- 43:48where the boys were I grabbed the phone
- 43:50and called 9-1-1 Darren started giving
- 43:53Devin CPR while I put a towel on my neck
- 43:57and a towel over Damon's back I remember
- 43:59telling Damon to hang on mommy was there
- 44:02I looked over at Darren and saw the
- 44:05glass table had been knocked halfway off
- 44:07and the flower arrangement had been
- 44:09knocked over
- 44:10I then stood up and turned around and
- 44:13saw glass all over the kitchen floor I
- 44:16tried to glance over to see if anything
- 44:18was out of place or if anything was
- 44:20missing I took a few steps and opened
- 44:23the door and screamed for Karen okay so
- 44:25this is Karen Neal it's their neighbor
- 44:28and friend she's also a nurse
- 44:30I was still on the phone with 9-1-1 and
- 44:33I don't recall what all was said because
- 44:35everything was happening so fast
- 44:38I went back to Damon and by then he had
- 44:41stopped moving and the police walked
- 44:43through the door the paramedics came and
- 44:45tried to work on the children Darren was
- 44:48screaming who did this who did this and
- 44:52I started asking if my babies were dead
- 44:54Darren was crying and said yes
- 44:56after I just remembered screaming and
- 44:59showing Darren my neck
- 45:01Darren took me out to the front of the
- 45:04house and by then Darren ran upstairs to
- 45:06make sure the baby was okay and then
- 45:08handed him to Karen our neighbor I
- 45:11remember them holding a towel on my neck
- 45:13and wrapping my arm and then they put me
- 45:16in an ambulance
- 45:18Darren got in but they told him he
- 45:21needed to leave so they could take care
- 45:23of me
- 45:24I remember we got to the hospital and
- 45:27them telling me they were taking me to
- 45:30surgery
- 45:31they took off my necklace and put me to
- 45:33sleep I woke up and minutes later the
- 45:36detectives were there making me all
- 45:38kinds of questions
- 45:39at the same time here Captain keep in
- 45:42mind darley's been rushed from the
- 45:44hospital directly to the police station
- 45:46to give that statement we have her
- 45:49husband Darren he's now providing a
- 45:52written statement as well at the same
- 45:54time and his statement reads as follows
- 45:57we were watching TV in the Roman room
- 45:59watching movie on HBO
- 46:02baby Drake had fallen asleep about 10 10
- 46:0530. I took him up to bed in parents room
- 46:07put blanket on him and turned out lights
- 46:10I went downstairs to talk to Darley we
- 46:13talked about the boys not being able to
- 46:15start baseball yet because we were so
- 46:17busy with the baby right now
- 46:19we talked about the business bills and
- 46:21how Darley was having a hard time with
- 46:23taking care of the babies today Darley
- 46:26said she wanted to sleep on the couch
- 46:28because she would sleep better because
- 46:30the baby would keep her awake the boys
- 46:32were asleep with pillows and blankets on
- 46:35the floor
- 46:36Devin was asleep face up in front of the
- 46:39TV and Damon was asleep between the
- 46:41couch and coffee table by the couch mom
- 46:44was on
- 46:45so I went upstairs to get her a blanket
- 46:48and pillow and came back downstairs to
- 46:50cover her up we talked a little more
- 46:52about her going to Cancun with some
- 46:54friends across the street and gave her a
- 46:57kiss goodnight
- 46:58told her to dream about me and went
- 47:00upstairs around 1am
- 47:02I went and turned on TV in our room and
- 47:05watched for 10 to 15 minutes I took my
- 47:08glasses off and turned TV off
- 47:10I could not go to sleep for a while but
- 47:12finally I fell asleep unconsciously I
- 47:15heard a noise and then Darley screaming
- 47:18loud she was yelling Devin Devin oh my
- 47:22God Devin I woke up quickly and grabbed
- 47:24my glasses on the nightstand and ran
- 47:27downstairs as fast as I could
- 47:29going into the living room
- 47:31I ran over to Devin lying on the floor
- 47:33where he was when I
- 47:36saw him last and kneeled down over him
- 47:39to see if he was hurt and then looked
- 47:42at the coffee table to see it tipped
- 47:45over on him
- 47:46when I looked again at his chest there
- 47:49were two holes in his chest with blood
- 47:51and muscles piercing out
- 47:53I slapped his face to get him to say or
- 47:56look at me
- 47:58no response I started CPR and when I
- 48:01blew into his mouth air came out of his
- 48:04chest I blew five or six times and held
- 48:07my hand over the holes on his chest
- 48:10then when that didn't work I blew into
- 48:13one of the holes in his chest I looked
- 48:16over at Darley and she was on the phone
- 48:18calling 9-1-1 I ran over to Damon lying
- 48:21on the floor in the hallway between wall
- 48:24and side of couch
- 48:26he had no pulse but I could not see any
- 48:29injuries police came in and I told them
- 48:32that my babies were stabbed and she told
- 48:35them that he went out of the garage I
- 48:38ran upstairs to put my pants on I looked
- 48:41over at Drake was crying and I felt he
- 48:44was okay I noticed my wallet left on the
- 48:47floor and all I could think to do was to
- 48:50go to Karen's house for help I needed
- 48:52someone to help and the paramedics when
- 48:55they arrived I went downstairs ran out
- 48:59the house ran across the street to Karen
- 49:01and Terry door
- 49:02I banged five six times as hard as I
- 49:06could until Terry comes to the door
- 49:07first and when I told them that Devin
- 49:11and Damon were stabbed they were in
- 49:13shock and ran over with me to the house
- 49:16and that was when they were putting
- 49:19Damon on a stretcher I knew that Devin
- 49:21was dead before I ran across the street
- 49:24and Damon had no pulse but the paramedic
- 49:27carried him out in a blanket out the
- 49:30front door
- 49:31I ran out yelling that we have to find
- 49:34who did this and Karen told me that
- 49:36Darley was cut too
- 49:38I never knew that she was hurt yet she
- 49:40had blood all over her from the neck
- 49:43down to the bottom of her night shirt
- 49:45she was standing in the doorway with the
- 49:48paramedics said she needed to go to the
- 49:50hospital so we helped her into the
- 49:53stretcher and she said Darren you have
- 49:55to promise me we will find this man he
- 49:58killed our babies
- 50:00I walked back into the house pushed my
- 50:02way through the police and saw the knife
- 50:05on the bar in the kitchen with blood all
- 50:07over it went to garage to look at the
- 50:10window that the police had said he had
- 50:12entered and I went out of the house and
- 50:15walked across the street and the
- 50:17neighbors were there to confront me and
- 50:19ask about what happened
- 50:21I sat for a minute on the curb and
- 50:24walked over to the ambulance where Damon
- 50:27was an ass paramedic was he alive and
- 50:30they said no I was in shock Karen told
- 50:34me to go with Darley in the ambulance
- 50:36so I got in and they threw me out said
- 50:39they needed to work
- 50:40so then they ask me questions
- 50:44from the fire department he says they
- 50:46wanted to know his social security
- 50:47number address and name and such and I
- 50:49asked what hospital and no one knew
- 50:52so found out where Darley went this
- 50:54would have been Baylor Dallas Hospital
- 50:56and drove over to the hospital at
- 50:59hospital I was questioned by detective
- 51:01frosh for hours is there any eyewitness
- 51:04statements neighbor Hood statements that
- 51:07heard her scream or saw anything
- 51:10suspicious that night
- 51:12so in reviewing the trial in the
- 51:15testimony of witnesses and such no there
- 51:20doesn't seem to be anybody that was
- 51:22aware that something was going on that
- 51:24night until they were alerted by either
- 51:26Darren or police or you know saw the
- 51:30the flashing lights and heard the sirens
- 51:32right there were plenty of people to
- 51:35have an opinion about
- 51:36darlie's Behavior what kind of mother
- 51:39she was and plenty of opinions about the
- 51:43rotiers in general
- 51:45so to me Captain the thing that jumps
- 51:47off both Pages here from their
- 51:49statements is they don't seem to line up
- 51:52100 with each other's statements
- 51:55and second of all they don't seem to
- 51:57line up 100 with what it sounded to me
- 52:00like what was going on during the course
- 52:02of the 9-1-1 call right because it
- 52:05sounds like darlie has the recollection
- 52:07that she may have
- 52:09woke Darren up as she's getting ready to
- 52:12call 9-1-1 but to back that up a little
- 52:15bit his statement does say that he comes
- 52:18in sees what's going on reacts to it and
- 52:20then the first he really sees Darley
- 52:22after that she's in the process of
- 52:25calling 9-1-1 or already on the phone
- 52:27with them now my general thoughts are
- 52:30this though in regards to darley's
- 52:33statement and Darren's statement
- 52:34I don't know that I would fully expect
- 52:37them to 100 line up I mean this is a if
- 52:40they're innocent it's too much trauma
- 52:43for their stories to line up this is a
- 52:46whole lot of chaos within a five to six
- 52:49minute window of time yeah chaos is
- 52:52probably a better word than trauma and
- 52:54for them to have a full understanding in
- 52:57a point by Point blow-by-blow
- 52:59recollection of what went down and how
- 53:01it went down and and every second and
- 53:03every minute of what was happening
- 53:07you know what to be honest with you I
- 53:08would be more suspicious of them
- 53:10together if their statements did 100
- 53:13line up yeah Bingo because there were
- 53:16two days between the time that the
- 53:18murders took place and these statements
- 53:20were given or a day and a half I don't
- 53:22know exactly what time of day these
- 53:25statements were were given at the police
- 53:26department but the murders were on the
- 53:28sixth the statements written by these
- 53:30two individuals individually on the
- 53:33eighth but the other thing I do want to
- 53:35point out too you know because one thing
- 53:37that law enforcement will use against
- 53:38Darley
- 53:40is that her statement does not line up
- 53:42with what they were seeing at the crime
- 53:44scene and the problem I have with that
- 53:47is look I agree first off I agree that
- 53:50her statements do not line up perfectly
- 53:51with with some of the physical evidence
- 53:53at the crime scene itself
- 53:56but her words they took me to the
- 53:59hospital they get me there they take off
- 54:01you know my jewelry my clothing they
- 54:03knock me out put me to sleep
- 54:06so they could put me into surgery right
- 54:08next thing I know I wake up she says
- 54:10minutes later anybody that's ever been
- 54:12knocked out for a surgery will tell you
- 54:14and I've had this happen twice in my
- 54:16lifetime I've been put under two maybe
- 54:19three times put under and then had a
- 54:21surgery
- 54:22and you swear to God that you're waking
- 54:25up and you're like I was I can't believe
- 54:27you guys worked so fast I was only out
- 54:29like 30 seconds and then somebody tells
- 54:32you like no you were out for a couple
- 54:34hours
- 54:35or you were out for a day that's one
- 54:38thing that I feel like Rings true in her
- 54:40statement there where she says they took
- 54:42off my clothes they took off my jewelry
- 54:43they put me out and then I went into
- 54:45surgery and then I woke up a couple
- 54:47minutes later
- 54:49or I woke up minutes later and the
- 54:51police are asking me questions and then
- 54:52they took me off to the police station
- 54:54and then we have later where we have uh
- 54:58people testifying that she was drugged
- 55:01up afterwards as one would expect
- 55:03because she's been pretty severely
- 55:06injured in my opinion but again that
- 55:09goes to
- 55:10the opinions vary depending on who you
- 55:12talk to regarding her injuries one and
- 55:16painkillers affect everybody completely
- 55:18different and so if I was in the
- 55:21hospital all for a couple days and the
- 55:24day I got out I was still on pain
- 55:26medication I wouldn't be I wouldn't be
- 55:29able to put together my correct thoughts
- 55:32I mean I already sound like a stoner and
- 55:34I'm not stoned I mean can you imagine if
- 55:37I'm all hopped up on pain pills and
- 55:39double down on the fact that you were
- 55:41just I mean just minutes or maybe hours
- 55:43before writing out the statement you
- 55:46were in a hospital bed right so here's
- 55:48what the the doctor testified to at the
- 55:51trial Dr Santos testified that Darley
- 55:54was given Xanax to treat anxiety and she
- 55:57was also given Demerol for the pain this
- 56:00is after the surgery so she's on Xanax
- 56:03and Demerol and just been whisked away
- 56:06from a hospital bed to the police
- 56:08station to give a written statement to
- 56:10police that oh by the way whatever you
- 56:13write here today we're going to hold
- 56:15this over your head for the rest of your
- 56:16life
- 56:17so it's an important document
- 56:19we're going to use this to either clear
- 56:22you or build a case against you I want
- 56:24to think that Darley or her husband was
- 56:27thinking that they're going to take
- 56:28these statements and and go over them
- 56:31with a fine-tooth comb to press charges
- 56:34against her
- 56:35I I bet that was even a thought at this
- 56:38moment right she doesn't know that
- 56:41they're building a case against her that
- 56:43they already suspect her at this point
- 56:45so you say this is two days after the
- 56:48murder to me that's not enough time to
- 56:51collect all the evidence at the scene
- 56:53get it tested for us to know whether or
- 56:56not there was an intruder or not
- 56:59so it seems like to me like a similar
- 57:02same year case two JonBenet Ramsey
- 57:06you're you're coming up with
- 57:09theories and then you're going to try to
- 57:11prove your theory before the evidence
- 57:13can tell you
- 57:15what happened well and you can't really
- 57:20make Darley give you a written statement
- 57:22any earlier than this because she's at
- 57:25the hospital she's under doctor's care
- 57:26she's knocked out she's in surgery
- 57:29but what's a little weird to me is
- 57:31wouldn't you want to get a written
- 57:33statement from Darren as quick as
- 57:35possible
- 57:36why does he get away this same amount of
- 57:40time he's not in surgery he's not been
- 57:42injured at all
- 57:43in the course of this attack or whatever
- 57:45went down well unless they're afraid if
- 57:48they say hey we need a statement from
- 57:49you and he gives the statement and then
- 57:51he tells his wife well yeah
- 57:54I I give the police a statement and she
- 57:56goes well what did you tell them
- 57:58so maybe that's why they waited I can
- 58:01agree with that that would be that would
- 58:03be an idea there but but also if you
- 58:06don't believe her statements are you
- 58:08asking for a polygraph test well and
- 58:10again back to the drugs and and her
- 58:13state of mind or what it could have been
- 58:15at the time of writing the statement who
- 58:17knows but again they they are going to
- 58:19hold the statement against her in court
- 58:22and the the testimony by Dr Santos is
- 58:26testified that Darley was given Xanax to
- 58:29treat anxiety and Demerol for pain
- 58:32when asked under questioning
- 58:35says what all can Demerol make you
- 58:38groggy yes could general anesthetic in
- 58:42your experience lead to confusion yes
- 58:44can it lead to disorientation yes can it
- 58:47lead to short-term memory loss yes
- 58:50would you agree doctor that to be
- 58:52questioned sometime before eight in the
- 58:55morning
- 58:56let's say 605 hypothetically to be
- 58:59questioned about very serious events at
- 59:01605 one hour and five minutes after
- 59:04anesthesia being cut off would you be
- 59:08somewhat suspect as to the response you
- 59:10may receive from a patient
- 59:13answer you may get an unreliable
- 59:16response yes yeah again but coming up
- 59:21with the theory before you get all the
- 59:23evidence back is irresponsible then on
- 59:27top of that let's get statements from
- 59:30somebody that we know
- 59:32see you again
- 59:34here's my problem with it it's
- 59:36irresponsible to come up with the theory
- 59:38you know it's irresponsible to question
- 59:41her
- 59:42when she just got out of the hospital
- 59:45but I think I think that was part of
- 59:47their play
- 59:48hey
- 59:49she she might not say things correctly
- 59:52and that's going to work in our favor
- 59:54because now we already created the
- 59:56theory now we're just trying to put the
- 59:58puzzles puzzle pieces however we want to
- 1:00:01to fit that narrative well I I don't
- 1:00:04necessarily agree with the idea that
- 1:00:06they are waiting to get her statement
- 1:00:09and then building the case around her
- 1:00:11afterwards I know that it took some time
- 1:00:13to get that statement again she's in
- 1:00:15surgery you can't do anything about that
- 1:00:16but they're working the crime scene
- 1:00:18during this whole time before they're
- 1:00:21able to get her statement so they are
- 1:00:23aware of certain pieces of physical
- 1:00:25evidence before getting the statement
- 1:00:28from her so right but what I'm saying is
- 1:00:30not all the evidence is collected not
- 1:00:31all the evidence is tested evidence is
- 1:00:35supposed to lead you to a theory
- 1:00:37not to have a theory first so yes I I
- 1:00:40agree with you there's been some work at
- 1:00:43the crime scene that would give you some
- 1:00:45information but you you didn't wait to
- 1:00:49get all the information to get all the
- 1:00:51evidence to get everything tested back
- 1:00:53before you created your narrative before
- 1:00:56you created your story of what happened
- 1:01:00which of course is certainly possible
- 1:01:01but I don't know that we want to say
- 1:01:03that that's exactly what in fact went
- 1:01:05down because we don't know when police
- 1:01:07came up with the narrative that
- 1:01:10that Darley killed her her children or
- 1:01:13had a a 100 case built around her what
- 1:01:18you would know immediately going into
- 1:01:20the crime scene and what some of the
- 1:01:22evidence you would know before even
- 1:01:23having to test it
- 1:01:25is you're going to see that the murder
- 1:01:28weapon you have evidence to believe
- 1:01:31before any testing goes down the murder
- 1:01:35weapon came from inside the home
- 1:01:38so now that makes you a little more
- 1:01:41suspicious of people inside the home
- 1:01:42rather than people outside of the home
- 1:01:45there was also some indication that with
- 1:01:47the way that the screen was cut and the
- 1:01:49way that the screen appeared once police
- 1:01:52were on the scene that it only looked
- 1:01:55like somebody went in the screen but
- 1:01:58never came back out through the screen
- 1:02:01so they were a little testy about the
- 1:02:04whole idea of well this Intruder came in
- 1:02:07this way and then fled back out the same
- 1:02:09way he came in
- 1:02:11based off of what they were seeing at
- 1:02:13the crime scene
- 1:02:15they also didn't find anything missing
- 1:02:16they didn't find again you brought up a
- 1:02:20good point
- 1:02:21one really freaking troubling part of
- 1:02:24this whole case is motive right yeah
- 1:02:26what what would be the motive for Darley
- 1:02:29to kill her sons not kill her other son
- 1:02:32not kill her husband and turn the knife
- 1:02:35on herself what would be the motive for
- 1:02:37Darley to do it but also what would be
- 1:02:39the motive for an intruder to come in
- 1:02:41and kill these kids and attack her well
- 1:02:43she had an infant so you know I don't
- 1:02:46have a lot of understanding of you know
- 1:02:48part postpartum depression
- 1:02:51but some kind of mental illness could be
- 1:02:55the reason
- 1:02:57that's the only thing that I can see
- 1:02:59here I can't see any other motive but
- 1:03:02then also like you said I mean
- 1:03:04we can't say that
- 1:03:07we can't say that this Intruder came in
- 1:03:10there
- 1:03:11just to murder right
- 1:03:14the the Intruder could have came in for
- 1:03:17a multitude of reasons agreed you know
- 1:03:20to oh well here's this uh young mother
- 1:03:23that lives there and and I find her
- 1:03:25attractive so you know it's a sexual
- 1:03:28motivation there or that they're going
- 1:03:31to break into the house and and now that
- 1:03:33uh I'm in here
- 1:03:35I don't maybe they these people would
- 1:03:38recognize me so I have to kill anybody
- 1:03:41that that possibly could identify me
- 1:03:43because for all we know
- 1:03:45the kids woke up and saw this individual
- 1:03:48yeah so it's very tough I mean it the
- 1:03:51motive on either end
- 1:03:54um just doesn't make a lot of sense what
- 1:03:57do you think Captain about the whole
- 1:03:59thought of she's saying the purpose of
- 1:04:00me sleeping downstairs is so the baby
- 1:04:02doesn't wake me up
- 1:04:04but then
- 1:04:06you know the prosecution and detectives
- 1:04:08want to know well then why didn't you
- 1:04:09wake up
- 1:04:10earlier during the attack if you're such
- 1:04:13a light sleeper yeah I would I'd
- 1:04:16question
- 1:04:18when she was stabbed
- 1:04:20and is any of the wounds that she has
- 1:04:24would that cause her to black out at any
- 1:04:27point because
- 1:04:29this neck wound
- 1:04:31which a lot of people have tried to
- 1:04:33state that her neck wound is a flesh
- 1:04:36wound
- 1:04:37I think it was like two millimeters away
- 1:04:39from the Carotid artery two millimeters
- 1:04:41away from killing her correct that and
- 1:04:45that doesn't mean that she did not
- 1:04:47self-inflict the wound is it possible
- 1:04:51that she fought with this
- 1:04:54Intruder and because of
- 1:04:57whether it's being hit on the head
- 1:04:59whether it's being stabbed that she
- 1:05:01actually blacked out
- 1:05:03and then came back to there are experts
- 1:05:07that have said and did say during the
- 1:05:09course of her trial based off of her
- 1:05:11injuries that there there's a likelihood
- 1:05:15that she may not recall everything that
- 1:05:17actually went down one based off of the
- 1:05:21trauma of her injuries but also the idea
- 1:05:24that she's waking up into the middle of
- 1:05:26a situation
- 1:05:27so you kind of it's a double whammy
- 1:05:29effect there too and now I am a light
- 1:05:32sleeper I'm not going to consider myself
- 1:05:34to be any kind of sleep expert but I
- 1:05:37will say this
- 1:05:39my light sleeping is can be an issue for
- 1:05:42me there are nights that I I miss out on
- 1:05:44a lot of sleep because of that I'm not a
- 1:05:46light sleeper every night
- 1:05:48of my life right every day of my life if
- 1:05:52I if I'm sleeping anywhere other than my
- 1:05:54home I'm an extremely light sleeper I'm
- 1:05:58I just I'm heightened awareness whatever
- 1:05:59I don't know what it is I it's hard for
- 1:06:02me to sleep in hotel rooms or be a guest
- 1:06:04at somebody's home without you know I
- 1:06:06basically just sleep for a couple hours
- 1:06:07at Best
- 1:06:09if I'm at home and everything is perfect
- 1:06:11everything is right
- 1:06:13sometimes I sleep like a rock and
- 1:06:15there's not a whole lot of Rhyme or
- 1:06:17Reason to while I sleep better some
- 1:06:19nights and why I sleep
- 1:06:21not great other nights a lot of it base
- 1:06:24is based off of how tired I am one thing
- 1:06:27we know is she's busy taking care of
- 1:06:29three kids one of them's an infant she
- 1:06:31could have just been flat out exhausted
- 1:06:34at this point right and one thing that's
- 1:06:36interesting to me too and and you would
- 1:06:38reference narrative a couple of times
- 1:06:40there is certainly something going on
- 1:06:42because we talked about motive well the
- 1:06:45law enforcement and the the prosecution
- 1:06:48they are easy and quick to point out
- 1:06:50motive for Darley to have committed
- 1:06:53these murders and then their argument is
- 1:06:55well there's no motive for an intruder
- 1:06:57and I don't think that's correct I don't
- 1:06:59think that's right I can see just as
- 1:07:01much until you until you catch the guy
- 1:07:05again pretending that she's innocent
- 1:07:07until you catch the guy or identify who
- 1:07:10it could be
- 1:07:11you may not know the motive
- 1:07:13of that individual
- 1:07:15for their actions and I think there's
- 1:07:17equal amounts like you were saying equal
- 1:07:19amounts for both possibilities if Darley
- 1:07:22did it or if in fact there was an
- 1:07:24intruder an equal amount of motives well
- 1:07:27again I think
- 1:07:28it always drives me nuts when we're
- 1:07:30having conversations about a possible
- 1:07:32Intruder and they go well nothing was
- 1:07:34taken it's like well maybe they didn't
- 1:07:37get a chance to and that's why there was
- 1:07:39a murder
- 1:07:41and maybe the person is technically not
- 1:07:44a murderer there are they're a thief
- 1:07:48but because somebody could identify them
- 1:07:50they became a murderer one troubling
- 1:07:53thing to me though Captain is it would
- 1:07:55have taken a bladed weapon let's say it
- 1:07:58would have taken a blade to cut through
- 1:08:00that screen and police will quickly tell
- 1:08:03you that in this scenario it makes zero
- 1:08:06sense to them because most of the time
- 1:08:07burglars which I actually don't think
- 1:08:09that there was a burglar all right if if
- 1:08:12we're going to pretend there was an
- 1:08:13intruder I don't think I don't think
- 1:08:16looking for valuables was the the motive
- 1:08:19here for going into the home
- 1:08:21so police will be quick to point out
- 1:08:24that most of the time a burglar will not
- 1:08:26bother to cut a screen they will just
- 1:08:28simply remove the screen as it's
- 1:08:31normally fairly easy to do in this case
- 1:08:33it would have been easy to do and they
- 1:08:36just hop in the window and hop back out
- 1:08:37or leave through a door on their way out
- 1:08:41but if it would have been a burglar that
- 1:08:44see that's a whole different kind of
- 1:08:46criminal
- 1:08:48a burglar comes into a home sees people
- 1:08:50in there that they they want to
- 1:08:52burglarize the home when no one is there
- 1:08:55they pick a home that they think that
- 1:08:57they could either get in and get out
- 1:08:59real quick Smash and grab or Smash and
- 1:09:01grab and nobody's there they don't have
- 1:09:03to bother with anybody
- 1:09:04a burglar would have came into the home
- 1:09:07seen her and or the children and then
- 1:09:10just turned around and left
- 1:09:12that's what a burglar would have done
- 1:09:14if in fact it was an intruder that
- 1:09:17attacked this family there was a
- 1:09:19different motive for going into that
- 1:09:20house altogether
- 1:09:22but one thing I keep coming back to
- 1:09:24that's Troublesome for me and goes
- 1:09:26against darley's case that she's
- 1:09:28innocent is
- 1:09:30it would have taken a blade to cut
- 1:09:32through
- 1:09:33that screen
- 1:09:34that's everything that they've told us
- 1:09:36from the test that they conducted on
- 1:09:38that screen
- 1:09:40so why if I already have a blade on me
- 1:09:44to cut the screen to get into the house
- 1:09:45am I picking up a blade from inside the
- 1:09:49house to murder these people no I I
- 1:09:52agree and I would like to know how they
- 1:09:55know for sure that this knife came from
- 1:09:57inside the house was it a part of a set
- 1:10:00yeah it's part of a set it's one it
- 1:10:02would have been taken from a butcher
- 1:10:04block that was inside the home and to
- 1:10:07take it a step further because I have
- 1:10:08like random knives and so that's why I
- 1:10:10wondered is it is it possible that it's
- 1:10:13not from a set and they were they
- 1:10:16thought it was from like just a random
- 1:10:18knife from a drawer or something yes
- 1:10:20exactly a lot of people just have a
- 1:10:22drawer full of knives that they've you
- 1:10:24know collected somehow throughout the
- 1:10:26years you know gift or something they
- 1:10:28purchased themselves and it's a it's a
- 1:10:31hodgepodge of what you have maybe the
- 1:10:33colors don't match up maybe you have a
- 1:10:35lot of the same kind of Blade and you're
- 1:10:37missing other specifics but
- 1:10:39um this was taken from a butcher your
- 1:10:41block and it was to take it a step
- 1:10:44further though too
- 1:10:46I could find nowhere that Darren or
- 1:10:48Darley were disputing that the knife
- 1:10:50came from inside the home right they're
- 1:10:52not saying no it wasn't our knife in
- 1:10:54fact it seems to be agreed upon by all
- 1:10:56parties that the knife did in fact come
- 1:10:58from inside the home but if I'm breaking
- 1:11:01into a house hypothetically
- 1:11:03and I use a pocket knife or I use a box
- 1:11:08cutter
- 1:11:09and then I go into the house and I put
- 1:11:12that back into my pocket and then I'm
- 1:11:15startled by maybe a kid waking up or
- 1:11:17seeing people laying there
- 1:11:20you reach for the closest item right so
- 1:11:24and and based off that it makes sense
- 1:11:27because
- 1:11:27from the garage you have to go through
- 1:11:30the kitchen
- 1:11:31and then that kitchen area you would see
- 1:11:33then
- 1:11:34you'd see the people that were in the
- 1:11:37family room also I'd like to paint a
- 1:11:39picture of a sophisticated criminal for
- 1:11:41you
- 1:11:42sophisticated criminal would enter that
- 1:11:44home and again this would be for motives
- 1:11:46that are are well beyond
- 1:11:49this the scope of burglarizing the home
- 1:11:53I do not know the exact you know the
- 1:11:56windows and stuff for this house uh I've
- 1:11:59seen the outside of the house and
- 1:12:01portions of the inside but one question
- 1:12:03I keep coming back to is if there were
- 1:12:07someone outside of the home
- 1:12:10looking to
- 1:12:12break into a home
- 1:12:13and then rape
- 1:12:16a female victim inside right think about
- 1:12:19the way that they described everybody
- 1:12:21going to bed if if you're a rapist and
- 1:12:24you're outside looking in through the
- 1:12:26windows peeking in to see if you could
- 1:12:28you know if there's a potential victim
- 1:12:30inside
- 1:12:32maybe you don't know the house maybe you
- 1:12:34do not know the people inside or who the
- 1:12:37home belongs to
- 1:12:38but if you're looking inside the way
- 1:12:40that everybody describes the sleeping
- 1:12:42arrangements to me
- 1:12:44it's very likely that a rapist looking
- 1:12:46in the window would see Darley 26 years
- 1:12:49old lying on the couch
- 1:12:52and from that vantage point I have to
- 1:12:54wonder would he be able to see two small
- 1:12:58children lying on the floor
- 1:13:00right they're not laying all together
- 1:13:02next to each other
- 1:13:03the boys are on the floor she's in the
- 1:13:05couch
- 1:13:06husband upstairs you don't see him at
- 1:13:09all if you're peeking in the window and
- 1:13:11if you're a sophisticated criminal
- 1:13:13you're entering the home already with
- 1:13:15gloves on thy hands
- 1:13:18and you know what you don't want to
- 1:13:19leave at the scene is a weapon that you
- 1:13:21brought with yourself so use your box
- 1:13:23cutter or your pocket knife to cut the
- 1:13:26tea into the screen outside go in
- 1:13:31through the garage through the utility
- 1:13:33room into the kitchen knife block right
- 1:13:36there I'm going to use one of their
- 1:13:38knives to threaten my female victim
- 1:13:42whether my intention is to kill her or
- 1:13:45not I'm using one of their knives
- 1:13:47because if I leave it here it doesn't
- 1:13:50lead back to me they can't trace this
- 1:13:52knife back to me I have gloves on my
- 1:13:54hand
- 1:13:55yeah and have you ever tried to cut a
- 1:13:59screen
- 1:14:00the screen part of a window dozens of
- 1:14:03times yes but there's also there's also
- 1:14:06a possibility that there's not
- 1:14:09it wasn't there wasn't a cut at all
- 1:14:12you the way those things are made once
- 1:14:14you start like a rip
- 1:14:16in that screen it's going to stay in a
- 1:14:19straight line
- 1:14:20and then if I rip it to the other side
- 1:14:22or pull it back to the other side you
- 1:14:25could you could
- 1:14:27um depend you know as long as there's
- 1:14:29some kind of hole or some kind of damage
- 1:14:31to that screen you could easily rip a t
- 1:14:35into that that screen without using a
- 1:14:37knife exactly exactly and then you have
- 1:14:40to wonder would the crime scene analysis
- 1:14:42would they be able to determine by
- 1:14:45looking at it if it were in fact cut
- 1:14:47or torn yeah torn or or you use your
- 1:14:51your keys
- 1:14:53to to make those
- 1:14:55um the initial
- 1:14:57incision so you could rip
- 1:15:00the screen their stance has always been
- 1:15:03in regards to the screen that it was cut
- 1:15:05in a in the shape of a t so somebody
- 1:15:08would have made a horizontal cut and
- 1:15:11then in the center of that roughly in
- 1:15:13the center of that made a vertical cut
- 1:15:15down there's so many reasons that this
- 1:15:17case is so frustrating
- 1:15:19but one if if she is guilty what the
- 1:15:23heck is the motive because at least I
- 1:15:26can come up with a couple plausible
- 1:15:29motives that make sense if there's an
- 1:15:31intruder
- 1:15:34[Music]
